first time tonight. >> from the world headquarters of fox news, it's the kelly file with megyn kelly. good evening. we start with a stunning new jobs report revealing an alarming new first. as the number of an cans who could be working but are not hits an all-time record low. a new report reveals that 92 million americans, nearly one third of the country, could be in the labor force, but are not. 92 million. in just december, more than half a million americans gave up. looking for work. and the implications of that are not good. not good for them. and not good for this country. melissa francis, host of money with melissa francis, and mark teason, fellow at american enterprise institute and columnist for "the washington post." i will start with you as the business guru. december job numbers were bad.

the significant number. jobs numbers go up and down. is the number of people who gave up. put it in perspective. >> an enormous number. people who have gone to the side lines and given up. they said i can't find a job. i might as well not look anymore. on the left they like to say these are babyboomers that are retiring. but that's only a tiny fraction of these folks. i mean these are just a lot of people who have gone out there and said, it doesn't make sense for me to work anymore. maybe it's more profitable not to. there are so many programs out there. >> mark, we have heard from this president, that the focus of his second term is going to be income inequality. income inequality he believes is a threat to the american dream. these numbers, and the people who have given up on finding a job. >> inscum inequality isn't a

threat. if you were a ceo and i was a factory worker and both got 30% increase in income. we would be better off. you would make more than i do. >> you are not going to make me do math, that's not where this is going is it? >> the factory worker is on unemployment. he can't find a job. the problem is the economic recovery policies of the obama administration are not working. the main problem in the country is not the safety net is too generous, it's too many people need the social safety net. the worst economic recovery since the great depression. the economy is not creating enough jobs to keep up. you have millions of americans who are dependent on government, who don't want to be depentd on governmenon -- 1/3 of the am scan people. have at one time or another, slipped below the poverty line. think abut that. so, they can't, people want the dig ni tef of work. they want opportunity. they can't have that in the obama economy.

>> it hasn't been this bad, melissa, since 1978. the work force participation rate wasn't this bad since 1978. >> the stock market you will notice is through the roof. last year, the dow was up 26%. it had the best year in 18 years. that its because of the federal reserve's policies because of washington policies. that has the made the rich so much richer. at the same time, when you are looking at employment numbers this month the number of hours worked fell. that means people who have a job, more of them were part time. wages were stagnant. the number of temporary workers. >> they turn around and blame the rich for getting richer, people are putting their money in the market there is no other place to make money given don't make any interest on your money. here's what i want to point out. statistics are terrible for what the numbers mean for the united states of america. not just your neighbor's problem

if your neighbor is unemployed. a couple to tech off. a huge risk factor for divorce to be long time unemployed, withdraw from the work force, worse than the loss of a spouse they say in terms of stress level. significant increase in death rates in the year after you have become unemployed don't want to be. two times more likely -- to, experience depression, low self-esteem, negatively affects some parenting prak ti ining pr thousands. children become distressed. on and on it goes, mark. these numbers are more than, oh, let's give them temporary unemployment. and we'll solve the problem. they need jobs. >> that's exactly right. look, the worst statistic is, a rume study found that six in ten americans think the american economy has undergone a perm nenlt change. this is the new normal. majority of americans think this its what normal is like. we have to change the policies. >> there is some truth.

look at the jobs that disappeared. manufacturing jobs went away. millions of jobs out there in computer programming not getting filled because people don't hatch the training. there has been a shift. away from the type of work a lot of people are trained for. they're not going to fiend new jobs. >>en what market, on the government dole? >> i, i disagree that we, that we are, that new normal should be 92 million people out of the work force. we have to find a way to create training and opportunity and jobs for the american people. and not blame people, i mean the big problem, what we need to be worried about, republicans cannot fall into the trap of mitt romney and 47% comment and say we are going to become a nation of moochers who don't want to take care of themselves. nobody grows up saying i want to be dependent on the government. people grow up, i want to be a fireman. policeman, doctor, computer program. er need to restore on upward mobility. so people can get a shot. >> sound like mark is getting ready to run. i got to gift.

got to run. see you, guys. >> thank you, megyn. >> story out of colorado where the senator mark udall under pressure amid suggestions his office pressured the colorado division of insurance to cook the books. to change the numbers. so it would look like fewer people had been canceled thanks to obama care than had in fact been canceled. now, we have obtained the actual e mail between the staffers as senator's office suggests at the kelly file. joining us, colorado congressman, cory guard next, a republican who had his insurance canceled under obama care and demanding answers from colorado insurance commissioner. good to see you. what is it that senator udall's office did? when they announced 250,000 people lost their insurance. had their insurance approximately seize because of obama care canceled.

he started pushing back using his office. using his staff to push back. and what was, called and described as a hostile way, with these -- these employees of the di vegs of insurance trying to get them to change the numbers. >> we have the e-mails that, that one of, there is a director of external affairs, jo donlin in colorado. she wrote to internally, said, senator udall says our numbers were wrong. they're not wrong. cancellation notices affected 249,191 people. they want to trash our numbers if i am hold strong while we get more details. and then she goes on. and then, she later writes -- e-mail to our colleague saying, follow might e-mail. i received a very hols till phone call from senator udall's deputy chief of staff. on the phone with the chief of staff right now. happy friday. its this inappropriate meddling or is this a senator's office just trying to correct what it

believes is misleading information. they say a lot of the people didn't get canceled. they got canceled with a renewal offer. >> the president's prom ris if you liked your health care plan you get to keep it dent come with an expiration date. that's what we are dealing with. 250,000 coloradan had their insurance approximately setz canceled. senator udall voted for the health care bill. i understhand why he is concerned this could jeopardize his election. there is a difference between calling up an office and saying, hey, are these the right numbers, versus a hostile phone call forcing division of insurance employee to say we are standing strong. an attempt to pressure a approximately see maker into changing the numbers of people who had insurance canceled. raises a question abut abuse of power. >> because the larger picture is cancellation notices were coming in. happened a couple months ago. pressure was mounting on the democrat whutz voted for the law from their home states. why did you vote for it?

awe la >> the latest, because it was broken, as people try to get insurance bills get them paid go to the doctor call insurance company's 800 number, they're not getting good service. >> is it happening do you have specific examples? >> plenty in the press. an "los angeles times" article that documented a number of circumstances. the fundamental problem, megyn, most enrollment came in the last two weeks of december. it takes insurance companies, two to three weeks to process enrollment in a there mall time. they haven't had the time they need to process enrollment, dealing often still with inaccurate data, not able to reconcile information from healthcare.gov. >> jay carney said the administration has aggressively dressed the so-called back end issues of the website, the website is being repaired. and that he says, that of the 1.1 million individuals who have enrolled in private insurance in federal exchanges only 13,000

are problematic. >> i'm hearing from health plans, upward of 5% of the latest enrollments are coming through with data problems. i am hearing that they're, they have gate number of things that haven't been corrected from earlier enrollments. they can't do a reconciliation with the federal guchovernment. >> still, still doing it by hand? >> that's right. >> they can't do what are called adds and deletes. if for example someone has a baby. health care.gov, couldn't put the baby on the health plan. if someone has a big cut in their pay, and therefore are entitled to a bigger subsidy. healthcare.gov can't grant subsidy or do changes. >> the insurance giant, humana is blaming obamacare for an adverse miximbalanced.

that according to one of the architects of obamacare, he told me, couple weeks ago, when the insurance pool is imbalanced too many sick people in and not enough healthy people that could be the beginning of the death spiral, means end of obamacare. just humana, are other companies saying that? >> no, what is going on here is they signed up, about 2 million people. there are more than 20 million people that are eligible for this program. so they have seigned up less thn 10% of the uninsured. no way you can have a risk pool, until you get to 70% of the people. they're off to a very bad start in terms of having a sustainable risk pool here. the fundamental problem is that -- misdemeanthat that-many people are passing on buying the insurance. costs them too much after tax

it requires lawyers to represent unpopular clients. whether you are, john adams or john roberts, indeed we are expected to actually make sure both side of the cases are heard. and that indeed not only, deter men whether some one is guilty or innocent but make sure indeed the punishment is consistent with the justice system. >> right. but you, he didn't have to take the case. and the, then he did take the case. he essentially got this guy sentence reduced from a death penalty to life in prison. actually are gud to tgued to ths conviction should be overturned. the man, a defendant has never publicly state heed didn't do it. according to witnesses admitted doing it. eyewitnesses saw him shooting the cop. standing over him. shooting in the face. dying on the sidewalk. trying to make an arrest of the defendant's brother. and so, people out there say -- all right. i get that, that that man deserved a defense bucht .

but he doesn't have to. the man who chose to defend him doesn't have to run our civil right division. >> let me say first, he is an extremely well qualified lawyer. someone an american success story. he is one whose family, one-time, homeless. and was able to rise above the circumstances and become a very well accomplished lawyer. and some one that served the public interest all of his career. clearly. other phases of the law. make an awful lot of money. some one that is dedicated. even now. senior counsel to the senior judiciary committee. deserves the position. >> can i jump in. ask you about that. there are some reports. i have not independently confirmed these. that he was deemed unqualified for a position on federal bench by american bar association and so his nomination never went forward. but the ada found him unqualified? >> i have never heard that before nor seen it, gone through

the vetting process. i think we may want to look deep near that to see how accurate it is. >> i don't want the viewers to take that as fact. that is out there being reported. i have not confirmed it. >> i have known him a very long time. watched his career grow. he served the american people. making sure justice is served. frankly is the best qualified candidate for the civil right position i have ever known. some one tried more cases before the supreme court. suck se . >> but getting back to the controversy at hand. i mean you have got the cop organizations cupping out saying this is a thinl the eye of the law enforcement and demonstrates lack of regard for everyone strives to keep the president and everyone in the nation safe. the letters talk about, the anger, and say in representing him that this nominee and others they said they turnt ju it on i

head with unfounded allegations of racism, the police organizations who speak for the fallen officer say this is not the man. >> keep in mind. >> you think he is qualify. you don't have a problem with his representation. and look at his overall career? >> i think he is in very good company. actually, john adams in our history, represented british soldiers after the war wecht know that john roberts, represented a serial killer in florida. indeed we expect our lawyers, our good lawyers, to be able to represent any american person that need that kind of defense. our adversarial system and democracy deserves no less. >> mr. shelton. thank you for joining us. >> a pleasure. >> the administration has received another series of letters from different police groups angry about this nomination. latest nailed from a group

attorney general, that person is response bum for ultimately determining which cases are brought against police officers, and law enforcement agencies throughout the country. and not only, volunteered for this position. but was successful in overturning the death sentence of a convicted cop killer, whose sentencing was upheld. >> doesn't that speak in his favor. the fact that, an independent court, two of them, said you know what, you got a legal argument. does that vindicate the lawyer in his poe snigs. >> but that's not the issue here. the issue here is why they took on the case in the first place. during his testimony, i apologize for misproducing his name as the well. he testifieden front of congress. asked about the case. made the case that they took it on. based on the legal issue. but when you look back at the video. look back at the rallies.
