catch up with you. >> you take a little snooze there thank you so much, clayton. >> one minute after the hour. right to your news headlines because we have a fox news alert. two american civilians are dead following a terror attack on a restaurant in kabul. another 19 people killed including three united nations worker. attacked out a packed restaurant while two gunmen snuck through the back door and opened fire. afghan police say the taliban is responsible. police are still searching for a second gunman wanted for a school shooting. this while one teenager wakes up in a philadelphia jail. a boy and girl both 15 years old were both shot in the arm in the school gym. they are expected to be okay. it happened at the delaware valley charter high school which has metal detectors so police are still trying to find out how the suspect got the gun actually inside that building. >> i feel like my son is not safe anymore he is senior in

school. i feel like he is not safe, not only him, other children are not safe. >> the teenager in custody turned himself in to police last night. no i.d.? no problem. a pennsylvania judge strikes down a judge requiring voters to show a picture i.d. at the polls. the judge saying the law, which has been challenged since signed in 2012, is unconstitutional and does not include a measure assuring photo identification could easily be obtained. the state's reason for the law was to combat voter fraud. smith grounded after being kicked off a flight in los angeles. this picture tweeted out shows the nfl star allegedly confronted by lax police. passengers taking this video here. authorities say smith was kicked off a virgin american flight to fort lauderdale after refusing to get off his cell phone. sources close to smith say he was the victim of an over zealous flight attendant. the jets say they are looking into it.

is that from. still wanting to find out answers and you find out from this report, this bipartisan report that there were ties from al qaeda. you hear from the "new york times" about a week or so ago a report that seemed very contrary to that. is that upsetting to you to see the differing of those two stories there? >> i work briefly in a carnival, okay? they used to have these guys called the patch man. david kirkpatrick and the gentlemen that wrote the the guys that smoothed everything over. and no, it's upsetting but, you know, i have developed a very thick skin, shall we say in this process which has been going on with me since december of 2012. the obama administration described hillary clinton as one of the great secretaries of state ever you have had

occasion to think a lot about her time as secretary of state. what do you think she accomplished? >> what did she accomplish? that's really -- what major foreign policy initiative was instituted under hillary clinton's tenure -- can anybody answer that question for me? i don't really see anything. they basically were trying to sell us this routine that al qaeda was on the run and that the arab spring was working. it did not follow the al qaeda winter. obviously benghazi is the greatest point in that i feel that hillary clinton and president obama at best are delusional and amateurish. >> can i say one thing? i have one people who have a heart and mind to support congressman frank wolf's efforts to pass house resolution 36.

served for that matter. someone's once we were able to accomplish that we felt like our job was done. nice added bonus that as many people that are going to see it or seeing it. >> it is incredible story. when we spoke to marcus last week. we wanted it know what the actors wanted to know and develop in this relationship before you started on this journey. we heard marcus' side of it. what did you want to know as you developed this relationship with marcus as o. to try to bring his story to the bring screen? >> well, as you know firsthand, marcus can be a pretty intimidating kind of guy. he wasn't really impressed with my resume as an actor. he is the kind of guy you have to earn his trust and earn his respect. and you do that by showing what you are going to bring to the table. and we were committed 110% to make it as authentic and realistic as possible and us looking like seals. we were basically under their tutelage. if you did something wrong they snatched you by the back of the neck and show you how to do it right and push you until you got it right. we welcome that with open

the training. you guys were right there. how important was it to be that authentic in your navy seal training? >> you can't cheat something like this. you know. i think originally the movie was supposed to be a much bigger budget but we wanted to tell the story. we wanted it to feel more like a documentary. we wanted to put the audience members and viewers right there on the mountain with us. the only way to do that is to go up there and do it and make it real. me being the oldest of the bunch there were times i wanted to complain and i would turn and look to my left and 10 feet away from me would be marcus standing there 14,000 feet on the mountain carrying pieces of equipment and stuff. considering what he went through and what he survived not only operation red wing but a year later going back to iraq and getting his knees blown out i wasn't going to complain. >> by brother having served with the navy seals and the navy, thank you for bring this to the bring scene. we aappreciate this. >> thank you, my honor sir. glad to do it.

type of a restaurant. but last night as people were sitting down to have dinner at the restaurant lebanese restaurant popular with international employees and also afghans. suicide bomber attacked back door while several gunman shooting people point blank. 21 people killed last night including at least two americans. maybe more americans. their names have not been released but according to u.s. officials they were not government employees. they were instead work for a private organization in kabul. among the dead also, the head of the imf in kabul. four u.n. workers and several afghan employees of the restaurant, guys. violence has been on the downside in kabul and afghanistan in the last year or so. but security there is still really fragile. and with the afghan election, the presidential election coming up in april, it's expected there will be more attacks like this. the scary thing is now it appears they are now attacking civilian targets like restaurants. something they have not done in the past.

voted for obama and the majority of veterans did not? do you think that has something to do with it? >> it has a lot to do with it. everything in this administration is definitely political. what further is incredible is when you think about what percentage of the american population are talking about military retirees as you know that 1% cost of living allowance is going to be taken away until you get to 62 because i guess they figure you can still go out and work even though you have given 20 plus years of your life to service. but it is incredible to understand that they don't recognize this service. that they don't understand that this is a commitment, a promise that's been made but it is all political because they don't feel that these veterans, the military, those retirees are supportive of this agenda. but i also believe this is an attempt to somewhat take down the military healthcare system and force more of our veterans to go into the obamacare exchanges. >> i want to read a statement by the v.a. i know some people who work at the v.a. who are veterans and love our veterans and doing the best they can and

morning. >> good morning, thanks. >> is this odd for senior advisor in the defense department in britain to speak so openly about this? slamming david cammeron as well. >> it is quite a statement he has come out with. ineffectively he has been hired to be the impartial voice. people want to hear it whether it's good or bad. is he actually fulfilling his job although slightly candidly in this case. >> certainly candidly because some of the statements are harsh in the statement that he puts out there. to the president's point though of the united states restoring confidence in the world. has that been done? what is your take on this senior advisor's comments about that? >> i think it's incredibly hard thing to measure. let's look baseline where president obama started in 2009. you had illegitimate war in terms of the eyes in the international community in 2003 in iraq raging for five years. war in afghanistan that's been going on eight years. approaching the height of coalition casualties. also just had a financial crisis that sent shock waives around the world and caused global markets to collapse.

i think from where he was starting from, he had a really good opportunity to implement some policies that could get america back on track in terms of the identity in the international community. one of the problems is one of the core principles of implementing those policies which is transparency which his whole campaign has been built on has been shattered when you look at benghazi and cia and drone problem. he has gone a step backwards especially in the second term. >> i was in ireland right before the inauguration and speaking to people in ireland were super excited about president obama coming into power it seems though that maybe things have shifted dramatically. robert gates our former secretary of defense and this british counterpart seem to make the case that the president is disinterested in foreign policy as if it is something that is not even on his radar and he has no -- he has no plans about it. what are your thoughts about the comments from the all has government? definitely been dropped on foreign policy. not just in the u.s. but from the u.k. as well and the west. i would actually argue ball

the veterans groups are sounding the alarm. here to explain is deputy legislative director from veterans of foreign wars ryan thanks for joining us this morning. >> thanks for having us, tucker. >> we received and put on the screen the statement from the v.a. about this. they say the proposed rule would require standardization to help streamline the process, modernize to make sure veterans and their families receive benefits more quickly. sounds like a good idea. why is it not? >> i will tell you right now. we understand what v.a. is trying to do with this. they are trying to incentivize veterans to file claims. it disincentivizes veterans from filing traditional claims or what we call more formal claims. sending written notice on a paper napkin to v.a. now, the problem with this, is that it could mean that veterans who choose to file a traditional claim could lose thousands and thousands

of dollars as they are waiting to fill out the form to the v.a.'s satisfaction. >> just to get some perspective on the magnitude of this, what percentage of veterans returning from iraq and afghanistan are claiming disability? >> well, i will tell you right now, we are seeing a much higher percentage than we have seen from previous generations. it's not only the veterans looking to receive the benefits but the number of conditions they're looking to claim. this can be viewed as a good thing because veterans know that these benefits are out there. unfortunately, when you are filing for more conditions or filing more claims it's going to take more time to adjudicate them. these are the wait times that we are sees six months to a year maybe longer for some veterans more complex claims. >> why do you think the administration is doing this? do you think there is another motive? >> i tell you i think it's about their path to modernization. people can file electronically. we know it's quicker so the vfw we have a cadre of service officers who help file these claims. if you file electronically

you will get a rating decision quicker. unfortunately, we don't feel this incentivizes filing electronic claim but penalizes a a veteran who chooses to go the traditional route. >> we talked to a congressman in florida who says he believes this is the part of the administration's plan to dlif veterans out of the v.a. system. do you think there is any merit to that. >> our organization hopes that is not the case. what we hope is that we can make sure shah veterans will use the electronic process at the same time the v.a. benefit claims are supposed to be non-adversarial process. they are supposed to be here for you if you are wounded in the line of duty. we hope the v.a. will take another long look at these regulations and make sure what they are trying to do here. and a veteran who believes they were hurt in the line of duty can simply just send in some paperwork and then have the time to really develop that claim, accepted the v.a. the information to deliver the benefits. we don't want to see a system where veterans have to fill out a long line of

over to rick reichmuth now for a look at the first alert forecast. >> so we have been talking about the warmth out across parts of the west. here is the storms two clippers watching right now. more behind these. one of them now moving across parts of upstate new york today and in towards new england. snow and isolated areas seeing more than that same story goes with this clipper that's moving in towards the northern plains and in towards the chicago area. continue to see the clippers move through. each time they do they will bring the temperatures down a little bit. start to hear people talking about very cold air moving in and possibly return to that polar vortex that everybody got very he excited about. no big concerns for that kind of cold temperatures but the cold air will come back. take a look at where those temperatures were in early january. we got to minus 31 in international falls. minus 16 in chicago. this time by tuesday, looking at temperatures still cold, about 10 degrees better than that though. so, cold air on its way. maybe in time for the super bowl? >> super bowl on its way, too. >> yeah, it is.
