richard tweeting so sad we took prayer out of our schools and look at the condition of schoolyards and safety these days. now "shepard smith reporting" from the fox news deck. there has been a ship, an american-owned ship, hijackedded off the coast of africa. an update from a naval center near memphis, tennessee, where there's been a shooting and the shooter is now in custody. let's get to it. first from fox at 3:00, from the news deck. the u.s. navy just confirmed two national guardsmen have been shot. it happened at the millington naval air station in millington, tennessee, north of memphis. but it was at a national guard center there on the property. one person was shot in the foot, another in the leg.
12:01 pm
the original thinking here is that nobody's life is in jeopardy. the shooter is now in custody. it's our understanding that the shooterred a received some discipline. maybe had just been fired. went out to his car, got his weapon, came back into the facility and began to shoot. they say he used a small handgun. one of the guardsmen was just relieved of duty when he went to the car started the shooting. this is a sprawling property north of memphis. >> this is the air station right here and the national guard station is over here. >> so right off navy road. the national guard has that -- uses part of that property there, and the national guard had been there for many areas and never had any problems with this sort of thing. we have some pictures coming in. action news 5 is an nbc station there in memphis, tennessee. >> they just tweeted these pictures moments ago, the
12:02 pm
ambulances arriving. a local fox reporter took this image. this is congestion right outside of the navy base. we just have more pictures of the scene itself, and a local reporter also got an image of -- >> this is from -- >> wreg, cbs affiliate. sheesh got this picture or the ambulance just arriving with the two injured victims. >> so they've taken those injured victims to a trauma facility there in the memphis area. early going, soundses like they care. motive? it looks as if the employee was very upset with the disciplinary action, maybe about to be fired, and went out and started shooting. the air station was on lockdown for a while. the lockdown has been lifted. traffic is about to get back to normally and we'll have continuing coverage two people shot and the shooter is now in custody in memphis.
12:03 pm
>> a gang of pirates may have already taken two american hostages to shore. one law enforcement source is now telling fox news that would be the biggest fear. we have a map of the area where this is happening. the kidnapping unfolded off the western coast of africa, right near nigeria. this is nigeria, and the spot where it happened. so much of the canadanaping -- candidate napping that happened was in somalia but nigeria is now the hot spot for kidnapping and pirating activity. it's two-thirds the length of a football field, this ship taken hostage. the fbi is taking the lead in this investigation. we reached out to the company in louisiana that owns the ship, but have not heard back. a state department spokesman did update reporters. >> at this point we don't have indication this was an act of terrorist. we have been disturbed by increase of maritime crime,
12:04 pm
including piracy in this area. i think at this point that is what we are operating under. >> that's comes two weeks after the release of a new tom hanks filled, called "captain fillies." the real life story of the hijacking of the merck alabama in 2009. we covered that extensively at the time. navy seals saved the crew in what was described as a daring raid. that happened off the coast of somalia, and led to a crackdown, and we have seen fewer pirating activity, but over here around nigeria, it's gotten worse by the month. a number of attacks there spiking to 29 this year alone. priors off somalia has dropped off since the marsk alabama incident. the dodds here -- the dots here overlap, showing it's one of the
12:05 pm
most dangerous shipping areas in the world. most kidnapping end with prisoners being released after a ransom being paid. and officials have not received a ransom demand and just before the attack pirates went after a different ship and murdered three soldiers. joining us now, the company's ceo involved in negotiations when his company's ship was hijacked. he was here in '08 when that happened. >> this seems to be getting baud off nigeria. >> you saw that piracy incidents are down 40%, but in nigeria, off the coast of west africa, it's almost doubled this year. so that area, as you said, is becoming a hot spot. >> there was a time when pirates would ask for ransom for people. now that are dying -- doing it for property. >> there are four type office attacks.
12:06 pm
one is theft where they go onboard the ship, rob the crew, and take the electronics. the ice where they're actually stealing the cargo, they'll pull a ship a longside the larger cargo ship and take the crude oil or gasoline. the third is what happened here, where they're kidnapping the people, holding them ransom, and that's a bad thing. >> after the taking their the mrsk can things got better off somalia. how did that happened? >> they allowed more lethal fire power on the ships. we're transiting somalia at high speed. >> faster boats. >> not faster but we're going at full speed when we go through that area. what is happening in west africa, off the coast of nye my jeera, -- nigerarch ships are waiting to move into port to discharge their load. so they're waiting there, not in transit and it makes them
12:07 pm
vulnerable. >> is the thinking the same people working off the east coast of africa has moved to the west or -- >> we think it's a whole new group of people. somalia drew all the attention. that i go doing it for money. >> it's difficult to see that. i can imagine being family of one extra version those waters al these years. >> the good news is, in nigeria, relative to somalia, it's pretty short-lived. it's not the months and year that somalia holdings go on. >> i hear you. all right. nice to see you again. the obama administration did not do enough tests on the health care web site before it went live, the word from some government contractors who built the web site. they told a house committee today they warned u.s. officials about the problems before the launch on october 1st, and contractors face very tough questions from members of both
12:08 pm
parties today. >> did you try to get on the system? >> yes, i did. >> for what state? >> i attempted -- i think i put in texas. >> is that whether you're program? i'm not. just testing the system. >> did it work? >> i logged on to create an account, what able to do. so i just never received a cob confirm make e-mail. >> didn't work. >> didn't work. >> they're confident the workers can fix the problems by the 1st of january when the new health coverage takes fight. >> does cgi have to rewrite five million lines of code? >> s no. 300 plus employees i have in the office would -- i think they'd all walk out if i told them they had to rewrite that many lines of code. >> is it going to be necessary to scrap the entire healthcare.gov system and start from scratch? >> i do not. >> the health and human services secretary, kathleen send biehlas, was not at the hearing. she is in arizona promoting the healthcare law but is set to
12:09 pm
testify before congress next week. ed henry is live at the white house. we're hearing there was some heated exchanges at the hearing. >> reporter: there were you had contractors from different companies pointing fingers at each other over whose software was to blame, who made last-minute changes that screwed up the system. and then you have these contractors pointing the fingers directly at the white house and saying they warned the administration this was not ready for prime time. the administration phed forward anyway. republicans were piling on because of that and adding to the mix that there's privacy concerns about whether folks' medical information is going to be dumped out there, since this web site is not quite all there yet. and democrats pushed back on that by saying, republicans are wrong and they're trying to scare people to not enroll in the system by saying that their private information will be abused. take a listen to this exchange. >> once again, here we have, my republican colleagues, trying to
12:10 pm
scare everybody. >> will the gentleman yelled? >> i will not yield to the monty coward. >> this not a monkey court. >> i'm not yielding. >> gives you a flavor. whether they learned much information is a whole different question. democrats saying this is overdone, and the run are -- republicans are saying there's going to be bigger problems and the -- >> jay carn any has said the phrase, i'm not go to monday, morning quarterback, who knew what, when. that is still something we are going to keep pressing on. secretarysell sebelius said the president was never informed that clearly hhs officials as well as the contractors knew that this system was not ready to go live on october 1st. president, we're told, didn't
12:11 pm
know about the problems before then. he only found out october 1st october 1st as it rolled out and started crashing. jay carnny downplaying say they knew there would be problems but nobody predicted it would be this bad. >> we knew prior to october 1st there would be glitches or hiccups or problems with the roll-out of a web site like healthcare dog dog. >> opportunity out to be more than hiccups. the bottom line is the president has been facing kris simple for -- criticism for years over the healthcare law and a growing number of senate democrats, especially ones up for re-election, are saying they want tweaks to the law. they're not saying defund it or scrap it but they're saying, let's make some changes, maybe extend the enrollment deadline beyond march of 2014 because
12:12 pm
home cannot enroll. >> good to see you, ed. thank you. when the german chancellor angela merkel asked woes whether it was monitoring her cell phone, she didn't get the most reassuring response. the white house said, singh lyrics -- essentially, we're not monitoring it right now. the george -- germans are not pleased and angela merkel talking about our trust. >> this officer arrested a shoplifter, and then he bought her some groceries. the day we rescued riley,

continuing coverage of breaking news. out of millington, tennessee, a northern suburb of memphis. the milling to be air station, and on the property of the naval air station, national guard operation. it's a services organization, if you will. but it's on the naval air station property. we have been reporting there was a shooting there today. two people shot the leg and foot. they've gone to the med, regional trauma center for memphis in the mid-south. the biggest question is, why did it happen? let's get to whbq fox 13's my memphis reporter. what do we know about a motive now, matt? >> reporter: they're saying this is a workplace shooting.
12:16 pm
we're told everyone involved are all tennessee national guardsmen. law enforcement sources tell us that one soldier was being disciplined. he understand he was being relieved of duty. the source says he went to his car, grabbed a gun, came backed in the armory and shot two people. they were shot in the legs and rushed to the trauma center. they are expected to survive. i it was a massive turnout here. this national guard armory is just across the street from a major naval base here north of memphis. so, a large response, and the local police department telling us that some of the soldiers not that armory were able to tackle this gunman. the police chief here says potentially prevented other people from getting shot here, but it's just a massive investigation right now. local authorities are expected to hand this over to the federal investigators who are also on scene, and the national guard will be coming out and giving us a briefing later. want to large more about exactly what happened when these soldiers tackled the gunman. but they're saying this was a
12:17 pm
workplace shooting. >> matt brought us the new information that as this map came outside, got his gun, went back in to shoot, then other national guardsmen tackled him and may well have saved the day. matt, thanks very much. a mother in florida says she tried to steal groceries because her children were hungry. and hen the police showed up they didn't take her to jail. instead one officer took out her own debit card and bought the family some food. that officer joins us live in just a moment. we're now getting breaking news from the nsa. the national security administration. so, we knew we were maybe listening in on the phone calls of the german chancellor angela merkel. we head about it for the last 24 hours. guess what we just heard? not just angela merkel. americans have been mad about this. they've been real mad.
12:21 pm
there is breaking news now from the fox news deck, and this has just come to us from britain's, the "the guardian." it reports ed snowed den has provided a document which indicates the united states government monitored the phone conversations of not just angela merkel, the german chancellor, but of 35 different leaders from around the world. this new report comes after a different one that the u.s. monitored telephone calls of angela merkel. european leaders have been up in arms after showing up in a german magazine. the magazine claimed it received
12:22 pm
information from ed snowden but the magazine has nottive closed a source. the white house says the u.s. -- and words matter -- the white house says the u.s. is not and will not monitor chancellor merkel's communications. notice that does not address whether the u.s. has in the past kept tabs on her. listen to the answer when a reporter asked that question, point blank. listen. >> i want to ask you, has the united states monitored the chancellor's phone calls in the past. >> we're not going to comment publicly on every specified alleged activity. and it's clear we gathered foreign intelligence of the same matter as other nations. >> chancellor merkel sent out a statement that says spying among friends is not acceptable among anyone and that guess for any
12:23 pm
citizen of germany. she is not pleased. now other european leaders are lashing out. belgium prime minister says we cannot accept this systemic spying, and the dutch prime minister says this is serious. i will support merkel, saying completely in her complaint, and say this is not acceptable. and that was before the report from just movements ago that chancellor merkel was one of dozens of world leaders the united states has been spying on for who knows how long. let's take this to pj crowley, professor another practice of george washington another, who is also learning about this now. from the reading of the aural and documents -- articles and documents issue it would appear world leaders have been targeted with the help of our friends. in fact the memo states our friends, our customers, can help us get intelligence.
12:24 pm
in one recent case, u.s. official provided the nsa with 200 phone numbers of 5 world leaders, despite the fact that the majority is probably available via open source. the p cs note 43 previously unknown phone numbers. do we spy on the whole world? >> we have an intelligence community and we do try to use our intelligence capabilities to understand the world. it's in our interest to too so, so we can pursue our interest and identify and pursue shared interests we have with men countries around the world. so do governments spy on each other? yes, they do. >> is it common practice to listen in on -- ameaning, angela merkel is none too pleased. can't you see her talking to her kids at home on the cell phone, the nsa listening? she is not happy. this could seriously damage our relations. >> it is going lead to some very
12:25 pm
awkward conversations regardless of the actual facts, and there are some things that we're learning and some things we don't know. the henry systemson famously said, decades ago, gentlemen don't read each other's mails. in fact that's exactly what intelligence agencies are intended to do. most of this works to our benefit, and to others' benefit. we understand the world we know what we can do and how far we can go, and how leaders and countries are going to react to things, and through that we have a relatively stable, peaceful, and prosperous global view. >> the suggestion is here now they don't trust u.s. in fact the lead are of the green party reportedly said this is an unprecedented breach of trust between two countries. >> certainly, shep, the united states has very deep intelligence relationships with many other countries. we cooperate very collectively and significantly, and that
12:26 pm
works to everybody's interests. if we're trying, for example to use intelligence capabilities to identify emerging extremist threats, that can be helpful to europe and the united states. obviously when the tables are turned and you're now also looking over the shoulder of a particular leader in a particular country, it does challenge not only the confidence that a country has and the relationship and trust that leaders may have. ultimately interests drive relationships about they're animated by politics and animated by personality, and certainly this is going to lead to some very awkward conversations between the president and his counterparts and between other leaders and the united states government and their counterparts in the next days and weeks. >> p.j. crowley, former assistant secretary of state. i called it the national security agency. graphic new information about

they're very pleased with this and commander with the british metropolitan police said, quote, i believe we have the best opportunity yet to finally understand what happened to madeline. a lot of people would say amen. not to suggest this has any link at all to the girl found with the gypsies in guest, right? >> certainly no direct link to the girl now known around the globe as maria. remember, authorities in greece say that where she was found and said she is around four years old. madeline mckohn, of course -- mccann was three when she disappeared and would now be nine years ol'. so, maria is certainly not madeline, but this whole greek case has put a spotlight on the issue of abducted children and child trafficking in europe and certainly a lot of'em in europe, when they heard the case of maria, immediately thought of madeline, and her parents have always said they believe she was abducted. they said that even while some people were voicing a suspicion
