good morning, everybody. it's sunday, december 29th. i'm julia huddy. back to blaming the video. just when you thought this story was long figured out, "the new york times" dropped the benghazi bombshell claiming once again that an antiislam video sparked the attack that killed four americans. this morning members of congress are debunking those claims. >> again. and a massive man hunt goes nationwide. authorities on the hunt for the mississippi cop killer who tried to rob a bank overnight. a major break through overnight. we'll reveal the details. did you ever play in the

streets? one florida community making it a crime. >> i was hit repeatedly. >> now it makes a lot of sense. "fox & friends" begins right now. go play in traffic. come on. i was dodging all the cars. it was a blast. >> julia huddy is here. mike from philadelphia. >> thank you, sir. >> thank you for having me on your couch. >> i cleaned it up. >> there is a little fuzz. >> we do our best. >> we have a jam packed show for you because if you were busy on your saturday afternoon and you didn't realize what happened, "the new york times" has tropdrd a bit of a bombshell. it's part of a book "the new york times" is publishing. they released a number of chapters online and it details some conflicting reports from things we hadn't necessarily heard in the past.

>> a guy by the name of david kirkpatrick is writing a book. he released the first six chapters. if you want some publicity for your boom, drop a bombshell. he did. we're blaming the video once again. >> yeah. this is pretty shocking. this piece suggests that we, i.e.,, americans over in benghazi, were thinking that we were getting loyalty by the locals by giving them aid and really there's no loyalty over there. we're having a difficult time discerning who our friends are, who our allies are and maybe one day a friend is a friend, the next day they're an ally -- the next day they're opposition to us, but it suggests that the attack was part of some sort of organized venture that didn't have anything to do with al qaeda but the locals, one powerful leader there named ak med katalla. >> basically the big argument that al qaeda was involved.

another big part of this book being released online is that the film sparked and fueled the attack, that that youtube video in part sparked and fueled the attack and that the group was led by a group of islamist militia men. >> not al qaeda. that had an attack in their mind, saw the video and that sparked them to go ahead and make this attack. it's all the stuff that's been debunked over and over and over again. >> right. "the new york times" said we spent months interviewing folks in libya and asking them repeatedly. what was the motivation. >> anonymous sources. >> here we go again. >> when you compare that to what we know from, for instance, the senate house intelligence committee or the house intelligence committee, mike rogers who has access to classified information and who has since debunk the all of this. listen to what might rogers said in november of this year. listen. >> i will tell you this by

witness testimony and a year and a half of interviewing everyone that was on the ground, by the way, either by an fbi investigator or the committee, it was very clear to the individuals on the ground that this was an al qaeda led event and they had pretty fairly descriptive events early on that led those folks on the ground doing the fighting to the conclusion this was a pre-planned, organized terrorist event, not a video. i mean, that whole part was debunked time and time again. >> remember when susan rice went on the sunday talk shows. she was just on "60 minutes" this last week and leslie stall asked her, do you regret having gone out and done that because you might have been secretary of state had you not gone on those five sunday talk shows and talked about how this was a spontaneous attack as a result of those youtube videos. >> she said that was the information that they had at that moment. >> right. we now know that's not the case. greg hicks who is the second in command at the time under

ambassador stevens who of course was tragically killed, when gregory hicks heard susan rice, this was his response. >> when ambassador stevens talked to you perhaps minutes before he died, as a dying declaration, what precisely did he say to you? >> he said, greg, we're under attack. >> would a highly decorated career diplomat have told you or washington had there been a demonstration outside his facility that day? >> yes, sir, he would have. >> did he mention one word about a protest or a demonstration? >> no, sir, he did not. >> so fast forward, mr. hicks, to the sunday talk shows and ambassador susan rice. she blamed this attack on a video. in fact, she did it five different times. what was your reaction to that? >> i was stunned. my jaw dropped and i was

embarrassed. >> gregory hicks took over for chris after he was killed. a man who was on the ground, not an anonymous source. >> i want to read you a couple of lines from this piece. surveillance appears to have been underway 12 hours before the assault started. then it goes on to say, angry video motivated the initial attack. looters were the ones who ravaged the compound. none of these people have anything to do with al qaeda according to "the new york times" report. these are locals who happen to be bad guys that we had some ties to. again, there's one mastermind that apparently, according to this article, the local american officials knew about and he was somebody that we suspected of being a big problem. >> this is a massive piece to go through. you can dice it a lot of ways. we're just presenting the facts. we're going to hear from colonel

schaeffer. he said this absolutely was al qaeda related and there were extremists. this flies in the face of everything we're seeing and reporting this morning from "the new york times." we'll have much more on that coming up in a short while. >> let's get to some other headlines. we start with a fox news alert. brand new owbama caobamacare nu. $1.1 million mark after a december surge. this number is only partial because the administration didn't provide an update on the 14 states running their own websites. this just days from what could be the biggest test for obamacare yet. the law swings into effect january 1st. another fox news it looks like the nationwide man hunt for a cop killer is over. the fbi says the man matching the description of the suspect tried to rob a bank in phoenix yesterday morning and was killed by police there. they're still waiting to make an official i.d. to confirm it's

the same man we talked about yesterday who killed a police officer and wounded another in a bank robbery in mississippi. try, try again. right now a third ice breaker. we talked about this yesterday. closing in on a stuck ship in the ant arctic sea. the australian ice breaker, the latest hope for the 74 scientists, tourists and crew on board the russian research ship which became stuck on christmas day. if this ice breaker can't make it through as others have not been able to, passengers may have to be air lifted off the ship by helicopter. "the new york times" releasing a bombshell benghazi report. it is our top story this morning. they claim there's no link between the attack and al qaeda, but doesn't their report contradict most of our intelligence on that raid itself? >> well, that's for sure. let's ask lieutenant colonel tony schaeffer.

thank you for joining us. >> thank you. >> what is your initial reaction to this bombshell? >> it's insane. let me be clear for your audience to understand the complete insane nature of what's being said here. when you go into k-mart and you buy something, a lot of things in that store is branded sears because sears is the parent organization. that's like k-mart to sears. sharia is k-mart. that's rebranded al qaeda. you can no get past that if you're a serious expert studying this. >> what about the video portion of this? >> there's no basis for that, clayton. everybody's looked at this. let me tell you. i've been in the region. i was in egypt. you don't have that level of access to social media necessary to spawn that level of response for a quote, unquote, protest. plus, this protest started at night. you don't have protests at

night. let me be clear on this, too. i spent several hours with the chief of egyptian intelligence, and i asked him directly the question, was al qaeda involved in the attack on the benghazi embassy consulate? he said absolutely. he went through and i can't go through all the details, but the chief of egyptian intelligence said flat out this was an al qaeda attack. who are you going to believe, the chief of the egyptian intelligence or "the new york times"? >> one of the pieces that this "new york times" makes is that you can't trust anybody. they bring up a person they call him the central figure in the attack, a malcontent eccentric. what can you tell us about this guy and the possibility that he was in charge or a ring leader in some way, shape or form? >> he was i'm sure a malcontent. i'm sure he was involved. but the guy that the fbi are after, juliet, are actually al qaeda guys. there's two guys in particular

that were -- are directly linked. they are al qaeda. who essentially planned and led the event. let's remember the key points here, you had 200 trucks mobilized to go do the attack. you had mortars. this is one thing they've glossed over so far in the article, i'm not sure what will come in the book. the mortar attack to the annex was precise. they put four rounds on to a target that the best u.s. marine corps mortarman would love to have. this was not spontaneous. this guy was but one of the rebel who was part of the organization but it was clearly al qaeda led and executed. >> i guess that's your headline in reaction to this "new york times" piece. when they say random militia. you say not random at all, they were al qaeda? >> right. right. shari is rebranded al qaeda. let's be very clear on this. the whole region is controlled by radicals. tripoli is controlled by al qaeda according to egyptian

intelligence. this is funded by outside organizations. the south of libya is complete chaos. so when you look at the big picture here, it's very clear if you trace back the this rearead. you know this, a classified cable which is alluded to in this piece, that there was reporting saying that the embassy is concerned about al qaeda but the piece basically says, ah, there's nothing to worry about really because it was just all chaos. let's be very clear. chaos was organized in such a way to cause maximum mayhem to our embassy that day so i don't buy this whole it just happened one day. >> colonel, could you buy this, that this -- these al qaeda members, albeit they say that they're a random militia, were planning something and then when they saw the video they said, let's go do it now? >> two things, problems with that. first, seeing the video is a problem. this is not, you know, somewhere

in the middle of missouri where you can go tune in to youtube. it's tough to get these things. secondly, how do you get it out there? again, looking at his own time line, it didn't have time to go viral in a third world country. then, third, i think most compelling is that the organization that was needed to launch a concerted attack -- >> right. >> -- this was an organized effort with people coming in wave after wave with mortars. so this was not a -- >> they're referred to as looters and arsonists according to the "new york times" piece. >> there was a track record, too, tony, with the british consulate attack. >> right. the by the british consulate shut down because they had two attacks earlier in the year. one of the little known things the british left all the weapons with us in the annex. with that said, again, these so-called rabble knew where to go to attack the annex, where to go to get the weapons. you don't do that if you're a crowd looking for something to do late at night.

responsibility. >> new information coming in on a story about a soldier shot and killed during an attempted robbery. a 14-year-old boy is under arrest. >> he doesn't even understand how he's impacted our family. he doesn't understand how he's impacted our community. it's so large. >> police say the boy will be charged with murder and armed robbery. his name is not being released because of his age. still trying to figure out if anybody else is involved. a new physical requirement, physical fitness requirement for female marines are being pushed back. right now women are not required to do pullups during boot camp but new rules would require them or have required them to do three, the minimum requirement for males, however, top brass reportedly saying most women in boot camp can't do three and if the requirement was put in place, it could hurt recruitment. the deadline has been delayed

there. the thing that's more onerous about this regulation is it's pretty expensive. they're talking about $24 million as you said in the first year alone and the problem here is that a lot of vending machine operators are small business owners. 3/4 of them have fewer than three employees that operate these businesses. it's not a terribly onerous regulation, right? everyone likes the idea of having information, but at the same time we're talking about reducing obesity rates or calories by a couple of tick tacks and at the same time costing over 10,000 small business owners thousands of dollars every year. that's i think problematic. >> another side bar, a lot of nutritionists says counting calories doesn't help you lose weight as much. >> as we have seen up in new york city that had mandatory menu labeling put on its books a number of years ago, the consumers who try to already eat healthy and don't need to lose weight take advantage of it, or at least they say they do.

those that need to lose weight glance over it. what has come out of new york city and frankly what has come out of our experience with nutrition information more generally is that you can lead a horse to water but you can't force him to diet. that is to say that although we give consumers information, we don't actually force them to take advantage of it and what really kind of scares me is that a lot of the folks pushing for these kinds of regulations recognize that information alone isn't enough to convince people to lose weight or eat fewer calories. what they're trying to do is push us one step further down the road to put mandatory labeling like eating funions is the equivalent of smoking tobacco. you're not taking advantage of the information we give you we need to start putting labels, warning labels. start banning it just like mayor bloomberg up in new york city. you know, unfortunately, the government is an atrocious vehicle for trying to convince people to lose weight because it ultimately undermines the idea of personal responsibility.

extreme weather center. >> oh. >> you were right. >> terrible. >> blast you. >> dogs running. >> yeah. >> janice, thank you so much. back to our top story this morning. following this "new york times" story. they dropped quite a bombshell yesterday when they released on their website six chapters of a brand-new book that david kirkpatrick has written about benghazi and the attacks wherein where he says we went to benghazi, spent months and months interviewing people on the ground. here are the three big take aways from their reporting. we'll parse all of this. part one is that there was no evidence at all that al qaeda was involved in the attack. this is what the "new york times" says. >> they also go on to say that an anti-islam film, remember that film, the infamous video that susan rice talked about, didn't talk about, that was what sparked and fueled the attack and the attack was led by a group of islamist militia men. it's very interesting because this article points out, these

little clips or chapters that they have picked out, they talk about a fuller accounting of the attack but they're talking about sources. we don't have any official sources. "new york times" piece focuses so he intently on al qaeda that they were failing to watch what was really going on with the local terrorists and local militias. >> we were talking to colonel schaffer, he says, this is an al qaeda group. >> yeah, they're rebranded as al qaeda. these are the same claims that we're hearing again. it's like deja aeja vu all over again. what we heard ambassador susan rice talk about and the next day and members of congress are sitting there saying, wait a second, this is not right. this was not sparked by some youtube video. here's mike rogers. this november saying that these theories have been debunked time

and time again. listen to mike rogers who has access, by the way, to information and secret sources that an intelligence reports that people like reporters on the ground in benghazi do not have. listen. >> i will tell you this by witness testimony and a year and a half of interviewing everyone that was on the ground by the way, either by an fbi investigator or the committee, it was very clear to the individuals on the ground that this was an al qaeda led event and they had pretty fairly descriptive events early on that led those folks on the ground doing the fighting to the conclusion this was a pre-planned organized terrorist event, not a video. i mean, that whole part was debunked time and time again. >> and how about greg hicks. remember him? he's number two in benghazi. he was there at the time of the attack. >> yeah. >> and remember what he said when he heard susan rice on the

five sunday morning talk shows. you'll remember this. his jaw dropped. >> when ambassador stevens talked to you perhaps minutes before he died, as a dying declaration what precisely did he say to you? >> he said, greg, we're under attack. >> would a highly decorated career diplomat have told you or washington had there been a demonstration outside his facility that day? >> yes, sir, he would have. >> did he mention one word about a protest or a demonstration? >> no, sir, he did not. >> so fast forward, mr. hicks, to the sunday talk shows and ambassador susan rice. she blamed this attack on a video. in fact, she did it five different times. what was your reaction to that? >> i was stunned. my jaw dropped. and i was embarrassed. >> "the new york times" piece

also goes on to say that there was surveillance 12 hours before the attack but that the people that were involved with their surveillance may not have been involved with actually coming out and attacking the consulate there, that these were arsonists and looters that got caught up in the chaotic event. it is striking. let's listen to lieutenant colonel tony schaffer, we had him on a few minutes ago. >> it speaks directly to what you were talking about. if it was arsonists and looters throwing molotov cocktails at a building, they wouldn't have been as precise and planned. >> and as organized. >> listen. >> let's remember the key points here. you had 2 oof trucks mobilized to go do the attack. you had mortars. this is one thing that they've completely glossed over in the article. the mortar attacks done to the annex was precise. they put four rounds on to a target that the best u.s. marine

corps mortarman would love to have. so this was not spontaneous and this guy was but one of the rabble who was part of the organization but it was clearly al qaeda led and executed. this is not, you know, somewhere in the middle of missouri where you can go tune in to youtube. it's tough to get these secondly, how do you get it out there? if you look at the time line, it didn't have time to go viral in a third world country. third, i think most compelling, is that the organization that was needed to launch a concerted attack, this was an organized effort with people coming in wave after wave with mortars. so, again, this was not a rabble. >> who are you going to believe? colonel schaffer, mike rogers, gregory hicks, or anonymous sources and, again, it's anonymous sources from "the new york times." >> it doesn't seem reasonable that it's an upswell of violence that could create this havoc. >> there were so many sign posts

along the way. we had the british consulate attack. >> when he got back from egypt and he spoke to the head of the intelligence in egypt who said it was al qaeda. everything they had on their books was pointing to al qaeda. >> i thought it was interesting what colonel schaffer said earlier in the morning, let's say the video didn't even exist. this little group that he says is a part of al qaeda was going to attack, video or not. >> again, just to sell a book. "the new york times" releases six chapters to drum up support. >> would you buy a book on the stuff we've been reporting that's hum drum. no, you have to have something that's salacious. >> it's focusing on al qaeda and not the local groups and militants and militias that can cause problems for our troops

welcome back, everybody. president barack obama has already spent nine of the 17 gays of his yearly christmas vacation in his home state of hawaii. conservatives, some, are criticizing him for taking off at a critical time when his signature health care law is just two days away from officially taking effect. is that criticism fair? joining us right now to weigh in on this, fox news contributor guy benson. guy, good to have you here. >> great to be here. >> every president takes a holiday, a vacation. maybe not 17 days. is this criticism at this critical time with the health care law going into effect in 48 hours, is it fair? >> well, i think there are cautionary tales on both sides of the aisle on this particular argument.

for conservatives and republicans, i think it's -- there's a danger in looking a little bit petty and petulant and sort of whining about everything that the president does. i think most americans see the presidency as an extremely high stress job and that the president particularly at this time of year deserves some r&r with his family in his home state. i think they ought to be careful how they criticize this trip if they do. >> i remember when president bush was in office and he would go to his ranch in texas, his state that he loves to go to, and he was criticized for that as well. >> yeah, both sides, it's a partisan thing. i think the context of this particular vacation is a little bit different. >> at this time. >> right. there's a risk for the white house here in terms of optics. this he have to know it. the president's legacy project, this signature law that affects millions of people and millions of those people are being affected adversely as they're discovering much to their

chagrin, this thing is unwinding. there's a real crisis still in obamacare, and for the president to take this moment when it's just about to hit for a lot of americans, people don't know if they're going to have coverage, their rates are going up, their coverage has been dropped, is the back end of the website fixed -- >> the idea is he should be in the white house baby-sitting this project. i don't think it helps him either that his state is so beautiful and it is paradise. >> it is paradise. there's another piece of context that the white house absolutely must be aware of which is within the last two weeks, mike, there have been two obamacare state directors, one in minnesota, one in maryland, that have been forced to resign amid controversies over tropical vacations that were taken at a bad time because the program was imploding. >> speaking of obamacare, remember when the president was touting massachusetts and romney care, a model for obamacare. listen. >> all the parade of horribles, the worst predictions about

health care reform in massachusetts never came true. they're the same arguments that you're hearing now. businesses didn't stop covering workers. the share of employers that offered coverage increased. care didn't become unaffordable. costs tracked what was happening in other places that wasn't covering everybody. >> but it's expensive. look at this. they spent -- let's call it $10,000 per person in 2009. that's 36% higher than the national average of $6800. the majority of them still say they like romney care? why? >> the choices made by massachusetts voters are often mystifying to me, but if you had governor romney in this chair, he would point to differences between romney care and obamacare. i don't think they're significant. one of them is polling. it was popular when it was proposed and it remains popular

welcome back. the obamacare administration is drawing criticism saying the move could strain u.s./vatican

relations. we're being joined by the former u.s. ambassador under president george w. bush. jim nicholson has written an opinion piece. nice to see you this morning, jim. welcome to the show. >> good morning. >> first of all, for our audience who isn't familiar with this billing, what is the holy sea and why would moving it be a bad move? >> the holy sea is the sovereign country. it's often referred to as the vatican. they're the same thing. the head of that sovereign state is the holy father, in this case it's pope francis. the most ascendant figure today on the world scene for the authority that he has to speak on moral issues and humanitarian issues and at the same time we, the united states, are saying that we need to close down the current separate dignified embassy that we have to this man

and to his country and move it into an office building next to the u.s. embassy in italy into some surplus office space that they have there in a building that they bought ten years ago. so it's a clear diminishment of the stature of that post of the united states. and when you diminish stature, you diminish influence and you diminish respect. so in many ways it's being interpreted by people as sort of a slap in the face to the pope and to catholicism. i don't know if that's their motive or not, i've never said it was, but it clearly might be a big mistake. >> here's a quote from the state department. the united states is moving the location of the embassy to a building that is safer, bigger, and architecturally more appealing. it's also slightly closer to vatican city. some have actually suggested that the united states has been considering closing the embassy or downgrading its status.

nothing could be farther from the truth. >> first of all, they bought this building about ten years ago. when i was there they talked to me about moving this embassy into that building because they wanted to help justify the expense of the building and i said that it would be a big mistake then. the president of the united states, president bush agreed with me. it didn't happen with you nbut e starting to do it under be the guise of economics. they're saying it would save 1 to $1.4 million a year. the united states spent $1 million to buy granite slabs to put on the u.s. embassy to the united kingdom, on the lawn. the current building is a free standing, state of the art secured building with its own identity. assistant secretary kennedy i think it was on a telephonic

press conference said it was ugly, slab sided and unprepossessing. besides that, the new location would be 3/10 of a mile closer to the vatican. so their reasons are specious, but the results are very serious. this just should not be done. >> for some more context on this you have to read jim nicholson's great piece in the wall street journal. you wrote an opinion piece there. fascinating stuff. mr. ambassador, thank you so much for joining us this morning. we appreciate tnchts thank you. >> have a happy new year. coming up on the show, didn't get a chance to see the movies. did you pick up "the new york times" this morning? god bless you. they have a bombshell story on the front page of the paper. six chapters they released over the weekend on their website that basically show that they're -- and reporting on this new benghazi book. three key findings that they have. in months of reporting by the reporter david kirkpatrick, one of which is that al qaeda was in no way involved with the benghazi attack. >> despite all we've been hearing, particularly from mike rodgers, our correspondent has been reporting on this. despite all of this, according to the "new york times" report there's no evidence that al qaeda was involved in the attack. antiislam film, that youtube film that became infamous, that is what they say sparked and fueled the attack. the attack was led by a group of islamist militia men. not al qaeda. >> but if you look closer at the random militias, as they call it, they are an affiliate. they have been associated with al qaeda. and well known. >> and so remember when susan

rice, ambassador susan rice was taken to the sunday talk shows. this is all the same stuff we were hearing from her that has now been discredited where members of the intelligence community were sitting there with their mouths agape at the time. >> literally. >> wondering what in the world she was talking about going on the air with five different sunday talk shows to say that, in fact, it was because of a spontaneous protest and of that youtube video. that flies in the face of what we heard in november from the house intelligence chairman, congressman mike rogers who will be a guest with chris wallace this morning on fox news sunday. he says, the video theory has been debunked. listen. >> i will tell you this by witness testimony and a year and a half of interviewing everyone on the ground by the way, either by an fbi investigator or the committee, it was very clear to the individuals on the ground that this was an a.m. kal qaeda event and they had fairly descriptive events early on that led those folks on the ground

doing the fighting to the conclusion this was a pre-planned organized terrorist event, not a video. i mean, that whole part was debunked time and time again. >> sure, time and time again. >> and one of the themes from this "new york times" piece is that u.s. officials seemed to be focused so intently on finding al qaeda. finding al qaeda that they weren't paying attention, they were blinding themselves to the local militia, the local militants, the local terrorists. as mike said and we talked with a colonel earlier on in the show, we'll hear about this a little bit later, these people are tied. these groups are allegedly tied to al qaeda in some way, shape or form. >> just rebranded or renamed in a way, really. might not have the name al qaeda. they're not carrying the businesses of al qaeda, but they're an offshoot. they had this all planned. gregory hicks, he was the second in command under ambassador stevens who was tragically killed. he said when he heard susan rice go on the air and say those

things, well, this is what he thought. take a listen. >> when ambassador stevens talked to you perhaps minutes before he died, as a dying declaration what precisely did he say to you? >> he said, greg, we're under attack. >> would a highly decorated career diplomat have told you or washington had there been a demonstration outside his facility that day? >> yes, sir, he would have. >> did he mention one word about a protest or a demonstration? >> no, he did not. >> so fast forward, mr. hicks, to the sunday talk shows and ambassador susan rice. she blamed this attack on a video. in fact, she did it five different times. what was your reaction to that? >> i was stunned. my jaw dropped and i was embarrassed. >> so who do you believe? you know, you have to look at the information now. read this article, i guess.

do you believe gregory hicks? do you believe mike rodgers? >> i would say because i read a piece online that said fox news is going after discrediting this report. wait a second. going after discrediting this report. laying out the facts is what we're doing. showing you what has been said by members of congress, members of the intelligence community. members who were there reporting on the ground for months. no one touching this story, who is touching this story? fox news. >> again, one official that we talked to earlier, we'll hear from him, lieutenant colonel tony schaffer, this doesn't make any sense. he did say that groups like al sharia, they are connected to al qaeda. according to this piece it says that the consulate there in benghazi was being surveilled. it was being looked at 12 hours before the actual attack. it goes on to say that the attackers themselves, despite what looks like a coordinated,

very, very official attack and technically coordinated as well. >> with mortars and everything. >> exactly. and trucks bringing the artillery and so forth. despite all of that, that the people who are attacking it were arsonists and looters. just sort of, you know, some sort of upswell of violence that happened just to click aural at o -- click all at one point. >> no one will buy a book about something that we already know, all the facts that are out there. when you want to release a book. >> and you want to sell it. >> sell a book. >> get a lot of publicity off the bat. >> first day, all of this publicity. >> meanwhile, nbc news is reporting that the white house doesn't dispute this "new york times" report about there being no al qaeda role in all of this. anyway, as we mentioned, mike rogers will be a guest on fox news sunday with chris wallace straight ahead. we'll talk to chris about what he's going to talk about with mike in the next block. let's get to a fox news alert. new video now showing the moment

terrorists strike a train station overnight in russia. surveillance video capturing the deadly suicide blast. at least 14 people were killed. that number seems to be going up. dozens wounded after a female suicide bomber set off an explosion at the train station in the city of volgograd. officials stepping up security at train stations and airports following this blast. the second deadly bombing in volgograd in just over two months. this coming month after a chechnyian rebel leader called on targets including the sochi olympics coming up in february. it's four miles north of the olympic site. another fox news alert. it looks like the nationwide man hunt for a cop killer is over. the fbi says a man matching the description of the suspect who killed a police officer and wounded another in mississippi tried to rob a bank in phoenix yesterday morning and was killed by police there. they're still waiting to make an official i.d. to confirm it is

the same man. we'll keep you updated on that. the joyride we were telling you about the other day. the joyride is over for a run away wisconsin girl and her friends. 15-year-old brianna gomez busted in new mexico after leading colorado police on a high speed chase and stealing two cars. gomez took off with her boyfriend and two other teens on december 23rd. the search intensified when gomez's family told police she was insulin dependent and believed she didn't have her medicine. the four were apparently headed to california. we have some dramatic new video proving riding the subway drunk is not a good idea. oh, yes. washington, d.c., finding out the hard way. surveillance video showing passengers taking dangerous falls off of escalators. a woman as you're about to see falls onto the tracks. good samaritans pulled her out a minute later. all did survive but transit officials saying, look, if you're feeling tipsy, just get a cab.

"the new york times" went to benghazi, they spent months on the ground talking to a lot of

the militias. their basic conclusion is there were a lot of extreme militias that had ill intent towards u.s. and western installations in benghazi but that they did not have ties to al qaeda and they also say that the anti-islam video played a role, not that there was a demonstration, but that they -- that it played a role. now having said that, there were certain things that were not contradicted because clearly, according to "the new york times" report, there were a lot of indications beforehand that there were security threats to western interests and the u.s. consulate in benghazi which raises the question why there wasn't a higher security question there. "the times" doesn't answer that. there are direct contradictions between what "the times" reports and what mike rogers points out. we'll have mike rogers on on "fox news sunday." we'll ask him about it. >> is it that important to leak whatever militia group had this plan to al qaeda?

there were still a group of people who wanted to attack the embassy. >> well, it's just a question of fact, mike. you heard mike rogers in that clip say that this was an al qaeda inspired attack. "the times" says it wasn't. you want to know. it feeds into this narrative the degree to which there were a bunch of independent militias that were operating in east benghazi and to what degree this signifies the rise. that's an important fact to learn. either way it still was a catastrophe. it seems to be a huge security lapse on the part of the state department and we have four dead americans. >> and we have that "60 minutes" report that was refuted, laura logan piece which got a lot of publicity and that has been discredited. some are raising the question about the very militia men that the "new york times" is speaking to. one day you can trust them as a source, the next day you can't. it's hard to get information out

of there. the obama administration is describing getting information out of there as the fog of war. >> i think that's a legitimate issue. how do you know exactly what the links are between one of these extreme militias and al qaeda? it isn't like, you know, they've got throw charts and organizational charts. the times in its long, very exhaustive article presents some evidence, whether or not, you know, it's persuasive or not i have to say i'm not sure i can discern, but it will be interesting to talk to two people who can as we've pointed out, mike rogers, the chairman of house intelligence and mike schiff has been more skeptical that it's all the fault of the obama administration. >> well, obamacare kicks in in 48 hours or so so you have a great guest here. howard dean, former vermont governor talking about obamacare. >> well, yeah. he'll be talking in a debate with scott gottlieb, that fella on the right, who is on the right. he's a conservative from the

american enterprise institute of obamacare. for all the talk about the website, to for all the talk about the enrollment and cancellations, the rubber really hits the road on january 1st or more likely january 2nd when folks under the obamacare plan have to actually go see their doctor. will they be covered or won't they? will they have that little card you have to give to the receptionist or not? will they be able to go see their old doctor as the president promised or do they have to go see a new doctor? do some of these networks have enough doctors for anyone to see. we'll get to the practical issues. what happens on january 1st if you're in the new system and you want to go see a doctor. after all, this isn't an insurance problem, this is a health care issue. >> it can be an insurance problem if the insurance companies haven't received the paperwork. chris wallace is the host of "fox news sunday." check your local listings. >> real quickly here. being a redskins fan, chris, who

just watching us back so i kind of thought, well, what better way to have -- than to capture it with four different cameras so that we could always look back. and if anyone that didn't really know about our relationship saw it, they could see our relationship kind of up to that point. also the fact that i got to surprise her. >> you'll always have it on video. april, i have to ask you. you're shooting a movie so obviously you're acting and things like that. >> yeah. >> you actually said, is this for real. did you really not know that he was proposing? >> i had no idea. i was totally in actor mode. i was like, yeah, we're shooting a video. when i walked through the door and i saw in my peripheral vision he was low on the ground. i was like, what is he doing? he was going to ruin the shot. i was totally in shock. it took me a second to come out of actor mode. >> you have the follow-up obviously because the camera kept rolling, but i understand you said you were in such shock that you were kind of in a daze

for a while and it wasn't until the evening that you guys kind of chilled out. >> yeah. >> tell me about that. >> yeah. well, after the fact i just kept staring at him like wait, what? i probably say the, wait, what, like 30 times. then as we started calling family and friends and then it was actually when we were at dinner and he surprised me with this really nice place downtown. i was just like -- it started hitting me. i was like, i'm so excited. it started wearing down on him. i think he got tired from all the planning. we did opposites. >> that's such a cute shot there. you can see your hand is shaking as he's putting the engagement ring on it. i hate this question, but i have to ask it. do you have a date set yet? >> well -- >> we don't have a date yet. we're looking at some dates and venues. >> definitely summer. we want to get married soon. >> thinking virginia beach. that's where we both live. we decided the city -- >> we narrowed down the place. >> very cool. listen, take some video.

six chapters of a brand new book written by david kirkpatrick. scheaf released six chapters of what they're calling a bombshell story about benghazi. it's called a deadly mechanics in benghazi. and the three bilg big take aways from this report are there. they say there's no evidence al qaeda was involved in the benghazi attack at all and it was all sparked, in fact, by that youtune video which has been debunked by a number of individuals. she is that's what sparked and fueled the attack. >> as the attack was led by a group of islamist militia men, again, not connected to al qaeda, already folks are coming out of the woodwork saying, hold on a second, debunking this and pointing to representative mike rogers, of course, who has talked about this in-depth. >> and who has access to high level intelligence other people do not have. >> exactly. >> but david kirkpatrick, he is writing a book, right? so he says that he interviewed a lot of people on the street in benghazi and -- but they're all

anonymous sources. >> right. >> throughout the book. >> again, to your point about mike rogers having access to sources of information, intelligence information that are never made public, the fbi interviews that were conducted as a result of this, remember, this is all been debunked. remember when susan rice, ambassador susan rice went on those five sunday talk shows? there's a reason she's not secretary of state right now because of what she said that very day on air. >> the question is has something developed. mike rogers spoke with us back in november, november 23rd it is. and has something happened since then? have there been new developments? we don't know yet. but let's listen to what he had to say back on november 25th. the how intelligence chairman mike rogers. >> i will tell you this, by witness testimony and all in a year and a half of interviewing everyone that was on the ground, by the way, either by an fbi investigator or the committee, it was very clear to the

individuals on the ground that this was an al qaeda-led event and that he had pretty fairly descriptive events early on that led those folks on the ground doing the fighting to the conclusion this was a preplanned organized terrorist event, not a video. that whole part was dedid you thinked time and time against. >> do you remember greg hicks? he was the second in command there at that consulate at the time of the attack. he's under ambassador chris stevens who was tragically killed on that september 27th. he said when he heard susan rice say that on those five sunday talk shows when he knew what happened, he couldn't believe it. >> when ambassador stevens talked to you, perhaps brins before he died, as a dying declaration, what precisely did he say to you? >> he said, greg, we're under attack. >> would a highly decorated, career diplomate have told you or washington had there been a

demonstration outside his facility that day? >> yes, sir, he would have. >> did he mention one word about a protest or a demonstration? >> no, sir, he did not. >> so fast forward, mr. hicks, to the sunday talk shows and ambassador susan rice. she blamed this attack on a video. in fact, she did it five different times. what was your reaction to that? >> i was stunned. my jaw dropped and i was embarrassed. >> why was he embarrassed? >> because of the coordinated nature of this attack. we spoke to lieutenant colonel tony shaffer on the show early this morning who said that he had just spoke b to the egyptian intelligence authority there in egypt and, first of all, pointed out that it was al qaeda related, but also look at the nature of the attack. the motor fire that was directly and specifically targeted. it had to have been planned.

listen to what the colonel says. >> let's remember the key points here. you had 200 trucks mobilized to do the attack. you had mortars. this is one thing they completely glossed over this article. the mortar attack was precise. they put four rounds on to a target that the best u.s. marine corps mortarmen would love to have. so this was not spontaneous and this guy was but one of those part of the organization but it was clearly al qaeda led and executed. this is not somewhere in the middle of missouri where you can go tune into youtube. it's tough to get those things. you're looking at his own timeline. it didn't have time to get viral in a third world country. so then, third, i think most compelling is that the organization that was needed to launch a concerted attack, this was an organized effort, with people coming in wave after wave with borders. so, again, this was not a rabl.

>> so who do you believe, mr. rogers, mr. hicks, the colonel there or do you think -- read the article in the "new york times" and then you'll have to decide, who do you believe? here we go again, the debate rages on. >> well, i also want to say something, surveillance of the american compound appears to have been under way at least 12 hours before the attack. the violence has spontaneous elements. anger at the video motivated the attack, but looters and arsonists were really the ones who were attacking the compound. which goes completely against what colonel shaffer had just said. >> interesting. so there are the facts, there are the facts as we know them this morning. this is six chapters of this book that will be published and the book will be coming out soon. so you can read into it and find out all you want. let's get to some other news and we start with a fox news alert. surveillance video catching the moment terror strikes in russia.

14 people were killed, and doesz injured including an 9-year-old girl. officials say the terrorist saw a policemen near a metal detector, became nervous and set off her explosive device. this coming months after chechen rebel leaders called for attacks on civilian targets including the sochi olympics happening in february. there have been reportedly 32 terrorist attacks in russia this year alone. and another fox news alert, it looks like the nationwide man hunt for a cop killer is over. the fbi says a man matching the description of the suspect who killed a police officer and wounded another in mississippi tried to rob a bank yesterday morning in phoenix and was killed by police there. they're still wait to go make an official i.d. to confirm it is the same man. and this year's -- is turning out to be a brutal one. the flue flu virus is now

year if not in our -- well, maybe obamacare is probably still number one. but the nsa leaker is going to have repercussions for the rest of our lives. and i think that it's hopeful that the government, the white house, is trying to organize and figure out how to minimize the damage from future things that are going to come out because there probably will be. we've already been warned that they will be embarrassed and it did have a lot of impact even in the congress and in the court. >> now you have one judge saying it's okay, now one saying it's not okay. but our lawmaker res going to have to think ahead about meta data. policy cannot keep pace with technology, but we are expecting our intelligence community to keep pace with terrorists who are using the new technology. so we have to think through all of those things. >> let's talk about a lawmaker, rand paul. how about that filibuster? >> i remember i was in houston, texas, and i saw on twitter all this stuff about rand paul. what is he doing? and my husband and i watched for

a couple of hours and i thought, wow, this is great. people probably don't even remember what the point of it was in terms of the topic, but they thought what a way to show the power of the senate, the power of a senator in one person and what they do. >> we couldn't forget hillary losing her cool as some say she did at this benghazi hearing. >> right. and you've been talking about benghazi this morning because of the new "new york times" report. i think that is going to be what it is going to be. however, for her, it was the imperious attitude of when she said what difference at this point does it make? >> and she didn't say it as nice lace you just said. she said it like this. >> the fact is, we have four dead americans. was it because of a protest or was it because of guys out for a walk one nooid night who decide they would go kill americans. what dirchbls at this point does he make? >> her defenders will say she didn't mean it in the way everybody seemed to want to take

>> it's already happening. so my good friend who lives in philadelphia got a puppy for her children. did you get a puppy for christmas? wondering how to train your new four-legged friend? robert is here to help us out here. and these are rambunctious dogs here. a lot of kids are going through this all across america. they have a puppy. how do we train them? one of the first things these puppies will do is chew your shoes and your furniture? how do you get them to stop doing it? >> chewing is a natural behavior. they should be doing it. keep your expectations realistic. on chewing on furniture, having had some really good chew dois like this. people can get sweetky toys and fuzzy toys. these you can put food inside of. i encourage people to feed their dogs entire meals from here. >> is that right? >> yes. if you feed -- you can have a couple of -- you know, at least one meal a day.

>> the poor doog is looking for food in the bowl and there's nothing in it. >> but they can sit there and work on this. it -- the best defense is a good offense and this is a best way to give them a place to put some of that chewing energy. >> look at this. they're nipping at each other and they start nipping at the guests when they come over. how do you stop nipping? >> that's a great example of normal dog behavior here. >> chaos. >> what i would normally tell people to do, in that case, is pair the guest up with somhing with some behavior that is inpatble. so you ask a dog, for instance, hey, sit. sit. >> sit. >> yes, did dog. and then you can say come over here and pet her and she can say high, but you can only say hi once the dog has sat. that's a lot of work and that's going to fall into the hands of the dog owner. >> another problem, the dogs will poop right in your house. how do you potty train?

>> potty training takes a little while to get through to the dog's head where the toilet is. it's going to be important for you to show the dog where the toilet is. you're taking them to the appropriate spot, making sure you know what the dog's schedule is so it's not just -- it's not just willy-nilly. you should have a limited amount of space so the dog shouldn't have access to the entire apartment or the entire house where they can be peeing and pooping all over the place. >> set them free, will you? >> sure. >> probably not. >> sure. >> run around, it's a big studio. what about stoeshlzation? >> socialization is the single most important thing. you want to make sure these guys see as many people, as many dogs, as many other animals, as many situations, sirens, cars, trucks, joggers, bikes. you can't do too much of it. they have a socialization period that's over around between 12 weeks. so you don't have a lot of time. and the more you can get them out into the real world -- >> hey, guys, come meet

of the highest order. now, whether you agree with what phil robertson said or not, a&e under pressure with all that money at stake has gotten on his high horse and said we as a network are champions of the game, these comments are offensive. phil robertson, you are on hiatus. and suddenly looking at the situation, the company decided to take the suspension down to zero days. >> so now, they didn'y time off for phil robertson, filming wasn't affect.ed. so he'll be back in full force. the family came out and said, hey, phil might be a crude guy, but he's real. and a&e seemed to be taking, this is one man's view and if you're going to watch the show, you're going to see a real guy when you're watching the show. >> some agreed with what phil robertson said, is some did not. i thought hit language was unnecessarily inflammatory. what a&e wanted was for him to issue a full fledged apology. phil robertson didn't do that,

he didn't back down. now a&e has managed to pull off a rare feat. it's ticked off everybody, the liberals and the gay activist groups because it had taken back the suspension with no real reason to do so. and at the same time, it alienated many of the hard core fans of this program by criticizing its star, it's patriarch and this is an effort at damage control, pure and simple. >> i think that's a great point, they managed to annoy both sides of this. but you do a great b job of analyzing the mead why in general. do you think this is a sea change for the way hollywood will treat incidents like this in the future? >> that's an interesting question. i think this is a hooung situation. there aren't very many reality tv stars like phil robertson. generally, the is not a free speech issue, as i've said. there's a social contract when you're a tv star that you're not going to go raging off in
