students near michigan state university. it happened near an apartment complex less than a mile from the msu campus. both victims were found inside the apartment. one is in critical condition. the other was treated and released from the hospital. police do not believe this was a random shooting: overnight scary moments on board a packed airplane it was forced to make an emergency landing at new jersey's newark airport because of fumes inside the cockpit. united flight carrying 220 passengers took off from dulles airport and was headed to germany. ambulances met the plane at the terminal to treat passengers. airline officials say nothing suspicious was found on that flight. is he off the wagon again toronto's crack smoking mayor busted for jaywalking and public intoxication. look at him here posing with random people on the streets of vancouver. he is in town or you are about to see that anyway. he was in town to attend a

issued its long awaited environmental impact study which included that the keystone pipeline would not significantly contribute to greenhouse gases or have any major environmental impacts, republicans immediately began calling for the president to approve the project which has been in limbo for five years. senate leader mitch mcconnell issued the following statement last night, quote: this report from the obama administration once again confirms that there is no reason for the white house to continue stalling construction of the keystone xl pipeline. so, mr. president, no more stalling, no more excuses. five years ago the pipeline's backers asked the obama administration for approval. the pipeline would carry oil from tar sands in western canada carrying more than 800,000 barrels of crude oil a day to refineries. >> allowing the keystone pipeline to be built requires a finding that doing so would in our nation's interest and national interest will be served only if this project

yeah, i think a the lo of people were hoping for a big snow storm, thinking you could have that amazing game, everybody playing in the snow. not going to be the case at all. in fact, models have been trending warmer and warmer. temperatures looking better and better for the day tomorrow. and certainly based off if you compare it to the weather we have been dealing with the last couple weeks that's good news. take a look at the weather map and show you what we are looking at. it is cold this morning, 36 degrees. compared to where we have been not bad. take a look at today's high temperatures, we are going to get to 43 high mark tomorrow closer to 50-degree mark. spectacular day. not quite that warm at kickoff. kickoff it will drop back down in towards the lower 40s. by halftime maybe still above 40. at the end of the game into the upper 30's. winds not that bad. a very slight chance of a shower but if there is a quick shower, it will be quick. it won't be anything big. overall, guys, this is pretty spectacular. a nicer super bowl here than

we have had with some of the super bowls in the south where the weather has been much colder and snowier and icier. so, overall, looking good. >> there was a lot of talk that super bowl tickets were actually a bit cheaper because people were so scared of the cold weather. and now it's not bad at all. >> i got to get rid of this ticket now, now it's going to be freezing. turns out of that wasn't the case. thanks rick. >> there are moments that just crystallize something for you, you know, something is big and complicated as obamacare all of the sudden comes to precise focus when you put a human face on it. the president was confronted with that human face just the other day. a woman asked him why she is not able to navigate what is supposed to be a pretty simple system. watch this. here is what she said. >> the rollout perhaps was premature. probably not the only one who has had really a panicked experience lately trying to figure out if my 10-year-old son can continue with his specialist or not.

and i know that i cannot keep my plan, which i liked, but i'm trying to decide what to do going forward. i have spent weeks on days on the phone getting confidently delivered wrong answers, conflicting information. what are you doing to fix this or simplify what seems to be such a complicated process? >> this is remarkable. you think a the lo of these questions are vetted, right? that was part of a google hangout that the white house set up. you see that is through whitehouse.gov. people well-lit that google and the white house worked out to make sure they are able to get these people on and have these questions. they might not have known the details fully of exactly what she was going to ask. the president then had to think on his feet and here is the president's response and see if you think it's sufficient. >> what i will do first right away is make sure that somebody out of here, this white house, calls you directly and i promise you not only will they be confident but it will be the right answer. >> that's great customer service but it took her having to go on a google

welcome back. the president's state of the union called for higher minimum wage, more o. owe boom that care signups. new trade agreements for asia. can these do more to hurt the economy than good. washington, d.c. economist peter morici. nice to see you this morning. >> nice to be with you. >> start with the minimum wage, peter, he wants congress a prove that minimum wage of 10:10 an hour. will that help or hurt the economy in your estimation? >> that's a 40% increase. since the last time he raised the minimum wage we have had 9% inflation. we are talking about a 30% increase in labor costs

mcdonald's. will have to, long with other restaurants, essentially shut restaurants, do things to save labor, they have fewer customers and there will be fewer jobs. it's a jobs killer. >> what about obamacare on young people, asking congress to spend the mandate that all americans obtain excessive and expensive healthcare basically but pushing this on young people. we know that the signups have been less than even lackluster being nice. >> well, you just had the president and the minority leader on tv and they can't explain or deal with web sites that simply don't function. the thing to do is to postpone the mandate for individuals the way he has for businesses until next year until they get the thing fixed. in the meantime obamacare is pushing up costs for hiring because of the mandates and the health insurance policies, and as a consequence it slows hiring. it's another jobs killer. >> one other area that the president is hoping to fix in this country or these promise zones and getting

back to manufacturing. proposal to build national network of manufacturing innovation centers across the country. get america back to manufacturing. these jobs have gone overseas, peter. >> well, manufacturing centers are a great idea. they go back to the time of the reagan administration. the same thing with opportunity zones, those were reagan ideas. however, the real problem for american manufacturers are imports from china that are subsidized by cheap currency and mr. president doesn't do anything about it. and what's more he wants to negotiate new trade agreements that will make it even more difficult for our manufacturers to compete by opening up our markets to foreign manufacturers without getting us a fair deal on currency and subsidies and also getting us into their markets. you know, the best selling vehicle in china are buicks we can't make them in michigan and send them there simply because of the regulations and tariffs and other barriers. we can't get our competitive

other corroboration. anna. >> amanda knox refusing to accept her murder conviction as the final word. listen. >> i will never go willingly back to the place where i -- i'm going to fight this until the very end. >> well, an italian court sentenced her to 28 and a half years for the 2007 murder of her british roommate meredith kercher. what can she do to fight the conviction? and does she even stand a chance? here for fair and balanced debate is defense attorney jonna spilbore and attorney lisa. good morning, ladies. thanks for being with us. >> good morning. >> how long is this process even going to be? it sounds like hurry up and wait,. >> the fat lady definitely has not sung in the amanda knox case yet. the highest court in italy is going to decide whether or not to finalize this guilty verdict. once that happens, then they need to decide whether they want to ask for her

extradition. then, once that happens, she is going to get a chance to fight it in the united states if that's the case. >> lisa, they would have to appeal to the obama administration my understanding for this, would it be a good or bad idea for the obama administration to take her side? >> look. first much all, i have to get the supreme court in italy to affirm the conviction. they have already dismissed it once. i think there is a strong likelihood they could dismiss it again and avoid this whole extradition question. if it should come to the point that the italian government asks for extradition, the u.s. in italy have a very strong extradition policy. it's built on years of cases they have worked together. organized crime. we currently work with them with heroin trafficking. it would be difficult for the u.s. to look to italy and say we think that your laws are flawed and we don't believe that your judiciary made the right call. >> anna, i disagree with that. >> here is the thing though, johnna. this has been going on for years. i mean, meredith kercher, the poor girl died in 2007.

of course, her family wants justice some way, somehow. but i mean how many times is this going to go on? this is so foreign for us. we have double jeopardy here in the united states. >> that's part of the problem. when amanda was acquitted previously. that would have been game over in the united states. the fact that italy has this process where it's not game over is probably one of the reasons if italy asks for extradition we would be able to will he g-8 matily -- legitimately say no you know what. we don't believe she is guilty, i mean, our country is more interested in deporting justin bieber right now than we are in sending amanda box back to italy. there would be strong support. but i think honestly because it's such a public issue, right, the world is watching this case you have to look at the italian supreme court. one other time they dismissed the charges. right now they are going to look at this case all over

again. the prosecution had to come up with a new theory. the first theory this was a sex starved co-ed and ended in murder didn't fly. now they are coming up with there was hygiene problems between amanda knox and her roommate. dirty dishes. and then the second thing they have to prove is this d.n.a. evidence. it's the same d.n.a. evidence. the highest court already said we don't buy it the ghar evidence doesn't stand and that was one of the bases that they threw it out the first time. so i think in order to avoid these issues of public policy, and the question of extradition, which would be a sticky one, we strongly see this supreme court in italy dismiss this case once again. and then it goes away. >> for everyone? >> two to three years for extradition. jonna and lisa, thank you for your time today. >> ever wonder what tsa agents are really doing during the screening process. a former worker shocking inside secrets that will have you think twice next

elizabeth price foley. professor of constitutional law at florida international university. thanks a lot for joining us this morning. >> good morning. >> what is the president attempting to do unilaterally without congress? >> well, he is trying to do a lot of things unilaterally without congress. let me just say at the beginning, you know, a the lo of people say you know, president obama is only issuing so many number of executive orders and that's a lot less than his predecessors have. i have to say, you know, this is not about quantity. there are a lot of executive orders that are perfectly constitutional. this is about the quality of the executive orders and what exactly he is trying to do. >> let's start with obamacare delays. obamacare passes. throw and a half years ago, it's unpopular. the white house basically says to favored constituencies you are not subject to it for now. is that constitutional? >>. no absolutely not. there are several provisions of obamacare that was supposed to take effect on january 1, 2014. the employer mandate. certain limits on out-of-pocket caps and the

like. and with a stroke of a pen, president obama says oh, no, i think i will delay that for a year. but, you know, why one year? maybe another year the following year or five years. the interesting thing here is, you know, he is directly contravening a law that says these things are supposed to take effect on january 1, 2014. interestingly here too, the republicans in the house tried to get a one year delay of obamacare and part of it spending measure that went over to the presise the president didn't want to delay it at that time at least legislatively. he doesn't want to amend the laws in the normal ways through congress. he wants to change them himself unilaterally. >> extending benefits and penalties to the federal exchanges also unconstitutional, you think? >> absolutely unconstitutional. the law is crystal clear on this that the only people who qualify for the these tax credits are people who live in states that run their own obamacare exchanges. and it turns out that, you know, congress did that very

purposefully. they wanted it encourage states to run their exchanges. they didn't want to have to rely on some sort of monolithic healthcare.gov which is what we ended up with. when it turned out most of the states, 3 a of them decided not to run their state exchanges, president obama sort of got out his wand again and wrote an irs regulation that said anybody can now qualify for these tax credits even those who get their health insurance through the federal exchanges. again, a direct contravention of the written law. >> yes. and as part of his never ending pander to demographics he believes he needs for election, the election of democrats, he just flat out suspended immigration law for dreamers. people to whom the dream act applies. >> yeah. this is a really bad one because, you know, congress has been debating for a while comprehensive immigration reform. and whether or not we ought to be granting some sort of amnesty, especially to these young people who were brought to this country illegally and whether or not on the merits we should do

a program like the earned income tax credit or subsidize them 100% if you raise the minimum wage to $15 an hour and there is no opportunity there anymore. even presidents bill clinton first campaigned on earned income tax credit could it could lift people out of poverty more than a higher wage. that's why we have gone to policies like that over time. better and smarter way to boost people's earnings without effecting their jobs. >> it hasn't worked because obviously wages have not kept for people in the lower echelons have not kept pace with inflation. they haven't grown. and, the concern is that you are going to see social unrest, ultimately as a result of that. you don't have to be a liberal to be worried about that what do you think the answer is? >> well, i think my bigger concern is that the social unrest that occurs. we have had 20% youth unemployment now for more than five years. so i think my concern is we are sort of heading towards a western europe type situation where you have a permanent underclass of young adults who never got sort of first entry level

travis, great to he see you this morning as always, welcome back to the show. >> thank you, it's a pleasure. >> imauto always fascinated about where money in this country is moving, what states are seeing this distribution and let's start with texas today. because something interesting is happening down in texas. >> well, you know, as we have seen in the past, we can look at past performance of how people and their income have moved over 43 million americans in the last 18 years and by looking at irs figures, we can projected now from 2010 to 2014 who are the likely gainers this year. and texas shows up not surprisingly with project projected first alert forecast of gaining income from other states, $8.72 billion. >> where is this coming from? >> coming from states like right here. from new york. new york is projected for 2014 for the last three plus years to lose $15.6 billion in income. that's income leaving new york to places like florida which also is projected to have a lot of income. >> so another big windsor florida. how much income is florida

looking at? >> florida we're projecting that we are seeing over $22 billion from 2010 to 2014 headed into the sunshine state, a state that has no personal income tax like texas. a very different tax rate than a place like here in new york. >> so, some other big winners this year in your study are texas, north carolina, and arizona. walk us through these. >> that's right. north carolina has changed its trajectory in the last few years. just last year cutting marginal income tax rates. that was already on the positive trend. we are projecting that $6.8 billion will move in of all transfers to other -- from other states from 2010 to 2014. that's big news for north carolina. >> what did arizona do? same thing? >> arizona has relatively low taxes as well. if you are california and looking for a better place to live and work, many people next door choosing places like phoenix and he they are projecting that $6.5 billion income gain from other states. >> are you seeing businesses leaving california going to arizona.

we know they are going to nevada as well, right? >> that's right. we have seen california income as they have been raising taxes by the way california right behind new york. $9.7 billion projected loss through 2014 on irs figures. and that is in part because there is a big spread on the price of work. if you are california resident, a lot of people are choosing texas, nevada, and arizona. >> so we mentioned california is a big state loser. they lost $9.7 billion. that's incredible. illinois and michigan also big losers. >> that's right. illinois has in the last two years, during this economy, chosen to raise its price on work. corporate and personal income tax on the increase. and they were already past performance projecting that they have lost $29 billion other states, most that comes from chicago. so this is not good news. we are projecting a loss of $6.2 billion through 2014. michigan, also facing a lot of problems with detroit.

important is was it for you to be a mentor and be involved in this project? >> it was important to me because it hit home. you know, elijah was told he will never walk right in his life. at one point in my life when i was at the epitome of my college football game i was told i might never walk again. i might not live until the next season. when you face something like that, you kind of understand what he he goes through. and bullying was a big thing in elijah's life. every single thing he did. he said he wanted to go out on the field and play tag with everybody. he didn't want to because he was always it. he couldn't play kick ball and he couldn't play baseball. people got him down for that and picked on him. >> it's remarkable because as he talks about kids would make fun of his legs. realize that he had cerebral palsy. kids don't understand that maybe the way as adults. something that, of course, you were suffering from. and going through. and told you might never walk again, let alone play in the nfl. play football ever again. as an adult we can handle it

differently. >> right. and that's one of the things that you see in middle schools. and you see a little bit in high schools as well. kids look at other kids as just different. and they don't see that difference as a positive. they don't see that difference as a uniqueness. they see it as a difference as a fault. and as a flaw. and so, elijah told me he said, look, mark, there is always going to be a mean kid in life. and it's just all about being better than that mean kid. 12 years old. and his infinite wisdom, you know, testament to what he has kind of been through. and the trials he has been through. >> when you were diagnosed in college, were you treated differently? could you relate to elijah in that way? did you think this is it for me. i'm in college and been diagnosed with cancer. this is it for me. >> i was. not necessarily intentionally negatively. but i was looked at with pity. and i was looked at as a

cancer patient. rather than as mark herzlich. that was something that took a while for me to get used to. because it is the physical appearance that you notice right away. that's why it is so tough for elijah with his walking impairment because that's the first thing you notice when he gets out of a chair. and i remember how people looked and how people talked about me. that's why i told elijah i said look, you are not alone. there is many, many people with cerebral palsy going through the same thing as you. no one is you. you are one of a kind. you are different but just know you are not alone. >> what were some of the other themes charlie that emerged in this documentary from some of the other players and their stories. >> it's always the most surprising thing every year. we don't want to recycle the same stories over and over. every time we get stories like mark. j.j. watt blew me away. toughest biggest guy in the nfl and yet he was bull idea mercilessly as a kid for being too small. it really almost prevented him from ever playing football which would have been a travesty for us.

we brought you a story about a school in which some of the kids parents weren't fully current on their debit accounts for lunch. this is in salt lake city, and so the school not only denied those kids lunch, and in some cases their parents owed a total of $4, but threw away the lunches they picked up. >> how ridiculous was it that they actually got served lunches, were sitting the there, and school officials came up, took their trays of food in front of -- first of all, how do you expect kids to pay attention to school and learn when they're hungry the entire afternoon? it's a huge disservice to their ability to actually learn and understand the classes they'll have later in the day. the school said we understand the feeling of the upset parents and students who said this was an embarrassing and humiliating situation. we again apologize and commit to working with parents and students to ensure they are never treated like this again. >> kevin conway, a father of an 8-year-old kid at this school

who had to do without lunch and was given an orange and water in lieu of a tray full of food had this to say. he's outraged. >> you're a third grader and go into your lunchroom and it's packed with other third graders and you get in line with your friends, and you get your lunch and you go through your line and you get up to the counter where you pay and you give your lunch lady your card, and the lunch lady sees there's a negative balance and a representative from the district is there. and they pull the tray from my daughter in front of her friends, in front of her classmates, and tell her she can't eat lunch because i owed $4. >> he said he normally gets an alert when it gets down to $20. the alerts happened to not go out. he says, yes, i should have checked but come on. >> and $4 negative, an orange and a bottle of water. that's like what a bottle water and orange cost. $4. so that's what they're give ing her. >> is it really the worst things
