christie. we'll break the story of a woman and three children possibly possessed by demons. and wait until you hear what happened with one of them. >> i noticed that the light was flickering them, from the moment i walked in there, it stopped doing it. >> first breaking tonight in the kelly file exclusive, the senate, the most powerful republican with news on what conservatives are saying is a new irs effort to silence them. welcome to the kelly file, everyone, i'm megyn kelly. and tonight with the democratic party facing trouble in the mid-term elections and with the president down in the polls there are new reports that the administration is doubling down on the effort that silenced the groups in the run-up to president obama's re-election. we have been tracking these stories starting with the irs scandal in the summer to the

news that the doj is prosecuting a filmmaker for allegedly making illegal campaign donations. and now reports of an effort to push back. joining me now, republican senate minority leader mitch mcconnell. sir, you are getting ready to announce a major pushback on the irs which has been doing what, while we've not exactly been paying attention to it in recent weeks. >> well, while they're not seriously investigating the irs scandal that i first spoke about back in the 2012 campaign, megyn, they're now initiating a new rule through the treasury department in the irs to quiet the voices of outside groups. it is called a c-4, and what they will do is redefine what outside groups can do in a way to silence the voices of conservative critics. a new regulation by the administration. you know how the president has been using regulations to get

around congress. they tried to do this through legislation back when they controlled both the house and senate and it did not pass. so now you're looking at an administration trying to silence the voices of their critics going into this important fall election by using the treasury department regulations. >> so they're basically going to try to change the regulations about what these groups can do and how they qualify for this saturday of tax-exempt status in the first place. but they say it is not just conservatives who will be punished, affected, whatever your word is. liberal groups will also be affected. so why do you think it is about silencing conservatives? >> well, i don't think the voices of either the liberals or the conservatives ought to be silenced by the government. i don't think it is the government's business to tell these groups they can't speak. so it is not convincing to me that it would fall on both sides. we do know, however, that this particular tax exempt category is the same category that they

were targeting conservative groups back during the 2012 campaign. so now i think what they have decided to do is to take these people off the playing field, and if it hits a few liberals, fine, but i think what they're really worded about are their conservative critics. >> let me just set the stage for the viewers. it came out that the irs was targeting conservatives, and both parties said that is awful, terrible, we need to investigate, and shortly there after, the focusing turning, they said they should not even be applying for tax-exempt status because they're too political. that is what the democrats basically said. what they're basically telling me is now the irs, all of these months later said you're right, let's change the rules. we wouldn't have to deal with it at all. >> let me tell you the key to it. nixon tried to use the irs to go after his enemies back during watergate.

and the commissioner of irs said no. so we have a new commissioner over at the irs, i think we want to see if he has the integrity to stand up to this white house like the irs commissioner did when richard nixon was trying to use the irs to achieve a political objective. well, this new fresh, irs commissioner coming in to clean up this troubled agency, be used by this administration to silence the critics? will he throw the irs right in the middle of this big political debate? i want to see a statesman over there at the irs. he got recently confirmed by the senate. we're counting on him not to be used by this white house to carry out their political agenda of quieting their critics. >> senate minority leader, mitch mcconnell, great to see you. thank you. and as the senator just mentioned it has been eight months since the doj launched an investigation into the targeting of irs groups, and just a couple

of weeks since the fbi said well, don't expect criminal charges, there wouldn't be any. this morning, some republican senators challenged the attorney general, that is who the fbi reports to, eric holder, about what is really going on. >> 280 days have passed, no one has been indictment ed. >> i don't know if you have ever conducted an investigation, senator. >> how many people have been talked to? >> i want to get into the specifics -- >> well, if the answer were none, that would be stunning, wouldn't it? >> i find it astonishing that the administration -- >> i don't know anything about the political activities of any people who are involved in this investigation. >> the integrity of the department of justice has been severely compromised. >> the chief legal counsel for the department of justice and represents a number of groups

targeted by the irs. so what we have here, it appears jay, is an effort to eliminate the groups from ever applying for tax-exempt status, or at least eliminate what they can do once they get the status. and the other question is what about the victims targeted all the months and years? and it seems like what we've seen from today, really no progress to report and if you're waiting for criminal charges against anybody, don't hold your breath? >> well, you're right. we did not get contacted. our clients were not contacted at all until the very end of december when we received a call from the department of justice and the fbi saying they wanted to talk to three of our 41 clients and get back with us. >> that is progress from not having spoken to anybody, which is how it was for all of these months. >> but let me tell you what happened, though, so as we discussed who came forward and participated in the discussions with the irs it is leaked to the wall street journal that the criminal case had in fact been

closed. when we confronted the fbi with why are you speaking now or desiring to speak with our clients, when in fact the criminal case has been closed. no response, they wouldn't confirm or deny anything. they still say they wanted to speak to our clients. and megyn, there is another issue that was significant, you mentioned it was senator mcconnell. now through the irs they're the rules that govern 501(c)(3), the groups that target any political speech. last fall they said if you had 40% political activity we automatically grant you status. now they're changing that and doing a post-talk about the change. it is very questionable whether we let our clients go forward. >> they found a very interesting solution to the problem, which is that is right, this whole thing is such a hassle, that will make it nice and easy, we just rubber sunday stamp it at

the beginning and no therefore there won't be a lengthy investigation in it. >> the problem with that, the constitution protects speech, including political speech. that is number one, number two, they have offered compromises back in the fall which would allow for political speech up to 40%. so this changing the rules, now trying as you say denying the groups the right to participate in the political process at any level we think is wrong. we'll challenge it in court, if necessary. the idea that the irs is doing this through the regulatory process and not legislation, brings up a whole other topic, and that is the president using the stroke of a pen. >> and that is what senator mcconnell suggested, they may want to go after the doj. they are considering whether they are a major donor in the obama administration, eric holder mains their person has their objectiveity, even though

they claim they did not know she was a major obama donor. and new fallout from an incredible story on the army ranger who stole the show. corey rensburg nearly died on his tenth deployment. a roadside bomb in afghanistan, leaving him in a coma for three months, partially paralyzed and brain damaged. but he has never given up. and during six hours of therapy, and the story leading to this incredible support, on capitol hill. [ applause ] president obama even saying that sergeant rensburg working toward the day when he can serve his country again. earlier today, however, nbc news's political editor started a debate when he sent a twitter message saying that obama's ending on rensburg was not just a story about america, it was also a story about obama.

nothing has ever come easy. war veteran and ceo of concerned veterans for america, and twitter went nuts, pete, with this saying you got to be kidding me. he is making a comparison between president obama's struggles and this hero's struggles? your thoughts on this. >> talk about a bubble he lives in, this is a political editor, the guy who runs the show. talk about a lack of understanding about the civil military divide. we have talked about that before. the civilian, think about the military divide here, this is somebody who covers the conflicts, likely came into contact with those. look at what sergeant remsberg gave, the combat, every single deployment, to compare that to a president who has seen political difficulty, that is fine, a whole other level from what remsburg brought, why people rose to their feet to applaud him. to draw that comparison,

shortsighted is what that is. >> you are not comparing the prep school guy, my son was getting shot out, and then somebody on the president's side, or i should say on nbc's side said, yeah, you know, barack obama, like that soldier never gives up and the country benefits. the nbc guy is saying murray, look, we're not trying to compare his story directly to the president. we were just talking about this story of stumbling, making mistakes and getting up could also apply to the president. >> you know, jake tapper had a similar interview last week where i think the intentions were good. the intentions of let's draw the comparison, but they forget what the comparison means to those who served. what did those ten deployments mean? what did that sacrifice actually

mean? let's honor it and let it be what it is. a great pampered ivy league kid who succeeded as the commander-in-chief compares in no way. the frustrating thing, did he ever really believe in it in the way that corey remsburg invested and fought and sacrificed for. that is an open question and very much a problem. >> one last question, woody allen and mia farrow's son sent out a tweet. corey struggles on the left side. quoting the president. congress relates. basically trying to crack a joke about congress and using this man's disability to set it up. your thoughts on that. >> i mean, ronan struggles, i don't need to know him. to make a statement -- it just indicates how little he truly understands. it is why marcus luttrell stated

if you haven't been there, and don't understand, you will make a flipping comment. it is not that we're outraged over every incident, it is that we understand that. ronan doesn't, let him make the statement on his behalf. and we also heard state of the union reaction from democrats today coming a day after harry reid illustrated even the most zealous democrats will campaign. >> i don't need him campaigning for me, i need him to change some of the policies. >> does that mean you will have him campaign with you side by side? >> we'll run a strong campaign based on colorado's interests. >> that was not a yes or no, yes or no. >> we'll see what the president's schedule is. >> wow, one more chance, you're not going to answer yes or no? >> we'll see what the schedule

allows. >> matt bender is co-founder of third way and a former white house deputy in the clinton administration. matt, it seems to me that the senators did not get the memo from harry reed that we were supposed to welcome him on the campaign trail and tout it. >> i think they realized it wouldn't happen in places like alaska, colorado, perhaps, as well. this is not new. this happens every cycle, every mid-term election, there are members of the president's own party that don't want him near that. >> why doesn't he sit down with dana bash as he did yesterday and say you know, that will be up to each senator. in certain years they're going to try to beat up on the president, he may not be as popular in certain districts. >> say what you will, i think he didn't want to give any ground. >> he decided to opt for dishonesty? >> well, i think the honest truth is a lot of the senators

are not going to get money raised by president clinton when he goes out on the road for the dnc, so there will be some campaigning on, i don't know that they will be in the state with him. probably some of the states, they won't. >> if they can coordinate the schedules it is hard to make time for the president of the united states for a lot of the democratic senators in competitive states. >> i want to shift gears, speaking of democrats, you work for the clinton administration, claire mccaskill has reportedly appeared on president clinton's so-called enemy list, the reason that she doesn't like claire mccaskill, because way back in 1976 she had appeared on "meet the press." the clintons had been good to her before, she was asked if bill clinton was a great president and she said this. >> do you think bill clinton was a great president? >> i do, i had a lot of problems with his personal issues, i said

at the time i think he has been a great leader, but i don't want my daughter anywhere near him. >> so she was asked yesterday about rand paul's comments that if hillary run, bill's prior indiscretions may become fodder for the election in one way or another. and here is her reaction. >> do you think bill clinton's behavior as bad as it was and the impeachment process should be an impediment to hillary clinton running for office? >> i think i can speak for most women that the conduct was infuriating. >> she doesn't want her daughter in the same room as bill clinton, but she thinks it is outrageous that rand paul would suggest that bill clinton's behavior may become an issue if hillary clinton chooses to run. do you see the contradiction there?

>> well, look, to be fair to her, they were different questions, the questions that senator paul was addressing were if bill clinton's behavior would impact hillary clinton's run -- >> well, he would be the first man, the assumption is he can't be left alone in the room with young women. and then she turns around and suggests it would be horrible if this were a campaign issue. >> she said that in 2006, she reportedly was very sorry she said that. but look, politicians make mistakes, i think this was probably one of them. >> don't tick off the clintons, especially if they have been fundraising for you, it is a little hypocritical. and extreme weather alert in the south tonight where a few inches of snow has paralyzed one of the nation's largest cities, affecting much of the population. the eerie scene here as drivers are stranded in their cars, on

the side of the road. hundreds of students forced to spend the night on cold school floors and all of this happening after getting two to three inches of snow, a snowstorm that the city new was coming. tom haynes live in atlanta with the very latest. hey, tom. >> reporter: boy, megyn, this was a complete disaster. two inches of snow has our city completely shut down to this very minute. and a lot of people are very, very upset tonight. they're pointing the finger at state and local officials for not preparing enough. you know, this happened to us back in 2011, and it has happened yet again, originally this storm system was supposed to hit mostly south of us. but at 2:00 a.m. yesterday, it moved back up north. apparently that was not enough time for state and local officials to making the call to get out in advance of this storm and salt and sand some of the roads in advance of the commuters going out to work.

it was not enough time for local school systems to making the call to shut down their schools. so here is what you had. you had this cascade affect. you had the schools closing early and then you had a mass exodus of students trying to get home. students could not get out of their schools, school buses were stuck on the busy interstates. people were stuck in their cars, and mind you, megyn, it was like 27 degrees yesterday. people slept in their cars all night long, many didn't know the fate of their children in the schools. now the school system said they took very good care of the students, the children thought of it as a night out. but still, the parents were very concerned. the fact it happened this time had others saying why didn't they learn from last time and prepare the city? >> unbelievable, also tonight.

peace in this house. get out! oh, man, remember that. the amityville horror? very creepy. but perhaps even more disturbing tonight. a report on the factor, wait until you hear this story. the report suggests that demons took over a family and their home. and trace gallagher has the details. trace? and megyn, the comparisons to amityville are notable, because just days after the family moved into the house the horrors began, black flies, children being levitated, here is the mother, listen. >> and i saw one -- like coming into a full image. it was coming out -- i never seen it like that before.

i would see the shapes, but i have never seen it like how i'm looking at you and you're looking at me. >> the family sought help, but between the horror stories, the kids missing school, and being injured the child services got involved with child services pointing the finger at mom, writing, quote, they believe the mother may have mental health concerns. they believe the children are performing for the mother and that she is encouraging the behavior. then child services witnessed something that changed their view. the 9-year-oldwn against the wall with nothing touching them. then they wrote, he had a weird grin on his face and began to walk backwards while the grandmother held his hand, he walked up the wall back wards, and flipped over in front of the grandmother and sat down in the chair. police also thought the story was a hoax until they went to the house and saw blinds dripping with oil and water where there was no source.

and a mysterious figure in the window when no one was home. 37 year police veteran captain charles austin saying quote, every one of us who was there that day in the basement and who saw what we saw, we all think the same. we call it the same. that bit of dirt is a portal to hell. the family called a local priest, father michael maginot, who was convinced the demons possessed the mother. he tried to contact the demons through three exorcisms. here is the priest. >> it is pretty much without incident until we get to the part of your name. and so far she has always been slept. i said is your name whatever, and all of a sudden she started c convulsing. >> after she convulsed, he believes the exorcism was

successful. >> thank you, and joining me now, the reporter on the story, marissa, let me start with this. after all the interviews you did with third party witnesses, what do you believe? >> it is not my job to believe or disbelieve, i will believe it to others. >> it is not your job, but what do you think? were you persuaded at all? >> it is not my job to be persuaded either way. my job is to report the facts as they were told to me and to let people draw their own conclusions. and i wrote it that way deliberately. >> well, let me ask you this, you have got a police captain saying he believes, did you interview the police who claim to have seen the boy walking backwards up the wall? >> i interviewed the registered nurse who witnessed or said he witnessed the boy walking back up the wall. i did not interview the department of child case worker, however i had the report from that incident.

>> and did she claim to see it, as well? >> she claimed to see it, as well. >> do you have any reason to doubt their accounts? i mean, as a reporter you always go in skeptical. >> i think they believe it, yes. >> is there any reason that you uncovered to doubt them? in other words, any history of their relationship with the truth? any performance complaints, that kind of thing? >> good question, no, there were not any source or situations to gave me pause. people in credible positions doing typical work and you know, nothing to report. >> how many eyewitnesss were there to the you know, so-called possessed behavior other than the mother? because the mother may or may not have had issues? there was a psychologist saying she had issues and the kids were basically performing for her. how many people outside of the family who verified the accounts? >> i mean in the hospital or outside of the hospital? >> anybody outside of the family? >> it would take me a bit of

chris christie. the mayor, we tried to speak with repeatedly. >> i just want to get somebody to back up your claims. is there any reason you wouldn't come on the megyn kelly show? mayor zimmer? >> mayor zimmer is accusing chris christie of administration of threatening her, claiming she would with hold funds on a project. she says she has produced handwritten journal notes. but tonight we learned in a deposition just last year, mayor zimmer under oath stated that she does not keep any such records. an attorney in that case asking her while she was under oath, quote, do you write notes on the calendar or a sort of memo pad, follow up on a text or this was said during this meeting. anything that would help you recall what was said during the course of the meeting, to which she replied no, i don't. lewis sayas is an attorney on

the case, and from the beginning, lewis, let me speak with you, you were in an adversarial situation, you asked her about note keeping, on meetings. and did she later provide any wiggle room on this? >> no, in fact in her deposition i specifically asked her whether or not she had any sort of diary account or some sort of memo pad that she would transcribe any matters that dealt with the hoboken business. and she specifically said she did not. and what is important to note is there was a trial in december where that same question was asked and she again affirmed she did not keep any diaries. so i find it curious that she alleges she has a diary.

>> well, she has given it to them, looks like a handwritten note. >> looks like she could have written it at any point. >> this is an excerpt of it. yeah, there is no date. this is the kind of thing that would not be miadmissible in a court of law. >> if this was a journal -- you would think there were other entries. >> but you did win the case, do you have a group against her? are you a republican? is this a political thing against her? >> i am a republican, but my case has nothing to do with politics, but a discrimination case, that we felt the mayor discriminated against in client, which the jury believed. my political affiliation has nothing to do with the case is

take. guy, strangely this piece of story has gone largely ignored by the media who were very quick to put mayor zimmer on the air. >> so strange, megyn, you remember two weeks ago when the story broke it was a feeding frenzy. this fuelled the narrative that chris christie was a big bully and there were swirling scandals that cast a pall over his second inauguration. and now, this is just the tip of the iceberg of what has emerged. all of this media attention came out, there was no follow-up on whether or not mayor zimmer was selling the truth. >> the thing is, her allegations came at a time that was very inconvenient to put it mildly for governor christie. and she was accused by some of piling on. but she came on tv, and she was like, she is just this mom who got bullied. she didn't want to come forward. and reluctantly did so once she

saw all the hubbub about the governor. many found her believable. >> well, i mean, many people did. the only piece of concrete evidence if you can call it that that she put forward to back up her claims is this diary, which she subsequently said she didn't keep. that is point one. megyn, you're an attorney, follow the old rule, the money, she says her city was starved of sandy relief aid because she couldn't go along with their extortion scheme on the quid pro quo building that christie wanted. but they looked into the money, not only are they downplaying the amount of money the city got, in approved direct aid, $70 million of the type of aid that she is grouping about her, megyn, the associated press went through and said actually hoboken got pretty much the same amount of money all the other cities within this group got. in fact, in another subset of the money got more than most of

the eligible cities. so the horror she alleges is not there. >> love to ask her these questions directly, which is why we asked her in the first question there, is there anyone who can back up your claims? because if the lieutenant governor came and threatened you, normally behaviors will be, oh, my goodness, what happened. no such behaviors yet, we'll wait to see what happened, thank you, gentlemen, both. thank you, megyn. and you would expect some backlash to the state of the union, some will rip that as well on the other side. but did they have to go after this congresswoman's kids? is that necessary, that debate is next, we'll tell you what they said. and a painful lesson of trying to cr

the conduct was most unbecoming of anybody, especially congress, congressmen or women should always act in a manner that reflects credibly. do i think he should be referred for investigation, absolutely not? should he enroll himself in an anger management class? heck, yes. >> everybody knows you have to be careful when you talk to reporters, especially when you threaten to throw them off the rotunda. he is under investigation and has not answered questions from reporters for the last two weeks. if you're a member of congress you have to expect hard-hitting press and have to understand this is not a proper way to deal with legitimate questions. >> speaking of hard-hitting, do you expect this, what jim cantore of the weather channel got? >> that is to come a little bit later on tonight. so obviously here at the college of charleston, they're already having a good time.
