of the relaunch of health care.gov as it goes forward. the man heading up the fixes said earlier this week today, deadline today, quote, there could be moments in the middle of the day seems to be the peak where capacity goes beyond that current user level, at which point there will be a customer friendly queueing system, which will notify you when to come back to the site. he says by today 50,000 people should be able to use the website at the same time. and that the website should be able to handle, in total, 800,000 day. overnight the scheduled hours of maintenance on the site turned into 11 hours of maintenance. something republicans noted today when talking about the website's relaunch. >> the expectation is for about 80% of those that go to the website, that it should work. you got to look at the fact that

they did take it down, again, for another 11 hours. i understand this morning it is sporadic as to whether it is working or not working. when people are logging on. >> blackburn says republicans are believe a better approach is to allow insurance companies to sell plans across state lines to increase competition and to allow consumers to have numerous choices in health insurance plans. arthel. >> molly heninburg, thank you. meanwhile, president obama taking a break from the oval office and doing some holiday shopping for small business saturday. the president and his daughters, malia and sasha, visiting washington's famous politics and prose book store. told is the fourth annual small business saturday promoting independent merchants. the president told reporters he brought books for every age group. we do have new details now

on that deadly police chopper crash that collided into a crowded pub in glasgow, scotland, killing at least eight people, injuring dozens more. the rescuers describe the scene immediately after the crash. take a listen. >> there was just people pouring out of the pub and there was just -- it does seem to be coming out of nowhere. like, almost from the ground almost. almost like a -- human chain. and there's people much deeper in the debris of the pub. trying to pass people out, you know, grab the person given to you and pass them on to the next person. >> the pub crowded because it was the eve of scotland's official national holiday st. andrew's day. scottish leaders reacted to the tragedy. >> our condolences to those who

will be bereaved and solidarity with those who have been injured. this is a black day for glasgow and for scotland, but it's also st. andrew's day and it's a day we can take pride and courage in how we respond to adversity and tragedy. and the response from emergency services and ordinary citizens has been exemplary. >> he did order the flags outside government buildings be flown at half-staff. investigators say it's too early to know why the chopper suddenly came down. >> there was another dead lie flight incident. this was involving a plane crash near a remote alaska village. st. mary's about 400 miles from anchorage. 4 of the 10 people on board are dead, including an infant boy. no word on what caused the crash. investigators arriving at the scene today.

north korean state media reporting a detained american ved ran has now apologized for alleged crimes during the korean war. state television releasing new videotape of this 85-year-old merrill newman. he was arrestled about a month ago while traveling inside the country. live in los angeles with the details. dominic. >> hey there, greg. big questions as to whether merrill newman wrote this apology actually by himself. merrill was part of the united nations career six partisan regiment back during the korean war. with the intelligence bureau. the koreans accused him of war crimes from that time. and also for acts against the state during his recent visit where he is returning to talk to perhaps or meet some of those people that he met during the korean war. in fact, during that apology, he describes how he wants to meet,

quote, surviving soldiers and pray for the souls of the dead soldiers involved in the conflict. help pl he planned to put them in touch with an association the north koreas consider an enemy of the state. during the part he wrote out of that statement, he appears to be describing some of that. take a listen. >> i asked my guide to help me look for their families and relatives living in dprk and i gave the document with their addresses and e-mail addresses to the guide in the hotel. >> well, it appears that he seems to try to reconcile himself with the korean authorities. there's a line that he actually put out in that statement. makes you wonder just what kind of conversations he'd actually had. just take a listen to this. >> on this trip, i can understand that in u.s. and western countries, there is

misleading information and propaganda about dprk. >> now, probably because of his age and the fact he's got health problems, the koreans accepting his apology. normally, they just throw them in jail and we'd just hear about a sentence they've been given. acts of repentance have certainly helped americans in north korea before in the past. back in 2009, there was a christian missionary who apologized and very soon after he was released. the families very much keeping fingers crossed. they're based here in palo alto california. they're hoping that perhaps he'll be home in time for the holidays now, christmas perhaps. >> thanks very much. the united states offering to help destroy syria's chemical weapons. the organization for the prohibition of chemical weapons says the united states could contribute destruction technology and financing to

but how far can they push away from their leader without coming across as disingenuous traitors? >> they're obviously running for the hills. even mary lap droe from your home state rode on the president's plane but did not attend a public event he was going to. landrieu said she would vote for obama care again if she had the opportunity. with that, 50% of her constituents think she's doing a bad job. clearly, the democrats don't want to face their constituents. i don't even think they're having town halls. maybe they're having them on the phone. even that's a controlled environment. so clearly they are backing away from obama because he's radioactive with obama care and his failures. >> and bringing this up again, democrats a month ago held an advantage among registered voters. take a look at a new cnn/orc poll. indicating the gop now holds a

49% to 47% edge, which indicates, again, a turnaround. we're talking about the battle for control of congress and next year's midterm election. julian, apart from a duck and cover approach, how would you advise the democratic party to proactively reposition themselves back into the favorable column with the voters? >> i think with all due respect you exaggerate how bad the position democrats are in right now. the democrats have been up in almost every single week of the last year on the republicans. it is only after the worst month of the obama presidency are the republicans even in a statistical tie with the democrats. that's what that is. that's a statistical tie. now, you combine that with the polling that has been done on republicans. seven in ten months do not have a favorable opinion of the republican party. nearly eight in ten americans do not have a favorable opinion of

the tea party. so while it's true obama's numbers are down and while some of that has been brought down as a result of health care, republican numbers are much worse and the polling on health care shows that it goes up and down. that's something that's easily reversible when they tell the positive story on health care. >> i understand your point. i pick it up with you, if obama -- >> a lot of spin. >> he's saying it's happening on both sides. >> i'm saying the republican numbers are worse. >> so listen to this, if obama care we're talking about now is still problematic, say, closer to midterm elections, will it be enough for the gop candidates to run campaigns about how much obama care's a disaster? or will they need to present a platform of viable options to the voters? >> i think there's a little bit of both that needs to be done. ways front and center is the failures of obama care and the democrats are the face of the failures of obama care from the

president on down. clearly, they don't want to face their constituents now. obama lies to us. he has a credibility issue and a trust issue. people don't trust president obama, including me. they don't trust anyone who backed obama care because it's failing americans. people are losing their health insurance daily today. >> i'm going to end with you. >> just to respond to that. republicans want to turn to a health care system where insurance companies can williamwilliam ic whimsically either -- >> free market, we don't want command and control -- >> can i finish? that's the policy before, insurance companies could revoke your policy or deny your coverage if they thought it was going to be bad for them financially. that's point one. point two, you did not answer the question, which is do the republicans have to have an alternative? nobody understands -- >> and -- and individuals

right over the building. >> the driver was not injured. no word yet on any charges. growing tensions now over china's new air defense zone. it's islands that have been controlled by japan. well, the u.s. and neighboring countries like south korea's rejecting beijing's claim flying their aircraft through the area. u.s. and japan also holding their regular joint naval exercise near the islands but now the state department is advising u.s. air carriers to comply with china's demands. this is vice president joe biden is set to visit the region next week. joining us now is former state department senior adviser kristen white. good to see you. is this the commander in chief telling, you know, armed forces to essentially stand down after controlling this area in the

south and east china sea for decades? >> well, it's a bad precedent. you know, you have china in an air space grab that's basically, you know, a step ahead of a land grab. trying to grab the seinkaku's. japanese carriers have said they're not going to play ball with beijing on this. u.s. airlines have been told they have to do what the chinese want, which is a terrible signal. it's another instance of ally betrayal by this administration. >> is it your interpretation that china sees obama as weak, and they've got three years to accomplish something? the policy doesn't exist in a vacuum. in china beijing can take a look at what just happened with iran, for example, where the administration paid $8 billion in exchange for meaningless promises from iran to halt or to slow down its nuclear program. you know, beijing sees this

administration as weak. sending b-52s through the disputed air space is better than nothing. that was an old plane, unarmed, not combat survival against a real air force, really if there's a threat to u.s. carriers then those planes need to be escorted by u.s. military aircraft. >> and the other aspect of this is that china is not skilled at no-fly zones. so, would -- what you're doing is you're setting up a real risk opportunity. or you're not? >> china's been engaging in risky behavior and this will only add to that. they've picked fights with literally all of their maritime neighbors, including -- or also india, as well. land neighbor. border dis350u9s with every single one of them. they're pushing the periphery in cyberspace against us. and this is on top of all the theft of intellectual property and defense secrets, so this is a belligerent nation undergoing a bit of a leadership transition still on the tail end of that. and all of this reckless behavior could, you know, frankly lead to something very

>> actually today marks their self-imposed deadline for fixing all of the problems that have been plaguing the health care website ever since its launch back on october 1st. we're live in washington with more on this. ho molly, any sense yet on how the day is going? >> not really, gregg. we're expecting -- we are not expecting an update today. but tomorrow morning, yes, we are expecting an update then. the obama administration has promised americans that they'll have a better experience as of today at the healthcare.gov website. but so far no numbers on how many people are trying to logon today, and how successful they've been. the president's team's been working on this website for weeks. it was just down for 11 hours overnight for maintenance. it was only scheduled to be down for four hours but was down for 11 hours. jeffrey zients who is overseeing the website's fixes and relaunch today said earlier this week that by today, quote, the vast

majority of consumers will be able to fill out applications, shop, compare plans and enroll in the insurance plan. he went on to say we will continue to update you on metrics and user experience and our success rate as we go forward. suggesting again that we shouldn't expect any numbers today on how the relaunch is going. zients did say that he expects that the goal is for 50,000 people to be able to use the website at the same time. and that the website should be able to candle 800,000 consumer visits a day. >> 50,000 at the same time. that's it? right? 50,000? >> for today. that's the goal, yes. >> yeah, okay. what are we hearing from republicans today? anything? >> republicans say they're skeptical about some of those promises and they're waiting to see if the obama administration will live up to those promises. here's more. what they have done was to reset the expectation so many different times. they passed their legal

deadlines. they've had 22 delays. they've given 1700 waivers and people are saying, wait a minute, this is not the way it was supposed to be. >> there also is the issue of who is signing up for what. one consultant estimates that 00,000 people have enrolled in medicaid. that's taxpayer paid health insurance for the poor. compare that to only about 142,000 people who have signed up for private health insurance plans through these obama care exchanges. greg? >> molly henneberg live in washington. molly, thanks very much. >> well, gregg, critics are saying that the white house can't really afford to make any mistakes this time around. especially considering all the embarrassing moments from the initial rollout, including when the health care website crashed right in front of the secretary of health and human services. >> -- temporarily down? >> uh-oh. >> well, it's okay, it will come back. that happens every day.

>> a chief congressional correspondent for the washington examiner joins us now. hi, susan. >> hey, arthel. >> okay. so come midnight, coupled with reviews in hours and days to come, and if the healthcare.gov website still is in the disaster zone, also in the face of the sliding deadlines pertaining to the rollout, could this make it impossible for the white house to get anything done in the president's second term? or can the white house get past obama care? >> well, the president's already in trouble. if you look at his approval rating, it's really taken a hit, and those of us working on capitol hill know from talking to democrats that they're losing faith in the president. a lot of them are really stunned by how this rollout didn't go as planned. they feel a little bit betrayed by the president not just for the website glitches, which the white house is clearly working hard to resolve. but the overall plan. is it affordable? are doctors going to be accessible? there are many, many questions

about that. i feel like for the president his legacy and his authority right now are really tied to the health care law. and there are huge questions about how it's going to roll out. are people going to find these affordable plans like the president is promising? if they are, then democrats prospects will improve and they'll be more likely to work with the president. he's already limited, because he has a divided congress. he has republicans in the house, and he has democrats in the senate. so there's not a lot he can do in terms of moving big legislation. but he, at the very least, needs big support from his own democrats. he will lose that big time. and where will he lose it? on this health care law. you'll see more clamoring by democrats in the senate to move legislation that will either delay it, or amend it in some way, that will undermine the law in the end. the president wants to avoid that very, very much. but he won't be able to if the glitches don't really get significantly resolved and if people can't get on that website and find a health care plan that they can actually afford, where they have access to the doctors they want, but which makes them happy. and so far that's a big question

mark. >> we'll find out the answers soon. meantime, another budget showdown is looming on capitol hill. budget. so congress has just until december 13th to pass a new budget. susan, as you well know, and while back room talks led by congress members bill manchin, susan collins, are reportedly under way, there is little hope on the hill that lawmakers can come to an agreement in time. so i ask you, can we expect a grand bargain, or a mini deal? >> i think we're looking at a much smaller deal arthel. because, as you say, there are some folks talking just in case they can't strike a deal. but i think what's going to happen, the budget conferrees who are negotiating right now are going to get rid of this idea of a grand bargain, while reforming medicare and doing the tax code over completely. there's not enough time and there's not political will to do it. the gap is just too wide philosophically between the republicans and democrats. they have less than two weeks. so what they're going to aim for, what members are telling me, the smaller deal, maybe a

top-line number for 2014, and 2015 at best, where they set the budget figure just for this little two-year period. they don't have to negotiate something much bigger. but what they will do is try to replace some of these unpopular sequester cuts through domestic and military spending. they'll divide it evenly and they'll get the money through some key increases in the government. they'll avoid tax increases because republicans won't go along with that without the entitlement reforms that democrats aren't going to agree to. it's going to be a mini deal that they carve out with just a much smaller -- smaller elements here. there's no guarantee they'll get that. but it's much more likely if they aim for small. >> for small. you already said the president's approval ratings took a hit over obama care. congress, their approval rate something 10%, and you've got all 435 members of the house up for re-election in the 2014 midterm, 35 senate sees up for re-election, 21 democrats, and then you have 14 republicans.

so final question for you, susan, is how much will this factor into those budget nego and the goal of getting something accomplished that would be satisfactory to the people? >> yes, the number one goal here will be republicans not being blamed for a government shutdown. so in some ways it gives democrats some leverage. but with the real problems with the health care law, republicans are on much better footing than they were in october after the government shutdown but that is going to be overhanging everything as you say, the elections, people don't want to be looking like they're shutting the government down by being obstructionist so you're going to see both sides working to the to strike a deal by that either get a number by december 15th and have a deal together by january 15th, which is when that temporary funding bill expires. i think both sides are quite eager to accomplish that, because as you say, their ratings are so low with the public they're just not going to tolerate another government shutdown.

welcome back. time for a quick check of the headlines. a flight attendant for united airlines now recovering after a plane was forced to make an abrupt stop on the runway. it happened while taxiing at washington's dulles international airport. spokesperson says the pilot was trying to avoid crashing into a vehicle that was on the runway. two dozen people, including several children visiting a las vegas casino also recovering after coming down with a flu-like symptoms. unclear what caused them to get sick. officials say majority of those who fell ill were all part of the same youth football league. and today marks the official end of the 2013 atlantic hurricane season. forecasters say it was one of the slowest on record. just one storm, tropical storm andrea, made landfall in the united states.

new details on the deadly police chopper crash that collided in to a crowded pub in glasgow, scotland. at least eight people are dead, dozens more injured, and crews today are searching for survivors. now, the pub was especially crowded because it was the eve of scotland's official national holiday, saint andrew's day. and joining us on the phone now, becky johnson of sky news. betsy is at the glasgow royal infirmary where 14 of the injured victims were transported. so becky, give us the details as far as you know? >> well, we have an update from the official just in the last couple of hours. we know that in the initial aftermath of this clash, 32 people were taken to hospital. we're told that 18 of them were treated. they've now left hospital but we're told 14 still in a serious condition. we're not being told very much more than that except that we know that their injuries are

mainly head injuries, spinal injuries, and fractures. so as you say, eight people confirmed dead. but also, the authorities this evening saying that until that helicopter is moved from inside that pub, they can't confirm how many people possibly bodies may still be inside. so there's really a tragic day for the people of glasgow. around this hospital tonight, where i am, a real sort of somber mood. and that's the mood across the city. i've seen people just walking around in tears, as the news that eight people were dead confirmed. you have to remember, of course, the investigation is being led by police scotland, the major police force here in glasgow, and it was, of course, two police officers who were on board that helicopter that crashed into the pub that are now confirmed as two of the people who died. the number of people leading this investigation have lost in some cases, and in other places colleagues. so really tragic day for the

people of glasgow here today, and of course we still don't know the full extent of this until that helicopter can be lifted out of the pub, at which doesn't look likely to happen today, more likely tomorrow as it's already late in the evening here in scotland. >> right. and becky, of course it's a somber mood there went from a celebration to just outright chaos. unfortunately, and i know you mentioned that there are people walking around there at the infirmary where you're located. what about the families of the victims. have they been able to get some information as to how their loved ones are doing and the condition there? >> we did speak to one man who -- whose father was in the pub last night, apparently he's a regular in that pub, and he hasn't been able to contact him, his phone he keeps ringing it, it keeps going to voicemail, and he fears now, obviously nearly 24 hours since this crash that his father may well have died but he's had no official confirmation of that. so really terrible situation for

that family. and of course, like i say, until that helicopter is moved there will be many families still just really anxiously waiting for news. we're told by police that this is still a rescue operation, not just the recovery offer, in which it might be a glimmer of hope that even if there are people trapped in there, they may still be alive, but obviously as the hours go by, that hope is fading, and i think the fact that we're being told very little about the condition, that they're in hospital, i think it's possibly a sign that either their families have yet to be informed, or that perhaps their injuries are potentially life threatening. so, as i say, this tragedy could potentially get worse for people as they hear news as the missing hours go by. >> it's news you hate to hear and news you hate to report. i do appreciate the update. becky johnson of sky news.

a district judge telling colorado sheriffs that they cannot sue over new gun control laws because they're a group of elected officials, thus they don't have standing. this halting a lawsuit that 64 sheriffs filed to overturn laws that went into effect july 1st limiting the size of ammunition magazines, requiring universal background checks to break it all down for us attorneys keisha heaven and robert shauk. robert, let me start with you. i mean the judge saying you don't have standing because, that means essentially, you're not affected by it. well, i can't think of anything more affected than sheriffs at the opposite end of a barrel of a gun with limited ammo. >> right. i mean it's a total cop-out by the judge. i mean she didn't throw it out because they're saying now you can go after it as individuals which some will likely do.

but this puts law enforcement in danger. you can pass the legislation just don't make it apply to law enforcement. they did it here in new york. it doesn't apply to police departments. why are we allowing there to be restrictions, where other individuals can even get around these new limitations, and stock their magazines with more bullets than the law is going to, you know, require, and the police officers are going to be the only ones with the required amount in their magazines. it directly affects their ability to fight crimes. >> does it make sense to you? >> you know what, gregg, it does because what i think the sheriffs need to do is show how it affects their job. how it affects their ability to likely carry out their job. and if they need these extra ammunition magazines or whatever, then fine, maybe the legislation can be amended -- >> they're being outgunned, everybody knows that. you just open the newspaper every day and read about police officers, who are being outgunned by all these guys with basically with machine guns. >> but it's rare that you hear of these standoffs where the police have to, you know, shoot

more than however many rounds are in a normal magazine. so i guess what law enforcement is saying. my husband's law enforcement. but i understand that this law has a bigger purpose and it's to protect the citizens. there's a reason why they're limiting the size of the magazine. >> that's the funny thing, the whole idea of them limiting the magazines protects the citizens. to me this is kind of the piecemeal or the legislation that is attempting to limit second amendment right the but in the end, to me, again, the 99% of people who are lawful, registered gun owners are the people who are being affected. someone can come into their house with an illegally manufacturing gun, it's affecting them, it's affecting law enforcement. there's no reason for it. we're both former prosecutors defense attorneys. if a bad guy wants to get a gun, they're going to get a gun. >> the difference is law enforcement officers are trained to have a more effective shot. they may not need to have 15 rounds.

and it is stirring diplomatic concerns for the u.s., as vice president joe biden prepares to visit the region next week. and with the obama care website rollout redoes unfolding, president obama expressing confidence in the future of the affordable care act to barbara walters. in a recent interview. but critics on capitol hill and far outside the beltway say he's got a long road ahead before convincing americans that his signature legislation is working. chief washington correspondent james rosen has this report. >> arthel, from washington where for president obama the semiofficial relaunch of obama care 2.0 could prove a decisive point in his second term. the latest fox news poll conducted just before november 14th when president obama issued the hour long mea culpa for the disastrous rollout find 55% of registered voters disapproving

the big ohio state/michigan game is over. it just finished moments ago. ohio state won 42-41. michigan went for the double and didn't get it at the end. governor john kasich has declared today scarlet letter saturday in ohio banning the use of the letter "m" all day today. in fact, he signed a resolution yesterday. so i'll be talking to the governor about the rule and we, as i mentioned, did find out that ohio state won 42-41. so there may be something to that. meanwhile millions of americans are expected to logon to cyber monday, in search of the hottest holiday deals. many just hoping to avoid

using its own trucks to deliver on sundays. so, basically amazon is testing, these two approaches. so i ask you, will it prove to be a success? and a great template for others to follow? or are there potential land mines that could blow this agreement right out of the water? >> well, you know, i think it's a very big deal number one for both sides for amazon and the usps. you know, you can trust amazon is really the global preimminent or dominant online retailer and i think they're looking for ways to number one provide something that's unique that others don't have. to certainly provide a better shopping experience for their customers, and also, you know, one of the things that a big strategic initiative for amazon is their amazon prime. which, if memory serves me correctly i believe people in the u.s. we pay $79 a year and we can avail ourselves of free two-day shipping and things like that. they may be looking for ways to drive some of their costs out of
