good morning, everybody. it is sunday, november 3rd. i am here with an amazing story of survival. two planes clyde midaollide mid. if you thought professional football players were some of the toughest players. one player walks out on the team. now the nfl investigates. he says bullying is to blame. the whole story to come up. there's no more terrifying speech than a toast, right, at a wedding. some don't always go as plabd, like this one.

am i? >> testing my reflexes. >> our producer, megan and i had 20 hours of me freaking out, wait, did it reset? is it 2:00 or is it 3:00 but 2:00. >> this is why we shouldn't do it any longer. >> but we're here. >> good to be here today, you guys. let's get to some of the other headlines. new details in the terrifying rampage at lax that left one man dead. they've charged the gunman with the murder of a federal officer. if he's convicted he could get the death penalty. he was shot four times by police. he is still in the hospital unconscious. he has not been questioned. overnight l.a.x. paying tribute to the fallen tsa agent lighting the 100 foot pylons blue in his honor. he shot 39-year-old gerardo hernandez at point blank range, left, came back because he saw him moving to shoot him again.

hernandez leaves behind two kids and his grieving wife speaking out. >> he was always excited to go to work and enjoyed the interaction with the passengers at l.a.x. he took pride in his duty for the american public and the tsa mission. >> that's what folks said, always smiling. two other tsa agents injured in friday's shooting. they are now home recovering. overnight a shooting on homecoming weekend at a college in north carolina. police say somebody was firing off a gun near a dorm on the campus of north carolina a&t university in greengs bosboro. the university was put on lockdown while they are looking for the shooter. the lockdown is over. luckily, the student that was shot is going to be okay. this story, nothing short of a miracle. a group of eight sky divers and two pilots very lucky to be alive. i mean, shocking story after the two planes that they were in

collided 12,000 feet above northwest wisconsin. one of the planes was sent plummeting to earth in flames. all of the sky divers jumped for it. >> any time two planes collide in the air, i mean, it's a potential disaster for everybody involved so we were all very, very lucky. >> i don't understand. i don't understand how -- >> disaster. >> that's the understatement. >> i love the way sky divers talk. it might have been bad. >> believe it or not, the only injuries were the bumps and bruises. the ntsb investigating this. touching moment in the world series parade in boston. ♪ god bless america, my home sweet home ♪ holding up their boston

strong jerseys. the red sox placing the world famous trophy on the finish line with the words reading boston strong. the rolling rally celebrated the team's third title in the past ten years. >> the former philly. take a look at this. a seattle bridge swaying during a fast-moving swind storm. drivers out of their cars. two people were hurt. more than 135,000 people were left without power when it was all over. the bridge, how does it look this morning? >> a lot better. it was a pretty short period that happened yesterday afternoon with strong winds up to 55 miles an hour. it's a typical storm you get up there. generally the winds aren't this strong in seattle and that's what happened. lake washington, that's the lake, the 520 bridge, closed

seven years ago. closed from 11:00 to 1:00 yesterday afternoon. the winds are done, which is good news. this is the storm and a lot of us this week will be dealing with the impact of this storm. take a look at the future radar. watch out, this goes forward in time. throughout the day spreading snow throughout much of the inner mountain west. in and across areas of colorado. then we start to see this merge up with a tropical system in the gulf. it will meet up with that energy in parts of the central planes. start to see a rain event on tuesday and wednesday in parts of texas. all of that flooding last week. temperature wise as you're waking up, a cool morning across a lot of the area including, guys, for a lot of people headed out to the marathon. a lot of the people having these bags. >> that guy has a box of munchkin donuts. >> that's not a guy running. >> clearly not running. >> they drop off their cars

here, take a bus to staten island, wait four hours in the 45 degree weather. >> if they were smart enough to order the bus. some people forgot to do that. they had to take the ferry. >> yeah. you have to really want to run 26 miles. >> really? take three buses to get there. >> i like taking a cab. thanks, rick. there's an amazing report in the wall street journal this morning that explains exactly how the president wound up assuring the country that if you like your medical plan, you can keep it. it turns out higgs aids, the white house knew that was false when they said it. according to the wall street journal, they thought admitting the truth could be confusing and would clutter the president's message. >> you should all read it on "the wall street journal".com. they wanted to simplify the language. there was dissent among the ranks in the white house as to whether or not one former senior administration official would have his voice heard. when you say if you can keep your plan if you love your plan,

you can keep it, that was simply too broad. they wanted to keep it broad. they wanted to keep it simple language because by changing it to be more complex by putting out the truth. >> caveat, well, if your insurance was bad, you may lose some of your coverage. they wanted to keep it simple. >> here's a quote from the story. one former senior administration official said as the law was being crafted by the white house and lawmakers, some white house policy advisors objected to mr. obama's keep your plan programs. they were overruled by political aids. the white house said it was unaware of the objections. the white house doesn't know that there is some sort of dissension amongst the ranks? >> this piece -- >> such a big issue. >> they made it perfectly clear. this piece makes it perfectly clear. they knew exactly what was going to happen because, of course, they wrote the regulations that made 10 million health plans untenable. >> right. >> in fact, illegal.

here's what richard kirsch, one of the advisors who pushed it, now says we should have had an asterisk attached to that statement. if you have shoddy insurance. >> if you have insurance we don't like, we don't approve of, you can't have that. as long as you have insurance we like, you're all set. >> he was one of the advisors, one of the speech writers. you can't get out on the podium and say that little caveat. >> tell the truth. 10 million people lose their health insurance? that's an asterisk? that's kind of a big deal if you're one of the 10 million. >> that's why many people feel they've been sold a bill of goods. there was a lot of information withheld. it's definitive. you see it from the story. >> you know what today's word of the day is one of my favorite news words. say it at home. word of the day, subpoena. the second subpoena may be approaching. you know darrell issa on thursday in the house oversight and government reforms committee

has been looking at the website issue and wanted to subpoena the documents. now we're looking at a new possible subpoena. >> the republican ways and means committee wants to subpoena the obama administration. they said, look, we're not going to be able to cull all of the information until sometime in november. that was on the understanding the website would be working. >> we know they have the numbers now. that's what the subpoena would ask for. >> do they or don't they? >> when carney was talking upset about the white house -- >> if you're a small coffee shop owner and all you do is sell espresso and a bag of beans, you know how many people have used square on your iphone device to buy coffee. >> the government doesn't? >> the spokesman for the white house admitted as much. he didn't say they were false. he was mad they got leaked. the public doesn't have a right to know how many people are signing up for obama care. these numbers are hidden because

they hurt the president. >> there's a pastor who is -- one pastor says the campaign for one thing, you heard the president out on the campaign trail talking about the plan to keep your plan if you like it. he says, he's changing his mind because of the promise. listen. >> what bothers me is that the president will say one thing while campaigning for the issue and then when it comes time to implement it will do absolutely nothing to make sure his promise is kept and then when called to his attention he then changes the promise. he talked about substandard plans are no longer in effect. wait a minute. people were happy with their plans. he said, you could keep it and now suddenly they're substandard and the government -- this is an overreach. it's typical unfortunately of a certain mind set. >> he shouldn't have said if we're happy with your plan you can keep it. if mommy gives you permission you can keep it. >> changing that one little word. >> you to us. hey, nfl sunday today. we'll have much more on obama care later.

are you guys watching football today? >> of course. i'm going to lay on the couch and do that this afternoon. i thought when you watched the nfl these are rough and tumble guys, they could handle pretty much anything, right? a lot of the players say we're not concerned about the concussion issue, right? we're out there playing tough. now we learn that the nfl players association is looking into what's going on in the locker rooms. is there bullying happening among the ranks inside nfl locker rooms. >> this has to do with the dolphins and one of their players who apparently had gone into -- he had gone into the cafeteria to esat down all of the other players got up. i mean, high school. >> johnson martin. >> this guy apparently had left the team and now the players association is looking into the situation as a possible bullying situation. i mean, i know some people are beyond this one. it makes me sad for this guy. sitting there and the guys that you're playing with -- there has to be more to the story. >> of course there is.

i'm in total sympathy with anybody who is snuffed by anybody. i'm against human cruel at thma. this bullying thing, it is a fad, just like self-esteem, just like low carb diet, whatever. it's mass hysteria. we're all worried about bullying. the truth is people don't get along. that's okay. >> in a locker room situation, look, we've all played sports i think at some point in our lives. certainly in the men's locker room, there's that back and forth bullying. it's part of that experience. >> he was a rookie from stanford. >> first of all, incognito is the name of the player, incognito, which is the greatest name ever. is the one accused of whether or not he was doing something. >> but we're not really sure it's him. he's --

performance. friday night's show was halted for ten minutes. the performer was taken to a nearby hospital. he's expected to be okay. this comes less than a week after osha issued a half dozen citations in the death of another performer five months ago. in that incident the acrobat died 45 feet. i think it was a different show. caught on camera, an incredibly close call in china. take a look at this. watch the left side of your screen in the middle of a busy street, a va careens over to the other side nearly hitting a guy on a scooter. the scooter doesn't have time to swerve. apparently he's okay. >> ducks out of the way. >> yeah. >> those are the headlines. kind of some disturbing headlines today. >> typical rush hour in china, i think. let's get outside to rick. watch yourself. >> do we have any idea what happened after that van landed? >> i think the guy kept going. >> the guy on the scooter went for a beer. >> whoever was behind the scooter. >> it's china.

we couldn't see it through the smog afterwards. >> is it busy out there? >> it is chilly out here, guys. what you notice is it's kind of light. it's 6:30. it's because it should be 7:30. now we've changed our times. it's 6:30. the light is out. take a look at the weather maps. the big story at least here this morning in new york city is the marathon. it is a chilly one. yesterday was such an amazing day across new york city. if you always like to run, i hear 50 degrees is the perfect temperature. it will be starting about 46. that's not bad. there will be a wind chill today that will make it feel like it's into the lower 30s with a kind of steady north wind coming at around 15 to 20 miles an hour. so that will make it feel much colder. by around noon when they're finishing up in central park, 43 degrees and the winds still going. so you're going to be facing a chilly head wind. it sounds a little bit uncomfortable for me. here's your forecast across the northeast as we go across the afternoon. you notice the temps for

everybody remain very, very cool. there will be a little bit of snow flying across the interior sections of the northeast. tomorrow will be the coldest day we've had yet across areas of the northeast so far this fall. down to the southeast, cool conditions, cool start to the day warming up into the 60s for almost everybody. we'll start to see some more cloud cover moving across texas. into the northern plains, also a cool day although you'll warm up across the high plain very nicely. denver into the 60s. get ready. by tuesday you have snow. guys, send it back to you inside. >> thanks, rick. we all have the experience where there's a terrible toast unfolding. somebody horrible. something uncomfortable. you cringe. you can't believe you're watching it. that's why that clip from "bridesmaids" is so apropos. >>. ♪ keep smiling, keep smiling

six hours had passed by all of these other people giving their speech first. >> mark twain. here's one i don't agree with. embarrassing isn't the same as funny. that's not true. em pair rasing is exactly the same as funny. >> as long as it's not you doing it. >> unless the wife or husband will be furious with you or the spouse after they hear the story. >> yeah. that makes it funnier. >> pick one story, maybe two. they often ramble from one anecdote to the next. often look, you were there. the audience wasn't there at your little story, the thing you're going to tell. they can't understand the context of that story. >> that's a good point. >> write and rehearse it. it's okay if you're up there reading it. i was in a wedding three months ago in the hamptons. the wonderful toews but her nose started bleeding. >> what? >> she was freaking out. >> that enhances it. would you remember it now if she hadn't done that? >> well, probably i wouldn't be

weren't enough, turns out the obama care tech troubles are only the beginning. as the affordable care act disasters lia head. here's laurie rothman to break it down. nice to see you. >> hi. you too, clayton. the story is we're dealing with the glitches, we're dealing with the cost overrungs. of the people that are going to suffer under obama care, you and me in terms of taxes, in terms of job structure. a lot of research is coming forward. let's break it down and look at deductibl deductibles. >> the sticker shock on deductibles will hit first. >> "the chicago tribune" did a survey of the exchanges and found that all of the nearly so-called lower plans, premiums will get you on the other side. they'll charge you more for the deductibl deductibles. annual deductibles of more than $4,000 for an individual. $8,000 for a deductible for a family. that's all the money coming out of your pocket. >> number two you mentioned, death spirals. we heard about all of the young folks that need to sign up for

this. what does this mean? >> we need 2.7 million younger healthies as we're referring to them to fund, to support. this is the underlying issue of obama care. who's going to sign up first? older, sicker americans. so they're going to pile in driving health care costs. they have obviously higher costs. they're going to drive premiums higher. why would a younger healthy want to continue, keep up with obama care if those premiums overtime are going to continue to gain and gain over time. they might as well take that fine and move on. it's a much better deal for the younger americans. >> we've heard about if you like your own plan you can keep your own plan issue. of course, "the wall street journal" breaking that down. turns out it might not be the case. >> at this point because of the glitches, you have more americans who were insured being notified that they're going to be kicked off their insurance plans because their current insurance does not comply with obama care than you have currently uninsured americans getting new coverage under obama

care. that is troubling. >> also you talk about lost jobs and lower wages for americans, too. >> obama care is telling companies, companies, especially small businesses trying to comply with obama care so they're lowering their head count under 50 for a small business. they're lowering hours worked during the week to 30 hours. they have part-time workers. fascinating. if you look at the monthly jobs report, now we know that burst in the temporary jobs, even though the corporate mandate has been delayed, they're setting up -- companies are setting up to lower the head counts, lower the wages so they're not on the hook for covering as many people. >> setting up. we've had a number of guests on the show over the past couple of months, small business owners who are already doing that. that's troubling. >> this is a shocking number here. five. another penalty for marriage. >> right. more discouragement to go out there and get married. >> under the federal tax code it costs you more to be married.

welcome back. facebook, fb, as a lot of us like to call it, can see a breakup coming before you do, your breakup perhaps. turns out that "unfriend" button may be more important than you think. the more mutual friends a couple shares on facebook, clayton, more likely their relationship is doomed. >> here to weigh in is former miss america, kierstin tagla and from campus reform. kierstin, what do you make of this? do you buy it? >> there is a long paper. it gives a lot of great

information. also self-esteem, depression, whether or not selfies, taking too many selfies is going to cause you to break up. so we're seeing more and more studies come out on the impact of social media. but, you know, at the end of the day this is really about the value of relationships and the quality of them is found in face-to-face communication, verbal communication. there was another study that came out that said that 60% of young people especially find that too many text messages and too much social media interaction negatively affect their relationship and dehumanize people. i don't know. >> i am confused, kathryn. the facebook theory suggests if you and your partner share the same circle, you don't have your own life, which i think is weird. if my friends "friend" my partner because they want to get to know him, doesn't mean i'm not hanging out with him individually without him. >> right. what i think is this study only covered people who listed their

relationships publically on facebook. maybe those people are likely to share a lot of other personal details on facebook. let's say your girlfriend -- you have a ton of mutual friends and they all see when your girlfriend posts taylor swift music songs with the lyrics. maybe people who are a couple, lots of mutual friends, keep it off facebook might have fewer problems. >> totally agree with that. >> you touched on this a little bit. are we seeing a bit of a backlash with social media and young people? are we starting to get to the tipping point. facebook admitted they're losings young people. >> absolutely. >> maybe they're going to instagram, youtube, twitter, who knows, but are young people saying that they need more face-to-face contact? are they starting to also understand what adults know? >> i think so. i think that people are learning to be careful on how much they trust their technology. all of the nsa scandals, obviously the real intrusion of

social media in our everyday lives. you can't go out to dinner without someone having their phone placed next to their fork and knife. >> taking a picture of the food, which i do. >> young people know what we want, when we want it. if we don't want people prying in and having 1,000 facebook alerts on our phone, we're going to shut it off. i think people are becoming aware and regulating their facebook use. >> kathryn, i think it was you who made a note in our producer talking notes as they say, people tend to when they look at what their friends are doing, they really can't help themselves to comment. they can't help themselves to comment. we whine about our boyfriends. we are asking for commentary on that. you take it to the facebook level. >> jessica posted this. >> yeah, i think that could be maybe what's causing the stress in the relationships. maybe not having the mutual

a potential disaster for everybody involved so we were all very, very lucky. >> shockingly, the only injuries here are bumps and bruises. the ntsb is investigating. and overnight, a shooting on homecoming weekend at a college in north carolina. police say somebody was firing off a gun near a dorm on the campus of north carolina a and t state university in greensboro, north carolina. that's when one of the rounds struck a 21-year-old student. the university was put on lockdown. the cops looked for the shooter. the student is somewhere out there. luckily the student that was shot is okay. the search continues. as i said earlier, it's marathon day. big day in new york city. safety and surveillance are the key words of the day. in addition to the thousands of cameras and police officers, runners are being monitored by bomb sniffing dogs. police scuba divers, surveillance helicopters, new york police started planning its extra precautions the day after

exactly what happened. he shot the 39-year-old tsa agent hernandez. he left the area until he realized hernandez was still alive. >> the defendant is then alleged to have begun walking away from the wounded tsa officer going up an escalator and then coming back down that escalator to return and shoot the wounded officer again. >> anna hernandez, the widow of the first tsa agent killed on that job in that agency's 12-year existence, spoke briefly to reporters about her late husband yesterday. she said he came to the u.s. from el salvador more than 20 years ago when he was 15 and that he loved going to work at los angeles international airport. >> he was always excited to go to work and enjoy the interaction with the passengers at l.a.x. he was a joyful person, always smiling. he took pride in his duty for

thanks, rick. >> you bet. pick up "the wall street journal" this morning, if you did, you're likely to see a bombshell story about the internal debate within the white house as to that line, the, quote, line you've heard the president say repeatedly. if you like your plan, you can keep your plan. >> it's huge. >> people who are on the fence about the obama care. there's dissension in the ranks. >> they knew it wasn't true. it was a lie and they knew it. it invalidated millions of health care policies affecting 10 million people. they knew it was a lie. they thought that telling the truth, this is a quote, could be confusing and would clutter the president's message? >> right. truth often does. it's more complicated, the truth. certainly in speeches, right, you want to try to keep it as simple as possible. john favreau said simplification

and ease of explanation were a premium. that was true throughout the process. so they wanted to keep it simplified. they didn't want to have an asterisk in there and say, well, you might lose your insurance policy. >> that was a big as stterisk t avoid putting in. one former administration official said that as the law was being crafted by the white house and lawmakers, some white house policy advisors objected to the breadth of mr. obama's keep your plan promise. they were overruled by political aids, the former official said. the white house was unaware of it. >> unbelievable. here's the context. four years ago when this debate was going on, most people had health insurance and most people were happy with their insurance and the care they received. obama care was justified on the basis of a relatively small number of americans who didn't have health insurance for whatever reason. the rest of the country didn't want it. they sold this plan by saying, look, if you're happy, you can

keep what you have. there will be no changes for you. that was a lie and they knew it was a lie. without telling that lie they never would have got obama care through. >> by the way, the website is down until 9:00 eastern for extended repairs. >> healthcare.gov? >> yes. maybe they took advantage of the daylight saving time to get extended repairs done or any repairs at all. a tennessee high school is causing a bit of controversy because of what it's doing around lunchtime. this has happened for two years down there at laverne high school in tennessee where if kids have below average grades, they're not doing too well, kind of struggling, before they go to lunch they have to being to a learning lab. >> i don't think this is special needs kids, it's just kids who really aren't making the grade. >> up to snuff. >> exactly. >> they don't get to hang out with their friends at lunch. one parent says this is segregation. straight up segregation. this is one of the fathers there says that to me it's considered separation because you have your

special needs kids and you have the kids getting the good grades on one side and kids below an 80 on the other side. i call it a civil rights violation. it's segregation no doubt. >> i would be furious if they were doing that to my kid. i don't know about you. that would upset me. we're not talking about kids who can't function in school. we're talking about kids getting lousy grades. when you separate them. maybe you disagree with me on this one. >> i disagree. >> i was a very lazy kid and i'm glad i got to have lunch with kids who weren't lazy, right? i mean, i don't think you want to put all the lazy kids together. that would have made -- >> they're getting tutored as they're being put together. >> race or civil rights, that's ridiculous. >> that's what the school says. the school backs that up. doecht agree with that parent. the school says they are not segregating them in the traditional sense. if the kids' scores are low in certain areas, they're getting help in that area. fup want to label that segregation, that's not the correct way to label it. they say the school because they've been doing this for two

vragga. good to have you guys here. let's start with you -- >> thanks for having us on. >> -- brandon. i understand you were able to go and be inside that auditorium. tell us what was going on. i heard the commissioner talking on a local station the other day, friday, and he said that it was his impression that it wasn't students, that it was maybe people from the outside who were able to come in, the public essentially. is that what you got? was that the gist? >> i would say that's probably accurate. it seems to me like almost half the auditorium was filled with people who didn't want to hear him speak and maybe half of that was people from the community, people from providence who showed up to join the protesters and to, you know, accomplish his goal of not hearing him speak. >> what was your feeling about how many people were there and who they were as far as the protesters go? were these people that were just had an agenda, were planning on going there? was it students mainly? >> it seems to me like it was

mainly students. there was a big protest outside right before the event. there was some sort of skit beforehand just about police brutality, that it was essentially just students. my impression being there was that it was a lot of community members but it was a lot of students also who were there and showed up because they didn't want to hear him speak. >> justin, you were outside. you weren't able to get in because it was a busy situation there. what can you tell us about what the university is doing to deal with this. basically what the climate is on campus in response to what happened. >> well, you know, immediate immediately -- i should say a few hours after the event president paxon put out a community to the brown university stating what took place did not represent brown's values of having an open and free exchange of ideas which i thought was important. over the past few days there have been events to talk about brown as a community of a free exchange of ideas. brandon and i have had the opportunity to partake in those

discussions, ensure and tell people how it's important that brown is that sort of community in which people like commissioner kelly can come on our campus and express their viewpoints. >> brandon, when you were there and watching commissioner kelly, what was he doing? what was his response to all of this as it was happening? >> at the very beginning he tried to say what he was planning to say and he got maybe a sentence out before he started being really heckled. then he asked if anyone else was planning to heckle him or if he could get to his speech, at which point it didn't stop. i would say 15 to 20 people stood up, started yelling, started chanting something. from that point on commissioner kelly wasn't at the podium anymore. it was deans and administrators trying to maintain some sort of decorum and quiet down the audience. >> justin, real quick, is there any plan to have the commissioner come back? >> not that i know of at this point. you know, as i stated, there has been a lot of discussion that has been going on. we're hoping certainly that perhaps president paxon would invite commissioner kelly back.

interagency council that involves every federal department to plot the future for us and also a local, state and tribal government task force to advise the president on how the federal government ought to be funding state, local, and tribal efforts to manage and control our lives. so this is more big government, i would say. >> i'm struck by the certainty of the tone from this announcement. >> yes. >> the liberal catechism states the earth is getting warmer because of the buildup of gases. many legitimate scientists believe the earth may be getting cooler because of solar. there's not a theory, is that right? >> yes. also, the statement, the executive order claims that we're already seeing the effects of global warming, and one of the things just to take one example is an increase in wildfires. well, i hope that the

president's council will consider the fact that the increase in wildfires is on federal lands in the west, on national forests, is largely due to federal mismanagement of those forests. >> exactly. >> so i hope maybe they'll come up with a sensible recommendation on that, but i doubt it. >> it's so -- forests that have been destroyed by beetles and sitting there as kindling waiting for fire. it's an insane policy. i agree. what kind of effect will this executive order have on american economy and productivity? >> it's hard to say. i would guess it will help contribute to all of the other obama administration policies that are creating essentially perpetual economic stagnation in this country. >> does it drive you crazy that the left, the ee bomb ma administration in particular, acts as if you ask any question about their global warming faith, that you are a denier, somehow immoral?

because it's gone to the supreme court. >> huge. >> it has major implications about religion in our country. >> it's huge. >> it comes from greece, new york. >> it does. the small town in upstate, new york, had a tradition of once a month there would be a pastor that would come in and lead the city council in prayer. usually it was a christian pastor because the local community is predominantly christian, but then a couple of people complained. they were non-theists. another term for an atheist who said we should also be able to have somebody represent us. keep in mind what is prayer? prayer is talking to god. why a theist would want be to do that i'm not exactly sure. but at the base -- at the core of this case is whether or not in a public place, like a courtroom, like, for example, before a football game in kansas someplace, whether or not in that public institution whether

or not we, people who believe, can express our faith in that way. the courts have time and time again said, yes, as long as you give space for people of different denominations or different religions to express those faiths that are representative of the local community. >> they have. even a wicken priestest felt that athena and apollo were apt dieties to call upon. a member got up and spoke of david, your servant. on and on the list goes. because there was a steady drum beat of christians getting up there repeatedly month after month after month, that's what the atheists had a problem with. >> i would fight for, i would die for the possibility of somebody else of another religion being able to express their faith in public, okay?

that's a principle that's -- that goes right to the core of who we are, religious expression and the freedom to do that, but what we're seeing right now in the united states is people who are activists trying to shut down that possibility by going after a little town like this in greece, new york, and saying, you know what, that's not right because the government should not establish one religion over another. that is absolutely the fact, but it should be representative of the local community. to have someone come in and say i am buddhist in a little town that has no buddhists and to come in and say i have the right to have equal time with you, that's the type of activism that i hope the court shuts down. that's not what the constitution means. >> and we should just be clear that no tax dollars were changing hands in this case. >> that's right. >> we'll see what happens. it's coming up. >> yes. >> father, we'll keep our eyes on it. >> good luck in your sermon. >> half an hour. in new york city, this is the

smiling. he took pride in his duty for the american public and for the tsa mission. >> there were two other agents injured. they're now recovering. overnight a shooting on homecoming weekend at a college in north carolina. police say somebody was firing off a gun near a dorm near the campus of north carolina state at&t university. the university was put on lockdown. the lockdown is over but the shooter is still out there and the search continues. luckily the student that was shot should be okay. nothing short of a miracle. listen to this story, unbelievable. a group of 8 skydivers and two pilots lucky to be alive after the two planes they were in collided in the air. one plane was sent plummeting to earth in flames. the pilot parachuted out. all of the skydivers just jumped for it.

it's going to bring a lot of snow toward the northern rockies. some of these energy will make its way down towards parts of the southwest. there is also a tropical storm aacross parts of the pacific. they're going to combine into one storm across the plains. tuesday into wednesday another snowstorm across this area and a big rainy day across parts of texas so be very careful. we obviously had flooding last week. big windy conditions across parts of the plains so the wind that you had there now moving in towards the plains not as strong but there will be some wind that causes problems across the plains. >> thanks, rick. well, if you picked up the "wall street journal" this morning you know the answer to the question why did the president make a false claim in public when he said if you like your plan, you can keep that plan. it turns out not only is it not true, we know that now, they knew it then. the president's aides knew it wasn't true and there was an

internal debate within the white house and in the end they decided to use it and i'm quoting from the "wall street journal" piece would be confusing and clutter the president's message. >> one official saying that's probably not accurate, maybe we shouldn't use that and this is what the article says. he said that as the law was being crafted by the white house and lawmakers, some policy advisers objected to the breath of mr. obama's keep your policy promise. the white house said it was unaware though of the objections to that. when he's talking about the breath of it his complaint was it was simply oversimplified. >> and leave out some of the most important information which is that it wasn't exactly true. the selling point for a lot of people was you have the option of keeping what you want to

chris wallace. nice to see you this morning. >> good to see you guys. >> you have studied a lot of presidents come and go. as they get re-elected they're concerned about legacy and making plans for your libraries. do you think the obama administration is worried about the current state of affairs or do you think they think they're fine. >> you never coast when you are president and i don't think they're worried about their legacy at this point. i think they're just trying to get through the day. it's been a bad year for the president. this whole second term, when you think of when he started out, immigration reform, gun control, obviously both of those major reforms have gone nowhere. now you've got the signature legislative accomplishment, obama care. it's too early to say that it's a failure but has been a complete fiasco so far.

it's a tough time for this white house and this president. but you talk about historical perspective. i covered ronald reagan back in the 80s and i remember in 1986 he was in the depths of the iran contra scandal and there was talk of is he going to be impeached. he survived it and he got into a number of deals with gorbachov. >> how much pressure is the white house feeling from fellow democrats? >> a lot. every time they go up to capitol hill, the chief of staff has gone up there -- remember the president isn't ever going to face election again. a lot of these senate democrats, particularly those running in red states are going to be up for election next year, november, and they're going to

own obama care for good or ill. if it's a great success which it doesn't look like it at the moment then that's great. if it continues to be the mess that it is now, they know republicans are going to wrap that around them. they're feeling plenty of heat, especially from red state republicans, get this fixed and working or you're going to end up with a republican senate next year. >> before we let you go, give us a rundown of who is on your rundown today? >> first of all we're going to have a fascinating debate about obama care. i heard you guys talking earlier about discussions inside the white house, that fellow right there is one of the architects of obama care and was one of the people back in 2009 debate is whether it was misleading. then lindsey graham is making a

collected, some snacks and fun stuff for my son's unit. i got there and i didn't exactly have the address correct and gardener was very good about helping me with getting the a.p.o. number. i put the package on the scale and waited for him to tell me how much it cost. he didn't say anything and i did notice that he had reached into his pocket and had taken out a money clip. i really wasn't paying a whole lot of attention. my mind was going in different places. he handed me the receipt and told me that i was all set. >> you thought, wait a second, i need to pay you. gardener, you just decided to pay for this care package? >> that's correct. i just spur of the moment just moved me. i had overheard her talking about how she and her friends had put these care packages together. so i said, well i can do a little bit and help a little more so i just paid for the

postage. >> that sounds sweet of you and christina you're a special girl but apparently not that special because he does this all the time for people. how many times have you done this? >> i can't tell you. years ago when i first started, the local guard unit was stationed in iraq. the girl scouts ended up with a batch of cookies so they put together care packages for the local guys. she said i'll pay for half the postage. i turned around and said i'll pick up the other half and that started it. when people come in, as the spirit moves me, somebody may say something. i've had one wife come in, it was obvious military wives don't have it easy. she was skrounging to send it over so i picked up the price of it. >> christina, what do you have to say to this guy sitting next to you? >> well, i asked him if i could hug him and he declined the

welcome back on. 53 minutes after the hour. ever thins think your grades mattered during lunchtime? one tennessee school is separating students based on grades in classes. is it segregation? here to debate it, tom kirsting and stephanie weiss.

nice to see both of you this morning. >> good to see you. >> so on one father, particularly, outraged, saying that because his child didn't do so well on some grades, he's gotten held back from lunchtime, forced into a learning lab with other kids. tom, he says it's segregation. do you think it's segregation? >> i don't really think it's segregation. i think it's they're making this too broad. if you have a school, this particular high school has 77% of kids graduating. that means 23% did not graduate high school two years ago. so as an intervention to help the kids, and sometimes you have to have a -- a little bit of a strong hand in this matter, telling kids, you need to, you know, come to this particular area before lunch, but perhaps the school needs to look at this from a different angle and give kids a choice or give parents a choice. >> when you take kids away from the socializing, this is harmful to kids. we know this from research, right? if a kid wants to hang out with these particular friends, they know they're being pulled back and into this learning lab,

they'ring going to have the some trouble. >> i think it's giving kids and parents a message to say you can't socialize with these kids and their grades are subpar and they're not -- basically, you're telling kids you are going to have to be with these kids now and they're not getting the grades you are. you're sending negative connotations to those children and these kids -- it's tough in high school. i think it's really important that lunchtime be a time where kids can be fre and friends. >> do we know the lunchtime? are they able to eat when they go to this learning lab? >> i know this from working at a high school. this is an intervention for kids that are failing, not kids below an 80 like we saw in the article. they're probably going there for 10 or 20 minutes, finishing up the homework. then going in and having lunch. you can't deny a kid lunch legally in most high school hes. >> right and -- >> how much are they getting accomplished for 20 minutes, though? lunchtime is such a time to be able to -- for kids to decompress.

they're so stressed out today. >> i agree with that. what about before school, what about after school? i think it's wonderful to -- >> one of the problems with kids not succeeding is they're not completing their homework in high school. that's a big transition from middle school. so sometimes a 20 to 30 minutes of giving them that opportunity before they go to class in that afternoon helps them with their grades. >> also kids are not eating breakfast for the most time or shoving a pop tart in their mouth, and then they're being delayed lunchtime even later. so they're sitting there, stomachs growling, how are they going to concentrate? >> if that's the case, you had a that, maybe let them eat lunch first. but i'm sure there's more to this story than what we see here. >> bottom line, neither of you think it's segregation? >> i think segregation is a tough word. >> a load word, yeah. >> but i don't think it's a good idea. >> the school says it's not segregation and their grades have improved because of it. tom, stephanie, agreed to see you. coming up here on the show, if you thought pro football players were tough, think again.

to work and enjoy the interaction. he was a joyful person. always smiling. >> two other tsa agents injured are now at home recovering. a group of eight skydivers and two pilots, lucky to be alive. they were in two plane webs those plane lighted. one plane was sent plummeting to either in flames. the pilot parachuted out. the other pilot was able to land the plane safely. all of the skydivers jumped for it. >> anytime two planes collide in the air, it's a potential disaster for everyone involved. >> incredibly, the only injuries here were bumps and bruises. can you believe that? and a touching moment during the world series parade in boston. watch.

about the politics behind obama care and some of it is shocking. this morning's "wall street journal" has a piece behind the president's rhetoric. his famous line if you like the plan you have, you can keep the plan. turns out it's not true. we know it now. but it turns out he knew it at the time. the presidential aides knew it and they said this out loud and they were ruled down, shouted down, in effect, by the political staff. >> this was a big selling point, obviously, being able to stay with your own policy. if you didn't like what the administration was offering. this is what the "wall street journal" says. one former administration official says as the law was being crafted, some white house policy advisers objected to the breath of mr. obama's, quote, keep your plan promise. they were overruled by aides. the white house said it was unaware of the objection. >> so no one in the room -- it was all yes men?

yes, let's go with that plan. apparently not, but it was all done around the idea of simplification. a former speech writer for president obama says simplification and ease of explanation were a premium and that was true throughout the entire process. they wanted the president to go out on the podium and they want add clear, simple message. if you like your plan, you can keep it. they didn't want add any asterisk or footnote. >> adding that it wasn't true. by the way, none of this is true. and as far as messaging goes, i guess they did a good job of it. >> he wouldn't have gotten re-elected, he wouldn't have known. 10 million people were going to keep their plan at least. they were engaged in something larger. and when you feel like you're on a sacred mission, it's pretty easy to wage holy wars. >> for a while. until -- >> for a while. >> outside of that bubble, people start to ask questions. and the word of the day around

package, after doing all of these things, this week's issue is his management style. whatever you consider his management style, we're more concern about the budget deficit, passing the budget, passing the debt ceiling issue and getting government back to work again and getting health care straight. so i know that this is,in', another condrived issue by the only on people whose approval rating is lower than the president, toous congress. >> but he has said he was unaware. this is a conservative's dream, though. if you don't agree with obama, you want him playing golf, don't you? >> this has been the narrative of the white house is that he's been the bystander. he didn't know the website wasn't ready. he didn't know we were spying on angela merkel. this is what's coming out of the white house. and i have to disagree, respectfully, with the reverend. this has been a consistent critique from the left and the white. during the syria crisis three months ago, it was maureen dowd, it was dana millbank from the washington post who called the president a bystander.

so this is nothing new. it's been fairly consistent and it has emerged because of his consistent governing style of creating this plausible deniability when thinking going wrong. and that's because this president, more than anyone in modern history has an aversion to modern history. >> it's just basic management practice when you have a massive screw up like obama care, why doesn't he fire anybody for these mistakes? >> i can't speak for the president. i think decency would say that after a massive screw up on signature legislation, that the person ought to have the grace themselves to resign. >> i agree with that completely. >> having said that, you or on i might fire that person or create a climate -- you see, the real climate you want is for the person to get the job done rather than have to fire them when they did do the job right. so having failed that, we're talking about a congress that for 45 sometimes voted against that legislation and created a toxic environment where improvements cannot be made and

aware of that. i know you really liked the flight attendance. >> she was amazing and in her welcome announcement, she thanked the soldiers. everyone clapped, which i thought was pretty cool. while i was in the air, i updated my facebook page and i wrote that. right before landing, the pilot made that announcement. >> there's some video that we're going to run right now. and it's really -- it breaks my heart. and when i read your blog about this, they had just basically what they do when there's a fallen soldier, some places, they actually have water sprayed from fire trucks on to the plane to honor the soldier. the families are often nearby. you said, looking at the video right now, that it looked like fought just water on a plane, but at one point it started to look like teares and we're about to see that in a second. tell us what that was like? >> i've seen the water cannon salute many times. in my line of business, a lot of times on an an inagoul flight

and it's a happy occasion. but this time, it was everything but happy. it just felt like tears, from heaven, even. >> and you said one of the rellists of this fallen soldier was at the airport to greet their son or husband. >> they weren't on the plane. when i got off the plane, there was a crowd around the window, all the passengers who are usually on a hurry to get off the plane and go on to their next flight. but i could see off to the left, the mother or wife and a couple other people, maybe their sons, wrapped in blarnths. and when they brought the casket out, my god, it was the most emotional thing i've ever seen in my life. i saw her put her hand up and reached on to the casket. i walked away and i felt like it was her private moment. i didn't want to take a picture after that. i thought it was an important story to tell because most americans don't appreciate the military. >> you've had incredible reaction on yahoo!.
