>> i don't see the moonwalk. maybe we should have closed in on that. all right, that is all the time we have left this evening. as always, thank you for being with us. let not your heart be troubled. start every day with "fox & friends." thanks for being with us. here is how to do it pick up the phone. the new answer to obama care. really? the phone? is that really president obama's new solution? well, that's what he said today. and so we tried his last idea all of us going online and then we all discovered the web site, well, that was a flop. and then even more annoying president obama blamed the american people for his lousy web site. he said the problem was too many of us logged on at once. you knew it was your fault, right? but tonight "on the record" is investigating obama ha care. >> the web site that's supposed to make it easy to apply for and purchase the insurance is not working. >> it's a failure. >> it ask a good deal. >> it's been a fiasco. >> it's not as quick or

efficient or consistent as we want. >> obama care is a disaster. >> nobody is madder than me about the fact that the web site isn't working as well as it should, which means it's going to get fixed. and this is a fox news alert. after weeks of congress asking hhs secretary kathleen sebelius finally agreeing she will be testifying next week before congress. that will be on wednesday. senator tim scott joins us. good evening, sir. >> thank you, greta. thank you for having me back. >> nice to have you. well, she will be testifying apparently this the house of representatives but your thoughts on secretary sebelius? they have been trying to get her to testify for some time. >> it's really time for her to take a stand and explain to the american people how this disaster could be so bad. it's as if she spent all of her time for looking for ways to market obama care. asking insurance companies to participate in spending money to market obama care yet we didn't have enough time focusing on how to get the opportunity to apply for

obama care online. listen, the iphone cost $150 million to produce something. we spent over $400 million for a web site that doesn't work. and you can't say there is a glitch. we need to ask very specific questions and very simple questions. what's wrong? how do you fix it? how long will it take? we are talking about one sixth of the economy. now being in the hands of folks who spent $400 million simply for a web site that doesn't work. >> well, she just released this press release a few moments ago in which she admits that it has been, in her words, rocky. that it's been rocky start but they are working tirelessly to make it better. here is a question. glitches can be fixed. how do we know that this is not just -- that these aren't flaws? flaws are a little bigger problem than glitches. >> i think the word "glitches" was pole tested to make sure people were comfortable with the thought

process. the reality is this is an absolute failure. you don't spend $400 million on a web site that people, no matter how many are trying to log on, you should be able to log on. we have hundreds of thousands of experts in sill silicon valley and across the nation who spend their time doing web sites. we ought to hire experts to build web sites. this is another example of how challenging it really is when you turn something over to the government that could be better done in the private sector. this is why it costs so much, why it doesn't work very well. migrate fear, however, is this is just a web site. we haven't started having a conversation about the provision of healthcare, about paying claims, about making sure that all the pieces fit together after 15 years in the insurance. i will tell you that the reality is, if it's hard on the front end, it's going to be really painful when we get to -- the pain of having

to take care of claims and having to take care of people. this is a real challenge. if it's this bad now, i fear the worse is still to come. >> today the president spoke from the white house. he said many politicians he was referring to those in the republican party are rooting for failure. are you routing for failure of obama care? i don't think anyone has to root for failure of obama care. obama care is consistently failing. what we should rout for is private sector opportunities to healthcare christopher delivery to make health insurance more affordable. what's the alternative? i would love to have a serious conversation about how do we solve the problem of having a more access to health insurance without giving it to the government. we see today why giving it to the government cost more and you get lower qualities when that happens. i think we could solve the problem far better in the private sector by allowing three or four basic

principles to guide us in the direction of a private sector solution. >> let's say that the online system gets up and running. the phone system works as well to register people. at that point, and you say that the obama care is going to fail. but, do you want it to fail? what i want to happen is i want more americans to have more access to health insurance. i do not believe obama care does that here are the numbers that stick in my mind. according to most experts according to 202310% of americans will still be without insurance will spend $3 trillion getting there. today, 15% of americans are without insurance. so the question is, is it really worth $3 trillion provide health insurance for 5% of the people or is there a better, more cost effective way to make sure that people have access to health insurance without

going to the government? i think the answer is yes. couple things that we should keep in mind, the cost was $900 billion just in 2009. the estimates today go in excess of $3 trillion by some experts. >> which brings me to the question then, one of the things that was battled about in the last week is the income verification to figure out who is getting obama care should have a subsidy from the federal government, subsidies go up that's a greatest coors of obama care. and yet if he we can't even figure out how to enroll people in the program, what level of competence can we have that we have this income verification so we know people who should get subsidies get them and those who should not do not? >> that's a great question. i think it brings into question also, everything from the navigators to the irs. we have a lot of serious questions that ms. sebelius needs to answer. because, at the end of the day, if we're going to ask the irs to be in charge of

the back end, the question is how do we do income verification accurately at the front end and then take into consideration the fact that these folks we are going to verify their income once we see the employer man at a time kick in, the 40 hour workweek for many employees will be gone and down to 30 hours, maybe 29 hours. so we're having a brand new conversation a year from now about how the implementation has to be once again kick started because of the new rules and the new opportunities that are coming their way after the first one year delay of the employer mandate. so piece mealing this bill together over the next several months and other the next year o two is not going to be great way for the american people to feel comfortable with a brand new entitlement that we both know is going to be very difficult to afford. we haven't started talking about the fact that it adds $6 trillion to our debt. >> senator, thank you, nice to see you, sir. >> thank you, greta. straight ahead h.h.s.

speaking out? robert gibbs, why don't they sort of be silent? >> because it's bad. i was one of the people first couple days you think it's a glitch. i mean, that makes sense. a lot of volume. the explanation made sense but it doesn't make sense anymore. it's a lot more than a glitch particularly when you see the president have to go out and make a statement today. it's a big problem aren't and how they weren't prepared for it particularly democrats. particularly with all the opposition from the republicans the whole time you knew if you messed up at all they were going to come and never give your opponent a loaded gun because they will turn around on you. >> it might be sort of a worey wart because the thing i worry about everyone is focused on the rollout and i'm looking farther down the road which is the subsidies and income verification i think to myself if they can't figure out how to enroll people in the program something so critical as

income verification to make sure people entitled to subsidies get them and those who aren't entitled to don't the american people. how can would he be confident on that aspect of the computer generated programs? look, they are bringing in the best and brightest to work on this stuff. i think it was very complicated set of programs from the beginning "new york times" says a million lines of cofd. people enroll get there the other issues, irs and other people is going to be a big problem. have you put your finger on it. if they can't get this part done when they had the three years to get to here. how are we going to get to the rest of it? this is a real problem. the -- it takes people right now where he this. to join up. you want to capture them now

you don't want people putting this off for a month or two. what's going to end up happening is -- i don't think they are going to delay, do a one year extension or delay the individual man date. they will extend the sign up period. >> how do you get rid of the fear factor, maybe i'm a fear monger about income verification. that really is important. if a lot of people get subsidies who shouldn't the thing will collapse financially. not an insignificant matter. >> >> no, no. it matters put youreninger on the point if you can't get this right how do you get that right. problems with income verification. i'm agreeing with you. i think the way they are going to deal with it, they have to deal with it. anything that's not working. i don't think they will delay the mandate. they will extend the sign up

period. extend the period where people can come into the system and verify their income. that's how i would solve it. the bigger issue is how did this happen? how did you -- how did they design a site that worked in, you know, sort of on 10-year-old technology and not make it work. >> i look at it differently. why are are people surprised? that's what i don't get. when something i'm surprised that people are surprised. what did you really expect? what did the american people expect? anyway, on something so giant like this and not testing it and like -- >> -- no. i think part of it was the move and republicans are right about this. we'll hear that's the argument we make. government isn't as good as the tech community is at doing things. you can't get the tech community in without bidding and all the government bureaucracy. >> i would love to see some bidding on contracts. usually just give aways. my scammer about -- sarcasm

site.he good point of is this is the easiest thing to do in this whole complicated government bureaucracy. >> all right. let's assume that the go -- she goes before congress, which she will. you grill her and ask her all these questions and three or four from now the web site is up and running and smooth and were not fatal flaws. everything is up fine, no harm, no foul on the web site at that point. could you do you then think that she should stay? >> you know, again, i think i'm going to look for what she says at the hearing. keep in mind, this isn't just a web site. this cost hundreds of millions of taxpayer dollars to build something that isn't working. now they are having to pull out all the stops and bring in all these experts which they probably should have done at the very beginning and i wonder where she is. she is now agreeing to testify to us next week it will be interesting what she has to say. ultimately if this continues i don't think there is any doubt she needs to be replaced and move on. this is something that is not just a good news story. it's not just anything.

this is real taxpayer money that's being invested in a program they made huge promises about. >> here is my question i would like to have answered. in light of the fact that the rollout web site was such debacle, is what level of certainty or proof or evidence or security or competence should the american people have that the income verification aspect, which really goes to the heart of it in terms of money, because we need to make sure that the american taxpayers don't get cheated by people getting subsidies who should not and we need to make sure that those who really should have extra help that they get it i want to know like i assume that's a computer programmer not going to be doing that with pencils and note pads. so what's level of confidence that that one is not going to have the same sort of problem we have here? that's my question. >> well, i think that's a great question because keep in mind the administration, one of the very small concessions that we actually got out of this continuing resolution deal was the income verification piece. keep in mind, up until that

happened, the administration said, you know he what? we're just going to take your word for it for a year. so somebody can make $200,000 a year and you know what i make at a level i get subsidy and they just be taken at their word. we actually got that done. i don't have a whole lot of faith that the administration is going to follow through on enforcing that. >> getting it done you actually have to have an effective execution of it. not enough to stuck in some tipping resolution a lot of pork nobody asked by the american people. the execution has to be effective and productive it just can't be well we stuck it in a bill and it just didn't work. whatever. >> you see that 100 times. we pass bills out of congress and the administration takes them and in the execution of those bills, comes up with something totally different. you see overreach from the epa. and h.h. s r and all over from this administration. we have to be on top of this. >> congressmsir. >> it was good being here. thank you. >> coming up, a young white couple's car is surrounded a

congress. now, that would also apply to the executive and judicial branches. he obviously doesn't like the congress exempted itself from obama care. now mystery of young blonde girl known as gypsy encamp many. the young man and woman claiming to her her parents are not really her parents. the couple are charged with kidnapping. international search is underway for maria's new parents. good news at the gas pump according to the latest lundburg survey gas prices are falling. the average price for a regular gallon of gas dropping 3 cents. that's tonight's speed read. and where is everybody and why is everyone talking about this one? a young white couple viciously assaulted in heir car allegedly by a group of african-american teenagers, it happened in brooklyn, income, the couple says the teens swarmed their cars then threw them to the ground slamming their heads against the pavement and brutally beating them. the teens shouting racial slurs throughout the attack.

two teens under arrest charged with gang assault. joining us legal panel in california. former prosecutor jim hammer and here in washington defense lawyer ted williams. i always hate to give you the first question on a story like this. it's like the elephant in the room so tell me your thoughts. >> well, you know, i think it's a tragedy that people cannot be more civilized towards people under the circumstances here. you have got a situation where you have got these young people that use racial epitaphs, they beat this guy up. it could very well be considered a race crime. greta, the one thing i believe is that individuals need to use common sense. in this case there was supposedly had v. have been a green light that this gentleman had. he blew his horn at these kids. they wound up shaking his car, beating his car up and gets out and he becomes very seriously injured. >> you are not suggesting that honking the horn is a legal provocation to get the living daylights beaten out of you and racial epitaphs

ideologies and hate. when you couple it with violent action they are particularly dangerous. they are going to do it again and again and green light with others to get away with it. everybody ought to speak out loud. con condemn this loudly and put these guys behind bars have any would agree. two young men arrested in regards to this. one of them is a young college student who has never been in trouble. his thing was that he was in a department store at the time i'm hoping there are videos to actually show who did what. in this kind of a scenario, especially in brooklyn where you are talking where race is very sensitive or anything could go. i do hope that these thugs should be, no matter whether they're black, white, yellow or blue. they should be brought to justice. >> according to the reports though, this wasn't just, you know, one race and another race. this was one race making terrible slurs and beating the living daylights out -- it does appear, if you believe all the racial -- all the things that were said about this white couple, this was racially motivated.

the tea party says it has new evidence the targeting went even higher up in washington than earlier reported. and now the tea party expanding its lawsuit against the irs. joining us kevin, president and founder of linchpins and liberty. executive director of the linch pin tea party. let me go to you first. how high up do you have good evidence to prove or how high up does this scandal go and what's your evidence in support of it? >> well, hi, greta, thanks for having me back. i think it's pretty clear that the evidence leads all the way to the top. the president. >> what's the top? the president? >> the top with the president. >> okay. >> yeah. the president had a meeting with william wilkins his political appointee to the irs on april 23rd, 2012. just two days later, orders were issued to new guidelines were issued in this tea party cases. i think there -- it's clear though that this started as far as back as 2009, the president began intimidating those of us from being involved in the political debate by his suggestion that these organizations

were nefarious or that we had been getting foreign money and things of that nature. this ratcheted itself up through congress. congress began sending letters of demand to the irs. and before we know it, the irs is actively involved in viewpoint discrimination, pick 'ing us out, selecting us because of the names of our organizations and what we believed. >> larry, this april 23rd, 2012 meeting that kevin just spoke about, do you know what the house said that meeting with william wilkins was about? >> well, i don't think they are making any direct connection that, yes, it was about irs targeting or whatnot. >> i think kevin is because he talked about these guidelines. >> yeah. i think the smoking gun is that there was a meeting and the next day there was more evidence of targeting. we found out later. so, it's almost an indirect kind of inference. >> i think we call it circumstance. >> right. >> it would be sort of -- it would be helpful to know what the house said went on

at that meeting. >> it would be very helpful. i think that's what congressional investigations are all about. they want people under oath to tell the truth. and that's what needs to happen here. we need to know what happened in that meeting. >> kevin, the lawsuit that was filed some time ago in connection with the irs scandal has now been expanded. it was amended, i think filed last may, i think amended this summer and amended again now? >> yes. every time it's been amended is when we have learned more through the congressional investigation or otherwise through media we learn of more individuals who are involved in this case and i can't remember them all by name now because that link, it is becoming quite a lengthy list. we also learned that lois lerner herself had up to 1600 pages of emails including 30 pages of confidential taxpayers information in her private email account. i would like to know what she intended to do with that or what she did with that. >> of course, what i would like more is to have a chance to conduct -- see what happens at these depositions. what's your thought about still about this ongoing --

justice moves slowly. >> it does move slowly in a way. we want to are thorough. we don't want to rush it and blow the outcome basically. that doesn't just come from me. that comes from speaking with staffers and congressman on the house ways and means committee. really what we are doing here is we are smoking out the rats from a corrupt ship estate if you will. we need to find out who knew what, when they knew it how high it goes and what we're finding is there are more and more names like kevin was saying beginning to add added to this list. can i rattle off three right now former commissioner showman is new on the list. we have also got sarah ingram who i think is very significant in this case and willie wilkins that kevin was mentioning too. >> i have 10 seconds left when do depositions start where you put people under oath in this case. >> unfortunately that's a better question for jay sekulow. it's going to be after the first of the year before we

even notice it. >> i think the goal with politics should be especially from some a lot of these newly elected members should be to try to find common ground and build upon the common ground there are people i disagree with 99.9% of the time. that .01% there is common ground. we can work on that and build on that. that should ultimately be the focus an the goal. we are talking about winning hearts and minds but it's hard to do that when we have this stuff going back and forth. >> is it desspiritting to the tea party movement that there is so much vitriol towards the leaders of the tea party on capitol hill? >> i know a the love them and some of them look at it as though it is feathers in their cap so to speak. if they ever getting at you and you are taking flack that means you are right over the target. some of them look at and it they're like yeah, we are having some effect. we are at least making them mad. that's great. it fires up the base and you get people involved. and they pay attention. but, at the same time.
