camera. what sparked this attack and the charges both men are now facing. >> and a movie legend who achieved instant stardom as lawrence of arabia and nominated eight finals for an academy award has died. we'll have more on the life and legacy of peter o'toole. hello, i'm in for harris faulker. the worst fire fighting disaster in arizona history. we are hearing the last radio transmissions made from the yarnell hill fire that killed 19 granite mountain hotshotss in june. audio and video from a firefighter close to the scene who had a helmet cam on, it was rolling and picked up a whole lot. will carr is live from los angeles. will, what are we learning from the recordings? >> reporter: we are learning what it was like on the front line seconds before the fire

killed the 19 firefighters. if you take a look at the video, like you said, it was recorded on a helmet camera by a firefighter who was very close by to the granite mountain hotshots, just a short time before they died. you can really see how smokey it was. you can also hear the last known transmission from the granite mountain hotshots. >> hotshots escape route has been cut off. we are preparing our deployment, and i'll give you a call when we are under the shelters. >> the shelters you heard there, they are referring to fire shelters. they are like cocoons and you are supposed to use them in a worse case scenario and they did not work that day. >> indeed. and what else are we learn being what caused their deaths? >> reporter: well that is interesting because there was a report back in september that said that a big part of the

tragedy came from the conditions with the weather and the fire conditions. but with these new audio and video that we have, actually, it kind of calls into question a potential breakdown in communication. i can tell you that the arizona republic, a local paper there, had to file a records request to get the video and audio. and in the records request, the paper warned that air tankers were bombing the wrong targets and commanders didn't have safety plans and the paper reported that everybody on the ground that day was having problems with their radios so the paper said that it doesn't -- the recordings don't call into question negligence, but could be used in lawsuits down the road. greg. >> will carr in los angeles. will, thanks very much. a 17-year-old colorado girl remains tonight in a coma and in critical condition, two days after being shot by a fellow student at their high school. senior clair davis was sitting with a friend in the school library when suddenly she was shot, apparently at random.

the 18-year-old gunman trying to settle a grudge with a teacher. among those keeping vigil on clair's condition, colorado governor john licken hooper who made a visit this weekend to the hospital. >> she was shot point black with a shotgun in the face. i visited with her and her family. she is obviously in a coma, critical conditions. her parents are two of the most wonderful people you could ever hope to meet. they adopted her. they are beside themselves and really we all to keep clair in our thoughts and prayers. >> in the meantime investigators say carl pearson killed himself after shooting davis. he was heavily armed with a shotgun, machete and explosives when he entered the school on friday. turning to washington and the scandal surrounding our top international spy agency and americans. a group appointed by president

brohm to look for way -- brohm to look for ways to reform the nsa has given a list of suggestions to the white house, suggestions that will not be made public until next year. we are live in washington with more. steve? >> reporter: a special review board has reported to the president with their recommendations on how to change the nsa operations. now the president has not made the findings public but according to reports, one representation is that -- recommendation is that control of telephone records be shifted to a third party. meantime the nsa is trying to become more transparent and reassure the public. the agency opened its doors to reporters, including a 60 minutes crew. all of this comes after former nsa contractor edward snowden released information on the scope of the nsa's surveillance activitie activities. they are planning on making a deal with snowden to acquire the documents he is still holding.

and this has hurt u.s. surveillance overseas. >> i worry there is a bit of a retraction in our ability to collect information worldwide, and it is being done based on some mythical political belief that something -- that they are listening to my phone call and reading my e-mail. it is not true and we are paying a real price for that. >> reporter: the former director of the nsa michael hayden said the nsa activities are in line with the separation of powers and the u.s. constitution. >> there is no abuse. and by the way, i don't see any unlawfulness either. this was done according to the maddest ownan formula. the president authorized and the legislation legislated and the congress oversaw. >> steve in washington, thanks. a top democratic lawmaker said a bipartisan budget deal

that would prevent another government shutdown doesn't have enough votes to pass the senate. senators talking about the bill on a rare day, due to sessions of patty murray and paul ryan. now lawmakers on both sides of the aisle pressuring the senate to make sure the deal gets done. >> i say to those who are criticizing it, this is keeping our principle in tact. no tax increases, net deficit reduction, permanent spending cuts in place of the across the board budget cuts. >> i feel we'll have a good strong showing from the democratic side. >> despite not having enough votes, henry reed is -- harry reid is supposed to talk about the bill.

they could risk another government shutdown. today was to be the deadline for folks to sign up for obamacare, if they wanted their insurance to kick in on january 1st. but the obama administration now pushing that deadline back by more than a week to next monday. partially thanks to the mix of delays, glitches and crashes that have plagued the obamacare website since the launch. the administration also now admitting 15,000 obama care enrollees are at risk of not being covered right away because of a glitch that kept their information from being given to the insurance companies. obamacare also hurt the president in the polls. that is just part of the challenges facing his administration right now. and tonight fox news will give you an in-depth look at all of the head winds facing the president in his second term. fox news reporting, behind the obama meltdown -- the breakdown hosted by bret baier airing

on august 2nd, 1932 in iefd. he spent his childhood years in leads in the united kingdom growing up catholic. he ultimately discovered the theater making his stage debut at the age of 17. he spent years on stage before his film debut in 1960. two years later o tool was chosen by david lien to play it. e. lawrence in the masterpiece lawrence of arabia. it made o tool an international superstar. his 1962 role was the number one ranked performance in premier magazine's 100 greatest performances of all time book in 2006. medical problems threatened to destroy his film career an his -- and his life in 1970s. he gave up alcohol and after serious medical treatment returned to films in the stunt man and my favorite year. though o tool was nominated for

eight oscars, more than any other actor, he never won the award for a specific film. when he was named the recipient of the special oscar for lifetime achievement in 2003, he originally intended to turn it down, feeling that the lifetime award signaled the end of a career. he wrote the academy a letter stating that he was, quote, still in the game, and would like more time to win the award outright. but he finally did accept the honorary oscar. >> always a bridesmaid, never a bride. >> o tool won four golden globes, a basta and an emmy. he announced his retirement in 2012. he leaves behind two daughters to his marriage to actress wife and a son. fox news.

in fact, he spoke to a group of at least 200,000 anti-government protesters in the central square. the demonstration has gone on now for nearly four weeks after the country's president did a u-turn on a trade pack with the european union that was years in the making, opting instead for closer tied with russia. protesters wanted the deal signed because it would mean closer tied to western allies. here is senator john mccain. >> this is a grass roots revolution here. it has been peaceful except for when the government tried to crack down on them and the government hasn't done that since. but i'm praising their ability and their desire to demonstrate peacefully for change that i think they deserve. >> well those protests are the largest the country has seen in nine years. senator mccain speaking out about the disappearance of an american in iran.

suggesting the cia has not been telling the truth to congr fox news is now confirming that robert levinson was working for the cia when he went missing in 2007. despite claims by the government he was there on private business. secretary of state john kerry saying today the u.s. is still working to find levinson. we are live in our new york city with more. brian. >> reporter: hi, greg. just days after an associated press report revealed levinson was a cia agent on a mission in 2007, the leave annin son family now says the government has abandoned the search but in an interview on this week, john kerry said the u.s. is looking for any proof of life. >> the progress in the sense that we don't have him back, but to suggest that we've abandoned him or anybody has abandoned him is simply incorrect, and not

welcome back. a seattle area bus driver has been fired and now facing assault charges after a brutal beating. it was all caught on tape. the incident happened last month when the driver finished his route and tried to get a passenger who had been sleeping off the bus. >> you want the police to come and get off. you have to get off the bus, man. >> well a video captures the passenger swearing at the driver, but what happens next is shocking.

the 61-year-old driver threatens to hit the passenger with a rubber wheel stopper. moments later the passenger spits in the driver's face and at that point the driver hits the passenger with the wheel block and follows him often the bus, punching and kicking him repeatedly. the bus company said there was nothing about the driver's path that suggested he was capable of it. >> when all of us first saw the video a couple of days after the incident, we were shocked and were appalled. >> it was -- he was an unremarkable employee and there was nothing in his record that would suggest anything like this. >> as we said, the driver has been fired. the bus company said there are specific rules in place for getting sleeping passengers off a bus. the victim in this is also facing assault charges. nelson mandela, the man known to fellow south africans as their anti-apart hide hero has been laid to rest. burial took place at his home

village following a funeral befitting the beloved former president it. was a ceremony mixed with ancient tribal tradition and a celebration of mandela's extraordinary accomplishes. we have the story from south africa. >> it was a last goodbye for south africans for their late and beloved leader nelson mandela. he was laid to rest today, some 4500 people were in his village in a rural eastern area of south africa. the crowd was from all around the world. jessie jackson, oprah winfrey and activists desmond tutu who feared he might be a no-show. speakers at the four-hour long event included family members, religious leaders and including south african president jacob zuma. here is some of what he had to

oweories -- memories to remember what happened. >> and congress paul ryan is very powerful and the gop vice presidential nominee and helped negotiate this with patty murray. he looks at the long view. let's play a sound bite of paul ryan and ge to this. take a listen. >> i was part of the last presidential election. we tried defeating this president. i wish we would have. elections have consequences, mr. speaker. and i fundamentally believe, this is just my personal opinion, i know it is slightly a partisan thing to say, to do what needs to be done we're going to have to win some elections. and in the meantime let's try to make this divided government work. >> what is he saying, pat? let's not republicans, shoot ourselves in the foot again. >> let's not have the disaster we had at the beginning of october with the shutdown. because, as doug said, their

numbers went to haitis in a hand basket. but the conservatives do have one point to make is there is no deficit cutting here, no spending cutting. it is very minor. and the democrats in the senate are unhappy over unemployment, whatever. but, look, they want to get the focus off of budget and on to obamacare. but the problem is they still have no positive message. but they don't want to look totally -- >> well, john, do they need a message or sit on their hands and let democrats through obamacare melt down. >> this agreement for boehner is that it is clear the decks, we will not be the center of the story any more, we won't let these yahoos close the government down, we'll let obama and the democrats commit mass suicide with obamacare. that is what he is thinking. but by 2014, by november, the republicans are going to need to be able to answer this question.

if the democrats are thrown out, what are you going to do to fix this mess of obamacare. >> they have a lot of months to figure that out, if that happens. and let's talk about obamacare because it is really the top news story day after day because every day brings a new problem or debacle for the white house. and take a look at president's approval -- or excuse me the obamacare approval rating, 36%. this is the real clear politics average. 52% disapprove of obamacare. and let's roll to the wall street journal nbc poll on obama care. this is just the uninsured. the health care law, a good or bad idea, 34% say a good idea and 50% say it is a bad idea. >> that switched a bunch. >> it has? >> yes. it was only 34% who thought it was a bad idea a month ago, they are up to 50% now. >> here is the bottom line on the politics of it, greg.

as john was suggesting, if 36% are positive and 34% as pat suggests, say it is a good idea, that is enough as pat and i predicted three years ago, to give republicans the senate. what they have concluded and i got this from another one of my bundlers is mitch mcconnell is going to run a totally negative campaign and believe that's will take him to victory. >> john, awarded the president of the united states the lie of the year. if you like your plan, you can keep your plan. our tally so far is 5.9 million plans have been canceled and each plan has an average of three people so you are talking about 18 million people. >> with predictions up to 50 million to 100 million will be thrown off of plans coming up. >> the employee small business

plans. >> it is tactical, the republicans can sit around and watch the democrats die because of obamacare. question is will the democrats in the senate specially finally say by -- specially final by say by february, we are going to get creamed. we have to stop this. change it or fix it. >> and that is where the challenge for republicans comes. but look, this gets worse and worse all of the time. it is affecting doctors, the pricing is going through the roof. the hospitals, the security, there was no security on the data plan. >> and the young people are freaked about that. >> 22% in a poll said they will enroll but a huge majority said we are not going to have anything to do with this. >> that is -- even the uninsured are unhappy. >> and this is brand damage. they are working uphill. the problem for the democrats in the senate, when are they going to bolt and i keep arguing the

republicans have to look like, wire for reasonable things and we can make changes. >> even the mainstream media is saying to the white house and the president, you guys were living in a dream world. yesterday the white house was bragging about the fixes, well today's new york times says according to insurance companies, it is utter nonsense. this thing is just -- wreaks of problems. >> and i saw the same piece. and bottom line, the insurance companies are pushing back and saying there are even more problems with the transmission and the implementation of the plan than the white house has acknowledged. bottom line, this is a ticking time bomb. but greg, let me underscore what my colleagues have said. unless the republicans can improve their numbers, they will not get the gains they stand to get in the 2014 election. >> you only improve your numbers two ways. and the old way is like a seesaw. democrats go down and republicans go up. not happening any more. they are both down. so the only way the republicans

hardship in the middle east, this time brought on my brother nature. it is being called the worst storm in decades. this is part of the world that often goes entire winters without any snow but in the past several days a rare frigid storm has dumped up to 2 feet of snow on jerusalem and unleashing massive floods and power outages across the region. connor powell joins us from jerusalem. >> reporter: it is being called the worst winter storm in

decades. after four days of snow, sleet and ice, the middle east is just beginning the process of digging out from the storm. in israel, the slow moving storm named alexa by meteorologist jumped a foot of snow on jerusalem, forcing police to block access to the holy city. it toppled trees and left thousands without power and brought joy to children unaccustomed to the powdery flakes. the storm caused severe flooding in gaza and forced hamas to appeal to israel for assistance. gas for heating and other humanitarian aid has been rushed in. the storm, however, only brought por misery to syria where the fighting continued despite the winter weather. syrian refugees in lebanon and turkey were hit the hardest as refugees battled to stay warm and dry in hundreds of temporary camps across the regions. >> even though the storm is over, governments across the region are struggling with the cleanup and a new concern that
