sometimes we get it wrong. thank you for being part of "the real story" today and every day this week. i'm gretchen karlson. have a fantastic super bowl weekend. see you back here on monday. shepard smith is going to report live from the fox news deck. hi, shep. >> thank you. might the american exchange student amanda knox have to return to italy to serve decades in prison? one day after the italian court or whatever it was, upheld her murder conviction. and did her former boyfriend try to make a run for it? it's bad for the biebs when the guy coming to your defense is the crack-smoking mayor rob ford. and the story behind this remarkable photo of north america's mayor. so let's get to it. >> good friday afternoon to you and yoursto shining sea. first, quite a sight this bunch.
12:01 pm
is this miss italy? i don't believe so. amanda knox says there is no way she will good back to italy without putting up a fight. that after an italian court once again found the american former exchange student in italy guilty of murdering her dead roommate. the prosecutor said was part of a drug-fueled sex game. yesterday reside verdict set the stage for a potential legal tug of war. amanda knox served four years behind bars for the killing of this woman, meredith kercher, knocks' then roommate in great britain. the case became a sensation, calling her foxy knocksy, and the prosecutors claim knox and her boyfriend stabbed, slashed the roommate, during a late night of drinking and drugs. an italian appeals court overturned the conviction saying the evidence was bad. the police botched.
12:02 pm
i. so knox came home to seattle so close to being off the hook, but not anymore. amanda knox says she watched on television with us yesterday and as the court reversed themselves again. she flew straight to new york to tell her side of the story. she spoke on "good morning america" about the moment the verdict came down. >> my fiction -- my first reaction was, no, this is wrong, and i'm going to do everything i can to prove it is, and i felt very determined and my family felt very determined. but it was only on my way here i really got my first cry. >> that from gma on abc this morning. now the case raises all sorts of legal questions, like whether italy can force the united states' hand and put foxy knoxy back in prison. we'll get some answers to that from a former judge, kenneth delveccio. first let's get to jonathan hunt with the latest. this an emotional interview.
12:03 pm

delveccio, has been a prosecutor and judge. there's another appeal. doesn't involve a trial but the judges go before an appeal and if she loses that, then there's this matter of whether to extradite here. will italy seek an extra addition? >> first of all it's not definitive that italy will seek an extra addition. it's extremely likely they will. there is precedent in the omar case back in 2003 about 22 united states cia agents kidnapped him, allegedly, from the country, and italy, in absentia, convicted all 22 of them but they didn't seek extradition. that said, here i think they're going to because in the vast majority of the other cases they do. >> you have to have cooperation from the host state if you will, and in the united states, there are those who suggest that under our laws, she faced double jeopardy and you don't have to do that. it's a great area but it's there. >> i'm going to tell you absolutely under no circumstances under united states law and the treaty itself

should she about extradited. why? the treaty, 1983, was agreed upon in a compact with other countries has article 6. and article 6 says specifically where there's double jeopardy there is no extradition. now, some legal analysts like allen -- wrongfully conclude that the italian government deems there has not been a final resolution to this case, it's not double jeopardy. that's wrong, though. the proper scope to view this new under is the united states law and this its double jeopardy. >> when meredith kercher came back here there was wide belief the second trial would find her not guilty. they had dna on a knife but a knife in her apartment. >> look, the evidence in this case is woefully inadequate which is a hole rope why politically the united states will not extradite her. you have a case where there's no
