>> on my way in going down sixth avenue, you pass by macy's and there were people everywhere. probably a lot of tourists right now looking kind of quiet. black friday shopping is in full swing this morning. things already turning violent in parts of the country. police in new jersey using pepper spray on a customer in wal-mart. the customer became, quote, belligerent while arguing with a customer over a television. spoil while looking for a -- >> while looking for a discount tv, one woman got one dropped on her head. >> how would you describe this scene? >> pretty much a madhouse. >> the spirit of shopping. overall shoppers claim these lines and the flying elbows were worth the extra

savings. >> there are things we really needed, things we really wanted that the kids asked for for christmas and we saved 50%. >> this year's holiday sales could top $600 billion. and it may be -- the whole thing is that people are really out there getting into some fisticuffs. >> this is the same story every year and all these stores have security guards and make sure they're putting things in place. they're not doing the dash for the door thing anymore. some stores are still making that mistake, and everyone runs in and tramples everyone. they learned from previous mistakes. it may be revamped but don't call it a relaunch. tomorrow it is the white house's self-imposed deadline, the day they say healthcare.gov would be up and running smoothly. so where are we now? james rosen, my good colleague from washington, d.c., has more details with the latest. james, where are we with

healthcare.gov? >> reporter: we're ticking down to the semi relaunch. you may recall that the obama administration, the day before thanksgiving announced that small businesses will not be able to purchase health insurance for their employees on-line until november 2014. it was an example of the kinds of problems that the obamacare website is still enduring even as we approach tomorrow. >> to be clear, november 30 does not represent a relaunch of healthcare.gov. it is not a magical date. there will be times after november 30 when the site, like any website, does not perform optimally. and our work will continue into december and beyond to make further improvements. >> the website opened for business on october 1 as the place for uninsured people to shop for health coverage with government subsidies if they qualify in 36 states but only 28,000 people were able to navigate the system fully. over the past months

president obama offered differing assessments as to how users will fare. >> the website is already better than it was at the beginning of october. and by the end of this month we anticipate it is going to be working the way it is supposed to. i think it is not possible for me to guarantee that 100% of the people 100% of the time going on this website will have a perfectly seamless, smooth experience. we're going to have to continue to improve it even after november 30, december 1. >> of course, in addition to the problems that the website has exhibited, millions of americans have seen their health plans canceled since october 1 because those plans did not comply with the patient protection and affordable care act as obamacare is formally known. kelly, i know you well for years. we're colleagues here in the d.c. bureau. but i never thought i would see the day when you would

enroll today, take care of that knee and every other part -- >> notice how young everybody was in that ad, too? the cool thing to do trying to get young people to sign up because if young people don't sign up, what's going to happen? >> and advertise during football, which was a smart move. you want to reach a young audience, run it during football. >> a lot of children who are up to the age of 26 are already covered under their parent's plan which was the beauty of this affordable care act. but now trying to entice these younger people to enroll, many are saying i don't have to do that. i can sign up with my parents, stay until i'm 26. maybe they're trying to appeal to the 26 and older crowd. >> maybe it was the last football reference the president had. remember when he said he fumbled the rollout of obamacare and was raked over the coals. jay leno said a fumble can happen to anybody. this is when you say you were great at football when you remember actually

stinking at football. >> president obama responded to a fifth grade schoolteacher in a letter. the president maybe saying that he's acknowledging that politically maybe this wasn't the smartest move in the world. this was a fifth grade schoolteacher who wrote this letter to president obama. he said this bill mass caused such a divisive and toxic environment. the reality anybody who disagrees with your legislation is targeted and ridiculed. i hesitated to write this letter for fear of some kind of retribution. the president responded with th-fplt >> he said i believe health care reform will be the right thing for the country. it certainly wasn't the smartest political thing. sincerely barack obama. if you remember back in 2009, the president famously asked his staff to hand-pick letters for him to read every day so he doesn't get -- so he can stay in touch with the american people. last year he answered a question about same-sex

marriages to a ten-year-old little girl. and then this is obviously another highly politically charged issue, health care that affects a lot of people. >> here's the deal. i'm glad the president responded to the letter. it's very nice of him to do so. he knows he has an uphill battle in terms of healthcare.gov and with the affordable care act. it is still very hit and miss. even navigators who have been navigating the site to look at it are predicting when this goes on-line be again, when people are asked to enroll by their self-imposed deadline of november 30 it will still have glitches, still have errors. it is very problematic for his administration. he has to get ahead of this and even some of his own democrats are saying it's not going to happen. >> this guy, fifth grade teacher in texas, he's putting the thing up for auction. he is saying this is just words on a page. i don't know know that the president even meant what he's saying. these are his words, not mine. he's putting it up for

"fox & friends" on twitter. >> we will see you tomorrow and sunday. we have a fox news alert. six people are dead after a fiery crash in ohio. a car traveling over 125 miles per hour was being chased by state troopers when it hit a minivan and both vehicles caught fire. the car struck several vehicles. both people in the minivan died in the accident. the 24-year-old driver of the speeding vehicle was taken to the hospital with minor injuries. a man shoots and kills a much -- a 72-year-old veteran in florida. he thought he was an intraoeurd but turns out he was an alzheimer's patient.

police were called but before they arrived, the man went into the backyard when o where he -- where he saw the veteran in silhoutte. he fired four shots killing him. no charges have been filed. 11 minutes after the hour. a real-life witch in north carolina. a thief stole a kettle from a s&l sraeugs army bell ringer. >> an elderly woman got out her car. she was on a walker. she had four of her grandkids with her. i escort them through the first double doors, then the second set of double doors. i come back out and the kettle was gone. >> there is no video of the theft and investigators have no lead. the commanders of the salvation army say the agency would have helped the thief. >> football time. let's check out yesterday's turkey day action.

if you were asleep on the couch, hung over from the turkey. the green bay packers headed to detroit to take on the lions. the lions won 40-10 in their first thanksgiving win in ten years taking srabg of the fact that arrest -- taking advantage of the fact that aaron rodgers was shouldered on the sideline. cowboys-raiders, marco murray would take it for his third touchdown of the day. dallas would win 31-24. raiders versus the steelers scary moment in the fourth when levon bell takes a hit to the helmet and goes down. the steelers would go for the two-point conversion and fail. ravens hold on to this win, 22-20. former super bowl champs. did you stay awake for that one? >> it was dragging on, the

next year, what are they supposed to do this year? charles payne from the fox business network joins us nice and early. nice to see you on this black friday. what are they supposed to do? we understand they can get on the phone and still sign up their employees. but going on the website, for a whole year they are not going to do this. >> people should know this shop, the acronym, was going to aggregate all the options so employers could go in there and have an opportunity to make sort of choices, you know, to weigh all the different options out there. even before this delay which was announced wednesday afternoon when everybody was away -- i guess that is when you announce bad news -- there was another delay before this where employers had a chance to give their employees a single plan or options. this website is gone. they don't have enough manpower to work on it. they're trying to get the other one fixed. essentially if you're an

employer of a small business, less than 50 employees, you've got to search around, get on the phone, go through agents, obviously not what was promised. it's thrown a few small business owners in a loan already. >> i know quite a few small business and their concern is how do i take care of my employees? how do i even take care of myself with this hanging over my head? what is the fallout going to do looking down the road next year. >> another shoe is going to drop. with all these delays, they have had three years to work on this, with all these delays and all these oops, give it another year, it is a matter of trust also. i think what you're going to see particularly with small businesses, they can't afford to -- even large businesses can't afford this plan. small businesses, i think a lot of them will yank away these options and let employees fend for themselves. maybe pay a fine or whatever. they're going to take the path of least resistance. right now that might be something that ultimately costs the taxpayers a lot

of money. >> h.h.s., the obama administration has said that the reason that they're having to push this back a year is they're blaming, we have this november 30 deadline. we've got to get individuals up and running first. are small businesses buying this? are they feel like they're being slapped in the face especially before small business saturday? >> of course they feel like they're being slapped in the face. you had three years to work on this entire thing. by the way, this new artificial deadline they threw up, even then, best-case scenario is 50,000 people at a time will be on the site. they're asking people not to go through the site even though quote unquote it will be fixed. >> why in the world do you advertise during 40 million people watching football game yesterday and tell people to go to this health exchange website? you spend all this money on advertising to drive people to your website that doesn't work? >> i think there are two goals. one goal is the public relations goal which has nothing to do with the other goal ultimately of

allegedly warned supervisors the ground was not stable enough to support the giant crane. he claims his concerns were ignored. >> clayton, thank you. after being injured in the line of duty, corporal matthew callahan decided to take up photography. he has been taking pictures of his aoubt -- unit to give the outside world an inside look into the life of a serviceman. joining us now is the incredible man behind those photos. sir, thank you first and foremost for your service. tell us, if you will, how all of this came about. you suffered an injury and then you took a different weapon. you started using basically a camera to tell your story. >> thanks for having me on the show. happy belated thanksgiving to everyone over there. >> thank you. >> i started -- when i was a wounded warrior, i began

interning with a public affairs office to be a correspondent. at first i started writing stories and reviews for the base publication and eventually put a camera in my hand. for five months while i was there, they started going about it and just covering stories and eventually when i got better, -- eventually when i got better i went back to my infantry unit, i went back to the infantry and i started kind of taking photos with my phone. >> those photos are incredible. i'm looking at those photos now. when you're on the battle field, on front lines and covering these kinds of stories, taking pictures of your fellow soldiers and marines, what's going through your mind as you're taking these pictures?

>> i really like to get really close to everybody. i feel like with my former experience as an infantry man, i kind of know, and everything that's going on with these training operations, whether it's live fire or we're doing urban warfare training, i like to get really close in the action and i'm trying to think of the best way i can visually i can represent what our marines do on a regular basis. >> what are the guys themselves saying to you when you're there with their units taking photos of them? >> they -- i get a lot of friend requests on facebook. they want their photos. i show them the photos. that's one of the things i really like to do is, you know, that one photo of that one infantry man, when he looks at it, go that's an awesome photo, i really want that.

can you send it to me? i love giving it back to them. >> speaking of awesome photos -- i don't want to interrupt you but we're running out of time. speaking of awesome photos, we're looking at one photo now; i understand this is your favorite picture. >> if you can describe it for me? >> it is a gentleman with a bazooka or rocket launcher and another gentleman standing on his shoulder as if he's doing some target acquisition. >> yes. those are assault men. that was my previous job in the infantry. what i loved about that photo, a live fire range on the big island on hawaii. those marines were private. they were all privates, assault section. it was nearing the end of the training exercise and they had to do a volley fire. they fired a lot of rockets at the same time. they all hit their targets. being so new to their new

more serious charges. these people adopted their son as an infant, at three months, and after nine years and very little request for assistance from the government, just dropped their child off with no notice, no discussion, no therapy, and washed their hands of him. the law shouldn't treat adoptive parents any different than biological parents. >> three months old, randy. we know from all research about child rearing. this is the parents' fault. if that child is wielding a knife, it's not because they got this child who was a bad seed from somebody else. they raised this kid wrong. >> fault does not necessarily equate to crimes. we may not agree with their decision. we may find it's stupid, ignorant. call it whatever you want, but crime, we look at in the moment. intent. what was their intent? was their intent to do harm or perhaps get this child away from harm? being stupid is rarely a crime. >> so that's a good point,

intent. to do what? they may be fearing for their lives because this kid in the middle of the night will grab a knife or something. >> first to your question, there are children with issues, children with problems. that's why every state in this country has services, child protective services to help the parents. you do not get to just ignore your obligation. look, they went through an adoptive process. that is a long, arduous process, to make sure that they were willing to devote their life to raising this child. when the going gets tough, you don't quit on a child. we're not talking about a pet or an accessory. and respectfully, i disagree with randy. fault is exactly what we talk about when we talk about crime. every state has laws on the books. child endangerment, abuse, neglect, and it doesn't have to be physical abuse. >> look at their intent, though. >> it is their intent. >> the same way that mother -- if it turns out a new mother

can't handle a newborn, they have a safe harbor. you drop the -- >> this is after nine years! >> they may need help. and you know what? maybe the adoptive system needs to be relooked at. maybe this was a while with special needs. the system didn't realize it. maybe the parents were ill equipped. >> they have other children. >> that's not the answer. >> i'm not saying lock them up and throw away the key. but they dropped this kid off a note, then they went home to their two other children and they left town. so it took the police 30 days for them to find them. this is a kind of crime that shocks the conscience. their fault is not helping this child, not getting the help that he needs. >> final word? >> what kind of message do we send to other parents who are in trouble? what do we do with the parents who do harm, who beat, who neglect, who even kill a child? give them the chair? there has got to be a spectrum.

about it at the moment. we need pakistan much more than they need us right now. probably for the last several years. we want to evacuate pakistan and part of our equipment and troops have to come through pakinstani territory, down to karachi where the port is. so we're going to have to depend on them to provide security for that. so there is not a lot we can do right now. >> our national interest may be different than pakistan's, so can we ever really trust them? >> we can always trust them to operate in a way that's best for them. one of the great difficulties for the u.s. intelligence service is american politicians who believe that america's interests are the interests of every other country on earth. just if you go back to bin laden, it was never in pakistan's interest to turn bin laden over to us. we knew that -- the intelligence service knew that from 9-11 forward. yet, we depended on the pakinstanis to help us.

most of the people in there were young because they want to attract younger people. but i spoke with one of our young employees yesterday who is only 22. she was saying, i'm on my father's insurance. i'm not ready to go out and get my own health plan because this isn't work. so i'll stay with daddy. >> that's the one nice thing about it, i guess, is what you're saying. >> you have to point that out. the affordable care act did provide opportunity for young students and college particularly, for young employees like this particular person to stay on their parents' health plan until the age of 26. my own son is doing it. that's a good thing. but then you have to talk about what else is out there? right now you're thinking -- >> the 5 million americans who lost their plans. >> my cancellations, my premiums going up higher. a lot more work needs to be done if it can be done. >> right. and have a lot of angry people writing the president. imagine the letters that come to the white house. here is one letter that made it through the sieve and aides because it came from a school teacher.

this came from thomas ritter, a fifth grade school teacher. he wrote this to president obama: this bill has caused such a divisive, toxic environment. the reality is that any citizen that disagrees with your administration is targeted and ridiculed. i hesitated to write for fear of some kind of retribution. then the president actually responded to this. >> yeah. this is what the president said. he said, i believe that health care reform will be the right thing for the country. it certainly wasn't the smart political thing and i hope that in the months to come, you will keep an open mind and evaluate it based not on the political attacks, but on what it does or doesn't do to improve people's lives. sincerely, barak obama. and this guy, this thomas ritter, the fifth grade teacher in texas, says he's actually putting this thing up on-line for auction and he's hoping to make a pretty penny off of it because he doesn't believe any of the words on the page from the president. >> i think that's unfair to the president, to blame the president as being disingenuous for returning a letter.

>> two people dead after a police chase in a firey crash. a car speeding over 120 miles per hour was being chased by troopers when it hit a mini van. both vehicles burst into flames and both people in the van died. their names are not being released. the driver of the speeding vehicle was taken to the hospital with minor injuries. no word on charges. a 72-year-old air force veteran in northern georgia because he thought he was an intruder. unfortunately, this vet was a lost and confused alzheimer's patient. ronald westbrook knocked on joe hendricks' door at 4:00 a.m. and police were called. but before they arrived, hendricks went into the backyard where he saw westbrook, but saw a silhouette. hendricks said he gave several verbal commands and fired four shots, killing him. no charges have been filed in that case. most of the estimated 425 families evacuated after a train derailment and chemical spill in ohio allowed to return to their

letter of the he was held in jail for four days before being released. kelly? >> thank you. it seems like each day brings a new setback for the president's prized health care law. it is his signature domestic plan. the latest stumble, delaying enrollment for small business owners and all that trouble comes with a very big price. it's costing 2.7 trillion taxpayer dollars. that's nearly 18% of our gdp, one sixth of the nation's economy. so how will the overpriced obamacare debauchle impact americans in the long run? let's ask arthur brooks, president of the american enterprise institute and he's also an author. thank you for joining us. the bottom line is what is the affordable care act leading americans to in terms of our prosperity? >> well, the truth of the matter is, we don't exactly know because we don't know how this is going to turn out. will it turn out that we'll have a repeal and replace? will republican be elected? will a democrat be elected and

will the whole plan collapse into a single payer system which would affect the economy even more than it does today? there is so many unknowns right now and it's impossible for any cost economist or scholar to proceed addict this. we know it's a threat to the economy and know it's leading us in a direction that most americans don't want us to go. that should be a concern to all of us. >> you alluded to the single payer system, which many people believe this is what the administration would really like to do. explain for those americans who don't understand that what that single payer system would do to america. >> well, okay. so the current system, obamacare, affordable care act as we know it, is more like medicaid insofar as certain people qualify for it. it's an entitlement based on your circumstances. if you have certain amount of money, you get a subsidy. if a certain amount of money, you don't. a single payer system would be like medicare, where everybody qualifies for it. so it's a blanket benefit. that cost a lot more. that's a lot more like socialized medicine and it is

socialized medicine. >> it's good you explained it because a lot of people hear it and don't understand what it is. having said that, where do you see obamacare going? is it on the brink of collapse or what's its future? >> it's a very complicated program. the latest setbacks, what they've done is effectively shattered the program so it's turning into a lot of little programs effectively. it's going in a lot of different ways simultaneously. it's not going to go away. point of fact, it's been around for a long time. it's been under plans for a long time. it's not as if republicans or conservatives or anybody will come in and get rid of it in its entirety and go back to the old system. most americans don't want to go back to the old system. virtually everybody knows we need reform of some kind. >> sure. everyone knows that and welcome reform. but they want it done in the right way. but having talked about all of this for so long now, what's it doing to the average person who would like to dig deep into their pockets to give generously to help out charities in need, people in need?

>> well, it's creating a lot of uncertainty. when there is uncertainty, people give less. this is something that i've been looking at for years and years and that my institution is looking at because it's part of our system of freedoms. it's part of who we are as people. when you inject uncertainty into the economy, when people are worried they have less money. when the government backs more of a european style social democracy, people become less generous. that's part of our exceptionalism. we should take that very seriously. >> i'm so glad you said that because generosity is part of our compensationallism. americans will give, give, give, it makes them happier and healthier. but look, right now there is a pal over the american society. there is angst and anxiety and charity would make us feel better, but we're constricted by all these things going on in the realm of obamacare and other aspects of our economy, which causes a great deal of uncertainties. what too we do about it to get back to being the giving people that we are? n that actually comes from our culture. that comes from our morals and

values. i know it's tough times. i know we're afraid. i know the economy, especially for the bottom half of americans hasn't recovered. we can say we're in a recovery, but that's not true for about half of americans today. so what we have to do is take matters into our own hands. one of the things we see in all the research on charitable giving which shows that americans give more than the entire gdp of most countries in the world. we're truly exceptional this way. we need to take matters in our own hands for the needs in our communities and give, even if it's uncertainties. we can do that at the end of this year and really get our american mojo back by being the givers we really are. >> the saying is, give until it hurts. but it's actually give until it makes you happy and feel good. >> that's right. one of the interesting things that we see, you're healthier, happier, you'll even get richer and the data shows that. >> that's true. it comes back exponentially. thank you. >> enjoy your holidays and happy thanksgiving. >> thank you.

this patriotic sign which reads, thank you veteran for your freedom, has been hanging above johnny's saloon in huntington beach, california, for six years. now the city is step not guilty and threatening to fine the bar unless it's removed. why is this happening now? is there a reason behind these demands? chris is an army veteran and employee of johnny's saloon. j.r. nichols is head of a veterans charity which works closely with the saloon. nice to see you. welcome to the show. >> good to see you. >> chris, let me start with you. why do you think this happened after six years it took them to get this letter out to you? >> why it happened? i honestly can't answer that right now. but what i can tell you is that yes, that sign has been hanging above the saloon for going on ten years. but prior to that, the actual structure has been up there for 30. back in 2003 when they pulled

the opportunity to get somebody out there to inspect that yet. >> j.r., what's been the response of veterans going into this bar? >> there is veterans and active duty that actually come in from all over the country. we host several fundraising event for our combat wounded right there at that location. this is a place that's probable low one of the most patriotic establishments in the country and they feel at home. it's difficult when you're coming back from combat, you're thrown back into home and you got a place you can go to where you're safe. you don't have to worry about people behind your back. you can't take that away from people. that sign is the initial welcome for them to be able to see when they come home. you might as well say don't come here. >> do you guys have a facebook page set up for our viewers wanting who want to help for you or make a comment and weigh in on this issue?
