bullpen. i'm bill o'reilly. please remember the spin stops here. we are definitely looking out for you. breaking tonight, president obama addresses his critics about the disastrous role out of the health care overhaul. for the first time, revises his now broken promise if you like your plan you can keep your plan. now has a bunch of qualifiers directly from the president. i'm meb. welcome. this is "the kelly file." the president is just returning from boston this hour after wrapping up a fiery, at times highly partisan speech about his health care law. it took 20 minutes bf he addresseded the newest obama care controversy -- b what about that now infamous pledge that was at the heart of this law's passage that if you like your doctor, you can keep your doctor the. if you like your insurance, you
6:01 pm
can keep your insurance. he said repeatedly, i guarantee it. period. but it's not true. 2 million so far have lost their plans. that number is expected to grow. it could top 10 million, 14 million. here's how the president explained the issue today. >> now, if you had one of the substandard plans before the affordable care act became law and you really like that plan, you are able to keep it. that's what i said when i was running for office. that was part of the promise we made. >> mm-hmm. the president had little choice but to the speak to the issue somehow. even b the washington post fact checker today labeled mr. obama's many guarantees on this issue a, quote, whopper. giving it four of four pinocchios saying his promise apparently came with a very large caveat. if you like your health care plan you can keep your health care plan if, if we the
6:02 pm
government deem it adequate. meantime back in boston president obama expanded on what the promise means now. >> today that promise means that every plan in the marketplace covers a core set of minimum benefits. >> all of the plans will now cover that. what happened to all the people who were supposed to keep their plans that maybe didn't cover all the benefits and they didn't care? it turns out someone decided for them that their insurance didn't work. washington didn't like it. the government wanted those americans to have something different. so here is the new promise tonight. >> for the vast majority of people who have health insurance that work, you can keep it. for the fewer than 5% of americans who buy insurance on your own, you will be getting a better deal. >> just take it, enjoy it, and be quiet. mark thiessen is a former speech
6:03 pm
writer for president george w. bush. now a vast majority can keep it and for the pesky 5% that keep complaining, just enjoy obama care. why do you keep complaining? >> the vast majority. he didn't say the vast majority in 2009. he said if you like your plan, you get to keep it, no matter what, period. this wu an exercise in dishonesty and revisionist history. do you remember george w. bush's famous 16 words on iraq? barack obama has 16 words he needs to answer for. if you like your health care plan, you will be able to keep your health care plan. those 16 words, he lied us into obama care. >> you feel this was no accident? i know you believe it was a lie. >> yes. >> you believe it was intentional, designed because they knew all along that this is going to happen in the market
6:04 pm
and they needed it. >> absolutely. he almost admitted it. he said today, quote, if you are getting one of the letters, cancellation letters, just join obama care. first of all, you can't because the website doesn't work. if you could, that was their plan all along. the problem is in the individual market most of the people are healthy people who don't use a lot of services. in order to fund obama care they need at least 2 million people, healthy people who don't use a lot of services to leave the individual market and join exchanges so they can cover and subsidize the poor and the sick. as you pointed out, 2 million people are losing their plans. it is the perfect gnu. there will be more. those people are coming in. they wrote the regulation specifically to make sure those people lose their plans so they have nowhere else to go but obama care. >> it's fascinating. you hear the testimonials of the rp i chose the plan that was not so great is because i'm pretty healthy.
6:05 pm
my wife's healthy. >> yep. >> we don't use a lot of insurance. we have it there just in case. >> yeah. >> we chose the plan to work for us so we could have a low premium and so on. your feeling is the administration also understood it and said those are exactly the kind of people we need to pay more to fund the expanding medicaid roles we'll have under obama care and the government subsidies we are promising under obama care. there is only one way to get them. that's to get them out of the insurance plan they have while i'm telling everybody they can keep the plan they have. >> that's exactly right. he was talking today about substandard plans. this they are pushing people out of what they call substandard plans into plans with mandates like maternity care, substance abuse care, vision care. what if you are a guy who's healthy and doesn't plan to get pregnant, doesn't use drugs and has 20/20 vision. you don't need that stuff. they are pushing you into exchanges where you are going to get the stuff you don't want rs don't need and in a lot of cases
6:06 pm
subsidized by the taxpayers. that's what they are doing. >> that's the irony. you have americans who are paying the full bill on their premiums happy with their coverage. now that's been cancelled. they have to move to the exchanges and the american taxpayer has to subsidize a policy they don't want and don't need. >> maternity care for guys like me. congratulations. >> thank you for the image. see you, mark. >> thanks, megyn. >> the health and human services secretary went to capitol hill. she had to face questions about her responsibility here and the president's. watch. >> so you are saying the president is not responsible for hhs? >> sir, i didn't say that. >> so the president is ultimately responsible. it's great that you are a team player and taking responsibility it is the president's ultimate responsibility, correct? >> you clearly -- whatever. yes. he is the president.
6:07 pm
he is responsible for government programs. >> texas congressman joe barton was one questioning ms. sebelius. what of the comment, sir. "whatever." there's been a lot of talk b about it today. some say it was dismissive of her. conveyed an attitude of why do i have to be here in front of you people. >> it goes to the heart of the obama administration. they are more into perception and feeling than they are into governing. i used the line about the wizard of oz. in oz it's more important what the perception is than the reality. and the secretary today obviously felt we should just believe her and the president that they want to happy these people and not pin her down on the reality. >> she said hold me accountable. she said, okay, i'm responsible. hold me accountable. how? they say she still has the confidence of the white house. he's not ready to fire her. no one is getting fired though we have wasted hundreds of
6:08 pm
millions of the taxpayers' money on a website that doesn't work while we are cancelling people's insurance. who will be held accountable? >> she'll be held accountable and the president will be held accountable. >> how? >> this website is a debacle. obama care. the president said if you like your health care plan you can keep it. >> we know that. respectfully, sir. we know that. the question is how will they be held accountable? she said, hold me accountable. how? can barack obama -- he's the only one who can do it. is there pressure on him? do you believe she should be fired? if not, who should be? where is the accountability? >> we are going to bring the secretary back after the end of november deadline that the b website is supposed to be up. chairman upton, i and several members of the committee sent the secretary a letter based on the testimony of the contractors
6:09 pm
last week. chairman of the intelligence committee mike rogers asked her questions today. >> we'll get to that in a minute. questions about how safe people's information is. 2k3wed. >> they will fix the lack of privacy. that's one thing she did positively agree the to do that. the code that says no reasonable expectation of personal privacy, they will take that out. >> they have you sign away your expectations of privacy when you get on the obama care exchange website. there are people on there and they have no choice. in order to go b on they have to sacrifice their privacy and sign a waiver. >> she did say that was wrong and they will fix it. >> thank you for bebeing here. >> thank you. >> we want to hear your obama care story. tell us what you are experiencing. good, bad, ugly, in between. go to the facebook page or send me a tweet. we are reading your stories.
6:10 pm
we'll try to investigate your issues. and charles krauthammer says there is much more on the line for the president than just getting people insured. he's next on how we could be watching an historical moment in washington politics. we have heard him talk on special report about what he thought about kathleen sebelius. what did he think about the president's remarks about how, you know, we have taken care of it. just -- there it is. go buy on the obama care exchange if you're unhappy about being cancelled. plus, it is bad enough the obama care website was down even as the secretary was speaking today. we'll show you the security warnings. these are ones that are much bigger and a bigger story and involves your most private information which remains compromised and about which we have no promises. also, new york's police commissioner denied a chance to speak when some rowdy crowds shouted him off the stage.

decade at least. the reason is this. obama care is not just any piece of legislation. it's not like immigration. not like a tax hike. obama care is the core of the new expansion of the liberal idea. this is sort of the continuation of the new deal. the continuation of a great society. in a sense the way liberals portrayed it, it is the completion of the entitlement state. the one element that separated us from the rest of the advanced industrial countries saying we were the only one with people who were not covered. now we're going to enter into the realm of those who insure and protect everybody. if this collapses, this huge expansion of the entitlement state, this essential nationalization of one sixth of the u.s. economy, i think that discredits the entire enterprise of the expansion of government which is at the heart of

talk about it. he was going to have a robust q & a. they said, there will be no q, no a, just get out. your thoughts? >> that's what censorship is all about. being an idealogue. stop and frisk and other programs i started with bill bratton taken over by mike and ray kelly has saved 20,000 lives, 10,000 lives. >> they say it's racist. >> do you know the lives saved? 8 of 10 african-american lives. 8 of 10 of the murder victims if you reduce murder by 80% which is what i and mike blumberg did. whose lives are we saving? i'm proud of it. there were 30 years of nobody
6:46 pm
caring about saving lives. giving political rhetoric and papandreouering. we saved lives. they just fooled people. >> the students went out at brown university with signs -- typical stuff. linking ray kelly to the kkk, calling him a racist. his name is ray kelly. calling him ray-cyst kelly. >> what kind of education are they getting? >> the president of the university said this is an affront to civil democratic society and the university's core values. >> did anybody tell them ray kelly was appointed by bill clinton. he's a democrat. he was a united states marine. this is a man -- >> not even allowed to speak. >> he's kept the city safe from terrorism on september 11 of 2001. if you asked how many times we would be attacked after that, i would have said eight, ten times.
6:47 pm
the policies have kept the city safe from terrorism. stop and frisk is not the only thing. there are four or five other equally important programs. it is aer part of it. another thing that happened in the city that ray opposes. police officers will be sued if they make a mistake over stop and frisk. don't you think that will stop police officers from being overly proactive. they will say, hey, my child's enl indication is at stake if i make a mistake. we need police to be proactive. the police used to sit back and wait to make arrests. i changed them into a police force that's proactive, tries to prevent crime. ray and mike have continued and done a good job. >> one of the bedrocks of the country's foundation is not less speech, it's more speech. you have a back and forth. he says what he feels. they could have challenged him. they just wanted to shut down the speech. i want to ask you about
6:48 pm
something important. there is a group called the m.e.k. which was on our state department's terrorist list. >> right. >> now you are backing that group in what way? >> so is ed randell . >> and howard dean. >> how about general jones and admiral mullen. >> john bolden. >> two of the last three heads of the joint chiefs of staff. >> why do you care? >> these people are anti-iranian government. anti-religious government in iran. they are a secular group. the reason for their alleged terrorism in the past is their opposition to the mullahs. don't we oppose them also? they are an organization that has the possibility of creating the government in iran. right now in iraq, our government, our military promised them protection back in 2003.
6:49 pm
that promise is being broken by the obama administration. they are meeting with malaki now. the president should realize what he's created in iraq is a client state of iran. malaki is working for the mullahs. not an ally of ours. >> you see it as a window to exploit. >> a hundred of them have been killed already. the reason lives won't be saved is the administration is engaged in a negotiation with iran and they want iran happy. it is not our job to keep iran happy. it is our job to make sure iran doesn't become nuclear. they gave the israelis all the information about where the sites were located. so they are valuable to us aus a source of information inside iran. we are cutting the source off. >> great to see you. >> thank you, megyn. good luck with the show. you're doing a great job. >> all the best to you. coming up, demands for accountability. why is the department of veteranses affairs spending
6:50 pm
millions on parody videos like this? wait until you see when congress tried to get answers on that. and hannity coming up at the top of the hour. >> it forces you to have health insurance which i think is a remarkably good thing. >> health insurance includes all kinds of add-ons that various interest groups lobbied for. i'm paying for rogaine and birth control whether i want to or not. it's a transfer of money from me to you, from the poor to the rich. when we made our commitment to the gulf, bp had two big goals:
6:51 pm
help the gulf recover and learn from what happened so we could be a better, safer energy company. i can tell you - safety is at the heart of everything we do. we've added cutting-edge technology, like a new deepwater well cap and a state-of-the-art monitoring center, whe experts watch over all drilling activity twenty-four-seven. and we're sharing what we've learned, so we can all produce energy more safely. our commitment has never been stronger.

2011. taxpayer money going to a $50,000 spoof of the movie "patton." really? this is what happened when a man who played a lead role in planninging the conferences was called before congress today. >> do you wish to make an opening statement? >> on the advice of counsel i respectfully decline to answer based on my 5th amendment constitutional privilege. >> when did you resign from the v.a. >> i decline to answer p based on my 5th amendment constitutional privilege. >> joining me now jesse jane duff from concerns veterans for america. good to see you back. >> thank you. >> this guy was forced to resign after this came out. the inspector general said all the money was spent and shouldn't have been. he pleads the 5th today. your reaction as a retired member of the military is what? >> he's spineless. how could he do this to the 22 million veterans that fought for the free come he has? for him to declare the 5th
6:55 pm
amendment we sit back and we are appalled. we would be thrown in the the brig on active duty. there was no option to declare the 5th. that's repulsive. he should be accountable. we are leaders and understand leadership means being held accountable for wasting taxpayer dollars. meanwhile we have 500,000 veterans in a backlog awaiting benefits that they can't seem to resolve? >> you have all the workers -- and i can speak to this personally. my mother worked for the v.a. for decades as a nurse. you had workers doing their best to help veterans. they don't live large, trust me. they just want to help the vets. now you have executives out there, $50,000 on a "patton" spoof? that's an insult to those who serve and those who help those who serve. >> what was worse was it was a $6.1 million wasted on only 1rks -- 1800 employees. there are 300,000 employees.
6:56 pm
you will throw this money down the drain while you have veterans on the appeals side over a quarter million waiting over 1200 days to have claims addressed? this money wasn't spent ek effectively. what about the $50 million in bonuses they hand out every year. meanwhile they are falling behind in getting the claims addressed. >> this guy refused to talk about it. >> we'll be right back. customizable charts, powerful screening tools, and guaranteed 1-second trades. and at the center of it all is a surprisingly low price -- just $7.95. in fact, fidelity gives you lower trade commissions than schwab, td ameritrade, and etrade. i'm monica santiago of fidelity investments, and low fees and commissions are another reason serious investors are choosing fidelity. now get 200 free trades when you open an account. and it feels like your lifeate revolves around your symptoms,

responses which are hi rare use to that interview. i'm just 5,000 away from 100,000 twitter followers. follow me @megyn kelly. let's go over the top together! here's hannity. welcome to "hannity." tonight the obama administration official in charge of the disastrous health care overhaul was finally dragged in front of lawmakers today. health and human services secretary kathleen sebelius testified before a house committee. she dodged questions, made up facts and continueses to be dishonest with the american people. in a moment we'll have people who participated in the grilling but first the highlights. >> madam secretary, while you are from kansas, we are not in kansas anymore. >> let me say directly to these americans you deserve better. >> here we are five weeks into enrollment and the news
