>> you are a loser. we'll talk about that later. i'm arthel neville, good to see you. >> tough crowd. i'm gregg jarrett. did you see the gridlock in times square? it's unbelievable with the horns honking and people cheering and the game is not even till tomorrow. look at that. you can't even move. police are certainly tightening security in the area ahead of tomorrow's big game. dozens of federal and local law enforcement agencies deployed to assist. there was a brief scare yesterday over a suspicious powder that somebody located in several hotels near the stadium. it was later found not to be toxic. today police are searching cars and monitoring the mass transit. our own rick len all this is live at metlife stadium. how does it look out there? >> warmer than days past. i thought that hand-off should have happened on monday and not today. it seemed premature. the weather is a story here.

they were predicting it might be the coldest super bowl in history. now it looks like it might be 42, 43 degrees at kick-off tomorrow evening. that's great news for the fans in the stadium. obviously security is a major concern. you mentioned the white powder scare. there was one today in midtown manhattan. nypd, new york firefighters and ems responding to the crown plaza hotel on broadway between 48th and 49th near the fox news channel headquarters. this was a false alarm. no injuries. something they had to respond to. similar situation yesterday. several hotels in new jersey near metlife stadium here. local police responding along with the new jersey state police, the fbi joint terrorism task force and hazmat because of letters with white powdery substance. the preliminary testing was it might have been corn starch. this is the kind of thing authority and law enforcement

have to respond to. it was a good dry run for the new jersey state police, according to major kevin fowler one of the men in charge out here. >> you keep going over your plans and you want to make sure they are tight. we think we've done that. a big component, a lot of the things we were worried about as far as the weather, how to do that with the troopers has been taken out of the equation. we are thankful. feels like miami compared to the last week. >> not quite miami weather but better than it was earlier this week. >> a balmy 45. does the security precautions, do they extend beyond just the fans? >> absolutely. they are checking every vehicle that comes near metlife stadium. they are also checking any delivery in vehicles coming to metlife stadium. there is an area down the road here where the u.s. customs and border protection is handling what it's calling nonintrusive vehicle inspections to make sure

no contraband or explosive materials make it inside the perimeter. they will fly over the stadium with blackhawk helicopters. new jersey national guard will have f-16s patrolling the skies over metlife for super bowl sunday and forcing restricted air space rules that will be in effect throughout the day. this is a level one security event. no one is getting near the stadium without tickets. you aren't going to get inside without being searched extensively. >> rick levinthal, thanks for the update. it's super bowl eve. fans may score big with mild weather at game time. that's just before another storm rolls in. meteorologist janice dean live in the fox extreme weather center. at this point we just care about the game. good weather for the folks out there? >> yes. however, we have a storm that is going to come in overnight

plan look like versus democratic immigration reform plan? >> sure. i think when you look at the republican principles that the house leadership rolled out this past week, clearly you know it is about providing some sort of legal status to the 11 million undocumented immigrants. first you have to have border security in place and also interior an enforcement which would be an e-verify system, for example. also where you are able to control the exit and entry of individuals coming to the country. the other point is that they do allow for the dreamers, for example, those children who came here and parents were illegal to have a path to citizenship. they are taking a common sense approach, a step by step approach that i believe is long overdue. i think speaker boehner is taking a positive and a very good role right now.

>> doug, is that similar to what the democrats have already been talking about? or is it something different? >> not at all. bottom line, we've got to give the 11 million undocumented a path to citizenship. not legal status. they're living here playing by the rules, paying taxes, they need to have a chance to be part of the american dream as citizens. bottom line, the republicans have a right wing, which mercedes knows all too well, that doesn't want to do anything. this legal status is an attempt to compromise. border security is a political sap to the right. bottom line what we need is a comprehensive plan, not step by step, and ultimately if the republicans don't do it, which they won't, it means they will be consigned to minority status for the foreseeable future. >> hang on, mercedes. let me pull up a fox news poll which is asking what should be done about illegal immigration?

68% say a pathway to citizenship. 15% say send everyone back from hence they came. 15% guest worker program. you see the people are saying pathway to citizenship is the popular approach. talk about the gop road map to achieve that goal, if you believe they agree, and how quickly might that happen? >> that is exactly the point. i think there is where the great divide lies. democrats want the path to citizenship. you have those -- the's a number of them in the republican party that would prefer to do it a step by step, the legal status first, then they are able to apply for a green card which then they are able to apply for citizenship. i think there is that difference that is the point where doug made an important point, which is compromise. this is a first time we are starting to see president obama saying he might be flexible on

this idea of the path to citizenship. however, that is different from what former speaker pelosi said where she is saying if there is no special path to citizenship for the 11 million, it's a no go. >>well, it is going to require compromise. and bottom line, we have to give people a path to citizenship. i think we have to move expeditiously on all phases of the issue, and bottom line, i'm skeptical in an election year, and i'm curious what mercedes thinks, that there will be any compromise, because bottom line, the republican party is divided between the establishment and tea party wing, and i don't think the tea party wants to do anything. i don't think they'll let the republican party do anything. >> it remains to be seen. doug, i have to leave it there because i'm short on time. doug and mercedes, thank you very much. >> thank you. >> an uproar in utah after young students at a public school have their lunches literally snatched away.

on that. first we begin with a major hurdle being crossed in the push for the keystone xl pipeline. a long exhaustive study finding no concerns with building that line to bring oil to the united states from canada. but the project is five years in the making and is still waiting for the green light from president obama to begin work. peter doocy is live with the latest. peter? >> crude oil in canada is going to be extracted, pipeline or no pipeline. which is part of the reason they find the construction of the pipeline that would take 830,000 barrels of crude oil a day out of canada isn't going to really contribute to climate change at all. >> this is one pipeline project. canada is certainly not going to be leaving the greatest valued

give final approval so we can put people to work in the good paying jobs right away. and our refineries in louisiana and texas can keep refining the energy from our friendly ally. the reporters say the pipeline xl will create thousands of construction jobs. the canadian ambassador to the u.s. said yesterday he thinks pipeline politics are going to play really big in upcoming midterm elections here in the state. >> and one thing is for sure, the canadas will pull the oil out of the ground, one way or another. doesn't matter if we build a pipeline. peter doocy, thank you very much. police in michigan are on the hunt for a gunman after a deadly shooting near the camp of the michigan state university. investigators describing the suspect as a black man in his 20s. two students were shot in their apartment complex.

one was treated and released from the hospital. the other was in critical condition and has now died from his injuries. police say the shooting does not appear to be a random act. a massive man hunt is under way in the state of colorado after a major bank robbery there. these two nicknamed the trash talking bandits. no, not the wet bandits or the sticky bandits. they're the trash talking bandits, targeting a suburb bank last week. donna is live in t-- dominic is live in the newsroom with the latest. >> the fbi doesn't know who the people are. we say people because although the initial suspicion is two men, if you take a look at the stills for the footage that we have, it could be actually a man and a woman. it appears possibly the man in the white jacket that you see there ft but then when you take a look at a picture of the other bandit wearing that sort of light gray, light blue sort of

jack jacket. well, perhaps it's a woman there. so potentially a man and a woman team doing this. it happened really fast. it took two minutes for them to get over the counter and into the cash vault and get away with what's been reported as at least 500,000. there we go. it could be because of the elevated sense of that jacket there. so up to about half a million dollars could have been taken. the policies never say how much is being taken. the trash bags gave them the trash talking bandits. but also the way they were dealing with people in the bank, very violent and abusive language. the fbi saying these people, well, maybe they actually learned their tactics somewhere. take a listen to this.

>> they are not the polite our courtesy bandits. there are new developments in the bridge scandal surrounding the office of new jersey governor chris christie. a port authority official who oversaw the lane closures at the george washington bridge claims evidence exists that proves governor christie knew exactly what was happening during the closures. david wildstein made the claim in a letter submitted through his lawyer. though he did not elaborate on what it have evidence might be. the scandal erupted last month when a chain f e-mails revealed that members of the christie administration purposely shut down several lanes of the gw bridge as part of an alleged political pay back scheme. governor christie has denied any involvement. more difficulty on the horizon for a fox news reporter who refused to reveal her confidential sources from the

report she did on the colorado movie massacre. she was cleared by a new york judge last year from having to reveal the name of the person who told her about a notebook containing violent images that belonged to the shooter. holmes is facing the death penalty, and hitz attorneys say the information about that notebook could sway the jury to have him committed at a mental institution instead. we turn overseas now where secretary of state john kerry and defense secretary hagel attending a conference in munich, discussing america's security challenges and a solution for peace between israelis and palestinians. secretary of state spent the

last nine months trying to draft an agreement between the palestinians. despite the lack of tangible progress and craftiness in the deal, kerry says he's optimistic a deal can be reached, at least a framework agreement by the end of april. it would address the core issues that have held up past negotiations. including borders, security, refugees and jewish settlements. after months of talks the israelis and palestinians remain apart and the impact on the security of israel. also the future of israeli settlements in the current territory. there's another issue holding up talks. while kerry remains optimistic, he has warned the status quo isn't an option, and that the future failure of a deal could lead to international boycotts of israel. now both israeli and palestinian publics have overwhelmingly

supported a peace agreement, according to polls taken in recent weeks and months. so far the politicians on both sides have really failed to make the type of negotiate d agreements that have to be reached. now, secretary kerry has warned in the coming weeks both sides are going to have to make some tough decides. shut will really dictates what happens in the long-term agreement coming forward. >> serious tug of war to come. thank you very much, conor powell. republicans are trying to come up with new ways the to repeal certain portions of obamacare, and one idea being floated around at this year's republican retreat in maryland, agree to raise the debt ceiling again, but only in exchange for

canceling the taxpayer bailout written into the affordable care act. >> we understand that people are hurting. we understand there needs to be a replacement that we need to fix in the health care system but not do it in way that puts government in charge. democrats have a majority in the senate. is this an idea to cancel bailout? or are at-risk democrats up for re-election in state where is the constituents don't really like the health care law, so maybe they might join some republicans to vote for the cancellation, assuming you can get harry reid to allow a vote. >> well, i think what will be used as leverage is the debt ceiling. the treasury secretary wants

action in february. and the republicans want something in exchange for raising the debt ceiling, which is at $17 trillion. eliminate the possibility of a federally funded bailout for health insurance industries in the health care industries. that's one way to undermine the affordable care act, km is what the republicans are aiming to do. >> republicans are mindful within the split of their own party over obamacare that led to the shutdown. it was not good for the gop. they have now passed two consecutive debt limit increases with no major policy changes. but they feel like this is different than funding the government, which is what we were dealing with in october. they think there's more momentum. that's why i think that this is

a possibility and because the democrats in the senate will want a vote to show that they're doing something about it. and the third factor is immigration reform. and in exchange they will fund them the health care insurance companies, that's another pass. even though it has nothing to do with it, it does not ease the way for the deal. if the so-called bailouts of the taxpayer funded reinsurances were canceled, i've heard predictions that some insurance companies would go belly up because they're so invested in this sort of thing. and you heard jim moran, a democratic congressman saying i

don't know how to fix this thing. only 10% of the previously uninsured bought into obamacare. not the young people. he said, i don't know how to fix it. >> well, it's important for viewers to know that the risk pools that we're talking about are one mechanism to keep health insurance premiums low. that will lead to premium increases. one way to avoid that tr the high risk companies that hay low the federal government to come in and help the insurance companies. if you take those away, it raises the question about what will happen to premiums. so democrats will not like the idea of it. they're going to try to resist it. you have to throw everything in the pot together. raising the debt ceiling. both democrats and republicans want to avoid anything that threatens the security of the united states economically. all that together may lead them to go along with the deal, despite the risks for premiums going up next year.

rutherford, new jersey. so the handoff to next year's host committee just happened, and of course, they're focusing on the security plans, right? >> absolutely ch and new jersey state police are in charge of securing the super bowl. and as part of that the new jersey state police visited the past three super bowl cities to observe how those cities prepare for their super bowl. it makes sense officials for the next three super bowl cities will come here to new jersey to see how new jersey is handling things. and that's what happened, glendale, arizona, houston had officials here touring the police public safety compound, which has been built in a secret location close to metlife stadium. ch they were checking out the video screens in there and the more than 180 agencies involved in helping keep the event secure.

at met life stadium, they only have 12,000 available for the super bowl tomorrow. that's one reason it's the first mass transit super bowl. some 15,000 people are expected to ride new jersey transit trains here to the stadium, which is a very convenient way to get here. tomorrow tsa will be conduct in searches to make sure no one is carrying explosives or weapons the through the stadium. you'll have to pass through screening and show them you have round trip train fare and you have to carry a super bowl ticket. they're encouraging people to allow extra time to get here because of the security precautions. >> i have a feeling everyone will cooperate and be patient because they want everyone to remain safe. >> let's hope so. >> thank you. >> sure. >> budweiser's famous super bowl ad is set to air tomorrow.

out. one of the keys is the money must be invested in the government-backed securitied. so you're really not going to get any growth. if you understand investing, any time you invest in government related bonds like this, inflation goes up and pushes the rate up. you're really losing the person power. i'm not a fan of this. put it that way. >> it's available if you don't have an ira and if your company doesn't offer a more traditional plan or 401(k) plan. right, ed? >> also. $191,000 if you make less than that, you can participate in this. yo you can participate with a 401(k) plan as well. anyone with a 401(k) plan, contribute to that. don't pay attention to this. we have a problem with e people retiring in the country. people do not have enough money to retire. this is not the answer to it. i don't know if a lot of thought went into how they put this together.

the italian judge says he agonized over the verdict but he and the jury agreed about the guilt in there and coming up with a motive that will be explained in the written explanation of the verdict, which is expected within three months. and it's a lawsuit against the team andmanning accusing him of creating bogus game worn football gear to pass off as the real deal, fooling fans and making money from collectors. the documents attached to the lawsuit saymanning took part in the scream so he cold hold on personally to each of these items. the qb denies any wrong doing saying the giants told me this suit is the completely without merit and i have no reason to believe otherwise.

the giants will fight it and so will i. both are defense attorneys and former prosecutors. all right. there's an alleged smoking gun here. and that is the e-mail between the memorabilia dealer who is the plaintiff in the lawsuit and joe, who is the equipment manager for the giant ls. let's put the e-mail on the screen. this is the smoking gun allegedly. hey, joe, he writes. my buddy was offered an eli gamed used helmet and jersey. are these the b.s. ones that eli asked you to make up because he didn't want to give up the real stuff? he says, bs 1, you are correct. how incriminating is that? >> not at all. that doesn't show that eli had knowledge. that's an e-mail from e eli manning. >> what about the equipment manager? the equipment manager may be

involved in this. we have to know who know what, what they knew and when they knew it. >> it's technically hearsay but it falls under exception, but that's only as to skiba. you would have to redakt the eli portion. >> and one is he has to prove the authenticity of the e-mail. how do we know if that's what the person really said? i do i think it's incriminating. >> what is he going to say? oh, i was just kidding. >> it's definitely red flags, very incriminating. >> there has to be a way to authenticate the real deal and the fake stuff. i mean, i think you can compare photos and video tape during game with what was supposed to be the game helmet, for example, the markings may be different. the jersey may be slightly different.

>> 100%. that's the first hurdle. are these fake items. the physical evidence. they have to prove that it's fake. now there are a lot of experts out there that will come to court and will authenticate the item or be able to testify that the item is fake. >> he alleges a whole bunch of claims. doesn't he have credibility from him? this is a guy who was indicted criminally at one point. the feds dismissed it. >> he will definitely have a credibility issue because of the indictment that he had. just because it was dismissed doesn't mean he was not guilty. that's not where they decided to let it go. >> he's got to take the witness stand in front of the jury as the plaintiff. so you can challenge his credibility with all kinds of stuff. this credibility will absolutely be challenged here.

a volcano in western indonesia unleashing a major eruption, killing at least 14 people. here's some of the videotape, coming just a day after thousands of residents who fled earlier eruptions returned home thinking it was okay. the victims include four stuptsz on a school trip to see the volcano up close. it's been spewing lava and rocks and gas for four months. super bowl xlviii, and this year's winter olympics in sochi, and security is, of course, a major concern. millions of your tax dollars going towards efforts to keep everyone safe. the fbi, cia and local law enforcement, and even the military all playing a role. steven yates is a former deputy assistant to vice president dick cheney for national security affairs. and we welcome you, te ven, how are you? >> great to be with you. >> steven, which event would you say is the more daunting, the super bowl or the sochi olympics

in terms of security? >> well, no major public event has a hundred percent security, but i'm much more comfortable with the approach likely to be taken in the greater new york area than with the sochi olympics. >> really? so you're a little more concerned about that? and if you are concerned about what's happening in terms of security there in russia, would you say the russian officials are cooperating with the u.s. when it comes to coordinating security efforts? >> yeah, control and cooperation are a big point in this. with the super bowl in the greater new york area, we have people who have tested and real-life experience protecting major events over multiple years since 9/11. with russia, there's really some mixed messages about how much our government and the russian authorities have been able to cooperate. so of course, russian sovereign territory, they consider it their job to keep security for the major event and they're committed to that. but we have some in our government, including the president, who seem confident that the russians understand the

stakes. but a lot of people say there's very limited cooperation between the russian authorities and other governments. so we don't know enough about the threat, and what will really be done in case there's an emergency. >> but the u.s. is preparing some security efforts there in russia, correct? >> well, we have some u.s. officials that say we'll have ships in the black sea offshore. that's, i suppose, a show of support and being prepared for contingencies. but it's very unclear what they might really be able to do if something should go wrong in the olympics, would the russians really be open to international intervention to help, or really try to do too much themselves perhaps. so openness cooperation from the outset i think limits what our forces can really do in a contingency. >> let's hope nothing major happens there. let's move on over to super bowl now. of course, we've got times square, like 13-block area blocked off, including super bowl boulevard.

as you say, there are live pictures right there, people are already cramming into the area. it's very festive, i have to say. but they're more used to these types of events. we see this place crowded for new year's eve, et cetera. of course, they have to take measures to protect folks for this particular event. and we're talking about 80,000 people going to metlife stadium. you have the open areas, stephen, around metlife stadium. how challenging are the open areas in terms of protecting the folks? >> well, challenge is significant, there's no getting around that. but we have a lot of resources going in to people who are using a lot of technology to analyze behavior, being pre-positioned in a number of different areas, anyone who's concerned about civil liberties and surveillance should not go into these kinds of areas because i think literally every square inch is going to be watched very, very carefully. there's, i think, less of a risk for active shooting type events, but there's going to be a lot of

concern about something like the boston bombing, a package that gets left behind and maybe gets ignored. security people are going to have to be vigilant. attendees veg lent and cooperative. but in general, in the greater new york area, there's a lot of people going to big events and doing their part for everyone's sake. >> very good. you've got folks going over there by train, by subway, cars, private and public. but you feel overall, you would say that you're feeling pretty good in terms of security regarding the super bowl? >> i don't think anyone in charge of security ever sort of relaxes until the event is over. and that's appropriate. i'm sure they're going to be watching every angle of access to the event. but we -- i think we have a finite geography and finite period of time with significant resources going at it. my hope is everyone enjoys the game. >> enjoy the game yourself, stephen yates. thank you so much. that's going to do it for us. we're back at 6:00 p.m. eastern
