presentation of fox news. a fox urgent terror threat against the upcoming winter olympics in sochi, russia. an event that you know is less than a month away that is going to draw thousands of athletes, visitors, as well as countless other people from around the globe. here's what we're watching. men claiming to be islamist militants posted a video to a chechen extremist website promising, quote, a new surprise package for olympic spectators. they vow tourists and locals in sochi will not be safe. fox news is confirming the intelligence community is working to assess whether this threat is credible. russian president vladimir putin's promises to do whatever it takes to keep the olympics

secure, fox news intelligence correspondent catherine herridge is standing by, working the story as we speak. she'll join us for the latest moments from now. also tonight on the fox report -- the white house, putting the brakes on yet another key obamacare provision. and it has to do with people who get their health insurance at work. tonight, see who stepped up to delay the affordable care act again. also, the fbi joining the search for a missing wall street journal reporter. they're looking at activity he had on his computer, on his phone, and at work. his family holding out hope. days ago, he went for a walk near his new jersey home. fox reports on the latest on the efforts to find the journalist who has not been seen since. and a very crowded church.

as clergy deal with long lines of parents and their newborns for a mass blessing. so we begin with a new good lay in the rollout of the affordable care act/obamacare. the president's signature law. this time, the snafu deals with a mandate which requires companies treat all employees equally. no special packages offered for different levels within a company. this is just the latest in what has been a series of temporary suspensions coming from the obama administration when it comes to the law's implementation. as you probably already know, the white house has suspended the employer mandate until next year, and enrollment deadlines have already been pushed back, thanks all of the glitches which virtually crippled the federal exchange website following its launch the first time in october. peter deucy has the latest from washington. peter? >> the latest delay associated with the affordable care act is to a provision that levels the

playing field and requires business owns to offer the same benefits to people who push a broom they offer to employees with a seat in the board room. it was a provision that was shortly to kick in shortly after the aca was signed into law, but it's been delayed add least until next year because the irs still hasn't figured out who is considered highly compensated, and they can't figure out why the white house keeps changing the law on its own. >> here once again, we have a administration one more time without consulting congress, without changes, is altering obamacare, the affordable care act. >> here's how the treasury department explains the latest delay. >> thd the affordable care act, for the first time, all group health plans will be prohibited from offering coverage only to their highest paid employee. they're working on rules that will implement this rule of the aca, taking into account public

comments that were previously requested. just 71 days from now, open enrollment ends, but the wall street journal is reporting most of the 2.2 million sign-up so far are enrolling because their other plans were canceled and only 11% were uninsured before the aca kicks in. >> new reaction coming in to a another controversy putting pressure on the obama administration. today, lawmakers on both sides of the political aisle were on the sunday talk shows sounding off on president obama's plan to reform the nsa spying program. the proposed changes include additional court approval, a nongovernment agency holding metadata and limiting the extension of data collection. today, michigan republican congressman mike rogers who heads the house intelligence committee said he does like the fact the president defended the nsa's actions as legal. >> first, the speech was good in the sense that it said, listen, no abuses. legal program. not a domestic spying operation

that you have seen and that rhetoric has occurred over the last year. i think he put that to bed. that's important. >> but, congress is far from sold on the president's changes. democrat senator patrick leahy of vermont, who heads up the senate judiciary committee said work would continue in the senate on bills to collect and store data on americans. and coming up inside the fox report, we'll take a closer look at the political fallout from the national security and personal privacy decisions which virtually affect every single american. the fox news inside report. >> a fox news weather alert on a new round of arctic air sweeping into the thagz. millions of people again will experience dangerous windchills and single-digit temperatures over the next few days. we have more on the extreme conditions. janice. >> the continuous winter, harris, yes, across the great lakes, the midwest, ohio valley, and northeast, these are your day time highs on monday as the

cold arctic air continues to sink southward, single digits for a lot of cities with windchills below zero, and that's going to continue to push southward and eastward wednesday and thursday. friday, things will start to moderate a little bit, but a lot of folks are going, when is this going to end? will it be as cold as it was in early january? almost, but not quite. look at the temperature on january 9th for international falls, minus 31. minus 26 for tuesday, and again, these are air temperatures. not windchill, so dangerously cold. minneapolis, minus 14 on tuesday. green bay, minus 8. zero in chicago. and again, that's just the air temperature. minneapolis, oh, my goodness. look at you, still winter time. wednesday, thursday, single digits. minus 11 overnight on thursday. so again, people are going to be urged to take precautions and stay inside as much as possible. across the west, we still have that ridge in place. very dry conditions across southern california. warm and breezy.

those santa ana winds are going to kick up early this week, and we remain in this trough over the great lakes and middle east with these clipper systems that could dump a couple inches of snow, gusty winds, and the big story across the west is the extreme drought for california. we'll continue to monitor it. back to you. >> thank you. some tenls moments in one wisconsin town following a massive train derailment. take a look alt these pictures. union pacific locomotives hauled 135 cars loaded with coal. it was doing so when 19 cars jumped the tracks. emergency responders said nobody was hurt and there was no release of any hazardous material. we're told the tracks, though, will likely remain closed until at least tomorrow morning while the wreckage is cleared. the train was heading from wyoming to chicago, and they're now investigating why this happened. so right now, we're continuing to work the breaking news this hour. terrorists vowing to, quote, a

fox urgent. on the latest details on the terrorist threat against the upcoming sochi olympics. men claiming to be jihadists have posted this video. we have still pictures tromit. they put it up on a chechen website. they say no one attending the olympic games will be safe until

russian troops leave the nearby clo caucus region. the guys who claimed the responsibility for a recent attack on a train station. the u.s. state department had issued a travel warning for americans heading to the games. kathericatherine herridge has b working the story. she joins us now by phone. is this threat real? >> harris, thank you, the u.s. intelligence community is aware of the video posted to a well known and considered credible islamist website, and we were told they are assessing the credibility of that threat. the two young men are alleged to be the suicide bombers who attacked the train and trolley station last month in volgograd. that's 400 miles southeast of socha. what the young men promise in the video is more of the same as the olympic games. earlier today, on the talk shows, lawmakers said there thd

could be real jeopardy in sochi. >> i would not go and i don't think i would send my family. i don't know how you put a percentage on t but it's such a rich target in an area of the world that has, you know, they have almost broadcast that they're going to try to do something there. >> there is information that we think is valuable about organizational activities that we fairly confident that the russians track, that they're just not sharing with our security forces. this has been a tug of war. this shouldn't be as difficult. >> what the congress says has real weight because there was a communications breakdown between the russian intelligence services and the fbi over the tsarnaev brothers, specifically the travel of the elder brother, tamerlan, to the same region where you find sochi prior to the boston bombing and whether it because in the region that he got the training that allowed him to build the pressure cooker

bombs because the detonators in the devices are inconsistent with the bomb making manuals you find on the internet. >> you have been able to gather such detail to drill it down for us. if people are getting ready to travel, what do they need to know? >> what they need to know is that the u.s. intelligence community is very involved and very invested in preventing any kind of security incident in the region. we also know that they are drilling down on whether the leader of one of these chechen islamist groups is in fact dead. there have been multiple reports in the last few days that he has been killed. likely by the russian security services, but we have been down this road before, and he has remained alive. it's also clear that the russians are engaging in what i could waould call a cleaning of the house, taking out any threats they perceive as credible leading up to the games, and earlier, the russian

president spoke about this to abc news. >> translator: the job of the olympic host is to insure security of the visitors to the olympics. we will do whatever it takes. >> a final note is that the fbi is sending dozens of agents to sochi to help with the security arrangements there. this is confirmed by the new fbi director, james thome, in a briefing for reporters about a week ago. what he emphasized at the briefing is ultimately, it is the responsibility of the russian government, not the u.s. >> you know, it's so interesting about what you say, that they're kind of cleaning house, if you will, the russian government over there, in terms of pushing out threats that they already knew they had on the landscape. this just gives them more, inyou will, intel and ammo to do that. many americans since the bombing in boston, for the first time, hearing of some of these groups, and may not be aware of how dangerous it is over there. dagestan, which is nearby, was hit by terrorists just what, 48,

72 hours ago? >> tourism is very real in that part of russia, and this group was fingered in this connection to tamerlan tsarnaev, and it's not publicly known whether this was where he got the training to put together those two very viable pressure cooker bombs in boston. this is a very active region, but the russians, if you will, based on my experience, have a take no prisoners approach, and this is what we have seen in the weeks leading up to the olympics. but the caveat, if you will, is what we heard from congressman rogers, which is that the russians in his opinion are not fully sharing the information that they have, and this, unfortunately, seems very reminiscent of the situation we had over the boston bombers, where many people faulted the fbi for not taking the russians' claims that he was a follower of radical islam seriousliness. >> that they might not share

after that, very frightening. thank you very much. the fbi has now joined the search for the wall street reporter who is missing, david bird. he vanished january 11th while taking a walk near his home in new jersey. his family says time is a huge factor in this. he is a liver transplant recipient and he needs medication. so far, no signs of foul play in his disappearance, but investigators are beginning to look at the technology he used every day in their search for answers. brian picks up the story from our new york newsroom. >> well, since david bird went missing eight days ago, investigators have searched through every piece of paper, cell phone, laptop, desktop at his home andophorous, and so far, they have found now klee clues to lead them to where he is. the 55-year-old is described by husband family as witty, athletic, funny. a boy scout leader, and an avid

hiker, which is why his disappearance in new jersey is such a mystery. david and his wife were putting away christmas decorations where at about 4:30 p.m., he put on his red jacket and told his wife he wanted to take a quick walk before it rained. two hours later, no sign of david. he has been missing ever since. hundreds of volunteers have been taking part in a round the clock search for david. police using helicopters, horses, atvs and divers in the passaic river. the search is concentrated on a wooded area and other nearby routes he was known to walk or hike. people have been known to get lost in the area. >> we suspect that the individual may have went out on the ice at some point at night and may have fell through. so using the camera, we probed through to see if he's lodged underneath it. >> david, a father of two children, ages 12 and 15, did not take his cell phone or his medications with him when he left. >> we're devastated.

they say they could smell rubber burning for miles. hundreds and hundreds of tires stacked on fire. it's our top story as we go across america. missouri, flames tore through a tire depot near the city of malden, not far from the arkansas line. thick black smoke you're seeing visible from miles away. firefighters at the scene for hours. the cause under investigation.

indiana, a highway now reopened after a crash and heavy snow snarled traffic for the better part of a day. police say at least 13 vehicles including nine tractor trailers were involved in this fiery wreck on i-65 near lafayette, we're told several smaller accidents followed. no injuries reported. tennessee, robbers used sledge hammers to rip off a jewelry store inside a shopping mall. police say they also used heavy equipment to break through display cases. grabbing 65 rolex watches. stuffing the items into pillowcases and running out the doors. now the hunt to find them. south carolina. 400 pounds of dynamite, just enough to take down this 14-story public housing complex in downtown greenville. the tower stood for decades, but had structural problems. they'll now be replaced with an apartment complex. that's the fox watches across america. after serving our nation,

this is the fox report. it's the bottom of the hour. if you're just joining us, here's what's happening. an islamic group in russia threatening to strike the 2014 olympics in sochi in a brand new terror video they put up on a chechen website. u.s. officials are now working to assess whether the threats are credible. our national correspondent on this, catherine herridge, joined us a while ago to tell you all the details utthat. here are some. they are claiming responsibility for a pair of recent deadly bombings in one russian city which killed more than 30 people. >> the last of people threatened to get out because of a fire pi burning in los angeles are now able to go home.

firefighters making progress in the colby fire. reporting it is now 78% contained and they're still two weeks away in the forecast from getting any rain. lawmakers sounding off on the president's plan to reform the nsa and how it collects and stores data on americans. steve is live in washington with the news. >> yeah, mixed reaction after the president's speech. some say he did the right thing. others say he didn't go far enough. the president said friday the gathering of phone records would continue, but would undergo more judicial review, and the collected data might be stored by a third party, not the federal government. the opinion is divided on the need for the surveillance program, even among democrats. >> new terrorists are emerging, new groups, actually, a new level of viciousness. and i think we need to be prepared. >> we can be effective in protecting our country, but we don't need to collect every single phone record of every

single american on every single date. >> the president wants input from the attorney general and intelligence officials on the best way to store the phone data. meantime, there are continued allegations edward snowden had help from russia in scooping up the secret documents from the nsa. the chairman of the house intelligence committee says some of the things snowden did were beyond his technical capabilities and he suggested the russian security service could have played a role. >> i believe there's questions to be answered there. i don't think it was a gee wiz luck that he ended up in moscow under the handling of the fsb. >> of course, it was snowden's disclosure of the secret nsa documents that prompted the current debate and the president's comments friday. >> steve, thank you. critics, some sitting right across from me, say president obama just punted his job of making changes to the nsa to

give up power? never does, and the nsa is not giving up this power. i don't think our elected representatives, president, senate, house, i don't think they even know what the nsa does. >> now, to you, john, what will republicans do when it gets to congress? you think nothing? >> well, they're split. the traditional establishment republicans like this plan, and the growing, not just tea party, but the sort of isolationist rand paul type people, they don't like it. they're libertarian. they don't like it. the young don't like it. >> who wins the argument in your party? >> the establishment for the time being, because they run the congress, they run the house. >> the president made that speech this week on eform and essentially said what you said, that you know what, we're sorry. we want to fix it, but we're going to keep doing it. pat, what does this say about the american people, that there really hasn't been an outcry about freedoms and privacy.

>> there is an outcry, but we don't hear it because the mainstream media doesn't pay attention to it. in washington, the division john talked about, not only in the republican party, but in the democrat party, remember, there was almost a vote in congress to basically defang the nsa, which failed when many members wouldn't vote for it. the fact is, young people particularly have done great damage. the president suffered greatly and his party has. this is an effort to try to get this off. the real problem is that the political establishment, the political elite likes the power. the american people don't, but the elite and the elite media don't listen to what the american people want. >> specifically those with these reforms, did the president do anything that really changes all that much? is my read on it wrong, that they're just going to continue to do it? >> they're going to continue to do it, and they made some cosmetic things. >> let me talk to you about the idea of privatizing all of the stuff they have from our phone records and everything else.

can i just say a couple things? target niemaeiman marcus. do we necessarily want our personal information privatized by the government? >> no, we don't, and the other thing is companies who would presumably privatize it, don't want to actually do it, because it puts a terrible burden on them. and bottom line, given what's going on and the revelations about snowden being influenced by the fsb in russia, the most recent reporting on neiman marcus in particular, says it was russian organized crime. this is ominous for our country, harris. >> the problem with this is, understand something, big brother and big data together being married or allies, and it's not to the benefit of the american people. this is what bothers people, both of these, they work hand in hand, which they do, to do even more outsourcing of them, i'm not sure what that solves. >> what's interesting, i'm starting to hear echoes of what you brought up, that part of the

republican party, that libertarian arm, even among the democrats, is there room now, real room for a third party? we talk about it sometimes. but where's the reality there? >> there is room, philosophically. we know that last week, we used the number with you, 46% of people say they're independent now, right? 22% are republican, 29% of democrats. so the biggest number ever are in neither party. that's a beginning, and this type of issue is part of the reason. and the irs abuse is another one. >> john, the only thing those two parties agree on is there shouldn't be a third party, and that's the sole reason it hasn't happened. >> that's called self-preservation, i believe. so, senator kay hagan of north carolina skipped the president's speech at north carolina state university. important this week? >> huge. >> why? >> because it shows that democrats running for re-election don't want to be near obama, and specifically obamacare. this thing is dragging them down. we haven't been talking about it

much in the news the last couple weeks because of all the other stories. >> well, we're going to talk about it now. >> but obamacare is ratting out the democrats for novem they're worried about it. >> we just saw another delay, and shock and surprise, who is pishing for it? the irs, they said you didn't give us guidelines on how to put forth some of the things this requires. we have to put a delay on what big employers do and how they hand it out to their employees. >> obamacare is literally an absolute crisis for the democrats. 35% support it. 62% oppose it now. bottom line, the administration is seeing that this could cost them control of the senate. the congress could go republican because of obamacare, as pat was saying compellingly, the american people are angry. they don't want big government. they want the burden off their back. >> look, the thing we saw this week, in gallup, the big government continues to be the

biggest issue. the threat of big government corruption, that's never happened. we had it now -- >> what's driving it? >> what's driving it is scandal, obamacare, the shutdown, all of these things. the threat more people believe that the government is a threat to them than ever. and you know, obamacare has not helped. democrats are only advantaged by republicans' inability to have a narrative. boehner promises there will be a plan, but in the red states where democratic senators are up for re-election, it is now, they are all taking big hits. and it is now becoming problematic. >> all right, you guys, doug and pat, are pollsters. you were congressmen in new york. so no doubt, polls are important, messaging. the white house has to see this, right? they have to see that there's a mood, if you will, in the nation of at least concern. john, i ask you, why does this keep happening? the big matters with this white house don't come with instructions? the irs can't go forth with parts of obamacare because they
