states said i feel bad everyone misunderstanding what i meant when i said you can keep your plan. instead of period, i should have said you can keep your plan if it didn't change. about the doctor thing, ezekiel emanuel went on to say you can keep your doctor if you want to pay more. i'm not buying those explanations. neither are the american people. >> because had the president said it just one time, he just said it one time, then, you know, okay, maybe he misspoke the one time. but he said it a couple of dozen times. people are p.o.'d. >> some say it is 28 times in terms of some record. the american people were promised that. 82% when asked said they want to keep their health care plan, clearly that is ringing true. they are disappointed they can't keep it. they are devastated their family can't see the doctor

they are dependent on. that argument is probably the most indicative in terms of how the american people feel, why they are ticked right now. >> this is no republican saying this. this is the american people saying this. you look at the "washington post," they talk about their pinocchio of the year, it goes back to the president and him saying you can keep your doctor and keep your plan if you want to keep your plan. that is the number-one misstatement of the year. >> you've got to remember that was said many, many times up until the election. to many it looks like the president lied to get this passed. he lied regarding things to get reelected. here is ted cruz responding to that point. >> obamacare isn't working, and it was sold to the american people under false pretenses. 28 times president obama looked in the tv camera and said if you like your health insurance plan, you can keep it. period. and yet, when he did so, that was knowingly,

discussion on homosexualty which phil believes is a sin and phil was graphic in describing that view. one of the things he did, he paraphrased corinthians. he said, quote, don't be deceived. neither the adulterers, male prostitutes, homosexual offenders, the greedy, the drunkards, the slanderers, they won't inherit the kingdom of god. don't deceive yourself. it's not right. >> phil robertson has been placed on indefinite suspension by the a & e network the same day these remarks came out. if this family is anything, they are taoeufplt they are unbelieveably linked. as an extended family, they are a nuclear family. i don't know if they will stand for this. they have nine million

viewers, extremely popular. they have three books on the top ten bestseller list. they are a huge franchise being themselves. are they going to stand for phil robertson being indefinitely suspended for a magazine article? >> to your point, a lot of comments across twitter sort of point to the fact that without him everything else would go. it may be because the family is that tight. if he went on to make some other comments which we won't discuss here in terms of pre-civil rights, it's interesting the timing of this article. there are some that are questioning if the magazine found these so inflammatory and so offensive, which many find, why hang on to it for so long. why hold it and then try to sell an article in a magazine based on these comments? >> it is tough to get magazine interviews because they are desperate for people to buy it. this is gold for them. >> after this article came

arabia -- and i do expect more of the same will happen in a general policy of shutting down guantanamo bay, sending everybody back home but in small groups. these guys are committed jihaddists. they have not been shy about it. they said we have been part of that struggle and the administration decided to solve the issue of guantanamo by sending them back to their own countries. >> the guys you saw on the screen -- they have got like 25 names -- both were held at gitmo, both admitted al qaeda members, long time members of the terrorist organization, not even claiming to be reformed. we're basically saying we just want you out of here. and those are the two guys released today. the other two guys also admitted al qaeda members, found sending money up to the front lines. one guy was captured in tora bora. why now? why now is it okay to put them back in the terror fight against us? >> there are two problems here, brian. number one is that

statistics are telling us that most of the people we send to the region, including mostly to saudi arabia, have reintegrated al qaeda in one way or another either by fighting or training or being part of plot. but second, there is something very important here. these guys will serve as heroes, as recruiters. the importance of individuals have served in guantanamo and went back to the region, when we look at internet, when we look at tv in the region is crucial. we are sending back a lead jihaddist to the region at the end of the day. >> i thought since this is a war, we get them to gitmo, we put them on trial and they can get the death penalty. one of these guys said he was willing and ready to be a suicide bomber and said both of his confidantes were high ranking guys when they were alive. why weren't they tried and possibly given the death penalty for their acts against the west and against us? >> it is a question of policy. this administration has

a case proving president obama is not delivering on his promises to create a more transparent government. do you think? a federal judge just ordered the obama administration to disclose documents it wanted hidden from the public. fox news senior judicial analyst judge andrew napolitano joins us right

now. judge, the president signed this like two or three years ago and he wanted it secret because why? >> well, he didn't tell us why. he didn't tell the court why. but his lawyers said to the court he's the president and he can classify anything he wants. and for the first time in modern history, certainly since the freedom of information act became the law in the johnson administration, l.b.j., a federal judge personally and directly chastised the president by saying you're engaging in government by secrecy. that's the judge, a bill clinton appointee. by the way, the president has nod had a very good week. -- not had a very good week. this judge accused him of secrecy. a george bush appointee said the amnesty program is almost orwellian. the president has been knocked down twice by judges in d.c. this was a document having to do with trade with foreign countries. this was not military secrets. it was not national security. it was not diplomatic.

600,000 people pack in here during the month of december. it's pretty incredible for everybody who lives here. they do all decorate their own homes and they pay their power bills today, unlike the tradition in the past. but far yarn still decorates 375 trees, from 6 feet tall to 90 feet tall and they pay that power bill, all in the name of spreading holiday cheer. it's a 1.3-mile route. just an amazing sight to see. the traffic is backed up everywhere, but it's worth it n it's beautiful. the time to be there is right now. the lights are on and the streets are clear. thank you very much. >> yep. >> we love that taste of christmas town. thanks. four minutes before the top of the hour. it's the movie everyone is talking about. the implementation of obamacare, some of the fundamentals to enable him to win was going to be cheap and you can keep your doctor and plan. when it turns out you can't keep your doctor, you can't even keep your hospital. and in many case, you can't keep your plan. the president's trustworthiness has taken what seems to be a body blow and how low these numbers will go, i don't even know. >> right. the fox news poll asked is barak obama honest and trustworthy? right now, only 45% of people said yes. >> that's sad. look at that. a plurality of americans say no. 49% say the president is not trustworthy. >> it was a dead heat a short time ago. >> the same poll indicated 82% of people found it very important that they keep their health care plan. that broken promise really is broken on the backs of americans who are answering that other question. >> sure.

of course, obamacare, we've just been heading toward the application of it in many instances toward the end of the year, but as you look at all the potholes the president has hit in the last year, it's starting to add up. steven hayes details the president's troubles. >> i think it's not only the if you like your plan you can keep it, but an accumulation of the various other things we've seen of the the irs, whether it's benghazi, to a certain extent the controversy over the nsa, all of these things together in the first year of his second term. for a president who said at the very beginning of his term on the first day in office, he said, we need to restore the faith in government so that we can make the kinds of changes we need to make. that faith is gone. he's done more -- his administration has done more to erode that faith than i think certainly anybody ever imagined any of his critics even imagined. i think that's the challenge for him and it's the most difficult thing for him to recover at this point. harder for him to make a case that people should now trust him

when repeatedly have been shown they should not. >> one of the problems is a lot of people look to the disaster that it is and you aptly put it that way, brian, and why isn't anybody being held at accountable? the lead editorial in the "wall street journal" is asking why people aren't held accountable. in minnesota they've had so few people sign up. the woman in charge of instituting it in minnesota, she's been fired by the governor. the person in maryland who is in charge of the program, who is on vacation, she got fired by that governor. in hawaii, the woman left her job because the reaction has been so bad. and in oregon, at the end of november, 44 people had signed up at a cost of $6.9 million per person. it has since gotten better, but only because they're using paper

application. why hasn't anybody at the federal level been held accountable as they are at the state level? >> the president's cure all is john podesta. he's going to bring in the epa on steroids now, and he's going to go out there and try to use executive actions to get these things across. this is going to be a very intense year in politics. the only thing he did get done was the two-year budget and it was done without the president's input. passed yesterday. on a different note, there is one show that is above all others in terms of ratings right now and it's on a and e and it's "duck dynasty." we went out there, we saw the family interact and we could not believe how well they got together, how this extended family acted like a nuclear family and how america's embraced them to the tune of 9 million viewers an episode. they hit some turbulence yesterday. >> turbulence is a great way to put it. phil robertson of "duck dynasty," he was suspended by a

and e for his comments on homosexuality. he sat down and spent a day with a writer from gq and he had some interesting things to say about homosexuality. >> he said there was some controversial things he would like to say on camera. this is what he told the gq magazine. but it was prohibited by a and e. that led to a discussion about homosexuality, which phil believes is a sin. he was frank in describing that viewpoint. he also quoted corinthians by saying, quote, don't be deceived, neither the adulterers, male prostitutes, homosexual offenders, greedy, drunkards, the slanderers, they won't inherit the kingdom of god. don't deceive yourself. it's not right. gay groups were outraged, called for a and e to take action. he has been suspended now. phil has, indefinitely. >> the problem is, you're not

suspending a cast member like the partridge family, this is a real family. he's going to be suspended and his wife and sons will go on? it doesn't make any sense to me. to me, you have a chance now with that misssive, if that's okay with them, they're going to ends up blowing up the show. >> if they were to depart from him, it would be a shock, given how tight they seem to be. phil did give fox comments. my mission is to go forth and tell people about why i follow christ and what the bible teaches. and part of that teaching is that women and men are meant to be together. however, i would never treat anyone with disrespect just because they are different from me. we are all created by the almighty and like him, i love all of humanity, end quote. >> as soon as we reported that about an hour ago, the e-mail machine started lighting up. here is an e-mail from one in wisconsin. the whole family should stick together and not do this show any longer. this is a strong family unit and if phil goes, they should all

the jury ended up debating for about one hour before they convicted the two. the judge had instructed the jurors to use their common sense. the retail giant target admitting that it may have handed up to 40 million americans' credit card numbers to criminals. this after a massive data breach at thousands of target stores across the country on black friday. the secret service now investigating. >> information we're hearing in this case it sounds like the actual payment software was hacked with a piece of malware or some other kind of security breach in the credit card processing itself. that's not very common. >> if you think you were hit by this, check your accounts for unauthorized transactions and also make sure your pin number has not been changed. so many people shopping at target, especially on black friday. president obama is set to nominate max baucus as the next

tv. >> we should bring people up to speed. if you missed the story, phil robertson gave an interview to gq magazine where he talked about -- at one point he talked about the things that a and e doesn't want him to talk about on tv and he paraphrased corinthians and he said, among other things, quote, don't be deceived. neither the adulterer, the male prostitute, homosexual, offenders, greedy, drunkards, the slanderers, the swindlers, they won't inherit the kingdom of god. don't deceive yourself. it's not right. then he made frank comments about why he prefers heterosexual sex to homosexual sex and then the gay groups were up in arms, demanded a and e do something. they suspended him indefinitely. what he made clear was he believed that homosexuality was a sin and that is his belief. >> if i were the president of a and e and i was confronted by the same demand by the gay and lesbian groups to take some

action, i would have said something on the order of, his views are vile, according to many people. we don't agree. we don't endorse his views, but he has the right to have his point of view. it is his legitimacy and his frankness that makes him so appealing to people. >> he did make them in the gq interview. it would have been a different case if somebody said something like this on air in your mind? >> would it be different? i don't think so, elisabeth. i think it would have been a closer call probably. but my point is that this is who the man is. he is deeply spiritual in the sense that was traditional until relatively recently. and my fear is as a person who has embraced for my entire adult life the evolution of gay rights and same sex marriage, my fear is by victimizing or targeting people like robertson, what you do is you dilute the main message. the message of tolerance.

the message of okay, this man is misguided, but we are gradually wearing down resistance to our point of view. we're making the world more tolerant. it is intolerant to go after him for intolerance in a way that wrecks his life and maybe wrecks the show. >> if you watch housewives and kardashian, they are train wrecks that people can't get their eyes off of. this is different. this is a family which people can't get enough of. so there are people who feel like they know them. so there is 9 million watching on cable, the biggest in history! their knee jerk reaction is suspend him. >> if he was a senator, i could get it. he's not. he's a duck caller maker. >> right. >> importantly, this is also freedom of speech and freedom of religion. >> i agree. i think you hit it on the head. this is freedom of religion. it is intolerant of those who are forcing this draconian

go to nursing home and get medicaid, how do i become eligible? please get an estate planning lawyer to look at your state to see how you could do this. but just transferring your property into your children's name is not the best way to go. if one of those kids gets sued, it's an attachable asset. if it's owned free and clear. not the best way to estate plan. get a professional, look at your overallstate and they'll plan it out for you appropriately. >> so phyllis needs to talk to an estate planner. next up, jim from new jersey says: i owe $104,000 on my mortgage. should i borrow from my line of credit to pay it off or should i just pay it down 30 or $40,000 in order to reduce the interest? >> you know, i'm an old school kind of guy where if i could have my house paid off, i want to do that. but the question becomes don't get rid of your rainy day money. if, in fact, you're going to use your money that you have and then still go borrow from your line to pay it off, that's not a good idea because one of the

things we experience in the last few years of this real estate crisis is nobody had any rainy day money. people that made a lot of money blew the money. so don't go use all of your money. equity in your home is good, but if your house is paid off, what good does it do if you need money? that's why people do reverse mortgages. again, be careful. don't get rid of all your money to pay off your house. it's a personal choice. >> good advice. finally, joyce from colorado writes: bob, you have discussed living wills, endurable powers of attorney. can you talk about the difference and who i appoint to make that decision? >> steve, one of the reasons i wasn't on last week is i lost a very dear friend of 32 years and i was in a crisis situation with the family where in about five minutes, we had to make a major decision. i never realized how important this living will is until you're in that situation that. is a medical directive where you have to tell the doctors, do you want to keep these people alive by

artificial mechanical means? that's a tough decision to make. medical durable power of attorney says if i cannot make those decisions because i've become incompetent, because of medical conditions, i'm delegating that to somebody else. these are two major documents. people do them very, very freely when they go to a lawyer. make sure understand that you are asking someb loved one, your spouse, to make a major decision. understand what it means and recognize how important it is. it's very, very difficult times. >> a lot of people don't realize how big it is. bob, thank you very much for answering those questions of our viewers. >> merry christmas to everybody. loved everybody and thank you all for always being so kind to me during the year. >> you're a great asset to the "fox & friends" program. thank you very much. >> my pleasure to be part of it. >> merry christmas and happy new year to you. >> merry christmas. >> it is now 20 minutes after the top of the hour. coming in your comments on "duck dynasty." many of you agree with geraldo.

which includes public comments by their talent. that's why he's suspended. nancy said, what is phil supposed to do? lie about his beliefs in case he might offend someone? all good. but keep them coming. e-mail us. in the meantime, out to the streets of new york city, maria molina has got the day ahead in weather. >> hello. good morning. taking a look at the weather conditions outside across parts of the east, it is going to be relatively quiet and i want to take you farther west where things are not going to be quiet. we have a storm system developing across portion of the rockies and winter weather advisories are in effect. anywhere from nevada, parts of california, all the way up to parts of montana and the dakotas. we have those winter storm warnings as well. locally some spots could pick up to a foot of snow in some of the higher elevations. farther east, we have temperatures cold enough that we are going to be seeing some freezing rain starting as other as this evening. as we head home from work, be careful. keep in mind that some areas

could be a little slippery out there. otherwise high temperatures, very cold across portions of the northern plains. high temperatures only in the teens. some of the colder spots, your actual highs aren't going to make it warmer than the single digits. farther south, look at texas, in the 70s. 70s across parts of florida as well. we are going to be warming up across the east. raleigh, north carolina, middle 70s by sunday. we could reach 70 degrees right here in new york city. warming up across the east. otherwise being chilly in the upper midwest. >> i got to tell you about what happened yesterday on the basketball program. coach making headlines with his two win team. they're not winning much because he doesn't feel his players are playing hard enough. he had a rant after the loss last night. >> got a bunch of mama's boys. we got to get through that. we got to get through. i'm tired of coaching a guy and having him roll his eyes or put his head down or feel sorry for

obamacare delayed a year. but haven't republicans been pushing for this all along? we're going to ask charles krauthammer, fox news contributor and author of "things that matter," number one across the board on all the book lists. charles, what do you think about this? we have harry reid who is saying this is actually going to be a great push for democrats come 2014. nancy pelosi seems to think it will help as well. is that possible? it's not what the polls are saying from the people. >> as a republican, i would say be my guest. they're either whistling by the graveyard or pretending. it is clear the democrats in congress really are in danger, who really have a tough race, are scared to death. they're running away from obamacare. i saw today of one report, gallup report said a majority of the uninsured oppose obamacare. the whole thing was supposedly as a way to help the uninsured. this is a loser and it will get worse 'cause this isn't a matter of rhetoric or argument. it's a matter of fact.

as it begins to unfold next year, a number of americans who are going to be upset by this, infuriated by this will grow and there is nowhere for democrats to hide. >> why isn't it ringing true? listen to what nancy pelosi thinks. she's not backing down, charles. >> i don't think you can tell what will happen next year, but i will tell you this, democrats stand tall and support of affordable care act. this is an issue that has to be dealt with. but it doesn't mean it's a political issue, so we're going to run away from it. no. it's too valuable for the american people. >> your reaction to that? is she just not seeing it or is she so set on a mission. >> she sees it. she understands it. she hears it from her own members. she doesn't want to break with the president now before the year even begins and be shown to have jumped off the sinking ship. but it's clear they know it's going on. this is a pretense they're going to have to maintain probably

until midsummer, at which point everybody is going to run for their lives and the democrats individually in their races are going to run away from this as hard as they can. >> things that matter, by the way, is an outstanding book. clearly everybody thinks so. i want to mention something that matters to the american people. we saw a new fox poll that asks how important is it to choose your doctor? 82% of americans in that poll said it was important for them to be able to choose their doctor. a promise that was made to them, a promise broken. do you think possibly that that will be made better by this administration going forward? >> there is no way it can do that. the reason that people are losing their doctors is because insurers have been commanded, they have been mandated to expand coverage to give a lot of freebies to take in people with preexisting conditions so their costs are much higher. the only way to reduce the cost

is to limit the number of doctors and hospitals and drugs a patient is able to access, which means there is no way around this. so as people discover they're losing their plans or even if they keep their plans, they're losing their doctors. in new hampshire, people in the northern part of the state are going to have to drive two hours past two of the best hospitals 'cause nobody will be covered -- the two hospitals are left out of the plan of the only insurer who will do obamacare in the state. people will see this, it's completely illogical and it really hurts them. if you have a doctor you've been with, half the medicine is a matter of trust and reassurance. that depends on the relationship with the patient. and the doctor. you don't have that, you don't have anything. >> sure. a doctor who knows your family's health, knows your child's health, what medicines work. we talked to patients with ms who takes you a decade to really

get a system down and they can't maintain that? >> and if you break the relationship, it introduces huge inefficient cities into the system. obamacare was sold, among other ideas, as something that would increase efficiency, would make the system work and reduce, as they would say, to bend the cost curve down. you don't have to see a new doctor every time who has to learn your history, learn your drugs, learn everything about you, you've increased inefficientcys, which is what obamacare is doing. >> doesn't seem like anyone would get better on that plan. time runs out. >> this is a huge experiment. obama has decided and the democrats decided in 2009 and 2010 for a huge experiment on one sixth of the american economy. there is no way anybody in america is left out of this experiment. instead of attack the problems i had vidly, attack the issue of the uninsured, they decided to use the issue of the uninsured as a way to revolutionize all of

impossible. what goes through your mind? >> it proves that there is nothing new under the sun. this idea was actually an idea proposed by militant freedman, one of the great conservative economy mists 40 years ago. he called it the negative income tax. i remember it because when i was in college on the debate team, that was our topic for the whole year. the negative income tax. the idea is you abolish all other forms of welfare, so you got a big pot of money. and all you do, you make it real simple. everybody files income tax if you're under a certain level of the government will pay you. conservatives looked at that and ultimately abandoned it. it probably was the only bad idea that milton ever had in his life. i'm not surprised that liberals are adopting it now. >> so within that plan, once you got a job and started making some money, that money that

money would be phased out? >> exactly. it creates essentially a really high marginal tax, a disincentive against work 'cause in the absence of work, the government sends you a check. so if you start to work, you actually are losing the money that's coming in. in the end, it was an idea abandoned. it's so simple that it actually -- it has the attractiveness of being simple, but of course, all simple ideas usually end up being as silly as they are simple. >> it sounds generous enough, but nearly impossible. but also long-term, wouldn't it just deincentivize the idea that working makes you feel good, earning something is great for esteem, you're creating your own life? >> that's true. the problem is that all the other current ideas and forms of supporting the poor also is creating a disincentive. welfare, food stamps, all of that. it's always a balance.

you want to make sure nobody lives in destitution. on the other hand, the minute you pile on the benefits, you create a society of dependency. that's really the case. in europe, you have a long-term chronic people who are unemployed chronically. that is because of the -- they don't have a safety net. what they have is an entitlement state. when you have that, you really have a disincentive. that, i think, is the reason that our system is a more dynamic and a more successful one, because we have a safety net which means you help the helpless, but you don't create a system so generous that nobody works. >> a government big enough to give you everything could then, what, take it away? >> it can take it away or lulls you into being incensible. >> charles krauthammer. i love our time with you. thank you so much. things that matter, no wonder everybody is buying that book. breaking news, everybody,

joins us from the new york stock exchange. what's it all mean, nicole? >> this is all on the heels of the fed tapering. but we did see a gain there of 10,379,000. this is going to fluctuate because of the holidays. it's good to take a look at the four-week average. that rose by 13,000 to 343 and 500,000. so the point is that is the low -- below the 360,000 motorcycle, which is still good news. overall, the labor market continues to improve, though this week was not great. >> all right. what about target? we understand that target might have had a whole bunch of credit card numbers floating around. >> oh, my goodness. this story, when i woke up and i heard this story, i really was baffled. i can't believe what's going on. target was hit by an extensive crime ring country for credit card and debit card data. this began over the busy black friday shopping holiday right through december 15th.
