three things. he could resign. may take a leave of absence until the new year, or he could, because he is such a mercurial character, come out at the last minute and say, i'm going to stay and fight this. it's not a surprise to anyone that he actually smoked crack cocaine. what is really a surprise he acknowledged it. you might remember in spring the toronto star said they had seen the video that showed pictures, images, of the mayor smoking crack. he denied it. what this other case is about that led to disclosure or of -- of this tape, map tried to retrieve the video. chargeed with extortion, and may have tried to get rid of the video. can the mayor survive this? people like his low-tax policies and is a man of the people. but when you admit to smoking

crack when you're the mayor of a big city like that it, it might beatle difficult to survive. >> it happened in washington, if i remember. >> reporter: it did. but marion berry faced charges and was convicted and did come back into politics. here's the thing that rob ford has going for him. if he does not resign outright today there is no mechanism in canada to recall him, and they say a day in politics i a long time, week is forever. he has a year until the next mayoral elections come around to clean this up. if he decides to take a leave of absence, he has a lot of time to try to repair his image. he is going ton something of an apology tour as well. if he does resign, that's it for him. >> we'll watch this. we're expecting him to walk out at any moment. john, he tried very hard not to answer the question. today, as he finally came out and answered id, he said you

didn't ask the question right before. i'm not an addict but, yeah, you now, i've smoked crack. >> people did ask the question, shep, and they asked it the correct way and a number of times. he chose not to answer it. the fact that the police chief came out and it do have been after rob ford fully believed the tape has been wiped from the face of the earth and said, we found a deleted file on a computer, we recreated and it it does show the mayor doing something, which we're not going to describe, but something that the police chief said disturbed him and was disappointment and he was between a rock and a hard place. >> he certainly was, a rock and a hard place of his open making. he is well-known -- he admitted he likes to drink a lot and he referred to that as he spoke to reporters earlier. >> do you smoke crack coke sustain exactly. yes, i have smoked crack

cocaine. >> when -- >> but no -- do i? am i an addict? no have i tried it? probably in one of hi drunk 'stuporss, approximately a year ago. >> his using the fact he likes to drink as healthier. >> he is actually -- if you go to youtube and search rob ford drunk, you'll find videos from a street festival, a very famous street to the east of downtown toronto, back in august, where he was kind of stumbling around, asking people if they wanted to go party, assuring people he wouldn't drive home, even though he had driven to the party. then there's the story of a legendary st. patrick's day party that took place in this city hall offices in which security guards say they saw him wandering the halls halls of cil with a half finished bottle of brandy. there were other issues that

involved a couple of women not on his immediate staff. >> yes, as you mentioned earlier, for a number of reasons, some of you listed, he still is pretty popular. >> reporter: it's bread and butter issues. comes down to the economy. rob ford is cutting taxes, trying to get rid of the fees that drive people crazy. he is a real retail politician. he'll sometimes go out and mediate a fence dispute between two neighbors, and he is very popular in the surrounding suburbs of the city of toronto. makes like north york. the folks downtown -- downtown is like chicago, because the further downtown you go the more expensive it gets. not your typical inner city. those people don't like him and think he is a national embarrassment. one current city council member with whom i used to work in toronto some years ago, adam vaughn, said he is a profoundly difference funkal person who -- difference funkal person who has

failed his way to the top. so people downtown don't like him, it in suburbs like him because the economy is doing well, and their taxes are lower than they have been. >> has he ever had attendance problems? does the fail to show up for work or shown up drunk? >> he shows up in a number of different states and does that when he goes out in public as well. the one thing that rob ford does, which kind of affects his attendance, he coaches a football team. a high school football team. and sometimes he has been known to leave city council meetings to coach the team. but there's no question, shep, he is a bombastic character, political bully, unlike most politicians that canada has ever seen. let alone the city of toronto, and canadaans are known for politicians who are bland, some say boring. this guy totally broke the mold among the politicians, but that's why regular folks like him so much. are they willing to cut him a break? unclear. but if he does, let's say, step

aside, gift his act together, he could stand for re-election. a lot of people in canada think he has a better than even chance of winning the second term. >> does he have political support in his own political apparatus to prop him up for a while in the middle of the storm? >> rob ford has something following him called ford nation. 22 to 25% of the electorate who are hard-core, hard and fast, set in concrete, never say die, i'll always be with you, voteres. but he needs more than that to win. should be noted that because canada doesn't slow directly for the prime minister, it's the party that wins the most votes, the person who leads the party becomes the prime minister, so each and all of the individual members in parliament getting very small slice of the vote. rob ford has had more people vote for hi directly than any other politician in canada. 350,000 to 360,000 votes in 20,

an awfully large number so he has a lot of people behind him. just a question of how many people will stay with im, depending on what he does here, and if he resigns doesn't matter who stays with him. >> what is his family and stepped family? what that their possession -- their position has been in. >> his lowest family member, his brother, doug, is a city council member as well who created a successful business in chicago and then moved back to toronto. doug ford may in some way be the catalyst for everything that is happening today. the two of them have a radio show on news talk 1010 they air on sunday, which which rob ford apologized for bad behavior. he didn't admit 0 smoking crack cocaine. said he had been hammered at this food festival. and then this morning, his brother, doug ford, went on the radio, and took a real swipe at toronto's police chief, bill blair, saying he ills the most political police chief the country has ever even, certainly

one senator asked this leader where the white house would support a bill to let all americans keep their current insurance. >> why not put the president's words into law and simply say, if you like the plan you have, we're not going to decide for you, you can decide it, use as an individual, if you like the plan you have, you can keep it without having to change a thing. >> they were given the option of renewing with a new plan , and yes, maybe some of the plans were more expensive, but i would encourage those individuals to go on the web site, take a look at what is available on the individual market in tennessee. i think you will see that the pricing in the individual market actually came in about 18% lower. >> the white house also would not say whether the president will back a bill to let folks keep their current insurance. lawmakers have introduced the bills in both houses of congress. peter doozey has this live from d.c. a lot of questions about the security of the web site. do we have any clarity? >> reporter: there are two main components to the federal

cuccinelli in the state of virginia fails to capture the governorship there this evening, the republicans will say these elections prove tea party republicans are failing to attract a wide enough section offed so voters, and terry mcauliffe has been roundtabling -- been labeling the republican as an extremist. >> obamacare is why this race is a horse race at this point. i was the first to fight and it terri mcauliffe didn't think it went far enough. a stark contrast. >> that's the line from his opponent, ken cuccinelli. he said he fought it as attorney general and the race it shaping up across the river. you look at what this could mean in virginia, and political analysts are saying, looking forward to elections in the future, especially when it comes to the mid-term election, turnout is expected to lower

than presidential elections. the u.s. supreme court taking off a bizarre case of a poison payback and the cheating husband. a tabloid soap opera for sure but raises questions including about how much power the federal government should have. here's the back story. a woman in philly says she decided to take revenge after she found out her husband was cheating on her with the best friend. the husband and the best friend had a baby together, so she was sure they were cheating. the wife says she used her skills as a microbiologist to whip up a chemical con cox containing arsenic. she sherrod the mess over the mail box the car and everything else of the friend, all places the victim would touch. seems the worst injury was nothing more than a burnt thumb. nothing else at all. bus it involved tampering with mail box, the feds got involved.

and listen to the charge they came up with. violating a treaty that regulates chemical weapons. the woman end up in federal prison, and that brings us to the arguments today before the supreme court. on one side the federal government, which claims the chemical weapons charges were the right call, on the other side, attorneys for the scorned woman who claim the government overreacted and that the feds should never have been involved in the first place in what was really a local domestic dispute. so the attorneys argue it's the constitution that sets the federal government's powers, not treaties. with us now, former federal prosecutor, ann marie mcavoy. this is weird. why not charge her with, in the stay, with, say, attempted murder? >> or given the injury, all she had to do actually was poured a little cold water over her finger. she didn't need in the treatment. it probably --

>> but, but, but, if i shoot at you ten times and i miss you ten times, you can still charge me with attempted murder. i was trying to murder you. >> but given what she did, putting it on door handles, this was never going to kill this woman. >> okay. >> you would normally be looking at an assault charge, harassment charges, state charges and that's what you would expect, and essentially that is what the arguments the woman before the supreme court are that's what she ooh have been charged with, not some use of chemical weapons and six years sentence, because the problem is now she is facing a six are-year sentence in federal court as opposed to perhaps three months to 25 months if she would have been looking at in the statement the bigger issue here, of course, is the federal government again usurping power from the states? normally the states have the power. somebody has a little problem like this, the state deals with it. now the federal comes in and say

we come in and say we have this treaty and we have to implement this international treaty that says it applies to chemicals and if you're not looking for peaceful purpose and it's not peaceful because she is trying hurt the other woman, therefore we have a right to handle a simple assault. >> it's absolutely incredible. i don't know how the supreme court will rule. bit i think it's safe to say that the intend of the treat ya was not to issue the whom who was mad about the husband having a baby with the friend. >> one of the justices said they were flabbergasted by the claim that the federal government had the right to come in and prosecute a case like this. normally there's some sort of federal issue, some sort of greater good, and clearly doesn't jibe with the legislators had in mind. it's a great example -- i teach at law school. i teach my students prosecutors have discretion and have to

exercise discretion when they are handling a case. sometimes you don't bring a case even though under the letter of the law you have a right to bring it. and here they brought the case under the letter of the current law they have the right to bring it, but there's a very good chance the supreme court is going to say, this is going be aon what is intended. >> good money on that. word today that your doctors may be liars. there's a study that shows their lies could actually be helping you so in that case a lie is good. and then there's toronto. where there really wasn't as much as a lie as an obfuscation. we're waiting for the mayor to talk about this crack-smoking habits and see if he decides it's time to not be mayor no mo. he may be 42 minutes late, but we can wait.
