republicans, democrats have very different views of this law. >> what the president did was make the best case he could. there are individuals who have dreadful problems and medical conditions who have already been helped and their bills have been paid that otherwise would have bankrupted them. that's one case he made antidote after antidote, after antidote maybe four or five of them. secondly he says the republicans simply want to repeal this. they don't have any plan of their own. in a narrow sense that's ineffective little argument. trouble is in a macrosense obamacare is a debacle from beginning to end not only the web sites but what's happening at the far end with the insurance companies, people losing their policies. i think is he going to lose this debate poor the reason that he is going toive tell the same little stories for three weeks. it's not going to change anything. >> i wonder if he knows anything about cameras and videotape? because he said today as you just noted that his opponents have not presented any alternative. i mean, we do this simple google search congressman roe had a plan

september 18th, 2013 that's this year. paul ryan had one may 20th, 2009. there are plenty plenty of alternatives out there. but he says they haven't presented an alternative. that's a flat out lie. that's not true. >> medical savings account and various aspects it? >> he says that in his p.r. offensive. how effective can that be if you say that when it's not so. >> what he is saying is there is no agreed upon large republican healthcare plan to rival obamacare upon which all the republicans -- >> -- so now we have to read into what you think he says? he is a pretty smart guy. what he said what he might have said he had thought it out. they sure haven't presented an alternative. whether you like the alternative or not, that's fals. >> where is he headed? he is going to veto any change in obamacare he doesn't like. i think the republicans right now could win the u.s. senate in 2014. so where do we go from

there? republican senate, a republican house. and obama vetoes any aspect to this program. he doesn't like. we will have gridlock for two years. i don't see how the republicans overturn obamacare without a national revelation against it which could get him two thirds of both houses. >> i don't know if they are going to overturn or appeal it i do know one thing web site a debacle. quite a distraction. i don't think that's the real problem because i thought the web site could be fixed. problem is two fold. number one, can we pay for it? are the young and healthy really buying into it? we don't know that yet. that's number one. number two is the problem is do we have the doctors to in order to deliver the services. we talked about healthcare. talk about access to healthcare. there is nothing that i see the republicans and democrats in any way enhance our medical delivery. >> well, this is -- i agree with you 100%. we are headed for a disaster. quite obviously, who is getting into it quickest and who is most persistent in

going to that web site and getting through it and getting help? it's it the people with preexisting conditions who have tremendous medical problems who need, as he said, you need a couple hundred thousand dollars paid. who is not going to it? the kid on the ad in the super bowl who is out there shooting hoops and they told him to go get hurt and have a bad knee, is he not going into that web site. >> stick around and see what rick klein of abc is going to tell news a few minutes when he comes up. i think there are far other problems than even sort of the mechanics how this works. the back end the insurance companies are complaining because they are not going to get paid. the question is what happens when you show up at your doctor in january and you think that you are all enrolled in a program and have a program and the doctor calls up the insurance company and says we have no record of you, then what? >> the problems -- what happens when the obamacare mandates hit all these employers? they hit the individuals at the it end of this year, 2013. they start hitting the employers at the end of 14 and all these companies start dropping their programs and dropping people off of them, what happens

then? where do they go? again, as i say, greta, i think we are headed for a major collision and a debacle and i do not for the life of me. i'm reminded general petraeus' comment going up to baghdad. will somebody tell me how this things ends because i don't know. >> i think one the problems though is if the president and the reason why i have isolated this comment because they sure haven't presented an alternative. >> right. >> not only is it flat out wrong, but it shows that he is not even listening. it's one thing to say they haven't presented an alternative, which they have. but maybe he doesn't like the alternative. he doesn't even acknowledge the fact that there have been other options to try to deal with these problems there are a lot of republicans who want to deal with a lot of these problems with preexisting illnesses and everything. he flatly denies it even exists and sell it to the american people when it's not true. >> let me tell you, the fact that you are responding with some agitation because he is saying something that's not true. this is an effective argument. political argument. you say i have got my program. we have problems with it but

they have nothing. what are they going to do with folks with preexisting conditions? what are they going to do about portability and these things is there any republican program that they have got out there that's competitive of mine? >> pat, it's not effective if people are going to call him out on it. it's not effective. >> would he not rather argue owe ma'am ba care the republican program obamacare vs. what we see in the papers? >> i don't think on the heels of what happened to him when he made all the promises about if you liked your health insurance you can keep it there is an abc poll recently i think in early november that says he is under water in terms of his hun necessary city and trust worthy with the american people. going out there saying the republicans haven't presented alternative. i don't think is he on solid ground. i think is he on the run. >> i think he is on better run than obamacare under water and -- where he is headed right now because i think is he going to lose this argument.

they have to quarantine this guy in the white house because he will be hemlocked to democrats running for the senate. he has already dropped down to something like 40%. he is already a drag in many of these states. again, he had some effective antidotes here, i don't see how he wins the macroargument because there are so many elements to it that are going wrong in the whole program. >> but what he should have said today and he should have said the republican ideas are bad ideas. he gets saying again something that's not right. >> republicans come back and say we do have ideas. we have this and that and the other. and if he is in a debate on that, my program vs. somebody else's. he is in a better debate than he is with the morning papers saying another disaster has occurred. >> i don't know. anyway, what happens with all of this? i don't see how this thing ends. i really don't.

i did see something in there. he said the republican ideas he looks to me fishing for some areas where he can bring the republicans over to him. i think where the republicans could run into trouble we have the exact opposite. what he does is insults the republican leader in the senate. he insults him. he doesn't name mitch mcconnell. reach out to. work with you, to be on the same team. the last thing you do is first of all say they haven't presented an alternative which is false. the next to last thing do you is insult them. >> is he in full political mode. this is his political offensive. again, some of these -- political offenses, if there is going to be a solution before 2018 or 20189,

you may think you signed up for health insurance but think again. abc political director rick klein joins us. nice to see you, rick. >> hi, greta. >> okay. if you have signed up, do you have health insurance. >> you might there is a very good chance that you do. not quite like going on amazon and ordering something where it immediately goes to the shipping warehouse and goes off. what happens when you sign up under the obamacare web site your information gets transferred to an insurance company. the insurance company takes your information and starts enrolling you in the system and everything is smooth ideally. if something is wrong in the electronic transmission that happens between the web site and the insurance company, they may have no record of you or have record of you with the wrong birth date or

the wrong social security number or number of dependents or all manner of problems. one little electronic hiccup can disrupt the entire process. could be that people have signed up for the obamacare health law through the insurance company. they have no idea they even exist much less enroll for insurance. >> can be as many as a third, impact a third of those that have signed up. >> the current numbers is 40,000 people. could be talking about 10s of thousands of people that have ghost insurance right now. they think they have it the white house has known this is a problem for some weeks now. they have had some patches involved. they have had a lot of phone calls and conversations with the insurance companies how to take care of it. they say the biggest problem involving social security numbers is now taken care of. this will be a manual process for these insurance companies to make sure that the people who think they have enrolled are actually enrolled, that they're getting the billing out and actually enrolled in the system. all of this is going to come up against this january 1st deadline where people are going to start to get insurance. you can sign up as late as the end of december,

december 23rd. so, if we are a nation of procrastinators. big rush of people around holidays. it better be fixed by then. >> if there is that error. if i have already signed up and i'm in that one third according to the "the washington post" who really doesn't have health insurance. the year passes and next july in the middle of the night i for some reason i end up at the emergency room in some hospital on some vacation and they call in my insurance and say i don't exist. >> that will be an interesting legal quandary that gets raised all of a sudden. >> legal quandary. that's the least of it? >> medical thing too. the insurance company will say the problem with the information we got from the federal government off 00 web site. and it's not our fault that you didn't get to us. but the consumer is going to say hey, did i this i think from. >> think how much fun it will be in the middle of the night spending all those hours on hold trying to sort it out. whether you have got like a sick child or something that's on your insurance policy. >> it's awful. look, i think people may or may not realize that they have this insurance. if you don't get a bill before the first of the year and you thought that you

enrolled then there is a problem there people may not pay attention to that if you don't get the insurance card in the mail maybe you know that maybe you don't there will be some people who think they have health insurance and come january 1st who will have to access that. it could be july or november make a call to the doctor and find out there was this problem on the back end of the obamacare web site. >> is the obama administration confident that the young people, the young and healthy are really signing up and joining this in order to support the older and more sick people? >> i think they are still concerned about that. >> and what happens if we don't have the money? >> well, if we don't have the money, then, in the next couple of years, there is kind of an ease off of subsidies that allow the insurance companies to still charge lower rates. >> all those people that think they got a good deal eased off subsidies and rates will go up. >> first real judge will be when those rates will come out for 2015, 2016, if those rates go up substantially we will note that the whole underpinnings.

federal obamacare web site is far from fixed and now some states are trying to bypass the federal data hub. connecticut is one of those states. why and what's the plan? the ceo of connecticut's insurance exchange joins us. good evening, sir. >> good evening, greta. >> why do you want to disconnect from the federal web site? you are a state exchange, right? a state established exchange? >> that's correct. our goal is to service our customers as well as we can and as consistently as we can. we are really looking at our plans as a backup those in those instances when the federal data hub may have some problems or might be down. >> is your state exchange better than the federal exchange? if so, how and why? >> you know, i don't know enough about the federal exchange really to comment on that. i can -- what i can tell is you that we have worked very hard in connecticut to try to provide a really good customer experience to try to make something complicated as simple and easy as possible. >> do you have any idea how

much signup you have had? >> yes, we have had about 22,000 people, 60% of which are in private insured plans. we're expecting probably another 10,000 more with organic medicaid growth. >> how do you -- what information do you need from the federal system? to what extent do you interact with the federal system so it can even be a problem for you if they had a problem? >> it's around verification of identity and of eligibility. so we rely on them like other states for such things as citizenship, verification, and eligibility for tax credits. and other types of programs. >> how about security? because thrive a lot of complaints by some of the good hackers, the ones testing the system that the federal system is insecure and there are a lot of security issues that haven't been fixed. >> right. well, i don't know much about the federal security and privacy issues.

what i can tell you is that the connecticut system went through extensive testing for both privacy and security. we passed it well and it's something we take very seriously. >> but, if you are linked to the federal hub don't you in some ways pick up some of the problems in the federal hub that they may have with security or not? >> not that i'm aware of. my understanding is that the test that we passed make us like other states a unique to our state. so i believe in fact, that we have got that pretty well managed. >> well, if the federal is working well. if you think theirs is secure why do you even want to disconnect from them? >> it's to provide a backup. it's a contingency plan. in those cases where there may be maintenance, where there could be an error, where it could be going down, in essence we are trying to be as self-reliant as we can and make sure that our customers can keep enrolling for eligible coverage whenever they want. >> you are one -- i think there are 10 states or so that have done the exchanges and yours is one of them.

i'm curious, when you hear that the federal system may have enrollment problems, as many as a third of the people who have signed up may not actually have been enrolled, what do you think about that? >> well, what i think about mostly is how things are working for connecticut. and what can i tell you is that we have done extensive testing of our system going back to the summer. we did -- we froze the code in september to make sure that it could be going to production well and errors could be fixed. we work collaboratively with our health plans in connecticut. we are pretty confident that our enrollees are going to get their booklets and i.d. cards and be enrolled in insurance on january 1st. >> how about the prices? are they seeing sticker shock or not in connecticut? >> you know, affordable insurance can be -- health insurance can can be an oxy moron. what we do know is that roughly 70% of our individual policy holders are eligible for subsidies which we know make the insurance much more affordable. >> kevin, thank you very much for joining us.

joins us. nice to see you sir. >> good to be with you. >> is president obama overstepping his constitutional powers. >> i think i is article 2 of the constitution says the president shall take care that the laws be faithfully executed and what this president has done on a number of cases looks a lot more like rewriting the law than executing it. >> is he doing any more than any of his pred predecessors? >> i think that he is president bush occasionally declines to execute statutes because he believed that they were unconstitutional that's quite another matter. the president does have the power to do that. president obama is declining to execute laws without a claim of constitutionality just for political convenience or policy preference. >> all right. let me go to obamacare. specifically, has he done anything vis-a-vis that law that's overstepping the constitution in your opinion? >> yeah, i think that he has. he suspended the employer mandate for a year. this is a provision in the

statute which is crystal clear about the date when it starts, january 1. he has decided to suspend it for an extra year and it's not because he thinks the statute is unconstitutional. it's because he finds it politically convenient to extend it for a year. this is in the teeth of the plain clear text of the statute. >> if his job is to execute the law, like congress is to legislate and create the law. his is to execute the branch of judges and everything is there any way to challenge -- rather complicated issue notwithstanding. is there anyone who can go to court and say the president is going too far? he is going to statute in order to put a check on someone overstepping? >> well, you raise the question of standing. congress itself probably cannot challenge sump an action in court. an individual possibly okay an individual who should have received coverage under the employer mandate this year but won't because of the suspension i think probably could go to court. >> when you talk about stand

you talk about harm. i can't sue for an accident that i have no harm. in congress you have your voters and electors have given you the power to legislate and someone is stepping on your power to legislate, are you not harmed? i mean, the courts have just not permitted to you challenge the executive authority of the president? >> well, this is quite a naughty issue of legislative standing. but this a net shell, no, -- nutshell. >> all the way to the supreme court or district court. >> the supreme court. the courts in general have been quite hostile to legislative standing. as i say there is a good chance that an individual could actually challenge some of these actions and, you know, we get the same sort of ruling from a court ideally. >> so what's the -- i mean, let me take the extreme case. i guess the extreme case if you have a rogue president going way out of line only thing that can happen is impeachment proceeding in congress if you have somebody way out of line. only way to put a check on the president overstepping the constitution.

>> ultimate remedy, there could be cases as we discussed. there is the possibility that congress could retaliate in other ways. for example, not confirm nominees. not advance his legislative agenda. >> that doesn't define the limits of the constitutional authority? that's a weapon to hit someone with? >> you are quite right. >> ultimate back stop for lawless president the is impeachment. those are the constitutional back stops. >> the only way it ends up in court some citizen can find some reason he or she is harmed. >> i think that's probably true. >> nobody has done it so far about this. >> as you know, there have been a number of cases concerning obamacare. >> that particular issue on constitutional authority? >> well, the deferral of the employer mandate isn't quite ripe yet because it wasn't supposed to start until january 1. so, this coming year somebody, perhaps, could bring a suit. >> professor, thank you, nice to talk to you. >> great to talk to you. >> straight ahead, you saw tsa workers spend their time at conferences shows.

okay. let's go off-the-record for just a minute. if this is true, what the house committee says and if secretary sebelius has no good explanation, she needs to go. now, here's what i'm talking about. yesterday the house subcommittee on health announcing secretary sebelius testify on december 11th. in that committee press release announcing her testimony, it is reported that the committee just got documents that demonstrates that on april 4th, secretary sebelius was warned of the challenges made in the october 1st launch date. despite that warning, 14 days later, secretary sebelius testified before congress that implementation of the web site was, quote: on track. on track? really? she got a warning 14 days earlier. now i confess i have seen some politically motivated cherry picked press conferences. if that is inaccurate and secretary sebelius has no good explanation or even if it's half true and she was simply being cagey and slippery with the facts in

are a lot of democrats who are just as frustrated as republicans about the implementation of the web site and some of the other problems with obamacare. but, if he does, likes a the site starts to work better, if you see those bricks of credibility go back in place, i'm talking about tiny ones, i'm not talking about -- one big bolt that goes out. then i think you are going to see other democrats get on board and start to make the case. because, frankly, they have got to. at this point, either by november -- democrats own obamacare. got his name on it we have got to make it work. democrats in congress have got to help make it work. and support it and the republicans, look, it's -- they have been opposed to it from the get-go they have made that clear. they will try to keep throwing up further impediments. some warranted, some not. that's the game from here on in. >> i fully expect that the web site will get up and running. the one thing that sticks with me those four people who testified security

experts they said it wasn't fixed and couldn't be fixed. one on last night said it couldn't be fixed as it relates to security. that's not being discussed much. i didn't hear president obama talk about it i assume these people are being can did it and honest these experts on security. >> if there is a security breach in which millions of people lose their personal information. >> hanging out there. >> all these ifs. the whole thing now is, look, both sides are not telling the whole truth. if the republicans say we're all going to die, it's a disaster, the socialists have taken over, and everybody is going to pay more for their healthcare or lose it or get cancellation notices tomorrow, the president and democrats say everybody is going to love it, it's going to be great. we already know that that part of -- you can keep your healthcare plan and your doctor, period, wasn't the whole truth. the other side has to play out now, too. and i think. >> you have to sort of -- do they both throw their fire bombs at each other and find out is there real security

bicycles does that have anything to do with building obamacare web site that isn't what cgi thinks. good evening, i should add that how they are spending their time is not on taxpayer dime but tell me about this 2009 event that they had. >> this event, greta, was an offsite meeting. primarily of the top brass at cgi federal which is the main contractor responsible for healthcare.gov. it included, it being the offsite event some team building exercises. these exercises are ripe in corporate america. in this particular case the exercise involved people putting together children's bicycles with tassels and things apparently got out of hand a little and people ended up riding the bicycles drunk through the hallways of this luxury resort.

>> let me emphasize private company as well as on the taxpayer dime this one. i want to reemphasize that. what is cgi? who are they? >> cgi is interesting. cgi federal is based in fairfax, virginia. they are a very major subcontractor and contractor of the u.s. government. they basically are a technology company that does the plumbing on all kinds of wonky complex complicated projects. they are owned in turn by cgi group which is based in montreal. it's a canadian company. they are a huge technology company. they are probably the biggest and right now most important company you have never heard of. >> how are they doing financially? i saw one part of your story shorted a lot. never a good sign when your shares are being shorted. >> well, typically, when your stock is being shorted, people are betting that your stock price is overvalued

and the shares are going to fall. but things can turn sour on that if there is a short squeeze. most people would say that's generally not good news. >> are they getting contracts right now? are they a thriving company? >> they have a lot of legacy contracts that he they are working through. they have bids going through on new contracts. they have had, according to financial analysts a slowdown in some bookings, but all of these contracts are long tail. you have the problems and glitches right now with healthcare.gov, but you have a lot of ongoing projects and contracts with other u.s. government and foreign agencies. >> all right, now, cgi federal with cgi federal who started the company? >> company, entire company started in 1976 in quebec city by a frenchman. he built this into a technological behemoth,
