it is saturday, the 21st of december, 2013. i'm anna kooiman. we have a fox news alert for you. overnight, suspects nabbed a big break in that deadly malakar jacking. four men have just been arrested in connection with with the gunning down of this man in front of his wife last sunday. we have the details straight ahead. >> and that "duck dynasty" double standard. new information about how far a&e went to silence phil robertson before the show even premiered. stay tuned for that unfolding story. >> and they fought for their country, but now two new jersey police officers say they are fighting for their jobs because of that. why they claim they are

being punished for serving in the military. it's "fox & friends" on a saturday morning that starts right now. ♪ hi, everybody, this is owe he olivia, production assistant with "fox & friends." have a merry christmas. >> hi olivia. >> merry christmas messages from our crew. >> thank you, olivia. so our viewers can see what a cheerful studio it is. >> it is. >> good morning anna kooiman. >> how are you doing. >> i didn't mean to interrupt that right there. >> it was a moment, yes, it was. >> we do have a fox news alert we have got to get to. breaking overnight four men arrested in connection with to a deadly carjacking at upscale new jersey mall. 30-year-old dustin freeland was shot and killed in front of his wife six days ago as the two had finished up christmas shopping and returning to their car. two men took off in the couple's range rover which was found the next day 10 miles away. details on the arrest have not yet been released.

a press conference is scheduled for 9:00 a.m. eastern this morning. charges will likely be reduced against the off duty police officer and nine other bikers charged in the road rage beating of an suv driver. prosecutors say they are going to drop the first degree gang assault charges because the victim's injuries are not permanent. instead, officials say the bikers will likely face attempted assault charges, which carries a maximum sentence of 15 years in prison instead of 25. and just about an hour nasa astronauts will conduct a risky emergency space walk. they are trying to fix a crippled cooling system on the international space station. they will be the ones doing the spacewalk. a second is planned for monday. if all isn't fixed by then, they will conduct a third on christmas day. the empire state build something getting into the christmas spirit.

problems going on. transition from big time icing into very heavy rain and into severe weather. can you see that pink around parts of oklahoma. we have already had pushing three quarters of an inch of ice accumulating on the roads, on the trees, on everything around the oklahoma city area. really dangerous travel conditions this morning. then you see that extending all the way up across parts of northern new york and parts of new england. that's going to be the in connection with place that this storm aims. right now we he have winter storm warnings in effect for snow and nice storm warning across much of oklahoma. snow heavy as well. 5 to 8 inches where you see he that pinch line from kansas city and quad cities and in towards milwaukee. ice storm warnings across our northern areas of the northeast. that means anything to the south of that it's going to be warming up so much we are going to see a lot of snow melt and big flooding concerns. this is what happens this afternoon. you see a lot of area of rain. you see the snow on the back side of it you see these temperatures incredibly warm. 60's and 70s all up and down the eastern seaboard. record breaking warmth will

where he admitted one reporter asked is his biggest mistake over the past year. >> the fact is it didn't happen in the first month. first six weeks in a way that was at all acceptable. since i'm in charge, obviously, we screwed it up. >> well, the president made big promises in 2014, including improvements to his sweeping healthcare law. the site continues to show major weaknesses. overnight it was freezing for issues. folks only have two more days to sign up before monday's deadline. that being said, the about the did defend his record saying millions of americans will have better insurance than ever before. he went on to say 2014 will be a, year, quote year of action. job creation, as well as expanded background checks for gun purchases. the president also says he will be reviewing the nsa surveillance program over the holiday break and will make a, quote: pretty definitive statement next, next month about possible

reform to the program. we have to wait and see. tucker, anna, mike, back to you guys. >> thanks a lot, elizabeth. >> well, the "duck dynasty" story continues to unfold. here is the latest. it turns out that a&e, the network that airs the show which i think is the biggest unscripted show in the history of television knew long ahead of time that phil robertson was a sincere christian and held these views. the show premiered in 2012. they had warned phil not to speak out about his views. so it's not like this was a surprise to a&e. >> apparently there was some youtube video of him standing in front of a congregation basically saying some very strong views, similar to what we heard published in the gq article about gays and condemnation and he got a standing ovation for it. it was on youtube which we all know. i mean, you you can see youtube, apparently they did warn him ahead of time. we are also warning this morning that a&e felt that they could not let him continue to be on the show. of course, this is just a

hiatus that has not been said how long it could be. they couldn't let him to be on the show because he was disrespecting gays by those comments that he made. gays that work for a&e. they didn't want to disrespect their own employees. >> his comments when he gave them to gq. first of all he is doing an interview with gq. magazine grooming, full beard and all of that. that was unusual. it can't be a shock to a&e that he may have mentioned this. they knew those were his views. >> a lot of times in these times of entertainment contracts there are moral clauses in there where you can't say something to shame the network and embarrass them. he had been warned by them to make these comments and then he made them. you can also see where they are coming from. >> if they are that outraged, maybe they could take the show off the air. i think they have another season in the can already. >> biggest show on cable. they are in this for the money, of course. they are going to do whatever makes them the most money. they have the right to fire any of their employees as

far as i'm concerned for any reason. they are the employer. on the other hand, you have to wonder about the people who have demanded his firing. you know, these gay groups are for being gay. they think that's right. phil robertson is against being gay. okay. why can't they live in the same country? why is it people that people who have a different view need to be crushed. >> always the same case, fire, fire, fire people. just don't watch it just don't watch it. >> apparently glaad receiving major backlash for. this all the time i have worked at glaad, we have never received the kind of phone calls and emails we are receiving now. people are upset with them. >> comments they are getting are comments about people who believe the same thing phil robertson believes against the condemnation for gays for living their lifestyle and also people who are upset about limiting his freedom of speech. you know, he has the freedom of speech to say these things, a&e also has their freedom, you know, let the marketplace determine.

>> yeah. >> determine to let him go if they choose to do that. >> if a&e feels like is he hurting their brand, then let him go. but apparently they don't think the brand enough to take the show off the air. >> because they have no principles. >> well, also, the show is more popular now during this controversy than ever before. >> see their facebook page, 1.6 million likes. wal-mart is selling out of "duck dynasty" stuff. >> i think there are important philosophical questions though at the heart of this. harvey levin who runs tmz who is gay had this to say about the controversy. pretty interesting. take a listen. this country was founded on freedom of religion. i mean, that's one of the reaps we broke from england. and it just seems to me that you have to tolerate things, even things that are abhorrent as long as they are not hurting other people. the irony here is you have got groups like glaad saying we are pushing tolerance you have to accept us just

because we are different doesn't mean that you shouldn't embrace well, can you make the same argument about this guy. and if you are going to accept tolerance on one side, you have got to accept it on the other. it just seems to me as long as he is not hurting me or other people and is he not propagating, you know, doing bad things to people, i don't see how you can punish him for how he feels. especially when you knew how he felt going in. >> that seems a totally fair point. i thought it was all about tolerance, respecting people, at least leaving others alone even if they have views that you think are weird or even repugnant. everybody is entitled to a view. and you shouldn't live in a country where you are not allowed to express your sincere view. especially one rooted in religious faith? come on. >> it should be tolerance respected on both sides. >> the only thing i was hoping out of the controversy was all reality shows would be cancelled. no, we are still going to have the kardashians and "duck dynasty."

to shrink as well. what is this current president doing to make it widen? >> well, you know, where the income gap is most pronounced is washington, d.c. where incomes are dramatically higher than the nation as a whole. housing prices have been booming while the rest of america was struggling. why is that? because this administration, the obama administration has been about stimulating government. and washington is where all the politicians and bureaucrats and lobbyists live. meanwhile, the rest of america has had a very tough time as you pointed out. but this is just changing the subject as you said at the top of the segment, away from the failings of obamacare. this is the president, i think, who is afraid of becoming the myspace of 2014. he just may not be cool anymore. talking to his base and that's unfortunate because his policies have not only been bad for america as a whole but they have been particularly bad for his base, for those voters that

have been most loyal to him, for instance, latinos have done terribly. 36% youth unemployment among african-americans. literally nothing you can can point to that this president has done for his core and most loyal supporters, never mind the rest of the country. so when we talk about income inequality, it's very pronounced there. >> let's talk about that gap between the rich and the poor, you have to do this pretty quickly here. you have got about 30 seconds. is there any way the government can help enthat shrink, the gap? >> first of all whether you have massive federal deficits that the federal reserve is using a trillion dollars a year of money out of thin air to help finance, that is very bad because that drives down interest rates and makes the stock market the only alternative for getting any return, so all of the rich people with stocks do incredibly well under that scenario. they have done very well with president obama. what you have got to do is encourage companies to hire more people, that means not scaring them from hiring. it's a big risk to hire

people whether you have a healthcare program that adds costs and a lot of uncertainty. whether you have a massive debt. we need a balanced budget amendment to create certainty. no law passed by congress is going to restrain spending. any future congress can break those caps and that's always happened. if we have a balanced budget amendment we will create certainty around the world, to world financial markets. businesses will know they won't be looking at further taxes and debasement of the dollar. that creates stability and predictability and the confidence that you have to have to invest and take the risk hiring people. >> you are making way too much sense. >> don't demonize wal-mart and people that hire. encourage them. tell them they are doing something good. >> appreciate you being here on this saturday morning. >> you are welcome. >> next up on the rundown here. there is no such thing as a free lunch with one congressman. he set off a firestorm saying kids should sweep the floor of the school before they get their free lunch. he joins us next. that should be interesting. truck is still missing.

♪ ♪ >> welcome back, quick headlines for you. transit trouble in new jersey. frightening. train carrying 800 people gets stuck in a tunnel. disabled train pulled back about an hour after sitting on the tracks. transit officials believe a power outage caused the train to get stuck. senate majority leader harry reid is cleared to head back to work after being sent to the hospital for exhaustion. the nevada democrat said he didn't feel well. harry reid pushed the senate through marathon sessions all week long to clear that budget legislation and then the massive defense bill and key presidential nominations but for him is he going to go back to work.

day life and your job. and i believe kids of all social, economic levels could benefit from having chores inside the house, outside the house, there are actually many schools already that do have some community service requirements in order to graduate. it effects all the kids. it builds better citizens. and it creates the work ethic for the next generation. and it's a sad thing that in america you can't even talk about things like this anymore without this kind of, you know, i gotcha, okay. we have got a tracker after you, we will put this on the news and make political hay out of it this was a public meeting on a saturday morning. not a statement of policy. it wasn't even a speech. it was a discussion. >> so the huffington post and other left leaning bloggers all of them are rich, want to send you the way of phil robertson. they basically concede we have a problem with the work ethic in america because they are espousing immigration reform because there are jobs americans won't do. is there a problem with

americans work ethic? how blunt do you want to be about that? is there? >> tucker, i think that there is. i think that kids from affluent families as well as kids from less affluent families can learn from some of the basics. again, when i ask the question, how many of you when you were 14 or 15 years old had a job in which you learned something that you still apply, if you ask that question to people who are 40 years old or so, nearly 100% of the hands go up. because people say oh, yes. i'm a father of four. i had my kids cleaning the garage, cleaning their rooms, helping do the dishes, and i think they are better young adults because of it. so, to me, we need to be talking about how do we instill the work ethic in the next generation? and i think that conversation is one that's desperately needed in america. >> certainly we don't want to breed an entitlement nation. kids learn a lot of things, even when they are at camp and it doesn't matter how are, if you are behaving, misbehaving if you make this much money or that much

that today starts to get longer? you get little more sunlight every day which feels great. this is the official start of winter. it feels like it's been winter for a long time. for the last month we have been dealing with a lot of winter weather. that officially, i guess, begins today. winter solstice. there is going to be a lot of ice across the central plains. possibly up to a half inch. likely see half an inch across areas of oklahoma. right along that interstate 44 area. just to the north of it in across areas of missouri. clinton, up towards columbia. in towards illinois. there is another side of this storm of the ice storm and it's across areas far to the north. we are going to be looking at a major ice storm across new england and way upstate new york up towards that charge up your guys if you can good chance you will not have power for long to do that. winter storm warnings in across much of illinois,

to our active and retired military. and i think it reflects not only a lack of veterans in congress. but, if you look at the leadership in the house, both republican and democrat, the nine top people in the house, have a combined eight months of military service. the leaders much the budget committee that produced this document, no military service. >> that's a great point. you know what the percentage is in congress? >> it's about 20%. which is historic low. even though there are some iraq and afghanistan veterans in the congress now. very few were directly involved in this he process. and it shows there was no one to speak up and say this is wrong. this is cruel. the american people aren't going to accept this. >> we do need a budget. >> absolutely. this is really the perspective that the veterans community has come from. i work for the veterans of foreign wars. we represent 1.5 million veterans. we are part of a larger coalition that advocates on veterans benefits. we want to see a budget deal. but the problem is we can't advocate balancing the budget on the backs of our veterans especially military retirees who gave entire career of military service. >> speak to that, it's true we do need a budget. should the military, should the vets be off limits when

jonna spilbore and segal. good morning, thanks for being with us. this happened in parker county, texas. give me a breakdown of what happened. >> the police had a tip they had been watching a meth house for 30 days. they had a tip from an informant that they were fixing to cook meth inside. that's what the informant said. so they went into the house without a warrant. came out, detansd everybody. then asked for a warrant. got a warrant. went in. and the conviction resulted. and the defendant said because he went in without a warrant, you should have thrown out all the evidence and the court disagreed. and what you read was the dissent from that decision. >> right. and this is what a sitting judge has to say. only after unlawfully entering and finding suspicious activity that they felt the need to then secure the warrant and order to cover the tracks and collect the evidence without the taint of their entry. so is this just a way to get this evidence nitted even though it seems like there may have been police misconduct there. >> you know, i disagree with

the dissent here. they are being a little misleading. this wasn't really an action that was based on a prediction of a future crime because, when the police got into the location. there was a meth lab set up. there is a meth lab. that in and of itself is a crime. number one, number two, i don't know a whole lot about cooking meth. i do know that people can be blown up in the process. there is very big risk. if you have to make a choice. have you been investigating for 30 days. you are a cop. you have got make a choice. do we go in without a warrant or knock on the judge's door in the middle of the night and get one and go in. the independent source rule is an pensioned to the warrant rule which says, basically, if you would have gotten it -- the evidence anyway, even though you originally got it illegally, it can be used against you. that's what this is based on. >> what if they had been monitoring this home for 30 months. waltz in there and making christmas cookies and didn't find anything. >> in this case the

the time. i have a pretty good credit card service. wait a minute, that doesn't seem like mike is buying stuff. we should all have that right? >> yeah no, question. even separate from this breach we should all have that. it makes it very convenient. if you didn't spend the money you know it i shut the card down fraud. >> if can you prove it's fraud, the banks normally will give you the money back. >> yeah, particularly with a credit card it's very easy to shut that down. with a debit card, that links directly to your bank account so if you were using a debit card at target, that's something that you would -- i would probably consider canceling because that goes right into your bank. >> i guess the same question right back at you then. so if i was in a target between black friday and the 15th of this month, wouldn't it make sense to just go ahead and cancel the credit card? >> you know, mike, i think it is. i cancelled mine. i was in target. we shop at target all the time. i think because a lot of times these criminals let the numbers lay dormant poor six months or a year. we don't each know that there is going to be fraud. so rather than do guesswork,

be preventative. don't be paranoid about it go out and cancel the card. >> when i i swipe the card, what information is on that little strip on the back? >> the information is your name, your account number, and and the cvv code which is different from the code sometimes on the front of the card. it's enough in some cases that you can make a duplicate. a replica card that they can go out and spend on just like they are you. >> but my social security number wouldn't be on there. so how easily could they steal my identity? >> you know, for true identity theft with the social security number, your credit are r. they probably think. target says they don't think social security numbers were involved. these stories evolve over time. sometimes we find there is more data breached and than we started with. wait to be seen if this is true identity theft. >> do you think target

credit information was stolen, could that make their credit score go down? >> >> you know, absolutely. if somebody goes out and uses credited and you don't catch it for 30 or 60 days and they are spending on your credit card, it can effect it. so, my recommendation is, you know, freeze your credit. you do a security freeze to expeerian, equifax and transunion. you protect that credit. by the way, you should do that anyway independent of this breach. >> i want to do what you do, john, how do you protect yourself on a daily basis? >> you know, on a daily basis, i make sure i'm watching my wealth. i'm watching it with the account alert. i freeze what i can. you know, one thing in the holidays that i do when i'm done with the shopping system, i cancel my card anyway. i have used it so much online. i have used it in person. and when you cancel it, it's a little bit of inconvenience but suddenly it's not sitting in all of those databases to be breached over and over again like we see every month.

of other things. the president is ready to disappear to hawaii. it's going to be forgotten. let's see if they are similarly tough when they come back the first of the year. >> the white house announced another exemption to obama care. people who lost their insurance because of obama care won't be bound by the individual mandate for a while. they are changing this law on the fly. what are the politics of that. does that work? do people think that's okay or don't they? >> this is the 12th such change. remember, they are using a provision that said if you're under 30 or if you have an extreme hardship, you're allowed to buy a catastrophic policy for the coming year. what's the hardship here? that you're subject to the affordable care act. to me this is an extraordinary admission by the administration. to handle the problems by the people who lost their coverage as a result of the affordable care act, the exchanges don't work. they are unaffordable, they are unattractive. all their earlier efforts to
