republicans have to give us an alternative. they've never done it. >> i agree. thank you. that is all the time we have
11:01 pm
. >> people don't have gaps in coverage. that's the responsibility i think all of us as regulators share. >> in terms of the reinstatement, what is the
11:02 pm
incentive for insurance company if they sent out cancellation notices? what would the incentive to go back and rewrite those policies? >> the problem would be if those folks who were canceled can't get on this flawed website and are not able to find out alternative coverage, find that alternative coverage, then the insurance company that sent the cancellation notice looks like the bad guy. i don't think they want that. they also want to find a way to kind of provide a little bit of a -- close the gap a little bit so that people don't fall through the cracks here, partly because and mostly because they weren't able to go on that website when they got those cancellation letters to find out what would be available for them. >> in terms of policies that would be canceled because they didn't meet the requirements of obama care that would go into the exchange so people theoretically can access the exchange and choose them, do the
11:03 pm
insurance companies -- are these more expensive for the insurance companies or do they make more money with them or less money or be magnanimous and decide to offer them back? >> these are policies that will be sold outside the exchange. the policies in the exchange will still comply with the affordable care act requirements and essential health benefits. these are policies that would be outside the exchange not eligible for tax credits. would still have the benefits that don't meet the essential health benefit requirement. in most case, they were canceled because they were less generous, let's say, with the benefits than the affordable care act requires. so they may still be priced at a favorable rate for the -- for these individuals. the concern that we have from a regulator standpoint is the folks that want these policies are people that are younger and
11:04 pm
healthier. those are the folks you heard that frequently said they want to get the young healthy folks into the exchanges because that's what helps offset the costs for older sicker folks. this further segments the market and keeps that market seg mentation around for another year. that for me is one of the bigger problems. >> for those 9,000 if they all decide they all want their own policies back and the insurance companies offer those policies back, do you expect the premiums will rise and to what extent do you expect that to rise? >> the premiums may go up. we'll have to see because the companies will have to look at a different marketplace now. the marketplace is changing. i don't anticipate they are going to go up considerably. of course, this fix that's been proposed is just a short term, that some of the considerations
11:05 pm
today being debated in congress were for these substandard policies to be allowed to be sold going forward. that really does continue the market seg mentation that would make it very problematic for the exchange. where the increases potentially we'll see would occur are the exchange policies that then don't have younger healthier folks in there to help offset the costs. that's where you may see some price increases. >> in terms of doing the math, i would think the insurance companies prefer to sell them on the exchange because you're forcing people to buy more than they otherwise want to by and added addition because these will be subsidized for many americans and subsidized means you have the american guaranteeing it. in my occupation, if the government guaranteed we will get ad payments every four or five minutes. this is a nice guarantee. don't the insurance -- the people selling insurance, wouldn't they prefer to sell it on the exchange? >> i think they probably would
11:06 pm
prefer to sell on the exchange. but in this case, if they are going -- if the president has said, if you -- you know, he said frequently, if you like your policy you can keep it and people started getting cancellations and now they're in a situation of having to live up to that promise, and i think it's -- you know, it creates some problems, yes, i think they would prefer to have policies that were uniform across the board. several of the state regulators have already spoken out and said they're not going to require companies or ask companies or permit companies to renew those policies, washington state for example. >> all right. bottom line- >> so, it's -- >> you are republican, you are a commissioner, i'm curious, with that laid out there, has this been a good idea or bad idea what's happened to the insurance industry and access of americans to medical care? >> well, i think everyone needs to have access to health care.
11:07 pm
our system today does not do that. i think we -- probably the bigger issue is getting costs under control. that will be even more difficult. there are things in the affordable care act that attempt to do that. this short term fix, i think, does address the concerns that i as a regulator would have, that's people falling through the cracks. going without coverage, having a coverage gap because they can't get on the federal website. that's really what's caused, i think the angst. if people had been able to get their cancellation notice, and then go directly to the website and see what's available for them, i don't think we would have the concern that's being expressed today at least to the extent it's being expressed, i don't blame those folks. it's scary, especially for somebody who had pre-existing conditions to think they might have to go without insurance. >> commissioner, thanks very much. >> thank you, greta. >> h hrhhs secretary kathleen

sebelius is adamant insisting the obama administration is not blaming insurance companies, meeting with health executives to discuss the proposed temporary administrative fix. josh is here with the latest. nice to see you, josh. what happened at the meeting? do we have any information coming out of the meeting? >> we have a little bit of information. the president spoke briefly with reporters in the room. interesting he didn't talk about this new fix mentioning he wanted to make sure he worked with insurance companies to make sure americans know what's available, what their options are. we did get word after the meeting from the white house a little more detail what they talked about and do know one of the major topics was this fix, how was this going to work? how are they going to work it out so people who already lost their insurance might be able to get it reinstated and a lot of concerns the insurance industry has about how this is going to work. when the executives walked out, did they talk to the press?
11:09 pm
the white house has spoken, were the executives talking? >> none of the insurance executive executives talked to reporters. sometimes they do and don't and some issuing statements saying look we're not sure this is going to work out for us. >> are they now mum today or giving us any information how the meeting went and whether or not they liked the president's fix? >> it was within minutes of him announcing this fix, a lot of insurance groups and represent insurance companies came out and said this is really -- we need to take a step back and see how we're going to be able to do this. i think the reason you're seeing a muted reaction, people are still waiting to see which states will do it, which insurance commissioners, like your previous guest, will allow this to happen until there's a little bit more clarity, it's hard to tell. >> i follow the money. if the insurance companies can make money doing this temporary
11:10 pm
fix, i think we will see it. if they can't, this isn't going to happen. >> everybody under the affordable care act has to have insurance or else they have to pay a penalty. >> some insurance you make more money. if you oversell insurance you will make more money or if you sell it to a healthy person youl it to a cisick person. >> if they don't make this possible to sell insurance the obama administration is going to hammer them for the next year and say, look, we did our part and the only thing standing between you and your insurance is your insurance companies. >> any good lawyer said you fed t them to t-- >> and coming up, is this really a fix or is the president in a fix? abc's rick klein is here to talk about that next.

11:16 pm
make less money. >> look, they had less benefits attached to them some insurers no doubt and pressure to offer what they offered in the past. they are not under an obligation to do it. just talking about what the enforcement from the obama administration comes. but that makes it a real problem. it's at the same time that you have the structural failing on the front end this web site that still isn't working. people can't sign up if they want to. this is a week of real concern about whether this whole thing is going to work. i follow the money. if the insurance company can't make more money by resurrecting them. it's not going to happen. i don't see how they make more money by resurrecting these old policies. >> there will be people who were told initially they would be able to keep their insurance. told again yesterday they would be able to keep their insurance and they won't be able to keep their insurance. >> the president can't force insurance companies to reissue this insurance? >> no. >> all right. nice to see you. >> thanks. >> straight ahead, president obama and secretary sebelius might think about having a chat. at least getting on the same page. the president and the secretary are sending messages conflicting with each other. the messages are about your health insurance.

persons buying insurance, that subsidy is actually money that goes to the insurance company. so they like their money. that's a done deal for them, preserved for them, money on the exchange by taxpayers. >> the upton bill is step one. i have a bill hr 348 that makes obama care voluntary for the first year, doesn't repeal it, doesn't delay it, lets the voters choose, let the market work. there are some people who will be helped by obama care. i don't think very many will be. there are a lot of people that will be hurt. this is just the first phase of people that are being hurt. when the employers start canceling their employer-based health care plans and start putting those people in the exchanges, it will get worse. the democrats own this law. it is a turkey, it is a lemon and it is just a question of time before a lot of democrats wake up to that fact and start

11:58 pm
they pulled out all the stops for him today. >> so how did it happen? what did he get to do? >> well, it started around the beginning of the work day. there was a damsel in distress that was stuck on the cable car tracks in our knob hill neighborhood. he saved her. he gets in the bat mobile and it turns out that the riddler was robbing a bank vault of all gotham' citizens. the riddler got put in jail. then he went to have what he thought was going to be a relaxing lunch but overlook -- at a restaurant overlooking union square and there were thousands of gotham residents down there alerting him to the fact that the pep begin had stolen the mascot of the san francisco chronicle or the san francisco giants lucille. so he he went to at&t park, our baseball park here. and he stopped that, he rescued lucille and duly awarded later by getting the
