kansas insurance commissioner sandy pragueer joins us. good evening, commissioner. >> good evening. >> so, tell me. >> nice to be with you. >> the president's administrative fix. is this going to solve things in your state? ened i know you are part of the national organization. first for you? >> it's not going to create a huge problem for us. we did have about 9,000 policies, maybe a little more cancelled or notifications that went out that they would be cancelled at the twinning of 2014. so, i think probably those policies will be reinstated. we haven't confirmed that yet with the companies. but i'm hopeful that -- our main focus is on making sure people don't have gaps in coverage. that's the responsibility that i think all of us as regulators share. >> in terms of the reinstatement, what is the incentive of the insurance companies if they have sent out cancellation notices? what would be the incentive

for them to go back and rewrite those policies? >> the problem will be if those folks who were cancelled can't get on this flawed web site and are not able to find out alternative coverage, find that alternative coverage. then they -- the insurance company that sent the cancellations in the looks like the bad guy. and i don't think they want that. so they find a way to provide a little bit of -- close the gap a little bit so that people don't fall through the gaps here. partly because and mostly because they weren't able to go on that web site when they got those cancellation letters to find out what would be available for them. >> in terms of those policies that have been cancelled because they didn't meet the requirements of obamacare that will now go back -- or go back into the exchange so people theoretically can access the exchange and choose them. do the insurance companies are these more expensive for the insurance companies or do they make more money with

them or less money with them or just magnanimous and decide to offer them back? the policies in the exchange will still comply with the affordable care act requirements outside the exchange. not eligible for tax credits. and would still have the healthcare requirements. in most cases they were cancelled because they were less generous with the benefits than the affordable care act requires they may still be priced at a favorable rate for these individuals. the concern that we have from a regulator standpoint is that these are -- the folks that want these policies are people that are younger and healthier and those are the folks that you have heard this frequently

said they want to get the young healthy folks into the exchanges because that helps offset the cost for older sicker folks. this further segments the market and keeps that segmentation around for another year and that for me is one of the bigger problems. >> theoretically if they all decide they all want their old policies back and the insurance companies are going to offer those policies back. do you expect that the premiums will rise to what expect would you expect that to rise. >> the premiums may go up. we will have to see because the i don't anticipate they are going to go up considerably this fix that's been proposed is just a short-term that some of the considerations today that were being debated in congress were for these

substandard policies to be allowed to go forward that continues the market segmentation that would make it very problematic for the exchange. where the increases potentially we will see would occur are the exchange policies that then don't have younger healthier folks in there to help offset the cost. that's where you may see some price increases. >> just in terms of doing the math, i would think that the insurance companies would prefer to sell them on the exchange because you are forcing people to buy more than they would otherwise want to buy. plus, you have the added addition these are going to be subcould i seed for many americans. subsidized means you have the government guaranteeing it. in my occupation, the government guaranteed we are going to get ad payments every four or five minutes. this is a nice guarantee. don't the people selling insurance, wouldn't they prefer to sell it on the exchange? >> well, i think they probably would prefer to sell on the exchange. but, in this case, if they

are going -- if the president has said if you, you know, he said frequently if you like your policy you can keep it and then people started getting cancellations and now they are in a situation of having to live up to that promise, and i think it's, you know it, creates some problems, yes. i think they would prefer to have policies that were uniform across the board. and several of the state regulators have already spoken out and said they are not going to require companies or ask companies or permit companies to renew those policies. washington state, for example. >> all right. bottom line though. you are a republican. you are a commissioner. i'm curious, with that laid out there, has this been a good idea or a bad idea what's happened to the insurance industry and also the access of americans to medical care? >> well, i think everyone needs to have access to healthcare. and our system today does not do that. i think we probably the

bigger issue is getting costs under control and that's going to be even more difficult. there are some things in the affordable care act that attempt to do that, but, the -- this short-term fix, i think, does address the concerns that i as a regulator would have and that the people falling through the cracks, going without coverage having the coverage gap because they can't get on the federal web site. and that's really what's caused, i think u the angst. if people had been able to get their cancellation notice and then go directly to the web site and see what was available for them i don't think we would have the concern that's being expressed today, at least to the extent that it's expressed and i don't blame those folks. it's scary, especially for somebody who has this preexisting conditions to think that they might have to go without insurance. >> commissioner, thank you very much. >> thank you, greta. appreciate it. >> and today h.h.s. secretary cath leone sebelius is adamant. she insists the obama administration is not blaming insurance companies. this afternoon president obama meeting with health

insurance executives to discuss the president's proposed temporary administrative fix. a.p. reporter josh letterman is here with the very latest. nice to see you, josh. what happened at the meeting? do we have any information coming out of the meeting? >> we have a little bit of information. the president spoke briefly while reporters were allowed in the room. it was interesting he didn't actually mention this new fix at all. instead he talked about wanting to make sure that he worked with the insurance companies to make sure americans have more information about what's available, what their options are we did get word after the meeting from the white house about a little bit more detail about what they talked about and we do know that one of the major topics was this fix how are they going to work it out so that people who already lost their insurance might be able to get it reinstated. obviously a lot of concerns that the insurance agency has about how is this going to work. >> when the executives walked out, did they talk to the press? the white house has obviously spoken, how about the executives, the other side of the table were, they talking? >> none of the insurance executives that were at the

white house came out and spoke to reporters, which sometimes they do sometimes they don't. in this instance we have seen some of them issue statements saying look, we are not sure this is going to work out for us. none of themselves putting themselves on camera today. >> they mum putting out statements? are they saying anything to the side. giving us information how the meeting went and whether or not they like the president's fix? >> well, they have already -- it was within minutes of them announcing what the fix was that a lot of insurance groups and groups that represent insurance companies came out and said this is really, we need to take a step back and see how we are going to be able to do. this i think one of the reasons that you are seeing a little bit of a muted reaction is that people are still waiting to see which states are going to do it it, which insurance commissioners like your previous guest are going to allow this to happen and until there is a little bit more clarity, it's hard to tell. >> see, i follow the money. if the insurance companies can make money, doing this temporary fix, i think we are going to see it. if they can't, they are -- this isn't going to happen. >> remember, that everybody

under the affordable care act has to have insurance or else they will have to pay a penalty. >> there is some insurance you make more money. obviously if you oversell insurance you are going to make more money or if you sell it to a healthy person you will make more money than if you sell it to a sick person. >> other thing insurance companies have in mind is if they don't make this possible for old people to keep their insurance the obama administration is going to hammer them and for the next year said look we did our part and the only people between standing between you and keeping your insurance is the insurance companies. >> any good lawyer say you made your bed, you lie it in the people who did that. anyway, we will see how it works out. nice to see you. >>, thanks, greta. 24 hours after announcing the so-called fix, the president rushing insurance executives to the white house as josh just said. is this a fix or is the president in a fix? abc rick klein is here to talk about that next.

your plan. you still can't say that with a straight face because several offer those not the federal government. it's not obamacare's fault. but he won't be able to say you definitely get to keep the coverage you have. >> what do you think the reaction from the white house is tonight. >> yesterday was the fix. they had the vote today. are they like high fiving and dodged a bullet or are they freaked out? what do you think? >> i think they are happy to have congress out of town and have the weekend here. they had to pull off the band-aid with what they talked to the president said and extraordinary series of admissions about and the apologies that came kind of every few minutes during that hour. but i think now they need to fix the problem. >> is it actually -- here is what i don't get. is it the president's bill let's everybody who got cancelled, is that you can now, if it's offered, you can now -- if it's offered. which i'm not convinced it will be offered. if it's offered you can buy into it.

the bill today and it's for one year. the bill today, fred upton the republican bill says the same thing except one thing allow people who weren't cancelled who weren't part of that group they could buy into it if it's offered. >> that's right. >> the president said he would veto it why does he care? >> it's not just a one year fix because the whole -- the thing is that the fix that the president put forward yesterday actually could hurt the law. probably will hurt the law. because the whole idea of these substandard policies they have to be phased out to make the financing of obamacare work going forward. get away with it one year. their concern is if you do over a longer period of time the reforms don't make any sense. >> i can't figure out why the insurance companies would resurrect policies. under the new scheme they sell you a then brew buy a lot of things you don't need. overbuy. like buying a camera that you don't know how to work it but you pay all the money to buy all the other stuff you can't use. go back to reissuing the other policies they are more refined and cheaper. what's the incentive for the insurance companies to try

to resurrect. make less money. >> look, they had less benefits attached to them some insurers no doubt and pressure to offer what they offered in the past. they are not under an obligation to do it. just talking about what the enforcement from the obama administration comes. but that makes it a real problem. it's at the same time that you have the structural failing on the front end this web site that still isn't working. people can't sign up if they want to. this is a week of real concern about whether this whole thing is going to work. i follow the money. if the insurance company can't make more money by resurrecting them. it's not going to happen. i don't see how they make more money by resurrecting these old policies. >> there will be people who were told initially they would be able to keep their insurance. told again yesterday they would be able to keep their insurance and they won't be able to keep their insurance. >> the president can't force insurance companies to reissue this insurance? >> no. >> all right. nice to see you. >> thanks. >> straight ahead, president obama and secretary sebelius might think about having a chat. at least getting on the same page. the president and the secretary are sending messages conflicting with each other. the messages are about your

president yesterday saying it's on me, it's on me. seeing different administration officials saying it's really the insurers. i don't think that is the strategy is going to work. they have to try something because this is such a debacle as sebelius has called it herself. they have got to go another play. there is so much unrest on capitol hill among democrats about this especially with a year to go in the election. a lot of these democrats set months ago and we talked to them. they were jennifers have you about the obamacare implementation. they warned the white house through the press and privately max baucus thought it was going to be a train wreck it was a train wreck. >> one is implea member station and rollout which has been bad. but there is also the substance. i mean, the substance is pretty much still -- the substance of how we even fund this. i mean, that still remains, we haven't even hit that part whether or not young people are going to come out in droves and buy this and support it. we haven't even hit that part. that's been there since day one. >> that's going to be, i think continue to be -- the web site you think is going to get fixed, okay. it's young people.

and in the breakdown at hhs release, the administration release. there is no break down of young people vs. old people. 100,000 plus are likely sicker people. they are not medicare. medicare is not part of this. probably between 50 and 64, something along those lines. and probably pretty ill. unless they get the young people though sign up. then you are going to have premiums skyrocket. >> are republicans gloating at this point on capitol hill? >> oh, yeah. they took a beating in the shutdown. and the reversal of fortunes is something i haven't seen and i have been in washington since 1995. this dramatic has done a 180 where democrats were united really on the shutdown. republicans divided and now democrats are -- problem for the white house is this is going to be the story for so long, months, maybe years. >> the president promised us november 30th. secretary sebelius, somebody did november 30th that this web site is going to work. and for the life of me i can't figure out why they gave us a set date. we are all sitting there waiting for that date. >> i think so much pressure from the press. they are like when is it going to be fixed?

secretary of state john kerry, former secretary of state hillary clinton and former first lady laura bush all sharing the stage. took part in a discussion about the future of security for women and girls in afghanistan. secretary clinton and former first lady bush are co-chairs of the us afghan's william's council and answered questions about the progress women have made fighting discrimination in afghanistan. now to capitol hill. republican controlled house passing a bill that would allow americans to keep their existing health coverage through 2014. the vote? 261 to 157 for republican representative fred upton's bill. 39 democrats supported the republican bill. and now, extremely disturbing new information about the botched obamacare web site. they knew it. they knew it was a flop. just released emails exposing a top tech official warning that staffing and software problems could crash the plane at takeoff. and that was three months before the healthcare.gov launched. representative joins us. good evening, sir.

>> good evening, greta. >> well, these emails are rather disturbing. one from henry chao dated july 16th. another one from mr. jeff grant on july 8th. both pretty much saying it like it is like this is going to be a problem. >> well, those emails went to cgi federal. the u.s. subsidiary, cgi group. canadian company. the overall contractor to develop healthcare.gov web site. now, this email came from henry chao, deputy chief information officer at cms and the manager of the project. and he basically sent these emails and said, guys, and this contractor cgi, cgi federal. we are worried. you are north going to be ready and we don't have enough people, and sure assure me that you are going to be ready the very next day, greta, he goes before the oversight government reform committee, house of representatives and says we're going to be ready

october the 1st tavenner and ourselves are under oath. our tails are in a bind if we don't get this right by october 1st. they clearly knew it and lied to congress and said we are going to be ready. >> are you going to do anything about it? fudge the facts and loose with the truth. it's not a game. there are a lot of americans out there tonight who are really terrified about their health insurance. and maybe if henry chao on july 16th or jeff grant on july 8th had gone over to the white house and told somebody, maybe that it wouldn't have been launched on october 1st. maybe people wouldn't be without their insurance because their policies are cancelled. maybe because it's not funny. this isn't a game what they are playing. they have been, you know, maybe i mean, this is stunning. this is disgraceful.

>> it is disgraceful, greta. and, yes, we can take it all the way to, you know to the white house and they say executive privilege and obama done that to us on a number of times. they did that on the solyndra case and i'm on energy and commerce committee and oversight committee, we are right there. that's where those emails that came out about this healthcare.gov and we knew now. we know that they lied to us. and they lied to the american people. so, this bill that we passed today, of course, the president comes out the day before, tries to reelement that with some fiat or executive order or whatever. and then you hear nancy pelosi, the democrat say oh well, you know, we won't lose but maybe a couple of dozen democrats. and there were 39. that's significantly more than a couple of dozen that voted with us on that bill. this is all about the american people and them having no insurance and a gap and then if something horrendous happens to them,

boy, that is a plane crash. >> well, you know what else? even today, this is what i don't get. almost like we are just sort of the -- basic decency, secretary sebelius saying i don't think anybody anticipated the level of problems that were particularly plaguing the site in early mid october. and then i go back to and look at this july 16th email from the chief tech officer who says i just need to feel more confident they are not going to crash the plane at takeoff. it is just appalling. i mean even today trying to pretend like nobody knew. nobody knew at all. >> a massive plane crash is a lot worse than a train wreck, isn't it, greta? that's what it really comes down to. that's why in this georgia senate race for next year i have taken a pledge. if i can't repeal obamacare in my first term, i will go home. that's an accountability pledge. that is not just some term limit pledge. it has no meaning, you know. >> i would like the pledge

"the washington examiner" susan greechio joins us, nice to see you, susan. >> good to be here. >> i think the the republicans expected more than 39 but 39 is bipartisan. >> there would have been more if the president had not come out and announced his fix the day before that quald a lot of mutiny in congress. it didn't end it. a lot are vulnerable and up for re-election next year. if you listen to democrats in the senate. they weren't pleased at all. they want a legislative fix they can vote for in the senate. this doesn't end it for the president. democrats are really angry.

both of us cover capitol hill and on the floor talking to these guys, they are really angry. they think this whole thing was completely botched, the rollout. they are mad at the president. one congressman told me we are not going to walk the plank for him on this. this is it it's about saving their own skins politically. >> what was nancy pelosi trying to say? twist the arms of the democrats to try to get them to go along or has she had it too. >> she wants unity. she is a much better whip than the speaker is. she is much better keeping her people in line. sheparded it through congress when did looked like it was never going to pass. she wants this to survive. got out there in front of the cameras and unapologetic about the botched rollout and said this thing is going to resolve itself. she wants the democrats with her. they offered own substitute plan or two trying to give democrats something to vote on to say to their cints we did something to allow people to keep their healthcare plan too. >> what's the difference between the president's fix.

>> sign up for the plan that the president's healthcare law deems insufficient. it invites new customers in. it keeps that side market open. >> is it the same length of time though, a year? >> it's 2014. the president said he is going to veto it what does the president have against at least opening up that market for others just for a year? i mean, what's the big deal because he says he is going to veto it. >> here is why. the first year is very critical. it's only 2014. if you just offer it to the old customers the way the president suggested we could do the other day, then that would be a smaller pool of folks who would be keeping their old policies. if you invite in new people to these same plans that are cheaper and don't have the essential benefits, it keeps them out of the healthcare exchanges. the more people you keep out of the healthcare exchanges and the critical first year, the less money you have to support it. >> and less money to the insurance companies, right? >> less money for the insurance company. which rising healthcare costs. >> which is why i think the insurance companies won't

obamacare with that more expanded menu you are going to pay more. insurance companies are in the money making business why would they ever want to go back to these other policies unless they could spike the premiums? >> well, the incentive is, greta, they are going to want to keep their customers and one would assume if they had a plan that just got cancelled. most people would prefer to keep that plan. rather than go to a more expensive plan that had coverage that they don't need. markets do work. and my bet is that a lot of the insurance companies will continue to provide and offer these plans. and i also think that once the american people look at it it, look and compare the plans with all the bells and whistles in the exchange, they are going to want a plan that fits them and costs less money. >> but here is the situation though if you are on the exchange, and, you know, we talk about the subsidies. but if you -- we talk about that subsidy for the person who is buying insurance,
