2016 republican nominee for president of the united states. welcome to "the kelly file" on a busy night, i'm megyn kelly. new fallout after new jersey governor chris christie held a two-hour conversation today, first apologizing and then denying any personal knowledge of a revenge scheme in a political situation, that snarled traffic for hours on the george washington bridge, a major east coast artery. and more, eric? >> reporter: hello, megyn, an apology, a firing of a top christie appointee, taking effect. many wonder what comes next. governor christie went to ft. lee, new jersey, to personally apologize to the mayor there,

and all of the plan was apparently a revenge because he didn't endorse christie for re-election. the mayor says he accepts the apology and christie's denials he was not involved. >> i take him for his word which was he had nothing to do with it. i said this once, i said it 100 times. we in ft. lee are not rooting for facts to you know, come about and surface that would suggest in some shape or form that he was involved in it. we take him for his word. >> today, christie fired his department chief of staff, the woman you see on the right there, bridget anne kelly, who apparently ordered the closures. christie said she lied to him. one of kelly's e-mails said simply, quote, time for some traffic problems in ft. lee. >> i come out here today to apologize to the people of new jersey. i apologize to the people of ft. lee, and i apologize to the members of the state

legislature. i am embarrassed, and humiliated by the conduct of some of the people on my team. i had no knowledge or involvement in this issue in its planning or its execution. and i am stunned by the abject stupidity that was shown here, regardless of what the facts ultimately uncover. well, just hours later, a top former christie appointee, david wildstein, took the fifth and clamped -- clammed up at a legislative hearing, and then was held in contempt. the investigations are continuing, and so too, are the

hearings. the governor damage control efforts got a thumbs up tonight from a rather unlikely source. former senior adviser to president obama, david axelrod, writing on twitter, quote, christie handled it about as well as could, unless a smoking gun turns up, he lives to fight another day. joining me now with the key parts of what happened next. andrew mccarthy, political contributor for the review. and chris stirewalt, our fox news digital contributor, andy, let me start with you. because you, i think it is fair to say are a right-leaning person in your politics. and yet, you are critical of the governor in terms of the questions answered today in saying there are still many issues you think he has yet to address. what are they? >> well, i think he has to

explain how it is that a couple of weeks ago he said that he put it to his team, to his aides, to give him a full explanation of what happened. and that they did, in fact, give him a full explanation. he was satisfied with that. and then when he was asked in a town hall forum what about this traffic study, which is supposed to be the thing that was the explanation, the counter-explanation, not the corrupt explanation for what happened here, he said you know, why would i be worried about that? why would i want to look at that? he sort of waved it off. and it seems to me if he was claiming or saying he got a thorough explanation that satisfied him and the traffic study was at the bottom of the explanation, or that was the reason for the traffic tie-ups, it is very peculiar to me that he wouldn't have wanted to see it. wouldn't have known anything about it. wouldn't have gone to ground to make sure that it existed,

particularly given the reputation he has cultivated and what he was originally elected on was the fact he was a hard-charging former united states attorney. >> that makes sense and a question that a lot of people wanted asked. if you, governor christie, believed this was a legitimate traffic study being conducted by the port authority and not some political extortion being committed on a local mayor who refused to endorse you, then why didn't you say to your staff, all right if it was a legitimate traffic study, let's see the study. and christie was asked about that today, and basically said i'm still not sure about the study. but, he did point out that this guy who since resigned, bill berone, who was once a state senator in new jersey and then the top port authority official, resigned in december in the wake of this controversy. he did point out that senator

berone testified on this issue and did say yes, indeed, there was a study. we had to terminate it early because of logistical issues in conducting it. but there was a study, he had a little clip of that, forgive the camera work, watch. >> two days of that is not enough to make conclusions. but generally speaking it is fair to say that for the analysis that took place and for the 95% of the people who don't come from ft. lee, their commute was reduced. at the same time, for the people who do use the special ft. lee lanes their commute was extended. >> let me ask you about this, this has been generating through new jersey politics for quite sometime. what the governor tried to say today with respect to the one thing that has a lot of people saying how could he not know, i was told by the port authority there was a study, that it had to be cut short. basically, i was given a reason that for the traffic snarling and for the fact that i was never given a report. your thoughts today on how he

handled that issue and how he handled himself. >> the governor was lied to. he was disappointed in his close staff members. he was clear to the press. he spent two hours. i was at that press conference. he answered every question. and he is very sad. this is a former u.s. attorney who prosecuted over 100 politicians who are corrupt. this is a last guy in the world who wants corruption in his inner staff. and he is saddened by this. he stood in front of this media, answered the questions and this is the kind of leadership you want. you want people to take responsibility. you don't want people who are going to ignore the press and ignore the questions, he is answering every question that has been asked. >> as a former federal prosecutor he didn't hedge on it. he got up there and said i had nothing to do with it. he left himself no wiggle room. what does it tell you? >> i was impressed, megyn, i must say he certainly didn't act at all like somebody who was

concerned that a disgruntled underling was going to turn over and talk about him. look, he did swiftly terminate at least the people that we know were involved in this. so i think it was to his great credit. >> i just want to tell the viewers, now we have a federal investigation. the fbi is involved. now we find there is a class action against him and the port authority by people who were sitting on the bridge in traffic. he knows this, he was a prosecutor himself, andy, so he gets out there. knowing he will be investigated by the feds, he is out there saying bring it, i am telling you, i had nothing to do with it. it is unusual, if he did have something to do with it, it would be extraordinary. >> and i hope he is right, because they're going to bring it. >> yes, you're saying a grand jury investigation. >> sure, and state

investigations, as well. there are federal concerns and state concerns. and there is the fact that this is a blue state, megyn. the democrats who have been pretty easy on him up until now will go after him. >> and it is interesting to see david axelrod send out the tweet tonight. it is also interesting, the near deafening silence we've heard from republicans in governor christie's defense over the past couple of days. why is that? >> well, now remember, he is not just any republican governor. aside from being possibly the frontrunner for the party's nomination in 2016, he is the head of the governor's association. one may expect that the fellow governors would sprint to be there for chris christie and say he is the guy. >> niki haley did. >> well, a tweet ain't a press conference. i think the reason is pretty

simple. chris christie is viewed with suspicion by many conservatives and a lot of republican loyalists because of a few things. but mostly, because of the reason he passed up very few opportunities within his own party, the conservatives in it, and number two, he was such an unsteady ally for mitt romney in the 2012 presidential campaign. and republicans remember very, very acutely the hug, the chris christie hug, and how we found out later in the book that chris christie was a very difficult surrogate for mitt romney and not eager to help. so those things carry over. you may be the darling of the new york media and may be the democrat's favorite republican, but when the chips are down your own party may not be there for you. >> is there a perception he thought he didn't need the party, that he transcended the party. >> i think there was a part that

developments tonight in the kelly file follow-up right now. big revelations in the case of a nebraska toddler and three other children. i talked with this on o'reilly a short time ago, these children are now in protective custody. we told you that on o'reilly. but there is more now. after a disturbing video went viral, watch this. [ bleep ] [ bleep ] [ bleep ] [ bleep ]. >> sergeant john wells, who is president of the omaha police officer's association, that is the group that has come under fire itself for posting the controversial video, which first appeared on the facebook page of that child's uncle, who we

believe took the video. sergeant, good of you to be here. first, if you could update us now. we understand the child and three others have been taken into protective custody, who are with children family services, why? what was going on in that house? >> well, megyn, if i could real quick before i get into that. i just want to say that lost in a lot of this is maybe a perception of omaha. and i want to say right here, that 99% of people in omaha are law abiding citizens, omaha is a great place to raise a family. and what we're talking about is the 1% of the people in omaha who represent a disproportionate part of the population. tonight i learned that apparently the state cps has had this family, been watching them and investigating them since at least august. back in october of 2013, there was a shooting at a house here in town where apparently the 16-year-old mother and --

>> the 16-year-old mother of that 3-year-old boy? that little boy has a 16-year-old mother. go ahead. >> that is right. as i understand it, yes. and somebody walked up and shot -- fired the gunfire into the house and at least two adults were hit, including the 16-year-old in the shoulder. and apparently the shrapnel hit the toddler in the foot. subsequently, they moved as recently as december 16th. the omaha police department investigated it. there was a drive by shooting and the helicopter followed the car that left the scene. and while the helicopter followed the car four people fled from the vehicle and went into the house. subsequently, we served a search warrant on the house where we found five firearms. the resident of the house was booked for five counts of felon in possession of a firearm. that was the house where five children were removed last night. and that person charged was this person with the toddler and the

video's grandmother. >> despite what we see on the video and now we know it is far worse than even the evidence on the video show us, the focus in this case has fallen upon you, upon the police union for posting this video. you didn't blur the child's face, first of all, do you admit that was a mistake? >> i -- wouldn't say it is a mistake. when we found this video it was public. it was on a facebook page, again, a follower pointed it out to us on our facebook page, anybody could go to this person's facebook page and pull the video up and watch it it was already on the internet. >> i do want to give you a chance to respond to the accusations that you shouldn't have been referring to this as an example of thug culture, i'll give you a word on that. >> you know, that is a word that i heard a lot of people disparage, i've been called a thug in various forms. it is a common word around here, the local media uses it.

it is a common term for the violent criminal culture. it doesn't refer to any ethnicity. it refers to violent criminals. >> have you since blurred the face of the child on the video? >> that is correct. >> do you believe that that child and his mother and two others would be in protective custody tonight if you had not posted this video? >> absolutely not, obviously, the state has been watching them since august. there was a shooting which they could have been innocent victims of in october. but there was an incident in december where the grandmother, where the child was living, was possessing five firearms illegally. because she was a felon. at that point, i don't know why they didn't remove the child. clearly they had them under investigation and i believe without this video that child would still be living in that home. >> sergeant wells, thank you for being here. >> thank you having me. >> and we'll continue to give you the update on the child. also this, a driver makes a

from the world headquarters of fox news, it is "the kelly file" with megyn kelly. well, tonight, the white house announced that it will oppose a new bill designed to protect your personal information on the obamacare changes. this is one of the nation's largest credit bureau's experience predicting that the health care industry and you are prime targets for data theft in 2014. and now we learn that if somebody steals your information off of healthcare.gov, the feds

don't have to tell you. yesterday i spoke with a top republican supporting the bill to put an end to this. joining us now on the kelly file exclusive, house majority eric cantor, good to see you. and so this is something that actually came up when they were discussing the security under obamacare. and they pushed hhs, commentators did, to protect people, saying all right if this information gets stolen on healthcare.gov or something, somebody should tell me so creditors can do something about it. and hhs says no. >> unbelievable, isn't it. and congratulations on the shocks a terrific show. >> thank you. >> it is pretty unfathomable to believe we are anywhere where we are on this issue. it is a no-brainer. i think that people are legitimately concerned about information and identity theft. if there is any chance that

one's information and identity can be stolen or abused on the healthcare.gov website or in any way shape or form connected with the obamacare exchange then we should take the precautionary measures necessary. that is exactly what we're doing on the house of representatives floor. this week we are voting on a bill that would require the obama administration to notify any victims of identity theft within 48 hours. >> why is this controversial? because as i look it up it looks like nancy pelosi and other democrats are dismissing this bill. it is a two-page bill, not some long bill, just saying hey, notify people if their information gets stolen. they're dismissing that in their view as another political stunt? >> it is pretty incredible. really, that is what is wrong with washington right now. let's just start to help people. we know this law has got a lot of issues with it, a lot of things that can never be fixed. but in the meantime, while all

of this is playing out we ought to protect people from the harmful effects. that is what this bill does, it is a no-brainer. we ought to require the administration to alert those who are victims of identity theft if it happens within 48 hour hours, very simple. >> because you can do something about it. if you get notified that your information is compromised, same as with target, they sent out a notice to the world saying if you were at target during these days buying merchandise in this way you may have been compromised. and then you go and look and see on your card, oh wow, somebody is buying stuff purporting to be me. the government is taking this way from pple, many who have been forced on healthcare.gov, if the democrats not supporting this bill means these people are going to remain unprotected, correct? >> that is right, the imperative is to allow the individuals to take the actions necessary to minimize or mitigate any damage that could occur.

you know, this is very scary issue to a lot of people. and legitimately so. if you have your identity taken from you and abused, i mean, you know, how much is occurring on line electronically. that is a scary thought. the government ought to be willing to just notify victims. that is all we're trying to do. and asking the democrats to set politics aside, just this one time and let's go about helping protect people in case their identity is stolen. >> well, especially when you talk about potentially more than identity. i mean, if it gets into the nature of your actual health care history that opens up another whole ball of wax. because hhs reports there were no security attacks, none, and no group has been linked to any personal identifiable information of the site. so they say this is really unnecessary because it has not happened. >> well, the question i would have megyn, back to that is why do we want to wait until it does

developing now, new questions about the man the white house has nominated to a top position at the doj. a lawyer who once volunteered to defend an infamous cop killer. fellow officer brutally murdered ten years ago, shot five times, including while he was down and his assaulter was looking him in the face. he was killed by this man, abu-jamal, who never denied the killing, but whose cause became a political move for the left, and was defended by this attorney, debo adegbile, and he is now being considered to head up the department of justice.

trace? >> reporter: and megyn, jamal was convicted by a jury of ten white people and two black people. and because the evidence was so overwhelming, the jury escape back after six hours of deliberating, sentencing him to death after less than two hours of deliberations. when the doj nominated debo adegbile, who was with the legal defense fund, he fought to defend jamal, claiming there was racial discrimination and that the jury was not given proper instruction. jamal, as you said, shot officer faulkner five times, as well as 12 inches from his face, having his death sentence overturned. but despite arguing that jamal's conviction was about race, debo adegbile told the commission it was only about justice. listen. >> our commitment in the constitution is to follow our procedural rules even in the

hardest cases, perhaps especially in the hardest cases so that all of our rights can be vindicated. >> yeah, we have now learned that a rally for jamal in 2011, this woman, an attorney for the legal defense fund team said it was an honor to defend abu jamal, saying there was no question in the mind of the legal defense fund that the justice system has completely and utterly failed jamal. and in our view, that has everything to do with race and that is why the legal defense fund is in this case. al also, after seen maureen faulkner on "the kelly file," the senate republicans now contacted her and she tells fox news that she will file a petition to make public her complaints against the nominee, debo adegbile. >> trace, thank you. well, the naacp may be standing by this defendant, by this

nominee, i should say, to the doj. but the largest police organization in the usa sends a decidedly different message. and the national order of police says this is a thumb in the eye of our national police force. and also joining me, pennsylvania congressman mike fitzgerald who wrote a similar letter of his own to president obama along with the support of several other lawmakers. representative fitzgerald, let me start with you. you write to the president saying i could not be more incensed and confounded. they made a mockery of the nomination, why are you so incensed? >> well, megyn, thank you for keeping a spotlight on this case. it has almost been 33 years, pennsylvania has not forgotten,

abu jamal, is a convicted cop killer. over the course of 33 years he converted himself a sort of political prisoner. and from prison he created a whole catalogue of speeches and tapes and radio shows. and after 33 years the legal defense fund and this notiminee and the defense fund decided to insert themselves into the constitution. >> is there any question whether he did it? >> i don't think there is any question, as we heard in the intro, a jury of his peers, he was sentenced by the judge. according to the supreme court, he was given an opportunity to testify. his own brother was a witness to the case and in 33 years has never defended abu jamal during the whole 33-year time frame. >> let me ask you, we heard the

nominee, debo adegbile, the one they want to take over the doj. we heard him testify, saying look, you don't have to like the defendant you are representing. but look, we saw the legal argument. in the case, we won, we got the death sentence thrown out because we feel the jury was not given the proper instructions. and so by necessary, he says i have been vindicated in my legal position, why are you so upset about this man's nomination. >> well, i think the statement by the naacp attorney with the ldf clearly said their position all along was that wesley cook, aka mumia jamal, was a prisoner, he is not, he is a murderer. the facts are clear, the fact they interjected themselves all

over the world. they tried to name a street after him. he is a murderer. they helped to promulgate the fact -- he is a murderer. >> he volunteered to help this man. >> absolutely, and many people in the organization led rallies all over the country to free mumia, free mumia, he is a convicted murderer, the court said he was a convicted murderer 32 years ago. those charges of murder have never been disputed by wesley cook. and the only part of the case that was ever overturned was the death sentence. and frankly, we're not concerned about that. what they did was turn a cab driver into a martyr, and he is not. he is a murderer. >> my question to you, when questioned about this before the

senate judiciary committee, his response was i'm a lawyer, we represent all sorts of people. why is that not an acceptable answer to you? >> well, certainly that is an answer. but you know he could have inserted himself into any one of a number of cases throughout the country. they decided to insert themselves in a 33-year-old case of a clearly convicted cop killer from the city of philadelphia. the facts were not contradicted. >> what does this tell you about the nominee? for the folks listening at home, thinking of debo adegbile becoming the top chief at the doj. what does it tell you? >> his attorneys at the conclusion said they could not have been prouder to have the opportunity, not to represent justice, not to fight for the constitution, but to represent abu jamal, and the fact they chose to represent themselves in a 33-year-old case pretty much tells you all you need to know about this administration and the constitution and the victims
