bucks i'm paying now not $300 a month than somebody who paid in their 50s less than me. that's ridiculous. >> senator nelson is kind of tired of me complaining. >> it's definitely more than my fair share for the health insurance. >> i think i'm just going to pay the fine because i can't afford it and i don't want to beg for the government. >> i would like to scrap this and start all over. >> should we scrap obamacare and start all over i'm kimberly guilfoyle in for greta van susteren. fear as aobama care deadline approaches. doctor is here. what can doctors and patients do to protect themselves? >> well, you know, this is a pretty difficult situation you know, people are obviously fearful because there was willful misrepresentation. you know, you can keep your doctor, you can keep your insurance and it's rolling out. people are seeing that that is not the case people are

seeing that if you can't make a web site work after three years, how in the world are you going to deal with millions of health records and keep anything straight? i mean, you don't have to be a rocket science tis to figure out that's just not going to happen. and the bill is so complex we keep finding more and more things in it that somebody obviously didn't know about. if we really want to solve it, it's going to take more than just doctors and patients. it's going to take a willingness to be honest. and i know that may be a difficult thing in washington, d.c. but, the fact of the matter is, we just need to recognize that this bill was passed because the facts were not on the table. so, if deceit is used to get a bill passed, is it really even legitimate? if we want to be honest, let's sit down and put all the facts on the table and then re-vote and see if it happens. or, alternatively and

preferably, let's just sit down as a bipartisan group and work it out. we can do that. that's the american way. >> to avoid the american people being mislead. the president and his administration and those he has put faith trust in let us down. should we trust them to take us to the next step whether so far all we have gotson a failure to launch? >> there isn't anything to indicate that there is any change of heart. when there is a change of heart, when some humility, when some concern for the masses rather than concern for your pole numbers comes in to play, yes, i would be happy. >> we have to remember that there is another big problem. that is that we have just turned over a huge chunk of power we the government with control over our lives.

we have to understand that there is severe implications to that. this is only the beginning. we need to heed these warning signs all of us and do the appropriate thing when it comes to voting. >> doctor, talk to me a little bit about what is most at risk here for dock for tores who are trying to serve faithfully the patients to trust their lives and medical decisions and patients on the other side there is a strong impact for both. >> sure. i talk to lots of doctors every week all over the week. and they are extremely concerned but not only their atom my but the relationships that they have seaboard over many years. many of those they have to give up now because people are no longer in their network. and their lives are being controlled. people who go into medicine are very smart people they didn't to tell them what they could and could not do.

you will see a lot of people quitting. you will see a lot more concierge practices. the government will come in and see you must see these patients as conditions of your license. that's going to cause a big revolt as well. this is what happens when the the government gets too powerful and gets too big. it doesn't know what to do. it wants to mess with everything. this was never the original intent. i beg the congress and the supreme court to wake up and realize that there was a reason that you are there that's a call to action serve trust and faith individuals do right by their families. we are seeing the effect across the boards. seeing americans from all walks of life well weather this was he well-intentioned or not. when they seek yo and say what can i do to protect myself, what do you tell them? >> first of all, i tell them to pray. but, secondly, i say, you know, look out there. there are some things that

are being presented buy the private sector which do work. there are a lot of alternatives. people aren't willing to sit down and discuss them and talk about them openly. the fact of the matter is, a zillion alternatives. you know, we need to insist that those things be looked at because they can take care of the problem in a much cheaper fashion without turning over the most important thing you have, your healthcare to the government. the government has a lot of important things to do. this is not one of them. doctor you came on to the international stage people came aware of your choice and resonated it the american people. you are a man of faith and science and medicine as well. i asked you new developments now with with the supreme court agreeing to hear the case contraception and right of corporations to be treated as individuals if they don't want to provide for contraceptive care, morning after pills, things

like that. what are your thoughts about that? >> i say this is just a harbinger of the many things that are going to come up when you take the government and put them in a position where they're start to dictating to us about the affairs of our private lives. it's gonna be, you know, contraceptives today, it's going to be something else tomorrow and something else the next day. government, please start thinking about the important things that they need to do. these kind of things will continue to crop up as they are. they are taking independent and free society and now you are trying to impose huge governmental controls on it. it doesn't work. it's like mixing oil and water. it's going to be continued chaos. >> you are absolutely right. those two were never meant to be together. dr. carson, happy to you spent time with us this evening. thank you. >> always a pleasure, thank

you. >> okay. and is obamacare headed for another meltdown? we have already seen thousands of americans lose their insurance plans. are we about to see it get even worse? washington chief political correspondent byron york joins us now. byron, thanks for being on the program. you heard the interview with dr. carson. certainly it sounds reasonable for the american people to have this fear, this distrust because of what's going on. and you say in your recent article that things are just going to get worse. originally, we he have had two big problems with obamacare. one the web site is a disaster and two people who get their insurance through the individual market have seen higher premiums and deductibles go sky high. the next thing we are going to see is a much larger segment of the population, people who get their insurance at work and they work for small companies. companies who have between 2 and 50 employees.

experts saying those people are going to experience kind of the same thing that those people in the individual market experience. they could be facing same set of problems. >> it seems that people aren't aware that this next wave is even larger, this looming over the healthcare industry. americans very upset when you see some 5.5 million and change have already had their policies cancelled. now we are looking forward this group that you said is called the small group market. that seems to be-to-have a tremendous impact. how are they going to be able to figure out the political implications of this when this comes to fruition and the american people see what's happening. political question of obama in care has been is it going to help more people than this hurts and is it going to hurt more people than it helps. to buy new coverage they are going to have to spend more money and have higher

premiums and deductibles that are way way beyond what they can pay. if you have a larger number a group of people experiencing that sort of situation, you are going to have a lot of political energy behind the opponents of obamacare. we have already seen now today we found dramatic change in the public's preference, republicans vs. democrats in the upcoming 2014 congressional elections. there was a dramatic shift towards republicans away from democrats. we have seen what this has all done to president obama's approval rating. just 40% think it can happen. >> a lot of people talking about this is the redistribution of wealth taking effect in healthcare. making winners and losers. do you believe the republicans can capitalize on that in the elections coming coming forward? >> if they can't, they ought

to have their licenses revoked. seeing more commentary of course obamacare does create winners and losers. this is redistributionist. that's not what president obama and the democrats said when they were selling this law. they said it would make the system better for everybody. they said it would cut premiums by $2,500 for an annual -- for an average family and they said if you like your coverage you can keep it so none of that is turning out to be the case. >> you are right about that and instead the american people have been given a terminal illness in the term of obamacare. byron, thank you. race is on to repair obamacare.gov. every fix leads to another problem. problem. yo hey america, even though she doesn't need them, problem. yo cheryl burke is cha-cha-ing in depend silhouette briefs for charity, to prove that with soft fabric and waistband,

>> four days to go. the obama administration's deadline to fix healthcare.gov is quickly approaching. cms admitting the system will not work perfectly on december 1st. so, can we expect any improvements at all. database developer luke chung joins us. thanks for being with the program. i have got a lot of questions for you. this is so much about technology and maybe for the first time in history or at least american presidents' history. technology could be the downfall of an administration. >> thank you very much for having me.

kimberly. >> so what do you think? they have got a lot of problems here. they said it's not going to work perfectly by december 1st. what improvements, if any, can we expect? >> you know, i don't really know what they are doing. they have uncovered and said they have fixed hundreds of bugs since they debuted on october 1st. i guess my question would be, did they know those bugs existed on october 1st and shipped with them or did they discover them after october 1st? you know, either situation raises lots of questions in terms of their test plan and how they executed. if they didn't know these bugs existed. software development, usually when you find some bugs there is more you don't know about. >> this what we know so are if a. you talked about this is some of the front end stuff we are seeing but not the back end stuff. also, this is interesting, you thought in the beginning perhaps these guys are incompetent. they don't know what they are doing. you actually have a

different theory now? >> yeah, originally, i thought that the people on this project were simply incompetent, right? like giving carpenter who are not quarreled a bunch of nails and drywall. they are never going to finish the project no matter how much money and time you give them. over time i am beginning to see that these government tore who's took over this project have essentially made every decision that favors them as much as possible. to maximize the cost of. >> if this was private sector, these guys have been paid millions of dollars for a terrible product. i don't know how you fix good code on top of bad code to fix it it they are too big to fire you say. >> yeah. that's the challenge within the government where they constantly buy custom software and don't hold the

contractors accountable for the deliverables. if it were a small like ours we would be kicked out the door and not asked back. large government contractors specializing in getting government contracts and change orders and have a bunch of lawyers to defend themselves against any accusations of wrongdoing or blame. they seem to be able to shift blame to other parties so that they are never held accountable for delivering awful results. >> all right. so, luke, tell us what you really think because i know. i want you to share with everyone else. i think it's so interesting. you think they might be working on another site completely separate hopefully properly beta test? in general in software development, one usually would have versions that would be kept separate in their own testing and

staging environment that would then be flipped over into production when they debuted. that would be the proper and best practice way of developing software like this now, i don't know if that's what they are doing. the papers that came out with the emails that led up to the october 1st debut showed all sorts of confusion between the government people and the contractors where it seemed to indicate that they didn't have a proper testing and staging environment. they were actually making stages on the production servers. so, that's really bizarre and basic, you know, what you should do once you are out of a classroom kind of platform. i don't understand how we spent thatch money and got such unprofessional results. >> yes. you even testified earlier in the month about this. about this whole healthcare dot.gov. only seeing just the beginning of it and certainly the american people deserve better.

new spokesperson trying to get sign up for obamacare. it's your mother. tongue in cheek messages from mom to their adult children. the ads try to get young people to get health insurance. now, that's because obamacare needs young and healthy people to enroll in order to stay afloat. new ads urge mothers to send ecards to kids to get them to sign up. one card says i don't mind you are getting health insurance. you are the reason i drink wine out of a box. how do they know he?

enough but, yeah, if you have a situation where the press is reporting that there are big problems still and people aren't going to be able to move forward and get online and check out the web site and actually get checked out o. i mean, get to it a point where they can make it work to get their healthcare, it's going to be a big problem. there will be more -- you will see more democrats start to push through bills to fix obamacare and to get in front of the president on making it work. >> well, what kind of advice are you going to give to democrats in washington about how to handle this? at a certain point they have got to protect themselves and their seats and, you know, do right by their constituents. >> you know, i think republicans learned in the late, you know, second term of the bush administration, it's pretty tough to move away from a policy of a president of your party. you end up hurting yourself with your party's base or, you can't get away from it

anyway. they have to help make this thing work. i think that is what will hold most of the democrats together. i think most democrats think this will work over time. i know republicans don't think so, but there is obviously going to be a big fight about that in november of 2014. and i think it's way too early to know how that will play out. >> what's your advice to the white house to get everyone on the same page? what kind of memo would you send out and what would you tell them to say? >> the only thing the white house can do is make the thing work you can't spin your way out of this any longer. they have got to build up credibility. the first thing that's going to come up, you know, you called it: november 30th. december 1st. doing things. november 30th. if it works. that's not going to solve the problem. the bring stars to build bring by bring getting back

your patients as well. >> well, where the double whammy comes from is i'm a small business. as a small business i provide health insurance for my employees wells messiahself and my husband. we received a letter in september telling us that our policy was going to be cancelled or not renewed. and that another letter would be forthcoming telling us what would be a substitute. that left me in a state of anxious anticipation wondering for three weeks what was going to happen. and what did i need to do next. in three weeks, another letter appeared which told me what the new plan was. and it outlined the fact that my premium was actually going to decrease by $13. but the tradeoff for that was increasing my already high deductible of $2,000 by an additional $500 per individual to $2,500. and i was going to lose access to any out-of-network benefits. so i would have in network care only.

that wouldn't be quite as much of a problem in my network remained constant to what my current policy was. >> that doesn't happen. >> that didn't happen. i was also informed that i needed to tell my employees and i needed to check with every doctor that i previously had gone to to see if they were still in this new network. that network was defined as pathway. i had gone on to the web site for the insurance company to see who were in this pathway network. of course did not even find myself. i am a physician and i had been in the former network. >> and your name wasn't. >> there and my name wasn't and there all the colleagues i work with are not there. i started to actually look up i'm an apt ophthalmologist. i only recognized 8 names. that really gave me some concern. so then the second part of this comes as another two or three weeks after that i received an additional letter from the same insurance company telling me

that while i would remain in the current network that i was in to serve as a participating in network provider they were not going to welcome me into the new network, that i was not needed. >> in layman's terms you were dropped? >> i was dropped. >> now, did you anticipate that this would be this devastating or perfect example of impact not only a physician but yourself as a patient. now you are thinking to yourself i'm a doctor but i hope i stay very healthy because i don't have the insurance. have you been dropped and your employees and then you are no longer with the blue cross shield. >> well, i'm with blues cross blue -- blue cross, blue shield but for the current not the new network. that new network will serve the affordable care act insurances as well as any small business plan because my plan that i have currently is through a broker. it is not through the affordable care act or the

new york state marketplace insurance. my plan is a privately brokered plan between empire blue cross and myself. it's a fully insured plan. but apparently because i'm a small business, because i have less than 50 employees, i am now going to be forced into this much more limited network and, in addition to having less doctors to choose from, i was also told that my choice of prescription drugs that would be covered would also be limited. >> how many patients do you expect to lose because of this scenario? >> that's a little bit difficult to say because i would have to be able to identify who are from small businesses. now, as far as any patients that are currently in the new york healthy new york plan, they have been dropped. they have to go to the healthy new york, will be substituting for the aca plan. as a result i have lost then probably in the age of 20% of my parents. >> which is devastating when you think about the small business impact. this was not supposed to happen. this is not what the

american people were told. they were told if you like your doctor you can keep it if you like your plan you can keep it by the president. we have seen that is not the case. thank you very much. >> thank you very much. >> the supreme court is taking up obamacare again. the high court will consider two cases. both involve companies who say complying with the contraception mandate violates their religious beliefs. abc news political director rick klein joins us now. rick, tell us more about this legal battle as an attorney i'm very fascinated by it and should the white house be worried? >> this gets to the heart of the first amendment. because, what you have here are individuals who own companies and because of religious objections they feel like they should not be forced to offer contraception coverage. birth control as part of the health plans that they offer. we know that religious institutions have that exemption. the question is whether corporations can have that same because of the religious beliefs of their owners. fascinating to see if the first amendment right to free speech we have seen

extended to corporations, extend to religion. what's the supreme court is going to decide. cuts to the heart of a key provision of the obama healthcare law. >> talk to us about the political impact. this is hardly the distraction that the obamacare administration wants to see at this point. people up in arms about their religious freedom as americans to express themselves and not be compelled to provide contraception, you know, emergency services, that type of thing that goes against their religious beliefs. >> that's right. the big context here is the focus at the white house over the course of the next few months and next year is to sell this healthcare law to make it seem like a winner. they are focused very much on getting the web site fixed. this is going to be a separate distraction. the idea of the supreme court arguments probably in the spring and finally a decision through the summer that gets to this issue of freedom of religion and people saying that they feel like their own religious beliefs are being violated as part of obamacare it's another distraction for a law that doesn't need anymore that comes from outside forces.

>> my prediction is going to be a-4 vote and going to uphold the tenth circuit of appeals when they look at this issue and say that the corporations can be treated like an individual based on the freedom of religion act. but, so let's talk about midterm elections. 2014. will this have any impact? >> i think the obama healthcare law is shaping up as one of the biggest if not the biggest issue of that election. we saw it in 2010 already play out in such a large effect. we have this come up against the back drop of the rollout of the healthcare law. the web site, the enrollments and then as we go into the fall, ideas about what's going to be happening in 2015 and beyond. and that's going to be happening right in the context of the midterm elections. that's why this all marries is that if this law is judged by the american people to be a successful, democrats can have a great time in defending it. if it is seen as a failure, then it is going to be a backlash against them electorally almost certainly. >> be keeping the seat warm for the next republican in office. let me ask you, do you think anyone anticipated three

years after obama signed this into law that we would have this kind of mess and political fallout? >> i think for this particular piece of it, it was almost inevitable. this was a big issue at the time that they were debating the law. i think in the broadest contest, the obama administration's hope was once this law goes into effect, people are going to see the impact of it they will make judgments based on that. get beyond the political issues that have dogged it from the start. we have seen this become trench warfare at the supreme court multiple times. various levels of the courts throughout and now playing thought a big political battle against the back drop of trying to enact the law. it has been every step of the way a huge fight. and it looks like it will continue to be that at least through the midterm elections. >> it sure is now with this new deadline looming november 30th. let's see what happens after that it's not going to be perfect yet. hardly perfect now. rick klein abc news political director and co-host of the show top line, thanks for joining us tonight. >> thank you. >> all right. straight ahead. startling news about the knockout game the dangerous attacks are spreading.

crime. we are showing you recent examples of these attacks so you know what to look out for. these attacks are happening across the country. but one area of new york city seeing a lot of knockout assaults. the latest report a 13-year-old arrested for allegedly punching a 12-year-old boy, knocking him to the ground. and a 72-year-old brooklyn woman also sucker punched on the street. new york state assemblyman joins us now. just within the past hour, there is news of auto yet another attack of a woman in your area. >> a young woman who was shopping, was the streets. and suddenly was confronted by a young man who raised his fist and attempted to punch her in the face. the police are on the scene as we speak. but this is a very latest incident. it's been an ongoing phenomena that is beyond comprehension. how do you understand what is the motive here? just to inflict pain? just to hurt someone? that's exactly what seems to be the case a neighbor of

mine 78-year-old woman walking down the street, not very safe community. someone confronts her, raises his fist, hits her in the head. this woman is now afraid to walk the streets. she is afraid. this is going on all over the country. it's happened repeatedly in new york throughout brooklyn in crowd heights, 8 incidents in a period of six weeks. it's the kind of senseless behavior that is incomprehensible. why, you know, is there some kind of pleasure? do you win points? do you score something if you attack an innocent person in the street? when you start attacking elderly people, somebody's grandmother that is nuts. it's crazy. >> it's reprehensible. it's depraved behavior. it should be taken very seriously by law enforcement. these are communities, neighborhoods, people under sieged afraid to go out.

just truly a frightening when you think about it and you have elderly women being attacked. >> what's happening, unfortunately, i want to tell people don't be afraid. go in the street. yeah. keep your eyes open. but what we are finding is that parents are not letting their daughters walk in the street. schools are canceling called a party last friday night. the parents called the school amend asked them to call off the event. is this america 2013? that young people are involved in this kind of nonsense sick behavior in they have to live in fear in their community? what is your call-to-action tonight? what do you want to see from the police department and law enforcement and the attorneys? >> the police department in new york they have the resources out a lot of people talk about additional funds for young people. additional education. as far as i'm concerned, you

know, that's a great idea. but i'm interested in one thing. get the people off the streets responsible for. this put them away. send a clear message. because. >> do you think some of these have been hate crimes that have targeted people? >> i'm letting the police decide that it so happens that almost all of the attack that have -- almost all of the attacks has been on people in the jewish community. in ground heights. i will let the police make that final decision. but it doesn't matter. it doesn't matter whether you have a' 8-year-old. a 72-year-old being attacked by a downperson, that is yawfned anything, 31 years in public office, i have never seen anything like this. >> imagine that 31 years of service. and this is -- did you ever think this day would come? >> it's insane. absolutely insane. it must be the authorities must act, i would love to he see the president of the united states and the attorney general say something. >> how about hear from the president of the united states hear about this?

this is a fox news alert. a dangerous winter storm slamming the country as 43 million americans trying to get where they are going for thanksgiving. chief meteorologist rick reichmuth is here with the latest. rick? >> this is the fifth day we have been dealing with the storm. now it's across the southeast and the east coast

and tomorrow it's going to be around much of the northeast. so i expect to see some pretty significant delays in the airports in the northeast tomorrow even down some of the plant. ripple effect of the country. tonight threats florida, coastal areas of georgia and the carolinas. northern side of it where it is much colder right now and seeing the snow falling pretty heavily at times from places like buffalo, back towards cleveland, pittsburgh, have you been mostly rain. it will be all rain as cross coastal areas of at least down towards the southeast. and then in throughout the northeast. this storm is taking a much farther inland track. that means the coldest air is interior sections seeing spots maybe up to a foot of snow. 2 to 3 inches of rain falling across the coastal areas though i-9 a corridor very windy conditions along with that kimberly. so we're talking about big delays tomorrow. thursday for everybody across the country looking good. >> that's what we like to hear for thanksgiving across the country. rick, thank you for being
