the ship. and breaking tonight, the senate intelligence committee today releasing a scathing report on the terror attack in benghazi. and the bipartisan report points the finger of blame directly at hillary clinton's state department for the failures leading up to the death of four americans. welcome to "the kelly file" everyone, a busy night tonight. the report is out and the findings are clear. a 15-month report determines not only was al-qaeda behind the attacks contrary to what the white house and "the new york times" told the world but that it could and should have been prevented. the report concludes as follows, this is a quote. the failures of benghazi can be summed up this way, the americans serving in libya were vulnerable, the state department knew they were vulnerable and no one in the state department did anything about it. the intelligence committee does not collect threats in dangerous

places so it can be ignored by senior decision-makers. yet the intelligence warnings in the field were met by this administration with a deafening silence, the four americans who were killed deserved better. our chief intelligence correspondent catherine herridge with more. >> well, good evening, the claims that this was the work of extremists with no formal terrorist connections. >> several al-qaeda members emerged as kind of leaders of the pack. so i can say with complete confidence that al-qaeda was involved in it. >> the report concludes that a former guantanamo detainee first identified as a suspect 16 months ago was involved in the planning. the senate committee also sought a classified cable first reported by fox, as well, that

summarized an emergency meeting in benghazi one month before, which warned al-qaeda camps were operating and that they could not defend against the coordinated attack. >> well, they resisted for a long time in providing it to us. but at the end of the day we did secure the cable. >> and the senator told us it is part of the pattern where the state department continues to block access to witnesses and documents that should explain whether a white house meeting on the day of the assault believed to be then defense secretary clinton, setting the margins for the attack. >> no we were not. we have been stone walled on that question, we asked time and time again who was in the meeting and what was the substance of that enemyi imeeti we've not gotten answers to that. >> the head of the senate committee, dianne feinstein says she hopes it will put to rest the speculation, and the

findings. carney failed to address one of the most significant findings, that benghazi was an al-qaeda-led event, megyn. >> catherine, thank you. you're welcome. >> this is the second shoe, a major one to drop in the benghazi investigation this week. on monday, as we told you, once classified testimony was revealed proving that this administration knew, they knew that this was a terrorist attack from day one, despite their refusal to admit that fact. we learned on monday that in a 2013 meeting, the general told a congressional committee, quote, i think the command very quickly got to the point that this was not a demonstration. this was a terrorist attack. a congressman followed up, and you would have advised as such if asked, would that be correct? general ham replied well, with general dempsey and leon

panetta, that is the nature of the conversation we had. yes, sir. he is referring to then defense secretary leon panetta and then the general chairman, met moments after, as the attack was in full swing. mr. leon panetta reported that yes, he was the one that informed the president that this was an attack under way, that there was no question in his mind, mr. leon panetta's, that it was, quote, a terrorist attack. despite all of that, that we've now learned and seen in writing this week, this is what we've hed from the president and his team for weeks after. >> there is no doubt that the kind of weapons that were used, the ongoing assault, that it was not just a mob action. >> uh-huh. >> but now, we don't have all the information yet. and so we're still gathering it. >> we've seen rage and violence directed at american embassies over an awful internet video

that we had nothing to do with. >> we have no information to suggest that it was a pre-planned attack. the unrest we've seen around the region has been in reaction to a video. >> in fact, this was not a pre-planned premeditated attack. that what happened initially was that it was a spontaneous reaction to what had just transpired in cairo, as a consequence of the video. >> former presidential speech writer and american enterprise fellow and a columnist for "the washington post." and so these conclusions tonight, mark, puts the blame squarely, squarely on the state department, saying they had been repeatedly warned and nothing was done. they were not protected. and they had every reason to listen to those begging for hillary clinton's state department to do something they did not. and so i ask you about the political fallout now for the

administration and for hillary clinton. >> yeah, this is devastating for hillary clinton. i mean, this is a bipartisan report. so it is her own members of her own party were saying that she was repeatedly warned. and that this attack was completely preventible, and the intelligence committee gave us all the information we needed that something was going to happen and that we needed to fortify that in the consulate area and we didn't do that. and hillary clinton was the one that campaigned against barack obama with that 3:00 a.m. phone call readiness, that she would be ready to answer the phonem. t well, you know what? the phone was ringing and ringing and ringing for months and she didn't answer. >> well, you know what? they can say that hillary clinton didn't know, maybe her minions who reported to her didn't tell her. and saxy chambliss commented

earlier. this is what he said. listen. >> what secretary clinton saw, i don't know. >> did you guys interview her? >> she did not testify before our committee. we don't have jurisdiction over the state department. we have hounded on the state department for documents as well as individuals and we kind of hit a stone wall with that. >> why are they getting stone walled? >> i have no idea, and honestly, i have a minimum of high regard for people who always blame their minions. we're hearing all the time, i didn't know, my staff is responsible. and i'm sorry, secretary clinton is the secretary of state. she is responsible for the embassy, and by the way, why didn't she go out and do those five sunday shows, susan rice was not the secretary of state. one of her ambassadors was killed on the job, and she didn't even have the courtesy to

go out and explain to them. and she put it on susan rice and then went out and delivered this line? there are a lot of questions that hillary clinton has to answer. >> it seems like a major story but you might not know it if you took a look at the media coverage this week. fox news analyst bernie goldberg joining us. as you watch the media, you see a lot about chris christie and bridgegate, which is the story. not so much about this. >> absolutely true, so what we know for certain, thanks to james rosen reporting, he broke that story that the secretary of defense and the chairman of the joint chiefs told barack obama minutes after the attack in benghazi started, that it was a terrorist attack. so what happened after that, as your montage showed. susan rice went out on all the talk shows and gave this fairy tale version that it was an anti--muslim video. we may have suspected that was not true. but barack obama knew it was not

true. and they let her mislead the american people. that over the next two weeks, a variety of members of his administration use whatever verb you want, lied to the american people, misled the american people, told half-truths, he knew because leon panetta and general dempsey told him it was a terrorist attack. so how did the media cover this, right? 35 minutes on the networks on monday and tuesday when the story broke. 35 minutes on the george washington bridge traffic jam, and zero, zero time on benghazi. and no major newspaper covered it either. now, one thing i know for sure, even though -- it is not even speculation, we all know for sure if george bush was president and he misled the american people for several weeks and his administration

did, that would get some play in the media you and on television. >> and i understand, obviously, we're talking about president obama and his administration. but we're also talking about chris christie and hillary clinton who we believe are the likely frontrunners for the next presidential post. so chris christie gets a lot of coverage for bridge gate. but what about hillary clinton and how this reflects on her? >> that is a very important question. and i'm not so sure, i agree with your previous guest who says that hillary clinton is in a lot of trouble. she ought to be in a lot of trouble, i agree with that. but a lot is going to depend on how the so-called mainstream media deal with this. now as i said they're not going to ignore this story that came out today, the senate report. that is much too big a story not to report. but they blame the state department. let's see what happens in editorials and in commentaries and comments. and let's see how journalists,

so-called mainstream journalists handle this with respect to hillary. are they going to go after her, since she headed the state department? or will they cover for her? >> because so far, bernie, the bridge scandal is not tied directly to christie, it is the people who work for christie. so far the state benghazi thing has not been tied directly to hillary clinton but people who work for her. so should not there be an equal approach in going after it with fervor on both sides? >> there should, but the reason the media is not worried about being even-handed is because they know the american people don't really care about benghazi. i don't mean the people watching us tonight. they care, half the people in america think benghazi is the latest hot spot on south beach. but everybody cares about traffic jams, that is how shallow the american people are, so traffic is going to get news

it's "the kelly file" with megyn kelly. well, it is 11 months to the 2014 mid-term elections, but "a new york times" report got our attention when it outlined serious concerns for democratic incumbents. attack ads hitting them early and often for supporting obama. >> it is time to be honest, obamacare doesn't work. >> tell congressman barber, obamacare is hurting arizona families. >> tell kay hagan obamacare is hurting people. >> call congressman peters and tell him obamacare is not working. it is hurting michigan families. >> joining us now, joe trippi, former presidential manager for

howard dean, he has worked on numerous campaigns and is a fox contributor, so the ads are growing, which largely have gone unanswered. >> i think they're right, i don't think they're going to get answered. this is 11 months out. and i think when you're -- look, these ads are going to work. they're going to drive some of these candidates' numbers down, they will hurt them unfavorably. and probably hurt them in their horse race numbers, the head to head numbers against a republican challenger. but the mistake here when you're being outspent like this, early, 11 months, first of all this means this will be a very ugly election year for these kind of ads to start this early. but second of all you don't want to start to chase this by spending money now when -- you want to wait, hoard your money until people are paying more attention later on in the year and get your message about any

flaws in the other candidates. but yeah, these are going to hurt. >> these are largely spent, paid for by americans for prosperity, financed by the coke brothers. they spent $20 million on the ads. they must see some benefit to doing it now. >> well, one, you're helping to define obamacare, these ads are saying that obamacare is bad for iowa, and for new hampshire, the gallup poll came out saying for 66% of americans, obamacare has not affected them. i'm not trying to get into an argument on whether or not obamacare is good. we're not talking about that. but the ads define it in a negative way and help to attach it to the candidates. i understand why the republicans or why this group is doing it. but i think look, i did jerry brown's campaign for governor of california. we were out-spent $187 million by meg whitman and other

independent groups out there. and we just had to let it go. we let it go for months and months and months, she built up a nine-point lead on us going into labor day. and we had enough money to get our message across, we came back and we won. and i think that is what democrats are going to have to do. first of all, mid-term elections are always bad for the president's party. republicans are likely to do well in 2014. and this amount of spending this early is not going to help democrats, the best thing for democrats to do is to hold on, get their message right and come back fighting later on in the year. >> hold on, batten down the hatches and wait for it. all right, joe, good to see you. >> good to see you, megyn. fighting for peace is like racing for virginity. the government lied about inventing the virus as a means

of genocide. goddamn american for treating its citizens for less than humans. goddamn american, she is supreme. >> so when you think, keynote speaker, you think reverend wright. apparently that is true despite highlights of some of his more controversial sermons years ago. the chicago teacher's union invited him to be their keynote speaker at a martin luther king jr. event today. you can't make this stuff up. when he took to the microphones, he apparently went after his old friend, president obama. joining me now, michael skolnik, political director to russell simmons, and editor in chief. why is he the appropriate choice

for that event on such a day? >> well, i think the chicago teacher's union is trying to push the envelope. they have been in a fight with the city for years now, certainly they went on strike, and then chicago closed down the schools. >> does it help them? >> i think it certainly brings news and retention, and it brings a clergy member together of the african american community that they need to make this fight. >> are they trying to embarrass president obama? i mean, rahm emanuel is on the other side of the fight they're having in chicago, who of course used to be with president obama. but this doesn't help president obama, it brings him back in the news. and then on top of it, reverend wright got out there and started ripping president obama, talking about racism and classes and talks about drones. >> i don't think the chicago union is thinking about president obama in the fight against the city of chicago or the fight against the mayor of that city. they're thinking about what they can do to protect their teachers in a very, very difficult fight.

so they bring in jeremiah wright as certainly a controversial figure, and somebody who had a lot of influence in the city of chicago, he is very well respected. >> i'm thinking, i think, yeah, i do disagree that jews controlled the flow of worldwide information and oppres oppresse blacks, how does anybody put him up as a spokesperson, a keynote speaker of alvins, to honor mlk? >> i think it is just easy to pick sound bites. >> those are pretty incendiary -- not like you take them out of context. >> there is a sentiment -- >> on those things? >> on some things, absolutely, they believe barack obama is using drones, which he commented on today.

>> i didn't cite that one as one of the controversies, it is something he said that was not flattering to the president. >> there are certainly many people in the country who are yes with the historical background of what we've done in this country. and they agree with jeremiah. his congregation is 10,000 people, he is not a preacher preaching on the street corner to five people. >> how does he get up there today and compare himself to mlk? >> i certainly am not defending jeremiah wright, but i think it is important we have a discussion about the issues he brings up, instead of dismissing him as crazy. >> we don't need him to talk about drones, we talked about it before. >> well, we talked about it tonight because of him. >> touche. i'll end now. joining us now, in the middle of a big media controversy after critics accuse him and his wife of bullying a cancer patient. that is next. ♪ ♪

. well, the former boss at "the new york times," executive editor bill keller and his wife are under fire tonight. critics say they bullied a cancer patient in articles penned for two very public publications. trace gallagher has more. >> megyn, the cancer patient is lisa adams, who has stage four cancer, and has been documenting the cancer for four years on her

blog, sending out more than 200,000 tweets. emma keller wrote in the article that adams is dying out loud, and that people follow her reality story like a tv show, going on to write, are her tweets a grim equivalent to a selfy, one step funeral selfies. what is the appeal of watching somebody trying to stay alive? is this the new way of death? in a new york times op-ed, bill keller talks about how his father-in-law chose to forego treatments, and that his death was calm. he writes, her decision to live on cancer invites us to think about it, debate from it and learn from it. it is the standard bearer of the warrior, that may raise false

hopes and that seems to peg patients like my father-in-law as failures. lisa adams then responded, quoting here, not the same. to think about what you would do if you were diagnosed with incurable cancer as it is to actually be living with it, trust me, going on to write, the main thing is that i am alive. do not write me off and make statements about how my life ends until it does, sir. emma keller has since apologized. her article has been taken down off the guardian website. we should note that lisa has three children, all under the age of 16. megyn? thank you, joining me now, an iraq and afghanistan war vet, monica crowley served as a policy assistant to president nixon, this is an interesting stop, because the woman, the woman, the fighter is not happy with the kellers, and nor are the people who follow her every

tweet and her blog on twitter, what are your thoughts? >> you know, i don't think this is chris christie-style bullying, but what it says in our time, the reality-obsessed culture, this is going to be the new normal. it struck a chord, people are going to react to it in a raw way. we have to point out and applaud lisa for her bravery and candor. i have to point out the keller's one-two punch makes it seem like they're bullying her and taking issue and both being obsessed with watching her die and also sort of recoiling from it. the comments made it seem like they were criticizing her. it was particularly raw when bill keller said my father-in-law went away quietly and it struck a nerve. >> not only that, but he went on to talk about oh, she talks about how at sloan she has

amenities such as the k-9 program. he points out neither she nor the cancer victims would tell me what all of this costs and whether it is covered by insurance. well, what business is that of yours, bill? >> look, lisa adams decided to take her battle with cancer to tweet what she was going through and that does invite public comment. but what i think is getting, ms. keller talks about a piece where she says it may be tmi, too much information, and yet it seems like she is enjoying watching the woman tweet. >> but isn't she open about that confli conflict? she talks about how i feel strange about it. >> she does, then when she talks about her husband's are commeco where it is a broader health policy statement, in u.k., where

they have universal health care, where people are kind of encouraged to die gracefully. >> it was inartful, i can definitely see where the kellers are coming from. again, i don't necessarily like the tone. but if you look at the comments they couch it in the comment of respect, every person should go where they like. lisa certainly doesn't feel respected. but ms. keller also had had a double mastectomy. she is a cancer survivor herself, to say i also have a difference of opinion on end of life. lisa adams also has a pretty fervent following. >> she has 12,000 followers, she is in a hospital bed struggling with cancer. and these two have a huge microphone.
