suspending phil robertson. and this is our question of the day on facebook. thank you for sharing your time today. here's shep. >> bad news from mark suckerberg. facebook is facing a big-time lawsuit. what it could mean to you? >> good afternoon to you and yours, first, from the fox news deck at 3:00. facebook and dozens of banks must face a lawsuit from investors who claim the company misled them ahead of its initial public offering. that's the new ruling from a federal judge in new york city. facebook went public at $38 a share last year. the founder, mark zuckerberg rang the bell.

let's look over here. here is the stock, writ was, the all-time low right here. you can see where it started. if you stayed, maybe added, you're doing all right because it has rebounded and yesterday hit an all-time high of $56. the investors behind the lawsuit accuse facebook of failing to disclose information showing that the growing popularity of mobile devices might hurt its ad sales. a representative from facebook says the lawsuit lacks merit. which banks are involved here? >> we're talking about goldman so i was, more began stanley. they have been named along with a lot of big names. >> lot of people invested. i invested. >> there's a law where you can

sue for damages so there's an opportunity there, and if you're stick a stockholder and you believe you've been undercut because of the low price, you can sue for damages as well. so there's a couple of ways to do it. if you're a previous owner or current owner. >> if you're a current owner and kept it from the beginning you're well in the green. >> today actually facebook took a big step in its life as a public company. has secondary shares for sale. 70 million totaling $4 billion. they're going to put the money back into the company and try to grow it more. so good news on that front, but the lawsuit -- they're not able to settle. they have to pursue it. >> like it? >> it's easy to like when it's at the all-time high. >> a blind man who survived a fall in front of a subway train will get to keep the hero dog that tried to safe his life. we have pictures of the man with his dog, orlando.

for a while it looked like the opener might have to geoff up -- give up the animal he calls his best buddy. now he doesn't have to give up the dog thank to very generous strangers. orlando's owner fainted in a subway stakes in new york city. fell on to the cracks and into the tracks between them, and the train rolled his way. his guide dog stayed life, jumped down on to those subway tracks, witnesses say the dog, orlando, barked and licked his owner to wake him up. that's what he thought he was trying to do. the train passed right over both of them. but they got into a trench between the rails and survived. when the news came out here locally, it became known that the 11-year-old animal was about to retire as a guide dog. they have to retire, and that meant the agency that provided this dog would no longer pay for his car. the metropolitan couldn't afford it. they're best friends.

>> well, you know, i was online, eating my breakfast sandwich, trolling through the news, and i saw the same thing you did. i read that orlando was the hero, and that they were going to break up this dynamic duo between cecil and orlando, and it's christmastime, and i didn't think that was fair, especially when i read that he would love to keep the dog but couldn't afford it. well, i'm the ceo of blue star transportation, and i don't make a lot of money but i do believe in philanthropy and i believe the christmas spirit still lives, and i said, not under my watch. i would make sure that dog can spend the rest of his life as a dog, instead of a working dog, and i contacted the agency, and

dramatic video of passengers taking down a gunman on a bus in seattle. look at this. you can see a masked man walk right up to another command point a gun in his face. the victim and other passengers fought back. isn't always the best idea. trace gallagher has the news. this guy robbed a number of people. right? >> he kept walking up to people with this gun, a semi-automatic, sticking it in their face and demanded a cell phone. when he got to this one guy, he would have none of it. pushed the gun away and ran after the guy. other people started to flee including children and a woman on crutches. three other passengers jumped in to help the guy. they started punching him. put him to ground, even tried to tie him up until police got there.

police said the subject was to agitated when they got him in the patrol car, he started kicking out the windows, kicked down the barrier when the cop and the suspect. nobody injured in all of this, amazingly, but a lot of fire power in a small condensed area with a whole lot of people around there. happened a little over a month ago in seattle. video just being released. in new jersey, the manhunt is still on as fox reports this hour, where the two guys who police say shot and killed a man at an upscale shopping mall while his wife watched. and we're now learning of a major jump in the number of carjackings in that area. the shooting happened on sunday, at short hills mall in essex county, new jersey, suburbs of new york. police say two men shot and killed the husband in the mall's parking lot during a carjacking. the car turned up the next day in the town of newark, not far

away, and anticrime group, along with the mall and donors, are offering a 41,000 tuesday reward for tips leading to arrest and conviction in this case. according to the essex county prosecutor's office, that county had roughly hundred carjackings in the year 2009. over the years that number has more than doubled, and the prosecutors' office reports 450 carjackings have taken place so far this year. for some perspective, that's 200 or so fewer than the city of detroit, where police say carjackings are, quote, almost a way of life. steven roger is if was, a former undercover detective. this is essex county, right next door is union county. those two counties used to have a joint task force that was disbanded in 2009-2010 and now they're relying o on another task force. >> one thing for sure, the essex county prosecutor's office and

the sheriff's department working very hard. we're not hearing about what they're prevent, but bus of budget cuts the manpower has been cut, equipment has been custom they need to help every municipality to shore up what they have to combat the problem. >> they have a particularly challenging set of circumstances. this sort of thing is happening over the country. local budgets are getting cut and these sorts of things are cut. the federal government, the fbi does not provide statistics because they don't break out carjackings, but we looked at different -- >> may i add, help could come from the courts. right now 10 to 30 years. you need to make sure these people are going to prison or get the death penalty. 30 years mandatory. death penalty for a killing. you need to take the sentencing out of the hands of the judges and make it mandatory. you really need to let these people know they commits this type of crime, they're going away or they're going to face death. >> what happened in this case

was, he was going steal the vehicle, and from everything we learned, he was just completely -- this was -- he just shot him in the head with if wife standing there. hard to talk about. >> unspeakable. this individual, the victim, probably went to save his wife's live. he let his wife in the car. went to his car, and these unspeakable individuals shot him in the head. so this poor fella saved his wife's life. it was heroic deed. but saying that there are certain mechanisms people can do. >> i was going to ask you. people shopping at night, you have the packages, full holiday christmas spirit, and you can become a victim easy. >> i shared with people over the years, shep, situational awareness is very important. look at your surround, park in an area and walk in an area where there's a big crowd, a lit area. you never know when someone is

going to strike but you can minimize a crime of opportunity and that's what this was. don't be afraid to call a guard or police officer in the mall and say, walk me to my car. we know -- we really have an instinct, a sixth sense, if something is not right. don't be afraid to ask somebody to walk with you. >> don't be a tough guy. you're never as tough as the bad guy with the gun. >> if you're lone and know one is in the car, give them the keys and let them talk off. this for fellow saved his wife's life. >> they had a very high-crime area, poor, high-crime area, next to this upscale mall -- >> i've been to that mall. but prosecutor's office, sheriff's department, police, they're doing the best they could with the resources they have. they're doing a darn good job.

away. you can see the attackers walking around with knives and a meat cleaver in hand moments after they killed lee rigby, soldier who was walking back to heir barracks. you're not seeing the time they rammed her in their car, then attacked him, trying to cult off his head. this is when the police shot one of the attackers after one pointed an unloaded gun as an officer. the killers said they were trying to provoke the police to shoot them so they could die as martyrs. they described the attack as a military operation. waiting to find a soldier because between us we decided that the soldier is the most -- >> today, lee rigby's family looked distraught as a police

officer read a statement on their wave. >> this has been the toughest time of our life. no one should have to go what we have been through as family. we're satisfied that justice has been done. but unfortunately, no amount of justice will bring lee back. >> the next step is sentencing and the judge says that will happen next year. >> what are the guidelines for the sevens? >> britain does not have the death penalty. so, in this case, a life sentence in prison is the most severe punishment that may come out. during the trial the older defendant told the court he admired al qaeda. prosecutors will press the court to rule the murder was motivated by terrorism. one law expert says this would increase the likelihood of life sentence. >> allows more aggravating circumstances to be entered into the record, way to push for life in -- inprisonment.

>> today the prime minister says that this really highlights the need to address extremism and violence. >> thank you very much. breaking news. there are 26 senators now who are breaking ranks with the president over penalties against iran over its nuclear program. the new iran punishment introduced in the senate moments ago. jay carney is speaking live now. just said as lea was talking, does not believe the senate's punishment against iran should or will be enacted. the white house has urged congress not to move forward with any new punishment because it could affect the administration's push to get a nuclear deal with iran. ed henry just asked carney about it. listen. >> democratic chairman of the senate foreign relations committee disagrees.

gives the president credit for the current sanctions brought iran to the table but says, a credible threat of future sanctions will require iran to cooperate. hough is he wrong? >> we don't think this action is necessary. we don't think it will be enacted. if it were the president would veto it. the fact of the matter is, this is not a debate about being for or against sanctions. there's no president in the history of this conflict with iran who has been more aggressive in pursuing and enacting and building international consensus around sanctions then barack obama, and he has done that not to take credit for the construction of a sanctions regime but in order to test the theory that a comprehensive sanctions regime would compel iran to change its behavior and come to the negotiating table and give us, the united states and our

partners, the opportunity to explore whether we can resolve this conflict diplomatically -- >> that's the white house. seconds ago a group of ten democratic senators, all leaders of newscast committees, came out in opposition to the senate bill. what the house is saying, you want to put new punishments on iran. now is not the time. and if you vote this -- if you pass this in the senate and it makes its way to the president, the president will veto it. he feels he has a diplomatic route to follow and the sanctions have worked with everyone coming together. now it's time for the diplomacy the sanctions allowed and if you can get a deal with iran it would be a best-case scenario. clearly some senators disagree. we'll keep watching this story. >> one of the biggest retail north america the nation is reporting we could have the largest security breach ever.

more headlines. at least nine people were hurt after a taxi crashed into a bus and sent it straight into a building in newark, new jersey. engineers reportedly say the building was already in bad shape and could now be in danger of collapsing. the european space agency launched a satellite that scientist say will map out a billion stars over five years.

the italians, love them but sometimes the decision -- prison officials give two days of freedom to a serial killer who already escaped six times. may not believe this but he didn't come back. officials are warning this killer is armed and dangerous. this happened in genoa, italy, where officials let the serial kill it out on, quote, good

behavior, unquote. maybe he hadn't killed anyone lately. he was going to visit his aging mother. instead the cops say the carjacked a man at gunpoint and there's been no sign of him since. he was in prison for stoning to death a hooker. he later escaped and killed two more people so they let him out to visit his mother. >> thieves have managed to access nearly 040 million credit and debit accounts from shoppers over more than three weeks, including black friday. everything since black friday, according to target. this is one of the largest security breaches in history. target is urging customers to check and recheck card statements for anything suspicious. target reports the stolen data includes customer names, credit card and debit card numbers, including expiration dates and in many cases the three or four digit security codes.

the company released a statement today that reads in part: we have moved to swiftly address this issue. no guest -- so guests can shop with confidence. we regret any ien convenience this may cause. the company is asking shoppers to alert credit card companies s and call the target number on the screen, but we have been calling that number and it doesn't work, and customers have been complaining about it all over facebook and twitter. officials say as soon as they became aware of the data breach they contacted authorities. we're live in chicago this afternoon. hi, garrett. >> that magnetic strip on the back of credit and debit cards contains all of that personal information, and for nearly three weeks, between november 27th and december 15th, these thieves were able to which collect that

personal information heartshoppers checked out. that personal information they collect, criminals can steal identities, creating counterfeit credit cards and potentially'm withdraw cash from theatm. target is not saying how the breach occurred. the secret service is also investigating. for one who shopped at that time target between november 27th november 27th and december 15th, target is, as you said, asking people to keep a close eye on their bank accounts to look for any suspicious activity, but cyber security experts say that those problems can extend for a much longer period. >> the consumer needs to understand the fact that the data is out there could lead to things later down the line.

you look at their facebook page, they put something up. there's 700 comments right now in response to what they posted. you don't see target responding. >> well, sometimes the pr does not work perfectly and it seems like it's not working perfectly for target. 40 million people. how does this happen? >> it happened with magnetic strips on the back of the card. and there's some experts that say you can go over now to microchips but that's more expensive technology so unfortunately the magnet strips weren't secure and it was a perfectly planned launch attack on black friday, when people were swiping. >> if you shopped online, you're not affected because you enter it into a different database. how can they get the readout from every target scanner in the nation. >> this is highly targeted, very calculated, something we haven't seen of this magnitude. had to do with the magnetic

strip. >> you should always pay with cash. if you use credit cards, just have to check your statement because if you didn't make the charge -- you have to find it. >> you have to pro-actively look for it. go through everything in your checking account, or use cash and swipe carefully. >> if you don't know something on your bill, it's $5, ask them, because if they take $5 from everybody they win. we don't need that. >> we're waiting for the senate to vote on a multibillion dollar bill to fund a crucial part of the government next year, but several items on the bill have lawmakers up in arms. we'll go to washington to see what they're doing to us today. that's coming right up. honestno way did i think a tablet was gonna be a good deal.

breaking news now on fox news channel. let's go to number just across the river from new york city. courtesy of wnyw. there's been a horrible bus crash. this video feed when -- the bus was full, on route 3 on pay passaic avenue. the bus was full, hit the median. several people were hurt but we don't have a number. there's a lot of traffic difficulties, and i think at some point this bus -- the chopper will pull out and you can see this bus. it is a mangled mess. it looks like to authorities and us that this bus hit a divider, the median divider in a high-traffic area. you can get on and off the highway without the offramps so it's not single access or whatever. but it looks like it hit the immediate yap, and though i can't see the bus right now because of what the chopper is doing, the bus is in bad shape. we are also getting breaking news out of london, and this

would appear to be extremely serious. authorities in london, england, are saying that fire engines are on scene at a london theater -- the apollo theater in london. they believe a balcony has collapsed during a performance. keep in mind, it's 15 minutes before 9:00 at night in london, theater time. and our sister network is on it. >> hello, just saying -- in row q, halfway through the first half of the performance, sound effects and noise in it already, but a huge crack happened, a banging sound, which for a split second everybody thought was something to do with the performance, and then my whole view of the stage was obscured by a huge cloud of thick, gray dust.

i was underneath the upper -- the balcony, so i sheltered myself, and anyone from rows -- in the circle would have been showered in this debris. when that happened, i -- my girlfriend and everybody sitting in the theater, after that split second of realization, i got up and ran to the door in a panic, and since then i've been standing outside, watching people now all over the road and the foyer, receiving treatment for head injuries. i asked one of the firemen, one of the senior firemen here, four fire engines -- whether he knew if there were any serious injuries inside. he said he didn't know yet, but with that amount of masonry falling from a height, he says it would be unlikely if there

weren't. a lot of people have blood on their faces, covered in dust. the program was popular with children and families, and they're outside initially, and then went home, and in tears and pretty distraught. >> simon, thank you very much for the story. tell us about the moment when you were able to leave the theater. in so much as you just witnessed what you had, was the ability to get out fairly orderly or some degree of panic? >> it was screaming. i was quite close to the exit, and the access to the theater was also close to the access on to the streets so i was out probably in five seconds. a couple other people said

they -- anyone under the dust couldn't see. it was completely obscured. huge theater, masonry that must have fallen because the whole view forward was dark gray, instant, and -- >> you're sitting in row q, that at the back? so you're protected,. >> i was second row from the back, so, yes, very much under the protection of the upper circle, thank god. so anyone in my area just saw this cloud of dust -- more than a cloud. a -- dust falling , and then debris, and a woman who was receiving treatment in the foyer, said a large piece of plasterwork had fallen on her head and shatted.

by our parent company, they have been the able to get thunder choppers there. it was an 8:00 p.m. performance at the apollo theater there. it was a children and family show, a holiday type outing, i'm told, and the theater was packed with people on a thursday night, and what happened was, from all the report wes have been able to get, the balcony collapsed. let me show you the tweets from people who were in the theater. lobby filled with head injuries, it says here. jesus was watching. curious incident at apollo theater when the ceiling collapses on audience ten minutes ago, chaos, she says, this one, i was in the audience. i'm fine but serious injuries i fear. so there's some conflicting reports whether it was the balcony that collapsed or the ceiling above, or maybe some combination of the two. at sky news they're working to get a chopper over the scene, which is in the heart of central

people inside is -- >> the capacity is 775. they have 775 seats across four levels at the apollo theater. right in london's west end. the auditorium is on four levels, 480 of the estates -- seats -- it's named for the greek god of the arts and designed and built as a venue for musical entertainment, first opened its doors in february of 1901. today there has been a collapse. exactly what kind we do not know. but from the tweets and information we have been getting on the news deck from people who were inside, people there believe there are some serious head injuries. again, it's nighttime. the authorities have made their way. their helicopters have not made their way above, and we don't have any ground crews on scene.

as you know in any major city in europe or north america, this time of year, with christmas time approaching, streets are clogged under the best of circumstances, and during theater time, of course, when this happened, the streets are very small around it as well. so getting to the scene is proving to be difficult for news crews. it's my understanding authorities are there, and sky news is scrolling through the tweets, pictures coming -- some are stack photos and some from people on the ground, and their ticker at the bottom of the katrina gives you an idea what they're facing. police say there are a number of casualties and a rescue operation is taking place after part of a balcony in the apollo theater in london collapsed. there are varying report weather the ceiling collapsed as well. you know that the first utterances, the first thing you hear from people at these things, are often contradictory

and frankly often wrong, and the psychologists tell us the reason is you're in a perfectly normal moment in a theater before christmas, watching a children's show, and suddenly the extraordinary happens and it messes were you mind and you can't remember what happened. so, was it the ceiling, the balcony? london authorities tell us it was the balcony which collapsedful people were seated below and it there's where a number of head injuries occurred. let's listen in to more. >> i can say that the fire brigade here is struggling and trying to get a couple of people out at this time. but i think a very -- >> have you been able to help people inside your restaurant? >> yes, we did. we had a few people come in -- well, about six people, and they

police have been mobilized there in some numbers. and we're hearing now -- it may seem obvious but it was head injuries you were seeing, was it? >> yes. >> what sort of head injuries did they have? >> have -- couldn't see what it was but blood out of the head and people with their shoulder, so there was really in pain, some of them. we tried to get the ambulance people inside of the restaurant and they helped them out. >> you were able to pass these people on to paramedics? >> yes. but i manage to get the paramedic, the first one to come in to the scene, and pointed out these people inside the restaurant. i'm looking now at a couple of young boys and his mother
