it is not clear they will down grade the stock pile of higher enriched uranium. the iranians have 440 pounds of the higher enriched uranium. if they 100 more, they would have enough for a single nuclear war head. talks in geneva that looked so promising when secretary kerry and others made their way to switzerland grind on. >> did people start it listen to israel? they are having a new's conference in geneva, switzerland. they have now just said that they will take a break and reconvene on november 20th. and so still a lot to talk about. people rushed to dpshgs eneva hoping to see a deal. and then a break until the 20th of the month and wol keep you posted if anything else changes.

testimony wont be credible on the stand. they want to know who broke the judge's gag order. the judge said don't talk about the evidence and that's what this is all about. >> will the new york shield law as you understand it protect her? >> that's what the albany case on tuesday is all about. basically colorado wants jana there. new york has a much stronger field law than colorado. in other words, jana would be much better protected in new york than she would be in colorado in terms of having to give up her sources and colorado asked new york to turn her over to them. what the highest court and state court in new york is going to listen to is that issue. should she deserve the protection she would have in new york? >> what is at stake for her?

>> we talk about 85 days in jail. are we looking for that potential time for her? >> we are looking until the end of the grand jury and depends on what the judge wants and the prosecution wants. these things are never clear and that's why my concern about what is happening is that jana could face an indeterminate amount of time in jail until the end of the grand jury. she shouldn't have to choose tone protecting her sources and doing her job. and becomely, that's the choice she's having to make. she is a very tough, and a very brave reporter. she and i have talked about the choice i made. i know that she's ready to go to jail to protect her source if she has to. i think all of us in our profession thinks she shouldn't have to make that choice. >> i am looking at the twitter

page. no one will talk with reporters and we'll not know details on stories that americans need to know about if we have to give up our sources. i know a judge in new york wrote words in defense of winter. do you think that can help? >> i think there was a lower court ruling and a powerful defense by the judge sacks. and he basically said that you know, a free press depends on confidentiality and courses. and of course, jana should have the benefit of doubt on that and protected by the new york shield law and shouldn't have to go back to colorado. but the problem is, this was a defensive opinion and minority view. most of the lower court ruled that she should go back to colorado. she in the moment is in considerable legal jeopardy. >> i know you have had a long

time since. 85 days behip bars, judy. did you say to yourself i will give up my sources and go home? >> for the reason you talked about harris, i couldn't do. that i am an investigative reporter and i say to people every day and we all do, trust me, if you tell me something you are not supposed to tell me, i will protect you. people out there don't believe us, then our credibility is shot and i couldn't work and jana said the same thing in the very moving affidavit that she wrote. you know, really our job being independent press and depends on the people knowing that we will do what i had to do and i hope jana doesn't have to do. >> i know she is watching and has been tweeting about it. what would you say this evening. this could ruin her career.

and what would you say to her as a young journalist. >> no one can make the decision for her. it is the toughest decision you have to make and i think that jana believes strongly in being a good journalist and the kind of person people want to trust that she is willing to make the decision and go to jail. i don't think in a democracy like ours, we ought to put journalist in jail. >> that's what happens in china and saudi arabia and countries that don't have free and independent presses and judiciary that is determined to protect people and protect that first amendment. i mean, there is a reason that freedom and speech and press is for the bill of rights and we ought to remember that as we face the moment on tuesday. and in january when jana is scheduled to appear in colorado

this is following three days of new yorks with iran and western countries over curbing the nuclear program. he said this, each day there is no agreement about that nuclear weapon's program, iran moves forward with making nukes. and he said the talks ended in the past hour. we know he rushed there yesterday because it looked like something was imminent. and obviously that did not play out. and we heard context from israel prime minister on the kind of deal they were considering and it gave way too much to iran and we needed to talk things back as western allies. secretary kerry called the meeting interesting and productive. they are going to take a bit of a breather and not reconvene until november 20th. and i would imagine israel's
