on the stories of the t last year. many of them are ongoing. tonight we begin with the signature legislation. the law that overhauls the health care system. to date, nearly 6 million americans and maybe more have seen health insurance cancel under obamacare despite the repeateded presidential promise that one fact-checking website has labeled the lie of the year. >> you've got health insurance, you like your doctor, you like your plan, you can keep your doctor. you can keep your plan. >> if you like your doctor or health care provider you can keep them. >> everybody will have lower rates. >> if you like your doctor, you will be able to keep your doctor, period. this is for people who have health insurance. you will save money. >> if you like your health care plan, you will be able to keep your health care plan, period. >> obamacare has been wonderful for america. >> if you like your health care plan, you can keep that, too. >> if you like your doctor, you keep your doctor.

if you like your current insurance, you keep that insurance, period. end of story. >> the nay sayers and scynic s doubt we can do it. >> it was at the heart of the sales pitch for obamacare. >> this is not a federal government issue. this is a people issue. >> us alone. that's all we would ask. leave us alone. >> four years later the nay sayers are seeing their worst fears realized. >> i was infuriated. the president kept saying if you like your plan you can keep your plan. your premiums will go down. in fact, the letter is contradictory to that. >> debra got a letter from anthem blue cross cancelling her existing policy and offering her a new one that would hike her monthly payment from $292 to

$484. >> it's forcing you to walk the plank. >> she's not alone. andy and amy of kentucky received a letter from their insurance agency humana informing them that their monthly premium would triple from $333 to $965. >> this is a high deductible plan where i assume a lot of risk for health insurance for my family. nothing has changed. our boys are young and healthy. my wife is healthy. i'm healthy. nothing in our medical history changed to warrant a tripling of the premium. >> obamacare requires policies sold this the individual market to cover what the law deems essential services. preventative care, rehab and maternity services. basically it is no longer up to you to choose what is best for your family. the government chose for you and the new policies come t t at a price. an estimated 14 million people

purchase their own coverage on the individual market because they don't get insurance through their jobs. experts say millions could lose their coverage despite the president's repeated promises. when confronted with the cancellations and rate hikes those defending the law scrambled for explanations. >> i don't remember saying everybody in the country would have a lower premium. >> there are certain types of crummy plans that will be illegal. >> they should be allowed to keep insurance at least until it expired and then buy plans through the exchange. i think that's the mix-up, a transition issue. it's difficult for a lot of people. i'm sorry about that. >> so far we have seen little appetite in congress for a fix to obamacare which leaves open the question of whether the president can still live up to his promises. >> it will bring down skyrocketing costs, save families and businesses money. it will save government money.

>> by november after weeks of denying that obamacare caused a mass cancellation, the white house changed its tune. the president issued an apology of sorts and proposed a so-called fix. the administration would allow the cancelled policies to be reissued. but whether state insurance commissioners and insurance companies agreed was another story. it the turns out the fix has fallen short of providing needed relief to americans kicked off their plans. joining me now, our fox news digital politics editor marc thiessen, a fellow at the american enterprise institute and former speech writer for george w. bush. i know there were warnings prior to obamacare being passed. who would have thought it would have crumbled in its roll out phase as we saw in october and november now moving on to january which is another huge test. marc? >> the washington post gave the

president his worst year in washington award. i would not be surprised if he gets it two years in a row. tomorrow is january 1. le in a few hours, obamacare goes from theory to reality. you have 6 million people who had their insurance cancelled. all the horror stories you showed of people getting letters become horror stories of people who are patients -- cancer patients having coverage disrupted, sick children losing their doctor. there are people who right now as we speak have health insurance that at the stroke of midnight will lose it. that will be -- it goes from a political disaster for obama to a humanitarian disaster for the country. >> it's not that none of that was foreseen. that wasn't the real story people were hitting when they were talking about obamacare. we talked about the individual mandate. we talked about the independent advisory board to oversee procedures. no one was really hammering the

individual insurance market will go away. the administration knows this. they are banking on it. they will devastate these policies because they have to for this law to survive. that was -- when that started breaking in october and november, america started paying attention with their jaws dropped. it changed the way they view this president. >> well, firstly, happy new year, counselor. >> happy new year. doesn't feel happy on this topic. >> it's still a new year full of promise and hope. >> okay. >> but here's the other thing. you asked a question. who knew? who knew? they knew. this was the plan. this was the idea. the problem was they were bad t at the internet and couldn't make the online home and the system. they had three years, $600 million. they couldn't find a way to build a system so people could

sign up for the new policies. remember the pepsi challenge? people said, hey, you didn't know but you were drinking pepsi the whole time. that's what he wanted to do here. take away your old plan. you would say, hey, is this obamacare? it's not that bad. the problem was with they couldn't make that. it exposed the problem, exposed those individuals to loss of coverage. it highlighted the difficulties. then you have the sticker shock which was an inevitable part of this. the short answer is what sounded good in the think tank, in an ivory tower, behind closed doors at that time white house in application with real human beings concerned about their care and families didn't look so good. >> marc, do you feel the worst is over for obamacare? or do you feel that 2014 is going to bring -- obviously it will bring some troubles. do you think it will bring more troubles than we have seen? >> the worst is yet to come. we have had 6 million people in

the individual market have their plans cancelled. an unknown number of them won't have insurance on january 1. then the second wave comes. you've got about 50 million people in the employer-based market who are either going to have plans cancelled or will see them change dramatically with higher premiums, higher deductibles. there was a poll and they have been talking about these people that they are not worried about because they are unaffected. half the people say now their coverage will get worse or they will lose it and they blame obamacare. the ticking time bomb of employer-based people will blame obamacare right bf the election. >> how do you think the president is looking back at 2013 when it comes to obamacare in particular? >> it's the republicans' fault.

it's complicated. he's frustrated, et cetera, et cetera. let's never lose sight of this. for this administration, they will never lose sight of this which is it's always a t matter of trust. it's always a hattmatter of tru. everything is too complicated for regular folks raising families, trying to work, tying to live to track all of the gobbledegook that the government does. okay, fine. every election is a character election. the president deceived people and told them something he knew wasn't true. he won re-election and the confidence level plummeted. getting out of the hole, i don't think it happens. >> they believe with health care.gov working better people will see the cadillac plans -- their description. they will see the pepsi, love it, guy the pepsi and it will turn the numbers around. we'll see. happy new year. >> happy new year, megyn.

april 15, 2013, is the day this nation will never forget. the serenity of the t boston marathon was shattered after two explosions near the finish line. the explosions were bombs made from pressure cookers loaded with shrapnels. 250 people were injured, three killed including 8-year-old martin richard. 29-year-old crystal campbell and 23-year-old lu lingxi. the fbi released a picture of the suspects kicking off a massive multi state man hunt. that night m.i.t. officer sean

collier was found dead in his car after he was shot by the suspects for apparently no reason. the brothers car jacked another man before getting into a shootout with police that left t the older brother dead. a man found tsarnaev hiding in a boat in his backyard and called police. in a few hours the 19-year-old was captured. he's pleaded not guilty to some 30 charges. in the end there is a real chance he could pay for his alleged crimes with his life. we'll find out more in the month of january. joining me now, a columnist for the boston globe who was there when it happened and has been with covering the story ever since. kevin cullen, good to see you. one of the things you remember the most about the day is the effect it had on the first responders including the poor man who was there when little martin was killed.

>> i think you are referring to sean o'brien who is a firefighter in boston. a great firefighter. great guy. i always describe that scene when the bomb went off, the guys from ladder 7 from the nearest fire station to the area were actually admonishing a bunch of college kids who put a hibachi barbecue on a porch overlooking the marathon scene to shut it down. then they heard the bombs. one of the firefighters, benny upton had just done three tours as a marine in afghanistan. when he heard it, he knew it was a bomb. he said, "bomb." they ran around the corner. another marine tommy hughes was with them from ladder 7. sean o'brien ran around the corner from ladder 7 and he came

to the scene. he ran around the corner and he was facing his neighbors, the richards family. bill richards, denise. denise was lying down. he saw bill yelling. bill had been so stunned by the bomb he probably couldn't even hear. he said, i can't find denise. he was talking to his neighbor, to sean o'brien. i say, megyn, boston is the smallest big city in america. i think that captured it. when sean o'brien, the firefighter, came around the corner and knelt over young martin, he was not just looking at a young 8-year-old boy who had lost his life to terrorism. he was looking at a young boy that was unfailingly kind to his daughter ava in the same charter school they went to. that's how small this town is. >> see his beautiful face? the globe did a long report on

how the tsarnaevs had parents who were not mentally well, about how the older brother heard voices and the younger brother may have had issues. there was a lot of pushback on that saying, who cares? you said it doesn't matter why they hate us. they just do. what do you think is the takeaway here? >> i would defend my colleagues who did that story. in fact, i would point out that one of the reporters on the story's name is david f the elapov. father al is a lovely guy and was murdered by al qaeda on september 11, 2001. so there will be suggestions that the globe story was soft on terrorism. i would defy anybody to go to dave and say he's soft on terrorism. that said, when i wrote that column i was sincere when i said i don't think that we can

understand the motivation and learn that much from what happened on that day. i think -- and i must say that long and detailed piece done by my colleagues at the globe explains that, first of all, these people didn't belong in the country to begin with. they didn't deserve political asyl asylum. second of all, they were pretty messed up as a family. there was a lot of dysfunction there. there was in grasp for something they found meaningful. i guess at the end they believed this sort of embrace of radical islam, tamerlan in situations attacked people who let their kids read harry potter saying there was something wrong with that. attacked an imam who said martin

a legal drama played out in florida so loaded with racial pressure the president felt the need to weigh in before and after the verdict. george zimmerman admitted to shooting and killing 17-year-old trayvon martin in february of 2012 but he argued it was self-defense the. he tried for -- he was tried for second degree murder after critics claimed the neighborhood watch volunteer targeted the teenager because he was black and demanded justice for trayvon. trace gallagher has a look back. >> reporter: the prosecution began the trial of the year with with a flurry of obscenities relaying what george zimmerman told the police dispatcher minutes before he t shot trayvon martin.

[ bleep ]. these [ bleep ] always get away. those were the words in that grown man's mouth. >> reporter: the defense began with a joke. >> knock-knock. who's there? george zimmerman. >> reporter: the joke fell flat but the defense recovered by catching the prosecution's star witness rachel jantal who was on the phone with trayvon martin before the shooting in a number of inconsistencies. >> when you were talking about that sale thing again instead of saying what are you talking about, it became what are you doing around here? correct? >> yes. >> reporter: a large part of the t case hinged on who started the fight and who was heard screaming on a 911 call made by a neighbor. [ screaming ] >> do you think he's yelling "help" is this. >> yes. >> reporter: the most compelling witnesses identifying the voice for the mothers of both the victim and the defendant. >> who the do you remember that

to be? >> trayvon benjamin martin. >> whose voice was that? >> my son george. >> reporter: in the end the jury decided the shooting was justified and found not guilty. >> we the jury find george zimmerman not guilty. >> reporter: zimmerman left jail but stayed in the headlines. he helped rescue a family after a car accident, got caught speeding twice, and there was this frantic 911 call from his wife shelli accusing him of threatening her with a gun. >> he said, step closer. he was threatening all of us with a firearm. >> step closer and what? >> he's going to t shoot us. >> reporter: she lated recanted the story. that was followed by another 911 call, again involving a gun. only this call made by his girlfriend. >> he just broke my glass table. you broke my sunglasses and you put your gun in my [ bleep ] face and told me to get the [ bleep ] out. >> the girlfriend said she may

have misspoken to police and didn't want zimmerman charged. zimmerman's wife has now filed for divorce. trace gallagher, fox news. >> zwrowhen you see that knock-k joke, god, we watched on the set. we just recoiled. yet they won. the defense won t not with with standing bone-headed moves like that. >> the state didn't prove the case beyond a reasonable doubt. yes. ultimate ultimately we were so disappointed because the defense team was supposed to be the ethics coming of the johnny cochrane team. >> the next dream team. >> here's what happened. the prosecution didn't the prove the case but a lot went on behind the scenes here. the first prosecutor didn't file the charge s.

when you have law enforcement trying to prove the case for the second prosecutor, if you just turned on the tv and weren't following the news you would think they were on the defense side. now in the wake of his troubles after the verdict, the not guilty verdict people think he was acquitted and he's a bad guy. so people think that's the wrong result. you can't make the leap. >> i was thinking casey anthony, no one's heard from her. >> she has her little viral -- >> most people acquitted of homicide disappear. the only other person who reappeared, o.j. >> guess what happened to him? >> these are multiple interactions with the law. >> get rid of the speeding -- >> hold on. >> two women calling 911. >> two 911 calls involving a

gun. >> his defenders say he may be suffering post traumatic stress. you have both tried criminal cases. does that happen? he was so in the center of the national firestorm. all the people talked about him. could that cause somebody to behave this way? >> it's not an excuse. >> is it an explanation? >> before trayvon he had domestic violence incidents. this is just a guy that a part of him wants to be a police officer. he loves interaction with law enforcement. he loves being in the spotlight. i think he's suffering from not being in the spotlight anymore. he was in the news every day. >> interesting theory. last word. >> they have all the charges and never actually brought the charge against him. just because the women recant doesn't mean charges shouldn't be brought. >> they must not have had the goods. great too to see you. >> happy new year!

welcome back to the "the kelly file" special 2013. a look back at some of the t major scandals that rocked the white house this year. more than a year after the deadly terrorist attack on the u.s. facility in benghazi and the obamacare administration continues to be dogged by complaints of a possible cover-up.

>> the fact is we have four dead americans. was it because of a protest or guys out for a walk who decided to kill americans? what difference, at this point, does it make? >> today lawmakers are still demanding documents and the victims' families are waiting for justice. americans are waiting for answers about spying after a report revealed the nsa is collecting millions of phone and internet records. edward snowden reveals himself as the source of one of the biggest government leaks in history. >> anyone could get secrets and pass them on the open market. >> i will not scramble jets to get a 29-year-old hacker. >> in may we learned the irs was targeting groups for scrutiny. she still refuses to answer

questions. >> i have decided not t to answer any questions today. >> just three of the big scandals plaguing the white house in 2013 and beyond. look at the picture of president obama. he looks so sad. these are the scandals. joining us now, president and ceo of whitman strategies and monica crowly. he probably is sad. which of these do you view as the most significant? >> i think the irs scandal is the most dangerous scandal in u.s. history. here is why. any time in the past the irs has been used as a political weapon against political opponents it's always been elite versus elite like the kennedys against nixon. it was always directed toward other elites they see as a political threat. this is what makes it dangerous to the fabric of the country. the irs is being targeted and

used as a political weapon against regular, ordinary americans in order to silence free speech, intimidate conservatives. anybody who had opposition to this president and his agenda. >> she's wrong again on this. here is why. to quote the bard this was much ado about nothing. what happened was the groups targeted were tea party groups and progressive groups. the ranking member of the house oversight committee obtained a memo from july of 2010 that showed, in fact, that the irs staff was instructed to investigate groups with progressive names and tea party names. he uncovered the guy, started labeling groups to identify it as a conservative republican and said the white house had nothing to do with it. issa's report showed no wrongdoing. this is a lot of hoo-ha. >> there is no -- >> that's not what hoo-ha means. keep going.

>> happy new year. there is no moral equivalent between hundreds of conservative and tea party and religious groups targeted and less than five rate of growprogressive gr. this was using the most fearsome arm of the united states government. >> the sound bite we ran of hillary clinton on benghazi. did she help or hurt herself? a lot of people think she wanted that on the record. do you think it helped her or has it hurt her? >> anything bill or hillary clinton says is calculated. those words were designed to have an effect. i'm sure she planned to say that. she probably thought in the moment it helped because she put distance between herself and the event and the administration. in retrospect the it is hurting her. when you look at the poll numbers on her. approval numbers, favorability they are in decline.

>> but still good. >> they are. but they are in decline. most people look at benghazi and say that statement showed -- >> does it stick with her if she runs? >> the tragedy is four americans lost their lives. that's what the tragedy is. the fact of trying to make it a political witch hunt against the clintons or the fact that republican snars like lindsey graham are using it to block a nomination and lose the filibuster for the minority that's the problem here. to suggest that this is a cover-up is just incorrect. >> if it is not a cover-up why have the cia operatives sign a second nondisclosure agreement? then on the day they were memorializing their fallen comrade s they said, we want y to sign another one. what more is there to the story? >> i hope the operatives have to

his very public displays of humility, kindness and his outreach to the poor and disillusioned convincing millions to take a fresh look at the catholic church. it earned pope francis time magazine's person of the t year. lauren green has the report. >> reporter: cardinal jorge bergolio emerged as pope francis the new leader of the world's 1.2 billion catholics. it followed the shocking resignation of pope benedict xvi. from the start francis showed his would be a different pontiff t cat. more humble, less judgmental. he lives in spartan dwellings and at easter included women in the washing of feet. >> his message is so simple. it gets back to the core of the catholic church.

jesus and his gospel. >> reporter: his popularity reached a fever pitch in rio causing a security nightmare as he waded into the crowds. >> the pope is continuing to bang the drum about inequality and how the advanced world has to help the developing world and the poverty, hunger and homelessness on absolute scan call. >> reporter: on the trip, francis made his first statements to journalists asking about the alleged gay lobby francis said, quote, if someone is gay and he searches for the lord and has good will, who am i to judge? he was quoted later saying the church had become obsessed with abortion and homosexuality and contraception. >> it's important to remember however that this pope is no changing dogma. he's changing emphasis. he's changing style.
