11:47 am
it goes nowhere. there's no winning strategy. we have to cut him off. >> i mean, he did another interview. and, you know, he said i might do this again. >> well, he can't do it unless 20 or 25 republicans in the house go along with him. they can't do that. i spoke out against this from the start. john boehner is going to have to make it clear to these 20, 25 house republicans who want cruz to be his leader that they can't bring the entire house of republican along with them. you can't have 20, 25 people determining the policy of the house of representatives. >> i don't want to characterize what he said. let me just correct that. for the better part of three weeks, the shutdown and the debt ceiling consume media coverage. it really sucked the air out of another big story. maybe a bigger story. the disastrous launch of the

can say to the judge who may determine her faith. look, i came from an abusive home. all you have to do is look at this videotape. the judge may may be lenient on her? >> i have seen this happen over and off again with juvenile cases. the judge is will say, you know what, you will have to pay the consequences for your actions. in addition to your sentence, you also have to have individual or group therapy so she doesn't do these things again. no leniency, but therapy. >> the mother in her case of beating up these kids allegedly says, oh, just trying to break up a fight. however, in another instance she said oh i was having a bad day. the video is pretty solid proof? >> a video speaks a thousand words, but it is how we interpret a video. certainly the mom has every right to put in a defense. her defense is she was trying to break up a fight. it will be the fact finders to
12:32 pm
figure out what she was trying to do. >> i want to go back to the two girls who are charged with stalking. bullying is a presented cet to the stalking charge under florida law. they are filed, these cases in juvenile law. i looked over a couple things that are poarnt. important. there is no limit to prosecuting a child as an adult in adult court. that decision is not made by a judge in florida, but by prosecutors given the heinous nature of their alleged acts which lead to the suicide of the poor girl. should they be tried as adults? >> i think they should. the reason being for society purposes look how many cases we are seeing where these teenagers are committing suicide because of cyberbullying. there needs to be some type of more serious consequence so that it stops. they just figure, okay, like there is that rutgers case where the kid killed himself. it it needs to stop. i am outraged by these poor children killing themselves over being bullied. >> they are 12 and 13 years
12:33 pm
old for goodness sakes. the messages by one of the girls charged was she told the poor sedwick girl, everyone hates you. you are ugly. you should drink bleach and kill yourself. that's one of the many messages. shouldn't she be tried as an adult? >> no. >> come on. >> have i a few problems with that. they are are children and they should be tried as children. >> they are behaving like terrible adults. >> where is the school in all of this? when is the school going to take ownership of cyberbullying in our society. >> the school has no authority to monitor all of these things. >> when are the parents going to teachers and their children proper behavior? >> they are connected because of the school and the school always has a policy oh if it is not in our four walls of the building we have no control over it. that is complete rub bish. >> i believe it all starts at home -- starts at home. are you a parent and it is your job to teachers and the children the right thing to do. the school has the children eight hours a day. they are there to teachers and
12:34 pm
them, but this started in the home. >> the home is broken so now what do we do? >> so it is the job of teachers to be parents now? >> it is the job of the school to not allow these kids to engage in cyberbullying. what happens over and over again -- >> you would have to hire a thousand teachers in addition to those there -- >> everybody knows about the cyberbullying. >> i think the parents need to be charged because obviously the victim's parents said something about it. she had to take her daughter out of school and home school her. >> what do you charge the pairns with in bullying? >> i would say they aided and abetted. they allowed their child to keep doing it. >> it is too disconnected. there is even a disconnection between the bullying and the suicide. it is a tragic situation. >> how can you say that a? >> it takes a village. it takes a village -- >> are you kidding me? >> no. >> are you suggesting that the bullying didn't lead to the suicide? >> it is around endless cycle and until the schools take ownership to what happened it will continue to happen no
12:35 pm
heart how long you put them in jail for. >> it is not just the school. it is the judicial system. they need to be harsher on people who -- >> i have another question. last saturday night apparently according to the sheriff one of the girls i believe the 14-year-old sent yet another message posting this message on-line that said "yes, i bullied sedwick. yes she killed herself and i don't give a belong -- a blank about it. the sheriff said that was enough to get them to arrest them. on that basis shouldn't she be tried as an adult? jay yes, it shows how heinous and the mind set to have no remorse and no care that a this girl killed herself. to use that kind of language. >> and david that girl now when confronted with that message told the sheriff's department oh i didn't write that. somebody must have hacked my account and written it.
12:36 pm
the father is backing her up saying she has an alibi and that he had her computer at the time. if they are lying to police, and that could be provable with an i.t. expert, couldn't they be charged with obstruction? >> absolutely. they could be charged with anything you want to charming them with. these are disturbed human beings. we know that. they are disyou are ited people. what do we do with the saw say tee? there is one case with a suicide. how about the thousands and millions of other cases going on this second as we speak of cyberbullying that no one is doing. we wait for the one suicide to discuss this. jay this case can set precedence so it doesn't keep happening. way can't take back the past, but we can put an end to this. >> by doing this story and we have been doing it all week, we are at least getting the word out that we can't stand for this anymore. something has to be done. if you do this you will be prosecuted. >> good to see you both.
12:37 pm
>> very, very, very interesting. listen to this. a group of boy scout leaders could face charges after toppling this rock formation in utah. the men leading the scouts on a trip through goblin valley state park, they noticed the top of the rock formation was loose and what did they do? they pushed it over. they say they believed they saved lives. >> you know you are under investigation, right? >> we thought we were doing a good deed. >> that wasn't going to last. i looked at the main walkway and thought one gust of wind and the family is dead. >> he had to brace himself. he had to get in position. that's more than a gust of wind. >> you know what, that earth wears away when there is a rain storm. >> i am not aware of any rolling off. they have been sitting there for millions of years. >> not just millions.

170 million years. their story seems a little suspicious when you say it. >> a little bit. >> if you thought it would be endangering someone you call park authorities. >> you don't take it into your own hands.xd >> you could hurt someone else. >> that's right. call authorities. so much for a rousing start. the website for obamacare is running into some well documented glitches, maybe more than that. isn't there a better way to go about this? we will look at some of the other options out there still ahead. ñiñi

million americans who are without health care. if in fact this is delayed for a year it could be without it for another year. let's talk about this. is there an alternative? we heard of cobra, but that is too expensive. is there something else out there for these folks? >> for them it will be very tough. when ever a business, and i use government as the word business, gets in trouble or screws up and does something wrong, other businesses come in and they try to come up with things and i try to suspect the insurance companies are now salivating a little bit and maybe they come up with a decent premium for these people and go at it. let's hope it doesn't last the year. all heck will break loose if ] jay this will be a good time to note one of the major vehicles in the affordable care act increases health insurance coverage is an expansion below the federal

poverty level. and of course they expand medicaid. 22 states decided not to expand medicaid. for the folks not there and can take advantage of that the established insurance companies may talk about the aca experiences. >> you know, look, it is not going to be free to these folks. you think it is possible that some of the insurance companies would maybe offer some sort of lower premium? >> the fact is you are right. it is snot going to be free. they will pay. the insurance companies will step back and see who these people are whether they are young or old or in between. if they are elderly premiums will be higher. if they are younger premiums will be lower. at least that's the way it is supposed to be. the big issue is nobody knows where this will end up. i am getting to work and
12:46 pm
getting our act together and getting somebody in there to fix this up right now. a lot of people will be held with nothing. you have a lot of people that have lost off of companies who changed their status there. those people are going to be looking to go on the web also. a lot of people are twid lig their thumbs right now. >> and those people you were talk about the existing insurance companies taking advantage of those twid lig their thumbs as you say. >> how would you go about getting the word out? >> big full page ads in usa today. wall street journal and you name. it. >> if you are unable to h, but have i a sneaking suspicion that the obama administration will be talking to the insurance companies saying, listen, we will be up here. have some patience and wait on this. i don't know if they will be patient because business is

business. >> from that perspective, how much of a loss would this cost the administration and how would you advise the administration to get out from under the troubling issues that started the new operation. >> this is nothing. this is on taxpayers and it looks like it will be a lot more going forward. they will have to change the whole website and politically it is a hit. if they get it right the second time this country is kind of forgiving. they will get past it. the sooner the better. the big loser is the taxpayer. >> so far around 113,000 and some change people, that's about 23% of the number that was expected to sign up to obamacare. they projected that enrollment would be 3.3 million nationally. >> just remember people do

have to sign up. obamacare does not work unless they have a ton of people in the poll. if they don't get this to work. >> i will read there are people who are saying they canned the idea and they are waiting to see if it plays out. that will play against the whole process and if there is going to be success with this. >> i think americans will give it a second chance. but i have to tell you they better get this right the second time. i don't think they will get a third chance. >> appreciate your time. see you later. >> my pleasure. thank you. >> an early blast of winter is hitting the country's midsection. the fox extreme weather center on where the major cold front is now heading next.çó

then i also want to point your attention to francisco. this would be an equivalent of a category 5 hurricane. unbelievable storm. it is not often you see these really, really strong typhoons. this is a super typhoon. it will make its way up toward japan. they were hit with another super typhoon last week. unfortunately a vulnerable area. the good news is it will weaken as we head to the later part of the workweek. >> that's good news. thank you, jd. >> you got it. a small relic of one of the worst tragedies of the 20th century going on sale at auction. this is the violin reportedly played by the titanic band master before it went down. it is selling for $1.5 million. not clear who bought it. the violin is no longer playable. his name was walter hartley and apparently the last song was "near my god to be."
