tents was set to take place. when authorities showed up, everything was on fire. they had a hard time even identifying the bodies. >> so ironic. well, one day after the white house's self-imposed dead line to fix the obama care website, congress set to give a progress report. a press conference is coming up. peter doocy has been following this. latest for us. good morning, peter. >> good morning, tucker. they said healthcare.gov would be working smoothly for people. however, i am not one of them. a screen informed me that the verification system is temporarily unavailable and that the problem should be resolved in the next 24 hours. that was it. end of the road for that application this morning. there was another smaller problem with the application earlier on. one of the first screens wanted

to know if the navigator or an insurance agent was helping me fill out the application. i clicked none of the people were helping me yet the banner at the top of the screen that followed said that i had just told the website another person was, in fact, helping me fill out the application. i tried it three times. same message every time. with that said, two months after the big launch of health ca care.gov is faster. federal officials are going to hold a conference call later on this morning to provide a an update. they said their goal is for 50,000 consumers to be able to use the website simultaneously. that would be 800,000 people a day. that is capacity they will need to enroll just under 7 million people in the next 120 days. back to you in new york. >> peter, how many times have you tried the site to fit out

history here of people declaring victory even falsely? bill clinton didn't win the new hampshire primary in 1992. the viet cong didn't win. the history says the opposite, they declared victory. >> i find this kind of deceitful really. >> you think? to me it's like putting lipstick on a pig. we're able to handle 800,000 folks. we told you we could only get 50,000. users will be able to fill out applications, compare plans, etc. when we talk to experts, we know the back end infrastructure is still hampered. we know getting payments out to the insurance companies is still a mess. bottom line, the 834 applications is like a resume. you're filling out a personal resume. insurance companies are reporting when they get those copies of your resume sent to them, it's filled with all kinds of errors. names are wrong, phone numbers are wrong and in many cases there are double applications being returned to them.

imagine the december 23rd deadline you have to deal with as an insurance company. you don't have the phone number to make a phone call. that's not working. the infrastructure is not working. the front end looks pretty. >> they will fix it. you have people chepg in from all kinds of big tech companies. they have an unlimited budget. they have the federal budget to fix. it's a problem they have. the real question in the end is does obama care provide better coverage for less cost? the opposite appears to be true. it's going to cost the average person more to receive more limited service. so the whole thing is a failure whether the website works. >> there's an article in the wall street journal that talks about once people start to see what the healthcare.gov plan has to offer, they'll see that

they're paying for first class air seats but they're getting coach seats. they're not getting more bang for their buck. >> "the wall street journal" editorial page said on friday, the reason the furor will continue even if the website is fixed is that the public is learning that obama care's insurance costs more in return for worse coverage, regulators mandated a very rich level of essential health benefits that all plans in the individual market must cover regardless of cost. the piece says this will hit the middle class the hardest. unlike people in the job system, they pay with after tax dollars. now they're being forced to pay for less coverage at a higher rate and subsidize those that

the president and all of his political appointees would have to enroll obama care. i don't think they would like that. i've also introduced a bill that says the definition of small business for obama care would be the same one that the small business administration uses. you know, what liberals always do, they don't always say we're going to grab one-fifth of the economy at once. they work on this for years and years and years. so we have to dismantle this piece by piece if that's the card we're going to have to play with the harry reid senate. >> guys, it seems inevitable that you will see medicare and medicaid expand in the wake of obama care and you're going to see a lot of doctors opt not to treat medicare and medicaid patients. how do conservatives respond to that? liberals will say they'll come pell doctors to expand it.

what's the marketplace for that? >> i don't see any way in the world. what i see is some of the best and brightest minds are no longer going into medicine not because of the reimbursement and compensation issue, because they don't want the government micromanaging their practice. what you see is the sons and date terse of doctors now going into finance and working on wall street. i think that's wrong they'll show that over and over again. the rollout was totally botched by the government. hhs says 106,000 people have enrolled over 7 million. less than 2% have enrolled. that's why i think it would be great to put the president on obama care and have a picture of him sitting by the computer signing up with a smile on his face, a 10 or 15 minute process and telling everybody, it's fixed and ready to roll. >> our own peter doocy couldn't get online. i wonder if the president could

them. >> if you're over 65, the average number of prescriptions that you fill is 14. there's a likelihood one of these may interact with alcohol. one of the benefits, you don't have to be carded anymore but that your body does not clear alcohol as quickly. the problem is that you feel the effects more quickly and it lasts longer within your body. you have to be more cautious. >> a lot of times people go to the parties and they feel like a little bit concerned with the way that they're acting so that's why if they want to have alcohol, they want to use this as kind of a tool to make them feel good and want to be free to talk to people. what should we do instead? >> just have a good time. you're with your family and friends. it's a holidaytime. it's festive. you don't need to raise more than one glass of champaign. >> while you're at the holiday parties, what else do you recommend as far as making sure you don't pack on the pounds this holiday season? >> definitely in moderation. enjoy, indulge, but portion

car, his friend was at the time. >> how ironic. absolutely terrible. >> kiss your children. one day after the white house's self-imposed deadline to fix the obama care website, guess what? health officials set to give a progress report this morning because it's not fixed. conference call set a few hours from now. what can we expect? peter doocy is on that. he's joining us from washington with the very latest. peter, good morning. >> good morning, tucker. there have been quite a few problems with healthcare.gov this morning. now seven hours after their self-imposed midnight deadline to fix the website passed. most notably, problems with the verification system. it's unavailable right now. you can't submit an application without completing that critical step. i filled out an entire application almost until you get to the very end when you're told to come back in 24 hours when the problem with the verification system is figurxed. earlier there was a question about whether a navigator or

insurance agent was helping me standing over my shoulder. i said, no. the system didn't seem to understand that. a banner on the next page read, you told us another person is helping you complete the application. one additional problem, i received multiple erroneous e-mails today from healthcare.gov notifying me there's a marketplace message waiting but clicking on the accompanying link took me back to the home page, no personalized message. with that said, healthcare.gov is a lot faster today than it was exactly two months ago. it's much easier to sign into accounts and get general information about subsidies. the administration is honing that 50,000 people will be able to use the site at the same time starting today. that will be 800,000 consumers every day. they need to sign up close to 7 million consumers in the next 120 days. back to you in new york. >> peter doocy live in d.c. those 7 million folks who may or

may not sign up could be still facing a big security threat. a number of security analysts have come forward. in fact, morgan wright who is a security and tech expert who had testified on behalf of cyber security for health care.gov said this about the security problems that still exist for the website. listen to this. >> memorandums that were issued by the cis and cio who had to sign off signed off on a finding that said the threat and risk potential is limitless and gave cms until 2014 to fix it. that means right now that threat and risk potential is still limitless on november 30th. healthcare.gov has 500 million lines of code and it can handle 50 million people. facebook has only 20 million lines of code and they handle 700 million daily active users. you can do the math. >> one of the problems is verifying even the identity of

users and sometimes sending the wrong information to insurers. so, i mean, can you imagine giving your sensitive information, your social security number, your income, your health history, you're putting it out there and once it gets sent to the wrong person for everybody to see or, you know, what if it gets hacked into? >> dig through such facts. this is an administration that after 43 months and spending more money than the entire gdp in most african countries can't run a website and they want you to send your most intimate and personal information including your tax information, social security number, health information to them and they're going to keep it safe. >> right. >> i don't think so. >> no, but i love that the assessments, let's go back to this. the assessment is that the risk potential is still limitless. limitless. open to hackers. we know that other databases within the federal government have been hacked recently by the chinese government and not even state sponsored problems but even outside of the united states problems with security

hacking inside the united states databases. when you have this database problem still on the back end underneath healthcare.gov, it's not been fixed yet. the front end looks pretty. >> i don't think you've read the memo. the memo says obama care is a success. the website works. they declared victory. >> they set the bar so low. >> get in line. >> no, just obey. be quiet. stop asking inconvenient questions. this is the strategy. it works, ladies and gentlemen. what are the chances that most of the press will take this unpredictably and repeat it? about 100%. >> they already are. if you read some of the headlines and news reports on the web this morning, it's handling 800,000 people instead of the 50,000 that were initially reported. we had representative jack kingston on earlier this morning. he says, look, people need to experience, the president needs to personally sit down at this computer and experience the same things that our own peter doocy was trying to get on and log on this morning and couldn't get on and actually sign up. listen.

>> if you look at the rollout itself totally botched by the federal government, the numbers according to hhs, 106,000 people have enrolled right now out of potentially 7 million? less than 2% about able to enroll. that's why i think it would be a great idea to put the president under obama care and have a picture of him sitting by the computer signing up with a smiling on his face, maybe a 10 or 15-minute process and telling everybody, it's fixed and we're ready to roll. >> a month ago we heard that today we would be -- it would be fully functional, right? october the 1st we thought that it was going to be. then he came out and said december 1st it would be fully functional. then they moved the goalposts, kathleen sebelius said they would have a totally different user experience. 50,000 at a time, is that even enough snf with 800,000 as a goal? >> well, i mean, i think congressman kingston has it wrong.

is the president right, he'll go up? >> the other option is to go down. president obama's job approval ratings have been tracking very closely to george w. bush's ratings at the same time in their presidencies. as we know, bush's ratings went on down, down, down, 40, 35, 30 and then down all the way to 25%. so it's entirely possible that president obama's ratings could continue to go down. both men started at pretty high approval ratings and have been experiencing long, slow slides after that. >> is media coverage -- we saw the mainstream media jumping on this bandwagon finally and actually doing reports. we had mainstream media report injuries cisicitsit -- reporter sitting there trying to log on. has that waned? >> there's no doubt that's hurt quite a bit. there's been two elements to

that media coverage. one is they're covering the fact that the website didn't work and this grand program of president obama's, the center piece of his presidency doesn't work. the other issue was his own personal credibility which has been very damaging after that if you like your health care coverage you can keep it promise. people just don't believe he was telling the truth then and that has really hurt his ratings. >> how can this feekt the president now and actually let's look to 2014 for those running for re-election. he's not up to re-election. president obama doesn't have to worry about that. how will his approval ratings help or hurt those other democrats seeking re-election. >> the other interesting thing is job approval ratings do matter. politicians don't like to talk about them. they say the only poll that matters is on election day. it matters in terms of a president's clout in washington. when a president's ratings go below 40, if they're in the 30s, fewer people on capitol hill listen to him. fewer members of his own period

>> it's absolutely true. if you think of this proactively and say, look, we have this four-hour trip, we have this six-hour trip, i'm going to be a gentleman, easy on the roads t. will insulate you. somebody will cut you off. you'll say, hey, let the guy go. you plants for it. road rage sneaks up on you. >> you also say drive with empathy. you are running out to get a present and leave late. you get behind the wheel and think about the ore drivers? that's a novel idea. >> well, listen, this is my profession. psychiatry. it's a profession of empathy. what kind of a person would care whether they're in line before you to get into the mall or to get through a highway exit ramp? the bottom line is if you start thinking, i wonder why this person may do that, you may have somebody struggling with illness and a family member, somebody with a divorce that's pending so if you start to think, hey, this could be an injured person

contributor father jonathan morse. good morning to you. is part of this that we're so detached from one another to facebook and twitter? >> i think there's a lot to that. there is a huge disconnectedness among people. let me give you an example. it used to be you knew the people you worked with because they grew up around you. you knew their parents and you knew their family. you knew them when they were kids. its a' so different now. now you know them just as they are right now, today, or over the last six months or year that you got to know them. it's very different. that disconnectedness makes trust hard. why? because trust has to do with getting to know somebody so well, so deeply and having gone through so much with them that you can predict what they will do in the future. that's trust. >> seems like -- it kind of seems odd given the fact that we think we're more connected now than ever before. smart phones, constantly online. constantly connected. texting friends, having that

communication. but really i guess in many ways this is leading to the larger disconnection. >> it's a good point and both of you brought that up about facebook, twitter. every day i send out a little prayer on my twitter and facebook page. i get messages from people sometimes saying, is this really you? is this you who's sending this? and that -- you always -- there's a distance, right? it's amazing that we can connect with all these new people, but how are we connecting with them? it's a little bit superficial. >> those beeps you're hearing on your facebook page. >> yes. >> they're commenting right now. you better check in. >> new friends. >> how do we combat this, snaer if we have all of these trust issues where we lock our doors? growing up you wouldn't lock your doors a lot. you hear stories how you would go to the store, not worry about locking up your house. security alarms in your house. we're so distrustful. how do you turn it around? >> from a spiritual point of view, i would say there's only

one person you can trust, that's god. that's the ultimate answer. yes, it's good to have close friends who you can trust, a spouse you can trust. that means deciding that i'm going to spend time and give time to close friendships. we might not be able to trust everyone, but we can trust the people who we've made the effort to get to know very deeply. >> how important is it to actually work on this, work on trusting other people? because doesn't it in the end really hurt ourselves? >> you know, i think one way to work on it, i think it's very important to decide among those who you're closest to, spouse, boyfriend, girlfriend, neighbors, siblings that you're not going to text all the time but you're going to actually pick up the phone and call. you're not going to just decide -- we're in touch constantly so we don't need dates or time together. that's not true. human beings need close contact, deeply getting to know each other in order to have that trust. trust builds confidence, faith and joy. >> have a meal with somebody instead of sending them a text

he was known for his charity work. he was about to attend a charity event for his organization reach out worldwide when the crash happened. >> a photographer snapped this picture of him getting into that car. this is the last known picture of him alive. >> gosh. >> from what i saw, it was when roger was backing the car into the garage, paul wanted to go for a ride. they went for the ride and that was the last we saw of them. >> well, hollywood is reacting this morning. van diesel says this on instagram, brother, i will miss you very much. i am absolutely speechless. heaven has gained a new angel. rest in peace. and denise richards tweeted, shocked over the news about paul walker. so sad. my heart goes out to his family and loved once. he was a kind and beautiful soul. and james vanderby tweeted this, thoughts and prayers tonight are with paul walkers's friends and family. walker was 40 years old.

he leaves behind a 15-year-old daughter. >> when authorities got up to that car they said they couldn't recognize any of the bodies in the car. it was on fire at the time and that what happened was they noticed the ground around the car had like donuts, figure 8s from spinning out the car tires and burned rubber. they weren't clear if it was actually from that car or not but clearly speed was a factor. >> if there's a lesson here, there's a less soon in every death and life, you never know. he was taking a quick drive around the street to test out the car and it ended. >> right before the charity event. only 300 yards from where everyone was gathering at this tent. >> don't hold back. if you love someone, tell them now. >> yeah. unbelievable. more on that coming up in the show. less than an hour ago, the obama administration set to give a progress report on the problem blogged owe bbama care website.

peter doocy with the latest. >> tucker, federal officials said by this morning's deadline healthcare.gov would be working smoothly for a vast majority of users, but i am not one of them because after filling out most of an application this morning, a screen informs me that the ver if i case system is temporarily unavailable. that is the way that the healthcare.gov portal confirms that everything that you have entered into the application is true. another screen says that problem should be resolved in the next 24 hours. so that was it. end of the road for this application this morning. there was another problem with the application though earlier on. one of the first screens wanted to know if a navigator owe or an insurance agent was helping me fill out the application. i clicked the application that none of these people were here with me and then the banner on the next screen said that i told the website that another person

was, in fact, standing with me helping me with the application. all of this this morning fueling congressional calls for healthcare.gov to come off line for good. if we just sit back and just hope it falls apart, it's the wrong thing. if it's teetering near the edge of the cliff, we should go ahead and push it over. >> the federal officials will holds a conference call later this morning to provide an update on how things are progressing at healthcare.gov. they said last week their goal was for 50,000 consumers to be able to use the website simultaneously. that would equal 800 thourks people in a day. that capacity they'll need to enroll just under 7 million people in the next 120 days. back to you in new york. peter, are you sure there wasn't a navigator hovering around in the newsroom that you didn't see, another person? >> if there was, i would be very creeped out because i couldn't see them. >> maybe the web side knew something you didn't. >> that's the thing about navigators, very stealthy.

peter doocy in washington. the person put in charge of creating the 24 hour war room where 300 people are making sure the back end is up and running, he said by the deadline it would be fully functional. those were his words, fully functional. according to their goals to their internal goals and metrics that means 80% of the people would be able to buy health insurance. this works. you are what you say you are. reality doesn't matter if the press goes along with it. so if you say this is a huge success, chances are it will be reported that way. >> like being able to declare a victory. the same thing came from kathleen sebelius a week ago. instead of saying it would be fully functional on this date and said that users were going to notice a drastic difference -- a drastic change in the way that it was functioning. >> so what specifics are we talking about here? they may have downplayed it in

an effort to drive some sort of media coverage on this. they said they're hoping 50,000 will be able to get on this. 50,000 in peak traffic times. they said, hey, we overshot expectations. 800,000 people are able to get online. they're able to get on the website, faster loading times, screens loading in less than a second but what they're not telling you is all the back end infrastructure is still not working. the applications that peter was talking about are arriving at the insurance company's website and on their desks with all kinds of errors. so you're having these insurance adjusters having to call people to confirm pieces of information on the applications like why is your phone number wrong? simple stuff. why are you -- >> and the part to pay insurance companies hasn't even been built yet. it's expected to be said and done spring of next year. >> at some point if you throw enough money at a website and get enough tech people in the room, you can probably fix it.

they'll probably fix the obama care website. it's obama care yourself that you ought to be worried about. "the wall street journal" said the core problem is the way this system, this law is set up. it's set up not to provide health care more cheaply for the average person. it's set up to redistribute wealth. a lot of people in the words of the journal are paying for first class seats in order to fly coach. you'll get fewer options, less good outcomes in order that the people who voted for the president get health insurance without palg f >> those folks who didn't vote for it, the majority of folks losing their coverage are small business and middle class folks and i quote the piece, they took responsibility for their own health care without government aid. they did this themselves without the small business. >> can you imagine? >> unlike people in the job basis testimony, they paid after tax dollars to get their own health insurance which is now being ripped from them and now they're being forced to subsidize those who don't have

health insurance. >> yeah. officially what the wall street journal website may be saying is the obama care may be bad but this is worse. even if the website is fixed the public is learning that insurance costs are more in return for worse coverage. regulators mandated a very rich level of essential health benefits that all plans in the individual market must cover regardless of cost. >> the point was never to make sure that you had better health care at a cheaper cost. that's not achievable when the government starts medaling. the whole point was to level the playing field. it was to redistribute wealth. that's been their goal from day one. i wish we would just say it outloud. >> it wonders if the ideology is a thing of the past once the public realizes that when big government is in your wallet, in your backyard, at your kitchen

bedroom communities coming into the city, coming in for presumably a lot of the christmas festivities here. we'll keep our eye on this. this information coming into our newsroom at this hour. >> it sounds like it could be worse than we know now. we'll keep you updated. later today the white house will announce the details to the fixes to healthcare.gov. even if they meet their deadline, could it be too little too late? joining us to weigh in is chris wallace of "fox news sunday." >> the white house is saying the launch, relaunch of the website is a success. is this accepted in washington? >> well, look, people have to wait and see and probably a lot of them will check it out for themselves to see as peter doocy has been reporting, it's not problem free but as you suggest, the white house will say that the website can handle 50,000 people at one time, 800,000 over the course of a day. but, you know, look, there are still a lot of problems and it's not just a website issue.

one of the issues is that the back end of the website has not been fixed. it's sending a lot of erroneous information to insurers. they still amazingly enough haven't built the system to actually pay insurers to process payments to insurers. i would think the insurers would care about that. then there were a lot of other problems, cancellations in the individual market, cancellations in the employer market, both small and big businesses. then we're also finding out because they're trying to cut rates they're excluding a lot of doctors and hospitals. so, i mean, there are going to be a lot of problems with obama care. in terms of making any kind of judgment, you're going to have to wait three months, six months, nine months to see do people feel the system is working out for them or it's not working out for them. too easy to tell at this point. >> at the very least, on a weekday and not on a weekend. chris, the press conference is coming up at 9:00 this morning. what kind of spin do you think we'll hear from the white house on this because the problems are

still pretty big problems. >> i think they're going to say -- first of all, they'll say, look, this is not a drop dead day, that the deadline is being over emphasized. the president set the deadline. they'll say it's a process and they'll continue to fix this. you'll hear although they won't say it in these words, we've declared victory and we're meeting our goals. look, they won't be the judges of this. each individual person as they have to deal with the whole obama care structure will decide whether or not this helps them or hurts them. >> on "fox news sunday" we'll talk to peter doocy. we'll have mira tandin, the center for american progress. , she helped write the american progress. we'll talk foreign policy with general michael hayden about

great. how did you conduct the actual social experiment? what did you do and how did your congress gr congregants respond? >> one hour before i went to the church and hobbled around the entrance of the church and tried to wish people a happy thanksgiving. i did have a poster that said need food or money and had various people as they entered into the church confront me and some avoided me. and then after the church service had started i made my way into the chapel and walked down the aisle to the front pew and made myself comfortable and i think made a lot of people uncomfortable and then about a half hour into the church meeting there was only one individual in there, my second counselor, who acts as an assistant to me, that was aware of this little experiment, and i approached the pulpit and he

asked if it would be okay if i got up and said a few words to express my thanks. i got up as a homeless man and began to recite a verse out of our him book, have i done any good in the world today, and then thanked the members of the congregation for their kindness that they had shown me. there were some that did show me some kindness, especially some children, and that i wanted to give the money back or some of the money back to the church to show mia preesh yags as a homeless man and then i pugd my wig and glasses off and exposed myself as the bishop. >> what was their rea beings? i have to ask, i'm curious, what do you think accounts for the uncomfortable nature of the congregants as they were coming in and avoiding? did they have some discussion or self-reflection? i'm curious what motivates to be avoiding? >> there are many things. there's obviously the safety of the ward members. there are some people that approached me that asked me to leave the property and told me i wasn't welcome there.

and after this experiment they were very, very -- they felt very a shamed and felt very bad but one of them that did that actually was trying to protect the members of the congregation because there had been some incidents prior where people had had their purses snatched and such and so i certainly didn't want to judge them but we just don't know where people have been and what's -- what lends their viewing these things through. >> right. i guess we learned not to judge a book by its cover in a true form there. hopefully in your suburb of salt lake city the message will spread across the country. bishop david musselman, thank you for your time. >> thank you. coming up on the show, top story this morning, hollywood still reeling from the death of paul walker. the president has had every excuse for every obama care glitch since day one. if the white house wants to say the website works, herman cane

wreck, the republicans did, and more people are aware of the fact. >> fwhb two, states refusing to participate in obama care. why is this not a valid excuse? >> because some states were simply saying, number one, we don't thing this is the right solution. and they so far have proved to be correct. and number two, they knew that they had a better chance of providing for those without insurance if they could control their own destiny, including medicaid. because if states had gone along with this fiasco, they would have had to expand eligibility for medicaid. we're seeing the few people who get through the website, they're now being dumped onto medicaid as a default. >> and where are the doctors to treat them? and number three, website glitches. the website has a few bugs. >> right, and my dog ate the homework. look, earlier in my career, i

a metro spokeswoman confirming four cars are off the track. there were initial reports the cars were in the water. as you can see from this photo here, at least judging from this, it looks like one of the trains is just teetering on the edge. all this happened around 7:20 this morning in the bronx. that's north of new york city. it happened as the train was headed around a sharp curve. it leapt poughkeepsie earlier this morning, en route to new york city's grand central station. so many happening when so many tourists are blockiflocking to g apple. >> early this morning. as rick was telling me off camera, good thing the train may not be sitting in the water. if it's teetering in the water, water temperature in the 40s, keep in mind, in that area, and we see ladders on top of the trains as rescue workers try to get to the people.

>> it happened at 7:20. fortunately, that's not the peak time of when commuters are coming in and out of the city for work on a monday through friday, but the trains always have people on them. they're never empty. we're still waiting to hear the number of people involved in that and we'll keep monitoring it. >> that's not the first time. in fact, there was a similar train, a garbage train, hauling garbage, derailed in july in the same spot in the same track. meanwhile, all service is suspended at this hour. we'll update you as more information becomes available. >> story could be getting bigger. >> we have another fox news alert. big news morning here. hollywood tragedy to tell you about. actor paul walker is dead. killed in a fiery car crash outside los angeles. >> walker was riding in a friend's porsche when it crashed into a light pole and burst into

flames. thorts say speed was a factor. walker is best known for his role in the "fast & furious "series. he appeared in all but the last of the seven films. he was also known for his charity event. he was scheduled to make a charity appearance just before he was killed. >> a photographer snapping this picture of him just moments before getting into the friend's car. this is the last known picture of him alive. >> what i saw was when roger was backing the car into the garage, paul wanted to go for a ride. they went for a ride. that's the last we saw of them. >> hollywood reacting to that this morning. vin diesel said, brother, i will miss you very much. i am absolutely speechless. heaven has gained a new angel. rest in peace. >> olivia wilde said heavy,

heavy heart tonight. paul walker was a genuinely good, sweet person. >> paul was a good person in a town of questionable character. a real life tragedy. >> paul leaves behind a 15-year-old daughter. >> so young. >> and you know, every time these movies come out, people talk about the speed factor and the danger of driving like this. no word on if this is the type of situation that paul walker was involved in at the time of the crash, but how ironic. >> it looks like he was not involved in a drag race or anything, but just getting in a friend's car for like a test drive. not circumstances you would imagine you're putting your life at risk, and then instantly, it was over. really a lesson that you can't control your life. >> and you mentioned some burn-out tire marks. bl some of the investigators looking and not knowing if they're related yet, but there were doughnuts, burned rubber

doughnut doughnuts, figure eights near the crash scene. but about 300 yards from where this charity was set to unfold in this park. >> we have other breaking news to get to. brand new developments on the 85-year-old u.s. war veteran held prisoner in north korea. the u.s. now urging the immediate release of merril newman hours after he appeared in a video. they confirmed the swedish ambassador has met with newman, releasing this statement. we were very pleased to hear that the ambassador was aplowed to pay his first visit to merril, merril reporting that he is being well treated and the food is good. kenneth va has also been held in north korea for over a year now. >> an update on a tragic plane crash in alaska that killed four people, including a 5-month-old boy. this morning, police are calling the infant's mother a hero.

up for grabs. >> one of the memorandums issued by the cio who had to sign off on the authorizization to operate signed off on a finding of high that said the risk potential is limitless, and gave them until may 31st, 2014, to fix it. that means right now, that threat and risk potential is still limitless on november 30th. healthcare.gov has 300,000 lines of code. facebook covers 327 million daily active user users. >> when you're hearing information meant to go to insurance companies is erroneously going to other places, it makes you wonder if you want to give your social security, tax records, and other things. >> they built the website that doesn't work. you trust them with your critical information? a lot of people are saying i'm not sure you're competent enough. not that it's like a nigerioan

e-mail scan, but they'll leave it open to phishing by foreign governments or criminals. >> it's not only our lack of trust in government, it's our general lack of trust. the new study out this morning highlights american distrust in each other. it's hit an all-time low. look at this. trust in decline since 1972 to 2012. most people can be trusted. 46% said that in '72. now down to 32%. can't be too careful. 50% back in 1972. now, it's up to 64%. >> we had father john on the show earlier this morning to talk a little bit about this and provide some thoughts. he was saying he believes of course you're putting your trust in god, the number one place to do this, but having a sense of community and having actual discussions, actual meals with human beings, learning what makes that person tick so you have empathy for another human being. >> part of that is because of technology, we're on social

there's are four or five cars off the tracks and about 100 firefighters have rushed to the scene. take a look at the images coming in to us now. metro north also confirmed no passenger cars in the water. the water temperatures right now, a little over 40 degrees. this happened around 7:20 this morning in the bronx north of new york city as the train was heading around a sharp curve. recall, the same curve where the rails caused problems back in july for another train. the train left poughkeepsie early this morning in route to new york's grand central station. yonkers is a big line, a lot of other big cities along the line. tourists coming in to see the christmas decorations. >> this is going to foul up travel on the busiest travel day of the year. we don't know the extent of the injuries, but we're tracking this intenltly. coming up, the u.s. urging, quotation marks around that one,

now. we're getting new images of the commuter train that derailed here in new york city. metro north spokeswoman is confirming there are four or five cars off the tracks. about 100 firefighters have rushed to the scene. we can now confirm there are indeed fatalities. >> marjorie anders, spokesman for the metro north joins us on the phone. we're getting different reports coming in. can you confirm to us this morning, are any of the passenger cars -- are they in the water or any cars in the water? >> no, there are no train cars in the water.

this is an area where the hudson line curves, and this was a southbound train coming out of poughkeepsie. it had seven coaches or passenger cars being pushed at the north end by one diesel locomotive. it appears the first four or five cars derailed. where the curve -- where the tracks curve sharply to the east. >> marjorie, we're seeing reports there have been fatalities, possibly as many as four. can you confirm that? >> i can't confirm the number, but i believe we're going to have some fatalities. >> this is an area of the rail that had problems this summer with a garbage train that had also had problems at this particular curved area. do you know if speed was a factor? something else on the lines this morning? what do you know about that? >> i can't say anything at all about the cause of this accident. it was not the same area where

the derailment of the garbage train occurred. it was about 100 yards north of the spot in the station. it was not in the rock cut area where the garbage derailment occurred. >> we know you're a metro north spok spokesperson, but give us an idea of what the scene there looks like. we're hearing 100 firefighters are on scene. this is a big deal. >> yes, well, i would hope at least 100 firefighters are on the scene. it is a big deal. it's a horrible tragedy, and we're getting great cooperation from fdny and nypd, and you know, local hospitals. and emergency service personnel. it's going to be a very long time before this is cleared up. >> it sounds like it. what does this mean for travel for everyone else? >> well, the harlem and new haven lines are running fine. the hudson line is not. i don't know if -- we'll

probably set up some kind of a shuttle service, certainly tomorrow, to get people to areas. subway stations, so that has not been determined at this point. but we're not going to have a normal rush hour tomorrow. >> i hate even to suggest this, marjorie, but are we going under the assumption this is an accident. have there been threats against metro north? >> i can't comment on that. >> also one of the big questions is how many people were onboard this train? do we have a sense? it was 5:45 in the morning when the train left. >> right, the only good news is it is not, you know, a hugely crowded train. i mean, it was the second train out of poughkeepsie in the morning. it left at 5:54 a.m. it was due in grand central at 7:43. that was the train involved in this horrific accident. and you know, there's plenty of people on it, but it's not a rush-hour train of thousands and

a fiery car crash north of los angeles. he was 40 years old. hollywood is waking up this morning. how are they reacting to his passing? joining us is kevin mccarthy. good morning, kevin. >> how are you this morning? >> well, what's the reaction in los angeles to this death of paul walker? >> paul walker, i mean, audiences across the world and hollywood lost one of their favorite actors. he was considered one of the nighest actors to work with. directors love him because he alouded the director to make the movie they wanted to make. he was a very charitable man. he had a foundation called reach out worldwide, where he was helping out natural disaster victims. he was one of the most successful actors working in hollywood. his movies have made over $2 billion at the box office. a lot of that money came from the "fast & furious" franchise. back in may of this year, i sat down with mr. paul walker, seven months ago. as a fan growing up as a kid, i

back to that fox news alert. the new york post is reporting four passengers onboard a commuter train headed to new york city are dead. the train en route to one of the country's busiest terminals derailed in new york city, and there are four or five cars off the track, and at least 150 firefighters now on scene. earlier on "fox & friends," we spoke with marjorie anders, the spokesperson for metro north. >> it's a horrible tragedy, and we're getting great cooperation from fdny and nypd, and you know, local hospitals and emergency service personnel. so it's going to be a very long time before this is cleared up. >> ooh, so we don't know the full parameters of this disaster. we do know that a train is down, four or five cars. it had quite a few passengers on it, coming south from

poughkeepsie this holiday weekend. we do know there are fatalities. the new york post reporting four or five. initial reports suggested one of the cars was in the water. thank heaven that's not true. looking at pictures on the left of the train on its side. more than 100 firefighters on the scene. >> so close to the water, the water temperature hovering around 41, 42 degrees right now. thank goodness the trains did not hit the water. we don't know how many passengers were inside the passenger cars as they plowed into the ground. >> when we spoke with marjorie anders, we did ask here if it was safe to say this was an accident. she would not confirm that or deny that, either. but you do see that it was going around a pretty big curve there. she also told us it was a seven-passenger cars pushed by one diesel locomotive when four or five of those cars were derailed. four passengers killed,

according to the new york post. >> it was an early morning passenger train, so there was already a train that left earlier that had other passengers on it. fortunately, it was so early, there might not have been so many people onboard this train. again, holiday travel is going to be disrupted, and normal commuter traffic is going to be disrupted. they're going to set up shuttles to get people to and from new york city tomorrow for work. one of the busiest times of the year. >> and other stories making headlines i want to get to. it claims to be a grassroots movement against walmart paying their workers low wages. the ones being paid were the protesters themselves. unions dished out cash and one member was caught on camera admitting it. >> local 7. what?

>> well, that person there, one of about 200 protesters at wall part in colorado on black friday. one of many gatherings across the country. better late than never. 34 years after a crime, a mother taking to facebook apologizing to the victim. michael goodman said he accosted him for a bus pass in the '70s. he was arrested but claims he always felt bad about the crime. when he came across his man's name on facebook and saw the picture, he decided to apologize. bell responded, accepting the apology. >> actress roseanne barr releasing a profanity released tweet. things are not going well, and in a series of tweets, she claims she has been disrespected and vowed never to work in television again. >> women who have achieved far

what should president obama be doing this morning to try to secure merril's release? >> the first thing, i think he needs to talk about it, not just the spokeswoman, who spoke yesterday. almost pleading terms. it wasn't a demand. i think we need the president of the united states himself to say this. also, we need to do other things. for instance, we can actually be cutting north korean banks off from the financial system. we should impose a travel ban to north korea and add them back to the state department's list of terrorism sponsoring states. there are other things we can do, but we need to have stick, not carrot here. >> we were very pleased to hear that the ambassador was allowed to pay the first visit to meryl. merril reports he's being well treated and that the food is good. that's coming from the family. as you pointed out to me, gordon, it's fascinating the number of p.o.w.s from the korean war that are still unaccounted for. they use these to sort of taunt

the american public and taunt america that they have access to these i.d.s, maybe not that they're kept alive, but they know this information. >> there are hundreds of unaccounted for p.o.w.s. we know of some of them because their i.d.s are shown as war trophies. this is the taunting of the united states. this is a very difficult issue, but it's brought up because merril newman is a korean war veteran, and we think he was detained because he was trying to see some of his comrades from the korean war during his tour last month in north korea. >> the president should be speaking loudly and carrying a big stick, but it appears the president is quiet. >> there's a bipartisan consensus in washington when you deal with the north koreans, you have to act in a soft voice. we saw this in the last administration. merril newman is the seventh american detained since 2009. we have to stop this. basically, the north koreans are

grabbing americans as hostages, using them for political purposes. this has got to end. >> one of the last times this happens, president clinton went over there. did president obama learn from that. >> i think he did. as president clinton and president carter in 2010 bringing back people who were detained, so north korea detained more people. and now kenneth bay, the obama administration wisely did nothing really to bring back or give north korea an incentive. that's important because we need to stop this cycle of taking americans. >> is flexing military force off the table for the united states? >> well, at this point, we don't need to do that because there's so many other things we have the ability to do that we haven't been doing. and really, i think we need to show some determination because that's the only way the north koreans understand. they're still fighting the korean war, and we're not. starving them, though, with fnlss, though, it seems kim

kurtz. >> there is a lack of justice. lara logan does a story that embarrassing the obama administration. apparently, it was a flawed story. alec baldwin makes comments, supposedly critical of gay people, he gets fired, and martin bashir attacks sarah palin, and he's fine. >> alec baldwin brought up the martin bashir comparison after msnbc blew up his show after the blow-up with a photographer outside his apartment. he did lose his temper and curse at the guy, but that wads on the street. he was angry. maybe you just suspend him, cut him slack, where bashir read his scathing personal, disgusting atact against sarah palin from a teleprompter. it was graphic, and they have not taken any disciplinary action that we know of, hasn't even condemned the comments. >> it was scripted and graphic. this was not some rogue event.

this is not something he ad-libbed out of rage. this is something his producers knew about. a lot of people knew he was going to say this on air and they didn't stop him. >> in the case of "60 minutes" not only has lara logan been suspended indefinitely as punishment for this badly botched benghazi report, but her producer got the same punishment. in the case of alec baldwin, initially he was suspended and now he's not coming back to do his weekly show for msnbc. you have to wonder why it is they have doubled down in terms of not touching or saying anything to martin bashir. i suppose it might have something do with the fact that the target was sarah palin, a conservative woman, woo is probably not well liked by the people who watch msnbc. >> of course, the audience agrees completely. back to cbs, compare this to what happened to dan rather who lost his job for falsely

reporting president bush dodged vietnam. it took a while for them to act after it was obvious to us that the story was false. compare that to the immediate response to the story that embarrassed the obama administration. >> things move more quickly these days. it did take time for rather to lose his job, but the other key difference is at least there was an outside independent investigation of that story that rather did about george w. bush and the national guard which led to the action here. we have no outside investigation, an internal inquiry led by a cbs producer which did find fault with the story and logan, but a different situation when you're dealing with it in-house. >> are we sure the logan story was false? >> cbs said the security contractor who claimed on "60 minutes" he had been at the compound the night of the fatal attack and had scaled the wall

has come and gone, but will the problems continue? >> peter was on the conference call for us from washington. he's live with the latest. what did you hear? >> we heard from the man president obama brought in to manage the healthcare.gov rescue project. that's jeff zions. he says that today, december 1st, this site is night and day compared to where things were at the launch aublth 1st, two months ago. on the conference call, other officials announced now 80% of users who logon to the site are able to enroll successfully. this comes after more than 400 recent software fixes and the infrastructure of the site itself is much stronger -- rather, it is much stronger today than it was a few weeks ago. the white house is also saying they have reached their goal. 50,000 consumers can now use healthcare.gov at a time, but they also are kind of couching that, saying these improvements do not mean everything is perfect.

>> there likely will be times even with this increased capacity, that that increased capacity will not be sufficient to handle peak demands. so to prepare for those times when spikes in user volume outstrip the system's expanded capacity, we will deploy a new coqueue system to allow consume to request e-mail notifications when it's a better time to come back to the site. >> that's right, healthcare.gov is now designed to handle more than 800,000 users a day, but you heard they are really pushing this new system where if a surge in traffic pushes the limits of the capacity, officials are saying the site will not crash because they have this new future that is going to notify the overflow crowd about better times to visit the site with follow-up e-mails. they repeated that several times in answers to questions and also in their prepared remarks. they said that is going to be a big help moving forward as they

marjorie anders is on the phone with us right now. marjorie, can you update us right now on the number of fatalities involved in this crash? earlier, we heard about four. is that correct? >> i can't confirm exactly. it's obviously a very in flux situation. there's a lot of things happening, people being rescued. there are a number -- i can say there are a number of fatalities, and there are dozens of injuries. this is a horrific situation, and we're getting great cooperation from fdny and nypd and local emergency responders. it's a horrible situation. >> marjorie, briefly, ten seconds, do we have any indication what the cause might have been for this? >> i do not know. that's obviously going to be the result -- we're going to find that out after a long investigation, but certainly, we're going to download the
