favorite things, cupcakes and booze. >> so in the cupcake there is booze? >> barely. >> this is why america is great. this is why america is great. we'll talk about politics this morning and what's happening in mid-march. march comes the obama care deadline. that's march 31st for the obama deadline for enrollees. according to a document published on a federal website, it turns out if healthcare.gov is not up and running by mid-march, the entire law itself could be jeopardized for a number of reasons. >> yeah, in fact, a lot of the insurers could even go bankrupt and the health care industry as a whole could be in jeopardy from all this. and part of the problem comes from those back-end problems on the website. and it's -- the system is vulnerable to, quote, inaccurate forecasting of risk mitigation programs. what does that mean? insurance companies depend on these healthy people to

subsidize when the bills come in for the unhealthy people, they are going to the doctor for this expensive treatment, and it's the pool of unhealthy people, if that's bigger than the healthy people, that spells real trouble for the health insurers. >> congress heard about it this week, so is this really possible at all? the report says this functionality is not complete by mid-march 2014, the government can make erroneous payments to providers and insurers additionally without a fastball management platform that accounts for enrollments and associated program costs that integrates with the existing cms accounting platform, the entire health care reform program is jeopardized. that's a fancy government way of saying the whole thing is in the dumper. the ceo of trusted sec llc, he gave testimony this week to say security for the obamacare has not gotten better, it's gotten

worse. listen. >> healthcare.gov is not secure today. and nothing's really changed since the november 9th testimony. in fact, from the november 9th testimony it is worse. i don't understand how we are still discussing whether or not the website is still insecure, it is. there's no question about it. >> it is insecure. >> it is insecure, absolutely, 100%. >> what happened in mid-december when they brought in the new company responsible for getting their website up and running, normally they would go through the open contract process, this document reveals they didn't go through the open contract process where, hey, anyone can say, we would love to help out and rebuild healthcare.gov. we'll entertain your contract, they had no time. so they went to get this thing up and running or we are in deep trouble. >> this is so urgent we have to take out the initial contractor who is in charge of it. you know how much this is costing you taxpayers? $91 million to clean up this mess. >> and clayton, our friends at home, the other statistic now

coming out that i really found disturbing is that a new report shows that only 11% of consumer who is purchased new coverage under obamacare were previously uninsured. so the whole point of obamacare was to bring coverage to 20 million to 30 million people who didn't have it before, and now we are seeing 11% of the people that have signed up, and it is not a heck of a lot of people already, only 11% never had coverage. >> so let's unpack this a little bit, what does that mean? the wall street journal says it shows the early signals suggest the majority of the 2.2 million people who sought to enroll in private insurance through new marketplaces through december 28th were previously covered elsewhere, so only 11% of those consumers who bought the new coverage were uninsured, meaning they were either transferred from their employee programs, they decided to upgrade their plan and move to a new plan, but

they had coverage. they are not hitting those most vulnerable in our society. >> only 225 or 230,000 new insured under the plan according to the one statistic. >> right. so when we hear the 6 million number that the president tweeted, 6 million have now gotten covered, it's a fact, you can -- we have said that those numbers were squishy earlier this week, they are even further squishier this weekend. >> some fuzzy math there. we have other headlines this sunday morning, so we'll get right to those. the death toll rises following a taliban-led terror attack on a restaurant in kabul in afghanistan. three americans now confirmed dead. 18 other people were killed. when a homicide bomber set off the blast outside the packed restaurant as two gunmen snuck through the back and opened fire two. of the americans killed were identified, one is a nutritionist specialist for unicef, and 27-year-old alexis cameron of chicago at the

university of afghanistan. cameron's family says this, she took the job at the american university of afghanistan to help the young women of afghanistan get an education and take their rightful place as leaders in afghan societe. as you can probably guess, her death is a shock to us all and we can't imagine a moment going forward when she won't be desperately missed. gosh, terrible. two marines who died in combat awarded the navy cease top honor, the navy cross. matthew menakis and the other marine were fired upon inside their come pound back in 2012. both of the men engaged in the shooter buying time for their fellow marines to escape. well, the driver attacked by an off-duty police detective in this infamous road rage video, you remember this, now is suing the city of new york.

welcome back on this sunday morning. a record 91.8 million americans are still unemployed, at the same time the government attempts for job it have training programs and they don't seem to be helping at all. >> they don't have a job because i don't have a job. now you do the math. it's a waste of the american dream. first of all, they stick you in front of the computer.

we need the one-on-one. i need somebody to talk to, not a whole bunch of keys. it don't work. >> with nearly half of americans relying on some form of federal assistance, has the government declared a war on work? here to weigh in, john tammy of realworldmarkets.com. good md morning. >> has the u.s. government declared a war on work? that's an incredible concept for us to get our arms around, true or false? >> i think so. it has to be stress that unemployment benefits are in some ways cruel. this is not to minimize the pain of unemployment, but if you know you have a check coming from the federal government, then that means there's less urgency on a daily basis to go out to look for a job. the simple point that incentives matter. >> john, let's look at some facts together, they are really devastated. a record 91.8 million americans are no longer in the workforce. since january 2009, the number of jobless working-age americans

has risen 9.6 million. 47.4 million americans now rely on food stamps. these are historic figures. people are staying unemployed longer now than ever in our history since the great depression. what does that mean for our future? and what does it mean for our present? >> well, it means for the present that we're being robbed of the economic recovery. and it's got to be stressed with government compassionate here. the compass here is very cruel. every federal dollar that the individual pays to stay sidelined is an extra dollar businesses have to offer them to get them back to the workforce. that explains a lot of people leaving the workforce altogether. this is particularly problem during the slow economic period, because business logically has less cash to offer new employees. government is making it far more expensive for them to get these individuals back into the workforce. >> the average duration of

unemployment in 1982 when unemployment was 10.8% was about 18 weeks. now it's about 37 weeks. are we doing that intentionally to the american people? or is that the result of something else? >> i don't think it's so much intentional, but this is the inevitable result of government programs to stimulate the -- or put a cushion under an economic downturn. when governments spend money, when they offer up unemployment benefits, when they invest in businesses, they are robbing the economy of limited capital. there are no jobs about investment first, so governments try to cushion the blow of recession, they actually elongate them and take from us the very economic recovery we would experience if the government would just get out of the way. >> john, that's pretty eye-opening on this early sunday morning. thank you for being here. we'll have you back again real soon. we appreciate your insight, as always. >> thanks for having me. it's the honor of a

green. >> who would have thought, put it all together? >> so this wednesday, you perform, tell us about that. that's incredible. >> well, it was actually in honor of pope benedict's brother's 90th birthday, and this is something that's been in the works since last year when i first met pope benedict's brother. at that time they were talking about a 90th birthday party, but then the pope resigned and everything just happened. i never thought about the concert again until i got an e-mail from the biographer for the pope's brother, and he said, we were doing this concert at the vatican, would you like to be a part of it? we are inviting you. >> and getting to perform three pieces, secular and sacred, were you nervous or excited? >> nervous doesn't explain the level of stress there on that day. because you want to perform, and a pianist doesn't take their piano along, so i was nervous

teacher in his essay. it is really smart a kid did that, but it is even smarter the professor figured it out. with the highlighter. that's a -- that's a good virtual high five that the teacher figured it out. >> maybe a real high five. we'll talk about florida this morning, because you know what might happen, a new law could hit the books called rebecca's law. the name after the 12-year-old little girl who ended up killing herself, rebecca sedgwick, she ended up jumping to her death at a cement factory near her home after being bullied. her mom, though, trying to push for this legislation to outlaw bullying and cyber bullying. it could be hits the books soon. >> if you remember the two girls that were accused of cyber bullying this rebecca sedgwick, they did face harassment charges, but those were dropped back in november, but this mother is saying what happened to my daughter, psychologically, was so difficult for her, i don't want other kids to have to

go through this. apparently this is the first attempt to try to end bullying like this in schools. it is defined as similar atticly and chronically inflicting physical hurt or psychological distress. but people are asking, is this going too far because it includes teasing, social exclusion, intimidation, and those are things that are almost a right of passage sometimes for kids. >> well, peter, i want to ask you as a lawyer as someone who covers these types of cases, what the law wants to do, is make bullying and cyber crime, cyber bullying, a crime. >> a first-degree misdemeanor. >> how is it different than what's currently on the books? >> they have come one a harassment charge for the other folks allegedly involved in this recent suicide, and the charges were dropped. in the state of florida, and most states, it's rather unclear. so they have to cobble together harassment charges. so now they are moved into a digital law age based on some recent cyber bullying cases. in april 2013 the canadian teen

killed herself after an alleged rape and a cyber bullying. and then in march 2013 another illinois teen committed suicide after negative comments were posted on her facebook page. >> yeah, and then we have december 2012, a florida teen hung herself after cyber bullying episode. and then in september 2012, another california teenager killed herself after humiliating cell phone photos circulated around. >> how can you tell, though, with cyber bullying? because so much of it is phone-based, and in person you can tell, but sometimes it would walk the line. >> it's a subjective determination, what crosses the line into now criminal behavior that some states are trying to legislate. when is first amendment a crime to have a line of demarcation? >> especially among kids. >> people have been arguing this now really, really hard. they are saying, are you going to lock me up or my kids up for them having a kids conversation

back and forth in terms of e-mail? the problem is there have been suicides, violent events that take place. psychologists also say that in those cases, there's a previous position. there may be a drug issue, there may be an alcohol issue, there may be anxiety issue or depression issue that pre-exists the question. but the point is, the state authorities now including florida are saying, listen, we need to take this seriously because obviously it's a serious, serious problem. and i saw it with some kids in my own kids' grammar school. my kids weren't affected, but other kids were affected. >> we all know somebody who this has happened to. the question on the facebook page this morning after the question of the day, are police or parents responsible for regulating bullying? go there to weigh in on this. we need a law. >> should people be going to jail and facing criminal penalties for what parents should be regulating?

>> cyber bullying, it's so much easier to hide behind a computer screen. if you don't stop it now, it will get worse. we have other news stories making headlines on this sunday morning. the star of the a&e "shipping wars" reality show passed away. >> just like that, nice and easy. >> i'm not impressed. >> do you expect more or less? >> more. >> i will tell you what's fun, getting the inspection over and getting paid. >> the network says roy garber suffering a heart attack. his team transport was featured on the reality show following different carriers. the transport of untraditional items. sources close to the garber family say roy has had a heart condition for some time. he was 49 years old. a pennsylvania school bus driver suspended after dragging a little girl nearly a block. >> the girl's backpack got caught in the doors. the bus driver was unaware of

this, apparently, and she proceeded to the next stop. >> wow. the girl's mother was picking her up from the bus stop and said she saw the whole thing. she chased the bus down. eventually the driver stopped. the little girl was not seriously hurt, fortunately. it is unclear if the driver will be charged. the tapwater in west virginia is now officially safe to drink. officials are lifting the ban on drinking water saying test results are clean. the ban was in place for ten days after a chemical spill contaminated the area's water source for 300,000 people. pregnant women are still being advised to drink bottled water to be on the safe side. what do you get when you combine don chito, arnold schwarzenegger and bud light? >> surprise. >> damai lama.

an article published on espn.com revealed the network looked into doing away with the name, but decided against it because of the news. the bad news it would make. anna? all right, peter, a new report finds the majority of more than 400 american universities are severely up fringing on their students' rights to freedom of speech. so which schools are the worst offenders? here with some examples from the foundation for individual rights, the group behind the study samantha harris. good morning to you, samantha, thank you for joining us. >> good morning. thanks for having me on the show. >> now first up, you have troy university in alabama, banning or putting a ban on any comments or conduct consisting of words or action that is are unwelcome or offensive to a person in relation to sex, race, age, religion, national origin, color, marital status, pregnancy or disability or veterans status. what do you make of this? >> well, this is a very, very

broad policy. and it bans a lot of speech, including the kind of core political speech that's really at the heart of what the first amendment exists to protect. in the court of a heating political debate, people often get offended. if you are discussing sensitive issues like affirmative action or immigration or the iraq war, people may feel offended on the basis of certain personal characteristics, but that doesn't mean that that political speech can't take place. and the policy is also totally subjective. if someone is offended, it's a violence of the policy. and so that means the most sensitive members of the university community get to determine what speech is and isn't permissible. >> yeah, for the masses there. and now to virginia, longwood university, speeches dmorngs stations and distribution of literature are limited to one area of campus and requires five days notice. what if they want to protest in response to a current event that

happened the day before? >> that's exactly the point. there needs to be some allowance for spontaneous speech on campus. it's understandable that universities will want notice of demonstrations when it's possible, but requiring students to wait five days after, say, 9/11 or the boston marathon bombing or any kind of event that people want to respond to immediately, really deprives those students of the immediacy of their message, and that's the important part of getting that message across. if you wait until the event is passed, the importance of your message is lost. so universities really need to make some allowance for spontaneous speech. they also can't quarantine free speech to just one or two small areas of campus. >> all right. samantha, let's go to boston now, northeastern university banning transmitting material that in the sole judge of the university is, quote, offensive or intolerant. who gets to define offensive and intolerant there? >> it is right there in the policy, the sole judgment of the

university. that's a lot of discretion. one thing we see is that university administration hate to be criticized. so any policy like this that gives the university complete discretion to decide what's offensive and to shut down conversation and debate has the potential to be used against students who want to criticize the university. it also has the potential like the policy at troy to be used against political speech, because again, if you are discussing sensitive topics, there are a lot of opinions that someone might find offensive or tolerant, but have the right to ideas. >> marshall university is banning disrespect of person. does this seem outrageous to you? >> it does. free speech is not always civil and respectful. people are allowed to be passionate and are allowed to get angry. in fact, a federal court in pennsylvania struck down the

>> it does happen on a fairly regular basis. there are times when patients tell me something thenand they like, can i tell you this off the record? yes, they can tell me that. they don't want it in their medical record, and they are afraid of reprimand. if they are telling them something about a sexual history that is a bit off color. >> this raises a host of other issues when it tells you about the new information people have access to with the north carolina law, but that's for another day and time. the number one law people tell their doctor is about drinking and drug use. >> yes. and honestly, in medical school, we are basically taught to double whatever the patient tells us. so if a patient says they are drinking two or three drinks per night, we automatically are thinking more. it's not like we write it down, you know, they say two and we put down four. but also with drug use. the issue here is more about not

so much what kind of patterns or habits people are having in terms of their social activities, but a history of i.v. drug use is part of a medical history. because that raises your risk for certain diseases, such as h.i.v., hepatitis c, so for the doctor who is taking the history, you need to tell the doctors that information because it generates a very different thought process in our minds when we're working you up for a particular symptom. >> number two on the list is monogamy, and you have a story about this. >> i have a story about this. i had a gentleman a few years ago who presented to me with a chief complaint as a swollen knee. as a rheumatologist, i was thinking rheumatoid arthritis, gout or lime disease, unfortunately is a presentation for a sexually transmitted decide. you have to say, this sounds indelicate, has there been infidelity. 48 hours, yes, i've been cheating on my wife, boy was he ever. it ended up being gonorrhea, but

talked about how there are higher premiums that her folks in her state are seeing, less choice and even more -- less competition as well. a ac take a listen to this. >> unfortunately, we are very concerned about the insurance companies staying in business to pay the claims. if it happens quick enough and they can't get the prices up soon enough, they are going to go bankrupt. that's bad for consumers. we have less consumer choice and less competition on the exchange. in ohio prior to the exchange, we had 60 companies selling individual health insurance. >> 60? >> on the exchange we have 12. >> whoa. so only one in five of the companies selling insurance before are now still in the marketplace? >> yes, on the exchange. it's unfortunate. >> if you think about these insurance companies going out of business, that can put our health care industry as a whole really in jeopardy. >> no, that imperils state budgets. insurance companies going into

liquidation, going out of business or rehabilitation, that's a tremendous drain on the state and on the insurance policy industry nationally. >> so bailout, peter? >> there are bailout funds in most states in the united states for this to happen, but they don't have enough money if insurance companies start to fall like dominos. and we've seen that only 11% of the new enrollees of the 2.2 million obamacare enrollees are new insured. >> or have even paid their premiums, which also goes to helping the insurance company. if you don't pay your premiums yet, you don't make money off of them. >> they won't tell us how many exactly. >> right, we don't know how many have paid. another weekend here on "fox and friends" and another obamacare delay as well. the white house now has prohibited employers from giving better health care to their executives. so sort of -- i don't know, you call them the gold plan for the

executives, they were not allowed under obamacare to get a better plan than the lower rank employee. that has now been delayed through 2014. >> "the new york times" is the one who is reporting this. they say tax officials are saying they will not be enforcing this for all of 2014. and what would have happened is for every single person who was negatively affected, the companies would be charged $100 a day, which would advise them to treat everybody fairly. >> and for all the claims about the obama administration being the friend of working men and women in the united states, there seems to be a strange disconnect four years after the affordable care act is passed. there's still this strange disconnect between the wealthier executives and the working folks in companies and the type of health care plans that they have. >> similar to congress having better plans. >> absolutely. so they say, well, we can't figure out what discrimination is, we can't figure out what high compensation is, any of those things, so don't expect a

hardware of private internet companies. all of that remains. the basic structure of george w. bush's surveillance program remains, so i think that while he gave some rhetorical nods to the civil liberties folks, generally speaking, he came down pretty hard on the side of national security, which is not surprising for a president. >> so what about the american people who are concerned about their privacy, are they going to see through this speech and think it is some sort of deceptive rhetoric? or are they going to feel better about all this? >> i don't know i would call it deceptive, if you're upset about the fact that the president or the government is able to continue to collect all this information, you'll continue to be upset about it. on the other hand, if you feel that the government is going through all this information may prevent a terror plot and may help keep us safe, and the president did make the point, anna, there's not a single documented case where any of this information has ever been abused by the nsa or the cia or

any of our intelligence agencies, then my guess is you'll be okay with it. >> yet, maybe we don't have health information getting out there and available to people when there's been a website breach, but we got the alarming expert from the security expert who said the obama website is a breach waiting to happen that could have catastrophic consequences. let's listen to david kennedy this week. >> healthcare.gov is not secure today. and nothing's really changed since the november 19th testimony. in fact, from the november 19th testimony, it's even worse. i don't understand how we're still discussing whether or not the website is insecure or not. it is. there's no question about that. >> it is insecure? >> it is unsecure, absolutely, 100%. >> you're going to be talking to mr. kennedy on your show this morning, chris, what are you going to talk to him about? >> well, exactly what he's saying, he testified, for folks that this may have slipped by,

he testified before a house committee back in november. and now at that point the website was pretty messed up, but he said it's just like swiss cheese filled with holes. now he comes back and says that he and six other independent security experts went back to look at the supposedly new and improved site just in the last week or so, and he says it's worse than ever. in fact, he says, and we'll talk about this at the top of the hour, he says that he could go onto the healthcare.gov website and he could access the records of 70,000 americans, your name, your address, your social security number, your date of birth, everything he would need to hack your identity, to steal your identity, in four minutes. so we'll see. and, in fact, there's quite a lot of pushback from the government. and we'll ask them what they say to counter this, but if what he says is true, it's very alarming. >> meanwhile, you are talking to general michael hayden and patrick leahy, an interesting debate about national security,

actually so cold here in new york that we don't have a reading. i believe we are in the teens right now as far as what it feels like. minus 1 in chicago. 18 in minneapolis. 33 in dallas. yes, much of the country is feeling the wintertime. will it be as cold as early january, you ask? i've got the special map to show you that it won't be as cold, but yet close to it in international falls. it will be minus 26. that's the air temperature. not the windchill. that's on tuesday. same for fargo, incredible temperatures. feeling like -- worse than that, below zero, for all these areas into the minus 20s, minus 30s. chicago, there's your air temperature on wednesday morning. so really cold. and then on the flip side of that we're dealing with extremely dry, record-setting warmth for the west. because we have the high pressure that's anchored across the west. that's funneling all these winds down towards southwest california. and los angeles is going to remain warm and dry and blustery over the next several days. so the fire danger is going to remain very high.

children's future? joining us now to talk about this are clinical psychologist, jeffrey gardier and stephanie wise. good morning to both of you. >> good morning. >> can i start with you, stephanie? what's your thoughts about this? are we crippling our kids? are we getting it wrong as parents in our society? >> well, i think crippling may be a strong term, but i do think that parents are parenting for the moment and not thinking about the future. i think there's this definite overparenting, helicopter parenting, where they are worried, they don't want their child to fail, because then they are going to have to see and feel for them. so they are protecting them. >> doctor, none of us want our kids to fail. are we protecting them too much? are we failing them? are we crippling them? >> well, stefanie is correct, this whole term of crippling is too much. and even though there's very good advice given in this

article that she and i have read as to how to make your kid stronger, i think this idea of making parents feel guilty, shaming them into doing some very, very difficult things, i think, scares the parents and it gets in the way of talking about it. >> let's go through some of these things and then apply it to all of us as parents and our kids. we rescue the kids too early when they get in trouble. right or wrong? >> right 100%. there has to be some failure there. there has to be some way where we say to them, it's okay to make a mistake because how will they learn? >> all right. dr. jeff, should we let the children fail their way to success? >> i think if we let them be less successful, i don't even like that term, failure. i didn't like that word, okay? so i think it is about you can rescue, but the rescue is, what do you learn from what it is that you didn't do right or what you can do better again, this advice is, just let them fail

>> and how did the pair come to you? >> animal services, seminole county animal services was called when they were abandon on the side of the road in geneva, florida. and the protocol is to separate the cats and the dogs. and they quickly noticed that the two of them were really stressed for not being together. and after five days, no one came to claim them and so we do adoptions through animal services at hollywood hounds and have since 2007. and so if it's something unique or needs a little extra special care, it's not uncommon for them to give us a call. and so we were anxious to go ahead and step up to the plate and take them. >> yeah. the anxiety they must have had being apart. this bond is incredible. is it something you've ever seen before? i know the dachsund was even barking at the rescue crews who was trying to get to them and

take them to a safe place. >> she sure was. and anyone that's ever had a dachsund or knows a dachsund knows that they take that charge very serious. they are all in, so to speak, and even though idgy is very small, she's all heart. >> it's those little dogs that you have to look out for with the big heart, as you mentioned. how are they doing now? >> they're doing fantastic. certainly ruth still has some physical issues. she's handicap, but we are looking into possibly some alternative therapies for her. and some diagnostics on the 28th. to see if we can either stabilize her condition or possibly improve it. >> and when you say different types of therapies, alternative types, what would those be? >> there has been some already tried. act ewe p

that's when the cutoff for obama care will take place. a new document has surfaced this morning. it's been posted on a government website which basically says if this whole thing, the website isn't fixed by mid march, if it's not fixed by mid march, it could jeopardize the entire health care law itself. the whole infrastructure would fall out of the bottom of the thing. >> yeah. accenture, who got this $91 million contract, which is your money, by the way, is cleaning up the money that cgi federal left behind. and they're basically fixing the back end of the website now. and part of the problem with it is if the insurance companies don't get enough money from healthy people, what is going to happen if the pool of unhealthy people outweighs the pool of the healthy people and then they end up going bankrupt and the entire health care system is in jeopardy? there's a problem on on the back end of that website, the

forecasting, so they don't know how many people are healthy and how many people are unhealthy. >> and let's hear the scary forecast. let's go through what the health and human services report is saying. they say if this functionality is not complete by mid march 2014, the government could make erroneous payments to providers and insurers, additionally without a financial management platform that accounts for enrollment in associated program costs that integrations with the existing platform, the entire health care reform program is jeopardized. >> now, peter, you're a lawyer. that sounds like the way lawyers talk to each other back and forth sometimes where we're like, what is that? >> essentially, we're going to be in the toilet come march unless they do a lot more than they're doing. they have significant problems that they're confessing to in a way that no one understands. >> and i love the technology side of this whole question. the real story was exactly what

you were talking about, it's this database problem, the back end infrastructure. now, it's very, very difficult for companies to even have two databases communicating with each other through one website. now, imagine 50 databases. 50 state database websites that need to be connected to the federal website to go to the state exchanges and these to these insurance companies which are compete, each other. it's like a web, an absolute nightmare for anyone. that's why google and other people said, you have to fix this. we don't want anything to do with it. >> and critic res saying that the consumer part of the website is being fixed first and the insurance side is being fixed second is because that's more obvious to americans. so if it looks like everything is okay and everything is rosy, more people will sign up. another reason people aren't signing up is because they're worried about their security. david kennedy says it's actually gotten even worse. >> it's not secure today. nothing has really changed since the november 19th testimony.

>> tell us, you had coverage and you were all set to go get your treatment for breast cancer. then what happened? >> as of january 1st, my insurance plan rolled over into a new obamacare plan that is part of the exchange. my doctors are no longer available in my network. so the surgeon that i was dealing with, following her orders, i no longer have access to. i don't have access to the facility where i was supposed to get a biopsy done on january 3rd. that was delayed about two weeks. basically, this is delaying all of my treatment and surgery. most people that get breast cancer don't wait this long to have a surgery. but it's as if i never had surgery at all. >> and so the peeled at sloan memorial said you were going to come here, but now you can't come here.

>> yes. >> as a result, you had to delay the biopsy for the type of cancer you have, this did you cto invasive carcinoma. >> yes. >> and it's a serious, serious form of breast cancer. >> absolutely. >> what do the doctors say about this delay? >> everybody has been trying as far as sloan kettering is concerned, my primary care doctor, they've all been helping me try to get through this disaster of an exchange. as far as the website, i wouldn't even pull up the comparable doctors that would be able to -- other surgeons that would be able to help me. when i called, if you can even get through to somebody, you're waiting there for over 2 1/2 hours. you finally get through to somebody and they can't give me a list of providers. >> josie, do you support obamacare when the president was talking about it?

would be called rebecca's law, to make it illegal for cyber bullying and bullying. peter, walk us through some of the murkiness of it. why wouldn't this be covered by regular law enforcement? >> it's interesting. they want to make it a first degree misdemeanor under the law to willfully, maliciously or repeatedly harass or cyber bully another person and a third degree felony if there's a credible threat and some physical threat involved in the harassment. some people say it's a subjective determination. how do you know whether it's really a crime? and other people are saying, well, this should be within the purview of the parents. the parents should regulate this and it shouldn't be a matter of criminal law. >> certainly, it's a lot easier for people to hide behind a computer screen. we get a lot of nice things sent to us and a lot of ugly things, too, and it can really be hurtful. and, you know, it's the way of the world now with technology being the way it is.

we have some other examples for you of cyber bullying cases. back in april of 2013 a canadian teen aimer killed herself after an alleged rain in 2013. in march, an illinois teenager committing suicide after negative comments were posted on her facebook page. december 2012 a florida teenager hung herself after a cyber bullying episode. we have several of these examples. how far, you know, can it be taken? and can the parents even be blamed for it, too? is it their responsibility? is it the police' responsibility? is it a human's responsibility not to treat people like this? >> and you've been talking about it on facebook because we asked earlier, rick says parents should be responsible, but too many of them won't take the time to discipline their kids for anything. ashley writes us, police because as a teacher, i've come to realize there are too many parents who don't do their job. >> and deb says parents need to parent more and be more involved

in their kids' lives, then if a problem arises, work with the police. >> and jeanie, if parents were held accountable for their child's actions, i think bullying would be less prevalent. we know our daughter's pad woords and review her accounts. >> when you have something like this that would then go on the book legislatively, are high school kids aware that somehow now the laws are more stringent for bullying? >> oh, yeah, i think it becomes part of a greater education program. and i think there's cyber bullying education, i know there is, in many of the schools and high schools and middle schools in our country. but part of the education would be if you break the law, then you can be held responsible or if your parents are somehow involved or enabling you, then they, too, can be responsible. so in terms of parental and student responsibility, they'll know that someone would go to jail, either a misdemeanor or a felony of threat of physical
