regime specializing in taking political prisoners. in just one month, cuba jailed 1100 political disyi dents this handshake took place in a tribute to a global symbol of freedom. in the hours since, the story exploded. usa today calling it handshake that rocked the world. "new york times" asking if this will lead to another new headache for the president. and a statement the handshake was not planned. see that there? and senator john mccain compares it to shaking hands with hitler. during a meeting today, congressman said this >> sometimes a handshake is just a handshake. when the leader of the free world shakes the bloody hand of a ruthless dictator, it
9:02 pm
becomes a propaganda coup for the tyrant. raul castro use that's hand to sign orders to regress and jail democracy advocates. >> with me now is chairman emeritus of the house foreign affairs committee. why is this a big deal? . >> i was born in cuba. like many others i had to flee the communist tyranny, raised here in this wonderful country but my district is filled with cuban americans like me who have felt the sting of communist oppression. this is a man, fidel and raul, makes little difference to whom we're referring jail dissidents. it's incredible today is the
9:03 pm
international human rights day and yet, what happened in raul castro's cubea, the man whose hand president obama shook he jailed, detained and he beat human rights activists who were trying to commemorate international human rights day. that is why it matters people are dieing to come to the united states from my native homeland to flee that oppression. raul castro does not deserve for president obama to bestow him this courtesy. sometimes it happens i can understand a setting but in that nature, he really should have ignored raul castro. and shook the hands of democratly elected leaders. raul castro is not a real leader of cuba. >> white house is saying this was not planned. andit, political experts from both sides of the aisle, democratic and republican have been saying not sure if that is true. because these events are very
9:04 pm
carefully choreographed and the white house would know who the president was going to see and what route would be and what chances would someone like this asking for a handshake from the president of the united states.. >> i think that the president did know. i think that his security detail knew who is going to be sitting around him. don't think it's by chance or by accident that the president of the united states was seated in front of raul kas stroechlt i'm in the saying he was in charge of the seating but he knew who was going to be behind him co have turned another way and ignored him. and it just happened but whatever, what matters most is the policy. what was the president trying to say? >> i hope it doesn't signal a shift in policy. that is why i wanted to force secretary kerry to admit that raul castro is a dictator and this does not mean change in policy. we saw a shift with syria policy. we saw a shift with iran policy. now, we're trusting iran to dismantle
9:05 pm
its nuclear program, it's unbelievable. i think the president wants to make good on that nobel peace prize he doesn't deserve but got it before he was really president. now, in this second term, i fear the worst in this presidency when it comes to foreign policy. he's tiptoeing around the thugs and making deals whenever he can so it worries me. we should be advocating for freedom and democracy. standing up for american values not shaking raul castro's hand. >> thank you so much for being here. >> feel better. you did great on leno. >> thank you, ma'am, thank you. >> i was able to keep from coughing. today, not so much. wasn't just handshake getting attention at mandela memorial. news photographers captured this moment. look at this shot. president obama posing for a three way selfie with two other
9:06 pm
world leaders our power panel weighs in on this photo op causing a lot of controversy just ahead. >> breaking tonight new signs of trouble for democrats from white house on down. president obama's approval rating dropping to its lowest ever in the university national polling. look at this, 38%. 38. now say they approve of the job he's doing. 57% disapprove. that is nearly a complete reversal of the numbers president obama enjoyed in 2009. if election held today voters would rather see republicans in charge of both senate and the house. now, 47 to 42%. look at that. the spread is larger when talking to independents. 50% say they'd rather see republicans in charge of congress. 35% say they would go with the democrats. how about that?
9:07 pm
wow. chris, so, the thing so striking about that is we've talked about how in that generic ballot the republicans have been disadvantaged. for many months. and now, what, what a reversal to see in the over all advantage and with critical independents. what do you make of it? >> well, the republicans are disadvantaged in the generic ballot for decades for generations. this is a majority democrat country. when people become ready this is just registered voters but among all registered voters you find a general preference for republicans if you get there what you find out is that there is a serious problem with the standing political order. you start to see contours of a wave election shaping up for 2016. that is why you have, 2014. that is why you
9:08 pm
have republicans in virginia saying maybe i will run. that is when money starts to come in and people start thinking bigger. >> this is a, not the result in his words are a rousing course of bah humbug for president obama. polling done between december 3rd and 9th, after health care.gov has been improved after the president sort of mea culpa. and it's not good for trust worthiness. that seems to be sticking. >> it's one thing, if you believe barack obama is bad at
9:09 pm
being president that may change. he's doing better and worse. if you think he's not honest, if you think you cannot trust him, in this poll more than four out of ten of the folks said only four out of ten thought he was trust worthy. this indicates something you don't fix. fewer people are going to lose their insurance than we've expected. those medium scale changes to bad governance is one thing. but if people don't trust you anymore, and remember this on the heel of the nsa, irs and other stuff if people don't trust you, they're not going listen to you. >> american people liked him. they may have disagreed on
9:10 pm
policy but liked him. these polls suggest they're liking him less which gives less cash in the bank. chris, great to see you. >> you bet. >> new warnings tonight about likelihood hundreds of thousands of americans will find themselves uninsured through no fault of their own. it could be more than that. brit hume is here on political fallout. why are american teachers staging protests from coast to coast this week? what about this ad? ripping on unions for failing our children? in a kelly file first, head of one of america's largest teachers union joins us live. next. looking forward to this, pl leno last night, or if you did, we've got the story from behind the scenes. don't go away.
9:13 pm
9:14 pm
look at this. united states rank theed number five in the world in per student spending. now, during national day of action you talked about teachers came out to reclaim public education. some of those opposed these common core standards american federation of teachers supports common core but cautions it's not a silver bullet. critics say the unions protect teachers at the expense of students. the center for union facts took out a full page ad in "new york times" attacking asd president randy winegarten saying teacher union continues to protect incompetent teachers. the fact is that unions have
9:15 pm
seen better days. national education association is losing members and this debate over union effectsiveness has been going on for the better part of a half century. the united states was number one in high school graduation rates. today, united states is number 22. as the debate goes on. >> trace, thank you. joining us now the woman in the advertisement. randy winegarten. randy great to see you. thanks for joining us. >> great to be with you. >> let's start with that critique. yikts say it's unions that are the problem in, particular there is tenure for teachers and inability to fire bad ones are contributing to disturbing numbers your thoughts? iets disappointing that richard berman would put an ad like this in today after biggest actions
9:16 pm
of frankly parents, students and teachers across america but let me just say one, if someone shouldn't teach, can't teach they shouldn't be there frankly our union as well as others, daily news said the ad was wrong we have actually been trying to figure out how to make sure have you great teachers in every school. two, where the ad and frankly all of the stuff about teachers so wrong this country have lots of unions and value their teachers issue is how to give the teachers tools and time that they need to do a great job? because what happens is poverty.
9:17 pm
>> i know you're complaining about standardized tests. they relie on testing. >> they don't. they -- they have made 1 or 2 or 3 standardized tests for kids for their career. they relie on great teachers and parental involvement. real engaging sir rick limb why we're into common core but this is what we see. in the united states of america if you factors out poverty we need to level playing field for poor kids. that is what countries have done. that is what we should do. >> we want is to make sure you have project based instruction
9:18 pm
for kids. from what i did with my kids. >> what is that mean? >> if have you a robotic course, look at ibm school in new york that the president has just been to. the performance schools where kids actually do a disser sayings tyke study for the year. with a really engaging thinking. >> one other question bri let you go. >> you have to have early kindergarten and wrap around services. have you to level the playing feld for poor kids. >> the unions take flak for standing up for bad teachers but one of the cases decided by politico the case of this one guy. mark burns. who he is a veteran teacher pleading guilty to lewd acts on a student but the district in l.a. paid him 40,000ses today resign. to get
9:19 pm
rid of him. so they won't deal with the process. that story says oh, the union. >> no. look. i when in new york city we made sure we have had rules about that stuff. there should never be anyone guilty of sexual misconduct teaching our kids. >> and gets $1 of taxpayer money. >> i don't disagreechlt but bottom line is that we've got to keep the great teachers. we've got to make sure we value teachers >> that is true. keep great ones but boot bad ones. good to see you. >> thank you. >> we're less than two weeks from a critical deadline that could leave millions without health insurance. brit hume on what that means. plus a 6-year-old suspended for sexual harassment. how ridiculous is
9:20 pm
9:23 pm
9:24 pm
is stronger than it was before. israel's national security is stronger than it was the day before we've entered into this agreement. the gulf and middle east interests are more secure than they were the day before we entered this agreement. >> joining me now is danny denann. stakes here are if the senate passes, both in favor of new sanctions iranians say they think it's a showing of bad faith. secretary kerry made the case it is faulting progress by iran and until something better can be negotiated. your thoughts
9:25 pm
on that? >> good evening, megyn. a bad deal for israel and a bad deal for american people. u.s. taking clearly in the white house don't hide. disparity towards black and white there are sanctions and nuclear reactors. today, secretary kerry created a gray area, iranians are celebrating. look who is happy. enemies of the u.s. enemies. not talking about israel. saudis, egyptians. they're all worried from the direction we're going >> they aren't happy about the deal. the point he kept hammering over was they halted some progress. being made by iran. it's a step farther, further than we were yesterday you know, before this deal. like not everything but something.
9:26 pm
>> and look what's happening to sanctions at a crucial moment, western society backed up. i think it was a mistake. people are happy. economy is going up. investments coming back to investing in iran. back to the point we were before that agreement was signed you think senate should impose sanctions you'd like to seat deal fall apart? >> politics in israel we're saying watch what iranians are doing not what they're saying. we're pessimistic. israel has not signed this agreement and kept options on the table. >> danny danon thanks for joining us, sir. >> a possible warning for possible obamacare coverage gaps and president obama's selfie
9:27 pm
9:30 pm
9:31 pm
warning for we believe it's millions of americans tonight they may find themselves uninsured january 1st. what say you? >> yes. the study released today shows that there are four groups of people going to have to pro actively go out to sign up for insurance in less than two week yofd time there is a dead line. it's december 23rd. it's millions of american going to have to do this. >> first group are people that had their plan. they like plans and lost they plans thanks to obamacare. now, have no choice but to go on health care.gov. >> important thing is that the law changes the way insurance companies spend money. >> a lot of policies were getting cancelled, too. >> they weren't available. this
9:32 pm
law limits ability to discrime investigate against people with chronic illness and forces them to go in to structure tight networks of doctors and hospitals so they can due cause. >> another thing you point out. small networks of doctors and hospitals is a problem for insured. people are concerned which is if you like your doctor you can keep your doctor. >> there is upside and down side. the upside is that they lower costs. down side is that it redistricts patient choice one thing not pointed out is that it makes it possible to make sure quality of care being provided is high. so, you know they're getting paid now. on the gays
9:33 pm
gaysis -- basis of quality. >> the argument on the other side if i'm getting paid by quality i'm not going to take sickest patients, but only ones i can clear. >> look. it's a quality measures in medicare are immunize people against the flu that is not going to affect whether you take a sick or healthy patient. >> doctors say quality measure will lead to refusal of patients. which is contrary to the act. >> i think a lot of doctors are not happy about this measure. as a patient, i want doctors to be measured and i want there to be a system that does not penalize them. >> who is doing measures? they
9:34 pm
don't want to answer to ipap or kathleen sebiliuos. thank you for being here. >> my pleasure, >> joining us now is brit hume and the big question is that next shoe to drop? if you like your doctor you can keep your doctor. wait. no you can't? >> yes. that is something that is revealing the facts about the situation now, get is what benefit do you find once getting in? and for a great many people the question arises is that you go in and look around, you scout for a plan. find one that looks good. comfortable what you had before. maybe better. and then, you go and look and see if the hospital you're used to going or or local facility whatever it is, and the doctors you're used to going to are included. in
9:35 pm
that plan. and so far, a lot of people are finding they're not. now, you heard argument made by mr. mendelson compressing number of doctors include hadded that way. you can keep sharper eye on it? well, maybe. on the other hand this gets more and more towards the core of this. which is the decision about what constitutes good care. >> yes. >> which is keeping an eye. it's being made not by you, but by your particular presences but more and more by some centralized authority whether insurance company, or whether it being you know independent advisory board you spoke of, which is one that got essences but it doesn't, isn't really what is supposed to be. more patient centered. >> we haven't got to the days of
9:36 pm
i pap. this awaits american people. there is a real question about how this is going to play out, you think of nancy pelosi. we have to pass the bill before we can know what is in it. americans starting to see they can't keep plans maybe not keep their doctor. maybe cannot keep their hospital. and now, it may be that they actually have a bureaucrat telling them what tests they can and cannot have. what happens when we get to that point? iets not going to be popular. that is the problem with this. it's possible in which you have sharp high r.eye will drain could. that doesn't mean people will be getting best care available. from people they're accustomed to getting it from.
9:37 pm
there is this issue you've raised is that is that until the part of the web site is built that allows information from the web site to be reliable to the ininsurance companies, people will sign up, enroll. we're not hearing about purchases because the facilities for doing that is not finished. insurance companies going to need to know information about who is signed up with policies. and what their premiums so they can compute premiums so they can send a bill. it's who you get a bill, pay it. you're not fully insured so. that is another issue. that is what a lot of people worry b window so so tight now. what people that lost their coverage. as of one of january. they think they're signed up. they find out they may find hout in numbers that they're not. which is the kind of problem nobody wants to
9:38 pm
have. not going to lead to improvement in poll numbers you're discussing earlier in this hour. >> yes. it remains to be seen how many will show up to offices or hospital in the new year. only to be told they're not insured. >> yes. that is worry some. >> did you see me on tonight show? i heard you shout out to my dear wife, kim, who discovered you and proud of it to this day. >> thank you. >> you bet. >> you too. >> coming up we're going to show you more about my appearance on leno. and after the health care controversy how is it kathleen sebeliuos may be the person of the year. really? and at six years old, hunter has been named a sexual harasser.
9:42 pm
9:43 pm
whether this was appropriate. danish prime minister and david cameron of great britain. so the critics are saying who takes a selfie at a funeral? a memorial service and they say it was disrespectful. david? >> it was. and i mean, whether you're a head of state, megyn, cameron, danish prime minister and president obama, better places to do this. this is going to get picked up. i've been worried about what michelle says with the danish pastry next to him. >> he looks unhappy. >> apparently she's unhappy and sat between them. i think he might be chilly. >> might have been rude for the danish prime minister saying
9:44 pm
let's pose. what is he supposed to say? >> supposed to say, i've been racking my brain when it is ever okay for the leader of the free world to take a selfie? the answer is, never. save merriment for irish. he's at a memorial for another leader. this makes no sense. i agree michelle obama probably gave him a piece of her mind when he got home. >> critics saying it shows he wasn't that moved, taking it seriously enough. that it was a breech of decoreum. >> people have no idea how south africans celebrate and honor their hero. >> they were dancing in the streets. you've got a point.
9:45 pm
there were all sorts of people taking photographs. this wasn't six hours of reflective silence. boy like to refer them to the you eulogy the president gave on his behalf. >> i'm sure people are going online to pull that up. >> there are no pictures of the eulogy. >> and let's move on to time person of the year. senator ted cruz, mily cyrus and kathleen sebeliuos. the question whether she should be on the list the roll out has been a disaster. what is she doing on that list? >> time magazine person of the year is meant to represent someone influential. you can see ted cruz symbol yizs the
9:46 pm
deviciveness of our political system now. in fact he was the first person to appear on your show. maybe he deserves to be most influential because he made that debut. >> damon? >> i love how mark goes to negative on ted cruz. time is trying to get attention they want attention with mily cyrus and twerking. yes, i said it on your show. and kathleen sebeliuos heads obamacare. i ma have been one of time persons of the year, it's about who has influence. it's just something about a movement like the tea party. something about sebelius that can have a greater affect on economy so it's time, getting attention. >> you're a tea party right?
9:47 pm
>> yes. 2011. >> the next case, a 6-year-old boyuspended and now has sex harassment offender on a permanent record for kissing a class mate on the hand. in case you're wondering how evil this child clearly is, listen to him. listen. >> and then in, class. yeah. and i kissed her on the hand. >> it's a miracle it's taken that long to get that kid out of school. what is the world coming to? >> this is insane. i'm going to admit on the record when i was five me and another kid used to kiss on the mouth. dougy raymond face book me. a kid under seven is legally incapable of forming
9:48 pm
a malintent other than whether he he should overturn the candiland board. in order for a skl to say there is a 0 tolerance when it comes to sex harassment dealing with a 6-year-old is nuts. the school should be held liable. because now this kid thinks he did something wrong. >> i think she's ignoring prior history. there is another incident he kissed this little girl. by the way, she had no problem witness. >> i think we should lock him up. >> it trivializes actual cases of sexual harassment. >> by saying this kid is an example, we're basically delegitimizing all other cases in the world. it's, we can all agree this is ridiculous, absurd
9:49 pm
i don't think his school record will translate to a criminal record. >> i hope someone gets a good laugh out of this one on his permanent record and says, mouch more about the school district than about this child. >> poor roam romeo. >> coming up, my first appearance on the tonight show with jay leno. we have photos for you gochlt to facebook.com/kelly file to see pictures and stay tuned for the back stage theory right here coming up plus, hannity. >> idaho where mark furhman lives and utah. we have private clubs all white.

aerobics in another life and another body. i used to do telemarketing on the side. that's a job you get paid depending how good you are. you call up. i used a fake name. rachel did a good job. right now i feel like i could do a 1900 number. if you're walking around with a secret and going on national news, wouldn't you dial it back a little bit? be a little on eggshells? >> a little. i don't know. >> he wasn't. >> when anthony weiner is in your face, it has a whole
9:55 pm
different meaning. believe me. believe me. a whole different deal. >> it was so much fun. everybody was so nice. i got a lot of attention online for my shoes. did you check out the shoes? they were totally fabulous. ladies, they were by sergio rossi. they rocked. i felt like a princess in those. they were amazing. i'm not getting paid to say that and they were actually comfortable as well. coming back after this break, i will tell you about other moments i had including what simon cowell told me about a very well-known fox news anchor. that's next.
9:59 pm
i had great time last night. when i walked on stage, simon did an air hug and i told him i had a cold and he goes, okay. and why we had that weird body language. and he said what has the name of that morning anchor that keeps interviewing me? brian kilmeade? love that guy. shout out for brian, sort of. and do you know jay leno still
10:00 pm
