>> keep all your tweets, facebook, ininstagrams coming in, we'll read them on the show. thanks for being part of "the real story." shepard smith is live from in the fox news deck. >> great -- today the story of a little girl. somebody's child. authorities don't know her name, where she came from, they know nothing about her. except that no one has claimed her. and now, thousands of tips from around the world and a suggestion she may be an american. plus, aaron hernandez the former new england patriot accused of murder, the prosecution looking for a new judge and a bizarre hearing ongoing right now. we'll get to that. where were you on saturday? man, the upsets in college football. we'll run them down and show you my favorites. let's get to it.

>> good monday afternoon to you from the news deck. first from fox at 3:00 in new york city, a deadly shooting in a middle school in nevada. cops say at least two people, including a staff member and the suspected gunman are dead two other students hurt, one critical. authorities believe the staffer died while trying to protect those students. it happened at sparks middle school in american nevada, ten minutes outside reno. witness says it happened around 7:00 a.m. local time. one teacher says, a teacher saw another student with a gun, and told the suspect to put down the weapon. but the gunman shot the teacher instead. a spokesperson at the hospital says the two wounded victims have undergone surgery. one now listed in fair condition. the other, critical. cops say the scene at the school is now secure. all other students are safe. and they're working to reunite all of them with their parents. will card is working the story from our west coast news hub in

los angeles. will, what is the latest on this? >> reporter: well, shep, the latest is that police are now saying the teacher who was shot and killed was a hero. they say this all went down 15 minutes before school started. it's unclear exactly where this shooting started, but they say that it ended near the basketball courts behind the school. that's when students say that one of their teacher was shot and killed by another student. they say they heard a pop, thought it was a firecracker and they had seen the teacher running toward the student, trying to tell him to put the gun down and at some point he was shot and killed. police are still trying to figure out why this happened. but say they do believe the teacher was hero. at the same time city leaders and police are quick to say this is an isolated incident, it wasn't part of a bigger plot, and the school will be closed for the rest of the week. it has 630 students so they'll be providing counseling for all of those students, and all of the faculty for the rest of the week. >> what else do we know about

the shooter? >> reporter: right now we know that apparently, according to police, he was a middle school student. his motivation is unclear. they say they don't know if his was targeting specific people or going on a shooting spree i'm also don't know what type of gun he had. and also, police say that they didn't fire any shots, and some witnesses say that it appears that this shooter did actually take his own life. police have been a little careful on coming out and saying that. they're going to hold another press conference today at 4:00 in nevada so we're waiting on more information, and when we get that, we'll bring it along. >> thanks very much. will carr. about 450-miles to the south and east, police say one person is dead after a shooting on the las vegas strip this morning. it happened at a nightclubbed in bally's casino in las vegas. police are now telling us that the suspect asked if he could look around before paying the club's cover charge. they say he did. that he paid the fee. and after that, the cops say he

complained the club wasn't busy enough for him and he wanted his money back. after arguing with he manager, they say he pulled out a gun and opened fire. hit the manager in the arm. coaches say security and other people at the club eventually tackled him but not before at least two other people got shot, including a security guard and the person who died. >> we're live outside bally's. what's it like there now? >> well, metro police have cleared the area but there's large security presence outside baliys bally's inside. and i saw the crime tape is still up. the entrance is still closed. people are still gambling at nearby slot machines so business is up and running. i spoke with a custom in other words me and told me she heard the gunfire, she hid for cover behind the bar, and she saw other dealers also running for cover, and they hid underneath

their tables. she says that she is obviously very rattled and shocked by what happened, and customers out here are just asking a lot of questions. but it's a wait and see game with metro. >> what more do we know about the shooter, if anything? >> well, we know the shooter right now is at unc trauma, nearby hospital here. he suffered injuries. we're not sure the extent. he was tackled by several people. we also know that three victims are in the hospital two people we know were shot two employees. and we know that the suspect will be booked and he is facing charges, including murder and attempted murder. the patron who was kicked call by police a good samaritan who was simply trying to help. >> outside the scene for us. thanks so much. >> just in, it's now the judge on the defensive, in the murder trial of the former nfl star, aaron hernandez.

the prosecution is calling for thor quilt the case. -- quit the case. there's a hearing that started in massachusetts. the prosecutor claims the judge had what he called a history of antagonism against him. it has been a bizarre scene. watching the prosecutor tell the judge, to her face, why she needs to step down. the prosecutor claimed during another murder case, that etried before the same judge, quote, her words, tone and behavior were unnecessary. discourteous and demeaning. now the prosecutor says he wants a judge that he trusts will be fair. defense attorneys for aaron hernandez came out against getting any new judge. the form football star's career came to anened in june when cops arrested him. aaron hernandez pleaded not guilty to the murder of a one-time friend who had been dating the sister of hernandez's fiancee. molly is live in fall river, massachusetts. what happened in court?

>> reporter: pretty incredible scene. the scene is still unfolding. the prosecutor just stepped up and told the judge that they would like her to recuse herself. this steams from a 2010 murder trial in which the assistant attorney general, william mccauley, claims the judge wasn't fair with him, she was anti -- she showed bias in the case and was coming down unfairly on his side of things. they asked the judge step down, moving forward in this case. now, mccauley denieses he is doing anything relatessed to judge shop, i, it's called. he says this is about get fairing trial for the client and across the board. this is about fairness overall and a perception that the public will have as the trial goes forward. really laying it out there to the judge, row hashing this old murder trial and making arguments howl she showed unfairness. shep? >> sounds like the defense likes this judge.

>> reporter: right. interestingly enough they just began their argument. ing this entire time they said this is without merit on the part of the prosecutor, asking the judge to step down. they filed paperwork as well saying -- they characterized the request on the part of the prosecutors as frivolous. they say this isn't something the judge needs to do, and essentially she can stay put at this point in time. the argument they made is essentially that this mutual antagonism, they say the prosecution is making, is one-sided, and that this is nothing to do with the judge, and in fact when the judge was actually criticized that she did not reciprocate, she has never reciprocated. so the defense says she can stay put. >> molly, live at the courthouse. first, we're gifting reports of a usairways flight that has been detained at charlotte douglas international airport after they found a suspicious note. detaining a flight.

unusual. live pictures here. officials from charlotte douglas international airport say usairways flight 2045 from buffalo, number, is being held on the airfield after the discovery of this suspicious note that i mentioned. some of the reporting here comes from wcnc.com. the flight was taxied to a remote area away from the terminal, and then the cops showed up to find out about the note. there were 124 passengers and a crew of five onboard this airbus a319. airport officials say there is no operation impact. the fact that this plane is being held while they investigate this note has not affected neglect else there at the big airport in charlotte. a major hub that sends a lot of flights overseas. but no disruption of service. they just found a note they don't like. what does the note say? we don't know yet. when we do, we'll let you know. street view of the airport now. an area where this is happening. again, a note found on board. erring on the side of caution,

another major storm is set to hit the southern coast of mexico now. this thing is a monster. it has winds at 120-miles-an-hour. a category 3 storm. that seems to be coming in just to the west of acapulco. this would be the worst part of that storm if it comes in right there, and could really do some damage. it's packing the threat of heavy rains and officials in mexico are stationing emergency crews all over the region. they have not ordered anymore evacuation. a surous tourist area. the forecasters say the hurricane it scheduled to move closer to the coast tomorrow. we'll give you updates as we get them. >> a little girl alone. no family, no certainty on who she is, where she is from. or how she got where shorts found her. it's happening in grease where they're -- happening in greece. the discovery came during a gypsy raid last week.

officials say she may be the victim of kidnapping. and here she is. they're calling her maria for now because they don't know her name. investigators say they believe she is four or five years old but they're not sure. no way to be sure. police say they found her near a small town in central greece. the town of lorisa. it happened during a crackdown on illegal activities going on there activities they say the couple who claimed to be her parents treated her like a dancing bear. forced her to beg for money. both of these people appeared in court today on abduction charges. meanwhile, a charity is taking care of the girl and they claim they have received thousands of phone calls and e-mails from all over the world, clawing number of promising tips in the united states, and that, they say, raises the possibility that maria, or whoever she is, may be an american. trace gallagher has this news this afternoon. what do we know about these tips

that are coming in? >> reporter: a lot of these tips and calls and very specific details about the little girl, which investigators are now looking into. they say those tips could lead them to better match her with her potential biological parents. now, the gypsy parents claim the girl was born back in 2009 to bulgarian parents, who lived in their camp off and on. but they gave the daughter away because they simply could not afford to keep her, and there are some reports the biological father was in the camp just a few days ago, but now he has turned up missing. here's the explanation from the gypsy parents' lawyer about what happened. listen to him. >> clients claiming that we never abduct this child. we just adopted. and we can go no place.

>> reporter: the parents clam the girl is four years old but dental records show she is a jeer, maybe even two years older than that. that raises suspicions even higher on top of that. the parentses, the gypsy parents' story has changed a number of times in recent days. >> trace, it's my understanding that there were other children besides this one girl living with those parents. >> reporter: yeah. there will 14 other children living in the camp with these parents, and a the majority of these kids were the same age. the mother told authorities that she had six children in a span of ten months and now ten of the 14 kids are unaccounted for. the gypsies are well known for trafficking young children, using them to beg and make money. the charity where maria is now staying, says she was in a very bad situation. listen to them. >> confused. living in a very bad environment, and then suddenly

she was moved. from that environment. and she was shocked. and she win with a social worker, start crying, until she went to sleep. >> reporter: in case you're wonder, there does not appear to be any connection between maria and madeline mccann who disappeared in 2007. authorities are checking about think this -- there appears to be no link between these two girls about they're still checking to find out if tips or legitimate from america. >> trace, good to see you. now the story you may have heard about in the last hour with gretchen. the consider of a boy scout leader recorded knocking over a giant rock formation that has stood for millions of years. that's not his only problem right now. because the rest of the story includes the fact he filed a personal injury lawsuit, claiming a car crash left him disabled. a car crash that happened four

the breaking news now. we reported on a suspicious note found on board a jet at charlotte's airport in north carolina. they've just given the all-clear on that. they didn't say what the suspicious note head or why they held the jet from moving about its way. whatever it was, it's now clear, and the charlotte airport is operating absolutely as normal. another breaking story happening now. this is out of the away hernandez murder trial in massachusetts.

the question was, should the judge remove herself from the case. that's what the prosecution wanted. well, the judge has just ruled, and the judge has ruled that she will stay on the case, will not step down. prosecutors spend the last hour arguing she should quit. the prosecution accused the judge of bias in a previous murder case involving the same judge and the same prosecutor. defense attorneys for aaron hernandez oppose the effort to get a new judge, and just moments ago the judge said, deal with it. i will be adjudicating this one. >> more updates. more trouble for a boy scout leader under investigation for knocking over an ancient rock formation in utah. he is now facing questions bat lawsuit he filed just weeks before toppling that 2,000-pound rock. in case you haven't seen the video, here it is. >> wiggle it. just a little bit.

raftlift -- [laughter] >> first the song, and then the hilarity. experts say the formation survived 170 million years. that is until the laughing high-fiving boy scout leader came along. by the way, former boy scout leader. the boy scout leader says the rock was not safe and might fall on one of his kids and pushedded over. we learned the guy filed a personal injury lawsuit after a car crash. he filed the claim four years after the car extent. the man claimed that crash left him disabled, even though he seemed to have very little trouble knocking over the giant rock. his attorney says he rock video does not prove anything. he says his client may be recovering but that he still suffered pain in the past. let's bring this to a lawyer, row marie arnold. i dent know what you can get for knocking over an ancient rock formation, but you can get the

ire of a lot of folks i'm confident. >> absolutely. when you're talking about a case like this, if you're going to present a case like this to a jury, what kind of jury is going to believe that you actually had back pain when you are able to push that 2,000-pound rock the way he did. and forget about the fact you can push it. after he pushed it, what you couldn't see on the video, he did a little wiggle dance. >> he had a song to go along with it. >> the wiggle song, and he did the dance, and if you're in that much pain, even if you think someone else is going to be in danger and it's such an emergency and you have to push that rock to save the little boy scouts, when you're done, you're going to be in pain. you're not doing your wiggle dance. >> the question is about the lawsuit and whether it's frivolous. >> well, the fact that the guy had pain four years ago, is very possible. it's going to be very difficult to convince a jury that he has pain now. >> as for -- i guess the charge

could be some sort of mischief for knocking the rock formation over, 170 million years in the making? >> we're hearing that in utah the authorizes want to charge these guys with a criminal act. this could be considered in that state criminal mischef, and in utah, you can go to jail for criminal mischief. depending on the value of the property you destroy. it could be a second degree felony. it doesn't have anything to do with intent. it has to do with the value of the property you destroyed. >> the men involvedder are glen taylor, dave hall, were leaders on local boy scout troop and youth leaders at the church, and they have not been contacted. >> right after the video, he said i was doing this because there was a boy that walked past at it couple of minutes and he was trying to save people from getting hurt. and that could possibly be true.

[ male announcer ] look for the easy-open red arthritis cap. the products is good. but the web site needs some work. that from the president today as he addressed widespread problems with the rollout of the new healthcare law. the president says the most talented technology experts in the nation are now working to fix that web site. >> the problem has been that the web site that is supposed to make it easy to apply for, and purchase the insurance, is not working the way it should for everybody. there's no sugar coating it. the web site has been too slow. people have been getting stuck during the application process. and i think it's fair to say that nobody is more frustrated by that than i am. >> administration officials blamed the frozen computer screens and delays on the flood of people trying to use the site. since then those officials acknowledged there are issues with the software it's, and apparently very big issues.

the administration reports more than 19 million people have visited the web site since it launched on the first of the month, but an analysis from a nonpartisan research grows that traffic dipped nearly 90% in the first two weeks. some republicans called for the resignation of the health and human services secretary, kathleen sebelius. the white house says the president has full confidence in here. referring to the day's event at the white house, an aide to house speaker john boehner said, and i quote, a speech does not solve the problem. wendell is live at the white house where everybody is aware a speech won't solve the problem. what this president's goal. >> reporter: the president is trying to keep people from writing off obamacare based on problem with the web site, that he admits are troubling even for supporters of obamacare. certainly providing am mission for the critics. during the government shutdown the problems didn't get as much attention but now there's a spotlight on him. the aides say the huge number of people logging on caused some of

the probable and exposed some others. the president says they have enlisted the brightest to fix the problem and other parts of the act are working as they should. the goal is to enroll nearly a million people over the next since months to keep costs low. it's possible some people might have even longer to enroll in the states where the government declined to expand medicaid. the obamacare law states people should not be penalized for not having access to insurance, meaning they wouldn't have to pay the fine that the supreme court ruled is a tax when it found outcome outcome kaz to be constitution -- obamacare to be constitutional, why what is the response from the republicans. >> they say the president's speech doesn't change the reality that the affordable care act wasn't ready for prime time. they suggest the online signup problem could pore -- fortend bigger problems.

>> in a 21st century, setting up a web site where people can buy something is not that complicated. people do this every day. the inability of the federal government to set up a web site where people can go on and buy something like health insurance does not bode well for the much moyer complicated elements of this law that are yet to be rolled out. >> actually, i talked with a computer expert who says the enrollment online experience isn't related to the rest of obamacare, but he says the enrollment form is so simple he can't figure out how to the government spent $200 million on it already, 5,000 man hours at $200 an hour, and computer programmers don't usually make that kind of money. meanwhile, republicans are going after kathleen send peelus, one calling for thor resign. house republicans wanted her to testify before a committee hearing this week. she says she is available next week. we see if the hearing is delayed to allow her to testify then. >> wendell, thank you very much.

event. he information was very, very sensitive. the combination created a very tough cocktail. >> he said, bringing in the tech elite to fix this you said that's not necessary. >> no, look. this is not about'em or money. this is about the right kind of person fixing the problem. that's a plumber that can look at that code, and change it. even have 80 ceos in the room of silicone valley companies and they're not going to get anywhere. >> to suggest they're going to get this fixed quickly you have to rewrite the coat. >> you have to -- it's a building with a certain foundation. if the building doesn't fit in that foundation? you can put 80 construction crews on it, expand the foundation, that's going to take months. >> you wonder how they didn't think of all this in advance. >> they probably tried, they ran out of time, just look we all do when we launch a product, but this is a very sensitive topic, you cannot do this with this critical information. >> people wonnerring if they

studying the threat but so far they don't seem too worried. steve harrigan is live watching this big asteroid from our south florida newsroom. 2032, huh? >> some real differences of opinion at to just how dangerous this asteroid, which is more than 400 feet in diameter, actually is. you listen to the head of the russian space agency, he sent out a note on twitter saying this asteroid could blow up the world 19 years from now. he is also lobbying for funds for an antiasteroid protection system. northern, nasa says the odds of a collision with the earth are one in 63,000 now and likely to be even closer to zero the more we find out about the asteroid. but scientists continue to warn that the billion cat -- potential of a catastrophe of as steroid colliding with the earth. >> it's believed that the impact of a one-mile diameter asteroid would cause great devastation to

in mississippi. take that, you hurted purple and gold monsters. almost one of every six young adults in the united states is not school and is not working. according to a study by a group called, opportunity nation. i reports 6 million people, ages 16 to 24, are unemployed, six million. the study found that 49 states saw san increase in the number of families living in poverty last year. while 45 states saw median household income fall. expert says the number of nonworking young adults could be a problem because they're missing a chance to build skills they'll need later in life. those experts say, without work experience, young adults are more likely to be an economic drain on their community. we have a special correspondent from stossel.

just into the fox news deck. the singer-songwriter celo green charged with drugging a woman with ecstasy. prosecutors say he slipped the pills to a 33-year-old woman during a dinner in los angeles and she had no idea. prosecutor says the two later went back to the woman's hotel room. there was discussion of charging him with rape of an intoxicated

person but authorities did not, citing ininsufficient evidence. ceelo green is expected to be arraigned sometime in the next hour on the west coast. prosecutors asked that his bail be set at $30,000, and if convicted, green faces up to four years in california state prison. crews are trying to stop what they're calling a mega fire from forming in australia. emergency officials say massive and deadly wildfires burning in the southeastern part of the country could merge into one colassal blaze. forthof -- firefighters say one of the biggest is west of sidney, having burned over 100,000 acres. the fires have destroyed over 200 homes and many thor -- many more damaged. one person died. officials urged folks to stay inside. jonathan hunt is following this. it looks like things are going to get much worse before they get better.
