the website has been too slow, people have been getting stuck during the application process and i think it is fair to say that nobody is more frustrated by that than i am. bill: critics are saying the president sounded more like a salesman than a president. >> even as we redouble our efforts to get the site working as well as it is supposed to, we're also redoubling our efforts to make sure you can still buy the same quality, affordable insurance plans, available in the marketplace, the old-fashioned way, off-line. i either over the phone or in person. >> meanwhile top republican leaders, they say that tech experts are not going to be able to fix the real problems with obamacare. >> the trip to the website is sort of like a trip to the department of motor vehicles in your state. look, the people who designed this website shouldn't be in charge of our health care. the government is going to botch this. they have had four years to get

heather: chief white house correspondent ed henry will be at today's briefing and he joins us live from the white house. seems the president is trying to sell the law but not so much the delivery. >> reporter: that's right. he is making clear that he thinks this is still a great product in the long run and it is going to bring along millions of people who don't have insurance right now but he did candidly say yesterday, the president, that mistakes have been made and they will have to be fixed. they have sort of redesigned the website but are there much bigger problems than a freshening up will fix it? look, jay carney also in the briefing maintained the problem is really about high demand and that they have been overwhelmed with how many people are checking out the website. the problem with that though is "the washington post" reporting this morning that there was a test done shortly before all this began and after just a few hundred people tried to log on, the system went down. and since the president is out here saying that they're going to get millions of people signed up eventually, you have to wonder why their tests were not

house hearing where they're demanding answers though she suggested she will testify next week. heather: possibly wednesday. ed henry at the white house, thank you. bill: could the white house delay after a month saying it ain't going to happen? bret baier the anchor of "special report" here on fox news channel. how are you, sir? we were talking about this last night. you seem to think, i don't know if it's a good possibility but how would you characterize the possibility that a delay for the individual mandate could happen, even now? >> i've been thinking about this a lot since the panelas night, and, bill, i would argue it already has been delayed. jay carney was asked five or six times about delaying the penalty for people who can not sign up to the, to, for health care insurance through the website because the website is not functioning. every time he answered this way, whatever you conclusions you draw about the way the law is written i think you can draw the law is clear, if you do not have access to affordable health insurance, you will not be asked

to pay a penalty because you haven't purchased affordable health insurance. he said the same line six times. six different times. now is the administration then saying, because this website failure is going to, it keeps going and perhaps it's not going to get up right away, is their answer, in the law essentially says, if you can't get it, we can't penalize you? that's a delay. bill: interesting observation. what does that mean then in practical application to the law or to health care? >> well it means that you're not growing to be able to put the onus onioning people to sign up right away. listen, the penalty was not that great anyway. i think it was 95 bucks in the first go round. it increases over time, getting the penalty anyway was kind of, a lot of people thought people would pay the penalty. if you don't have to have the

penalty, if it is not hanging over anybody, then the impetus to get these young people to sign up in tech problem websites is not going to be that great. bill: incentive evaporates. i saw research that suggested if you delay the mandate as you are just describing here, you could get anywhere from 11 to 26 million more americans without insurance in 2014. and in addition you would see the premiums go up even higher than what we've seen already. is that what you have found? >> yeah. i mean, listen to some of the reports that jim angle brings forward, and he has been doing great work getting down into the weeds of the numbers and the substance of this really hinges on the amount of people signing up. the administration wants seven million people signed up and enrolled in these health insurance exchanges by march. if they don't have that and a percentage of that being young, healthy people, then there's a real problem in making all the numbers work. if you look at the deductibles that people have to pay, if you

look at the premiums across the board without the subsidies, it starts to add up especially if the bottom end doesn't sign up. bill: if the way you describe it, if that comes to pass, you wonder what this law is anyway? it frankly doesn't look anything like what they passed three years ago. what is obamacare? what does it look like, what does it do? >> bill, there are many democrats who say, while they support the president they are frustrated with this law overall. i mean they would like to see it go much further. they would like to see single-payer. even if the law is chugging on all cylinders and everything works perfectly, 30 million americans will not be covered. so, there are big questions about the effectiveness of the law overall and how much it costs. bill: we'll see what they explain today. see you tonight at 6:00, all right? thank you, bret baier, host of "special report." what do you think at home? will the white house delay the mandate? send me a tweet @billhemmer. you can log on right now.

expect from this law that is now taking place? >> what we're seeing the difficulty in signing up. our constituents are responding to it in that manner. it seems to be punishing healthy people more so than anyone else. >> why is that happening? we were told it was going to go the other way. >> what is happening is they are making healthy people sign up and one constituent i heard from said he had $11,000 deductible and his premium going from 325 to 860 something per month. bill: that is ridiculous. john fleming, how do you understand it? >> this is a government takeover of the largest economy in the world. none of the people in charge of this have ever run a business.

and so the terrible rollout we see today is a fever of the disease. the disease is this is an and ill-conceived concept. i would say to you today that this terrible rollout that is really an it problem is a systematic of the future problems we will see, which is going to look like this where you have the exchanges sick people, older people rushing to the exchanges and healthy people standing back. that is going to put us into a spiral that enclose the system. >> can they make it better? >> it would be like making a skyscraper better built on a poor foundation. the whole thing needs to be taken down. we need to go back and reform health care once again on a bipartisan basis. bill: weigh in on this. what are you hearing from your

patients? i imagine they are curious at a minimum. >> most of the health care is employees. over 160 million get it from their employers. if you predate existing conditions, pay for colonoscopies, basically somebody is going to have to pay for that and your premiums are going to have to rise matter how many young people you enter. she cannot afford the premiums you'lyou end up on state exchane talk about these glitches on top of that the network is shrinking. the only way is to pay less for doctors. the only way is to take those doctors who can afford to work for almost nothing. which means a lot of the best doctors will not work with obamacare. i think there is a big glitch.

i want to point out something that comes when have not said. the biggest problem is with employer-based system, not the exchanges. 7 million people maximum which they will not get. bill: do either of you still see patients today? >> i will go first. i do see patients as a reservist, i stil still have mys the practice. we're taking care of our troops, set is a different system altogether. but in general talking with my partners still practicing, they are greatly concerned whether they will be able to take care of people properly. we're looking into situations right now you're one of the largest business propositions the country has ever had, being run by people who have never run a business.

bill: do you see patients today? >> i have not been able to see them as much as i would like, but i would receive a letter this week on a mother who said his son received the health care, is now cancer free and now with the infliction of obamacare, forced from a full-time to 20 hours per week job and now going out to search for health care insurance. >> they can tell us a bigger picture of what many people are going through right now. i asked a moment ago, can they make it right? >> as we sit here today, can they, and how would they? >> the biggest problem is they extended insurance rather than health care. you go to the doctor's office, you cannot get into see the doctor you want, no longer in

campaign committee says they can pay themselves a fair market rate, that rate hasn't been challenged in any time, so she can charge 18% interest. she is not alone. we found other members of congress who also made very strange loans and took a lot of interest. you can find us on both sides of the aisle. >martha: people are thinking how can this be legal and what can be done to stop it. >> this is just one of the many problems we have got there. where the main things we need to see happen is a reinvigorated federal commission that has been a total failure, failed to regulate any kind of campaign spending. if we had commissioners and forcing the law, we might see, is behaving themselves a little bit better. >> some other things you discovered, from georgia sent more than $100,000 entertaining world-class golf courses.

spent $35,000 on nfl games. anything else that stood out to you? >> there are so many. members of congress will routinely use their funds to host lavish events at premier golf clubs and sporting events and musical events. another thing people need to be aware of they don't know about is a thing called leadership pact that is entirely unregulated becoming nothing more than slush funds to spend on anything they want. >> the bottom line, what are these political action committees originally intended for? >> they were originally intended for the congress to take on a lot of money for their colleagues in leadership raises as they could a city chairmanship when they need the vote.
