hello, everybody. i'm harris faulkner in tonight for my friend greta van susteren. we were just five hours away from the obamacare deadline day, but just moments ago fox news confirmed the giant web site will now be down for extended maintenance. starting at 9:00 p.m. tonight until 8:00 a.m. tomorrow morning. that means we will not see any sort of launch at midnight. in the past few days, the white house has consistently been lowering the bar ahead of the fixed deadline. but how low can they go? former congressman allen west joins us now. congressman, no time like the present who bring you in for some breaking news tonight. lower the bar even further. what is going on? >> well, i think this is incredible he thud ♪ put their own set mandate on it because everyone is watching. for them to continually come back and say we can only take 50,000 or as you just reported it's going to be down, this is a erode in the

confidence of the ability not just in the obama administration but of president obama himself. even worse the political ramifications it's going to have going throughout the democratic party is going to be absolutely chilling because they can't explain this away anymore. we really do have some problems. so what you are seeing is not just the web site. but the entire policy. hard to call it a law with all these waivers, exemptions and delays that have been granted out there. the american people don't know where this is going right now. and to be 20% failure rate people won't be able to get on it. what does it mean for 20% who are still looking to have healthcare coverage? >> it's interesting to hear the white house talk about it they call it 80% success rate. but, you are right. in one in five people won't be able to get healthcare insurance. congressman, you understand

messaging. a hype in reverse. setting us up almost for nothing to happen. what are you expecting come tomorrow? >> i think right now you you saw a president talk about more immigration reform than this current pressing issue. they don't have any answers. they don't have anywhere else to go. i believe you will see internal pressure within the democrat party to sayot to put g on time-out. we have got to, you know, how do we go back to the drawing board the question is is the president willing to set aside his arrogance and healthcare law this policy and say you are right. this thing is totally unworkable. let's not forget, this harris, between one october and one march, they are supposed to hit the magic number of 7 million americans to be enrolled into the healthcare exchanges. that means about 55,000 americans a day in order to make the sustaining numbers

that they need for this to go afloat. they can't hit it 50,000 people not signing on that. would be almost impossible if you see the math. healthcare.gov do something. in the white house don't call did relaunch. i don't know what term you would call it are we any farther now from the initial rollout than we are in terms of all of obamacare? >> no, i don't think you you have gotten any anywhere close to be successful in a rollout. given all of these delays and push back for the employer mandate and what have you same thing individual mandate. if you are concerned about people with preexisting conditions. establish the high risk pools and appropriate type of subsidies for them. not talking about tort reform. that's a major reform

healthcare. need to break down the state-by eye state monopolies. deter competition and drive costs down. promote health savings accounts and not taxing health savings accounts which is what obamacare does. really, you are talking about not just a web site failure, you are talking about a policy failure. you know, it's interesting inherent what you were just saying is you come up with the talking points if you will for the g.o.p. to give a replacement tact if you will a strategy against what is failing. i want you to take a look at something with me. i don't know if you caught this today, congressman. kathleen sebelius wrote a blog ahead the deadline which we know now is a moving target with thought an extension and shut it down overnight. highlights on the screen for you and all of our viewers now. i just want you to see she has kind of put a shopping theme to getting coverage on healthcare.gov once it goes live again. a holiday shopping theme. she says the product is popular. so avoid the lines and shop healthcare.gov during off

politicizing the holidays. >> well, i think you would have to say that. last few days the white house has sent out and the president's organizing group called organizing for action has sent out talking points for people who might be at thanksgiving gatherings or hanukkah gatherings to pitch obamacare to their family members. and it gave instructions for how to bring it up and how to it suggest that we should go to the web site if it works. and sign up for it. discuss the features of obamacare. it even said you could use common events in a holiday household to -- as a springboard to talk about obamacare. it had a picture of a man with a big knife carving a turkey and then the next photo he had a bandage on his hand and said you know food-related incidents happen this time of year. that's a great opportunity to talk about obamacare. >> i had not seen that picture. that's insulting. >> actually, this got a lot of negative reaction. it got a lot of ridicule.

certain amount of mockery. on a more serious basis, it received criticism for the obama administration trying to politicize what had been family, personal, and sometimes religious gatherings. remember, back in the 2012 campaign, the presidential campaign, the obama campaign asked for people who are having birthdays or weddings or anniversaries? >> i do recall that yes. >> to register with the obama campaign and essentially make, instead of people giving gifts to the happy couple, they would make a contribution to the obama campaign. so, there has been this kind of trend with the president in the past wanting to politicize the personal events of his supporters. >> well, if we have slid down a slippery slope obamacare getting hurt, that's disturbing to say the least. byron, you know, congressman allen west was just on, former congressman from florida, and he was kind of giving some points if you will of republican fixes to all of this.

is it time for us to see republicans come up with a complete replacement plan for obamacare? where is the pac money? should would he be seeing some ads on the air with this now? >> i think a lot of republicans would say it's long past time. this has been a huge problem for republicans in dealing with obamacare. everybody knows they are against it. they want to repeal it but what would they do in its place? and if you go back to the debates of 2009, 2010, republicans had a lot of plans to replace obamacare. their alternatives. they have created some sense then. but they have never united behind a single plan in the way that democrats united around obamacare. members of the public could say okay, republicans, we know what you are against, what would you replace this with? right now the national republican party has never united behind a single plan. >> well, i will tell you, they will have some talking points to work with if, in fact, this site gets shut down for maintenance through

well, it is down to the wire, the deadline to finish repairing healthcare.gov is set for tomorrow. tonight, the web site is shutting down for nearly 12 hours of maintenance. extended maintenance, they are calling it it cyber security expert david kennedy joins us. you know, david at first i had planned to kind of asking you to tell me what still needed to be done. now i want to ask you what are they going to be working on in 90 minutes that they didn't get done before now? >> i think what they are going to be doing is basically pushing new code to the web site so that it will probably be reskinned to look a little different. probably be functionality, availability, things that they have changed but unfortunately i don't think none of russ too optimistic about it actually handling the load that it's intended to do the period of time. >> well, what will the deadline actually look like if you will? i know you you say they are going to re-skin it which means it may have some different colors so on and so forth.

if you tried to sign on before and need to sign on after the deadline passes what will you notice right away. >> the feel and functionality will be be different. how you navigate the site will be different. and mostly it's going to be mostly behind the scenes of a lot of things that have changed. if you look from the imposed deadline of october 1st, obviously the web site didn't function appropriately. what they are trying to do now is get it stable so the individuals can can go on the web site so sign up for healthcare benefits or go to the state exchanges or whatever they need to do to sign up for it? >> how realistic was this november 30th deadline? >> about as optimistic frrt october 1st deadline. when it comes to programming, if your architecture and how you design your infrastructure is flawed from the get go, this sin harntly what happened here. they weren't ready to go out the door. october 1st was a bad day, it's not going to be any different at the end of the month here. especially tomorrow. what we are going to see here is pretty -- maybe it will stay up for a while.

still see a the love the same issues we did before. working on functionality and ability of the site. basic will you you have hundreds and hundreds of developers. all hands on deck. cops, programming rushing out the door. exactly what happened october 1st deadline. they are not going to test it again this time. now they are going to be pushing all this code out which introduces security flaws. >> are you saying they are not going to test it before they put it back up? >> that's what they are doing now, basically taking the site. push all of the new code to the infrastructure and have some test environments. not going to be the same as if if it was in a production instance. basically pushing it out the door and hoping it's going to work again. >> you testified before congress earlier this month and you told them that you had some serious security concerns about this. what are they and do you still have them? >> yeah. a lot of things that we have seen and a lot of the areas that we identified for security flaws haven't been fixed yet. they are not going to be fixed by this deadline tomorrow. >> what are we looking at here? i put my personal information up if i try sign

where we started site will be down 12 hours scheduled to go back online tomorrow morning saturday. that is tonight's speed read. right now is there an outbreak of lawlessness in washington, d.c.? our next guest says absolutely yes. charles krauthammer. author of all things that matter joins us rather. and i just read your book. it's fabulous, by the way: what do you mean by lawlessness in d.c.? >> i'm talking about how the administration particularly the president seems to think that he has right to change duly passed statutes on his own. suspend whole parts of laws on his own. the constitution pretty clear. the president executes the law and the congress passes the laws. so, for example, a few months ago obama decided that he wanted to suspend, the postpone the employer mandate of his own law of

obamacare. of obamacare. you are not allowed to do that you have got to change the law in congress if you want to do it. he did it without hesitation. a year ago he did some recess appointments, you are allowed to do it if the senate isn't in session. the problem was the senate was in session. and the courts have so ruled. this is a very cavalier attitude. but the worst part was what happened a couple of weeks ago when the president, stunned that there were all these cancellations of insurance policies. so your memory held a press conference a couple weeks ago. told the insurers to reinstate the policies. there is only one problem with that the policies were cancelled because under obama's own healthcare law it's ill lee to issue a policy after the year 2013 unless it contains, these minimal requirements, these 10 elements that it has to have. for example, maternity care and all other stuff. so if you had a policy that

wasson said, it's because it did not satisfactory the minimum. -- satisfy the minimum. there is no way that an insurer can reinstate a law because it would be illegal to do it. so obama's own law is something that he ignores and he encourages insurers and state insurance commissioners to allow to be violated. and the way he has been doing this, it's sort of the cavalier attitude. i find absolutely astonishing. >> you know, you talk about lawlessness and then you mention the fact that the president appeared stunned when millions of americans started seeing their healthcare policies cancelled because of the healthcare law he put into place. could it also be panic? >> well, i think absolutely. i think they didn't sort of see any of this coming. quite remarkable how you could have missed that after all the idea of this healthcare law is to increase radically the number of people with health insurance and instead we get

almost no one receiving health insurance, and we get 5 million americans losing health insurance, so absolutely and it was also one other thing matter of deception. it's the way he had sold the bill, promised the bill and told americans if you like your insurance you keep it, and then he added the fatal word, period. which meant no caveats, no exceptions, no argument, and no curly qs around here. that turned out to be false. and that's why his numbers have cratered. >> we have seen his job numbers tick down. that job approval well above 50%. before i let you go, charles, overall not just this white house, we have seen abuses of policy and of power. do you think this is on the rise inside the beltway? >> i think it is because i think there is so much hostility between the parties that the one party in power is willing to

overlook all kinds of illegalities, all kinds of violations of constitutional norms. if it satisfies their political interests, if it advances their agenda. and i'm just shocked the way democrats are allowing all this to happen and the reason is, one day the other guys are going to be in power and democrats will roux rue the day when they allowed all of this. >> as you pointed out in your book it's karma. >> absolutely. >> thanks for being on tonight: many republicans are getting ready to make their next move. what will that be? will members push for obamacare to be repealed again? chip away at the law? tell everybody we are going to throw the towel on this thing. come up with their own idea. that's them talking. louie gohmert we can put the words in your mouth on your own, good to see you, sir, what is next? >> well, first of all, thanks for the unenviable

position of following charles krauthammer. >> you're welcome. >> but, well, there is a lot of: this president is turns out we now know was intentionally being deceptive. these were lives that were talked about, should we lie about it? should we not? and they did. and harris, i think it's now time, now that we're seeing cracks in the democratic dam, they are realizing what a disaster obamacare is. just as those of us who read the bill before we voted against it knew. so, now is the time i think, harris, not only have we voted to repeal obamacare in the past, but now is the time to start doing what the president promised the american people, what they elected him to do. and that is to reform healthcare by having hearings where he said we'll do it on c-span, where the whole country can see who is in favor of what.

that's what we ought to be doing now. >> how would you push that? what would you do to make that happen? >> we can start having those hearings in the house where we talk about what is suitable reform. we had offered to have a bipartisan bill to deal with the issue of 26-year-old or 28. heck, if he they're at home and they are living with their parents, we can work that out. we ought to do those bills now because the democrats are saying, gee, there are three or four good things in obamacare and you will lose all of those if it's repealed. well, we can go ahead and fix those in advance, debate the proper reform. there are a number of us that have great alternative healthcare reforms that will get people back in charge of their healthcare and it will cost less and it will be better all the way around. so, the less government, more filling. >> you know, it's a positive message that you are offering up now. you know, republicans really get slapped on the hands for being no, i know 47 times

have you tried to get obamacare repealed. but i don't hear you saying that. i hear you saying there is a way that you guys can actually work together. i think you are in the minority having read the bill before it passed into law. >> well, i think i was. it was pretty nasty reading but the more you read it, the more you see it delves into things that had nothing to do with healthcare it was all about a government takeover. harris, to think about our federal government, this administration saying dangle your driver's license all your most personal information out there, and put it on line because it's about to be hacked, i cannot imagine an administration telling americans get on this thing when it opens up in the the morning, and get your personal information out there and know protected. it's just unfathomable what they're reduced to at this point. we ought to be about these hearings. let's show america the real reforms that will really fix healthcare and let's get competition back in there

to get on the site. it's just one of many ways americans are feeling the impact of obamacare. remember, the deadline to start this whole thing was tomorrow. now they are shutting it down. just a few minutes ago you heard from doctor. who raised a lot of red flags, including a 90-day grace period for companies to pay doctors. can you imagine your mortgage company giving you 90 days to pay? people wouldn't pay. "the washington examiner" susan joins us now. i'm still reeling from that, susan. this is unbelievable. why are we hearing this from the white house. if doctors feel they are not going to be paid in a timely manner, they are not going to want to work in this system. >> it's all part of the rollout. you will start hearing more about it when people start trying to use the healthcare plans and they go to their doctor and they find out the doctor is not on the plan or the doctor finds out they are not going to get paid. we really haven't gotten to that point yet. we are at the point where everybody is trying to sign up for this thing and having a hard time because the web site as have you been saying isn't up and running, isn't functioning yet.

secondly you have a lot of people who are shying away from signing up for coverage because the premiums are really high. the deductibles are high. it's not gotten off the ground yet. but, when it does, we are going to start running into the problems that you have been talking about on the show. particularly the doctor reimbursement issue. availability as well. all of these things sort of a rolling system of problems associated with the healthcare law. we are going to start finding out more in the new year if people sign up. well, i guess former house speaker nancy pelosi was right. we have to pass it to-to-see what's in it apparently interest v. to live with it for a while to see what's in it too. susan in terms the messaging coming out of the white house. i ask why isn't the white house -- i see this as bad news. in a way the bad news about the white house is keeping us from focusing on the bad news about everybody else. >> >> the issue with obamacare two major issues, the first one, of course, the web site is not working. people can't get on it to sign up. that's a technical problem. the next issue is the bigger

more fundamental problem with healthcare law. is it affordable? is it accessible? is it going to work? are people going to be able to get the healthcare they want? those are big question marks right now. we are really hearing a lot of bad news. there is this big push trying to rebrand, remarket as the president said a few weeks ago this whole healthcare law so they're paying company, families usa a liberal leaning group to try to send a message that there are people getting affordable healthcare. they are going to make big push in the coming weeks to try to throw out a message of people getting affordable healthcare. they just started on that right now. if you look on their web site, what you are seeing are a lot of folks saying they think the healthcare law is going to help them. you are not seeing a lot of people say hey, look, i just signed up for healthcare plan, it's affordable for me it's what i'm looking for. you are not hearing a lot of those stories yet. spent a million dollars on this website. susan joining us tonight on a friday.
