[ bleep ]. >> you are about to enter the no spin zone. the "factor" begins right now. hi, i'm bill o'reilly. thanks for watching us tonight. president obama in a big bind. that is the subject of this evening's talking points memo. last night the president apologized for not being more direct with the american people about obama care. but it was really a nothing statement, and he had to do it. with anger growing across the country and democratic politicians very angry, mr. obama finally admitted some culpability. >> i am sorry that they, you know, are finding themselves in this situation based on assurances they got from me. we've got to work hard to make sure that they know we hear them and that we're going to do everything we can to deal with folks who find themselves in a

tough position as a consequence of this. >> when pressed to explain what happens now, the president fell back on his playbook. >> my job right now is to make sure that with what we have, we get it done, we get it fixed and, you know, there are going to be some lessons learned. >> lessons learned and we'll get it fixed. where have we heard that before? >> i can tell you that if you've got the irs operating in anything less than a neutral and nonpartisan way, then that is outrageous, it is contrary to our traditions, and people have to be held accountable and it's got to be fixed. when it comes to this issue, when i saw that we are going to find out factually what happened, everybody will be held accountable. >> no one was held accountable for benghazi and no one has been held account l bl for the reploshl rollout of obama care. in an irony, dylan rattigan who

used to work for msnbc, "i bought a catastrophic health care plan for $170 a month when i left msnbc. obama care canceled the policy. new rate, $600 a month. thanks, mr. president." i wonder if he'll lead with that over there. the unattended consequences of obama care are beginning to be felt by americans. every day, thousands of us are having to deal with dramatic change and often dramatic new expense. this cannot turn out well for the president, or for the democratic party no matter what they say. but, again, talks points urging fairness in the reporting of obama care, not partisan hysteria. americans now in the middle of an intense political war between big government people and small government folks. and the winner of that war will be the side that tells the truth and states the facts. whatever they may be. and that the memo. now for the top story tonight. "consumer reports" magazine is a

trusted name in the usa. it's generally been supportive of obama care writing the best place to secure health insurance is through the state marketplace websites. now, that has angered many anti-obama care folks. "consumer reports" was able to provide a spokesperson tonight. joining us from dallas, jim stone, president of meticus, private business that does health care consulting. what are you hearing from doctors about obama care, mr. stone? >> well, first thank you for having me on. we are hearing anecdotal information that physicians are scared. there's a lot of uncertainty as to how it's going to affect their practice. and their income going forward. for the last three years, we've done a survey of physicians and asking about practice preferences and whatnot and we've included references to obama care and the affordable care act, and in our last survey, which i believe you have a copy of, more than 50% of the physicians we surveyed gave the

measure a "d" or "f." >> okay. >> generally i think it's very negative. >> now, the reason they are flunking obama care is what? the primary reasons that doctors don't like it? >> well, two questions we asked were, number one, does it provide greater access to patient care? number two, does it decrease the overall cost of health care? and on those two measures, they specifically, well, 50% of them gave it a "d" or "f." >> are they in a position to know, are american doctors in a position to know, because the new law really hasn't kicked in yet? is this just conjecture on their part? >> yeah, i think that's a great question. and the answer is absolutely yes. physicians are gravitating more toward hospital employed opportunities where they feel there's potentially a safe harbor for them. they don't want to deal with the decrease imburstments and increased regulation. >> they want to go on salary the

a hospital and a have an income coming in. i think the paperwork is going to be massive. another thing you had in your study, in your analysis was there are going to be a lot of american doctors retiring and they're not going to be replaced then you have 30 million more people coming into the health care insurance system. which looks to me to be a disaster coming down the highway. >> yeah, i mean, hhs did a survey that they released that predicted that 268,000 physicians will be retiring over the next ten years. those physicians are 55 and older. they're baby boomers. and at the same time, we've got half residency rates which is where we train our physicians, at about 15,000 per year. so 26,000 leaving and 15,000 coming in, you've got an issue. there was also a survey done a couple of years ago by the journal of the american medical association that suggest eed general physicians work five hours fewer per week now than

ten years ago which when you multiply that over the 800,000 physicians we have that equates to fewer physicians right there. yeah, there are major issues associated with supply. >> in canada and great britain which have socialized medicine, there are long, long waits to see, not only specialists, but primary care physicians. so it looks to me like another unintended consequence of obama care is going to be that people are going to have to wait a long time for an appointment. am i wrong? >> well, if you look at the history of spending on health care in the united states, the only time that it hasn't been ridiculously high rates of growth was in the mid to late '90s when we had the hmo gatekeeper model and that was essentially a way to ration care. if i hurt my knee on a saturday, i had to wait to see my internist on a monday to get a referral to an orthopedic surgeon. it's going to function in a similar fashion.

health care employers and providers are going to be provided a certain amount of money they're supposed to provide care for patients and to have unlimited access to physicians has obviously proven that we just continue to spend and spend and spend, and it is unsustainable for sure. >> i'm going to assume we'll have to wait longer unless we go to the boutique doctors. that's my last question for you. looks to me a like a lot of doctors in affluent areas are going to say i'm not going to participate in medicaid and medicare. i'm going to open up a boutique practice where i'll charge higher rates to the wealthy people, they come in whenever they want, i might visit their home. whatever it might be. do you see that trend developing? >> yeah. concierge medicine is what we call it. and definitely there is a trend in that direction. there are a number of physicians across the united states, tens of thousands of physicians, that have stopped taking insurance altogether. >> yeah. >> you pay an annual fee to be able to have access to a physician, and, you know, have

anchor, lou dobbs. isn't this interesting that the stock market, guys like you and i have portfolios, and mine's making money and i'm sure yours is, too. >> twice as much. >> yeah, you're twice as smarter, so that's the way it goes. then the working guy doesn't have a lot of dispose bl income to buy stocks. >> absolutely. >> their position is going down and down and down and down. >> the dow jones industrial is up 20%. >> just this year. >> year to date. the s&p 500 up 23%. the unemployment rate is 7.3%. it's moved from 7.9% in january to 7.3%. the labor force participation rate, the number of us by percentage of population working, has dropped to a 35-year low. 62 -- >> people are giving up. >> we have more people underemployed, unemployed in this country. >> part time. >> 14% of the country is in that

category. and we are taxing jobs. the effect of obama care is to tax jobs. to create part-time jobs. we have stagnant wages over the course of three decades. >> i know. i mean, this is the irony of this whole thing. president obama's primary goal in his life -- >> right. >> -- is to redistribute income assets. right? >> right. >> you agree? i think nobody can disagree with that. he came into office with the belief that he was going to make the usa more fair economically. that is, bring the wealthy closer to the working people. he has done the exactly the opposite. the fat cats are making more money than ever before. all right? and the workers are making less money. >> he's raised taxes through obama care, through taxes on capital gains. raising the income tax rate. none of this is a tax on wealth, itself. and i'm not trying to give him,

i assure you, any ideas. >> if you die tomorrow, dobbs, they're coming with a truck to your house. you're lucky you have a motor scooter left after they get through with you. >> the fact of the matter is, i'm going to resist -- >> don't die. that's how they get it. >> the truth is, we are watching companies in this country do no more investment in plants and factories. they're buying back their stock. and everybody's making a bundle. the effect of a stock buyback is reduce the number of shares in a market that does not reduce demand. the fed puts out another trillion dollars a year and next thing you know the market keeps rising and rising without necessarily improving earnings. >> let's get back to -- >> or creating jobs. >> let's get back to the folks. five years president obama's been in office and median income is down in five years. >> right. >> so obviously 31%, i don't even know who these 31% are, think he's doing a good job in the economy. they must be you. you and me. the stock market guys.

the fat cats. >> it's sure not me. i would like to see the middle class in this country prosper. i would like to see people who aspire -- >> the wage earner can't unless there's more jobs and competition. >> exactly. >> for that earner. >> why does this elude the president of the united states? >> i've been saying tha ining t years, you have to have more jobs to drive rages up. now they want a $10 an hour minimum wage. >> now the jobs that aren't being created will pay more than the folks who can't find a job should have expected five years ago. >> what that will do is the $10 minimum wage, this is for you, ralph nader, okay, that will make fewer jobs. >> absolutely. >> the people at the bottom will go, look, i'll do without so-and-so and so-and-so because i don't want to pay that much money. >> it's a simple matter. this president is taxing wealth. he's taxing income. he is taxing jobs. and instead of talking positively and strongly about the direction of the country,

and respotoring prosperity -- >> he wants the feds to run the economy. just like he wants the feds to run the medical system. >> he says that he's not -- he doesn't know how to code, therefore he's not responsible for healthcare.gov's debacle. but the truth is, he is the president. >> he's the leader. >> he's got that responsibility which he is failing miserably. >> finally, finally, most, many americans are living paycheck to paycheck and the paycheck's shrinking. this is a recipe for anger and disaster. every society in history has had the folks, you know, be destitute. all right, has risen up. i mean, there's been big trouble. is that's what's on our horizon? >> i think there's a very good case to be made we are looking at the prospect of civil unrest. we're looking at a population of americans that have never had to deal with the fact that 50% are living in poverty. that 50% of the folks out there, 5 50 million of the folks tsh. >> they're getting entitlements.

in the impact segment tonight, the tea party versus the republican party. in virginia, tea party guy ken cuccinelli lost his bid for governor. exit polling shows that 28% of virginia voters support the tea party. 42% oppose. 28% are neutral. meantime in new jersey, moderate republican governor chris christie won re-election easily. joining us from boynton beach, florida, allen west who generally supports the tea

party. did the virginia numbers concern you, mr. west? >> no, they don't so much concern me, bill, because i think that if you've been demonized in an organization like we've seen that happen with the tea party, you're going to see those numbers reflect such. if you are to take that same poll and go out and talk about excessive government spending, or growing debt, if you were to talk about onerous taxation, or small business growth and development, or even talk about national security, i think that you would see people supporting those physicians in a positive way. >> here's the problem. here's the problem. i think you're right about the perception of the tea party. it's shaped by a hostile media. there's no spokesperson for the tea party. it's fragmented by design. by design. it's a state-run grassroots movement. there's nobody to fight back on the national level to get the message out that the tea party isn't a subversive organization. it's an organization that has these set of beliefs that reflect a lot of people's beliefs system. but the gop, the republican

party, there's a fierce debate and war inside that party. chris christie and jeb bush and the moderate faction. versus rand paul and ted cruz. and they are still loggerheads. i'm not sure how that's going to play out. >> it comes back to leadership, bill. that's the very simple thing. the tea party believes in this decentralization but that can lead to fragmentation. they need a strategic marketing and communications plan. most importantly, these people should sit down at a table and come up with a platform. a platform that talks about what they are for, not so much what they are against. >> that would take a cohesive organization, a lot of money enthen they don't see that. here's something else coming down the pike that everybody should be aware of. immigration reform. now, the tea party is not going to want that. all right? they're not going to want, and i'm speaki ining generally now, they're not going to want to give illegal aliens anything.

the moderate wing of the republican party, john mccain, they do want it, saying and rightly so, we've got to convince hispanic-americans to give us a look. if you're going to say no on immigration reform, you got to tick them out of the country and that's it. we're doomed. so now you're going to have another issue, and believe me, president obama, the only way he gets out of obama care is by making the immigration thing. and he's going to do everything he can to get that in the forefront. but then you have another battle between the moderates and the tea party. >> yeah, you're absolutely right. the president is going to pivot away from that because that's more politics than policy. let's look at what governor chris christie did up in new jersey that was successful for him and gave him the black vote. he came out very strongly on school choice and he got the black ministers associations vote. then in washington, d.c., i attended a rally where you had democrats, black democrats, that

understood the adverse effects immigration reform as it is written would have on the black community as far as unemployment, further depressing their wages. so there are ways we can have the right policy solutions if we just sat down and came together on this instead of being two ships passing in the night. >> i don't know if the moderate wing of the republican party is ever going to reach detaunt with the tea party over immigration. it's too emotional and bitter. believe me, the democratic party and hillary clinton in particular savoring that. peel off the hispanic vote and they win. republicans need 40% of hispanic-americans to vote the gop in order to get the presidency back. that's what they need. if the republican party opposes immigration reform, as the tea party will, doomed. >> well, i don't think you have to sit back and say we're just going to grant amnesty. i really do believe that you can have a tiered type of plan. we can get to the point where we

have a guest worker program. most important, what are the values of the hispanic community? talk about their communities, talk about their families. >> marco rubio is doing that. would you be, say you were approached, because i know you have associations with some. would you be willing to be the leader of the tea party? would that be something that interests you? >> well, i mean, if people come to me, i will do that. of course, i give the opportunity to go around the country and speak. i'll be out in utah and speaking at northwestern university next week. i'll take that message on the road. >> all right. mr. west, thank you very much. plenty more ahead. more trouble for the miami dolphins over a player accused of violent connect. later, mcguirk had the edge of the week and will comme you're givi away pie? would you like apple or cherry? cherry. oil...or cream? definitely cream. tonight the story just keeps getting worse for the miami dolphins in the national football league. offensive lineman richie incognito has been suspended after a teammate accused him of making threats and using racial invective. a florida woman has filed a police report saying incognito assaulted her with a golf club. here to explain further, geraldo rivera. i don't want to convict this guy on tv. once some bad stuff happens, then people come out of the woodwork with accusations. you know how it goes. all right? but this latest thing, now, is apart from the dolphins. what's going on? >> it predates everything having to do with the alleged bullying.

i have severe reservations, i have to say, about the bullying. i hope we double back to that. >> okay. >> this happened in may of 2012. allegedly. allegedly happened. there is a police report and there are some witnesses and we actually have the actual document, the police report. the miami dolphins have an annual golf tournament at the notorious turnberry isle resort. it's where gary hart and donna rice did the monkey business. it has kind of a racy reputation. they do their golf tournament there and every hole, you know the way those charity golf tournaments work, every hole has a monitor, a volunteer that, whether it's the longest drive, the closest putt. >> right, so this woman was doing that. >> she's a volunteer. richie incognito, apparently this boisterous larger than life some say bully, others just say a fellow well meant, took his golf club apparently and used it

to physically molest allegedly this volunteer in the bar. he ran it up and down her private parts. >> and he was allegedly intoxicated. >> he was definitely allegedly intoxicated. he rubbed himself against her, et cetera. she complained to dolphins authorities and people at turnberry. she went to the aventura local police department and filed a report. no criminal charges were ever brought. as far as we know -- >> this was 2012. >> may 2012. >> okay. now, you fast forward up to, and you say you have reservations. >> i do. >> there's a tape of this guy calling up one of his teammates using racial invective and another tape of him in a barroom and he's been thrown off three football teams prior. i mean, there comes a point where, and i said when i saw this tape, this looks like a e violent guy. you don't want to get in front of this guy when he's doing this stuff. he's drunk, using the "n" word

in this tape. i don't know, are people apologizing for him? that makes me uneasy here. >> well, you knows you and i are the fathers of small children. bullying is an awful problem in this country. and i see, you know, how hard schools work to protect children against bullying. to warn potential bullies against that. there's the bullying of exclusion. you're not invited to the party. there's the bullying where you can't sit at the cool table. there's bullies and it has a corrosive, awful effect on a youngster. to use that language -- >> maybe bullying is the wrong word. >> in the context of this testosterone-fueled macho world where we want them to be psyched, we pay them, we cheer them on. >> i will see that probably bullying isn't the right description. this is emotional assault on this guy. that's the way i see it. >> i reject that -- >> no, no, if everything is true, and what this incognito guy was doing was incessantly mocking him about his race and everything else, and there is

proof that he was, all right? and here's the guy, william martin, jonathan martin, who left the team. now, you can say he's soft, he should have taken it and allegedly the general manager, the dolphins said, martin should have punched him in the face and all that business. this is a workplace. yes, it's a national football league. but it's off the field. and you're having some guy who's out of control, he's got a previous history of being expelled from three teams. >> i don't know about his previous suspensions, but -- >> want me to tell you about it or what? >> i saw a movie called "a league of their own." remember, tom hanks, no crying in baseball. there's no crying in football. jonathan martin was drafted -- >> all right. okay. i got it. but i think this goes over the line. look, you see this aaron hernandez up in new england charged with murder. all right? now, the patriots knew this was a bad guy. they knew he was a thug. nobody knew he was going to allegedly commit murder. nobody knew that. but you've got to run your

organization, particularly a billion-dollar industry with responsibility. >> i get it. i get it. hernandez is a thug, alleged murderer. that's a whole different story. >> sure, but this guy, he's on the road. >> you know, "sports illustrated" just tonight came out with an article by lydon mertha that jonathan martin replaced on that line. mertha says pointblank, i was there three years, jonathan martin was never bullied by richie incognito. incognito is larger than life, the guy who gets everybody going. do you see these football players? they knock their heads against the wall to psych themselves up. for him to make this complaint is -- >> wait a minute, wait a minute. so you have a bunch of players sticking up for incognito. >> they're virtually all black and white together. >> that's fine. that's on the record. they're sticking up for him. he's thrown off three teams. he has a police report against him by a young woman.
