. let's see it one more time. we have not gotten into the worst part of this storm yet. that is to come a little bit later on tonight. so obviously -- >> do not mess with that weather man. have a great night, everybody! i'll see you right back here tomorrow night 9 p.m. and welcome to "hannity," and tonight, we are in our nation's capital, last night i was in the exact same room with president obama when he was delivering his state-of-the-union address. now, for the entire hour we're going to meet with the american people that you have elected to meet with our representatives in washington, d.c. and we'll have questions on facebook and twitter and later on the show i'll take you behind scen and show you my experience here. which includes a post-state dinner. and i'll tell you exactly what we talked about.

but first, last night we heard more of the same from president obama with a twist. our commander-in-chief said he would act with our without congress. and here is a sample of what he said. >> america does not stand still and neither will i. so wherever and whenever i can take steps without legislation to expand opportunity for more american families that is what i am going to do. >> pretty unbelievable, and kicking things off tonight are two of the more conservative senators. senator rand paul, good evening, gentlemen. >> we talked a lot about the president, the use of executive orders, i guess what he can't get done legislatively, he will use legal? not legal? >> absolutely not legal. and really dangerous, it has been the pattern of the obama presidency over and over again to just disregard the congress and law. you know, sean, we've never had a president like this. you take something like

obamacare, he unilaterally granted an exemption for big business. the law doesn't allow that. he unilaterally granted an exemption for congress, the law does allow that. and when nearly 5 million people had their insurance cancelled because of the law, if the law is not working usually the president would go to congress and say we need to change it and fix it. instead, the president just holds a press conference in which he tells insurers, i'm instructing you, private companies, to issue insurance policies that are illegal that obamacare banned. in over 200 years of our history, we never had a president just tell the private citizens just violate the law, i'm the president and i'll give you the get out of jail card. >> that is right, co-equal powers. >> once upon a time. i think the president has changed the constitution. he decides it is optional and he

will obey it when he wants to. really this is not a republican/democrat problem. this is a separation of power, the checks and balances, basically democracy is messy. you have to work with people. it is not conciliatory to say yeah, i'm going to work with congress but if i don't approve, i'm not going to do it. it is either his way or the highway. >> so he is confrontational. >> i sense an arrogance. and it is confrontational. and really, do you think that brings people more likely to talk with him when he says i'm going the do it whether you like it or not? >> let's take a trip down memory lane, we have a montage of candidate obama railing against president bush over the use of executive orders. and will these words come back to haunt him? >> there is a tendency on the part of this administration to try to hide behind executive privilege every time there is

something a little shaky that is taking place. and i think you know, the administration would be best served by coming clean on this. >> it is not actually true that the patriot act was the worst. most of the problems that we have had in civil liberties were not done through the patriot act, they were done through executive order by george w. bush. >> and i think one of the biggest problems of the last eight years has been the degree to which president bush has taken almost the opposite tack, that secrecy and concentrations of power in the oval office. >> i taught the constitution for ten years, i believe in the constitution and will obey the constitution of the united states. we're not using it as a way of doing an end run around congress, all right? >> we're not going to be using signing statements as a way to do the end run around congress. let's go through the list,

obamacare. >> he is right, he doesn't use signing statements. you know how he granted a waiver through business? through a blog post by an assistant secretary. it is just defying the law. the president has the responsibility to take care that the laws are faithfully executed. and you know, sean, it is striking. two people absent from this, two players, number one, congress, congress should defend its constitutional prerogatives. when the president said he will act if congress doesn't act just about every democrat in the chamber jumped to their feet applauding. it is extraordinary to see democrats abdicating their role under the constitution to protect our liberties. but number two, where is the media? if we had anything like an impartial media they should be calling out the administration, if this were a republican they would be lighting their hair on fire. >> let me give you two examples,

immigration law, recess appointments. >> you know, the arguments have been heard at the spring training. but one thing after another, it is legislation on its own, amending legislation on its own, and writing legislation on its own. you know, the separation of powers is where we got some of the ideas for our documents. he said when the executive usurps, when the president attempts to write laws that is a form of tyranny we need to fear. here he was, saying bush is terrible, and he has taken those steps and gone one little extra step and created his own kingdom here. i would be standing up today,

were this a republican president and i think ted would do the same. we would stand because we have beliefs in the separation of powers. i would stand up and challenge the president. where are the democrats that would challenge him on the usurpation. >> i agree with that, but both of you have had struggle with prominent republicans. you invited chris christie to a beer summit. >> oh, no, we're all one big happy family. it is all under the bridge. we have all -- we're all getting together. >> no pun intended. >> we're all getting together now, we'll be a big happy party now. >> senator mccain, i agree with him, the separation of powers, co-authors of government. and senator john mccain has been a vocal critic of you, as well as others. why haven't they lighted on this as a constitution -- >> i think the way we unite, we're standing on principles.

if we're standing to defend the constitution that brings together republicans across every stripe, whether they are conservatives or libertarians or right in the middle, that brings together independents and moderates. get back to the principles this country was founded on. that is how we unite the rarch party. and you know, the more brazen the president is, when he started saying now i have a pen and i have a phone. you know what? if you want to bring back jobs he doesn't need a pen, he needs an eraser. he needs to get in and start to erase the job-killing regulations and erase the incredible damage. he just wants to rule by decree. that threatens everybody. >> and we'll be right back and continue with senator cruz and rand paul. we'll get their reaction, on senator hillary clinton saying that benghazi is her biggest regret. and i'll give you my scoop on

is what happened in benghazi. it was a terrible tragedy losing four americans to diplomats, and now it is public, so i can say two cia operatives. >> that of course was former secretary of state hillary clinton finally admitting her biggest regret. and that being her deadly terror attack in benghazi. so why the shift from her infamous line, what difference does it make? as we continue our conversation,

with senator rand paul and ted cruz, and there was a request for security beforehand that was denied. we were told during the attack nobody helped. and then after the fact we got a big lie. >> i think the thing is, the american people want a commander-in-chief who will send reinforceme reinforcements. we don't want a commander in chief who when asked for help, doesn't send in reinforcements. she should apologize for the debacle, she says i didn't read the cables, why didn't she read the cables? why didn't she send help? >> why didn't they send the security ahead of time? >> it is a very big point. >> talk is cheap, if it is really her biggest regret then she should join in calling for a

joint select committee in congress to investigate what happened in benghazi. we don't know why nothing was done in response to the multiple reports of terrorist activities. we don't know why the state department repeatedly turned down requests for security. we don't know why there were not attempts in place to save the four brave americans and we want to know why nobody has been held accountable. at the state department, and none of the terrorists who carried out this terrorist attack have been brought to justice. so i'm sorry, sean, you have two kids. if your kids are fighting and one says they're sorry, sorry is not just saying it. it is making it right, it is fixing what it is you're doing. if she wants to say she is sorry, it is just like president obama what he said to the 5 million people who lost their health insurance because of obamacare, i'm sorry. if you're really sorry -- that was the most stunning thing last night. that he speaks for over an hour

and says not a word. over 5 million people. >> if you like your plan you can keep your plan senator, and if you like your doctor, you can keep your doctor, i remember those promises. all right, back to hillary, did she say this because she wants to run for president? you think it is a political calculation? >> you know, it seems with the clintons almost everything they do is political. you you knknow, i like to give the benefit of the doubt. she can demonstrate that that apology is sincere, she can say let's get to the bottom of it and find out the answers. it was striking that gregory hicks, the career foreign service officer testified from congress that he got a call from sheryl mills, hillary clinton's top political aide telling him don't speak to the congress. don't speak to the press, don't tell anyone what happened. you know what? you're not sorry if you engage

in a cover-up. she needs to come clean and support getting to the bottom of what happened. >> let me go through the last comment with both of you. you're a conservative, you're a conservative. is there a problem between the establishment in washington where you're working every day, and those that want a more active, pro-conservative agenda, because i think obviously there is. is it time for the conservatives to unite and put forward a plan that they can articulate, run on and be united on? is that possible? >> i would say yes, but i would say it is not new. the struggle in the republican party for what it represents is healthy and has always been there. i went to the 1976 convention when i was 13, reagan was the up-start, the establishment. now, everybody is a reagan republican. and the battles, how we have to decide, the bottom line is we're

not winning o-- >> what should the message be of top five items? because i believe it should be the penny plan, i believe it should be energy, energy, energy, because we have more resources, shell oil, gas, all the resources combined. i think you have to control the borders and offer an alternative to health care, what are yours? i think we have to boldly, passionately defend the bill of rights and liberty, they are grand terms. we have to defend them for everybody, black, white, everybody. >> and you think the president is putting the bill under assault? >> exactly. >> i think rand is right, if you look at 1976, reagan took on a sitting president, gerald ford, and interestingly enough, they all said he is destroying the party, it is terrible. and yet what reagan did to unify republicans in 1980 is he brought us back to core principles. there are two sets of principles, number one, free

market principles. and number two, the constitution, those have been the items that have led to opportunity. >> what do you say to american people if elected will accomplish this, this, and this, what are the top few items? >> we have to rein in spending, deficit s going to $10 trillion under barack obama. you mentioned jobs and energy. we should be having an american energy renaissance, by number one preventing all the job-killing elements. even more so opening up federal lands, can you imagine if the federal government was not just stopping what was going on but was actively -- >> the president bragged about it last night. >> and think about the one thing in our economy that is thriving? oil and gas, his proposal? to raise taxes on oil and gas,

t that do. we are becoming more energy-independent because of that. what does he want to do? he wants to punish them and tax them. >> isn't it all on private land? isn't north dakota private land. >> he is responsible for his hero, he has done nothing to help it. >> in fact, he wants to punish oil and gas by raising the taxes. >> you and i talked about last night how in north dakota a kid flipping burgers at mcdonald's, making 17 bucks an hour. unemployment is booming. it is booming and the great thing also about energy, if we keep developing our natural resources we have the capacity to be energy-independent. it makes the world a safer place because we're not depending on countries in the middle east whose values are very different from our own. but it also has the potential to bring back manufacturing jobs, bring back steel. bring back the sort of jobs where people could go and work an honest's day's work and compete with china. not based on low-cost energy.

lord knows we don't -- >> here is -- >> last word. >> here is what obama doesn't understand, money goes where it is welcome. where are jobs and money going overseas? our taxes are too high. our corporate rate is twice as high as others, he wants revenue tax reform. at the best that is not going to help anybody. we have to lower taxes and bring money home. >> last question, will both of you campaign even against sitting senators if you think a better candidate is running? real quick. >> i'm going to stay out of race s with incumbents. >> and i'm likely going to do the same. >> all right, thank you both. yeah, i was in attendance at the state of the union last night. and so were all of my next guests. we'll turn it over for focus from our members, for their reaction to the speech, the gop speech. plus, it is not too late. send us your questions for the

>> it is going to be stopped when the american people rise up. but also as democrats understand they can't get reelected if they're going to continue to defend obamacare, that will be the signal that we can undo obamacare. >> and it will be the money, as people understand how much it is costing we're losing. and it really does go back to the pocketbook. and you're actually getting less people insured than before. the whole premise falls apart and then you start paying for it. the american people are not stupid. >> we were made specific promises, if you like your plan, if you like your doctor, keep your doctors. you're going to save $2500 per year, none of which was happening but yet it is still the law of the land. and the president mocked a lot of you in this room tonight, saying oh, we can't be voting 40-some odd times to repeal. what is the problem with this repeal? >> the problem with this president, i sat through six

state of the unions through this president. best news is, there are only two more left. but look, we have got to hold the line. we have got to keep reminding people time after time after time what the president said, what he is doing. it is a lie, not true, the president is not going to fix this. >> if we're going to take the pain of higher premiums, losing your doctor and health care. congresswoman, i know early on you were part of the repeal effort. has not happened. one, you guys are in charge of the house, not the senate. you don't have the executive branch, so how do you do it? >> well, i just want to give the american people hope that there are members of congress that are not giving up. we're going to stay on the repeal train because that is hurting americans. we want people's lives to be better. my guess last night was a young female physician who wrote me last month and said let me tell you how patient care has changed under obamacare. i used to spend 90% of my time in patient care, today it is 50% of my time. and 50% of my time i'm filling

out paperwork, so it is hurting jobs and patients in america. that is why she came. because this is so bad it is not reflective of what health care is like. >> there seems to be a divide among republicans. the words we use are "establishment" and "tea party" seems there is a push on this side and the tea party wants to push hard and fight on this issue. there seems to be an evolving strategy that maybe we just ought to coast to the election and obamacare will help us keep the house and maybe get the senate. is there a divide? >> well, look what we're after is to win back the house and the senate. the reason we made the progress we have is exactly the men and women in this room today, we hold the majority. the divide comes when people are not exactly sure what the truth is. and the truth is we've held

president obama accountable over 40 votes, we have repealed over $80 billion worth of obamacare up until now. but it takes us to have the senate to where then we can sustain a filibuster. then we can sustain the things that our agenda -- >> let's say we get the senate. all right, so then we're told if the republicans get the senate then we'll really be able to make change. barack obama is still president for two years. then is the argument going to be well, just give us until january 2017. because i don't know with $17 trillion in debt, $90 trillion in unfunded liabilities, and 50 million on food stamps that we can wait that long. >> well, the bottom is, we're at 2008, and next year we'll be in 2015 and we'll be back to 2007. >> still a trillion in debt? >> but you have got to reduce government spending. to be in 2016 and have 2006 discretionary spending levels is a victory. and that is what we told the american people we do. now give us a senate, we can

make more progress. >> congressman burgess, from the great state of texas, i talked to your governor. you're going to have a $13 billion surplus when you guys get back in session. in i guess, 2015. but you don't even have a state income tax. how are you able to accomplish that in texas? >> well, it just never happened. and the people will not allow it. they wouldn't elect anybody that would be for it. >> that is why it is at the top of my list, i'm not loved in new york anymore. >> i'm telling you, the gates are open wide for you to move the north texas. we would love to have you. you know when the president talked about his job creation and energy plan, i thought the whole time, why don't you say god bless texas, because without texas your job creation is zip. >> you're from the great state of wisconsin, your republican governor put in conservative principles, faced a recall. he had a huge massive deficit. he has a surplus, he is giving it back to the people of your

state. >> a billion dollars, tax breaks now going to wisconsin families. if you don't want to go to texas you can come to wisconsin. >> any other bidding going on here? >> but on obamacare, i think it is important they're honest with the american people. if we're going to repeal it we have to win elections. we wouldn't be able to repeal it without the senate. >> even if you have the senate you think you can repeal it? >> we can put pressure on the president. listen, harry reid is putting pressure -- we have to be realistic. the president shut down the government in october. >> that is not what speaker boehner said on jay leno. >> funding stopped, right, but obamacare continued to roll out because they set it up to put the funding mechanism in. one more point on the speech, sean, the president is trying to be compassionate and reach out the middle class americans, he

and letting individuals earn as much as they can possibly earn. >> you just care about the rich, you know what they're going to say. >> we want individuals to have opportunity and children to dream big dreams and see those dreams come true. >> could part of that argument be it is immoral to rob from our children, with $17 trillion in debt. and congressman, they said it is irresponsible, now it is $17 trillion. is there an argument to be made we have to balance our budget? how many of you would support the penny plan cutting one cent out of every dollar that the president spends? you got in trouble last night, i'll get to you. congressman paul. >> i wouldn't comment on that. but certainly, the president is not living in america. he says one thing and that is not the america he is talking about. the reason the economy is bad is because of his unilateral decision-making of issue and

edicts from the white house, ignoring congress, going his own way, becoming like burger king, trying to have it his way without following the constitution, which to him is just a mere suggestion. he is not living in america. he is saying things that are absurd. and of course, the debt, he has helped to create the debt and now he wants to blame other people for it. >> there are two great movements in the conservative movement. ronald reagan. is there time for a new five-item contract? the penny plan, energy, we'll be drilling health care savings accounts. run down -- secure the border? >> well, i think there is, in fact i think the reason we took controlled congress in the '90s was in the fog of government, republicans set up a beacon of light, where if you believe in these principles. look, spending cuts will get us half way back to a balanced budget. you need a strong economy.

the starkest difference is when the president talked about tax reforms. he wants to close tax loopholes to spend more, republicans want to close the tax loop holes to help -- >> two things come to my mind, one is you have to spend less. the second thing is i see the success we talk about in middle texas, 3%, middle dakota, 2.6%, people are getting $100,000 a year jobs. the growth is amazing. >> last night the president was taking credit for the fact we have so much wealth and natural gas, i have a news flash. it happened in spite of him. not because of him. that drilling is all happening on private lands. it is not happening because he is letting it happen. it is happening because we have entrepreneurs who are letting it happen. and they're paying on $5,000 signing bonuses to mcdonald's.

the offshore drilling has all but gone away. if we want to jump start the economy, let's unleash this engine. >> how is the party -- can you all unite and maybe get behind five items? is that a good idea? maybe, two, three, show of hands, but i don't see it. congressman grimm, why are we not seeing united party saying elect us, we're going to do a, b, c, d, e, f. >> let's be honest, if you're not on fox news you don't even hear what republicans saying. you're up against santa claus, what did the president say last night? he told everybody what they wanted to hear. is it based in reality? not even close, but that is what we're up against, we're up against reality -- >> and you're not going to throw

responses we have gotten the top five are these you want the lawmakers to address. number one, when will you do your job? they will answer that, number two, keep focusing on benghazi, number four, why is the government such a less? and term limits and how will we end the lying in washington. as we bring back our studio, i guess congressman kelly is next, first of all who would support term limits? >> about everybody. >> all right, a lot of people you look at the dissatisfaction rate with congress, people say they blame everybody, obviously the lies from obamacare. >> they can follow the same example as the president and say i have a phone and a pen. people need to get on their phone and write letters. i want the president to use the phone to call harry reid and say harry, we have 40 job bills on your desk, debate them and amend them. i guarantee you he would get
