wake up again america and get back up on our feet. i'll see you all on the five. have a great weekend everybody. this is a scene at los angeles international airport as it slowly begins to return to normal operations. a day after the terrifying and chaotic scene and investigators work on establishing a motive. a disturbing picture of the gunman begins to emerge and the tsa mourns the first agent killed in the line of duty. we'll have a live report from lax. who takes the fall for the botched launch of the obama care website, health and human services secretary kathleen sebelius apologizes on capitol hill. is it enough? we'll talk with congresswoman marcia blackburn and how big of a problem is this for the president. governor mike huckabee will join us as well.

boston strong, stronger than ever. fans pouring into the streets to welcome the world series champions red sox. we'll take you there live. hello. this is america's news headquarters. live in the nation's capitol. it starts right now. we're hearing some of the chilling stories emerging from that rampage at los angeles international airport. leading the coverage, standing by live at the airport is dominick. >> reporter: uma, the fbi is looking into the background of paul ciancia, they believe is the gunman. that's how they identified him yesterday. they're also searching his apartment which is just east of hollywood here. they believe that after messages he stoent his family that his intent was to harm tsa agents and as he went through the airport yesterday, that is what he appeared to exactly be targeting.

the los angeles times is pointing out, quoting officials saying that's what the tsa firmly believes and we're hearing via local radio from passengers who say that as he went to the airport, he was asking individuals if they were tsa and they were saying no and he was moving on looking as it appears for officials. we also looking into -- rather, the fbi is looking into just what exactly his motivation could have been. they're looking at whether he had an issue or run-in at a tsa checkpoint at an airport at some point in the past. they're looking if he may have been a job applicant who was turned down and the police officer was telling me yesterday that as to whether he might have been turned down for the tsa's pre-check security pre-clearance service. an awful lot of them to look at. the tsa also saying yesterday that he, by all accounts, was well on to do so.

this is what one official had to say. take a listen. >> there was additional rounds that the gunman had. the fact that these officers were able to neutralize the threat as they did, there were more than 100 more rounds that could have literally killed everyone in that terminal today were it not for their actions, it could have been a lot more damage. >> reporter: more information coming out from official sources. speaking anonymously to the media, describing the tsa agents who was killed. you were saying earlier in the headlines that he is the first tsa agent to be killed in the line of duty since the agency was set up after 9/11. he's named as gerardo hernandez. worked at the airport for five years. father of two. described by co-workers as a great guy. it really has come as a shock to the tsa. flags across the city are flown at half mast.

he's asking fellow police officers to wear black band as a sign of respect. across the city, people very surprised about this attack. it's only the second attack in ten years we've seen at lax. uma, back to you. >> just a dramatic story. dominick, thank you very much. turning now to other news. one of the world's most wanted terrorist with a $5 million bounty is reportedly dead. they're saying the leader of the pakistani taliban has been killed in a u.s. drone strike. u.s. officials are not confirming that just yet. he's believed to be the mastermind of a deadly suicide attack at an afghan cia base and the times square bombing. his death would be a major blow to that terror group at a time when pakistan is starting up peace talks with insurgents there. coming up later in the hour, we'll look at the impact of his

death and what it means for the u.s. war on terror with fox news strategic analyst, lieutenant colonel ralph peters. >> during the fateful benghazi terror attack, they will be meeting with lawmakers what they witnessed the night when terrorists killed four americans. in will be happening despite effort over the past year by the state department and the department of justice to block that meeting. more now from fox news chief intelligence correspondent katherine herrage. >> based on congressional sources and this press release from the house intelligence committee on 9/11, three contractors who have a book deal for the benghazi story are expected to testify the week of november 11th. committee staffers did not immediately respond to fox's request for comment. but in a recent interview, the committee chairman confirmed he would not take no for an answer. >> i think it's either you come voluntarily or with a subpoena. either way, it's okay with me.

>> the cia contractors described as former members of the military can immediately explain the timeline. whether there are inconsistency, as well as the cia's response and not sending military assets. national security reporter has written extensively on benghazi. >> never heard from the actual operators who went on the ground. the other thing is, these guys are working in benghazi and they can begin to tell the story of what the u.s. intelligence community was doing there. >> whether the cia operation was the target of the attack or somehow provoked the attack which killed ambassador chris stevens and two others and glenn doherty. the recent letter to republican congressman frank wolf obtained by fox news meticulously laz out the weapon collection programs in benghazi, but emphasizes it does not speak for all u.s. government entities. touted as a gateway to overhauling the nation's health care giving uninsured americans health coverage. but it's proving to be not so affordable. what's the fallout for the president at a time when americans feel betrayed or misled by his promises tied to obama care? his approval ratings, for example, are taking a big hit and some in the white house worry that there will be consequences for a president playing defense who repeatedly says he simply wasn't aware there would be problems that would ultimately lead to a disastrous rollout. joining us now, fox news host, governor mike huckabee, who is here to offer his perspective. governor, great to have you. let me ask you first, what we're seeing is a law designed to cover the uninsured. it's now booting far more people off their insurance plans than it can sign up. right now, on the nonfunctioning insurance exchanges. governor, the longer this goes on, what does this do to the

president who can't distance himself from a law he set in motion and the cornerstone of his leadership agenda. >> he really can't, uma. the fact is, he can say i didn't know about these problems. well he should have known. frankly, i don't believe for a moment that he didn't know. no less than nbc indicated that the president knew three years ago that everything he was saying at the podium, if you like your health insurance you can keep it. he knew that wasn't true. if he had explained that more people would lose their insurance than would keep it and that this program will put more people on medicaid than on private insurance, this thing would never have passed. i think a lot of democrats are going to be scrambling for the exits between now and election time next year. >> governor, because many people are discovering that the rollout is plagued with dysfunction, having an adverse impact in their own immediate lives, can the president get away with simply saying that he didn't know about the potential

problems with the rollout ahead of time? i know you say you don't believe he didn't know. as he continues to say that he didn't know or wasn't aware about these issues, what does it do to his credibility? because this is a kind of answer he's been giving about issues like the spying of foreign leaders and about benghazi. >> you know, he can say he didn't know anything about it. i'm sorry, this is his baby. i don't care how ugly the baby is, he's the one that has to nurse it. it's his. he owns it. his signature piece of legislation, the only significant legislation that he's passed in five years. and for him to act like he's completely bum fuzz willed that it didn't work. when everything that isn't working, people have told him. in fact, if he had been watching my show the past five years, he would have known that his health care plan would not work. >> he should have been watching. that's for sure. >> should have. >> let's talk about the credibility issue since to many people he's not offered up a

convincing display of owning up to these mistakes. in boston, he didn't appear concerned and instead, he didn't even show -- instead of outward compassion to the folks who believed in his promises and are now being dropped from coverage, he's telling them to shop the website and be happy that the government knows what's best for you. >> you know, that's one of the most troubling things that's happened. rather than him say look, i'm sorry, we thought you would keep your health care but looks like we missed that one, that would be an honest assessment. i think he knew they wouldn't. but for him to say it's the bad apple insurance companies, no, it's not. it's the bad apple regulation that is took away people's choices. this is not just about health care anymore. it's about the liberty of americans to choose what kind of health care insurance that they want. here's the problem. this is like going to a restaurant and saying i'd like the $5 sandwich. i'm sorry. you can't have that. we've decided you're going to

have the $25 entree special. you say well, number one, i don't want it. number two, i don't like the food and number three, i can't afford it. well, fine. that's not the issue. you can either have the $25 or you can have nothing. here's the problem. you've got people who are 35-year-old single males who have to have maternity coverage. i'm pretty sure a 35-year-old male isn't going to deliver a baby. people have who have to have insurance for children they don't have. it's about the unsustainable dysfunction of obama care itself. >> in terms of the political stakes at play right now, the fallout for democrats going forward in the 2014 election, how do you see that playing out? many of them are very concerned about what this is going to do to their close races that are taking place in many states across the country. >> my advice to republicans and this was months and months ago, even more so before the shutdown, was look, don't

overplay your land hand. you don't have to. the democrats are dissem blg in front of our eyes. back off and let them do it. they have to go out and defend this between now and the elections of 2014. let them play defense. they deserve the right to be on the field by themselves playing defense with the ball they don't want to be holding. i think it's important to realize that this is not a good time to be a democrat running for reelection because every person in the democratic party who voted for this nightmare, it's like they voted to put everybody on the titanic and i'm sorry, there are not enough lifeboats to save everyone. >> it's interesting to note that a lot of the folks that were saying that we shouldn't delay obama care and things shouldn't be postponed during the government shutdown are now saying perhaps it should be delayed. they're seeing for themselves what's happened because of the ips of being prepared. what's coming up? >> we're going to have a great

us. >> good morning. happy to be with you. thank you, uma. >> it's been an unbelievable week of headlines and millions of americans and the rollout of obama care is far from being fixed. one huge concern is security. we learned in the hearings that there's been no real testing on protecting the security of private information on the site. can security concerns be corrected in time and do you think people will have any confidence in rolling on a site that has been misrepresented so far? >> well, the security concerns are right there in the very top. we're looking at what this cost and we're also looking at the data security, the privacy and the hipaa complaints. the site has already been hacked. those individuals who have been able to go in and register their informati

information, that's been hacked. then you've got that information that is out there in the public arena. what we're seek to go do and what we've recommended is that they delay or suspend this until they can conduct the appropriate hipaa compliance audits and then bring the site back online once people know that their financial and health information is not going to be hacked and distributed for all the world to see. >> do you think people will have any confidence in knowing that security has been a concern from the get-go? >> well, and you're asking the right question. confidence in the website, in the program and in the rollout of this is certainly being compromised. i don't think individuals do have that confidence. uma, one of the things they are at the heart of this issue over trust and confidence is people are saying, look, if you cannot run a website, then how in the

world will you be able to deliver health care. it also begs the question, what is going to happen once people do enroll in one of the president's health care law programs, then january 1, if they're going to the doctor or hospital, how are they going to find them in the system? if it has been hacked and if it is being manipulated by individuals who are not qualified to be inside that system, then you may be paying for something and get to the hospital or the doctor and not be found in that system. >> let me ask you very quickly. so far in your state, how many people have you discovered have actually been dropped from their insurance coverage? >> what we have known is that we've got somewhere 28,000 that have been dropped. and we don't know what the full total is of that.

and we know that with the president's health care law, there have been about 200 enroll ees into that into our state. we're currently working to compile the data of what companies are dropping or terminating programs. we do necessity that the tennesseans that were involved in health savings accounts were like other states. i'm one of those that is -- i've had a health savings account. i have loved it. those are some of the products that won't be available on the marketplace going forward. >> congresswoman, i know that you're going to continue to keep close watch on what happens as this rollout continues. we appreciate you joining us and bringing us up to date. >> happy to be with you. >> thank you. absolutely. thank you so much. a school science project is stirring up controversy. why one parent says she's upset some kids are heading to a local brewery. they're dancing in the seats of boston. we'll take a look at the major league celebration with a new

they're celebrating big niem bean town. still savoring the victory as the world series champions. what you're seeing are duck boats up the waterways of boston cheering the team for winning its first world series at home in fenway park in nearly 100 years. this makes the victory all the more sweet with the red sox dedicating the victory to the victims of the marathon shooting. the biology assignment creating controversy at a colorado high school. a mom whose family struggled with alcohol addiction is angry when she finds out that the alcohol content of her daughter's class lesson. here's more on the story. >> when adrian mars was making dinner last week, her daughter was learning to make beer.

welcome back everybody. let's take a quick look at the stories making news right now. the gunman who opened fire at lax had a lot of ammunition and a note saying he wanted to "kill tsa." the suspect was shot four times by police and is in custody at a local hospital there. officials are saying he killed one tsa agent and wounded several others. john kerry says that the nsa spying on u.s. allies went too far. kerry telling an open government conference in london this week

that some activities have been happening on what he calls automatic pilot without obama administration officials knowing about it. scott carpenter is being remembered by family and friends at a funeral service in colorado. he died last month at the age of 88 from complications following a stroke. he was the second american to orbit the earth following john glenn's historic ride who will speak at the funeral. time to fall back everybody. at 2:00 a.m., it's officially daylight saving time and end to that. set your clocks back one hour and enjoy that extra hour of sleep. that's a quick look at some of the stories making news right now. well, one of the world's most wanted terrorists now dead, killed in a u.s. drone strike in pakistan. taliban leader.

hypocrisy is -- he's butchering officers, oh, the americans derailed the peace process which didn't exist. the americans are violating our sovereignty. the hypocrisy is astronomical. >> they're playing to the local audience there. they were obviously saying that they were in the midst of peace talks with the insurgents there. at a time when they're taking billions of dollars from the united states. >> right. the thanks you get for president obama releasing over a billion dollars in aid is more accusations. and the pakistanis have always done this. america is the big -- for all political parties, america is the monster. but giving me the money, please. there was no peace process going forward. nonetheless, the pakistanis always, while they grab money with both hands, steal money with both hands, they like to blame us. it works for them. the problem is, up in the

northwest frontier, wa zero stand, et cetera, a lot of the people want the taliban fanatics gone. they're not complaining about the drone strikes. it's the intelligenceia and the media in islamabad or pin di. >> that's interesting and something to watch. i want to move on to another story that surprised a lot of folks when it was revealed by general odierno at a conference. as we expect our troops to stay combat ready, particularly talking about the war on terror for example, that army personnel have not been taking part in training exercises for the last six months due to the lack of funding? >> what we've seen is a dramatic decrease in the major, the expensive training exercises such as at the national training center. they're the capstone events to seal our military readiness.

but the bottom line, uma, is straightforward. it's not just the sequester and its pains. although they're very real. it's that on capitol hill, while politicians love to pose for photos with troops and talk about how they respect and loves the troops, when it comes time to vote funds, there is no benefit to your home district to vote training funds. there's no benefit for supporting the troops. the troops always get the shaft. what happens is a congressman, the average congressman or woman, the average one will vote to preserve five, do nothing contractor jobs in their home district at the cost of 5,000 soldiers. we are on the way to having an army that is much too small as well as drastic cuts in the marine corps, on the way to having an army that while it will be trained, not trained to the crackerjack level that american military usually attains and has enabled us to do so much so incredibly well over the last decades. that we're going to lose and

we're going to lose it because congress will support the defense industry, not our real -- >> really a shame to see that happening. americans expect the best from our troops and want them to have the resources that they need whenever they feel it's necessary. >> there's no political constituency in capitol hill for the soldier or the marine. the constituency is for buying big ticket items and pork. period. it's going to hurt us badly. we've been through this cycle so many times, uma. after every major war, after world war two, we cut the army and we had to reduce it, but we cut it to the bone. then we got the korean war. we were unprepared. after vietnam, we cut the military. had to rebuild it painfully in the reagan years. after the cold war, we cut it dramatically. rumsfeld, he was a villain in this. he wanted to cut it even further. guess what? he was for buying all sorts of fancy stuff. when we got to afghanistan and iraq, it wasn't the $350 million

paves the way for the controversial health care law to again be taken up by the supreme court. we have more on the legal battle and what it means. elizabeth? >> a circuit court striking down a requirement compelling business owners regardless of religious beliefs to provide health insurance including birth control coverage. the federal appeals court says the requirement not only burdens companies but limits the right of free exercise of religion. a senior council from the beckett fund helping hobby lobby says this is another groundbreaking case for religious rights. >> we believe that these cases will be successful, they've been successful so far. we think the trend will continue. we believe that religious freedom is going to trump what the administration is trying to do here. the administration has already given out over 100 million exemptions from this law. and soap we don't think in the face of all those exemptions

well, this is one of those inspiring stories that shows us the best of america. a janitor and a cook in california are being hailed as heroes after helping and caring for more than a dozen elderly and folks with mental disabilities. the center where those people were living had been shut down for alleged abuse. our producers found the story on fox news latino.com. when the state shut down that home, every one walked out except for that janitor and

cook. they felt compelled to stay and care for those residents. two days passed but eventually the situation was brought to the attention of authorities there and those been moved to other homes. well, mystery solved. at least part of it. two giant barges floating off the coast of san francisco and one in portland, maine, have twitter people buzzing belonging to google. the coast guard knows what's up but it's not allowed to say anything more than google is involved. it will be awhile before we know what they are doing there for sure because the barges are still under construction. there are reports at least one of them will be used as a floating retail store. others say it's going to be a google showroom. what do you think google is up to? sound off on twitter. so that's going to do it for me
