"the new york times" now says they had a reporter on the ground that night of the terrorist attack in benghazi. their reporter was even talking to the attackers. you've got to hear this to believe it. it's coming up. >> a new year, a fresh start even for this guy. >> yes, i have smoked crack cocaine. but, no -- am i an addict?

doubling. while they are doubling, the number of people the white house has said will be involved in it is shrinking. >> we heard a long time ago and for a long time that the seven million goal signup was there but look at the numbers here. 4.7 million plans have been canceled. unreal. then 2.1 million plans have been added. so they're giving us that number of 2.1 which seems suspicious to some. but that whole -- remember the seven million, people that actually pay for the program. longtime advisor for president, part his transition team, a white house advisor now, he basically said that seven million was irrelevant, not really there. take a listen. >> well, that was never our target number. that was a target put out by the congressional budget office, and it's become the accepted number. >> kathleen sebelius has said seven million people -- >> that was because it came

from the congressional budget office and become an accepted number. there's no magic to the seven million. what there is magic to is that in the month of million americans signed up for insurance. not because they had to. they didn't face a penalty if they didn't. they signed up because they wanted insurance on january 1. >> there was magic to the seven million number. they had to have seven million people sign up for this thing to work. and if they didn't have that number with a lot of young healthys, the things will go into a death spiral and implode. >> the c.b.o. is gospel if you like what they say. when you don't like what they say, you say that is c.b.o. numbers. >> kathleen sebelius many times said seven million is the magic number. here's the big thing you should look for and everyone will know about. if they sign up for

insurance do they actually have it? i hope you don't get sick if you sign up for it, but if you get sick when you need some type of medication you will find out at that point do you have insurance? there are already major changes saying you just show me that you signed up, don't worry, i'll postpone the payments. >> some people don't know. >> the fulfillment, the back end of the website is not effective by almost all accounts. now in about two separate states they say only 50% of the people have actually made their first payment. >> in the state of iowa they asked 16,000 people to reapply because the paper work wasn't in. >> people on capitol hill were told don't trust the website. call the insurer. some people think they've got insurance today and they actually don't. so beware. over the past weekend "the new york times" had a big article about what really happened in benghazi. david kirkpatrick did this big piece and what it said

was no al qaeda was involved and a video had something to do with it. republicans and democrats on both sides have since said that is simply not true. there were terrorist groups with links to al qaeda there and the video really did not have much to do with it. >> enter al shah rei can't, the name -- al sharia, the name of the group that did the killing. this group has a leader, there are reports by the libyan tribune which does not come to my doorstep but i assume it is the newspaper of libya, and they are looking to confirm it now that the head of ansal al sharia has been captured in tunesia. that would be great news. having said that, if you ask him is he an al qaeda affiliate. he'll say yes. we're not saying al-zawahiri is saying kill him. we already know about the group. anybody with competence knows al sharia takes their

template and continues to have a loose association. >> americans were killed, including ambassador chris stevens and david kirkpatrick contradicts a report that went out earlier in "the new york times" and making so many question what actually happened here. he had this direct tweet saying we had a reporter on the scene that talked to reporterrers during the attack. still invaluable. >> the reporter was of libyan descent and was there and talked about who was at the gate and what they were telling him. the question that comes to mind is if you had a reporter at the scene and you know americans were in danger and you're working for "the new york times." did you have a phone, number one and did you call for help and announce what was happening? >> clearly what they're saying is somebody that works for "the new york times" knows the identity of the people who murdered our americans. that's kind of a headline. have you seen that headline in "the new york times"?

minutes after the hour. moments ago the director of a hospital where former israeli prime minister airline sharon is being -- ariel sharon is being treated says his life is in danger. the 85-year-old has been in a coma for eight years. his family now at his bedside where he's listed in critical condition. we'll watch the story very carefully for you. brand-new video just coming in of a chinese helicopter picking up the first passengers from a russian ship that's been stranded in antarctica. that ship got stuck on christmas eve after a blizzard pushed ice around it, literally freezing that ship in place. there are 52 passengers on board and it will take at least five chopper flights to rescue all of them. the 22 crew members will stay on board until that ice breaks up. >> if you haven't gotten enough of toronto's crack-smoking mayor you may be in luck.

rob ford filing for reelection later today. this is brian's favorite story of the day already. the mayor wrapping up the year by admitting to smoking crack cocaine. his lawyer believes his chances of being reelected on october 26 are excellent. the actor best known for playing will smith's uncle on the tv show the fresh prince of bel air has died. >> i'm not going to punish you, will. >> that's radical uncle phil, but it might work. >> james avery passing away following weeks of complications from heart surgery. alfonso ribera who played his son carlton on the show posted this on twitter. he was a second father to me. i will miss him greatly. james avery was 68 years old. in the meantime we've got a storm blowing in. >> good impact. maria will keep us updated. >> we'll run through every

three more high-risk detainees set free from gitmo while we were on vacation. what does this mean for our national security because we have a growing trend. how many at gitmo will be

allowed to go free? let's ask former pentagon spokesperson retired commander j.d. gordon. what just happened? >> happy new year. we released three from gitmo. they have been fighting a separatist movement against the chinese government for some time. we released them to slovakia. they were the last three wiggers and could easily go back to terrorism. about 30% of the detainees who left guantanamo have gone back to terrorism. we're talking about leaders of al qaeda, leaders of the taliban. a suicide bomber in iraq who killed 13 people. but here we go, president obama just released 11 detainees in the last month. >> how many are eligible for release and why aren't these being made public? why are we getting word after the fact? >> about 155 detainees are at guantanamo right now. of that number, close to 80 are eligible for release because the obama

administration when they came in, they had a top priority to close guantanamo, let the chips fall where they may. basically the with obama administration cleared basically half the detainees, these include body guards, terrorist financiers and president obama wants to let them go. under the national defense authorization act, unfortunately so many of those tough restrictions to transfer them out have been rescinded. in order for them to not come to the u.s. they are going overseas. >> we do remember the last years of the bush administration, the second term, some of these guys got out. many returned to terror. there was a much different political climate then. the pressure that was on president bush has not been on president obama. what's the difference? >> i think president bush was under a ton of pressure from the international community and human rights groups who, by the way, have been linked to a

qatari financier who has been giving money to priority, that shows the priorities for some of these human rights groups. nor president obama, i think it is self-inflicted. i think president obama thinks you can appease al qaeda. al qaeda wants to destroy this country, kill millions of people here, not just thousands. so president obama has basically made it a priority to close guantanamo, let the chips fall where they may. and i think that's very dangerous for america. >> isn't it amazing, our allies who are putting all this pressure because we aren't living up to american values because we put people who try to kill us in prison, that pressure seems to have evaporated and now it is just coming from the president's frustration because it seems he's been unable to fulfill a campaign promise. thanks so much. we'll continue to watch these men as they get out on our own behalf. straight ahead, she helped terrorist plot to kill americans but now the obama administration giving the lawyer who representedas

exercise, just like eating, is about quality. when we exercise with higher quality or more resistance, we use more muscle fibers, we get tired faster and we have to exercise less not because we're lazy but simply because we're working our muscles more effectively. >> what about when you're on the treadmill and it says you're in fat-burning mode after so many minutes? >> there's no such thing as fat-burning mode necessarily. what we want to do is cause a fundamental change in our body. rather than try to rip calories out of it. >> cardio is better for burning fat than resistance training? >> absolutely a myth. our body is great at burning fat if we can heal the underlying cause of obesity. cardio doesn't do anything to heal the neurological and hormonal causes of obesity. rather resistance training, interval training actually treats the cause. >> they're getting in there and triggering -- >> a hormonal change as well as reducing inflammation in your brain so your appetite reregulates and you only

eat when you're actually hopbgry and stop when you're full. >> exercise myth number three, in resistance training more is better. why is that a myth? >> it's about quality. you don't want to go to the gym every single day. if you are going to the gym every single day that means you are o you must not -- that means you must not be having an impact on your body because you're not sore every day. >> what if you're seeing results and you do a ton of cardio. are you going to hit the wall where you're not burning fat at that point? >> you may be able to see results just taking less of your time at the gym. it's not that you can't see results by exercising a lot. it's that if you exercise smarter, you may see even better results in less time. >> that sounds good to just about everybody here. you can eat more, you have to exercise less and it's all going to benefit you long term. jonathan is going to be back at us with 8:50 with smart exercising and tips

had -- people had a good time. as the new year came in here is something you probably did not realize and that is that the u.s. congress and the president have allowed 55 popular tax breaks to go out of business. they sunsetted at midnight on new year's eve. in other words, 55 different tax breaks have gone away, and essentially what we're all winding up with is 55 new tax hikes. a lot of people aren't talking about it. >> the first one here, we have the state sales tax deduction is one example here. you see this didn't make it through. it's going to expire today. this allows you, would allow you, in other words, to deduct state sales tax if your state doesn't have an income tax. >> a lot of people do that. >> 57 million people use this. this is going to anger many, i would assume, and they're hoping maybe this will get reinstated but it's not looking good. >> another one is -- >> that's big because

people were able to deduct money they spent on their own classrooms in the past, teachers were. and now the teachers will not be able to do that. teachers, your taxes just went up. >> the majority of my great friends are in special needs education. this abraham was claimed by more than 3.6 million teachers in 2010. they would go in their pockets and pull out nearly $400 on average for teaching their kids in supplies and now they can't deduct that. >> especially with budget cuts on schools any way. the energy efficiency deductions i'm sure that slipped by the obama administration because they love this. >> it has to do with insulation and green cars. if you have used that in the past, it's gone. also do you use mortgage insurance? do you have to have that? many, many people did that a write-down that allows home buyers that had to get mortgage insurance a deduction. if you claimed that in the past, it's gone.

>> ira distribution to charities also going to expire. people who are required to take minimum distributions from their retirement accounts, this would allow them to contribute to charities, that's going to expire. >> a number of companies who have hired veterans in the past have been able to claim credit, a tax credit for between 6,200 and 9, 600 per veteran. that they hired. that, another tax increase. >> most of these things are either actions or plans that have taken place a long time ago. so people have hired a long time ago. they sort of set the plan, started remodeling their homes, switching their electric units out and now they find out this is going to expire today on long-term plans they made thinking they'll benefit on the other end and they're not. not happy about it. >> happy new year? question mark like ron burgundy would say. 26 minutes before the top of the hour.

heather nauert joins us for this thursday that seems like a monday. >> does feel a little bit like a monday but a short work week for those of us returning from new years. got news now to bring you. former first lady barbara bush hospitalized with pneumonia. doctors at houston medical hospital giving her an excellent prognosis. the 88-year-old has been treated there since monday. hundreds of folks waiting in the snow to buy pot. colorado is now the first state in the nation to allow people over the age of 21 to buy weed for recreational use but there is a pretty big price tag attached to that. some shops charging $400 for an ounce and that's about four times more than street value. almost ten years after the cross was removed from the loss angels county seal there is a fight to bring it back. the older seal has a small cross on it. the new seal is without a

>> let's see if she denies it. >> is that the truth, maria? >> 10 to 14 inches of snow possible in boston and surrounding areas. incredible stuff expected here as we head into tonight and tomorrow morning. here's a look at what's going on now because we have a complicated weather pattern set up. we have two storms. one is in place across the midwest producing snow out there. then we have another one that's in place across portions of the southeast just producing rain. both of these are going to be merging later on today off the coast of the northeast and they will be intensifying and we're going to be looking at significant snowfall accumulations. right now winter weather advisory stretching across portions of the midwest up into parts of new england and winter storm warnings in effect in the northeast. this is where we're going to be seeing some of the worst conditions to some of the heavier snowfall accumulations and that in combination with strong winds gusting up to 35 miles per hour will be producing whiteout conditions and dangerous if not impossible travel

conditions across portions of the northeast. areas like new york city could get 6 to 8 inches of snow from the storm system. very tough evening commute as many head home from work tonight and during the overnight hours and into tomorrow morning. by later friday this storm is out of here and we're going to be looking at brighter conditions but it is going to be very cold. take a look at some of these lows for tonight. the actual temperature -- this is not a wind chill. the actual temperature in boston is going to tkrofp tkrofp -- drop to 3 below zero. factor in the wind and we'll be looking at dangerously cold weufrpl -- wind chill temperatures. >> i got a new snow blower for christmas. my last snow blower was my son. the 100th rose bowl, michigan state against stanford. second quarter stanford up

time of the day when more injuries happen? >> exactly. the other thing is knowing when to call it quits. the most accidents happen 2 to 3 p.m. that is when most people get tired maybe you're losing your form. go into the lodge when you get tired. don't push it. the other thing is keep your speed under control especially when you're skiing in unfamiliar terrain where you might not know what obstacles are around or in crowded areas. sometimes other skiers are just as dangerous as natural hazards. >> let's look at the different helmets. >> what do they offer? >> helmet technology as the nfl increased quite a bit lately, spending a lot of money on research and development. i brought favorite helmets. this is a very interesting helmet because most helmets are designed to shatter upon impact and this one is one of the first helmets out there that can withstand multiple hits. it's made with a softer foam. >> good for kids? >> great for kids.

younger skiers, this helmet can withstand multiple impacts. that is a great helmet. this is from a swedish company called the receptor bug. you can see it's offset. it prevents lacerations from anything from getting in to your helmet. extremely well made. >> how much? >> about 120 bucks. this is about 200 bucks. >> can that one withstand multiple hits? >> this just one. this is from smith called the vantage. it has honeycomb structure in here. while big impacts obviously can hurt your brain, so can slower impacts. this is designed kind of like the bumper on your car. it will start deforming at slower speeds which is critical. for example, michael schumacher apparently was not skiing that quickly when he hit that rock. it doesn't take that much force to get a brain injury, an important thing for people to realize.

plans to make this thing work. the thing about these numbers that are heart breaking is you've got 4.7 million americans' plans that have gone away. that's the number of plans. on each plan, you got one person, you might have a spouse or children. it impacts a lot of people. charles krauthammer is absolutely right. for the administration not to tell us how many people have actually paid for plans in the new year is disingenuous because if you haven't paid, you don't have coverage, unfortunately. >> maybe they don't know or they're not excited about that number in its actuality. charles dives in when he says the young and healthy, which is so important when it comes to paying for this system because the young and healthies would truly subsidize the plans that would end up costing more for those who aren't as healthy without their support, all those premiums are set to skyrocket. >> this is going to need very little analysis. the impact is great on

are you surprised with where we're at today where we hear about these things and there has been no hell to pay for anyone? >> i'm not surprised. this is the same playbook we've seen with this administration with every single problem that we've had that comes out of any department in the administration. we're talking about now 1400 fast and furious guns still missing. as you saw, there was this big shootout known as rocky point to american tourists. i've been on that beach, sandy beach a bunch of times. my family used to go to arizona and we would stay right there. this situation puts a lot of americans at risk. p puts innocent bistanders at risk. luckily in this instance it was only cartel members being killed. but again, it goes to the point when you give bad guys gun, they do bad things with them. >> the atf says atf has accepted responsibility for the mistakes made in the fast and furious investigation. regrettably, firearms related to the fast and furious investigation will likely continue to be recovered at the

future crime scenes. and the statistic you just brought up that there is still 1400 guns out there, this could last for a very long time. >> absolutely. and atf's definition of responsibility has always been a very loose one that they use. a lot of the people who were at the head of fast and furious haven't been fired, not to mention a lot of them are now in higher positions than they were before. and we're talk -- there is not a lot that eric holder will admit, but there is one thing he does admit and that is that we're going to see lots of murders, lots of deaths down the road as a result of this operation. we're talking about hundreds of mexican citizens already killed. we're talking about border patrol agent brian terry here in the united states being killed, and of course, let's not forget that these guns are being used by cartel members against chiefs of police, against public officials, against people like -- just people in public office. it's not like they're just killing each other.

they're going after theseblic oe weapons and they're being very successful. >> unless there is a public outcry, this will go by the board. is there anything legally that could bring this to the surface again? anything congressionally that could bring this out? >> absolutely. so for the past two years, we've been in this court battle with the congress -- the congress has been in a court battle with the department of justice. the department of justice asked for all the lawsuits from the oversight committee to be dismissed. what we're looking at now in the court system and waiter for which we're expected to see a ruling on here in the next couple of months is whether president obama's executive privilege over certain fast and furious documents will stand. if a judge strikes that down, documents will have to be turned over and then there will be lots of information released, which will probably give us more than we already know about the operation and a way to kind of present more information to the public about what happened. >> given the fact that a couple of agents died in it, you would think they would go ahead and reveal it. we'll stand by. >> you would think.

touting the fact that so many millions of people now have coverage that have never had it before, take a look at the sad statistics. in the run up to january, 4.7 million plans were canceled. meanwhile, they say 2.1 million plans were added. they don't say 2.1 million plans were paid for, so we don't know exactly how many people actually have coverage through the exchanges. we do know that we have heard for at least a year that what needed to happen for this to be a success was 7 million people had to sign up for plans, otherwise it wasn't going to work. it was very clear. 7 million. >> that was the goal so it could be paid for and taken care of. >> the amazing thing is, then they start saying, i never said that. >> you have proof -- do you have anybody saying that? >> we do. >> may be proof of that.

homeowner has many different faces now. you have those homeowners who are out there that are angered from what happened and now they're eligible to try and go buy a home. you have those homeowners who were not ever a homeowner and they're sitting around saying, now i'm in a position to buy a home and i'm paying for the sins of the past. you have those homeowners who went through loan modifications and really got played around by the lenders or short sales or foreclosed on, rebuilt their credits and they wear another face. and we have the informed homeowner. homeowners never will be able to say that they didn't understand that they have to pay attention to what they do now when they buy a home in the future, from lending to understanding the loan you're getting, to understanding the house you're buying. we're going to cover some of those things as to what you need to look for when you're buying a home in the fewer. >> so relevant and important to those across the country. we love your legal advice. what are we going to know and what do we need to know heading into 2014? what sort of issues are you

well. and will be very cross with anyone who will make a fuss over her. >> i bet. the statement says mrs. bush is doing great, is receiving fantastic care at methodist and will be very cross at anybody who makes a fuss over her. we should point out that the president of the united states, barak obama, sent her a note, michelle and i send our best wishes to mrs. bush for a speedy recovery. barbara is blessed to have both a loving and supportive family by her side. >> this is what we're expecting is a speedy recovery. a lot of times these things are precautionary. you want to give antibiotics. i would fully expect her to recover soon. >> that's terrific news. let's talk about a case that got a lot of attention over the christmas holiday and that was young lady out in california, went in for a routine tonsillectomy, currently on life support because she had cardiac arrest. currently, according to her doctors, she's brain dead.

now there is a struggle over whether or not she should be taken off of life support. >> steve, this is a hard case to talk about. let's start with this, i haven't seen the mris. i haven't seen the eeg or brain scans. but several u intos, reputable ones, are saying there is no brain activity. no upper brain activity, no brain stem activity. the movements that we may be seeing are spinal coming from the spinal cord. now, that's a definition of death. medical definition of death. that can be reassessed. if that's the case, then it's very hard to make a case for continuing to keep her going. on the other hand, people have different religious beliefs. people say well, i don't want people intervening. i want god to be involved with this. so that's why it gets difficult. from a purely medical point of view, if these things are accurate, and neurologists wouldn't put their reputations on the line like this, this wouldn't be the terry shiavo case where there was some brain activity. if there is no upper written activity, she's not -- brain

activity, she's not going to recover. >> speaking of shiavo, there is a story out that apparently the shiavo foundation is secretly helping this family keep their daughter alive. but you mentioned the movement, and that is i think it was revealed yesterday or the day before, her grandmother, who is a registered nurse, says that she feels that she's able -- the little girl is moving her legs and moving her hands because she hears the family. if you're the family, you want to believer that's true. >> well, and of course, there is a lot of heavy emotions involved with this and i dealt with this every day in my career with patients and patients' families. you have to be compassionate and open to reassessing things. but it doesn't mean that a family member who is a nurse would be objective about this. we have to be totally fair. there is issues with what the role of the hospital is, the hospital is in a very difficult situation here. again, we have to have a definition of what death is and we tend to make it from brain activity. not heart activity these days.

just constitution being the constitution? joining us retama is someone who led the charge for well father -- welfare reform in massachusetts. your reaction to that ruling? >> good morning. i don't agree with the ruling. there are plenty of people that go out there every day, work hard to actually earn a living and they have to be drug tested for the privilege of working and supporting their families. and this is a real problem in our country. we have public assistance programs that are infested with fraud and abuse. one of those forms of fraud and abuse is the trafficking of ebt cards. and just in massachusetts in the past year and a half or less, we have had five major busts of trafficking rings where stores are buying cars from people for 50 cents on the dollar and in some cases, there are drug deals right there to sell people drug

drugs. >> you're seeing a large number of those cases drugs are involved? n yes. we actually had -- we have tim cruz a did d.a. here. i have spoken to him. one of the busts, law enforcement was in the store that was specifically set up to buy these cards and sell people drugs and there were people outside the door saying to the law enforcement officers, gee, are you almost done yet 'cause i need to get in there and i need to sell my card so i can get money for drug. >> incredible. there has got to be something besides word and honor system to make this work. here is one thing beyond reproach. beyond any judge's decision. the food stamp enrollment has virtually doubled. in 2008, you had 28 billion. now 47 billion. so look at these numbers. they -- million. they've doubled so far. we're out of the economic crisis. evidently we're in recovery. how could these numbers continue to grow? the price of food stamps has virtually doubled. how do you get ahold of this?

>> these programs are out of control. we opinion over upwards of $80 billion in this country on the food stamp program. over the years, the application process and oversight has become very lax and we need to get back to where we're verifying people are who they say they are. a lot of this is done on-line and it's very easy to get a license and social security number and just mail it in and say that. that's why when we find people are busted, they often have multiple ebt cards. i think something very important that we need to mention and remember is that children are involved. and a lot of times this money and this food is for children. and when these cards are being trafficked and sold and drugs being bought, children are the ones who are suffering. so we need to be responsible. we need to help people break their addiction from drugs and this is one way to do it. we can actually get them the help they need if we know there is a problem. >> some of the most successful people in our country comes from families that were helped by welfare, single parent families, a lot of situations, it's beyond

whole foods you find in nature. >> you have to work out less, but work out differently, right? >> exactly. modern exercise scientists shown we can work an entirely different set of muscle fibers in our body. imagine if you never worked your biceps before. >> why are you looking at me? >> when we exercise smarter, we exercise with more force, but for shorter periods of time. we work more muscle fibers and we get better results. >> let's do one. >> the primary way to do this, and the good news, is you don't need complicated equipment or you don't need to go to the gym. eccentric training. focus on lowering down rather than lifting weight. lowering versus lifting weights. may i show you an ecentric pushup. a lot of people who maybe have tried to do pushups historically haven't been able to because they are a challenging movement. but a lot of us could do the ecentric or lower down. instead of doing a full on pushup, what you could do is just slowly lower yourself down.

>> that kind of happens anyway, right? >> exactly. >> coming up part that's the hard part. >> you can put your knees down, do that portion up. make the up portion easier and the down portion harder. >> hang on. >> just real slow, just real slow for ten seconds, i want you to lower down. and then once you get to this hardest portion of the movement right here, just hold it. just hold it. >> i'm not holding it anymore. >> brilliant. now push yourself up on your knees. keep your knees down. push yourself up. now put your feet back and now lower yourself down. >> while they continue to do this, we're going to step aside. the new book is called "the calorie myth." thank you very much.
