have written a secretary to kathleen sebelius about president obama overreaching. what do you think? >> well, they have to be very concerned down at the state level because what they are looking at is a president who once said that people had junk plans. and they were not in concert with the mandates of obamacare and the laws that they had established. and those plans had to be cancelled. but then, because of political pressure, i would say, the president comes back and says that those plans now can be reimplemented. that causes a lot of consternation down to the state level when you look at the state insurance commissioners and those, and the real crux of the matter is for these 11 attorneys general they are seeing executive branch that is really going back b. and changing law just based upon their own, really whims. and you cannot have a separation of powers, coequal branches of government that way. if there is to be a legislative change to an established law, there has to go back through congress, and that's really what these attorneys general are making

a complaint about. >> you know, we had attorney general greg abbot on from texas last night. here is the problem is that, you know, they all talk a big talk and they all say the president is doing this horrible thing. he is going beyond his political power. all i see he are these letters that get passed back and forth whether it's from capitol hill to h.h.s. secretary or state attorneys general are they really going to take any action or not? >> well, they have to. because, if they don't take any action. >> how? >> establish a very horrible precedent. well, you know, one of the things that you have to look at is whether or not they can go back and challenge this based upon a very anyone possibility of nullification. using the ninth and tenth amendments of the constitution they're not going to follow. this and not going to go along with people changing law in the executive branch instead of upholding and defending and executing those laws. this is a real constitutional crisis that we see happening in the united states of america. >> i have never seen such a

slow response for some that deeply believe the president has exceeded his authority no longer executing the law but legislating which is the responsibility of congress. whatever. we will see if the state attorneys general go beyond writing a letter. meme ask you something else though. when the bipartisanship budget act of 2013 was passed that happened just before christmas, we learned that one of the groups getting partial ax to retirement benefits in that new budget ax are our military vets. of course, that's distressing to many americans. but today house oversight committee chair darrell issa introducing a bill would end delivery of mail on saturday instead of cutting benefits for military veterans. is that the answer and a good one and is now the post office, are those postal workers in essence going to take a cut? >> first of all, i think that's a pretty easy way out to say we are going to cancel the service on saturdays. when you are talking about the military retirees and also the medically retired individuals, that's not a lot of people but we have made a promise to those people and i just happen to be one of those individuals.

i think that when you look at the wasteful spending up there in washington, d.c., senator jeff sessions brought up an amendment over in the senate to close tax loopholes for illegal immigrants and harry reid refused to do that you had senator tom coburn on who articulated his government waste book. $33 million of wasteful spending and you still have that gao report from 2011 that has $200 billion of redundant and do you politic duplicative programs. >> you found waste in the pentagon two months into the first term and got everybody to sign on with you to collect it or to keep it from being spent. i'm totally with you on that. senator tom coalburn. why is there appetite to spend that appetite to cut the postal workers. taking their money to pay the military. there is plenty of waste and fraud. where is the appetite to go get it? >> well, i think it comes back to a lack of leadership up there on capitol hill. they are always looking for the low hanging fruit. as a matter of fact, instead

of going after people who have given 20 must years lives and service to this nation. look at their own which katie couric kick in five to six years of service and even after the member has passed away it goes to their spouse. so there is a lot of other tough decisions that they can make and it will require a lot of hard work instead of like i have just seen chairman issa do go for the low hanging fruit. i'm sorry, that just is not acceptable to now try to punish the american people, to punish the postal workers instead of doing the job that you should do is cut the waste, cut the fraud, cut the abuse of the american taxpayer dollar. >> and sort of hold your breath waiting for that one to happen. let me ask you about something else which is enormously distressing but maybe not shocking piece of news today. an associated press poll showing a majority of americans, 54% believe the u.s. will be on a downward spiral until the year 2050. your thoughts? >> well, that comes from one simple thing and it transition from our last

little segment. there is a lack of inspirational visionary leadership in the united states of america. there is no one that is putting out a positive message about this great nation, talking about the resurgence and the recommitment to our, you know, constitutional republican values, which is so important. you know, when you look at president obama, he is someone who has lost credibility. he has lost trust. he has lost confidence. who would have ever thought that we would have a president of the united states of america that was awarded the lie of the year in 2013. so, that's very damaging for him. but then on the republican side, as you just brought up chairman issa, looking for the low hanging fruit instead of coming out and making the hard decisions. so we need to have some committed leaders, not self-interest. not special interest, and that's why a lot of people here in the united states of america really concerned about we're going to pass on to our children and grandchildren. >> you talk about inspiration. and i actually think that's a very powerful weapon and very important weapon to get the country going. whether economically or just, you know, in terms of our working together. when president obama ran for

office, he used to be able to draw crowds of 90,000. inspiration was his most powerful tool. he had it within his hands. what happened? >> that was false charisma. that was really someone that was telling people what he thought they wanted to hear. and not what they needed to hear. that's the difference between a politician and a statesman. a statesman is going to tell you what you need to hear. just the same as in the military. if you are going into a combat operation, you are going to inspire those young men and those young women to get out there and fight hard and train them very hard and tell them the truth. you're going to make sure that they come back home to their families and what have you. that's what we need. we need someone that says we're not down in this country. when you look at the resurgence of al qaeda. when you look at our economic situation. the unemployment, when you look at the failures of this affordable care act. obamacare because they are nowhere near the numbers that they need. this is where you need leadership to step up. leadership that could convey a true principled message and then have the policies to support that principled

the birth control mandate saying it wasn't necessary. that didn't stop the nuns from firing back at the president. the lawyer for the nuns insisting the obama administration is trying to bully nun into violating their religious beliefs. joining us a lawyer for the little sisters for the poor daniel. nice to have you back. >> thanks. nice to be here. >> i sorted through the pleadings today much of the afternoon. here is what i don't understand. i thought you won before you even started. it seemed to me all the nuns had to do sign a certificate nonprofit. against their religious beliefs and then they didn't have to pay it. >> you know, it comes down to the fine print. in this course with lawyers, that's the way it would be. if you look at the fine print on this form that the government wants the little sisters to sign. the fine print says three things. one, when i give this to you, to my insurer, you have my permission to do the thing that i think is wrong on my behalf. two, you must do that thing on my behalf. and three the government is going to pay you to do the thing on my behalf that i think shouldn't be done. >> my understanding, i'm

totally confused because as i understand the nuns are self-insured and they have someone administer the program who are the christian brothers who are not going to be out there, the christian brothers themselves which is a catholic order. they are not going to be out there selling insurance with contraception, at least i assume or administering it. >> that's what is so crazy here. because the government is saying you have to sign this form. you must do it. and we'll fine you millions of dollars if you don't sign this form that's an abortion permission form. >> but if they do sign it, don't the nuns and the christian brothers, aren't they exempted? don't they have a waiver from this. >> no. if they sign that form that is a legal permission slip. >> giving permission to who to have an abortion or who to have contraception? >> it's giving permission to their insurance provider. >> which is christian brothers? >> not just christian brothers. not just christian brothers. >> they have a second one? >> they do. well, they may. you might be surprised. it's complicated with the obamacare law, but the christian brothers are a primary healthcare provider, but there is also another

entity out there that provides the prescription drugs, and so this would cover the morning after pill, the plan b. >> that's a non-catholic based insurance company or administrator? >> exactly. >> that's what the attention is on. >> that's. >> they're not worried about christian brothers. >> that's part of the concern. let's step back. let's say the christian brothers. only the christian brothers out there who gets this form. that's it. well, they are still signing a form it's a lie. >> saying what? >> signing a form saying i'm giving permission abortion pills to my employees. >> are you saying if the christian brothers -- if they signed it and it the christian brothers went rogue, using that term. the christian brothers could then go out and sell insurance or administer insurance with abortion or with contraceptive which would be -- which would be against -- what the nuns don't want is that what you are saying? >> yeah, they could. ifthey are giving permission to do that. >> no way to bind their administrator from doing this with someone else? >> they are signing off that permission slip. they are signing it away. it's a bank slip.

they don't have control over it afterwards. say even if the christian brothers don't do anything with it. we don't think they would, the sisters shouldn't be forced to sign off their conscience to subrogate their conscience to someone else. they don't want to sign a form that's a lifetime achievement you were just talking a second ago about the examples that we set to young people. about standing up -- >> -- i think i'm getting boxed in but go ahead. >> standing up for things that you think are true and you think are right. and not saying things that are a lie. they are signing this form, it's a lie. it's saying i give you permission to do something that's wrong. >> could the form be written differently sign this exempt from it so they could let those who want to do it go do it and they don't have to do it? >> that brings up another great point there are people exempted from, this right in the catholic bishops are exempted. the catholic nuns aren't. >> i don't like. nuns aren't exempted and the bishops? >> that's right. let's say we being take the little sisters to the poor. take their ministry to the poor 175 years and gave it

a bizarre mystery unfolding in michigan. at the center of it a world famous gospel singer and a female doctor. the doctor vanished a month ago and now the singer claims the doctor was stalking him before she disappeared. for the latest on this case news director john mcneil joins us. john, who is this doctor? when she d. she vanish and what in the world going on? >> that's the million-dollar question at this point. we really don't know. there is a lot we don't

know. there is a lot we do know. what we do know is she disappeared on december 5th leaving behind her phone and her purse and she tried to leave behind her car, too. but when she was denied access to a local motel because she didn't have enough money, she left town in her car and was heading west towards chicago when her car went off the road in porter, indiana, and that was the last physical trace of her. state police impounded her car. it wasn't discovered by local police here that it had been impounded in indiana for five days. the trail had gone pretty cold by then. they asked search in indiana but they didn't find anything. they found her wallet in the car though and some items of clothing and she just hasn't been seen since. >> what's the story on the gospel singer, the stalking the gospel singer and the videos? >> that came -- we learned about that much later. we have learned about that in the last couple of days, in fact, apparently she had been sending him messages for over a year even as she

was a student in lominda, california. it's believed at least her husband suspects, her ex-husband suspects that she took the internship in kalamazoo to be closer to marvin sap. who is a grammy nominated gospel singer who has a large congregation in michigan. she joined his church. she contacted his kids. she showed up at his house one day. he sought a personal protection order from the court and got it it the judge felt that she was stalking him but she has never been charged with that what we found a couple weeks ago was a couple videos made on youtube made to a mystery man. i believe you have sample of some of those videos there. >> yes, we do. ♪ good night. it's teleka. i am just coming to you to say hi.

would like were cancelled. should the obama administration count them as they boast about the numbers? bob cusack the washington examiner fuzzy math or what? >> definite there seems that way. there are at least five or six million cancellations. what we don't know is how many of those cancellations actually have their plans expire on december 31st. if you think the majority. so right now what i have heard at least from some healthcare industry sources that they were expecting a deficit of people on their plan january 1st. again, they are still shuffling threw, sorting out who is actually enrolled and who is not. so we don't really know for sure. if you do the math it, seems they have not had what their goals are. kathleen sebelius said their goal was 2.3 million; they are at 2 million. don't even know if they signed up. not even at 60% of their goal. by anyone's book i think that would be a failing grade. >> something about being forced off your policy you

2014. that's a serious problem. >> does that include medicaid additions or not? >> that i think, includes it all. they keep counting it all. one of the things that the house republicans is doing a lot of information we don't know. young enrollees we have no idea these people who got their plans cancelled. kind of a shrewd move, a bill will be on the floor that will say you have got to release this information. we need to know these details. >> medicaid makes a difference too. if they're medicaid they are not going to be paying if thee enrolled in these programs. >> medicaid is a big part of the expansion of the law. administration knew there was a bit of a stigma when you sign up for medicaid. they were making the case listen, you are covered, you are covered. you have a better plan than you had before. people wanted these plans they signed up voluntarily for these plans and these plans in all likelihood are less expensive than what they're pay for now. >> and they don't cost the taxpayer. if it's mostly medicaid that he would talking about, we are not getting the paying people that we need. >> that's what. >> to sustain the law.

>> that's my point who is in this 2 million people. who is paying? but i guess we will find out if that law is passed. >> it passed the house. >> just when you thought the glitches could not get worse. a new problem with healthcare.gov popped up. turns out the web site cannot handle updates for common life changes like baby births, marriages, or new jobs. so now what, john? suppose during the course of the year someone has a baby. do you add the baby to your healthcare? >> there is just some crazy process you have to go through. again, it's why people hate this law. not something making them pay more which is annoying enough. dmv experience bureaucratic nightmare of making a simple change. i think that's really the problem. bad enough taking their money, it's even worse taking their time. >> is that just the aches and pains, susan of a new program or are these like fatal defects? >> added together they can be. because already you are losing people. you are losing interest. you are losing the patience of people that you need to sign up for this.

that he is being encouraged by the democratic party? >> oh, i think it's highly likely. met with democratic consultants. he has talked to the fundraising arm. it's an uphill climb given the nature of the district. but he has won half the battle. he has name recognition and the current incomer is facing challenges from the right that could drain some of the funding that she would need to face someone in a general primary fight. so, she could end up, you know, a primary battle can really hurt general election candidates. >> how about any other celebrities? >> they don't usually run. al franken is the exception. arnold in california. when they look into it, number one, there is not a lot of money into it compared to what they're already making. number two, they would be a freshman in congress. look at ashley judd, she didn't decide to challenge mitch mcconnell. >> the halls are full of celebrity in congress. a lot of the them are sports celebrities. they are former athletes.

>> how about tennessee? >> tennessee really kind of fascinating example of the economic effect of obamacare. as you know, if you are an employer, you have to provide health insurance for all of your employees if you have more than 50 employees for more than 30 hours a week. 11 school districts in the state of tennessee according to lamar alexander are shortening the number of hours of their substitute teachers because they don't want to have to get into this. nice example of unforeseen consequences of this. volunteer firehouses still waiting for the irs volunteer is considered employee under the rules of obamacare. can you imagine being a teacher saying okay, can we have somebody work that day? have them leave at 2:00 instead of 3:00 because we don't want them hitting 30 hours a week. unforeseen consequence style headache of this. >> minnesota? >> minnesota, first of all the web site was down again thursday. maybe that relates to the really awful weather we have had in some sort of key

server froze. >> i can go to amazon and shop site has had these problems. the average wait time was 76 minutes, which means obviously some folks are having less and some folks are having more. most people who are trying to get insurance have had all the problems with the web site so far you don't have hour 15 minutes sitting on that person antidotally facebook comments not happy when they get through the kind of information they have. the navigators, expertise, things like that. >> california? >> california, where to begin with california? probably the most interesting example is that they just found out they don't have enough money to keep the exchange going beyond 2015. these states didn't set up their exchanges based on their own money. the federal government gave them oodles and oodles of money. in the case of california roughly a billion. seeing another fantastic one of those ads out there in california. but this one basically they realize it's not going to be self-sufficient starting in

>> hi, greta, how are you? >> good. what do you think about this regulation? >> simply it's insane. that's all i can say it makes absolutely no sense why they would force small businesses like mine to post calorie counts. i believe it's a very good thing to have the calorie counts and people should know what they are buying. information is very good. why don't they make the manufacturers post it on the label. they are much larger company. fruit toe lay, coca cola, pepsi-cola, they can afford it far more than any vending company could. half of them have it on their packaging already. i don't know why they push it on us. >> probably they have a lot of big lobbyists get underneath that i understand could of thing that would make since if you are going to do it. put a big 50 on something as to represent calories. the thing that is sort of unusual though about this, too, the whole idea of obamacare was to get access to healthcare. that was the fundamental korean. and now what it's doing is like access to healthcare doesn't come through calorie counts on snack food vending machines. it just doesn't. >> no. it has nothing to do with it

we want people to be healthy, it's a great thing. what does this have to do with healthcare. vending machine business is about convenience. in a place where somebody can't get out to get a snack or something to drink or in a school or somewhere else. if you want to give the information, that's great. put it on the packaging. by us to do something like, this my company alone will cost a million dollars to retrofit the equipment. >> how would you do it? >> you would have to get, you know, purchase parts, which probably aren't even available at this time that would read out every calorie of every item that's in the machine. so, for example, if you select snack machine item a 1 in the top corner and it was selling a bag of fruit frito potato chips, it would read out the nutritional facts of the product. but if the product gets mixed up or the man that loads the machine doesn't put it in exactly the same place, now it's all off. it has to be reprogrammed once again. it's going to be a never ending battle for me. >> i'm sort of an expert in vending machines i have lived on it for 11 and a half years having had a late show here.
