"america news headquarters" starts right now. hello from washington. we begin with a debate over all that data. the national security agency has been scooping it up and who should hold it, the government or a third party? president obama floated his ideas friday and today members of congress responded on the sunday shows.

we are joining now with more on the debate that affects anyone who makes a phone call. hi, steve. >> that's right, shannon. the balance between privacy and security, a hot topic on the sunday talk shows, just days after president obama announced the nsa spying scandal, or controversy, that is. on friday the president announced that most of the nsa data gathering program would remain in place, but he said the government will need judicial review before checking americans phone records and will find a way to preserve the data gathering program without the government holding or restoring that so-called metadata referring to phone calls. but they say that government nee information belongs in the government's hands. >> many don't understand we still occupy the role of the great satan, new bonds are being devised, new terrorists are emerging, new groups. actually, a new level of

health benefits for all their employees. here with the details is peter. >> the delay again was supposed to go into effect shortly after 2010 after president obama signed the affordable care act into law. it layers the playing field by offering honor employees and their lower compensated employees her benefits. but still the irs has not qualified at each individual company, the rule has been dlanged longer. the critics are saying this is curious because they want to know how the white house can make so many changes to a law on its own. >> and here once again we have an administration that one more time without consulting congress and without legislative changes is altering their signature piece of louisiana, the

affordable care act. >> quote, under the affordable care act, for the first time all group health plans will be prohibited from operating coverage to the highest pay employees. t they are working on a new rule to take into account public comment that is were previously requested. the new enrollment period has 71 days left. if you don't have coverage 71 days from now, you will face a fine. and the wall street journal reports at 22% of the people who have signed up so far were uninsured. meaning those running through the exchanges are doing so because they had other plans canceled. and this races a lot of impact they have on those who don't have health insurance. on another note, senate

a agricultural bills comes from within the states. they need topaz a bill to the right of the senate bill. there's plenty i can do about that. there are a lot of ways you can pass a bill good for the comp y company's economy and make sure the people who come here work and pay taxes and that they are actually that's not a strange at all. maybe if we didn't have this to start with, i would feel better about it. >> what about those who oppose the idea of massive immigration reform. if some pathway to citizenship or some call it amnesty would allow millions of workers and you talk about the neat need for

those who desperately need work. if we have an influx of cheap labor, it stands to ben feet those from the outside coming in. >> the biggest agricultural commodity in mississippi is not cotton, it is actually chicken, broilers. you know what a chicken is? people are not having to bring labor to use that. up 70% of cattle workers in california are not here legally. we need to understand that and grow our economy. only 47% of adult americans have a full-job, but that's not because of immigration, that's about the bad economic policy by the obama administration that has pushed people away from work. we are talking about our

country's future and then the politics take care of themselves. >> we are talking about polling. recently there was a quinnipiac poll, there's been a huge swing in things. many are less likely to vote for someone supporting that kind of package. when the folks were asked about their vote for congress, they had immigration on the list ranked behind, quote, something else at 5%. is this something that republicans want to spend a lot of political capital on when it seems like it's not a priority for voters? >> well, i think boehner has the rig right idea in the house. pass the bills, not one great big bill, but pass the bills that really improve the situation. and then you see what you take up by what you can pass. i don't think it needs to be by

the senate where we say, oh, we have to do this and do that by some artificial deadline. american people don't want that, but it needs to be -- i'm not against a pass to citizen ship if the requirements are rigorous enough. if you did what we did in 1986, americans are not going to vote for that, but in 1986, only 40% of the people who could have become citizens chose to. >> can we trust this government to open force, without teeth, will they be reinforced. the senate bill says we are going to spin and the other says we are out of commission. the house is moving to the standard we are going to set, and unless those standards are met, we are not going to go forward with some of this other stuff. i do believe that we can sit on

south of milwaukee a train collided loaded with coal. it derailed this morning. 19 of the 135 cars jumped in trains in wisconsin. nobody was hurt, but there are big concerns because this happened on an overpass. officials say it will take crews with heavy equipment all day to try to clear that scene.

according to a number of house members, gop, they say president obama has overstepped his constitutional authority and are prepared to sue the administration to put a stop to it. authorization against the executive branch is gaining in the house. joining us is republican congressman tom rice of south carolina. congressman, welcome. thank you for joining us today. i know this is something you have been working on for a while. why do you think it is necessary to take this bold of a step? >> well, shannon, thank you for having me on the show. and welcome to myrtle beach in south carolina, america's beach playground. this started last summer. i've had hundreds of constituents say the president's breaking law, why do you continue to allow him to do that? and when they are president,

vote to unilaterally pengsd the benefits for a year. the next day senator hard kip and came out and say the law, this is what spurred me into action. and we are looking at things short of impeachment, which requires a vote in the senate to force the president to comply with his ab on legation in article 2 of the -- resolution 442. >> i know it points to specific modifications of the law. and i know there have been some issues regarding when members of congress tried to sue issues in the executive branch and a lot of people think what you have put together here may help you get better idea of that, but this -- in may of these instances, when he's made a change, congress says, great, we'll put it into legislation.

and the white house says, if you do, we'll veto it. so there's quickly french beyond the executive orders. so if you don't succeed in this particular effort to stop him with regard to the law, it sounds like he has other plans in place. how far do you push this and do you need other democrats to sign on to be successful? >> well, you know, if it passes a majority of the house, it will start to -- i have not crossed the aisle with my friends la lately. clearly the president is overstepping his bounds. in the prior cases that you discussed, there were congressmen who were unhappy they lost the vote and the way the law went and they were challenging that law. that's not what we are doing here. the president has no authority to do many of the things he's

doing. for example, extending the employer mandate. waiving the executive order, that was not demanded by congress. our forefathers thought of rebellion to get from under a monarc monarchy. and they designed or constitution to be a government of, by and for the people. the people are the ones who are -- who have the power in our government. and this is based on second generation of powers. the congress enacted this. and when you have the president of the united states coming out two days ago to say, look, i'm not going to wait for congress to act on my agenda. i'm going to have a win on the tell. well, he may have an opinion over the telephone, but we have a right under a constitution. our freedom is under attack. and we cannot stand by to watch

security concerns are in the spotlight as russia prepares to take the stage with the winter olympics. peter is here with this story and more. hi, peter. >> vladimir putin says he will, quote, do whatever it takes to keep the winter olympics safe next month. in his first american interview in years, he told abc security will be tight but not in your face. guaranteed there will be plenty

of snow, which has also been a concern. however, putin declined to make a bet with president obama over which nation will bring home more olympic medals. egyptian voters overwhelmingly approved the new constitution. and by overwhelmingly, we mean with 98% approval. that's raising eyebrows now, including those of secretary of state john kerry who is voicing concerns over fairness. voter turnout was around 39%, but the youth vote went largely missing after the military cracked down in november on unauthorized demonstration. things are still bone-dry in southern california, but the wildfire there is finally dying down and evacuated residents are being let back into their homes. the fire damaged five homes and damaged 17 other structures according to estimates. and it's been a deflating weekend for the city of minneapolis. yesterday the air was cut off to

>> you cannot not have an election this year, so they are looking for a way to run. nancy pelosi and her team, it's a dangerous course, i think, they are charting. if you invite people to think about how bad obamacare's rollout has been, how unpopular the law has been, it is a pretty stunning assertion to believe that you can say, we are the party of obamacare o. b. obamacare is the most important thing the democratic party has done in three generations, and then to somehow think you can trick voters to thinking obamacare is bad. we are fixing it. no one is going to think the republicans pass odd obamacare, so this is a dangerous course. maybe they don't feel like they have a choice, but i doubt they will pull off this switch. >> another change we have noticed is that this week, or within the last two days when house minority leader nanny

pelosi was asked about it, the reporter said, are the numbers accurate with sign-ups, he called it obamacare and here's how she responded. >> first of all, it's called the affordable care act. that's what you're referencing, they are going after the affordable care act. you are saying let's do everything we can to take away health insurance from 9 million americans who already have it and prevent many more millions of americans from having it. >> i think there's a lot in there you would like to address, but let's start with the fact it was call odd obamacare by the administration on down, but now it is affordable care act. >> the approval ratings stink and he's not popular. the law is not popular for democrats who would like to preserve the entitlement, they will try to take his name off the door. at some point the firm of obamacare and company is going to get changed and the democrats hope to remake it as the affordable care act so it

doesn't have sort of the odor of obamacare about it. but the other important thing she did there is deceived. she didn't tell the truth about how many have signed up for the law, and that's been the biggest story on obamacare this week. the big story on obamacare was the president who said, we're going to be on the level-level with you people from now on. we are sorry about if you like it you can keep it stuff about your doctor, and we did mislead you, but it is really for the best. so we'll be absolutely straight-forward with you. the 9 million number she talked about is total bunk. the biggest part of that, for example, just to -- you can defeat the number quickly by pointing out the biggest part of that, the sign-ups for the welfare program, medicaid, they said they had 4 million. shaun trend from real politics and others at "the washington post" took a moment this week to say that's not true. and that number is probably more like 300,000 people who signed up for medicaid under obamacare. the rest are people who would have signed up anyway. so they are trying to, in her

wednesday marks the 41st anniversary of the supreme court's landmark decision roe v. wade. groups on both side of the abortion issue will gather at the nation's capital. joining us to discuss the march for life and the latest on the battleground for reproductive righ rights, thank you both for coming in. >> great to see you. >> marjorie, pro-life has been targeted with going to the state level with mixed success. there are a number of things that passed but a number of things challenged in court, some things struck down and some didn't succeed as ballot initiatives. what is the state of play? >> the state of play is centered around the 20-week bill.

we'll see in 2014 that pro-life candidates go on the offense on this, and legislation has passed in 13 states already. the 20-week paying capable bill, that certainly is passing on the state level. and it's also passed in the house. and senator lindsey graham has already collected 40 co-sponsors in the senate. so we expect to see a vote on that in the senate. i would say that it is exactly the crooked line that the partial birth abortion ban took when it made its way winding through courts and through state legislatures and finally being signed by the president. >> so much of the same track there. we know recent polling on the 20-week ban which is fetuses can feel pain at 20 weeks so banning past that point. in a washington post/abc news poll, 56% said they supported it at 20 weeks. a quinnipiac poll says 60% of woman support it from that point forward. reverend, can you agree with that kind of limit?

should there be unfettered access? >> we don't believe in unfettered access. we are in favor of the 24-week ban that is currently the law of the land after roe versus wade, as are the majority of the people in the country, including a majority of people of faith. people of faith know that we need to look at these very difficult decisions with compassion and as a pastor and a person who represents pastors and rabbis around the country, i know firsthand the difficulty of having conversations with women and families about whether and when to terminate a pregnancy. the 24-week ban is the law of the land because it really does strike the right balance of justice. >> do you think science has greatly progressed since 1973 and we know more about development and those kinds of things, does that give you concern that when there are specific findings regarding 20 weeks and even earlier in some cases that maybe it's time to revisit that cutoff point?

>> that science is really disputed in lots and lots of different ways, but what we do know is that if we're going to have a conversation about the availability of abortion, we must keep central the lift experiences of women who are facing these difficult decisions and their families, including the children they may already have, that they are struggling to house and educate and feed. those children and their lives have to be brought in to consideration, too. so it's most important that that woman be left to have the choice herself in consultation with her family and with her clergy. >> marjorie, i know your concern is also for the pregnancy, the child that is being carried at that point. >> that's right. if we're going to choose a point in time in the gestation of the child, we must be choosing it for a reason. and i would say that the experience of women and the experience now we are seeing inside the woman of the unborn child shows that we're talking

about two people. we're talking about two people whose lives need to be protected. on the child's part, we want to welcome him or her and protect him or her with the law. when it comes to the women that deserve our love and support, they will have it. and they already have a safety net that's out there and there are couples just dying to adopt children who can't be cared for and the families they are coming into. >> i wish that were true, marjorie, but the reality is that the very people who are working to try to get roe versus wade overturned, and that's really what we are talking about here n the long-term, all these efforts are to get a case before the supreme court that would cause roe to be overturned. those folks are not working for regular access to prenatal care, postnatal care, educational opportunities for children. >> we have to wrap up, five seconds. >> i would say you will find the most bleeding heart, kind, wonderful people in the march for life this week. it's bigger, it's more female

there are reports that a russian teenager could be behind the cyber attacks that hit target over the holiday season. he had a software code that encrypted target's systems. the teenager was given a cut of the profit, we are told. and you may be surprised at this next list of trend, a new list of millionaires and the state where most of them live is turning heads. brenda buckner has more on this. hey, brenda. >> what state is climbing faster in the millionaire rankings? hello to north dakota heading way north in the annual rankings of millionaire households per capita. it shot up 14 spots last year.

in 2012 north dakota was 43rd and went to 29 in one year. you won't find any beverly hills here, but you'll find natural gas, lots of it. energy in the shale region fueled the rapid rise in pple with a lot of zeros in their wealth. the state's unemployment rate, too, is get this? 2.6%. a new study finds there are more than 50,000 added millionaire households in the nation last year than the year before. add them up? some $6 million. maine was another fast-moverer climbing 11 spots, be don't bet on nevada's economy, that state fell to 29. arizona, florida and michigan also fell. why the drop? it's the economy, the recovery very uneven across the country. the states that jumped in the rankings turned around in their economy. as for nevada, florida and the losers still stuck in the aftermath of the recession.
