load of the mayor of toronto, canada, accused of smoking crack and generally being out of control. >> have i tried it? probably in one of my drunken stupors. >> caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ >> hi, i'm bill o'reilly. thanks for watching us tonight. how obamacare is exacting american politics, that is the subject of this evening's talking points memo. last night in virginia terry mcauliff big fundraiser for bill clinton won won by a 5,000 votes. it wasn't supposed to be that close. it was against ken cuccinelli. according to 53% of dislike. 46% think it's fine. in new jersey the republican governor chris christie. had advice for president obama. >> don't be so cute.

and when you make a mistake, admit it it now, listen, if it was a mistake in 2009. if he was mistaken in 2009, 2010 on his understanding, of how the law would operate, then just admit it to people. you know what? i said it, i was wrong. i'm sorry. and we're going to try to fix it and make it better. i think people would give any leader in that circumstance a lot of credit for just owning up to it instead of now trying to -- don't lawyer it. people don't like lawyers. i'm a lawyer. they don't like them. >> governor christie is on the mark. mr. obama should just admit the fiasco that is the rollout of obamacare. delay the law for a year and give the folks a break. as we have seen, that is not likely to happen. the president does not have to run again. stubborn guy and thinks obamacare is terrific. is he not likely to compromise unless there is an uprising in the country. as we saw in virginia and here in new york city, the left wing may be shaky but it's still a force. the new mayor of new york is

bill deblazio who is almost radical left and many fear the city's improvements under republican mayors like rudy giuliani will collapse. that might not be fair but, believe me, there is grave concern in the police and business communities. but not on the part of the voters in new york city. the deblazio got 73% of the tally last night. so we are living in a confused time. most americans don't like obamacare but not enough to really bother the white house. it's clear they will try to tough out the whole thing despite embarrassing hearings like the one held today. >> the only thing i can conclude is that it's impossible to do something in this administration that gets you fired. it's impossible. you can lie to the american people, you can consistently misrepresent the facts, but it's impossible to get fired. >> those remarks by the senator directed to health and human services secretary kathleen sebelius. of course, she should resign but she will not.

summing up obamacare is having some impact on politics but not enough for the president to make any changes. and that's the memo. now for the top story tonight. reaction, joining us from reaction, fox news analyst charles krauthammer. so virginia now a liberal state, charles? >> it remains a purple state. it's up for grabs. the last time we enacted this play four years ago a republican won. i think the republicans had a weaker but obamacare was a very key issue. this is going to be the one lesson the democrats are going to take out of last night's elections and what you said is true. the white house, the president is not going to change. that's because he is not running again. so he will stay there. he will hang in there. he will pretend it's all going well. he will do all the surges or whatever. what you have to keep your eye on is the uprising.

it doesn't have the to be the uprising in the country. uprising among the democrats who have to run next year. 11 democrats in the senate who have signed on to a postponement, there is going to be an uprising if this continues and then obama is going to be at the crossroads. >> it will be interesting to see how that will be handled because we have ed henry coming up behind you by the way. is he going to tell us about the meeting today with some the democratic senators who have to run again apparently they are furious and cammeron and rosen are going to report after henry comes on. some kind of compromise. harry reid is blocking all of that my question to you is you know this better than i do is harry reid just attached to president obama at the hip, is he just going to take his orders and let these senators go down if the president doesn't want a compromise or does he have some kind of independence?

>> harry doesn't run next year so he doesn't have quite the urgency. i don't think he thinks he is going to lose his majority and he will probably want to stick with it look, after all, people remember harry reid, top of the list among liberal historians. that's his legacy as well. i think he is pretty stubborn. obama, who, again, who is not running again is going to stay with us because this is the first entry in the line on his obituary in history obamacare. if it's a failure that's how it will lead. you heard christie say look. >> then the senators will break away. then the democrats will break away. that's happened before. you can do it in the second term. in the first, it's really hard because you are going to get punished. you might need the president. president is going to be a lame duck next year anyway after the election. if it gets really bad as i think it likely then you will have the uprising that you are talking about. and it's going to be

localized, u.s. senate, u.s. house, democratic caucus. >> all right. now, you say as it likely will. so this is speculation, but, you know, once in a while you hit it, krauthammer, once in a while. so we will take a gamble. how is it going to get worse? >> two ways. well, i will put it in this way. for obamacare to work, two things have to happen. number one, they have to fix the web site by the end of the month, because, if it doesn't happen, there is going to be a calamity. there is going to be -- there is going to be calls for a one year delay or longer. and i'm not sure how likely it is. that is not easy to do. >> they have only got 17 days. you have got thanksgiving and all of that. >> right. >> got about 17 days to fix the damn thing. >> it's the entire architecture that's wrong. that's unlikely. there is a second unlikely hood here. that is this idea about the cancellation of the policies. people are waking up all over america in the hundreds of thousands, losing the

policy they liked, the one the president had promised them. how you get out of that, i'm not even sure there is a way. is there going to be, you know, in some states they may extend the deadline, but that isn't a solution. have you people with cancer, other diseases like their doctor. their lives hinge on staying with the team that is in charge of them. they are going to lose that they are going to have a hiked premium and they are going to have a higher deductible. these people are speaking out. you can see them in the mainstream interviews. it isn't only here on fox news although we predicted this months before. but, that -- i don't even know how they undo that. it could be at a postponement. it could be a sen sell legs. unless those two things are fix it's going to go down hill rapidly. >> something happening in the media last night as i said in the talking points people mow. those media people on television who are apologizing for president obama and obamacare, their ratings are falling at an

in the impact segment tonight as we told you in the talking points it was not an easy day for health and human services secretary kathleen sebelius. >> your main goal should have been to protect americans to lessen their risk and to ensure their safety. but, in your zeal to implement this law, not warnings, not advice, not counsel would deter from you implementing the exchanges. you have said america should hold you accountable which is why today, madam secretary, i repeat my request for you to resign. >> joining us now from washington kate obenshain a republican, and kirsten powers democrat and fox news analyst. so, the republicans are being too mean to ms. sebelius, kirsten? >> no, i don't think so. i don't think she should resign merely because they are in the middle of a crisis and i don't think it would help them to have her step away, but certainly the idea that she has done a bad job and she should be held accountable for it i don't think there is a lot to disagree about on that topic. look, the web site was a

we have had problems with her over other issues. but that's not the deal. the deal is that you hold people accountability to send a message to other people. this is taxpayer money. we are paying this money for a job she is not doing. >> i'm not sure that she is not going to be held accountable. more of a timing issue. when you need her in front of congress and need her answering these questions, does it make sense for her to be stepping down? >> you know, if i'm in charge, she is in honduras right now on vacation. >> the other point is she has been disingenuous. >> nobody cares about her. they care about -- they care about efficiency and being -- >> -- i think they should care about whether she lied about whether the web site was ready and safe and secure and whether the program was ready. >> she does what she is told to do. >> i completely agree with you, bill, i think accountability should be at the top. >> your brother, mark, right -- >> -- yeah. >> did he win the attorney generalship in virginia? >> he is up by 1100 votes. he is -- you know the

brought in 15 democratic senators who were up for re-election in 2014, the key being they are the ones who are going to have to defend obamacare. they are very nervous they are going to lose their seats over this and the president had to come in with the vice president jeffrey zions, web guru dealing with healthcare.gov. i'm told there was spicy back and forth folks pressing the president on why the web site wasn't ready and to give you a quick idea, one democrat mark beggats a democrat not a republican attack the president. a crisis in confidence in this administration in terms of rolling out healthcare. again, this is a supporter. these dradz are saying they want the law to work. they do not want to repeal the law. they want to figure out how it make it work. they think right now that the administration is just completely botched it. >> all right, now, this meeting wasn't on the president's schedule because we get that schedule they

possibly couldn't think they would have a meeting with 15 senators and nobody know about it. >> >> because i don't think they wanted to tip anybody off getting pictures of senators coming and going. after the meeting the democratic senators were blistering a lot of democrats saying and even you dal the president needs to do a safeguard privacy. that's the next big thing. democrats saying people are putting social security numbers in there. is it safe? is it secure? >> nobody knows. >> the bottom line is these are the guys up for election. the president doesn't face the voters again. and just last night you had had terry mcinclusive who had a big double digit lead in virginia all of a sudden

only won by a slim margin. >> we talked with krauthammer about that and certainly it's impacting. but, i want to know about president obama himself. i was surprised that he went out this week and kind of tried to explain how he mislead the country in this way that he just got more criticism for everybody is calling him a liar and he goes out and won't admit any wrongdoing at all. i haven't heard the president admit anything well it's screwed up but we will fix it. >> i have talked to several senior democrats who have been in a meeting with the president. they tell me they don't think the president lied. they think he probably should have been clearer about who was going to get kicked off the plan and not. but they say look, forget about the past. moving forward, you are right. they can't believe that he just just in their words rip the band-aid off and say we weren't clear enough here moving forward is what is going to happen. >> why did he do that? is it his personality? is he stubborn? >> the sense i'm getting from democrats on the hill is that the white house is

>> washington beat segment tonight, it's all about obamacare right now. joining us from the nation's capitol ace reporters james rosen and carl cameron. we hear about some bills. mark row rubio manchin much to delay obamacare what's the inside story on that. >> there is a bunch of them. they do different things. marco rubio of florida his would essentially delay obamacare for a full year. joe manchin the democrat from west virginia would delay the penalty for the individual mandate so if you don't sign up you don't have to pay that fine. there is a democrat from louisiana mary landrieu who wants to put together a bill that would make sure if you like your insurance you you can keep it a democrat who is upset that the president's pledge to do that hasn't exactly come to fruition. jeanne shaheen liberal democrat from new hampshire who wants to postpone the

enrollment deadline. all these things and there are variations of them are going to see some serious obstacles getting to the floor and the senate because harry reid the democrat isn't really committing to it. the president doesn't want to see any delays. they want to see this f. they can push this thing to the march 231st deadline. it's a bit of a dead lock which means the democrats have to go home waiving these bills or proposals that they hope to some day be bills and tell their constituents though h. who are upset with obamacare they are trying ting make a difference even though the democratic leadership has no doing so. >> roll the tape. >> will you give mary landrieu a vote on her legislation that would force insurer who have cancelled their policy to reinstate their policy. >> well, we have to see where, you know, there are hundreds of bills introduced every week and we have to sort through those that have opportunity to be voted on. >> all right, so that's a no. >> bill, that is a perfect invitation for any senator

to say well, i only have one other recourse, i feel strongly about this issue. i will therefore execute my senatorial right to shut down the senate with a filibuster and fight for my principles and make sure nothing else happens until these changes get fixed. republicans do that. don't count on democrats doing it. >> is it a crisis, cammeron. is it a crisis now in the democratic precincts? do they feel that the whole thing is beyond salvation, at least in the short-term? >> well, for all the democrats who are up for re-election, the term sort of ends on election day 2014. and what they are seeing already is barrages of attack ads coming from independent super pacs and opponents in the case of mark prior in arkansas. buchanan has been hammering him for quite some time. in each cases there are marvelous old sound bites if you like your insurance you can keep it like the president said and now they are being slammed. >> now they are hanging around their neck. rosen, from your perspective, is there anything going to happen?

you know, look, we can complain and we do all day long that this thing isn't ready for prime time. the americans are getting hurt. but, the folks now i think got it. most people don't like the law and they believe that president obama either lied or mislead them, depending on their point of view. anything going to happen in your opinion, rosen? >> no one needs fox news to attach the label of crisis to the obamacare rollout. senator barbara mccull ski of maryland, one of the most liberal democrats in the senate this week said that the rollout has produced a crisis of confidence. and i have spoken to a number of influential democratic strategists on the hill who tell me that the anxiety level amongst democrats is rising rapidly because of the way this is unfolding. they are watching jay cancery's white house briefings which are becoming increasingly painful exercises for all concerned. and they are seeing that they're not getting the information they need to go out and fight on behalf of

president obama. one democratic strategist told me that he chalks it it up to the insulatory of the president, bunker like mentality over there some are wondering if the second term staff of the president is up to the task like the first term was. they even told me for example earlier this week we saw the president at a dinner of supporters here in washington amend his famous pledge. he said we didn't just say i'm paraphrasing him but faithfully, bill. we didn't just if you like your plan you can keep it if it doesn't get changed after the law becomes the law. the democrats were given no hezbollah up that the president was going to tweet his pledge that way. they received no guidance from the white house. >> isn't it true though, rosen, that the obama white house for five years and today is the fifth -- you know his fifth year. we have three more to go. they never reached out to anybody though. he doesn't govern that way.

basically it's this is what we are going to do. you democrats say fine and republicans oppose. pass with not one republican vote. not one. >> to the agencies, the state department feels the same way. things get decided in the white house and then rolled out. usually with some guidance of some kind. and so one the key things to look for here is senator reid, as you just showed that clip, if and when he becomes more susceptible to bringing something to the floor, that's going to show that there was real up rest in the democratic caucus can. and also there is a reapprehension. >> i only have 10 seconds. what are the odds of reid ever bringing any kind of delay zero, right sphrnchts right now less than 50, 50. bug thing is going to happen. >> way less than 50/50. >> when they release these enrollment numbers for the first time and, again, democrats are saying we don't have -- you are not briefing us in advance. how are we going to defend this. >> all right, gentlemen, we appreciate it it when we come right back, it it will be miller time. the d man turning 60 years old this week. is he in full panic mode.
