the government may be back open for business, but responsible leadership, that remains shut out of washington, d.c. the spiral of decency, that left a long time ago. it's never been more apparent under one man's watch, and i say it's president obama. his arrogance fueled this shutdown. the president's inability to lead got us to this point, his radical idealogy, his cohorts, they need to be exposed for who and what they stand for. even though the old majority republican senators were too afraid to stand up, they sabotaged the guys in the house. we own this program, we'll stand up. we're not afraid. we've witnessed the recent days in the media, they're upset. they want to pick political winners and political losers. indeed, there were losers as a result of the shutdown, but it wasn't the tea party. it was you, the american people. you have now become victims of obama care, and while the house of representatives tried to

stand up for what was right, they were bulldozed and sent out in the cold by lawmakers who have spent far too much time in the beltway. here's one example of arizona senator john mccain violating the 11th commandment. watch this. >> i was standing there watching senator cruz as you were. he says he's standing there with the american people. the american people disapprove of republicans now by 74%. to tell american people that you can defund obama care was a fool's errand and a desepgs of the -- deception of the american people, and i resent that. after '95, we waited 20 years before we tried this experiment again. i hope it will be another 15 to 20 years before we try it again. >> what the senator failed to realize was the reason president cruz did what they did and the republicans did what they did was because you, the americans,

were sold a bill of goods what it came to obama care. nothing he promised is even close to what the reality is today. here is a small sampling of what it was you, the taxpayers, were promised. >> under the reform we're proposing, if you like your doctor, you can keep your doctor. if you like your health care plan, you can keep your health care plan. and if you do have health insurance, we'll help make sure that your insurance is more affordable and more secure. if you like your health care plan, you can keep your health care plan. this is not some government takeover. if you like your doctor, you can keep seeing your doctor. cost-cutting measures mirror most of the proposals in the current senate bill which reduces most people's premiums and brings down our deficit by up to $1 trillion over the next decade. >> you know what the problem is? none of that is even close to true. premiums are skyrocketing. employers are being forced to slash their employees' hours, and worse, every day there is

another tragic example of how this disastrous law is tearing apart american families, which is exactly why our president is now openly advocating for the s sensor ship of conservatism both on the air and on line. look at this. >> now that the conservatives are removed, all of us need to stop focusing on the bloggers and the talking heads on radio and the activists who prosper on conflict and concentrate on what the americans sent us here to do. and that's grow this economy, create good jobs, strengthen the middle class, educate our kids, lay the foundation for broad-based prosperity and get our fiscal house in order for the long haul. >> five years no growth, and by wait, this president lives on conflict himself. now, it's pretty revealing when the commander in chief tells you to stop listening to people like me simply for telling the truth. you don't have to take my word for it. i'm not making up facts or

twisting any numbers. for example, the heritage foundation, they crunched all the numbers and they calculated how much premiums are going to rise state-by-state under the new obama care exchanges. starting right now, you're going to see these dramatic hikes right there at the bottom of your screen for you, the american people, for example, ages 27 and 50. now, my next two guests are business owners who are being forced to rethink their hiring strategies, reduce their employees' hours all because of obama care. but the worst part about all of this is they both personally warn these lawmakers about the consequences earlier this month when they both testified on capitol hill, and yet our selfish lawmakers, that wasn't a part of this debate this last week and a half, two weeks, their pleas for help. well, when they voted last night, they were ignored. joining me now are the vice president of paul's supermarkets, steve herman and hauling junk owner.

steve herman, let me start with you. i found your story pretty interesting because both your grandfather and your father were in the supermarket business? >> correct, yes. yeah. and my grandfather started it in 1968. >> that's a pretty cool story. now, independent grocers account for, what, 25% of the entire supermarket industry right now? >> you are exactly right. >> and how many people work directly, how many people's jobs are we talking about in that industry, in that 25% of the sector? >> we account for 944,000 jobs, and that's, i think, $9 billion in wages. it's a staggering number. $30 million in wages, excuse me. i believe i'm off by that number. it's a big deal. >> talk about -- because this is real life scenario. we just played what the president promised. if you want your plan, you can keep your plan. the average family is going to

save $2500 a year. what is the reality you tried to warn congress about about the law? >> well, there is a couple things, and the way i look at it is i'm a simple guy, simple business guy here in the midwest, and i got to look at small parts of it that affect me huge. they have a new requirement of 30, and i didn't know what the full requirements were, but there is a cost increase of 10% just by employees that have to go on the health care. we're a family business. we take care of our employees, and we're going to do our best. the problem is looking toward the future in our hiring practices. also they have a 50 full-time employee equivalent, so if you have a 50 full-time employee equivale equivalent, which is a complicated calculation, you have to offer insurance also. as i talk to people in the community that are right at that threshold, they say, i may have to close my business down, so if they close their business down,

i have less people shopping in my grocery store. it's just a cyclic effect and it goes across the board. that's what we went on was the 30 full-time, and i think that's common sense. >> i've worked in the restaurant business for a lot of years. when i was a kid, i was a dishwasher at 12, cook, buser, waiter, i did it all. there are razor thin margins. you don't have a lot of room for play in there. am i pretty accurate about that? it's so competitive? >> you're very accurate on that. we have a 1.6 profit margin. our health care counts for two-thirds of all that. you look at a 1% cost in health care going out the door right there, and we've offered that. we didn't need the government to tell us how to take care of our employees, we already do take care of our employees. >> bottom line, you didn't have to reduce employees' hours? are you going to have to let some people go? >> well, the thing is, like i say, we're a family business, so we're going to take care of

people that have been with us and worked hard for us. i think you take care of people that take care of you. the issue is looking forward into the future. how are we going to handle it right now taking care of employees that have been with us? talk about charities. we have a title i district which means a 50% reduced lunch and we have a buddy pack program. the buddy pack program used to be funded by the government, which was a great thing, it gave students food on the weekends. it's not there anymore. they're just going to continue to hurt people. there are economists and people up on the hill that model these things. they don't come down to where the real things happen. >> steve bianco, i get a kick out of this. hauling kids' junk mover owner? how many years? >> three years. we're a new start-up. >> how many people work for you? >> 72 people overall. >> you went to congress. you said it's a serious threat, obama care, to your company. >> as a former cadet to the

united states academy and state trooper, i truly believe in the american dream. i believe in the prosperity and the opportunity that's presented to us, and our obligation as citizens to help people establish that. i'm now trying to do that as a business owner, as an entrepreneur. i was only open three years and having a mandate placed on us during our biggest growth period, this is when we are trying to hire the most people, have them help us and grow, and most importantly, bring them on culturally into our culture, it's destroying that. it presents that failing opportunity where we can surely provide a culture for them. >> are you going to have to hire people as independent contractors? what are you going to have to do? >> not so much independent contractors, but definitely a reduction in hours. >> you have to get them below 30. >> we're going to have to. in order for us to grow properly, we're not going to be able to afford it. we need every inch we can possibly get in our profit

margins in order to help us continue to grow. we're going to have to reduce those individuals who come to us for 30 to 48 hours. >> you want to give them more hours. >> we want to. that's what helps us grow, that's what helps america grow. >> i couldn't work for you. >> you could. >> i have gray hair and i'm old and fat. >> somebody would think you're a hunk. >> if you have an independent contractor it still goes through the calculations, so it doesn't help you out. they have so many calculations in there. >> can't even get out of that. >> yeah, it's a mess. >> this is why the house republicans fought for you guys. this is why cruz got up there for 21 hours and 19 minutes. we've got a lot more coming up right here tonight on "hannity." >> i hope they're working day and night to get it done, and when they get it fixed, i hope

this is excruciatingly embarrassing for the department of health and human services. this was bungled badly.

this was not just too many people came to the website, this was a website architectural problem. i hope they workday and night to get it done, and when they get it fixed, i hope they fire whoever was in charge of getting it fixed. these are glitches that go, quite frankly, way beyond the pa pale of what should be expected. >> there you have it. even former press secretary robert gibbs cannot defend his old boss's master plan. while obama care may live, will anything come to an end because of the disastrous rollout of the law? we're learning that the 9 million people who tried to visit the site, only 1% of the visitors actually enrolled in the exchanges during week one. as pathetic as this is, my guess is secretary sebelius and her bureaucratic millions will be just fine, especially if our arrogant leader has anything to do with it.

by the way, on the bottom of our screen, you'll see just how much your premiums are rising state-by-state as you look at the obama care exchanges and the cost to you. here with reaction, democratic strategist steve mcmann. dana lash is back with us. steve, pick any company, apple, any company. they spent $364 million, have three years to put together a rollout, and it's to quote robert, excruciatingly bungled badly. wouldn't you fire somebody? isn't that what you would do? >> somebody should be held accountable, absolutely. you spend three years planning it, someone does it. i don't think kathleen sebelius was in charge of the architecture. i think it was a democrat bureaucrat somewhere, and they should be held accountable. the accountability should

perhaps go up to who manages those people. perhaps she is responsible. i'm not here to judge, all i can say is this rollout did not go as planned and someone should be held accountable. >> only the government could screw it up this bad. you can't even make this up, it's so awful. >> and it gets even worse. not only was this -- this was outsourced to a canadian i.t. firm. you could have had a united states firm just kind of do it half effort and come out with the same results. now what the weekly standard reported was that they discovered the code was actually just open source code, and now there could be a suit filed against hhs because they stripped out the copyright from this code. you're supposed to give courtesy when you use open source software like that. they stripped out the copyright, that's the exchange for it, so now hhs will be in trouble. if there is a lawsuit against health and human services, shawn, who is going to foot the bill for that? taxpayers? who is going to foot the bill to fix all the glitches? >> who is footing the bill for

the $24 billion of the shutdown that cost the gdp? >> that's a nice goalpost move, but no. >> at the bottom of the screen, we have the premium percentage increase in cost. the president, 45 out of 50 states going up as high as 250%. the sticker shock is staggering for americans. tell me why, now that it is so different than the $2500 savings that the president promised, why shouldn't we put this off a year and see if america really wants it and really debate it now that the facts are so different than the way he sold it? >> look, if the republicans want to litigate -- relitigate again obama care, the democrats are actually saying bring it on. you lost nine points -- >> steve, i'm asking, look at these increases. oklahoma. if you're 27 years old, 50% increase in your premium. >> shawn, i went on the other day and i actually did this for myself. the premium for a 27-year-old, who i was sitting next to as i

did this, was $250 a month. it's a high deductible, but it gets people in. >> if you're young, you're going to pay a little bit more. but if you're older and you have a preexisting condition, you're going to be able to get insurance. if you're a woman, you're not going to be able to be discriminated against. if you're a kid under 26, you can stay on our parents' policy. >> steve, you give me all the talking points i gave you. >> those are the facts. >> the facts are on the bottom of the screen. 45 out of 50 states, enrollees 27 years old and 50 years old, they're paying dramatically more and they're not saving anything that the president promised. none of them are. >> exactly. it's a one size fit all. regardless of what your health insurance needs are, you're going to get this and you're going to like it. the biggest thing for me is that the mill enials are going to ge

screwed out of this. they need them to make this program solvent. it's the biggest bait and switch i've ever seen aside from social security that obama care is carrying out here over the younger generation. and in st. louis, sean, in my city alone, because of obama care, we have a ton of people who have blue cross/blue shield in st. louis. the hospital, b jc, a big health system here, all the best hospitals, the cancer center, they're not now able to go to those hospitals because they're not in the obama care exchanges. so people who are getting cancer treatment in the city of st. louis, they don't have access to a cancer center. it is absolutely true. this is the city in which i live. >> one of the first -- >> it's absolutely true. it's not in the exchange. >> have you been to the website? one of the first questions is, do you want to keep -- >> i heard a spokesman who had a press conference and stated it. >> you have a computer. you can go on, right?

are in need of structural reform. i think olympia snow has put forth an idea which really makes a lot of sense, that they should work two weeks on and one week off instead of having six weeks off for recesses and not really getting anything done on a current three-day week. >> i think the senate terms need to be shorter. they are too complacent for six years. >> but none of that is going to happen. >> i think if you're going isto bet get rid of structural reform, you need to go back to the people who construct it. >> who blames congress more? who blames the president more? is there anyone here who voted for mitt romney but you blame congress more? tell me why. >> because the easiest way to let obama care go away is to let it work because it's completely
