"the new york times" posted on their website a big six-part story by a fellow by the name of david kirkpatrick. essentially what he did was he went over to libya and he talked to a bunch of the people he says were deeply involved in what happened in benghazi that night. and according to "the new york times" report, hey, that video did have something to do with it.

he said there's no evidence that al qaeda or any other terror group was infiltrated in benghazi, and that that video perhaps accelerated the anger toward americans. >> these are the things we initially heard, the talking points similar to what we heard from susan rice on all the sunday shows a year ago or so. but that is not the case according to a lot of sources on the ground who have spoken to adam howsly and they're outraged about this. they say this was an coordinated lie, al qaeda did have something to do with it, there were men pointing in one direction and saying do this. it didn't saopl spohn taeupb -- didn't seem spontaneous. representative mike rogers talks about this and here's what he had to say. >> there was some level of preplanning. there was aseparation to conduct an attack by al qaeda and their affiliates in libya. we know that.

individuals on the ground talked about a planned tactical movement on the compound. this is the compound before they went to the annex. all of that would directly contradict what the "new york times" definitively says was an exhaustive investigation tells me they didn't talk to people on the ground who were doing the fighting, shooting and intelligence gathering. when you put that volume of information, i think it proves that that story is not accurate. >> the interesting thing is that the "new york times" story ignited this firestorm, a bipartisan firestorm in america. even representative adam sheuf of california says i agree with mike rogers that al qaeda was involved and congress based on intelligence that they see say, yes, al qaeda was absolutely involved. so the question becomes, has this -- is this report that the mainstream media has been waiting for. we watched "meet the press" yesterday where they went

hard after congressman darrell issa. take a look at this. incredible. >> you said repeatedly it was al qaeda -- >> you and other critics said the president won't acknowledge it is al qaeda because it is an election year and he wants to say after bin laden has been decimated and it would make him look bad -- >> al qaeda has not been decimated and there is a group there linked to al qaeda. what we never said, and i didn't have security look behind the door, what the intelligence were on the exact correspondence with al qaeda. those sorts of methods i never claim. >> why use the term al qaeda? you and other members of congress are sophisticated and know when you say al qaeda, people think central al qaeda. they don't think militias that may be inspired by bin laden and his other followers. it is a hot button for political reasons from the administration's -- >> it was accurate. there was a group that was

involved that claims an affiliation with al qaeda. al qaeda is not a central command and control. it was in fact a loose group that could take general statements and act on them. the fact is people from this administration, career professionals, have said under oath there was no evidence of any kind of reaction to a video. and in fact this was a planned attack that came quickly. that's the evidence we have by people who work for the u.s. government and were under oath. >> notice how david gregory and andrea mitchell both tried to gang up on him like, hey, wait a minute, you republicans were trying to tell us it was al qaeda, and "the new york times," they wouldn't have a dog in that race -- "the new york times" says it wasn't al qaeda and it was related to that video and stuff like that. what's interesting is i've spoken to people who were on the ground. do you realize that the house next to the consolate was owned by al sharia, the

al qaeda affiliate and they had a week of briefings on september 11 that year and the affiliates said the number one thing to worry about is al qaeda. maybe they have a political ax to grind, a agenda, but that is not true. >> adam howsly's story is an incredible story published yesterday and he speaks to sources who were witnesses to the attack. it was a coordinated attack. it is completely false to say anything else. it is completely a lie. one witness to the attack told fox news, talking about the times account. guys were coming to the compound moving left, moving right and using individual movement techniques. this was not a spontaneous attack. >> there are names, multiple sources are floating around. namely ahmed mutallah, also

tied to ansar al shah rei can't. that is the name in the game, the one with the most money. these other militias are not wanting to turn him in because they also have ties. >> you've got to wonder why would "new york times" put that story out there? could it possibly have anything to do with, let's see, who is running the state department back then? oh yeah, would she possibly be running for president? it kind of looks like that. >> let's talk about credibility. for "the new york times" to accept the word of anonymous sources who are allegedly participants in this attack on americans at that facility and say, yes, we believe them over the intelligence that congress has seen and that congressional leaders, democrats and republicans have gone out on the record

welcome back. preplg took an oath to preserve, protect and defend the constitution of the united states. but with regard to his actions over the past few years has he pushed the constitutional envelope apart and kept his oath of office? here are top violations of 2014. florida university international law professor elizabeth foley. good morning, professor. you believe the president has violated the constitution in a few ways. the first way you say is with regard to obamacare. supreme court upheld obamacare. how has he violated the constitution with regard to

obamacare? >> how much time do we have? >> we've got about 30 seconds. go ahead. go. >> the five biggest constitutional violations by the president have been in obamacare, which as you know is the signature legislation of the president and it's basically sort of become a playground for him to try out an imperial presidency. >> you say he's blown away the employer mandates, didn't keep his word on that? >> that's right. he delayed that for one year with the stroke of a pen because the employers basically protested it was too difficult. he also decided unilaterally that he was going to grant congress an exception. the law says that congress members and their staff have to buy their health insurance through the obamacare exchanges. he said that they don't have to do that. they can continue to get it through the federal employees health benefits program. and they continue to enjoy the generous subsidies they have always enjoyed. and these are kinds of

subsidies they wouldn't have to pay. >> professor, let's talk about so-called recess appointments. has the president kept faith with the constitution with regard to making recess appointments? this is going to the supreme court, his conduct, isn't it? >> that's right. on january 13 the supreme court is going to hear oral argument in a case called noel canning. the question is whether or not the president can appoint members to executive agencies when the senate is not in recess. article 2 says he has the power to fill vacancies that happen when the senate is in recess. but guess what? the senate wasn't in recess. no other president has ever attempted to fill a vacancy when the senate wasn't in recess. the d.c. court of appeals said that's unconstitutional and i expect the supreme court to say the same thing. >> professor, let's finish with this one. the president gives a lot of lofty speeches about the power of the first amendment. is he keeping faith with the first amendment or is he disregarding it? >> far from it. this is a president that's using his executive power

to basically chill speech with which he disagrees politically. prime example is the i.r.s. scandal where basically he was using the power of the internal revenue service to provide special scrutiny to tea party and other conservative groups because he wanted to shut them down and stop them from speaking prior to the 2012 election. he's doing the same thing with the universities. he's got a new speech code that universities have to abide by which basically says that any utterance that offends someone on a sexual topic is to be considered sexual harassment. so any kind of joke, any kind of play, even flirtatious banter could be prosecuted by these universities. that is a violation of students, faculty and stafr first amendment rights. >> you talk about the dream act. tell us how he's kept faith or not. >> this is an act that would provide amnesty for young people brought to this country illegally by

ball-drop ceremony. >> another california city is on the brink of collapse. the reason? bloated police pensions. >> the city is desert hot spring. its 2013 budget revealing about $7 million in the city's $10.6 million annual payroll goes to the 39-member police force. that's more than 66% of their budget. are other countries -- cities across the country at risk? >> the host of "varney and company" staoufrt -- stuart varney is here to explain this. i was reading police officers as young as 50 can retire. how can that formula work? >> that very powerful police force that has pushed for these kind of very strong, lavish pay and pension benefits. they have been pushing for them for years and years. now they've got to be paid. in many cities across the country it is the police and fire fighters pay and pensions which are breaking the back of cities'

finances. case in point, desert hot springs as you've pointed out. $7 million out of a $10 million budget, that goes to the police force. the average pay package for the 39 police officers in desert hot springs, the average -- this is pay and benefits all lumped together -- $177,000 per year. >> that's a rich force. >> it's way out of line. the police force is very expensive in this particular city that's mirrored in other cities across the country. i suggest that what youto see if ghost towns, modern ghost towns emerging because they cannot pay these police pensions. they're insolvent and they've cut services to the bone. people are moving out and you've got modern ghost towns developing all across the country especially in california. >> your objection is you say police officers should be paid fairly. they are an important part of our society but the issue becomes the power of

unions, the power of labor lobbies in this country and bringing down cities. >> police unions, fire fighter unions and municipal unions generally and politicians who get votes by giving the police force, giving the fire fighters, giving civil servants what they want, getting reelected and postponing the bill that has to be paid way down the road. this is true of countless cities across the country. >> do you think we're going to see, for instance, with what's going on in desert hot springs, what happened in the state of michigan, or in detroit, specifically, where suddenly because they were bankrupt, they got to go back in and redo the pension deal? >> precisely. detroit is the template because detroit established the principle that you can go into these pension contracts and break them up and bring them down again. detroit showed you can do that. that's what these other towns and cities have to do. your heart goes out to the retirees because they bargained in good faith.

a deal is a deal. these guys are going to suffer, but they're going to have to suffer big time in the year 2014. >> what do you do when the culture there has made the people feel like that's what they're entitled to; right? are you going to see a lot of people leaving the police force because they're scared they're not going to get their benefits and they're not going to be joining the police force in these towns? >> a lot of cases like miami, there is a mass retirement of police officers right before a certain deadline so that they can lock in those lavish pay and pension benefits. that will happen frequently. but looking forward, the police, fire fighters, municipal union people generally, they are under extreme pressure because to pay them what they negotiated for means cutting services to the bone. and, frankly, means bankruptcy. >> got a feeling you're going to be talking about that and so much more over on "varney and company" 9:20 eastern time on the

president obama sat every one in the room saying we're not going to compromise on anything. repeatedly republicans were compromising and repeatedly democrats said no compromise. shut it down. >> and it got shut down. >> it's interesting between these two sunday shows on abc and nbc, it seemed that these veteran reporters and anchors got taken badly by congressman issa and senator cruz. they got the better of them really on tough questioning. it was very, very interesting. >> and pushing tough talking points too. what we see from the obama administration even with benghazi from "the new york times" and the mainstream media and then you see this coming from abc and from nbc as well. you think about what happened after the government shutdown and during the government shutdown, who shouldered most of the blame for it? it was the republicans. once the obamacare rollout started to happen, what happened with those poll numbers.

it was a huge swing and democrats started to feel the brunt of t. maybe that's why they're bringing the shutdown up again. >> it was republicans who said before the shutdown we're just trying to stop obamacare and given the fact it has completely imploded and the signup numbers are, they got better in the month of december but still there are a lot of democrats who probably have, given hindsight would probably say we should have delayed it or something. but now it's the law. but obama administration said we have two million people who have enrolled. that's great but what they were hoping for was 3.3 million; right? pretty short of the goal. >> a long way to seven million. >> 24 minutes before the top of the hour on this monday. we've got news. >> a man sleeping in his bed is killed when a car crashes through his home in california. the car jumped a curb and ran into the home early yesterday morning. the victim died at the scene. another person in the house

medicaid and stuff like that. and the estimate was 3.3 million would at this point. we're just a little short of that big mountain there. >> first of all, you already said it. a lot of 1.1 million is getting medicaid. number two, another big chunk of the 1.1 million has back-end problems meaning they got something but when they go to the doctor's office it may not work. six million have already lost their coverage at the same time one million is signing up. the overall goal here of getting more insured people isn't working at all. if anything, we're getting more uninsured. even if that problem is ultimately taken care of, i think there's a bigger problem which is that the undocumented -- i'm calling a new term today, the undocumented. this is people who think they have insurance but don't, so they get to see me, they can't see me. or they never signed up. they said, i know i qualify for medicaid. i know i qualify for something under the exchange but i never got

there. what do i do doc? are you going to see me or not going to see me. the third group is those who come into my office who say, i got the card and i say i'm not on that card. this is a narrow network. i could be in that network. they don't include me. the patient says what do i do now? i'm going to have a lot of patients coming to see me and doctors like me who are not going to get paid for seeing our patients. >> that is not right, not the way it's been done. it sound like what we've heard from the administration in the past couple of weeks is the fact that they're going to want you to take care of them even though the people don't have coverage, even though it is going to cost you money. >> i can't believe that. think about what that really means. what are we going to get? an i.o.u. the government is going to make sure that an insurer pays you, dr. segal, so see the patient? i want to say to viewers i am altruistic and will never turn away a patient

but do we want doctors across the country to be working like that saying the government is going to make sure an insurance company pays you. don't worry about it. the same government that can't fix a website? >> such a good point. you're worried about the people who have the card, they come in with strep throat and say got to have your help on this and you're not in that network. that's what you've been talking about for a couple of years. now it's going to hit the fan on thursday. >> because it's the old-style medicine from the 19 # -- 1990's, meaning h.m.o.-type insurance where there's very few doctors in the network. even if you get to see me, the specialist i'm used to referring to may not be accepting insurance. all boils down to the concern about quality of care medicine. the real secret here is and i wrote about this in the "wall street journal," it takes me time to figure out what the problem is. i had one patient came in with a rash that was not revealing, did not impress me. as she was leaving she

showed me an iphone photo of the rash three days before which was classic for lyme disease. i would have missed that diagnosis if i had obeyed the insurance rules which is get them in and out in 10, 15 minutes or you don't get paid. medicine takes time. it's a careful conversation between a doctor and a patient. telemedicine cannot replace it. nurse practitioners who i love and are very well twaeupbd cannot replace the same training. the issue is how are we going to preserve quality of care in a situation like this with all these regulations. i can't imagine democrats liking this law. this is big business, big insurance. in a way that is bad. republicans don't like the big government. we've got the worst of both worlds. big government and big business operating at their worst. >> are you going to be working on thursday? >> i'll be working, toiling. >> let us know how it happens as it all unfold. thank you very much. great op-ed in the "wall street journal." coming up, the president always promised he'd take care of our vets, so why is

miracle. a grandfather driving his six-year-old grandson to christmas dinner goes into diabetic shock. the quick thinking little boy realizes something is wrong, jumps out of the car, runs and gets help and the paramedic goes and saves his grandfather's life. here to tell their story is ronald vita and his heroic grandson. good morning. happy holidays to everybody. >> good morning. >> good morning. >> ronald, i'll start with you. what happened on christmas night when you were taking your grandson to christmas dinner? >> well, we were headed to my daughter-in-law's grandparents' house and he asked if he could ride with me and i said yeah. so we were heading down midland drive and all of a sudden i must have blacked out. i don't remember a whole lot of what exactly happened. >> but sully, you remember what happened. what did your grandfather look like and what did you do?

>> he looked all tired, so i knew he was -- i jumped out of the car. i ran to the nearest house in the area and we saw a big cloud of smoke and it was burning up rubber. it really freaked us out. >> how fast was this car going and were you scared when you jumped out? >> no. >> how did you jump out? what did you do? did you roll or how did you catch yourself? >> i rolled. >> you rolled. then you ran and got help, right? what did you do next? >> how did i do it? >> what did you do next? i know there was snow there. what did you do next? >> i knocked on the door. >> you knocked on somebody's door and got help. ronald, where do you think you would be without sully.

what if he hadn't jumped out of the car? >> from word i got from the paramedics, my blood sugar was at about a 20. they said that at that point, your body functions start shutting down. so having sully with me was truly a blessing. i don't know where i'd be. they said in a few more minutes and i probably wouldn't be sitting here today. i just thank god for sully being in the car, you know, and for god god watching over and taking care of both of us in the situation. >> your little christmas angel. >> yes. >> you two have a beautiful family. i hope off fantastic new year and we're happy that both of you are happy and healthy and that sully, you didn't get hurt jumping out of that car either. have a great day. >> all right. thank you very much. >> 56 minutes after the hour. that "new york times" report on the benghazi terrorist attack completely false? what eyewitnesses on the ground that day are saying this morning

pretty good. >> let's get right to that fox news alert. while everyone was sleeping, terror strikes again in russia. a bomb blast tearing through bus in the city killing at least 14. officials saying it was the work of a suicide bomber. russian president putin now calling for increased security in the region. it's the second terrorist attack in that city in two days. this one caught on camera. yesterday a suicide bomber set off an explosion inside a packed train station. at least 17 killed there. dozens injured. now officials saying they were carried out by the same terrorist group. no one has claimed responsibility for either bombing. this coming months after a chechen rebel leader called for attacks on civilian targets, including the olympics in february. the bombings happening 400 miles north of the games' site. the body of the american heiress to the general foods fortune has been cremated and now back in the united states.

police in honduras found the 46-year-old dead last week in a room at her spa resort. she lived in the country for 15 years while running the spa. cops eventually arrested a local musician. she was helping quit drugs. another setback in an attempt to rescue 74 people on board an ice lodged research ship. the ice breaker was 11 miles away before it was forced to turn around. the ice too thick to cut through and low visibility from snow showers. this is the third ice breaker to attempt to free the ship. it's been stranded since christmas day. the helicopter evacuation would be the last option. you got to see this. a woman snapped the photo, her son and his friend surfing and gets photo bombed by what appears to be a shark. you can see the two kids on the surf board with the wave behind them and inside the wave what appears to be the shadow of a shark. this happened at manhattan beach in california where there has

been an increase of great white shark sightings. those are your headlines. >> all right. now let's bring in donald trump who joins us every monday. mr. trump, you were just on hold. out of curiousity, do we have music or what do you hear when you're on hold? >> i hear nothing. i just hear your voices, which are lovely. >> oh, good. >> always nice to hear them on monday at 7. >> you hear the program. >> are you being serious? >> of course he's being serious. >> on this monday morning, let's look at what the "new york times" ran over the weekend. essentially what they said was hey, that video did have something to do with benghazi and al-qaeda not involved. no terrorist groups. what does it look like to you? >> well, it seems to be a total cover-up and it was an amazing story. i read it very closely. it just seems to be at odds with everything else that you've read over the last year and nobody really understands the reason. is it a hillary thing or whatever? and nobody really understands

why they're not just talking about cover-up. it's such an amazing story and such a sad story when you think of what happened. the fact that we were so unguarded and so vulnerable and have people killed like this, our ambassador and others killed like this was terrible. >> the intel committee chairman, representative mike rogers, was on the sunday shows yesterday. hear what he had to say. >> do you think there is a political motivation to this times report? some people suggested, this is trying to clear the deck for hillary clinton in 2016? >> i don't know. but i found it interesting that there is this rollout of stories, including susan rice who would go on tv and have a direct discussion on this when we still have an ongoing investigation in the house intelligence committee. >> yeah. and you know what, mr. trump, we have adam housley, who has spoken to some of the special operators who were there that night, they're angry about the "new york times" report. they say, quote, it was a coordinated attack. it is completely false to say

anything else. it is a complete lie. so given the fact that they say it's a complete lie, plus the political dynamic, why would they choose the weekend after christmas to drop this thing? >> well, anybody that has studied and knows anything about benghazi attack really thinks that story was completely false. what their motivation is, nobody can say. there are people in the "new york times" that can say. but certainly anybody that knows about benghazi would say that is a completely false story. >> no doubt about it. apparently the intel people viewed -- in washington viewed the video of the attack and specifically i.d'd that it was al-qaeda and the administration has known that. so the "new york times" sends this guy, david kirkpatrick out to talk to the people on the streets of benghazi, not the same people that the intel sources and government sources.

but they found a bunch of people to corroborate the story that is helpful to hillary and the president that yeah, probably had something to do with that video and no al-qaeda. >> one of the most amazing things is we know some of the people involved in the attack. we know who they were and we don't do anything about it. we're not doing anything about it. we could go in and get them and for some reason -- nobody knows what the reason is -- we have their identity. we know who they are and where they are and we don't go in and get them. so what is going on there? >> in not knowing it, donald, could there be any reason in the world why we wouldn't want to bring these people to justice who killed these americans? how can we justify that? >> well, that's really the big question. why are we not going and getting them? why aren't they giving them to us? what is going on and what's the silence? people don't even mention that. that's hardly mentioned, hardly mentioned in the report and hardly mentioned in reporting. so why aren't we going after these people that killed the ambassador and others?

why aren't we doing that? we know who they are. >> right. donald, another big story people will be talking about because in just a couple of days, january 1st, that's when people will be trying to go to the doctor and they may find out that they aren't able to go see their doctor or pick up medications and aren't able to get those either. the obama administration is being urged by some people who are pretty close, even ezekiel emmanuel saying it's time to name the ceo to run the obamacare market, yet there is a senior official who has spoken to reuters and saying that's not even on the table. we're not considering it. why not and why not two years ago? >> well, obamacare is failing badly in every way, whether it's sign-ups or anything else. by any standard, the disastrous web site, which people are saying $1.4 billion -- i can't believe that -- but they're now estimating it cost -- the cost of the web site is $1.4 billion. somebody is making a lot of money on this web site. sounds like a good business.

we're going to have to get into that business. it's failing badly. i think if he wants to try and save it, he's going to have to put somebody very, very -- i actually think ultimately it fails of its own weight. i'm not sure that it matters who runs it. >> you have a reputation for getting things done where other people fail in the city and the state. if the president of the united states asked you to take over obamacare and become its ceo, in your spare time, would you take it over? >> i always believe -- you have to believe in your product. you have to believe in what you're doing, whether it's a development or anything else. i don't believe in obamacare. i think it's been a very bad thing for the country. it's a very bad thing for business. it's a very bad thing for people and when they say a million people signed up but they don't talk about the millions of people that have lost their plan, so you have fewer, if you look at it, it's a net negative, it's been very, very bad. it's proving to be and getting very expensive.

unbelievably expensive for people, just wiping them out. so you have to believe in your product. so i would say no. >> in your answer, you kind of gave a prediction of the future. you think that it's going to fail on its own weight. as we approach 2014, we're on new year's eve eve today, what are some of your predictions? there was that story that new york post story a week or two ago that suggested you might be thinking of running for governor of new york. >> we'll see about that. there are a lot of good people and great republicans that want me to do it. we'll be seeing about that. we'll have a meeting sometime next week and we'll be discussing that. but one prediction i would make is i think the republicans will have a tremendous 2014. if you look back a few months ago, they were saying the republicans are going to really have a bad time. i think because of obamacare and the tremendous failure, i mean, at least thus far and i think it will only get worse, the tremendous failure of obamacare and i really believe that the

republican also have a tremendous election victory in 2014 and a lot of democrats are going to start going out and whether the word would be against obamacare or something similar, they're going to start fighting obamacare because they are not going to lose their office. they're not going to be thrown out of politics because of something that just is not working. so a prediction would be that the republicans are going to have a very, very strong 2014 election. >> the democrats are going to defect. that is an interesting prediction. >> you have many democrats defecting at this moment. they're really going under the rock. frankly, as an example, you look at some of the races recently, had they stressed obamacare a little bit stronger, they almost won races that were unwinnable. in some cases, they won only by using obamacare. so i think a lot of republicans are going to make that a single issue and frankly, they're going to win a lot of elections. >> well, as we like to say, stay

like for somebody -- i'm referring to your service in vietnam -- you were left for dead and only by the grace of god are you alive today. but you needed the veterans administration and america's advanced medical complex to bring you back to life. so it's got to break your heart to see what's going on right now. >> it does indeed break my heart because what we're looking at are thousands of veterans, not all from the vietnam war, but most from then who are on the streets and apparently no attempt to try to help these folks. as you just mentioned, we're watching benefits for veterans disappear. we're watching early retirements for our active duty folks who will not then get their full retirement. these are promises that the government's made to us.

so yeah, i'm pretty upset about it and the actions that are being done in washington are in my view, verge on being criminal. >> we've got some statistics, we're going to take a look the. the number of vets living on assistance now, nearly 340,000 veterans receive public money for housing. 900,000 veterans live on food stamps. 5,000 active duty troops are currently receiving food stamp assistance. we just heard the president of the united states talk about how we're going to take care of these guys. yet you look at the facts and doesn't look like we're doing a very good job of it. >> i don't think he really cares about our military despite what he says. if he did, i don't think that we would be having the issues that we have with veterans. anyone who ever worn the uniform, in my mind, or of -- are of a special breed. when i came back from vietnam, the country was in a different mode. we were heckled. we were talked about.

we were spit on. all of those things. but at that particular point in time, the government recognized that we were veterans and did everything they could do to help us. today that's not the case and in your piece a few minutes ago, everything that the president said, everything that he has said is not backed up by any kind of action at all. >> one thing that is backed up is it's looking like guys are going to get a pension cut. we've got statistic, a veteran who retires at age 42 could face a $72,000 loss in benefits over a period of time. that doesn't seem right. >> well, absolutely is not right. again, that verges on being criminal. you don't take vets that have lost limbs, that have lost their sight that, have lost their hearing and some cases folks that have lost their entire face or burned beyond recognition and to stand at any group and say we're going to be here for you

33 gallons for other uses. mainly by using the natural gas obtained during fracking instead of burning coal. here with more on this is the founder of the center for industrial progress, alex epstein. good morning. how are you? >> good morning. i'm doing great. >> this is so interesting. the conventional wisdom of the mainstream media and some of these stats that are put out is that fracking wastes water. but we have this new study that shows the opposite. explain to us the significance, please. >> well, i find interesting your comment that the frackivists will be weeping because it's true but isn't that weird because if they really cared about water, wouldn't they be happy? if we look at the full context of water usage, it becomes clear this is just a rationalization, this is another fracking fable. so i brought with me a prop, which is a 20-ounce bottle of water. with 20 ounces of water, you can get the equivalent in natural gas of a gallon of gasoline.

guess how many of these it takes to get the equivalent in gasoline of ethanol? it takes 14,000 of these. 14,000. you can check it out at industrialprogress.com. why is there no outcry over ethanol? again, water, this whole water thing is just one of the latest fracking fables. it started out with this is a new untested technology and it turns out no, there are advances and then contaminated ground water, then people discovered oh, wait. it's a mile below the ground water. now it's oh, there is too much of it. and if you look at the full context, it's okay, this is .1% of water usage and one fifth of what we use on golf course. this is just pure hysteria opposing a really exciting technology. >> how does hydraulic fracturing or fracking help our water supply? how does it help? >> well, first of all it helps everything in life. energy a fundamental enabler of

peter johnson, thanks for filling in for brian and we've got anna in for elisabeth. elisabeth will be out in times square tomorrow night at midnight. >> are you? >> getting ready for that. that's great. >> with bill hemmer. >> let's talk about this. over the weekend the "new york times" came out, they did an investigation in what happened at benghazi and as it turns out, the stories that those republicans have been telling us for the last year or so, all wrong, according to the "new york times," david kirkpat trick. he talked to a bunch of people, sources on the ground. that video did have something to do with benghazi attack, but no evidence al-qaeda or any other terror group was involved. what's interesting is adam housley, fox news correspondent, has got a piece up right now on foxnews.com and he's speaking to some of the special operators who are on the ground that night. they are angry because they say the "new york times" story is a complete lie. the quote is, it was a coordinated attack. it is completely false to say

anything else. it is completely a lie. that from people who were there that night. not whomever the "new york times" talked to. >> adam housley sources are saying there is no way this was spontaneous when there is a guy watching the gate and a guy pointing, other militants to go there. >> waving them in. >> and somebody else running and somebody else shooting. it was organized chaos, is the idea that the sources are painting for adam housley, very different from what the sources are telling the "new york times." so they've found people to set this other narrative. >> top lawmakers, democrats and republicans, have taken on this "new york times" report as being accurate based on the oversight and intelligence information that they have received. congressman darrell issa and congressman rogers have said no, it appears this was terrorism, al-qaeda was involved and the witnesses on the ground have

verified that. >> sure. so the big question is, why did the "new york times" do this report, an exhaustive report, talking to a whole bunch of people over there, and dropped it the weekend after christmas? some are saying, well, maybe it could possibly be to help hillary clinton who probably will be running for president next time around. here is representative mike rogers, republican from michigan, on whether or not the "new york times" report had some sort of political ax to grind. >> do you think there is a political motivation to this times report? some people have suggested, this is trying to clear the deck for hillary clinton in 2016. >> i don't know, but i found it interesting that there is this rollout of stories, including susan rice who would go on tv and have a direct discussion on this when we still have an ongoing investigation in the house intelligence committee. >> because if they say that al-qaeda didn't have anything to do with it, then it fits the

narrative, the obama administration was trying to push during the last election cycle that osama bin laden is dead, and al-qaeda is on the run. but there are multiple sources that are quoting, saying ahmed cootala is leading a militia group that has ties to al-shariah and other groups associatessed with him are not want to go turn him in because it will ruin their game, too. they're all connected to al-qaeda. >> but it's interesting, donald trump touched on it. year and three months later, the people have still not been brought to justice, even though we know who they are. a year and three months later, no congressional investigation. certainly the "new york times" hasn't determine what the commander in chief was doing the night that this happened. and based on one intelligence study after another, there has really been in terms of the highest echelons of the state

department, no punitive action taken as to allowing this to happen in the first place when they had warning. >> to your point, peter, this still does not address the question, why, after the ambassador asked for more security, why didn't they get it? also, why wasn't there a flyover? they said well, the assets were too far away. they could have buzzed them with a drone. there are still a whole bunch of questions not answered. does it look to you like the "new york times" is trying to help hillary? is there a political motivation or do you think it's just good, honest, reporting trying to get a side of the story we have not heard so far? what do you think? e-mail us. you can twitter us, facebook us, foursquare us, anything you want to do. >> also in the next couple of days -- >> whatever foursquare is. >> you can check in somewhere. >> that's the newest. >> january 1st, a lot of people will be trying to go to the doctor and may find out they're not covered. they may head to the pharmacy to try to pick up meds and find out they're not able to get that.

in the wake, we're talking about december 31st and the enrollment numbers. the obama administration saying hey, we're doing great, everybody. we've got 2 million people enrolled. but you know what? that number is pretty short of their goal, which was 3.3 million that they wanted by december 31st. very short of their 7 million that they're asking for by march. >> if you add up the numbers or subtract the numbers, you say well, assume 5 million people lost their coverage and assume that 2 million people have coverage now. so is that a net loss of 3 million people? do we have 3 million people that don't have coverage? >> right. and of the two that you were talking about right there, of the 2 million, how many of those people are actually now on state medicaid rolls? >> a huge percentage. >> absolutely. and they're not going through the exchanges. they're getting the old-fashioned medicaid instead. dr. gottlieb is a physician and

a resident fellow at the american enterprise institute and he details something that a lot of people don't realize and that is -- we've heard so many problems with the back end. after people add something to their cart, there is a disconnect between actually getting coverage and being in kind of a no man's land where you're just floating around trying to figure out what happens. listen to the good doctor. >> people are going to go and try to access health care snot going to be insured. what the administration has said to the insurance companies is they want the insurance companies to float people through the month and if people think they're insured, cover them through the month and the administration said we'll reconcile with the insurance companies later. so there is going to be another reckoning february 1st. >> in other words, there are a lot of people who will show up, they're not going to be covered because of one problem or another. but the government is just saying to doctors and insurance companyies, we'll run a tab.

let us know whatever that costs. i'm sure we've got cash in the back we'll be take it out. >> when you consider the human toll of showing up and not having coverage, we can talk about that in an objective way, but to actually experience something like that, i think would be terrifying. >> yes. especially if you're really sick. if you're really dealing with something serious that, could be a life changer, game changer for some people. >> dr. siegle said he's not going to turn patients away that need medical care. but there are some physicians who will. >> and it starts day after tomorrow. >> we start to see more of the -- also to mention, there has been a lot of growing pressure for president obama to name a ceo to try to clean up the affordable care act by the senior advisors has told reuters no, we're not even thinking about that. that's not even on the table. do you think that would even help? with somebody who knows the insurance industry and has had years of experience, would that

help or is it past the point of no return? >> good question. let us know. should there be a ceo for obamacare. donald trump said he would not take on the job because he did not believe in obamacare on our show an hour or so ago. >> you got to believe in the product. >> absolutely. let's hear from you. other headlines to talk about, a fox news alert. while you were sleeping, terror strikes again in russia. bomb blast tearing through a bus, killing at least 14. officials saying it was the work of a suicide bomber. russian president putin now calling for increased security in the region. it's the second terrorist attack in two days and this one caught on camera. yesterday a suicide bomber set off an explosion inside a packed train station. at least 17 were killed and dozens of others injured. officials saying the two attacks possibly connected. no one has claimed responsibility for either bombing. this coming months after a chechen rebel leader called for attacks on civilian targets, including the olympics in february. bombings happening about 400 miles north of the games'

>> good morning, steve. >> i don't know why you guys on capitol hill are wasting your time with these committee hearings because the "new york times" sent a guy over there and talked to a bunch of people on the street and they solved the case. you're wrong. >> well, you know, we can't really give a lot of credibility to that report. we've been talking to americans that were actually on the ground over there and participated in defending against these attacks and he went over there and talked to the libyans that had great knowledge of this and we think could have even participated in it. >> sure. and wasn't it for the libyans that they talked to to tell the truth. >> they're not. almost like a mother asking a child, did you do this, johnny? oh, no, i didn't do that. we've been able to see communications from some of these folks, know what they were

saying and you can say one thing when somebody knows that you're listening. but when they don't know you're listening, you may say something totally different. >> the "new york times" said that there is no evidence that al-qaeda or any other terror group was involved. but reports i've heard, the house right next to the consulate was observed by al-shariah, which is an affiliate of al-qaeda. al-qaeda lived right next door to the consulate. >> yeah. steve, we don't have any knowledge of who owned the house next door, but the reports by the "new york times" was -- i don't know why they put it out unless it was for political reasons. we thoroughly dispute that story as far as the link to al-qaeda. >> you just brought it up, perhaps they put it out there for political reasons. what kind of political reasons? >> well, you know, i think this thing is eventually going to

fall back on the state department when all the truth gets out there. of course, secretary clinton was in charge at the time and there is just now a lot of rumors going and pushing about her running for president in 2016. so i think they're already laying the groundwork. we are not quite as used to this kind of political machine as the president and the clintons have. so i think they're just laying the groundwork, trying to absolve her from the lack of security that was sent over there, the number of requests for security that was turned down. so i think they're trying to take the pressure off her and the administration, quite frankly. >> sure. your comments echo what our e-mailers are saying. they say sure kind of smells fishy. before you go, i want to make sure i understand, you feel from

what you have heard behind closed doors, and i know a lot of it is secret, but the "new york times" says al-qaeda nor other terrorist outfits involved. is that wrong? >> yes, sir. absolutely. absolutely. >> all right. that's what -- and accelerated by the video? >> no. no. the video never came into play. in fact, if you go to some of the research or the people that study these media, social media outlets and stuff, there was nothing even on the radar in libya or in benghazi actually until the next morning. so this had nothing to do with a video. watching a video doesn't give you instructions to how to shoot five mortar rounds and the last three of them be within a five meter radius. like some of those guys told us, look, if you'd have been on the mortar range and got that close,

right. supreme court justice sonia sotomayor will hit the button at the ceremony. you can watch elisabeth hasselbeck and bill hemmer live from times square. you got to hear this. now here is a story of a pregnant nurse fired for refusing a flu shot. the hospital that employs her requires the shot for any employee that treats patients. but she was scared of potential side effects on her unborn child because she had miscarriages. she's here live to share her really compelling story. good morning. >> good morning. >> so you were asked to take the flu shot and you consulted with your doctor and what did your doctor say with regard to you taking the flu shot and tell us about your history, if you could. >> sure. i've had two miscarriages this year. we have one healthy son and after he was born, we had two miscarriages. i was more anxious this time around with this pregnancy.

i did my own research when it came to the flu vaccine, talked to my health care provider about it and ultimately obtained a letter from my og practice, as well as from my family care doctor requesting that i be exempt from the flu vaccine. >> and your doctor said that it would be medically hurtful or dangerous for you because of the anxiety and stress that it would create for your concern about taking the flu shot and what affect it could have on your unborn baby. is that right? >> that's what my family care doctor said, yes. >> and so we know and i've been looking at some of the research here this morning, that stress hormones can play a role in terms of miscarriage. was anybody sympathetic to your view point with regard to the flu shot? >> in response to that letter, my employer replied that was not a medically necessary reason to be exempt from the flu vaccine.

so no, i was told that wasn't a good enough reason. >> so what happened as a result of your refusal to take the flu shot based on doctors' orders? >> ultimately i was fired. i was suspended for five days and told if i didn't obtain the flu vaccine during that period, i would ultimately be terminated and that's what happened. >> so you were fired right before christmas? >> december 17th, yes. >> let's hear what horizon health care services has to say about this whole case. for our employees who are pregnant, we believe that the flu vaccine provides a safe and effective way of protecting a mother and her unborn child from a serious illness. but that doesn't go to the heart of what you were saying. you were saying i want to keep the child that i'm holding at this time and i'm afraid that if i take this flu shot that it's going to affect this pregnancy. what do you say to them in a human way, now that you're out of a job based upon you're

trying to care for your child and your own health? >> i feel i did the right thing. i stand by my decision even though the consequences have been great. no one can tell me that this is safe for my unborn child simply because the studies haven't been done. you can open the package insert and read that for yourself right there. it says studies have not been done on pregnant women. we do not know the risks on the unborn child. it should ohm be given to pregnant women if clearly indicated. i feel -- we live in day and age we can do our own research. i looked up studies and government web sites. i looked at this very intensely. i didn't make this decision lightly. so i still believe i did the right thing for me and my family. >> as our last question, what are you going to do about it now >> just get the word out there. i want people to know that you should be able to make the decision for your own body, for your own baby and i carry on, i move on to the next thing.

that is a tough looking truck. >> that's a great truck. so on the sunday shows, ted cruz gave an interview to abc jonathon karl and essentially asked him about the shutdown and said, you know what? you've had a little bit of time to think about this. the republicans shouldered a bunch of the blame for this and now do you think that this was a bad idea? so they're kind of playing gotcha with each other. senator ted cruz doesn't bite. take a look. >> you've had a couple of months to think about this whole government shutdown strategy. now that it's over in hindsight, are you prepared to say that it was a mistake, it wasn't the right tactic? >> i think it was absolutely a mistake for president obama and harry reid to force a government shutdown. >> you know even john boehner has said this was a republican shutdown. >> look, i can't help what other people say and john, i understand that in the media, every day the media reported the republican shutdown. >> come on, we're a couple months away, the only reason why this happened is because you insisted, republicans insisted

that obamacare be defunded as a condition of funding the government. if you took away that insistence, there will be no shutdown. really. >> you got conservatives who stood strong and said let's stop the train wreck that is obamacare and you've got democrats in the middle of the shutdown, president obama called every senate republican to the white house, sat us in a room and said, i called you here to tell you we're not going to negotiate. we're not going to compromise on anything. repeatedly republicans were compromising, trying to find a middle ground and repeatedly democrats said, no compromise. shut it down. >> so since the shutdown and then in the aftermath of the obamacare rollout and the web site debauchle and all that, we've noticed a huge switch in poll numbers, a huge swing from president obama support approval rating, same with democrats. we're seeing some of them run for the hills. is this an effort of the main stream media to bring it back to an issue that had the public a little bit miffed? >> senator cruz is quite a communicator in spite of the smirking and the come on and the really and the skepticism that

good morning. he signed a professional baseball contract for $2 million. so why did this pitcher take a second job as a substitute teacher? alex myer from the minnesota twins joins me now. good morning. how are you? >> i'm doing well. how are you doing? >> doing fantastic. when i hear that you just signed

this $2 million contract, i mean, when you're substitute teaching, you are got to be making 60 bucks a day or something like that? what made you decide to do this? >> i went to college and initially i wanted to be a teacher coming out of there, hoping i'd have the opportunity to continue my baseball career. but you need to have a back up plan and everything with that. so i went to college for three years and then like i said, signed and my first offseason at home, i was used to having me time filled going to classes and then having practice and staying pretty busy. when i was home in the offseason, you're pretty much on your own with your workouts and everything in that nature. so my mom threw out the idea, she works at the superintendent's office in my hometown, she said if you want to pursue being a teacher some day, maybe you should look into substitute teaching during the offseason. that's how i got started with it. >> a lot of professional athletes in the offseason catch up on things like movies and "breaking bad" and mom's home cooking. what kind of impact are you

having on these young kids? how are you received by them? >> i hope i'm having some sort of good way. but it's fun. it's something that i really enjoy. i think the kids enjoy it when i come in and i'm able to try and help them out in some way, whether it's being around them, somebody new in the classroom or something i can actually help them with school wise and show them a different way of doing something which, i don't know, maybe i am, maybe i'm not. that's what i'm trying to do. i feel like making a difference is important. >> so often when a substitute teacher is in the classroom, the kids walk all over them. i can't imagine they disrespect you like that. what type of lessons are you teaching them being the strong male figure? >> it's funny, it wasn't too long ago that i was in high school. it makes me feel bad because i remember how i used to act sometimes when we had substitute teachers. at this point i try -- i tell them, i understand the things you're doing. i'm not too far out of it. for the most part, they're good. they laugh. i like to have a good time with them.
