12:03 pm
four years in an italian prison. the first trial court found them guilty of murdering knox's then british roommate, meredith kurcher, after a night of drug-fueled sex games. an appeals court cleared foxy knoxy and her boyfriend but last year italy's highest court in all of its weirdness claimed the verdict was full of inconsistenciesessed and ordered the repeat of the trial. that's where we are now. jonathan, what is it? >> this has been something like 11 hours by my calculation of deliberation by the presiding judge and assistant judge and six jurors, and we do belief that within the next few minutes we'll see the judge and his assistant emerge into that courtroom and deliver the verdict that amanda knox, and the family of murdered marry dearth kurcher have been waiting for -- meredith kurcher.
12:04 pm
this has gone on for six years and three months and might not be the final chapter. if, for instance, amanda knox is found guilty, she is likely -- her lawyer are likely to appeal that to italy's supreme court. that's likely to take one more year. only after that, as we understand it, would the italian authorities, if she was findly found guilty again, then would they seek her extradition from the united states. she has made it very plain she will not go voluntarily, which means she would become a fugitive from italian justice. >> hang tight. we'll bet back to you in florence. with us now is legal analyst athyria dollla. with being gene through this for the better part of our lives. >> she was in jail for four years and now is sitting in seattle, and she is waiting, she said today, with her heart in her throat.
12:05 pm
the million dollar question, let's say she is convicted. goes up on appeal and the appeal says, yep, she's is convicted and needs to go to jail for this now. the italian ministry of justice goes our united states department of justice and asks for them to produce her. what do we do? what do we do? i'll tell you that for me, political economic standpoint italy does not want to make an enemy of america. the phrase goes, when united states sneezes italy catches a cold. i think the italian government, the people who are in charge of the money, they want to see amanda knox be acquitted and put this behind them. but this isn't the end of out and. the biggest difference that people should know between the italian judicial system and the american judicial system is the in the mesh -- american system, when there's an appeal, you just hear from lawyers talking about the law and whether it was applied properly.
12:06 pm
here there's been three separate trials where witnesses testify over and over again. but this time the biggest missing witness was amanda knox. even, my understanding, rafael testified and will be in court for the verdict, and they're whole contention is this other dude, rudy, who is in jail -- >> we haven't mentioned him. his trial was first. he pleaded guilty. >> right. the got a big reduction in sentence because of that. he had 16 years. >> and he turn on them. >> and he turned on them two -- to a degree, but the bottom line is it's that gay. amanda knox says i wasn't there when it took place. she is saying she was outside of the house. that he was burglarizing the house, rudy was, meredith came in and that's when the incident happened. >> the fact this is no evidence of any kind, nothing, that they were there. there's no dna, nothing. >> the new part of this trial supposedly is that there is some dna of amanda knox on the knife.
12:07 pm
she lived there so it's going to be there. the reason why the case was sent back because the judge said the authorities mishandled all of thed and the evidence and the dna was unreliable, and you cannot base evidence on something that is so unreliable. so, yes -- >> she lived in that apartment. that she would have touched things in the apartment is not a weird thing. >> correct. >> there were no marks on her, no statements -- they didn't have much. i don't -- you couldn't have got an conviction in the united states. >> she made a bunch of statements initially, and in fact when she was initially sentenced she was sentenced to an additional four years and that conviction held for -- she slandered someone else, and somebody is no the courtroom today is the bar owner or former bar owner of someone who she accused or complicit in the murder which is an absolute lie. but she is saying the police liebed on her, forced her, interrogated her inappropriately, but that charge
12:08 pm
still sticks but she served her time on that. >> there is more ahead? >> there is more ahead. we'll go to the italian supreme court. most legal experts seem to believe that is likely to take 12 to 15 months. so the nightmare for everybody goes on, and in all of this, as we talked about amanda knox mostly, we shouldn't forget the victim in this, meredith kurcher. her brother and sister, lyle and stephanie, in the front row of the court, they spoke to our corporate cousins about how they would feel been an acquittal. >> if the evidence proves they should be acquitted, yes, if that means the correct people be found guilty, and then we have to accept that ultimately. all we want is justice for meredith because nothing is going to bring her back. >> that's the final word on
12:09 pm
this. howhowever long this goes on, nothing will bring back meredith cutcher, a 21-year-old who was murdered on the night of november 1, 2007, and we just saw again a picture of lyle and stephanie, her brother and sister, sitting in that court awaiting this verdict. >> i want to find out what this is going to look like. we have been studying this italian system now for all these years, and the thing islander is, -- i learned about it, i don't work. i don't -- you practiced law in it tall and speak italian. >> the first trial took 11 months, this one took four months, based on the same set of facts, how does one trial take twice, mean theme -- >> many they have a judge ito.
12:10 pm
>> this is being judged by two two judges and six civilians. >> they're working on italian time. it was supposed to happen apt 9:00 florence time, 3:00 on the east coast, 11 on the west coast, and they have doesn't anything. so my guess is they're out having an espresso or something, and when they do this thing we'll take you there. >> a fox urgent now. federal roads will seek the death penalty against the surviving boston marathon bombing suspect. attorney general eric holder made the announcement an hour ago. prosecutors say jakarr tsarnaev and his brother master minded the bombings at the boston marathon. jakarr has pleaded not guilty again. the attorney general ache holder announcing the federal government will seek the death
