supporters -- just like i am right here. this isn't the first time. thanks, steve. remember when he signed a bill and when the doctors -- he had doctors and the kids next to him and all the support next to him. today he's going to go through points, what actually happened. he's going to talk about how people are going to expect better health care, of course, and kind of make the case again. >> this is going to be kind of a change in strategy. you know, for the last couple of weeks people have gone on and the website doesn't work and millions of people logged on and people are p.o.'d. you know what? today apparently the president is going to offer a mea culpa. essentially he's taking a page from nordstrom's. more customer service. in fact, if you look at the affordable care act website right now it says we're listening and improving every day. and in fact apparently they have called in a whole bunch of experts from the tech world to help them. too bad they didn't call them in to start with. >> they said on the website, our team is

bringing some of the best and the brightest from both inside and outside government to scrub in with the team and help improve. >> why hurry? >> the president of the united states is going to admit he's just as frustrated as everyone had the buzz term and the talking points from jack lew on down that the president is just as angry and frustrated as all of you that after three years since its passage it is still not ready for prime time. his director of office of management and budget says i can't even guarantee this is going to be ready on december 15. and as andrea mitchell, of all people, said there is a small window of opportunity for the president. this is his chance to get this up now. you can't even look at the policy itself if you can't log on. they said there's 476,000 people who have enrolled. they haven't enrolled. they've gotten on. they have applied. people said it shows there is a level of interest. yeah. if there are people who don't have insurance there is a level of interest. but for this to work,

healthy people have to sign up for it. healthy people are not going to sit this for a week and a half trying to log on to something that is going to cost them money they wouldn't normally be paying. >> i would say probably five of those people who have applied are me. i've tried it at least five times and each time it says use a different user name. i will do that. my son, peter doocy, the correspondent, has done it about ten times. i imagine reflected in that half a million are a number of people that tried a couple of times. >> one thing they said isn't working is the data collection. it is a one-way relationship from the jump. you can't get information from the jump but they have all of yours. >> the president famously ever since harry truman, the buck stops with the president; right? in this case he handed off essentially what is pelosi care. nancy pelosi and the house wrote the affordable care act for the most part. but it has been the charge of kathleen sebelius, the secretary of that department to do the deedget it.

here's the thing. on thursday they are going to have a house energy meeting. they're going to talk about this horrible rollout. you know what? she can't make it. apparently she's got a conflict of interest because the day before she's going to be in boston. you know what? bipartisan -- both sides are steamed she can't make it. first the dems. >> ultimately secretary sebelius will testify before congress. you know that. i don't know the circumstances with this last-minute let's do it in a few days. >> as far as the affordable care act, as i call it, the fact is that, yes, what has happened is unacceptable in terms of the glitches. >> do you think? >> yeah. >> it's unacceptable the glitches, but that is the new talking point. instead of saying do we have to go another six months. and not to harp on the president for golfing yesterday? how could you be golfing

yesterday. you should be banging heads saying you embarrassed me, my name is on the program. and people across the country can't even log on. meanwhile should somebody be fired? senator cruz, senator rubio weigh in. >> absolutely she should resign. the program she implemented known as obamacare is a disaster. >> she will have to resign partly because she no longer has the credibility to do the job. >> gets you worried. it's not so much people are worried about the program, they are also worried about government running the program. what does this do about people. >> it is a mandate you have to get on by a certain date and pay the fee but you can't get on and pay the fee. but the person in charge won't talk. everybody is frustrated. we want to know should sebelius be fired? let us know on facebook today so we can kind of collect that info from you.

certainly i think everybody is frustrated and rightfully so. >> like us on facebook. we're going to monitor a lot of your responses. when the president realized this was a glitchy situation, couldn't he have looked magnanimous, conciliatorry and say i have an idea, like the corporate mandate put on hold for a year, why don't we put on hold for a year the individual mandate. that would give a sense of we're coming together in washington as opposed to i'm not giving up anything, not even negotiating. >> i have a feeling that while that is a great idea, he's not going to do it because he would be saying the republicans were right. >> exposure for the flaws that are and how it will affect premiums. >> "60 minutes" last night had an eye-opener. most people think it is illegal for politicians to profit from their office. that is not the case. we've heard of political action committees, okay.

you send in campaign money. apparently congress has created these loopholes called leadership pacs. whatever money they get in their leadership pacs, they can spend that dough any way they want. stevecroft confronted a democrat from california by the name of grace napolitano yesterday who thanks to loopholes has essentially lent herself money and then paid herself 18% interest to herself. she's made close to a quarter of a million dollars. i think she's a little surprised to see him. watch this exchanges. >> you loan money to your campaign and then charge the campaign 18% interest? >> that is correct, to be able to do a lot of things i have to do were not feasible unless i did what i had to do. at that point that was what was recommended and that's what i went with. >> i don't think anything is wrong with loaning your campaign money but collecting 18% interest from your campaign.

it is under a state of emergency at this hour. 56 wildfires are raging across the country. and already hundreds of homes have been destroyed in the region. take a look at this. it is just so bad that this is video we're about to see from inside a day care center. the woman who was filming was trapped by a wall of flames. incredibly she was able to make it out alive. we'll keep watching that one as it develops. former nfl star aaron hernandez is back in court at 2:30 eastern time today. prosecutors want the judge to step aside. they say he has a history of hostility toward the lead prosecutor in the case. the defense is calling this an intimidation tactic and says the request is simply ridiculous. hernandez pleaded not guilty to murder. a fight between a jets and patriot fan caught on camera and in the middle of it all was a woman. she gets slugged right in the face.

j.p. morgan chase reportedly reaching a tentative $13 billion deal to settle civil investigations into the bank's mortgage-backed securities business. remember that? the biggest amount paid by a financial firm in a settlement with the united states government. and this isn't j.p. morgan's first time settling with the u.s. government. the largest u.s. bank spent billions in the last two years alone. here with more is the host of "varney and company," stuart varney. this is to settle civil problems but they still could be on the hook criminally? >> this latest $13 billion fine, settlement, call it what you will, does not include exclusion of possible criminal charges down the road. in other words, these bankers at j.p. morgan could be subject to criminal charges later. they have already paid out this $13 billion. that's the settlement

there. and all those other payments in the past -- at fox business we totaled it up, how much have the banks had to pay out since 2008 in fines and penalties. so far $135 billion. >> with some exposure, they might have done something wrong back from the day. >> i'm going to express the opinion this is a highly politicized shakedown of the banks. it is an attempt to say all the blame for what happened in 2008 rests with the banks on wall street. forget the politicians. they have nothing to do with this. the regulators? no. and those home buyers who lied on their mortgages, they have nothing to do with it. it was all those wicked banks. >> you make a good point but the politicians aren't on the hook even though they pretty much mandated let's go ahead, housing lenders, and get people in houses who cannot afford to pay for them. but, stuart, if the banks did something wrong, i hope they do hold them accountable. >> yes.

j.p. morgan could still be on the hook for criminal charges. the result of a criminal charge if successful could be that someone will go to prison. that is a possibility at this point. >> all right. let's talk little bit about this as well. when government employees were furloughed, we all know they're going to get their back pay and they were hoping for that and are going to get it back. but a number of them in a number of different states, federal employees did apply for unemployment through the state and now they get to keep it? >> in some states they will keep it. in some states they are pressured to give it back. i'll give you the state of oregon, for example, 1,300 checks went out $680,000. they may not get that money back in the state of oregon because there was a rule which says if it's unclear whether you get your money because you're furloughed, you may apply for unemployment benefits. they shelled out $680,000.

someone stay with me all day and be able to nurse on breaks. but since i'm a stay-at-home mom, we don't have child care. >> kiesha, it seems extreme she would have to pay $500, maybe face jail time. she filed for an exemption. shouldn't she be afforded that? >> i don't agree. i think she should have taken her duty to serve as a juror more serious and found someone to watch her child. i understand that breast feeding is important. i personally did it. but you also have other options. she needs to teach her baby to be able to take a bottle like most working mothers have to do. >> she brought the child there because she didn't have anybody. she said she's the sole caregiver. her husband is working. the baby doesn't take a

bottle, only five months old. what is your take on that? >> you're absolutely right. she does take her service for jury duty very seriously. she showed up. a lot of people would have simply not shown up. a judge has the right to hold her in contempt for willfully ignoring the jury duty notice which she clearly didn't do. certainly she should not have brought her five-month-old baby to the courthouse but she was there and it shows her willingness to do her civic duty. she should not be charged. she should not be arrested. and she should certainly not be fined. >> she appeared before the judge on thursday. he he has been known to give exceptions before. someone apparently couldn't sit for the whole time. he said you can stand up in the back. do you think she can present her case to him and get this exemption? >> i think so. i think that is exactly what is going to happen. i expect that the judge will scold her, give her a little bit of a speech or lecture about how serious

jury duty is and that it's not a place for a baby but he'll give her a new date and a fine. that would be my hope. >> i disagree. i think the judge will hold her accountable for her lack of disregard for the rules and her obligation to serve on the jury. i mean, come on, she can find a baby sitter. you're there for a very serious reason. people's lives are on the line for this purpose of serving on the jury. >> we all know people who have gotten out of jury duty for far less than a newborn baby and breast feeding needs. i think this is the perfect example of why she should get a new date. >> kisha, do you think breast feeding takes a priority or jury duty takes a priority in this case? >> i think you have to balance it. i did it. i worked in the federal prison and i bought a $200 breast pump and pumped milk and left it home and i went to work. i think you can still provide your child with the benefits of breast feeding while also doing what you have to do as a juror, as an attorney or whatever important role that you must play. >> right. thank you both for being
