for so-called hostile acts against the state. what he says he did. meanwhile, his family fighting to bring him home. and holiday shopping can be a contact sport. two women, one taser, and a whole lot of this. it is here, deadline day for a key part of the affordable care act. the day the obama administration promised the website healthcare.gov would begin working normally for now most americans, no longer all. we've been told by the white house the site will be different in some ways, better, this after a dismal unveiling plagued by freezes, glitches, crashes, frustrating delays that kept many americans away from the exchanges that would let them shop around for the heavily advertised better, more affordable health care. but what remains to be seen is if the frantic pace of repair

work is going to pay off and more importantly if the mess that got us to this point will simply keep people from ever going back to the government website, healthcare.gov. earlier today on fox news, marcia blackburn from tennessee said even if the site bugs are worked out, it may be done at the cost of many other parts of the law. >> what we know is that in order to try to meet an adjusted deadline with reset expectations, what they've done is to say, okay, the small business, the shop, is not going to work so we're taking that out of the picture and delaying that. the payment process for our insurers sending those subsidy dollars for insurers, that's not going to work. >> live with the news in washington. molly, any sense of how the day is going? >> reporter: he don't have any numeric data yet on how many people have tried to log on and

how quickly they were able to sign up and enroll, but the department of human services put out this statement. the statement said, quote, the site is performing well today with low overall error rates and response times. despite heavier than usual weekend traffic. we are making additional hardware upgrades and software fixes tonight as part of a planned set of improvements to improve speed and reduce errors. the president's obama care team has been working for weeks on this website. it was down for 11 hours last night for maintenance. jeffrey zeints says by today 50,000 people should be able to use the website at the same time and the website should be able to handle 800,000 consumer visits a day. harris? >> well, that would be a lot, but again, we don't have hard numbers to judge this by. and we know republicans are talking about this on this saturday. >> republicans say they're skeptical and waiting to see if the obama administration will live up to these promises.

>> what they have done was to reset the expectations so many different times. they've missed half their legal deadlines, they've had 22 delays, given 1,700 waivers and people are saying, wait a minute, this is not the way it was supposed to be. >> they're also shutting down the site again tonight. there's also the issue of who is signing up for what. one consulting firm estimates that 800,000 people have enrolled in medicaid. that's the taxpayer paid health insurance for the poor. compare that to only about 142,000 who have signed up for private health insurance plans through the obama care exchanges. harris? >> interesting. some of the messaging coming out this week, molly, has been shop in off-peak hours once this thing comes back online. and you're telling me during the off-peak hours, they're going to shut it down. president obama has suffered politically in the polls as a result of the disastrous rollout of the signature health care law and a growing number of americans even view the

president, now, as untrustworthy over his broken promise that if you like your health care plan, you can keep it. in an exclusive interview with abc news barbara walters, the president said there are bright spots in his low approval ratings. >> are you worried you won't be able to get things done because of this lack of support? >> well, barbara, if you remember, i've gone up and down pretty consistently throughout. the good thing about when you're down, usually nowhere to go but up. >> exactly. >> that's a silver lining. more on what's at stake at the white house. james? >> harris, good evening. for president obama, the semiofficial relaunch of obama care 2.0 could prove a decisive point in his second term. the latest fox news poll conducted just before november 14 when mr. obama issued the hour-long mea culpa disapproving

of the job performance. of the of the repeated promise, if you like your health plan, you can keep it, nearly half of all registered voters believe mr. obama openly lied. 4 in 10 believe he didn't know that promise would turn out to be untrue. only 1% think he was exaggerating and 9% don't know what to think. and of the president's apology, 38% of registered voters regarded as sincere but 58% nearly 6 in 10 believe it was proffered for political reasons. the president sat this week for that excruciating exercise known as the barbara walters interview. wherein, obama was confronted with the fact that people just don't think you're trustworthy. >> i got reelected in part because people did think i was trustworthy and knew i was working on their behalf. i think the bottom line is, barbara, i don't know any president who hasn't gone through certain periods during their presidency. >> very rarely the president added in that interview do the

good things that happen get the same attention as the things that aren't working, as well. harris? >> thank you. the state department is now joining the calls to bring an american home from north korea. a spokesperson for the agency says it's urging north korea to release an elderly american war veteran detained for more than a month now. and this video released from north korean state video reportedly shows the man 85 years old reading an alleged apology. north korea claims this is merrill newman confessing to hostile acts against the state and for alleged crimes during the korean war. we do know newman fought in the korean war. he's retired now and an avid traveler. la last month, took a ten-day tour of north korea and was about to head home when he was snatched by authorities. live from los angeles, dom, we've been on the story, but now we're seeing the federal government take a deeper interest all of a sudden, why?

>> well, i think given what was said in that confession is giving its indication that perhaps the koreans are considering releasing merrill, actually. what he actually said in part of his confession was that he apologized for so-called hostile activities. and whenever the koreans actually put out something like this and it, you know, americans appearing effectively on video are apologizing, it indicates that they could be released soon. that certainly what's happened in the past back in 2009 when you had the case of robert parka. he was released. but the state -- but the white house coming out today saying it's deeply concerned about newman's welfare and this is what they had to say about a statement. given mr. newman's advanced age and health conditions, we urge the dprk to release mr. newman so he may return home and reunite with his family. that coming out of the national security council spokesperson

there. and so i think given what the state department's also saying you said a short while ago, there is now a sense of cautious optimism that something could be happening behind the scenes. harris? >> well, i want to go back to this idea of korea actually accepting this apology and whether or not they are really prepared to let him go, dom. >> it's an important act of contrition, quite frankly. that's what it is here. and you know, we've seen it once before and seen it happen to other american citizens in other countries, as well. he apologizes, he says it's his fault, describes killing civilians and troops during the korean war and that he was up to subversive activities during his recent trip. we can actually hear precisely the element of his apology from that video. take a listen. >> on this trip, i can understand that in u.s. and western countries there is misleading information and propaganda about pprk. >> given his age, 85 years old

and the fact he's got a frail heart condition, it could be that the north koreans are sympathetic and wouldn't be surprised if we see him released soon. we can only hope so. >> pressuring that older gentleman to confess. it was hard to listen to him say those words. a war hero and any right having served, dom, thank you. now to syria and new developments on destroying chemical weapons there. the united states is offering to help neutralize some of the most deadly weapons in that country's 1,300 ton arsenal. it would most likely happen on a ship in the mediterranean sea by december 31st deadline. and that was the date agreed upon following a chemical attack on citizens in august. that killed hundreds of people, many of them children. syria's production capacity reportedly was destroyed in october. but the existing weapons and hazardous materials still need to be taken care of at this point. and as we have been reporting and this number actually by some services and groups is higher. more than 100,000 people killed

this, obviously, is what's left of that plane. ten people onboard. six of them survived, but they were all hurt. we're told people who live nearby had to wait out bad weather finally reaching this crash. some two hours after the plane went down. no immediate word on what caused it, the ntsb is investigating. and in scotland, they're mourning those who died in a helicopter accident. this was happening last night as we went to air right about this time. eight people were killed when a police chopper crashed into a pub. this is glasgow. there was a live concert going on, more than 20 others were injured. the crash shocked, saddened all of scotland which is also observing st. andrews day, a national holiday meant to celebrate scotland's heritage and culture. >> we pray for those who have tragically lost their lives in this incident. those who are injured, those who are bereaved.

and all the rescuers, emergency services and members of the public. and we pray for our city of glasgow. >> such a hard day for them there. people paying their respects in their own way including this moment of silence at a soccer game. james matthews from our sister network sky news has more. >> reporter: friday night on the banks of the river clyde and seeing was disbelieving. a helicopter had fallen from the sky, crashed through the roof of a busy glasgow pub and embedded itself in the building. this video shows the chaos, the dust and destruction at the pub which was packed with drinkers enjoying a live music concert when the police scotland helicopter dropped through the ceiling. >> it was a huge bang and like a couple of seconds of almost --

and then it collapsed and then the roof and the entry of the bar and all that stuff collapsed. >> glasgow mp was driving past when the helicopter came down. >> trying to rescue people so there was people farther in the pub than me. i'm trying to grab people out and there was a small line of people. and you got past -- you basically got past one person and you try to pass them to the person next to you to try to get them. and from harm's way. >> reporter: as they brought the fire brigade poured over the remains of the building in a fruitless search for survivors. the emergency services said contact had been made amidst the rubble but it didn't last. a rescue effort devolved into a recovery effort overnight.

we're getting new numbers in on holiday shopping. retail research firms shopper track is reporting people spent $9.74 billion at stores on black friday. that's actually down by 13% from last year. but spending over thanksgiving plus black friday combined rose slightly. and today is small business saturday, a day when shoppers are urged to visit those local mom and pop shops instead of going to the big box retail chains. president obama taking part by visiting a local bookstore, politics and prose with his family by his side, he bought enough books to fill two large shopping bags. what did he get?

this is the fox report, it is the bottom of the hour, and if you are just joining us, here's what's happening. a reboot for the government's health care website. today is the self-imposed deadline for the obama administration to repair that critically flawed site. one administration official telling fox news they're quote, on track to have the site working for the majority of the americans and the public relations push is now in full swing as we are seeing. joining me now is michael warren. good to have you along on a saturday night. >> thanks for having me. >> we are ready for take two. you say the it doesn't work for me stories, though, will still keep coming. why? >> that's probably true. it's kind of interesting. anyone who is a college football fan has been watching college football out there can recognize that the administration's been moving the goal posts on what's

happening with this obama care website, it was supposed to be ready to go on october 1st. then it had all of these disasters and had to move it to november 30th. and it was supposed to be fixed by november 30th. now they're saying it's going to work for most people. local news organizations who have been really sort of giving -- giving a lot of these folks who have been having trouble with the website, they're going to be a lot of those people. it's going to be working with most people. there's still a large chunk of people it won't be working for -- >> yeah. 20%. >> we're going to be hearing horror stories for them, it's not working when they said it was going to work. this isn't going away at all. >> the government is now saying, the white house is telling us, 80% of people will see no problem. that means 1 in 5 will. aside from that, though, they get the thing up and cyber experts are saying, well, they are going to turn on something this weekend. when that happens, details now are coming out about once you start to actually sign on and put in your information, there's some other problems behind that.

and we will start to see those unfold. what can you tell me about that? >> well, i've talked to a few sort of health care policy experts. and what they tell me is that on the back end of the website. not the part of the website where you log in and put in your information and see all of those pictures and click on the links or whatever. but the back end, that actually takes that information and tries to spit out something at the end that tells you maybe what your subsidy is or what kind of insurance plans you qualify for. whether you qualify for medicaid. all of those things are completely jumbled on that back end. and so none of that that actually computes something that tells you and tells a kmur customer important information is apparently working very well. even if you get all the way through and the website doesn't crash for you, what you could be getting back could be wrong information. >> wow. and what do you do at that point? >> it's a big question mark. the problem with all of these delays and these extended times for fixing is that -- is that

sooner or later, people are going to need to buy health insurance. and it's going to leave a lot of people kind of high and dry. >> you know what, i want you to take -- i don't know if you can see this. let's pop this up on the screen. you've no doubt seen the home shopping list. it's a list of tips from kathleen sebelius. she put this out yesterdmorning course, it's black friday. the things you can do to basically make it easy to shop for health care during the holiday season. she reminds people that the product is good and unlike black friday it will not run out. i know it sounds funny. i know it does. you know, michael, the thing with this is people are going to look at this and say, is this real information i need to know? >> well, also, it sort of reveals how terrible this website and how terrible the whole venture has been for obama care and the administration. we've been online shopping now for close to two decades. amazon was first -- sold its

first book in 1995. i was on amazon earlier today. they told me i could get an artificial christmas tree delivered to my house in two days. it's really easy and it didn't matter what time i was going on the website to order this thing. so it just goes to show you that the administration has really sort of fumbled the whole rollout and brings into question a lot about what the federal government can actually do in the marketplace as they've done in this individual health insurance market. >> i'm going to ask to put this back up. that was a lot of information to digest on this one screen. but it's a blog that the health secretary put out. if you need to talk to somebody, use the call center and gives the number here. 150 languages they can speak. and then if you want a personal shopper, find a person in your area, localhelp.healthcare.gov. now you're going to have to get somebody to help you shop during the holiday season. i don't know, it sounds difficult.

one thing you mentioned, though, it was a key point of this blog was try to shop in off-peak hours. we learned from our reporter earlier tonight, they're shutting this thing down during off-peak hours. so when are you supposed to shop? >> i don't know. i guess you're supposed to take up your workday and try to get in there where most people supposedly aren't supposed to be online doing online shopping. but, hey, maybe we know they sometimes are. a lot of young people are going to be needed to sign up for obama care. they know how to buy online. they know how easy it can be to buy music or books or, you know, ebooks or anything like that. this is just, again, showing how much in trouble the website, the whole obama care project is. so i mean, as kathleen sebelius can do whatever she has to do and she has to do it with the way the website's going now. i'm not sure this blog post is going to turn things around for the obama administration then. >> what is working about obama

care right now? what good news could democrats be going home with along this long holiday weekend as the white house has asked them to do? >> well, one thing, at first the website and obama care was doing very good work at was signing people up for medicaid, being the health insurance option for low-income americans. if there's one thing that government is very, very good at, it's writing checks and gives folks money. so the website was outpacing itself on medicaid. folks were getting new medicaid, you know, funds as opposed to those who were getting new insurance policies. but even then, we're seeing problems here with this new administrative fix we found out about just earlier this week where the federal applications are not being able to be integrated with the state applications because, of course, the states actually administer

medicaid as a program. if there's one thing that democrats can sort of hang their hat on, well, it's signing more people up for medicaid. that wasn't really what the law was intended to do, but it seems democrats have to throw everything out of the window as what's intended and what's happening with the law. >> we have hit deadline day. we will see what happens as people sign on. and the back end information you gave us is pretty startling. we'll have to see if people are able to find out what they get once they put their information in. good to see you tonight, thank you. >> thanks, harris. new developments now in the dispute over who controls the air space and where united states planes can fly in asia. our government is now advising u.s. airlines to comply with china's demands that they inform china of any flights passing over the parts of the east china sea. this comes after the u.s. joined china's neighbors in refusing to honor the new defense zone that country has set up.

china made the demand last week adding it would take defensive measures against anybody who did not comply. i wonder what that would look like. vice president joe biden is set to arrive in japan tomorrow for a week of talks with asian leaders. he said he will raise the issue. they are arguing the air space they're arguing about is over some islands. japan says it owns that air space, china's fighting over it now and when we fly through it, that's the problem. well, police trying to put an end, now, to violent protests demanding that a record leader leave office. it's our top story as we go around the world in 80 seconds. ukraine -- they're using tear gas to disperse hundreds of protesters in the capital city of kiev.

do this? how did you learn all about it? >> well, my dad takes me out and did some little hikes, and then we just got bigger as the time went by. >> well, i know you're not just doing this for fun, and i know that you climb the highest, tallest mountain in the western hemisphere as your goal. you're raising funding for research for something called deshin, a type of muscular dystrophy, which steals many little boy's ability to walk. why are you so dedicated to helping with this disease? >> well, i want to help them so much because i can walk, but they can't, so it's kind of like i'm using my muscles for them. >> you know, tyler, i don't want to freak you out too much, but i did some homework on this, and the mountain that you want to climb, they say you have to do it in three parts. have you to trek in in 100 degree heat and then climb to the highest camp. that's, like, 13,000 feet, and then you have to reach the summit, one of the coldest days on the planet have been recorded there. are you afraid at all? what's going through your head? >> well, the only thing i'm afraid of is the cold because i'm not used to it. >> yeah. you're in suburban california, i
