we'll go get drupg abonk. >> yes, i have. >> thanks for inviting us into your home tonight. that's it for special report. i'm chris wallace here in washington. greta goes on the record right now. a new fix or another fumble? >> the rollout has been rough, that's on us. that's on me. it's on us. we fumbled the rollout. >> it's not just a broken website now. it's a broken pledge. >> two fumbles on a big game. i said that i would do everything we can to fix this problem and today i'm offering an idea that will help do it. >> no one can identify anything that the president could do to keep his pledge that is both legal and effective. >> think of a belt and suspenders. what the belt will put forth will be one and what we will do will be the other. >> what we see is a political

band-aid, it is not a solution. >> insurers can stepped the current plan that would otherwise be canceled into 2014 and americans whose plans have been canceled can choose to reenroll. this fix won't solve every person for every person. >> let's be clear, the only person to fully protect the american people is to scrap this law once and for all. there is no way to fix this. >> good evening, greta. >> of course the main question, what does this do for the people, those who have had their policies canceled. second question, what does it do for president obama politically. third, about those in the 2014 midterm democrats. so let's start first with the substance of what president obama said today. what do you think? >> this does little or nothing for people who have had their plans canceled. these plans have gone away. these companies have spent several years preparing themselves to bring all of their plans in to compliance with the

requirements of the affordable care act. and these plans were not comp compliant and were canceled. what company will bring back a plan knowing it has one year and then it will have to cancel it again. this is all about politics. state insurance commissioners get it. we've had the washington insurance state commissioner say we're not going to do this. it'sle not clear what authority the president has to do this. so what it will do for people is action or nothing. these plans are gone and few of them will come back. >> i raised the question the president's authority. for all the law students out there, 1952 case which probably the case we'll all be talking about the next few days about whether the president has overstepped his -- he's the one who is supposed to execute the law. but can he legislate it, which is of course the purview of congress. that will be a hot discussion. >> right. this will also cause higher premiums in 2015. because what's going to happen is if people somehow find a way to stay in a nonqualified plan,

that means that it will probably tend to be younger and healthier and hence the population that goes to the exchanges will be what we have a hint of, which is older less healthy. between february and june of next year, insurance companies have to figure out what their premiums will be for 2015 and they will look at a population that justifies a higher premium. and as a result, anybody who then tries to stein ign up aftet would maypay a higher premium. president obama said today i like my red state democrat senators and i want to try to keep them. but it's all about politics. kick the issue beyond the 2014 election and all those people who lost their policies thus far, if there's any way they can get help bacthem back, they wil them again in 2015. >> he actually sort of dumped it on the individual state commissioners. he basically said here is the

fix, here's what i want to do. you state commissioners carry it out and if you don't, it's on you. >> exactly. and that allows him to blame somebody else, blame the insurance commissioners and blame the insurance companies. there is one other thing about this that caught my eye. here is the three page letter that the cms, centers for medicare and medicaid services sent out today. on page three is a thinly described illegal bribe. it says though this transition policy was not anticipated by health insurers when setting rates, the risk corridor program should help unintended revenue. the risk corridor program is a program you can get on cms risk corridor program and drawdown this document and look at it yourself. but what it says is that for the transition from where we were to the affordable care act, the federal government can give money to insurance companies to

help them adjust and stabilize some of their premium payments if they get too many sick and older. but it has to be for qualified health plans. on the third page, if scissot s recipients are qualified health plans. it talks about section 1342 and section 1343, both of which only apply to nongrand fathered individual and small group plans inside and outside the exchanges. qualified health plans that meet the new obama care standards. but what they're saying in this letter is we'll try to find a way to bribe the insurance companies to bring these back by promising that we'll give them bonus payments, not allowed under the law, not anticipated under the law, but try to bribe them to bring the plans back. >> where are they getting the money? complaint ju

can't just pull it out of the hat. >> the law set up two pockets of money, one pocket goes to reimburse the treasury for lost revenue. the other goes to the companies themselves. $10 billion in $2014, 6 billion in 2015. they charge a tax on every insurance policy. the president will get that $18 billion by basically taxing everybody's insurance policy and then give it back to the insurance companies to make up for his mistake. and again, he doesn't have the authority in my reading for do it because this program only applies to qualified health plans, which is exactly why these policies are having to be canceled because they don't meet the higher more expensive, more extensive benefit requirements and mandates of the affordable care act. >> the president's statement today, he said he's sorry again. is it enough and how many times two we make him say sorry for what was clearly -- it was

either a lie or a mistake or i guess you could say soften it like the "new york times" and say it's something else. but how many times do we keep asking this question about his previous statements about the promise? >> well, it's insufficient for the people who will lose their coverage. and this is not going to stop and do anything much if at all for the 5 million people who have already lost their coverage and it won't do anything to stem the losses next year. there was a study done which suggest has between 32 million and 52 million insurance policies will have to be canceled because they fail to meet the standards of the affordable care act. and remember, those policies generally cover multiple people. they generally cover families. so husband and wife, children. well in excess of 32 million to 52 million people and that will be playing out all next year. p if the policy is not

president obama announcing his administrative fix and fred upton calling for the president to work with them, not away them. he joins us. good evening, sir. >> how are you? >> very well. so does the president have the authority to do this administrative fix and how is your bill tomorrow different from what the president proposed to do today? >> well, a couple things. we do think he needs a law to change it. we want to send quickly as we can particularly as most of us, all of us came back from our districts from a week of listening to angry constituents who had gotten the letter saying their individual policy had been canceled. our bill is a little bit different than what he's done. hey, i confess that i oppose obama care. i thought the president's health care bill was a lousy one.

but what we ought to be doing is allowing folks to keep their plan as the president said from the very beginning. and that's what we do. and we allow -- if a plan was in essence authorized or met the test earlier this year, it is available for anyone that wants to get that plan. >> so yours is forever -- >> no, for one year. >> then how -- his is for one year, as well. >> but what he does is he discriminates against folks who might want the seam plan as their neighbor or somebody else had a different plan. >> so you have to be in the plan to begin with. you can't just admire someone else's a plan and say i want that one, too. >> ours, if a plan met the test, anyone can purchase it. his plan from what i understand, just people that had it and nobody else. so it really discriminates against other folks. >> do you expect to get democrats tomorrow and does the

president's offer of democrats ? >> well, i'll say this. before he gave his announcement about noon today, we were positioning that we might gets as many as 90, 100, maybe more democrats with us. a number of democrats did co-sponsor our bill. all along i thought we'd get at least 40 or 50. so that's my thinking. but nobody's whipped it. we'll see how things are and we'll vote on it probably early afternoon tomorrow. >> does the president have authority to do thissed ed a m d administrative fix? he can tinker with it a little bit, but he can't step on the length la legislative powers of congress. >> here we go again. we want certainty to this. who is to say he doesn't change his mind a week or two or maybe even a few months down the road.

our bill we think fixes or allows the problem to be resolved. and so many americans -- i read -- i told the story of one family in my district in bangor, michigan whose rates in essence doubled. the tee deductible goes up. and come january, they have to find something else. >> i guess it doesn't -- i'm waiting for the one kuwoone constitutional scholar that can tell me whether this will does overstep -- i don't know the answer. >> that's why our bill is a better answer. who knows how his executive order will be tested, is itting for going to be allowed to stand in court or not. ours sends a signal. our leadership scheduled our bill literally within five or six legislative days from the day that it was introduced to get it on the house floor. we're trying to do it quickly to send the message not only to the insurance company but also the

the insurance commissioners have the power to reject president obama's new plan and already washington state's insurance commissioner is doing just that. so why is washington state's insurance commissioner saying no to the president's administrative fix today? >> this is pretty interesting because we know that washington is a liberal state when it comes to insurance regulations, so people might expect that they would follow the white house on this one. but in fact washington is going against president obama because they argue that the consumer protections under the affordable care act are too important to waive for one year. they want everyone in the individual and small group markets to be on plans that

abide by obama care's new rules and they won't make any exceptions. >> and arkansas another state commissioner we've heard from tonight. by the way the washington commissioner is a democrat. but how about arkansas? >> arkansas also is very interesting, another state where insurance regulations can really go back and forth in terms of the politics. but they're also saying that they don't want to waive any exceptions for these insurance plans that are changing under obama care. and that could create a backlash among people seeing their plans canceled. they could appeal to these insurance commissioners and say why don't you back up president obama on this one. but i think the real key here is seeing what individual insurance companies do in other states because they're really going to be looking to these regulators for cues on where to go. p. >> how about insurance companies themselves, do they like the idea of resurrecting the canceled policies? >> no, they know the policies won't be profitable for them in a post-obama care world. and they put out a very strong

statement today while president obama was in fact still explaining his plan, of course his press conference was pretty long and they put it out in the middle saying we've basically had enough. they said that this will possibly raise premiums across the individual insurance market. they said it will be disruptive to their business. and it could cause chaos in the marketplace which would only reflect poorly on insurance companies. >> and the reaction among democrats on capitol hill, seems a little luke warm. >> that's right. democrats on capitol hill, some of them like it, some of them want to see the administration go even further. for example, senator mary landrieu, a democrat from louisiana, who we know is facing a very tough re-election race, is saying she wants insurance companies to be mandated to continue offering whatever health policies people continue to pay premiums for in perpetuity, which would really put republicans in a tough spot because that's an insurance mandate to insure people keep their plans. >> and senator shaheen of new

pipeline explosion in the city of milford. fortunately nobody was hurt and all workers are accounted for, but the giant fire forcing residents and schoolchildren to evacuate. fire crews are now letting the fire burn off on its own, so it will be a while before people can return home. and in florida, a giant sinkhole causes parts of into homes to collapse and swallowing a boat in a backyard pool. the sinkhole was discovered this morning. and in just hours, it grew to 70 feet wide. no one was hurt, but nearby residents also evacuated. and that's tonight's speed read. now more on today's top story. president obama offering what he considers a fix to the giant canceled insurance problem. but the president still getting grilled about his repeated and broken promise if you leike you plan, you can keep it. here is part of president obama's exchange with major

what we saw on the president's part today is a tactical move or a strategic move because he's in a very bad place that he put himself into. >> there's a part of what the president said caught my attention and it was actually on the other issue and that was the website. he said, okay, on the website, i was not informed directly that the website would not be working as it was supposed to. he wasn't informed directly. my question if i were there, were you informed indirectly. did anyone give you any sort of hint or tip? >> what this points to is either the president is a bystander president some have called him and he didn't inquire or didn't ask or his staff knew and didn't inform him or his staff didn't know a thing about it and so they couldn't inform him or hhs didn't know or didn't inform him. so what it points to here candidly is incompetence all the

way down the line or deception. in this case with the website, i think it was incompetence and i think nobody told him. and i think nobody checked it out. >> he's also got a number of senators who have said they appreciate the -- democratic senators appreciate the president doing the administr e administrative fix, but it doesn't go far enough. harry reid said in part democrats are working to fix and improve the affordable care act while republicans still wantd-- on and on. i would have been careful and avoided that one because they're the ones that put it in and needed fix. >> this is palpable nonsense. what president obama is trying to do today is something he may not even have the authority to do which is tell the insurance companies you can go put back in

those policies which don't meet the standards of obama care because basically why, because we didn't know this disaster would occur. i'm not sure he can do that without legislative action. >> actually, pat, i don't think congress can legislate definitely tell the insurance companies to put those policies back on the table either. i don't think -- nobody can. >> nobody can, yeah. if insurance companies don't want to do it, they don't have to do it. but what i'm saying is i don't think obama himself -- president obama himself can absolve the insurance companies under the law unless you change the law. so this is a real miss. how does harry reid explain the panic that ensued when the democrats looked over the railing and saw bill clinton rolling away in a lifeboat. i think that's what caused this panic on the part of these democrats and the panic is what caused the response today. and i saw -- i see the response today as basically that, an act

transparency. a.p. photographers can't take pictures of the president. nsa spying scandal is anything but trance part. and now the latest trarns trarns parp city failure. kennedy was sworn in and it was closed to the press. she was taking an oath to the united states. that is not exactly national security secrets. so the state department gets an f, too, because they released still pictures of ambassador kennedy at the swearing in s ceremony but they controlled what the american people see. and it gets worse. as a reception later in the day, ambassador kennedy made brief remarks to the press but then reporters were not allowed to ask questions. yes, of course over the years ambassador kennedy and her family has been hounded by the media, sometimes brutal and even mean. but this time, she asked for it.

policies. what do you think? >> i think it's a mess. it's never been anything that i've ever seen like this. it is a total catastrophe. and now what he's doing, look, it was the big lie and now he said we'll delay the lie for one year. that doesn't do anybody any good. so they will get their insurance back. number one, the insurance companies won't do it. so it was the big lie that is becoming a total catastrophe for the country. and really hurting people terribly. >> i imagine, though, insurance companies if they can make money by reissuing these canceled policies, that they would be interested in it. >> they don't want to do it short term. they godon't want to be treated like that. they have to be treated like everybody else. this is a plan that doesn't work. it's catastrophic. now, the website is incredible because it shows the gross -- it's not the biggest problem. just the beginning. but it shows the gross incompetence. and i know the president was 35

minutes late for his news conference which bothered a lot of people because it shows something. >> show what? >> shows -- you're supposed to be on time for a news conference. to me it shows he probably had no idea what they were doing at the time that he was supposed to be there. because it's all being done on the run. this is all being made up and done on the run. and that's the problem. >> what do you tell the american people? as they look at this and they think now at least we have a year maybe, those with the individual policies, what would you have advised them to do? >> i said it first on your show, this will die of its own weight. it's happening faster than i thought. and when the president said i understand he said that he knew nothing about the web seat. how can your whole administration be based on obama care, the whole thing, your whole legacy is obama care and you're not even enough involved to pick the people that are doing the website? why didn't he pick google, why didn't he pick microsoft, why didn't he pick somebody? a couple of these companies would have done it for nothing.

we're into the website for over a billion dollars. i have 60 websites. i don't think i spend anything. they just make them up. smart people in the office. so we spent over a billion dollars. we were at $635 million, it was all screwed up. so instead of going out and getting somebody that knew what they were doing, they hired the same company to keep going. it's a real disaster. it's so embarrassing for the country. >> but the website is sort of the most visual problem, the whole problem about where he would have had cancellation of policies even without a website that went kerplunk. >> the website shows the incompetence and it's out there for everyone to see. that's what the problem with the website is. it's a disaster. but also the website costing -- it will be over a billion dollars now. and you have a company that blows it. and i know a lot about websites. you don't fix websites. you start all over again. they're trying to fix it. too complicated to fix. you got to start it all over. but why aren't they going out and getting some of our great --
