hello. i'm gregg jarrett. glad you're with us. well woman to a brand-new hour inside america's news headquarters. >> i'm arthel neville. topping the news this hour, the moment of truth for obamacare and the white house's deadline to get the problem-plagued web site up and running for most users. so is it ready for prime time? a live report moments away. we have seen those black friday lines outside the big box stores. but today small businesses are hoping to get in on some of the action. we'll explain.

♪ ♪ >> plus, a young dj hitting a positive note after a very tough struggle. we'll be sharing his story. as you likely know, deadline day is here for obamacare after a disastrous rollout that frustrated millions of americans. the administration today saying that healthcare.gov should be up and running for, quote, the vast majority of users. whatever that means. molly henneberg is live in washington with more on that. molly? >> reporter: hi, gregg. we don't have any numeric data yet on the relaunch of the web site. meaning how many people have tried to log on and how quickly they were able to sign up and enroll. but the department of health and human services did put out this update this afternoon. the statement said, quote, the site is performing well today with low overall error rates and response times.

despite heavier than normal weekend traffic. we're making additional hardware upgrades and software fixes tonight as part of a planned set of improvements to improve speed and reduce errors. the president's team has been working for weeks on this web site. it was down for 11 hours last night for maintenance. by today, 50,000 people should be able to use the web site at the same time and the web site should be able to handle 800,000 consumer visits a day. republicans say they're skeptical and waiting to see if the obama administration will live up to these promises. >> what they have done was to reset the expectation so many different times. they missed half their legal deadlines. they've had 22 delays. they've given 1700 waivers and people are saying, wait a minute. this is not the way it was supposed to be. >> reporter: there is also the issue of who was signing up for what. one consulting firm estimates

that 800,000 people have enrolled in medicaid. the taxpayer-paid health insurance for the poor. compare that to only about 142,000 people who have signed up for private health insurance plans through the obamacare exchanges. gregg? >> molly henneberg in washington. thanks. after a disastrous rollout of the affordable care act, polls show president obama's approval rating hitting an all-time low, but in a recent interview, the president says he's confident that in time, more and more americans will embrace his health care law. chief washington correspondent james rosen has this report. >> reporter: for president obama, the semi official relaunch of obamacare 2.0 could improve a decisive point in his second term. the latest fox news poll conducted just before november 14 when mr. obama issued that hour long mya cullpa. record high 55% of registered

voters disapprove of his job performance. of the president's repeated promise, if you like your health care, you can keep it, half of registered voters now believe he knowingly lied when he offered those assurances. four in ten believe he didn't know that promise would turn out to be untrue. only 1% think he was exaggerating and 9% don't know what to think. and of the president's apology. 38% of registered voters regarded as sincere, but 58% nearly six in ten, believe it was given for political reasons. the president sat this week for that exercise known as the barbara walters interview where he was confronted with the fact as walters put it, quote, people just don't think you're trustworthy. >> i got reelected in part because people did think i was trustworthy and knew i was working on their behalf. the bottom line is i don't know any president who hasn't gone through certain periods during their presidency. >> very rarely the president added in that interview, do the good things that happened get

the same attention as the things that aren't working as well. arthel? >> james rosen reporting there, thanks. so what if you still can't get on to healthcare.gov? officials say there are some other option, like picking up the phone and calling the 1-800 telephone number. you can also sign up in person at any nearby hospital or you could download the form on-line and then fill out a person application depending on where you live. you might also sign up through a state web site. if you're just looking for a ballpark estimate, you can use an independent calculator. whatever that is. like the one provided on the kaiser family foundation's web site. and remember the white house also has extended the current enrollment period so that you now have until december 23 to sign up for coverage instead of the original date of

december 15th. the white house asking for the immediate release of an american veteran detained in north korea after he made this confession of, quote, hostile acts he performed during the korean war. 85-year-old meryl newman was picked up by north korean officials last month during a sightseeing tour with other vets. now questions are being raised over whether he was coerced into saying things like this in exchange for a chance at freedom. listen. >> this trip i understand that in u.s. and western countries there is misleading information and propaganda about pprk. >> dominic dinatale in our west coast news room with the latest. hi. >> hi there. there is no way for to us independently verify whether indeed he made that confession voluntarily or whether he was actually forced into doing it. we do know that actually that statement was made on

november 9, two weeks after he was originally arrested on october 26 as he was preparing to leave the country. so this has been around for some time. why it's taken so long for the koreans to let us know with it, we just don't know. but in that confession, he went into quite a bit of detail about his past as a veteran in north korea and the koreans saying he committed war crimes at that time, and during his most recent visit to north korea, pretending to see what life was like today. apparently he tried get hold of some partisan fighters that he fought alongside or advised apparently back during the war and he was trying to connect them with some of those fellow fighters that they had down in south korea. that was considered a treasonous act. that was considered a hostile act. this is how he explained it seemingly in that alleged confession. take a listen. >> i asked my guide to help me to look for their families and relatives living in dprk and i

gave the documents written with their addresses and e-mail addresses to the guide in the hotel. >> the white house released some extent, they say they're aware of the confession. the white house via the nsc giving out this statement. given his advanced age and health conditions, he with urge the dprk, to release mr. newman so he may return home and reunite with his family. the state department saying in the past couple of hours that america's representatives over these sort of diplomatic matters in north korea, that is the -- they met with newman today. no indication of what his stated well-being is. we know he has heart problems. looking from the video, he seems to be well treated. he was well clothed. his hair was groomed and he denton to be having health problems.

but no doubt once he gets back on u.s. soil, if he does, the indication is from everything we've seen, that this is the kind of actions that the korean that would indicate they might want to release him. we'll know how he is once he's back here. >> let's hope he is released and healthy when he gets back home to his family. thank you very much. a deadly police helicopter crash in scotland. the chopper plowing into the roof top of a pub in glasgow last night. at least eight people were killed. more than a dozen now being treated for serious injuries. the pub was packed with people at the time of the crash. it happened on the eve of st. andrews day. that's scotland's official national holiday. the u.s. wants to help syria get rid of its chemical weapons. a plan being planned for the u.s. to dismantle the hazardous material on a ship. u.s. officials say destroying those weapons on land would pose environmental problems. the weapons set to be taken out of syria at the end of the year.

tensions rising as china begins enforcing its new air defense zone creating a challenge to the united states. the u.s. has long been patrolling the area for decades really. now chinese patrols over disputed islands are stirring diplomatic concerns. yesterday china scrambled jets after it says two u.s. spy planes and several japanese aircraft entered that zone. the news coming just ahead of vice president joe biden's trip to asia next week with stops in china, south korea, and japan. this might be our favorite story of the evening. christmas lights being turned on in downtown salt lake city as a young dy becomes a symbol of hope for folks attending the ceremony, especially since not long ago, he didn't think he could even make it there. caroline connally from our fox affiliate in salt lake city has the story. ♪ santa claus is coming to

welcome back. time for a quick check of the headlines. a brawl breaks out, injuring four guards and several inmates last night. now police are investigating after an unknown chemical agent was used on officers trying to break up the fight. the ntsb sending their own investigators to saint mary's alaska after a plane went down in the remote town. the pilot and three others, including an infant, were killed. six others are being treated for injuries. the u.s. state department says swedish embassy officials

have been allowed access to the american veteran detained in north korea. after major repairs to the health conveyer web site, the obama administration now trying to strike a delicate balance, encouraging people to go to the web site, but not too many people so as not to overload the system. can the administration make this balance work? joining us now, syndicated columnist cal thomas and former president of women's media center, jehmu green. both fox news contributors. cal, they're bragging about 50,000 people all at once. wow! i do mean to be facetious because facebook and twitter would laugh at that even instagram and snapshot and some of the smaller web sites would say, are you kidding me? 50,000? >> yeah. i think that the web site is only part of the problem. look, we're being asked after

having been told we're supposed to talk at thanksgiving dinner about the web site, oh, now don't visit it 'cause we don't want it to crash. the problem is teacher than the web site. even if it were 100% accurate, the real problem is the idea and the notion and the faith that government can do a better job of running health insurance and ultimately caring for our health than we can and doctors. we have doctors leaving the profession. we have insurance rates going up. we have deductibles going up. we have coverage going down. the "wall street journal" has a great editorial today on this very subject. people have lost faith because they no longer believe what the administration is telling them. >> jehmu, i talked the last hour to a security analyst who has been associated with the system and he says they haven't even done a beginning to end test of the security of this thing. he said, you go on to this thing, you're going to get

ripped off. >> gregg, now, i think i can agree with cal that we would like to have this web site work more like twitter and facebook, but i also think the media has been a little bit irresponsible in really ginning up the fear around security issues. we're not entering information that is sensitive into this application process unless you think you're -- >> your social security number is not sensitive? no, no, no, gentleman -- jehmu, your social security number has to be entered in. that's not sensitive? >> well, gregg, look, clearly we need a better functioning web site. but we can not sit here and deny the fact that the web site has gotten significantly better. it's not exactly where it should be and i don't think that the white house said it would be perfect by november 30th.

and -- >> yeah, they did. actually they did. >> he never used the word perfect. but as cal said, this is so much bigger than the web site. you can go in person to sign up. you can fill out a form that you download and print out. you can pick up the phone -- >> you got to go in person? really? >> voter registration, you can't register on-line either. we have to be practical with this and we should not, as people in the media, be irresponsible and be fear mongering when people are uninsured and underinsured in record numbers and they need this program. >> cal? >> all that paperwork, of course, the polls show it increasing number don't. but all that paperwork, let's take oregon, for example. the los angeles times reports today that nobody is getting on the computer web site in oregon. it's all being done by paper. same thing in north carolina. many states facing the same problem. after you fill out all the forms, which run for multiple pages, you still have to enter it on the web site, which is

increasingly difficult. but once again, you've got even howard dean, the former presidential candidate and governor of vermont, says the i.p.a.b. board, which will eventually be making decisions on who gets what care, how much it costs and will have the power to deny care to people, says that it's going to be rationing. so if you want to look what obamacare will look like say five or ten years down the road, look at the nhs in britain where rationing occur, where people are on long list where is minimal treatment and major operations. it's a disaster. it's gone bankrupt. we've got a $17 trillion debt here and growing. it's in the tank. >> jehmu, i got another e-mail from my friend in california who for 25 years paid faithfully his premiums on a health care plan that they liked and loved and got canceled because of the affordable care act. he is one of millions of americans who are experiencing the same thing. he loved what he had. it was perfect for him, but, you

know, he's got a guy who is telling him that he's smarter than he is and knows what he should have. what do you say to him? >> i would say to your friend, make sure that you check out the plans that are available on the health care exchange, especially since you're in california. yes, it's unfortunate that some of these plans had to be adjusted to make sure that we were covering people with preexisting conditions, that we were taking out the unfairness that had been part of the individual insurance marketplace. that is an unfortunate consequence of it. but when we get through this process, when we finally make it down the road, we will not have 50 million americans who are uninsured or underinsured. >> according to the cbo, we'll have 31 million americans uninsured. >> instead of 50. that's progress, gregg. >> really? at the cost of $2.6 trillion?

it is the bottom of the hour. time for the top of the news. after round the clock repair work, the obama administration unveiling the health care web site again. it reportedly produces fewer errors. but questions remain about the stability of the site and the volume of traffic it can handle. the state department advising u.s. air carriers to comply now with china's request related to the country's new air defense zone. beijing is asking any flight passing through the air space to inform the chinese government. the disputed areas over a group of islands controlled by japan. at least eight people confirmed dead after a police helicopter crashed into a crowded pub in scotland. five of them were in the pub and three were on the aircraft. the numbers are out after millions of people packed stores

for black friday looking for all those great deals. the analysts say shoppers spent nearly $10 billion yesterday. that's a 13.2% drop, though, from last year. but stores opened earlier than ever this year. some on thanksgiving day itself. those few extra hours put retail sales up just over 2% combined. many shoppers trying to avoid the lines and some took to the web. really awesome out there. on-line sales jumped nearly 20%. art, you were involved in all of this. >> no, i didn't take part in the black friday. >> oh, really? >> yeah. did you go out? >> yeah. no, i shopped ahead of time. president obama's also getting into the holiday shopping spirit, taking his daughters shopping at the famous dc book store, politics and prose this afternoon as part of

small business saturday when local stores try to get a little revenue boost just like the big chances do on black friday. now more from dinosaur hill toy store here in new york city. high, laura -- hi, laura. >> reporter: hi. there has been a steady stream of shoppers here in the east village doing exactly what many of these small retailers had hoped they would do, open up their wallet and spend that cash and make the all important promise to come back and do it again. we're talking about small business saturday and it is definitely been the focus and the push for this day, which started back in 2010 to help local mom and pop shops get a boost in their business. last year nearly 70 million people shopped small as they say in their communities on this day for an estimated $5.5 billion in sales. while those numbers are impresssive, some local business owners say they could still use a bit more revenue building

ideas. but say every bit helps. >> it's an introduction. so if i get one new customer out of this day, it's absolutely worth it. i think it's a great idea. i know they've been doing it for a few years now and i hope they continue it. >> reporter: there are over 28 million small businesses in america, according to the small business administration, which also reports that half of work america either owns or works for a small business, which is why small business saturday is so important to so many. something not lost on this shopper who had a choice of where to spend her dollars today. >> my mom's birthday weekend, so we wanted to come to new york and we really wanted to support like the local businesses around here. we could have gone to like a bigger business or whatever, but we really wanted to just keep it local. 'cause it's nicer and there is more creative things and little drinkets that you can buy. >> reporter: that is music to the ears of so many down here in the east village and all around

the nation who have a small business because a lot of these businesses just don't have the advertising dollars of big advertising dollars to spend to get people in their stores. so they want to see more of the shoppers that we spoke to there and hopefully we'll have good numbers to report in the coming days of how successful today was. gregg? >> we hope so as well. thank you. u.s. businesses criticizing a plan to simplify the tax code now being proposed by the senate's chief staff writer, tax writer. the plan would stop companies from deferring u.s. taxes on foreign earnings and also impose an immediate 20% tax on roughly $2 trillion in profits u.s. businesses gained overseas, as well as curtail businesses being able to quickly deduct certain expenses like advertising, bringing in kyle harrington, founder and managing partner of harrington capital management. good to see you. >> good to see you.

>> so those businesses that are crying foul, explain to what it is they have to lose and also how would an crews the board, 35% tax on corporate profits hurt them? meanwhile, those in favor, how would they benefit? >> here is the thing, let's just start with this, the public needs to know, and i think they do, that the u.s. tax code is messy. it's complicated. the discourse and discussion that they're having now about how to work within the tax code and maybe alter the tax code is a great narrative to have. now, the businesses that could be hurt by a flat tax of, say, 35% corporate tax are businesses that have an effective tax rate that is currentsly lower than that 35%. so they have tax call it loopholes or tax writeoffs that they benefit from that puts their effective tax rate lower than that. so a 35% tax rate could increase their taxes and hence, take away

after tax disposable dollars that they may invest back into their business, hiring people, et cetera. so that's an important point to take in mind. now, the folks that it would benefit are obviously those that have a higher effective tax rate than the 35%, 'cause then they have more after tax dollars to go out and invest in other areas of their business. >> kyle, taking a look at the overall economy and attracting new business and retaining existing ones to head quarter in the u.s., is the 35% across the board a good incentive? >> arthel, the other piece of this, consider this a spider web. so there is vibrational effects to all this stuff. the goal here is to create jobs domestically. that's definitely a piece of how this legislation is tied in. so if we can bring more businesses back here by not allowing companies in the u.s. to take profits overseas in the

international world where they can delay these profits for i think up to five years before paying taxes on them, we can bring jobs back here and make the tax code internationally more detailed and more functional, the goal is to create jobs here. so i think that i'm all in favor of figuring out a tax code in which we don't have international havens to put profits aside and delay tax dollars and bring more jobs back here. >> in the interim we highlighted some concerns the lobbyists had regarding the current proposals and president obama has said a corporate tax target of 28%. but the treasury department not really sure right now how to get there. so it sounds easy, but how tricky is tax reform? >> you know what? i think this is a conversation like i said, is healthy in nature. needs to be had, but it is not an easy discussion and it's not

as simple as saying, okay, our corporate tax code will be 28% fixed. you're going to have a lot of vibrational issues associated with that. so have the discussion. i think it will carry into the new year. i'm hoping that we can all have collective reform and agreement on the issue. but i think the key is lastly, is to have these discussions from dc with the business community and have it be a cordial discourse rather than have dc make all of these decisions on their own. there needs to be the business world involved in an overall reform. >> good information, kyle harrington. thank you very much. see you next time. >> thank you. toronto's deputy mayor calling the city's crack smoking mayor and his brother, quote, the kardashians of canada. which is an insult to the kardashians. after antics like this, yeah, you got to love that, when mayor rob ford pulled over a fellow council person and other gaffes

60 votes necessary to break a filibuster. but there is all kinds of other procedural things along the way. for instance, the republicans can demand 30 hours of debate on every single nominee and there is a huge backlash as you know, gregg. i got friends whose names i won't mention, i don't want to jinx things, who are very uncontroversial people, but have been waiting a long time and could still be subject to this 30-hour rule. so the truth of the matter is, if the republicans want to play hard ball, they still got some balls to throw. >> yeah. i would think so. looking down the road, look, this is often been battled back and forth, republicans thought about doing the nuke leer option when they -- nuclear option when they had control of the u.s. senate and i think in the end they sort of said to themselves, wait a minute. the pendulum swings back and forth. what happens when we lose

control? isn't harry reid sort of facing the same sort of threat here? >> well, of course he is. i mean, 51 votes is still 51 votes and the problem here is that you get a midterm election coming and most elections, most contested elections, at least in the general election, get decided in the middle. the democrats have to hold on to their majority. in terms of legislation, you still got the republicans in control of congress, but one of my funniest moments since i heard somebody -- i think it might have on fox, interviewing a republican saying if you're so much against what the democrats have done, will you repeal it if you get control of the senate in the next midterm? and the republican senator was like, cat dancing a -- tap dancing a little bit. because you're right. it's exactly the problem. you don't like it except when you got power, you're going to

keep it. you're going to change it? >> the shoe on the other foot. >> yeah. >> but now, i do wonder about how far they're going to extend this thing. right now it is associated strictly with nominees. but in the end, it could proceed to legislation, right? >> yeah. it could. the problem with legislation is that last time i checked, the democrats do not control the house of representatives. so since it takes two bodies to get legislation passed, the reality is even if the democrats were to get rid of the filibuster and be able to pass legislation with a simple majority, still got to be passed in the house and unless the democrats can get control of the house, it becomes, well, frankly, kind of meaningless. that's why they're focused on
