prosecutor investigate. remember a mother says a popular high school football player raymond her daughter, who was 14 years old. and it didn't end there. the mother alleges the boy dumps the girl on her own front porch where she passed out in the freezing cold. said to have happened last. year in maryville, missouri. the prosecutor said he dropped the charges because the mother and daughter stopped cooperating, but the mother said that's not exactly right. this has confused us for days. it's becoming clearer. the mother says the backlash against her family drove them out of town. she says she lost her job, her daughter tried to kill herself, and their house burned down. she says she suspects somebody set fire to it. and now we're getting the rest of the story from garrett teny, who sat down with the mother and daughter. there's more to this star. we could always feel it. and now you have it. lay it on us.

>> reporter: when i spoke to the family last night, they said they're feeling much more hopeful about the prospects in this case now. it's been two years since this happened and all they've been wanting to see is joyce be served. with this independent review they're hoping this will work its way to going to court. that will be determined by the special prosecutor what has been assigned, daisy, who is 16 now, says she is in a much better place in her life. she feels like she can better handle taking the stand to testify in this case, but she says what happened on that night, never very far a. from her. take a listen. >> i don't think i'll ever be the old me again. i almost feel like she's completely gone, and i feel like this case will always be part of me. >> reporter: she says the hardest part of the -- if it does go to court would be facing the men who say says sexually assaulted her on that night.

>> did the county prosecutor say why that office took so long to get to this point? >> reporter: almost been a year and a half since the charges were dropped. he says it wasn't until just the last couple of days that he heard from the family they were willing to actually take the stand in this trial if it did good to a trial. he said, previously they had told him they didn't want to take the stand and chose to invery if the fifth amendment. i asked her mother and she said it's only because of her persistence this case is getting an independence review. >> we tried all along and, i think that is part of the reason the prosecuting attorney and the sheriffs dislike me so intensely, because i was the pain in the butt mom that wouldn't let go of this. >> we're told that special prosecutor will be assigned probably the beginning of next week, but there's no timeline

how long the independent review will take and determine if those charges will be refiled in this case. shep? >> thanks, garrett, very much. let's take this to a lawyer, a criminal defense attorney who is live in studio this afternoon and has his own thoughts. nice to see you. >> you said you have done these cases all the time. >> at first blush there's no denying from the surface it appears to be some sort of coverup. when you look at the finer details, the telltale signs of this girl actually lying. she is leaving her home at 1:00 a.m. in the morning, and nobody forced her to drink. and what happened? she gets caught by her mom. she is embarrassed and the easy way out here is, mom, someone took advantage of me. what did she expect to happen at 1:00 a.m. in the morning after sneaking out? i'm not saying -- assuming these are accurate -- i'm not saying she deserved to be rape, but

node the facts, this is case is going nowhere quick. >> the prosecutor didn't take it anywhere. the prosecutor declined to prosecute. a lot of other events came together. and then the prosecutor said, if i'm getting all this pressure, i'll bring in a special prosecutor. >> exactly. he is saying i have nothing to hide. i've done by job thoroughly. she very victim invoked for fifth made right. >> a lawyer for barnett says barnett cooperated with the investigation and freely admit thread was indeed a sexual encounter. while many may find mr. barnett's behavior rep he residencible, the legal issue is whether a crime was committed. the prosecutor in not prosecuting, decided he did not belief a crime had been

committed. >> without a doubt. we all know there's no crime in the state of missouri of have can -- two minors having sex. the only issue is whether or not one is incapacitated. given the facts the way we know them, this is not a case that's being tried. right now it's being tried in the court of public opinion, but a court of law is different. the is, can you prove the case beyond a reasonable doubt. there are too many inconsistent statements. this case is doomed. >> a lawyer for barnett, quoting, this time the complaining witness did testify with numerous inconsistencies and changes to previous statements. when the alleged victim's mother was questioned about the changes she freely admitted her daughter does not always tell the truth. al of those are the facts and accusations in this case. what you have done, joseph, is taken an alleged victim of rape and turned her into a liar and a crime-committer. >> well -- >> that's a far jump from a

through. one guy works in the compliance office, social security administration, and he says that people are better off when they're on the job because they make sure the people are getting the benefits they should, and in the meantime, the are still uncertain how long they'll actually be on the job. here's what he told me earlier. >> it's very disorienting, very discouraging. a anyone mays crystallizes how a lot of federal workers are being treated like garbage, held as hostage for something we have no control over. so, it affects morale. it also affects obviously people's financial lives as well. >> reporter: and sean o'connell hasn't got an paycheck since september. his next check comes at the end of october and doesn't know if he will be paid.

and he has a house that was damaged in hurricane sandy. >> i listen to gretchen read a tweet saying the winners are the federal workers who got two weeks off without pay. they went two weeks without getting a check. how many americans are going check-to-check, it's not as if people are getting rich on the government's dime. >> a lot of these people are secretaries, their office workers who don't make a lot of money to begin with. they got kids at home. the mortgage company doesn't care if they haven't before paid. so it's a challenging time for them. >> you're among a lot of federal buildings. the fbi is right there, isn't it? >> the fbi has 1100 agents that work here in the new york office, as well as 2700 supportive workers. they were not furloughed, but they also were not getting paid. so they were coming to work but weren't getting a check, and

meantime i'm told the budget has been tight so a lot of work wasn't getting done, and i spoke to other law enforcement agencies who said they had a hiring freeze no overtime, and they were also still having to do their jobs without get can paid, and couldn't take time off. so it's been challenging for them as well. a lot of investigations have suffered. but they're here and they now hope to get paid soon, and pick up where the left off. >> let's hope so. nice to see you. i mentioned off the top about a school bus hijacks. cops say an armed man jumped aboard a bus with some skid took the children for a frightening ride. a live report. this is shepard smith reporting from the fox news deck in new york. glad you're in today.

i mentioned school bus hijacking in arkansas. cops, local police, arrested an armed man who did indeed hijack a school bus full of kids, according to place. happened right here in jacksonville, arkansas, which is just a little bit north and east of little rock. a witness recorded video of the chase. police say the guy boarded the bus with a knife when it stopped to pick up elementary school students. the cops say there were 11 kids on the bus when the suspect got behind the wheel and drove off. cops chased the guy into the next town and eeventually did

surrender no kids got hurt, but the suspect does face charges, including kidnapping. -phile -- phil quiet cateing has more. >> reporter: police in arkansas believe the school-busjacking came as a crime of opportunity. wrong place, wrong time. 7 al-this morning, 22-year-old nicholas miller, with a knife in hand, tried to steal a car from a pedestrian. that person had no car. then the school bus pulls up on its norm recall route, comes to an to, police say miller barged into to the bus, wielding the knife, forcing the school bus driver in the back with the 11 elementary school kids and then took them on a terrifying one-hour ride, going north from jacksonville with 12 police cars, with lights and sirens blaring, trailing it, further frightening the children, until miller finally pulled over. >> the bus driver must have been beside himself.

>> reporter: the bus driver -- a 51-year-old woman and she is being considered the hero in this story bit the school district. the woman has been driving kids on school buses there for 20 years, and as timing would have it, just this past february she underwent hijack training, which the school district provides for all drivers, and a spokeswoman there says she did everything right. she remained calm, kept dialogue going with the hijacker, this 22-year-old nicholas miller, and also most importantly, kept all of those school kids safe. one ten-year-old described it to a local report as very scary. >> your suspect there nicholas miller, is not new to trouble. >> reporter: including today's indent he has now been arrested and chargees four times this year alone, and his wife describes him as a meth head. in may he was charged with breaking breaking and enter an automobile, stilling a shot gust

and a wallet in september, police arrested him for's of drug paraphernalia when they syringe with residue, and then employs charged if with threatening the mother of his child she showed up at his important to get money for pooed and diapers and he appeared high on meth, and he said -- he grabbed her by the neck and threatened her with killing. so 12 charges of kidnapping and one charge of aggravated assault. i mentioned oj simpson at the beginning of this newscast. oj simpson. what do you think he wants to do when he gets out of prison? he has a new plan. it involves jesus, be healed.

football star's manager. o.j. is currently in prison for his 2007 holdup two of two me. -- memorabilia in may. official says he has to serve at least four more years. back in '95 is when the bunch of people found him not guilty of murdering his ex-wife, nicole, and her friend, ron goldman, despite a trail of blood and the most physical evidence i've ever seen in a case in all my born days. now o.j.'s manager says o.j. is obsessed with religion, and he wants to take his passion to the small screen. trace, he wants people to give them their gold. the gold they've been buying and the silver now. give it to o.j. so they can be held. >> don't believe oj just found god in prison. his manager says oj has been religious for a very long time and has helped very many people

find god but o.j. never publicized it because he thinks the public would rather see him as a bad guy. but in 2000 his and hi cruise worked on a religious show called holy safari and set up interviews, hired a production team. the problem is before the shot got underway, o.j. got tossed in the clink. but the manager says, o.j. has, in fact, found more than just one god in prison. now he is ready to save the world. >> the first thing i think he would want to do is sort of get his life back in order. he is going to want to get in better shape. but i think he has learned a lot more in there. he has read the bible, the koran, pretty much every religious book made. so i think he would be more knowledgeable, and hopefully he'll be on board. >> reporter: once he gets back in shape. you know o.j. picked up a few

pounds in the big house. >> i wonder if he has talked to any of the gods in the of the books about the trail of blood from rockingham to bundy. you can ask for forgiveness. >> reporter: everybody said god will know where the trail of blood came from. o.j. says he is not in this for the money. he has the $50,000 pension from the nfl and if oj made any money of this new career he would just donate that money to an orphanage in uganda. his manager says he is in this for the people north the money. >> we should let him right -- out right now. report that appeal he was in, we're still waiting for judge to rule. the court said the judge still considering it but has about 202 different claims that go along with that case she is investigating, so it could be a while.

the manager told us a short time ago that oj is hopeful. lisp. >> he is being very cautiously optimistic he is going to get out. but he believes, the lord will take care of me. that's what his entire family tells me. the lord will take care of him. expects what o.j. says. >> coincidental a lot of people believe they -- believe god a little something for o.j. >> it's coming. covered that case, trace. jo noh doubt. >> you were oj by the say and o.j. downtown. iryou're fed up with the antics in washington, join the club. but this whole thing is not over in fact in a few months we may be doing this all over again. would you, could you, should you do it all over again?

the way washington does business has to change. those are the word from the president today. but it could have happened from just about anyone in the country. the president says now that the budget crisis is on hold congress has to get back to work. the president spoked aboutth hoe federal shutdown and he blamed the standoff on extreme elements of congress. the dead lock hurt the economy more than anything necessary the last three years. and most americans blame the republicans for the shutdown, 46 to 37%. analysts say president obama appears to be cashing in on that political capital, and trying to push a second-term agenda. today he called for congress to focus on passing a budget, immigration reform, and taking

interesting is the broad theme from the president was to change the tone perhaps here in washington and turn the page on what was a brutal budget battle. republicans taking it on the chin, and presidents acknowledging democrats took a hit and there needs to be an effort by both sides to regain the trust of the american people. what you heard from senator marco rubio there was, in terms of kind of lowering the temperature on the rhetoric, there were white house officials in recent days charging the republicans were hostage takers and terrorists with bombs strapped to themselves because of how the debate was playing out. so to change the tone the white house has to be part of that, and the president -- why does he have show much optimism? his aides say this was such a bruising battle, the american people are so angry, that maybe now both sides will come together. here's the president. >> you don't like a particular policy? or a particular president?

then argue for your position. go out there and inan election. push the changes. but don't break it. don't break what our predecessors spent over two centuries billing. >> now, on the point, though, go ahead and win an election, what house republicans say is that many of them won their re-elections last year as well. that's why republicans are still in charge of at least one chamber. the president's pushback was he won the national election and believes that in recent moves he had a mandate, and the bottom line is that both sides hear to figure out a way. we have a divided government at least through the end of 2014. the dynamic is split and both sides have to work together. >> they do still control the house of representatives no question, and yet they ask for 14, 15, 16 different things during the budget showdown,

ended up with none of them, and a divided caucus. what is their plan now, especially regarding health care? >> divided, true. look, jay carney was pressed on wasn't the president scolding the republicans and jay carney said if it was a scolding, it was nothing compared to the scolding republicans have turn on themselves. you hear john mccain and other senators saying is in was a failed strategy. what the supporters of the strategy are saying, mike lee, ted cruz, they're basically say they got the nation's attention, they've been building support among conservatives to turn around the healthcare law and they're not going to give up now. >> this is a fight that's going to continue. when a publication like the chicago tribune, the president's home town newspaper, has come out and said that, like us, they believe that we should have a one-year time-out on obamacare. you know something is wrong.

>> the problem with the push is that the president is not going to fund the law. where they may finally find some compromise, the president is probably willing to delay a year or two the medical device tax within the health care, but major overhaul, he's not giving in on. >> the rollout of the mechanism for signing up for obamacare, but all conditions -- even the president's own former press secretary says it was disastrous and people should have been fired. but that was drowned out by the noise of the shutdown, and republicans are saying, man, i wish we were focusing on this instead of that. >> there are republicans saying that. one republican senator last week said, i understand the

filibuster by ted cruz. this person says he still wants to overhaul the healthcare law but look at all these glitches, day after day, newspapers around the country, and this senator, republican, told me, if the party was focusing on that, the president would be much more on defense than he is now, shep. >> ed henry, live, good to see you. americans spend $300 billion on medication every year. $300 billion, according to major healthcare institute. and according to the mayo clinic. seven of every ten americans are on prescription drugs. more than half are on at least two different medications and that's the legal ones. medical reach sears say there are times it makes sense not to take your medicine. they say eating healthy and exercising more can help treat and prevent diseases like diabetes and some cancers. doctors warn the pill-free route is not for everybody.

little anything can be done about it. police say all the thief needs is one of these little things. a small device that sells nor. the picture here comes from cops in south florida, who say they found several of these devices on cash registers at a nordstrom department store, the police said the devices tracked all of the credit card numbers scanned at the cash register. in this case police took the devices before the crooks could get back to claim them, but experts say these things could easily go undetected. they look like any other piece of harmless commuter hardware, customers, even store workers, might not give them second glance. what can we do to make ourselves safe center here is alex little, former assistant u.s. attorney who went after many cybercriminals. alex, good to see you. >> they ha have these at best buy for 40 bucks. this wasn't the only idea behind the products but the thieves figure it out. what are they, how does it work

we are following breaking news that's coming out of san francisco. actually sky fox just a second ago was showing us a picture of the chopper and they turned the camera around. this is union square in san francisco where we're told there is a suspicious device. union square is a very upscale section of san francisco where all the high-end shops and businesses are. they've now shut down all businesses that face union square.

union square has been completely and totally evacuated. people who work inside those businesses are being told to, quote, shelter in place, unquote. and they're very concerned about a suspicious device. here's a map of the area from our google machine. where are we? >> this is market street and powell street, a busy part of the city. we just got these reports, report suspicious packaging, and you can see here all the buildings around here. they're really large buildings. the busy part of the city. there's a report of a suspicious package right here on market street and powell street. they evacuated all of union square, and we're getting a lot of information on this and trying to determine exactly what is going down right now. >> new info. do you have anything more? the chopper has just gotton to the area. they're trying to get us aerials of this. it happened such a short time

ago they haven't been able to make it there. this is union square over which they're flying now and looking for this specific area where this is going down. this is more than a bomb scare. we don't report on bomb scares. this has changed the landscape in town for the afternoon. it's what is approaching 1:00 in the afternoon, lunch hour in san francisco, and this entire area of town has been shut down because of one suspicious device. it's our understanding they would not have done this had they been able to just handle it with one of those robot or just get personnel in to find out what happened to evacuate this entire area we're told by our bureau is a matter of great significance. our fox station there, their chopper is just getting into place and this is the scene on market street, where originally we were told that everyone was asked to shelter in place inside

the buildings, and everybody out in the square was told to get out. the police presence, we're told, is pretty large. all i see is one police car. but this is on the perimeter of the area. and you don't see a lot of foot traffic. i'm led to believe this is just around the corner. now we see that's chopper made it to the scene, the area which is blocked off. these are all emergency personnel on the street down below, and with the tall buildings, it's tough for the chopper to get an exact view. we were watching yesterday in new york as there was a police incident on the east side of manhattan, and getting choppers in position to show what is happening on the ground without getting the build indigents the way is a difficult task -- buildings in the way is a difficult task in any landscape, especially this one. bat 3, i'm told -- we have a street view. what are you seeing? >> the corner of market and powell street. union square is just north of
