bullpen. i'm bill o'reilly. please remember the spin stops here. we are definitely looking out for you. breaking tonight, president obama addresses his critics about the disastrous role out of the health care overhaul. for the first time, revises his now broken promise if you like your plan you can keep your plan. now has a bunch of qualifiers directly from the president. i'm meb. welcome. this is "the kelly file." the president is just returning from boston this hour after wrapping up a fiery, at times highly partisan speech about his health care law. it took 20 minutes bf he addresseded the newest obama care controversy -- b what about that now infamous pledge that was at the heart of this law's passage that if you like your doctor, you can keep your doctor the. if you like your insurance, you

can keep your insurance. he said repeatedly, i guarantee it. period. but it's not true. 2 million so far have lost their plans. that number is expected to grow. it could top 10 million, 14 million. here's how the president explained the issue today. >> now, if you had one of the substandard plans before the affordable care act became law and you really like that plan, you are able to keep it. that's what i said when i was running for office. that was part of the promise we made. >> mm-hmm. the president had little choice but to the speak to the issue somehow. even b the washington post fact checker today labeled mr. obama's many guarantees on this issue a, quote, whopper. giving it four of four pinocchios saying his promise apparently came with a very large caveat. if you like your health care plan you can keep your health care plan if, if we the

government deem it adequate. meantime back in boston president obama expanded on what the promise means now. >> today that promise means that every plan in the marketplace covers a core set of minimum benefits. >> all of the plans will now cover that. what happened to all the people who were supposed to keep their plans that maybe didn't cover all the benefits and they didn't care? it turns out someone decided for them that their insurance didn't work. washington didn't like it. the government wanted those americans to have something different. so here is the new promise tonight. >> for the vast majority of people who have health insurance that work, you can keep it. for the fewer than 5% of americans who buy insurance on your own, you will be getting a better deal. >> just take it, enjoy it, and be quiet. mark thiessen is a former speech

writer for president george w. bush. now a vast majority can keep it and for the pesky 5% that keep complaining, just enjoy obama care. why do you keep complaining? >> the vast majority. he didn't say the vast majority in 2009. he said if you like your plan, you get to keep it, no matter what, period. this wu an exercise in dishonesty and revisionist history. do you remember george w. bush's famous 16 words on iraq? barack obama has 16 words he needs to answer for. if you like your health care plan, you will be able to keep your health care plan. those 16 words, he lied us into obama care. >> you feel this was no accident? i know you believe it was a lie. >> yes. >> you believe it was intentional, designed because they knew all along that this is going to happen in the market

and they needed it. >> absolutely. he almost admitted it. he said today, quote, if you are getting one of the letters, cancellation letters, just join obama care. first of all, you can't because the website doesn't work. if you could, that was their plan all along. the problem is in the individual market most of the people are healthy people who don't use a lot of services. in order to fund obama care they need at least 2 million people, healthy people who don't use a lot of services to leave the individual market and join exchanges so they can cover and subsidize the poor and the sick. as you pointed out, 2 million people are losing their plans. it is the perfect gnu. there will be more. those people are coming in. they wrote the regulation specifically to make sure those people lose their plans so they have nowhere else to go but obama care. >> it's fascinating. you hear the testimonials of the rp i chose the plan that was not so great is because i'm pretty healthy.

my wife's healthy. >> yep. >> we don't use a lot of insurance. we have it there just in case. >> yeah. >> we chose the plan to work for us so we could have a low premium and so on. your feeling is the administration also understood it and said those are exactly the kind of people we need to pay more to fund the expanding medicaid roles we'll have under obama care and the government subsidies we are promising under obama care. there is only one way to get them. that's to get them out of the insurance plan they have while i'm telling everybody they can keep the plan they have. >> that's exactly right. he was talking today about substandard plans. this they are pushing people out of what they call substandard plans into plans with mandates like maternity care, substance abuse care, vision care. what if you are a guy who's healthy and doesn't plan to get pregnant, doesn't use drugs and has 20/20 vision. you don't need that stuff. they are pushing you into exchanges where you are going to get the stuff you don't want rs don't need and in a lot of cases

subsidized by the taxpayers. that's what they are doing. >> that's the irony. you have americans who are paying the full bill on their premiums happy with their coverage. now that's been cancelled. they have to move to the exchanges and the american taxpayer has to subsidize a policy they don't want and don't need. >> maternity care for guys like me. congratulations. >> thank you for the image. see you, mark. >> thanks, megyn. >> the health and human services secretary went to capitol hill. she had to face questions about her responsibility here and the president's. watch. >> so you are saying the president is not responsible for hhs? >> sir, i didn't say that. >> so the president is ultimately responsible. it's great that you are a team player and taking responsibility it is the president's ultimate responsibility, correct? >> you clearly -- whatever. yes. he is the president.

he is responsible for government programs. >> texas congressman joe barton was one questioning ms. sebelius. what of the comment, sir. "whatever." there's been a lot of talk b about it today. some say it was dismissive of her. conveyed an attitude of why do i have to be here in front of you people. >> it goes to the heart of the obama administration. they are more into perception and feeling than they are into governing. i used the line about the wizard of oz. in oz it's more important what the perception is than the reality. and the secretary today obviously felt we should just believe her and the president that they want to happy these people and not pin her down on the reality. >> she said hold me accountable. she said, okay, i'm responsible. hold me accountable. how? they say she still has the confidence of the white house. he's not ready to fire her. no one is getting fired though we have wasted hundreds of

millions of the taxpayers' money on a website that doesn't work while we are cancelling people's insurance. who will be held accountable? >> she'll be held accountable and the president will be held accountable. >> how? >> this website is a debacle. obama care. the president said if you like your health care plan you can keep it. >> we know that. respectfully, sir. we know that. the question is how will they be held accountable? she said, hold me accountable. how? can barack obama -- he's the only one who can do it. is there pressure on him? do you believe she should be fired? if not, who should be? where is the accountability? >> we are going to bring the secretary back after the end of november deadline that the b website is supposed to be up. chairman upton, i and several members of the committee sent the secretary a letter based on the testimony of the contractors

last week. chairman of the intelligence committee mike rogers asked her questions today. >> we'll get to that in a minute. questions about how safe people's information is. 2k3wed. >> they will fix the lack of privacy. that's one thing she did positively agree the to do that. the code that says no reasonable expectation of personal privacy, they will take that out. >> they have you sign away your expectations of privacy when you get on the obama care exchange website. there are people on there and they have no choice. in order to go b on they have to sacrifice their privacy and sign a waiver. >> she did say that was wrong and they will fix it. >> thank you for bebeing here. >> thank you. >> we want to hear your obama care story. tell us what you are experiencing. good, bad, ugly, in between. go to the facebook page or send me a tweet. we are reading your stories.

the president returning to the white house here. we are getting pictures in now after his trip to boston and his speech defending his health care plan. many critics describe the roll out of the signature piece of

legislation -- criticizing it. if obama care does go down the tubes it could set back the president's legacy and the entire liberal movement for what could be a generation. dr. charles krauthammer is a fox news contributor and author of the new book "things that matter." great to see you. why do you say that? >> pleasure to be here. there is a lot more at stake than we think. it is not just the fate of health care. it's not just the fate of the democrats. it's not even the fate of the president. i do think his presidency is in jeopardy. he could lose -- he could become a lame duck very early if this continues to unravel. what's really at stake here is if this thing goes south, if obama care truly self-destructs, i don't know that it's certain, but i would say right now it is more than likely. i think it will set back american liberalism p for a

decade at least. the reason is this. obama care is not just any piece of legislation. it's not like immigration. not like a tax hike. obama care is the core of the new expansion of the liberal idea. this is sort of the continuation of the new deal. the continuation of a great society. in a sense the way liberals portrayed it, it is the completion of the entitlement state. the one element that separated us from the rest of the advanced industrial countries saying we were the only one with people who were not covered. now we're going to enter into the realm of those who insure and protect everybody. if this collapses, this huge expansion of the entitlement state, this essential nationalization of one sixth of the u.s. economy, i think that discredits the entire enterprise of the expansion of government which is at the heart of

obamaism. that's why liberals are running zar escared. not just one election. it's the ideology that the government knows best, the government will take care of you. put your trust in the government or as obama said you didn't build it, the government did. it can't even construct a website. >> when you hear what the president said today, there are tones of big government in there. and the message and reliance on big government. the president is saying, look, it's for the vast majority of people who have insurance. if you had health insurance we feel works, you can keep it. this is the government speaking to us. for 5% of americans who buy insurance on your own, you will get a better deal. we are giving you a better deal. what do you hear in that? >> you are hearing the essence of new liberal ichl. this is the ultimate

paternalism. this is jay carney explaining the president and the president himself today saying, look, the only reason we are cancelling your plans is because you are too stupid to understand what you need. we are giving you a better plan. sure, you like the plan. sure, you chose the plan. sure, you paid for the plan and renewed the plan. but you don't even understand that this is substandard as defined by a bunch of experts that we slapped together to issue regulations in washington. it is the essence of the entitlement state, the essence of the nanny state. you can't have a drink over 16 ounces. you can't have health insurance you chose and you like as a free citizen because we know it is not good enough. that's the essence of obama care. it is the essence of the larger project of liberalism. it was grating today when you heard it. >> he didn't come out and say let me be honest. i know i said "period."

i know i said this is a guarantee sh period. i was wrong. this is how i was wrong. there wasn't even an honest, let me tell it to you straight now. you know 2 million of you have been cancelled so far and it's likely to be 10, 14, 15 million. there was a just enjoy it. just go to the exchanges. does that hurt him? do people who loved the president and believed his words on baobama care now start to sa wow, wait a minute. >> some of the ak lites have religious investment in obama. they are not going to change. empirical reality facts won't alter it. there is a vast number of americans who want to give the president the benefit of the doubt. he is the president. the only one we have. he's the leader. look at the pattern here. it's not just obama care on benghazi. did he ever say, you know, we got it wrong.

it really wasn't spontaneous. unlike what the secretary of state said, the this really matters? there is a difference? you know, i regret that you were misled. no. he pretended they had always been saying the same thing or that they were acting on the intelligence of the intelligence community which was not true. he's got a pattern. i can't remember once in the five years of the presidency where he ever said, i got it wrong. here's why i got it wrong. what's so interesting is that from history we know when a president levels with the american people, he benefits. >> mm-hmm . >> kennedy admitted the bay of pigs. he said it was a mistake and said, i'm responsible and no one else. his numbers shot up astrono, ma'am -- astrono, ma'amcally. when we see candor which is rare today, americans appreciate it.

from the world headquarters of fox news it's "the kelly file" with megyn kelly. >> we're back with one of the top stories from today's health care hearing. a leaked government memo revealing that just days before the obama care rollout the website was deemed a high security risk. yet they proceeded. today republican congressman mike rogers accused secretary sebelius of knowingly exposing americans' most personal information. watch. >> you accepted a risk on behalf of every user of this computer that put their personal financial information at risk because you did not even have the most basic end to end test on security of the system. you have exposed millions of americans because you all, according to your memo, believed it was an acceptable risk. would you commit today to shut

down the system and do a security test -- >> no, sir. >> joining me now, monica crowley, host of the monica crowley show and president and ceo of whitman insight strategies. this is a serious charge. basically forget the technicalities about the website which we assume will will get fixed eventually. that this personal security information of the people who have gone on there is ready for the plucking by some hacker. >> and they knew ahead of time and went ahead with launching the website because they were afraid of political ramifications of not launching. they were willing to expose americans to theft, identity fraud, criminal activity that they could now be exposed to because they inputted their information. they knew it and didn't do anything about it is a serious problem. >> if you got kicked off your plan as you were told you wouldn't. then were kicked off.

you enter your information, get identity theft. how could they assume the risk? >> there is no question the roll out was a disaster. to the suggest that people's personal security information, financial information was a risk is completely wrong. it is grandstanding, hyperbolizing. >> mike roger shs? >> rogers was grandstanding on the sunday morning talk shows days before this. the memo said there were potential risks, not a shred of evidence to suggest that anyone's personal information has, was or ever would be potentially compromised. unlike the data breaches from aol or t.j. maxx where information was released there is no evidence that any information was at risk. >> this is just the beginning. one of the other things was the fact that health care.gov was

hacked last week. lord know where the personal information is now. the problem for team obama is this this. if they want people to come to the website and enroll in exchanges, if they have been burned already once. if they can't get in, if the information has been exposed and they have been compromised the idea of getting them back a second or third time to try out the website, to enroll will be greatly reduced. once people have been burned once, exposed or compromised they are not going to do it again. >> we should the talk to the hacker about getting on health care.gov. >> that's another misstatement. the site wasn't hacked. someone said there is a possibility of vulnerability. but hacking actually didn't occur. the problem i have with this is unfortunately the botched roll out has taken over the story and unfortunately the people aren't seeing the benefits that obama care has. >> i will tell you now -- >> people have free preventative care. 13 million people that couldn't

get coverage because they had pre-existing conditions can get coverage. seniors saved billions. that's the story. why? because of a botched rollout from the administration. >> if the website had gone perfectly the story would be that the president broke his promise and those 13 million who got coverage because they got pre-existing conditions covered are balanced out by the 14 million or so about to get cancelled. thanks to obama care. the whole point was to see if people to didn't have insurance -- >> the exact opposite is happening. the insured are becoming uninsured. >> and the taxpayers are subsidizing them and they were happily paying for themselves before. in some cases. thank you. we have breaking news from the wall street journal. an eye opening poll on the president released moments ago. we'll have it for you after the break. and the vet raps affairs department under fire for months

their health care plans can keep them despite the passage of obama care. here is marcia blackburn challenging secretary sebelius this morning on that. >> madam the secretary, before during and after the law was passed the president said if you like your health care plan you can keep it. is he keeping his promise? >> yes, he isle. >> joining me frank palon. congressman, thank you for being here. >> thank you. >> we are struggling to understand how ms. sebelius can say the president kept the promise of if you like your health care you can keep it, period, i guarantee it. when we have seen 2 million americans have policies canc cancelled so far. >> you can keep it if the insurance company agrees to continue to sell it but a lot of

them are selling lousy plans that are skeletal and don't provide benefits. they are cancelling those. many of them are a scam and saying, we are not going to sell this because nobody will buy it. we'll give you a better plan at a more affordable price. the president never said he could stop the insurance companies from cancelling plans. this is a private market. this is a competitive market. >> okay. that's only partly true. there are some insurance companies who cancelled policies. that's -- >> they cancelled the policies -- >> let me just -- >> it's a private market. >> let me pose the question. then you respond. some insurance companies said, all right, we'll cancel policies. that happens on the insurance market. >> right. >> but many, many other policies -- in fact, according to the insurance companies the vast majority of policies being cancelled are being cancelled because the the regulations imposed on them by obama care left them with no choice. >> that's absolutely not true.

they have a right to continue the policies -- >> she admitted it today, sir. >> she did not. it's not true. >> she was asked about whether -- the. >> insurance companies can cancel policies if they want to. they can offer policies at the same price for the same lousy wft benefits. >> if they change the policies in any way obama care requires that they be cancelled and people get kicked off. >> that's not true. >> yes. she was asked about it today by a $5 increase in the premium. >> it's not true. obama care -- >> let's run the sound bite. $5 change and -- >> obama care says -- >> stand b by. >> if coinsurance went up by any amount, even by a dollar according to your regulations, that would not qualify as a grandfathered clause for the record. i gather even by a dollar. >> dr. cassidy, i want to start with the amount you gave isn't accurate. i was told $5, not a dollar. >> she's not saying, no, you are

wrong. they can't cancel people if it changes by five dollars. she says if they up the premium by $5 it's cancelled. they get the notice and wonder where to get insurance. >> they tell them where to get insurance. look, if you are selling a lousy policy at a price that's too high nobody is going to buy it. >> that's not true. >> they know people won't buy them. it's a competitive marketplace. >> but they were buying them. >> but they won't buy them anymore when they have -- >> they like them. >> when they have a better alternative. >> thanks to you. >> well, i can't go out as an insurance policy and sell a lousy policy at a high price. >> why do you get to decide what's lousy? why can't the american people say it's lousy for you. for me, i like it. >> it's capitalism. you can go out and buy whatever you want, but the insurance

company realizes they can't sell this lousy insurance policy anymore. >> they were selling it. you are ignoring my point. they were selling it. 15 million americans thought it was great. you didn't like it, but they liked it. you and the president -- >> there are better alternatives. >> they could keep it, period. when you make a guarantee -- >> if you can't sell it, nobody will buy it if there is a better alternative out there that gives you better insurance for a lower price. that's what the affordable care act offers. that's why the insurance companies are cancelling. they know they can't sell that lousy policy anymore. >> it's not true. >> it is true. of course it's true. you deny it but -- >> we'll let the viewers decide. >> let the marketplace decide. >> the marketplace would like to decide but they have been told by the president and democrats thanks to obama care they can't. >> it's a list private market. >> it isn't. the capitalist private market is controlled by laws including obama care which imposed regulations with which they must now comply. >> you can't sell the policy if

nobody will buy it because it's lousy. >> 15 million people bought it! they were told they could keep it and now they can't. i have to go, period. thank you, sir. >> i tried. it's so much better when you can have an exchange on the actual issues. listen. send me a tweet and let me know what you think. in the middle of the difficulties people are having with the websites we decided to check in with the obama care navigators who are supposed to help people through the process of applying for health insurance plans under the new system they are supposed to love so much. trace gallagher is live in the west coast newsroom. >> we know the federal health care website is a mess. a lot of the state websites are down. if you go to health care.gov and put in your city or state they will give you a list of the navigators. these are people who are

supposed to help you navigate the wednesday or fill out an old-fashioned paper application. so we calleded four different states. arizona, montana, iowa and mississippi. these are states have been trouble with their websites. we made 27 calls in these four states and nine of those navigators were ready and willing to help us. four were unable the to help at all including a man in mississippi who had no idea what i was talking about and a man in montana who is certified to help but recommended that we call back in november when the website is up and running. five of the called went right to voicemail. eight, we could not get through to anyone. the bottom line here is if i was trying to sign up for health care today i couldn't get on the website. what happens is i would have to juice the phone. i have a one in three chance of getting through to any of these navigators by using the phone.
