fact? and new developments tonight on the shocking death of a hollywood great. >> go [ bleep ] yourself you [ bleep ] child. >> what the cops are saying about philip seymour hoffman on "the kelly file" right now. >> and new political fallout from the just released clips of the bill o'reilly interview of president obama. welcome to "the kelly file," everyone. if you have been watching fox news tonight, you know o'reilly and the president covered a lot of ground in the interview but there was one message that seemed to come up repeatedly. >> look you can't make that accusation without telling me. >> we just went through an interview in which you asked about health care, i.r.s., were we wholly corrupt, benghazi. so the list of issues that you

talk about -- >> but these are viable questions. >> but they're defined by you guys in a certain way. regardless of whether it's fair or not, it has made fox news very successful. >> that was president obama. and look at this from hillary clinton. quote, it so much more fun to watch fox when it's someone else being blitzed and sacked." so both the president and hillary clinton deciding to take shots at fox news on super bowl sunday. and then the president's top campaign guy sends out some tweet bashing the gop. and i ask you whether this is all -- what a coincidence that they would all come out and decide -- whom ever could they be trying to rally, mark? >> maybe their liberal base. hillary clinton is much more used to going on television than having people block and tackle for her than she is getting blitzed. fox news is the only one asking

these questions. i find it amazing the president of the united states, how he defines unfair, you asked about benghazi, about the i.r.s., about obamacare. no one else challenges him on these things. he's trying to rally his liberal base. there's a gallup poll that shows that support from liberals is at the lowest point in his presidency. 62% compared to 92% when he came into office. he blew the rollout of the biggest new government program in a generation. they're frustrated with him because of that. for the next generation, any time anyone proposes a big program, all they have to say is it's another obamacare. they know the consequences. picking a fight with fox news is a great way to distract them.

>> is it beneath the president, beneath hillary clinton -- the hillary clinton thing is amusin back in 2008 when she was running in president, name another network that gave her a fair shot. it was to the point where her campaign manager came on fox news and said "god bless fox news, you really are fair and balanced." and now she's, oh, it's so nice to see somebody else getting sacked and pushed around on fox. oh, poor hillary. >> that's before she presided over the benghazi debacle. fox news is the only one who has stayed on this story, has not let go of it. everyone else in the country moved on. the questions haven't been answered, they're legitimate questions and fox is the only one pushing. >> it's so aggravating to have these questions persist about benghazi, about the i.r.s.

it not like only fox covers the i.r.s. scandal and so on. does that make them, what, go to the polls and vote for democrats in the 2014 mid term? >> i think it's a very feeble attempt to restore liberals. they have to start somewhere. when you're the president of the united states and your base only gives you 62% support, you need your base support to be in the 80s and 90s. when you're at 62% among self-described liberals, you're in real, real deep trouble. >> so your solution is to give an interview to bill o'reilly and try to challenge bill? >> you know, they're struggling over there is all i can say. they're looking for ways to rally the base. if you want to change the subject, move on from all these topics and attack you guys. >> if he was looking to fluster

mr. o, he failed. >> he was pretty tough on us, too. i was in the bush administration on a lot of the receiving of o'reilly barbs. >> we were number one under george bush as well. the president may have challenged fox news but he created his own controversy last night when he challenged bill about the facts behind the terror attack in benghazi that killed four americans. listen. >> at the moment, when these things happened, bill, on the other side of the world, people doesn't know at the very moment exactly why something like this happens. and when you look at the videotape of this whole thing unfolding, this is not some systemic, well-organized process. you see -- >> it was heavy weapons coming in. >> bill, listen. i've gone through this and we have had multiple hearings on it.

>> someone who has also gone through it and has been reporting on this -- i'll get to you in a minute. president obama said within a week we were calling this a terror attack. you were the one saying the story is falling apart, there was no protest. day by day the information came out. that is only one of the ways in which he wasn't exactly straight on with bill last night. >> we were first to report here at fox news one day after susan rice's appearance that there were no demonstrations outside that embassy. this senate report also reveals what was known by susan rice. the agency received a critical e-mail reporting that the tacks were "not/not an escalation of

protests." it was from the most senior intelligence officer who was on the ground. >> the way the agency works, he's been running 24 hours a day to nail every fact. and now he's reaching out four days into this e-mail directly to the most senior levels of his organization saying again with a big red crayon as clearly as he can there were no protests. >> well, the senate report does not explain when morel read the e-mail. the word "islamic" was cut but "demonstration" stayed in. two days later the cia and fbi reviewed closed circuit tv video from the consulate that showed no protests. two months later in november 2012 at the height of the talking points controversy, susan met with senators mccain,

ayotte and graham. morrell talked with rice. >> what i found curious is he did not take responsibility for changing the talking points. he told me the fbi had done this. i called the fbi. they went ballistic. within 24 hours himself statement was changed where he admitted the cia had done it. >> since leaving, morrell has joined beacon global strategies. he reported his interests in advising future presidential campaigns. morell decline an offer to speak to us on camera about that report. >> senators also picked up on the president's remark and one,

james inhofe, did not hold back. >> that's going to go down in history as the greatest coverup. i'm talking compared to the pentagon papers, iran-contra, watergate and the rest of them. this was a coverup in order for people right before the election that there was no longer a problem with terrorism in the middle east. >> joining me now south carolina republican and member of the oversight committee trey gowdy. congressman gowdy, great to see you tonight. the president basically told bill on the subject of benghazi that, look, people just doesn't know at the very moment exactly why something like this is happening and it wasn't some systemic, well-organized process. those were his reasons it seems for not being more direct about the fact that this was a terrorist attack. >> then he needs to read the

e-mails from the state department because on september the 12th, less than 12 hours after the siege ended, they said we know who do it. his own state department knew within six hours of the siege ending this was a terrorist attack. i would encourage him to spend more time with secretary clinton. by the way, cheryl mills was copied on that e-mail and so was patrick kennedy. >> he said there may have been some bad guys and people taking advantage of the moment and so forth and didn't speak to how they knew where to find ambassador stevens, they used military hand signals to communicate with each other. it was mostly these guys who got to the and decided to cause havoc is not exactly dead on. let me ask you about the

president's suggestion that this scandal, benghazi, is being kept alive by fox news. the only people think it is a scandal is because we at fox news have decided to make them believe that. >> mi can tell you this, there are four murdered americans and i am asked about benghazi more than any other issue. that is true in south carolina, that is true in texas. >> that's because your viewers may watch fox news. taking the president's logic a step further, he'd say your people must be watching fox. >> it's about who we are as a country that four of our fellow citizens were murdered, that we weren't prepared to provide for their security, we didn't go help during the siege and then susan rice lied about it on television. >> and it was said there's not a

smidgen of evidence that there is corruption at the i.r.s. and here's -- do we have carney as well? all right, watch. >> so you're saying there's no corruption there at all? >> that's not what i'm saying. >> you're the leading of the country. you're saying no corruption? >> no. there was some bonehead decisions out -- >> but no mass corruption? >> not even a smidgen of corruption. >> did the president misspeak? >> no, he didn't. i have about 20 of news organizations that cite the variety of way that was established, including by the independent i.g., who testified in may. as his report said that he found no evidence that anyone outside of the i.r.s. had any involvement. >> isn't there an active justice department investigation into the matter? doesn't the president prejudge that investigation? >> obviously we do not interfere with justice department investigations. >> your thoughts on that. >> well, my thoughts are that

two days ago we got a letter from the department of justice, from the congressman of ohio saying he can't send a prosecutor to update us on the i.r.s. scandal because it is, quote, under investigation, it's an ongoing investigation. in fact, megyn, in a one-page letter, seven times the department of justice said it's an ongoing investigation. if it's ongoing, how does the president know there was no criminal conduct and who briefed him on it? all the more reason for to us have a special prosecutor who is immune from any pressure that the white house might put on him or her. >> is there some potential problem in the boss projecting to those conducting the investigation that he knows exactly how it going to come out? >> i think that the president said with a lot of certainty -- he certainly acts as if this thing is dead. the wall street journal has reported it is dead.

i can tell you the people i work for and the other states i travel to, this is a big deal when government targets you based on your political beliefs. but to say there's not a smidgen of evidence when the investigation is ongoing. >> he fired the head of the i.r.s. there's a criminal probe open and lois lerner took the fifth. >> on questions about the failed healthcare.gov, here's the answer. >> we decided how we're going to fix it, it got fixed in a month and a half, it's up and running and working the way it's supposed to and we've signed up 3 million people. >> not so fast.

t"the washington post" article says that health care.government can't handle appeals of enrollment errors. robert, it gogood to see you. >> good to be with you. >> so it's not working well. >> quite to the contrary. i'm not going to excuse the web site as failures in the beginning, nor will i rationalize why it wasn't up and running. it's important to put it in the context factually. the 20,000 in the appeal process represent less than 1% than all of those working with the obamacare web site. >> what about the site that collects payments is not working either. >> until it's up and running,

each individual is being contacted by e-mail and phone and most doesn't have to go through the appeal process. >> he's saying the web site is working as it should. is that how it should? >> any web site that has a margin of error of less than 1% is doing good. but the american people are smart. anyone who has been on a web site for banking or to buy something knows that web sites have interruption of services. >> they're smart and they know when they're being sold a bag of you know what. the president claimed we have 6 million people signed up in medicaid thanks to obamacare. that's not true, robert. "the washington post" fact checker came out, gave that three pinocchios and said people need to stop saying that because it's not true. how does the president go out there and say that? >> i'm not the president's spoke person. the facts speak for themselves. 3 million have enrolled through state and federal exchanges and

over 6.3 million are now eligible either for medicaid or children's health insurance protection. >> you're dodging. he said 6 million are on medicaid thanks to the laws. that's not true. we can put up the fact checker from the "washington post." >> glen kessel also pointed out in 20149 million more will be added to medicaid. >> you're dodging. >> let me answer the question. whether it's 3.8 or 6.3, what's plan b? return to the old system? >> the truth doesn't matter. the only truth that matters is what it would be if we didn't have this system. robert, i got to run but it's fun talking to you. >> we are tracking the president's recent vow to act without congress. senator grassley asking for legal justice for where the president gets some of the power he claims he's has. paul ryan accusing the president of breaking the rules.

>> we have a lawless presidency where he's doing the job of congress. presidents don't write laws, congress does. when he does things like he did in health care, delaying mandates that the law said was supposed to occur when they were supposed to occur, that's not his job. >> our fox news senior judicial analyst has written about this issue extensively. they complain but they're not going to do anything about it. >> i wish everybody in congress had the attitude that paul ryan does. there are good executive orders and bad executive orders. the president is the head of the executive branch. there are 3 million people who work there. when he issues an order that tells you how he wants a law enforced and it's within the law, that's a good order. but when he writes it so that it

frustrates congress, that's going outside of congress. >> what are they going to do with the memo of the d.o.j. giving him a legal end around? >> they will never get those memos. they are afraid that they are without the type of authority that the president claims he has. this d.o.j. has gone to federal judges and refused to reveal memoranda of legal authorities based on public law as to the president's decision with respect to drones, for example. how could you claim that your legal reasons is secret? i can understand keeping certain facts secret but you can't keep legal reasoning secret. that's what these guys are doing and that's what has frustrated and upset senator grassley. >> the "new york times" now doing serious back pedaling on

march, more than two decades after anita hill's testimony at justice clarence's hearings. >> and she's covered subjects from jimmy stewart to rose kennedy. she began this film about anita hill some four years ago, before the 20th anniversary of the judiciary hearing. she began saying we the american public really only saw her in that blue dress for nine hours and i think there was a lot of misunderstanding 20 years ago. now to be clear, this documentary, as she calls it, is told from anita hill's point of view. it does not tell clarence thomas's view of events. in an interview she was asked if she had a story in mind before she started the project or if she would let it unfold.

breaking tonight. 72 hours after a misleading report slamming republican white house hopeful governor chris christie, the "new york times" now admits it erred in its initial reporting on this story. on friday david wildstein, who once worked for the christie camp, claims contrary to governor christie, he may have had knowledge of the lane closures at the time they were happening. the time fired out this article "christie knew of the lane closings as they happened, ex-ally suggested." here's how we reported it. evidence suggests tying him to

having knowledge. what does that mean? he knew? is what that you mean? they want him to say he knew. that's not what the letter says. since then the times has changed their reporting and failed to point out to the people that it was changing their stories. joining me, gentlemen, i read the thing on friday -- this is a qualifier -- if you read the letter, the lawyer speaks in short declarative sentences until he gets in that part and then he has always sorts of flowery language to sky what christie knew or didn't know.

the times made a mistake here. >> here's the problem. the statement that you know evidence exists is not the same as you have evidence. if you have evidence exists that there is life on mars, that's different. the times messed it up because they're out to get chris christie. it's going to in the end benefit chris christie, because all of people, like me, are not super fond of chris christie, it's going end up -- >> once the sheer sloppiness was end to down, there was no clarification, no correction, no editor's note. readers had no way of knowing the headline and the lead were misleading. the paper wasn't straight with its readers.

it did do one thing right i have to say in publishing the storylistory online, it posted the letter so we could come to our own conclusions. >> that's exactly right. i read the times headline like everyone else and say whoa and then i clicked on the actual lawyer's letter and i took back my whoa. saying he knew and he has proof is much different than saying evidence exists tying mr. christie to having knowledge. that's a totally different message, ben. >> it absolutely is a totally different message. my biggest critique of the media in the chris christie scandal is not even their ability and attempt to go after chris christie. i wish they were this hard on barack obama. i like that the media is this rabid. i wish they weren't getting things wrong. if the media were this rabid

with regard to all of our leaders, i think we'd be a better country. if this sort of thing had come out about barack obama, an update would have been listed by the "new york times" and a lot of excuses. >> after the times had that report that afternoon, the letter was there for all to see, all had you to do was click on it, they were wall to wall and they were wall to wall on cnn and they had lawyers analyzing this. they reacted as though the report was christie knew, he was in on it, he planned the whole thing from the beginning, he and brigette ann kelly are like this. >> and they were saying if this is true, christie would have to resign. i do have to say for david wildstein, who was a member of christie's inner circle, to him

publicly through that letter turn on christie is a potentially important story that should be covered. it didn't need to be hyped. chris christie used to be the media's favorite republican. they liked his brash style, his personality, in your face, jersey shore, more moderate brand of republicanism. now the blood is in the water, everybody is piling on. i think this set the tone for a lot of the media overreaction. now there's been almost like a stock market correction, a pullback. >> and chris christie loved the left-leaning media. he was on msnbc, always gave you interviews. >> he sent out letters attacking the "new york times," which is good politics, blame the messenger, plays to his base. ultimately he's either going to be proven right, that he was telling the truth at the two-hour press conference or not. >> the one thing that jumped out

at me about chris christie's response was him talking about the social studies teacher not thinking he was an ethical teacher. can you imagine? you must feel like you're on good ground when you start talking about what your high school teachers were saying about you. >> more information on the death of philip seymour hoffman. we're learning more about the investigation in the hours before his death and the possible charges that could be filed. that's next. mine was earned in korea in 1953.

women will always be problems for guys like us. >> great scene from "almost famous." new developments in the tragic, premature death of philip seymour hoffman. police confirm there was heroin in at least some of the dozens of plastic pacts found in the actor's new york city apartment where he apparently overdosed over the weekend. investigators want to know who sold it to him. trace gallagher is live with the latest. >> reporter: police are now focusing on the last 24 hours of philip seymour hoffman's last 24 hours of life. we know he went to a market near his apartment to buy soda and tissue. the clerk said he looked gray and disheveled. the store does not have

surveillance cameras. a witness told police he saw hoffman at 8:00 withdrawing a large amount of cash to an atm and gave the cash to two men in exchange for something. the men who came in contact with hoffman could be facing more than drug charges. 15 hours later he was found dead in his apartment, a needle in his apartment, several more scattered around, they found 50 small bags of heroin, some used, some not, along with several bottles of prescription medication. now they're investigating whether the heroin was mixed with a pain medication used for cancer patients. that combination makes the heroin at least ten times more powerful and has been connected to at least a hundred deaths around the country. the reason police went to philip seymour hoffman's house in the first place was because he

failed to pick up his three children, as he planned. >> thank you. joining me with more of ton's power panel, jamie weinstein, the senior editor at "the daily caller" and julie, a fox news contributor. now there is some discussion about whether anybody could potentially be charged. i mean, the heroin dealer? they say some of these packages were stamped with the ace of hearts, others the ace of spades. they believe there may have been a bad batch going around. not that there could be a good batch of heroin. what do you have make of it, jamie? >> it's pretty stunning. he said 50 bags of heroin were found in his apartment. i've seen the reports now as high as 70. we didn't know very much about philip seymour hoffman's personal life. we knew a lot about him as an

actor. like a lot of stars, he didn't seek to reveal himself. we heard about the rehab, we thought everybody was behind him. all of a sudden on super bowl sunday we get hit with this news. not only the fans are stunned but people in hollywood who knew him are pretty stunned as well. >> it seems like there is an attitude of look the other way when it comes to substance abuse in many industries, julie, and hollywood is one of them. i mean, they're artists, they do what they need to do to find their inspiration. he was supposedly 23 years sober and this was a relapse. just the other day ben affleck sent out a message saying he can't stand to watch a republican actor on tv becau because it ruins the suspension of disbelief for him. what about something like this? >> anywhere in new york city you go to parties, there's cocaine on the table, there's all sorts of drugs around. i've seen it, anybody who lives

in new york has seen it. i think if you're a recovering addi addict, after 23 years of sobriety, who was still an addict, you can't have one sip of wine and you relapse right away, that's the tragedy, when it's so plentiful and available, the fact that you can have people deliver drugs to your house. >> a lot of people believe if you're a celebrity you have no problems. >> clearly you do. i think there is a tendency to look the other way and when it comes to a sensitive subject like addiction, you don't want to press too much because it comes off as being pushy and this is a medical problem. i think people have a hesitancy, particularly with adults, to not overstep a bounds in someone's personal life. >> it sounded like he off the wagon for a while prior to his death. it's not inappropriate, it love. we'll be right back with our power panel on these new claims
