a press conference is scheduled for 9:00 a.m. eastern this morning. charges will likely be reduced against the off duty police officer and nine other bikers charged in the road rage beating of an suv driver. prosecutors say they are going to drop the first degree gang assault charges because the victim's injuries are not permanent. instead, officials say the bikers will likely face attempted assault charges, which carries a maximum sentence of 15 years in prison instead of 25. and just about an hour nasa astronauts will conduct a risky emergency space walk. they are trying to fix a crippled cooling system on the international space station. they will be the ones doing the spacewalk. a second is planned for monday. if all isn't fixed by then, they will conduct a third on christmas day. the empire state build something getting into the christmas spirit.

problems going on. transition from big time icing into very heavy rain and into severe weather. can you see that pink around parts of oklahoma. we have already had pushing three quarters of an inch of ice accumulating on the roads, on the trees, on everything around the oklahoma city area. really dangerous travel conditions this morning. then you see that extending all the way up across parts of northern new york and parts of new england. that's going to be the in connection with place that this storm aims. right now we he have winter storm warnings in effect for snow and nice storm warning across much of oklahoma. snow heavy as well. 5 to 8 inches where you see he that pinch line from kansas city and quad cities and in towards milwaukee. ice storm warnings across our northern areas of the northeast. that means anything to the south of that it's going to be warming up so much we are going to see a lot of snow melt and big flooding concerns. this is what happens this afternoon. you see a lot of area of rain. you see the snow on the back side of it you see these temperatures incredibly warm. 60's and 70s all up and down the eastern seaboard. record breaking warmth will

reform to the program. we have to wait and see. tucker, anna, mike, back to you guys. >> thanks a lot, elizabeth. >> well, the "duck dynasty" story continues to unfold. here is the latest. it turns out that a&e, the network that airs the show which i think is the biggest unscripted show in the history of television knew long ahead of time that phil robertson was a sincere christian and held these views. the show premiered in 2012. they had warned phil not to speak out about his views. so it's not like this was a surprise to a&e. >> apparently there was some youtube video of him standing in front of a congregation basically saying some very strong views, similar to what we heard published in the gq article about gays and condemnation and he got a standing ovation for it. it was on youtube which we all know. i mean, you you can see youtube, apparently they did warn him ahead of time. we are also warning this morning that a&e felt that they could not let him continue to be on the show. of course, this is just a

hiatus that has not been said how long it could be. they couldn't let him to be on the show because he was disrespecting gays by those comments that he made. gays that work for a&e. they didn't want to disrespect their own employees. >> his comments when he gave them to gq. first of all he is doing an interview with gq. magazine grooming, full beard and all of that. that was unusual. it can't be a shock to a&e that he may have mentioned this. they knew those were his views. >> a lot of times in these times of entertainment contracts there are moral clauses in there where you can't say something to shame the network and embarrass them. he had been warned by them to make these comments and then he made them. you can also see where they are coming from. >> if they are that outraged, maybe they could take the show off the air. i think they have another season in the can already. >> biggest show on cable. they are in this for the money, of course. they are going to do whatever makes them the most money. they have the right to fire any of their employees as

have been most loyal to him, for instance, latinos have done terribly. 36% youth unemployment among african-americans. literally nothing you can can point to that this president has done for his core and most loyal supporters, never mind the rest of the country. so when we talk about income inequality, it's very pronounced there. >> let's talk about that gap between the rich and the poor, you have to do this pretty quickly here. you have got about 30 seconds. is there any way the government can help enthat shrink, the gap? >> first of all whether you have massive federal deficits that the federal reserve is using a trillion dollars a year of money out of thin air to help finance, that is very bad because that drives down interest rates and makes the stock market the only alternative for getting any return, so all of the rich people with stocks do incredibly well under that scenario. they have done very well with president obama. what you have got to do is encourage companies to hire more people, that means not scaring them from hiring. it's a big risk to hire

americans work ethic? how blunt do you want to be about that? is there? >> tucker, i think that there is. i think that kids from affluent families as well as kids from less affluent families can learn from some of the basics. again, when i ask the question, how many of you when you were 14 or 15 years old had a job in which you learned something that you still apply, if you ask that question to people who are 40 years old or so, nearly 100% of the hands go up. because people say oh, yes. i'm a father of four. i had my kids cleaning the garage, cleaning their rooms, helping do the dishes, and i think they are better young adults because of it. so, to me, we need to be talking about how do we instill the work ethic in the next generation? and i think that conversation is one that's desperately needed in america. >> certainly we don't want to breed an entitlement nation. kids learn a lot of things, even when they are at camp and it doesn't matter how are, if you are behaving, misbehaving if you make this much money or that much

to our active and retired military. and i think it reflects not only a lack of veterans in congress. but, if you look at the leadership in the house, both republican and democrat, the nine top people in the house, have a combined eight months of military service. the leaders much the budget committee that produced this document, no military service. >> that's a great point. you know what the percentage is in congress? >> it's about 20%. which is historic low. even though there are some iraq and afghanistan veterans in the congress now. very few were directly involved in this he process. and it shows there was no one to speak up and say this is wrong. this is cruel. the american people aren't going to accept this. >> we do need a budget. >> absolutely. this is really the perspective that the veterans community has come from. i work for the veterans of foreign wars. we represent 1.5 million veterans. we are part of a larger coalition that advocates on veterans benefits. we want to see a budget deal. but the problem is we can't advocate balancing the budget on the backs of our veterans especially military retirees who gave entire career of military service. >> speak to that, it's true we do need a budget. should the military, should the vets be off limits when

it comes to cuts? >> they sacrifice so much. spending time away from family. being willing to lay down their life in protection of our free press documents and liberties. putting on pause educational enhancement opportunities. any cut at all is significant. it's not some argue this is not a big cut it is a big cut because they sacrifice so much. >> why is it always the vets. >> no lobby for veteran. no prolific group of veterans that help get members of congress elected. military personnel and veterans are use offed to gritting their teeth and taking everything that comes at them. in this case that ask to their detriment. >> i think you might be right there is no lobby we do have organized veterans community. vfw and the american legion are out there. what we can bring is votes. what happened this week is the vfw grass roots membership. we generated tens of thousands of messages to

congress. we received one call from an oklahoma congressman who said how can i make the phone calls stop? that's the voice that we have. the military is used to doing a mission overseas. we don't ask questions. we follow orders. >> that's a big group of people. there are a lot of vets in this country. you do have power. >> the area that i live that vat largest veterans population the entire state of new york. one of the highest in the country. we have to participate. and really hold our elected officials accountable when they don't represent us. >> why do you think the lawmakers do get away with this? >> i don't think they are going to get away. active duty assistance back in march. outcry is so loud they fixed that and make that right. i'm hopeful they can make this right. >> are you hopeful? >> i am. i think we have seen the outrage come. where i am on the eastern long island, which is i represent a state senate district and the first congressional district where i'm running, you know, veterans are speaking up. it's not only the veteran who served. but family and friends. >> anybody who has been protected by folks like you.

>> thank you, mike. new report out will have you wondering which side of the law the department of homeland security is working for. a federal judge has accused the agency of hand delivering smuggled children to their illegal immigrant parents right here in the united states. some evidence it actually happens. joining us with more on this is michael cutler retired special agent with the u.s. immigration and naturalization service. mr. cutler, thanks a lot for joining us. >> thanks for covering this. >> well, it's a remarkable story. so as i understand it, the department of homeland security tasked with keeping us safe has knowingly and illegally delivered children to their legal immigrant parents in this country. >> that's absolutely correct. that's why i have called dhs the department of homeland surrender. this is so outrageous if you look at the law section 1324, harboring, shielding, transporting, aiding, abetting, inducing and encouraging are all felonies. aren't they doing all the above? >> well, but this also

encourages human smuggling, right? >> but it encourages human smuggling and encourages more illegal aliens to come here. we had a problem with junk driving what did we do? we lowered the acceptable blood alcohol levels and imposed severe sanctions against drunk drivers. here you are giving more inducements and incentives for people to run the border. let's remember we have immigration laws for two primary purposes to mecket measure lives and protect the jobs of american workers. how in the world does having immigration hand deliver illegal alien children to the illegal alien parent and not act against the illegal alien parent, how does that the not create more incentives for more people to come here in violation of our borders and laws? >> the white house has no incentive to reduce illegal immigration. because it benefits their donors, the finance people, obviously, and it also delivers potential new voters to them in the future. here is what u.s. district judge andrew hannahan said about. this the dhs policy is as logical as taking illegal

drugs or weapons it has seized from smugglers and delivering them to the criminals who initially solicited illegal importation and expoor station. legally this situation is no different. it's got to be legal what they are doing. how can they keep doing it? >> totally. why isn't anybody charged on the alien side with endangering the welfare of those kids? you put a kid in the car and don't put the safety belt on the kid, you are going to be arrested for endangering the child. handing over a child to the cartels, i don't know of a more pernicious bunch of thugs in the world next to the terrorists than the mexican drug cartels. so they know that the cartels are bringing these kids here. what could possibly go wrong, right? i mean, there is nothing about this story that makes sense, but it seems to follow the strategy of this administration of abro gating responsibility. look at the dream program. >> not just not enforcing the law working against the laws. >> look what they did with the dream act. 9/11 commission report encarnanze we do with

jonna spilbore and segal. good morning, thanks for being with us. this happened in parker county, texas. give me a breakdown of what happened. >> the police had a tip they had been watching a meth house for 30 days. they had a tip from an informant that they were fixing to cook meth inside. that's what the informant said. so they went into the house without a warrant. came out, detansd everybody. then asked for a warrant. got a warrant. went in. and the conviction resulted. and the defendant said because he went in without a warrant, you should have thrown out all the evidence and the court disagreed. and what you read was the dissent from that decision. >> right. and this is what a sitting judge has to say. only after unlawfully entering and finding suspicious activity that they felt the need to then secure the warrant and order to cover the tracks and collect the evidence without the taint of their entry. so is this just a way to get this evidence nitted even though it seems like there may have been police misconduct there. >> you know, i disagree with

the dissent here. they are being a little misleading. this wasn't really an action that was based on a prediction of a future crime because, when the police got into the location. there was a meth lab set up. there is a meth lab. that in and of itself is a crime. number one, number two, i don't know a whole lot about cooking meth. i do know that people can be blown up in the process. there is very big risk. if you have to make a choice. have you been investigating for 30 days. you are a cop. you have got make a choice. do we go in without a warrant or knock on the judge's door in the middle of the night and get one and go in. the independent source rule is an pensioned to the warrant rule which says, basically, if you would have gotten it -- the evidence anyway, even though you originally got it illegally, it can be used against you. that's what this is based on. >> what if they had been monitoring this home for 30 months. waltz in there and making christmas cookies and didn't find anything. >> in this case the

dissenting judge didn't believe the police. that's the problem here. there was a supreme court case that allowed. this texas has a more restrictive rule against making exceptions to the search warrant requirement. but, in this case the judge just didn't believe the cops. he said you could have gotten a warrant. you could have asked for a warrant. they ended up getting a warrant at 1:auto 50 in the morning. they could have easily tried to get the warrant before walking. in and they waited four hours between the tip and the raid. and then another two hours before getting the warrant at 2:00 in the morning. he just doesn't believe the cops and he said if you had found christmas cookies and no meth, you wouldn't have bothered. >> we wouldn't have been here. they busted a meth lab good for them. >> philip and jonah, thank you so much for your time. it is a sliply slope. you think what that could mean rights as a citizen. >> 7:56 now and a fox news alert for you. there are reports that a u.s. military aircraft has been shot at in sudan wounding three of our service members. we have the breaking details coming up. don't miss it and, a&e pushing phil robertson out

bears. how nice? mike, over to you. >> target is trying to make good this weekend. offering its 10% employee discount to shoppers following that massive breach of its customers' credit card, debit card information. and if you are run one of the 40 million people to have their credit card information stolen between black friday and december 15th. i'm sure you have some questions. going to get answers for you right now. let's talk to privacy and security expert john celio. john good to have you here. >> good to be back. >> i will tell you i almost get the feeling i need to check my credit card information on any other credit card web site every day. >> yeah, i think right now that's probably a great idea to monitor it. the other thing to make it easier, you can set up online accounts alerts with those credit card -- those different credit cards so you automatically are alerted any time there is activity on that card. >> that happens to me all

the time. i have a pretty good credit card service. wait a minute, that doesn't seem like mike is buying stuff. we should all have that right? >> yeah no, question. even separate from this breach we should all have that. it makes it very convenient. if you didn't spend the money you know it i shut the card down fraud. >> if can you prove it's fraud, the banks normally will give you the money back. >> yeah, particularly with a credit card it's very easy to shut that down. with a debit card, that links directly to your bank account so if you were using a debit card at target, that's something that you would -- i would probably consider canceling because that goes right into your bank. >> i guess the same question right back at you then. so if i was in a target between black friday and the 15th of this month, wouldn't it make sense to just go ahead and cancel the credit card? >> you know, mike, i think it is. i cancelled mine. i was in target. we shop at target all the time. i think because a lot of times these criminals let the numbers lay dormant poor six months or a year. we don't each know that there is going to be fraud. so rather than do guesswork,

be preventative. don't be paranoid about it go out and cancel the card. >> when i i swipe the card, what information is on that little strip on the back? >> the information is your name, your account number, and and the cvv code which is different from the code sometimes on the front of the card. it's enough in some cases that you can make a duplicate. a replica card that they can go out and spend on just like they are you. >> but my social security number wouldn't be on there. so how easily could they steal my identity? >> you know, for true identity theft with the social security number, your credit are r. they probably think. target says they don't think social security numbers were involved. these stories evolve over time. sometimes we find there is more data breached and than we started with. wait to be seen if this is true identity theft. >> do you think target

credit information was stolen, could that make their credit score go down? >> >> you know, absolutely. if somebody goes out and uses credited and you don't catch it for 30 or 60 days and they are spending on your credit card, it can effect it. so, my recommendation is, you know, freeze your credit. you do a security freeze to expeerian, equifax and transunion. you protect that credit. by the way, you should do that anyway independent of this breach. >> i want to do what you do, john, how do you protect yourself on a daily basis? >> you know, on a daily basis, i make sure i'm watching my wealth. i'm watching it with the account alert. i freeze what i can. you know, one thing in the holidays that i do when i'm done with the shopping system, i cancel my card anyway. i have used it so much online. i have used it in person. and when you cancel it, it's a little bit of inconvenience but suddenly it's not sitting in all of those databases to be breached over and over again like we see every month.

from shaming the network with comments or embarrassing them in any way or format. the other thing is, phil robertson was seen on youtube, too. that's out there for everybody to see. basically saying these types of beliefs in front of a church crowd and getting a standing ovation for it. it was online. they had seen that, too. this is a reality show. now he is getting punished for being real. >> let's get perspective here. a&e is calling its advocates for the lgbt community. all of a sudden they are political activists. they have been moved to this position by glaad which claims falsely to represent all guys and lesbians. if you say something we don't agree with, you ought to be punished. this is the opposite of tolerance. >> there was an interesting take by harvey levin, the guy with that tmz show.

he's an attorney, he's guy and he made these comments. see if you agree with him. >> this country was founded on freedom of religion. that's one of the reasons we broke from england. it just seems to me that you have to tolerate things, even things that are abhorrent as long as they are not hurting other impeachment the irony here, i've got groups like glaad saying we are pushing tolerance. accept us because, just because we're different doesn't mean you shouldn't embrace us. you could make the same argument about this guy. if you're going to accept tolerance on one side, accept it on the other. it seems to me as long as he's not hurting me or other people and he's not propagating doing bad things to people, i don't see how you can punish him for how he feels, especially when you knew going in. >> phil robertson, when you think of what he said, never called for anyone at glaad to be

aren't allowed, it's certain kind of views aren't allowed. the least popular group among the people who run television networks or evangelical christians. >> the only thing in more danger than a mallard duck is an evangelical christian saying something based on his or her belief of the testament. the simple thing is to say what phil said expressed what phil believes. phil is an american and he is free to say that. it doesn't express what the management of a&e believes and the end of it. >> phil has the right to say it if he wants to and the right to pull the plug. the robertsons have the right to walk away, too. if they do, i don't think it will take long for another network to pick them up and start making a lot of money. >> if you don't like his

of other things. the president is ready to disappear to hawaii. it's going to be forgotten. let's see if they are similarly tough when they come back the first of the year. >> the white house announced another exemption to obama care. people who lost their insurance because of obama care won't be bound by the individual mandate for a while. they are changing this law on the fly. what are the politics of that. does that work? do people think that's okay or don't they? >> this is the 12th such change. remember, they are using a provision that said if you're under 30 or if you have an extreme hardship, you're allowed to buy a catastrophic policy for the coming year. what's the hardship here? that you're subject to the affordable care act. to me this is an extraordinary admission by the administration. to handle the problems by the people who lost their coverage as a result of the affordable care act, the exchanges don't work. they are unaffordable, they are unattractive. all their earlier efforts to
